Duas das principais controvérsias que têm ocupado aqueles que se dedicam à teoria aris- totélica do movimento animal são a controvérsia acerca da forma da cognição através da qual um animal irracional apreende um objeto como um objeto de desejo e a controvérsia acerca da função desempenhada pela cognição na explicação aristotélica dos movimentos voluntários de locomoção animal. Neste artigo, eu apresento uma teoria acerca das formas como o desejo e a cognição se articulam na teoria aristotélica segundo a qual (...) um animal irracional apreende um objeto como um objeto de desejo através da percepção incidental deste objeto e, ao contrário do que a maioria parece acreditar, esta percepção não tem sempre a mesma função na produção destes movimentos. Se o que for dito aqui estiver correto, em alguns casos esta percepção é responsável tanto pela geração do desejo quan- to pela sua orientação, mas em outros ela é responsável apenas pela sua orientação. In this article, I use the expanded hohfeldian model presented by Wenar to argue that, according to Aristotle's theory of friendship, every bond of friendship that is based on utility or virtue creates duties and hohfeldian incidents between those who are friends. In section 1, I provide a quick presentation of Hohfeld's work and of Wenar's hohfeldian model. In section 2, I present my thesis about the creation of certain hohfeldian incidents and certain duties in virtue and utility friendships as (...) conceived by Aristotle. In section 3, I give a broad characterization of Aristotle's theory of friendship and of the three great kinds of friendship that he recognizes. In section 4, I defend the thesis that it is only in virtue and utility friendships that duties are created. In section 5, I specify what are the hohfeldian incidents created by these two kinds of friendship. In section 6, I specify the two ways in which, according to Aristotle, these incidents and duties might be created. In section 7, I conclude with a brief recapitulation of the argument. En este artículo utilizo el modelo hohfeldiano extendido, presentado por Wenar, para argumentar que, según la teoría de la amistad de Aristóteles, todo lazo de amistad basado en la utilidad o la virtud crea deberes e incidentes hohfeldianos entre aquellos que son amigos. En la sección 1 proporciono una presentación rápida de la obra de Hohfeld y del modelo hohfeldiano de Wenar. En la sección 2 presento mi tesis sobre la creación de ciertos incidentes hohfeldianos y ciertos deberes en las amistades basadas en la virtud y la utilidad tal como fueron concebidos por Aristóteles. En la sección 3 ofrezco una caracterización general de la teoría de la amistad de Aristóteles y de los tres grandes tipos de amistad que reconoce. En la sección 4 defiendo la tesis de que los deberes se crean solamente en las amistades basadas en la virtud y la utilidad. En la sección 5 especifico cuáles son los incidentes hohfeldianos creados por estos dos tipos de amistad. En la sección 6 especifico las dos maneras en que, según Aristóteles, podrían crearse estos incidentes y deberes. En la sección 7 concluyo con una breve recapitulación de la argumentación. (shrink)

Este artigo tem quatro objetivos. O primeiro deles é mostrar que dois debates contemporâneos de grande importância para a filosofia política aristotélica – a saber, o debate acerca do laço que liga ou deve ligar os cidadãos de uma comunidade política e o debate acerca da importância da participação política no que diz respeito ao alcance da felicidade – devem ser compreendidos em conjunto com o movimento hermenêutico que chamamos hoje de biological turn. Como veremos, a maneira como respondemos a (...) essas duas questões influencia ainda uma terceira, a saber, a questão acerca da importância e da função da lei para a comunidade política tal como pensada por Aristóteles. O segundo objetivo é resumir os principais argumentos apresentados nos ditos debates apontando sua pertinência e as suas falhas. O terceiro objetivo é ressaltar um ponto de considerável importância para ambos os debates que não recebeu a devida atenção por parte dos comentadores. Sendo impossível alcançar uma resposta definitiva a respeito das duas questões no espaço que temos aqui, o último objetivo do presente artigo é indicar um possível caminho para futuras investigações. Wesley Newcomb Hohfeld was an American jurist who published a series of articles between 1909 and 1917 that were very important for 20th century analytical philosophy of right. In these articles, Hohfeld analyzed how jurists and judges alike use the word ‘right’ to speak of the rights of groups and individuals. Since he presented his articles, it has been commonplace among ‘hohfeldian specialists’ to distinguish rights into four groups: privileges, or claims, powers and immunities. This paper has four sections. In (...) section I, I present Hohfeld’s notion of privilege and point to a difficulty that has long been known by specialists, namely, that there are actually two significantly different legal relations that this notion is supposed to cover. In section II, I analyze and criticize the way proposes we should define these two legal relations. In section III, I do the same with suggestion proposed by. This article offers a new formulation of the Socratic principle known as the Principle of the Sovereignty of Virtue. It is divided in three sections. In the first section I criticize Vlastos’ formulation of the PSV. In the second section I present the weighing model of practical deliberation, introduce the concepts of reason for action, simple reason, sufficient reason and conclusive reason that were offered by Thomas Scanlon in Being realistic about reasons, and then I adapt these concepts so as (...) to render them apt to be used in the formulation I intend to offer. In the third section I present my formulation of the PSV using the concepts introduced in the second section and explain why I believe this formulation is better than the one offered by Vlastos. In this article, I present an interpretation of Aristotle’s thought regarding the normative value of friendship duties.The argument is divided in VII sections. In Section I, I provide brief summaries of the main arguments defended by me in a previous article about the normative consequences of virtue and utility friendships in Aristotle, the objectives that are to be defended in this article and of the conclusions that I take them to support. In section II, I offer an interpretation of Aristotle’s (...) thought regarding the normative value of friendship duties in cases where there is no practical conflict between friendship duties. In section III, I outline Aristotle’s theory about how we should deal with cases where there is such practical conflict. In the next sections, I analyze three other passages of the Aristotelian corpus where we have good reason to think that this kind of conflict appears, namely, NE, III 1, 1110a20-29 (IV), Pol., III 10, 1286b23-28 (V) and Pol., VII 9, 1330a9-25 (VI), in order to flesh out the outline presented in section III. Promovendo uma releitura de _L’aperto: l’uomo e l’animale_ de Giorgio Agamben, o presente artigo tem a dupla intenção de expor a máquina antropológica que opera clássica e modernamente a antropogênese e de apresentar aspectos da filosofia indígena que orientam a relação entre o homem e o animal, bem como entre o humano e animalidade, em contraste. Arriscamos empregar a expressão _filosofia indígena_, conscientes de que ela pode ser mal recebida, embora tenha o texto uma implícita defesa dessa possibilidade. Entre os (...) interlocutores indígenas, visitamos Gersem Baniwa, Daniel Munduruku e Davi Kopenawa, entre outros. Se o contemporâneo está absolutamente presente e cativa a nossa atenção com as luzes e obscuridades, nada pode ser mais contemporâneo do que o esforço de ampliar os nossos horizontes epistemológicos. As linhas que se seguem são dedicadas à análise de um dos romances mais conhecidos de Franz Kafka: O castelo. Nosso fio condutor será o esforço de interpretação que Giorgio Agamben tributa ao romance em seu Nudità, publicado em 2009. Serão três os momentos do texto: antes de escutarmos o filósofo italiano, um capítulo introduz a discussão pelo viés da questão dos símbolos e dos gestos. O segundo explora então a tese de Agamben confrontando-a com outras leituras. O terceiro enfrenta (...) o inevitável tema da burocracia, presente como um coração pulsante em toda a obra. As considerações finais querem não só recuperar parte do que foi dito mas oferecer os contornos de uma concepção de mundo que arrisca ainda, contra todas as previsões, confiar na ação humana. Em um âmbito mais geral, pretendemos contribuir para a compreensão do modo de recepção da obra do autor checo na recente produção do filósofo italiano, expondo o grau de relevância e a particularidade de sua interpretação, bem como investigar em que medida a obra do primeiro pode ser utilizada como campo de experimentações para as hipóteses filosóficas do segundo. Com o escopo de revisitar a relação entre biopolítica e direitos humanos, as linhas que se seguem se dedicam ao diálogo que Giorgio Agamben estabelece com Hannah Arendt. The origens of totalitarianism e The human condition, publicados respectivamente em 1951 e 1958, e Homo sacer: il potere sovrano e la nuda vita e Mezzi senza fine: note sulla politica, publicados em 1995 e 1996, serão as referências mais proeminentes. O diálogo será, todavia, orientado pelo cortejo da ajuda humanitária. Devemos levar (...) a sério as hipóteses do filósofo italiano a esse respeito. Por um lado, o humanitário surge no nosso século purificado de todo comprometimento político, contribuindo para consolidar a compreensão da vida como mera vida, vida biológica, simples fato de ser vivente. Por outro lado, aferrando-se contraditoriamente na visão da “vida nua” como aquela desprovida de direitos, podemos observar que a ajuda humanitária substitui o reconhecimento, a atribuição e a garantia de direitos. A distribuição de cestas básicas e remédios adia sempre mais o gesto de reconhecimento da igualdade, a justa atribuição de direitos e a garantia de oportunidades para o exercício de direitos, levando-nos ao ponto de não mais evitar as suspeitas deque uma secreta solidariedade,celebrada entre os organismos internacionais de ajuda humanitária e as forças que deveriam combater, embala os sonhos contemporâneos. This work aims to examine the concept of inoperosità proposed by Giorgio Agamben – in the last phases of his project entitled Homo Sacer – and pointed as a possible vehicle of evasion of the diagnosis of sovereign power and bare life’s hypertrophy. Proceeding to the reading and analysis of Il regno e la gloria, published in 2007, and Nudità, published in 2009, the text that follows might not only reclaim the genesis of the concept but it might also try (...) to demonstrate how the concept arises to those that dedicate themselves to the task of thinking contemporary politics, without leaving behind the question about its pervasion force. In this context it is also important to investigate how the notion of inoperosity may be conceptually absorbed as well as to study the appropriated ways to disarticulate the dispositives of power – which are operative principles both to the relation between law and violence, as the relation between culture and knowledge. Em um ambiente onde as razões de segurança roubaram o lugar da razão de Estado, uma vez que não se questiona mais se é o Estado necessário ou não, e não está mais em jogo se o Estado pode lançar mão de todas as suas potencialidades para conservar a sua própria existência, estabelecemos as considerações que se seguem. Como sublinha o filósofo italiano Giorgio Agamben, nossa principal referência teórica no presente artigo, estamos diante de um processo em curso que faz (...) as democracias ocidentais se desenvolverem no sentido de algo que se deve, desde já, chamar de Estado de Segurança, com o avultamento de três aspectos bem reconhecíveis: a produção e manutenção de um clima generalizado de medo, a despolitização dos cidadãos por todos os meios possíveis, a liquefação da certeza e da efetividade da lei, ou melhor, a orientação consciente para um estado de relativização ou indeterminação jurídica. Temperado no horizonte biopolítico, com dispositivos de captura disseminados lá onde nem conseguimos mais distinguir com nitidez, o Estado Securitário fará da segurança e da necessidade de se garanti-la o seu embaixador maior, produzindo, contudo, contraditoriamente, sempre mais insegurança. Gostaríamos de, nas linhas que se seguem, explorar particularmente o último aspecto do denominado Estado Securitário, qual seja, a orientação consciente para um estado de relativização ou indeterminação jurídica, situando-o na realidade jurisprudencial brasileira, sob o recorte ilustrativo de algumas decisões do Supremo Tribunal Federal. Em outras palavras, busca-se analisar de que modo o argumento da segurança é mobilizado pela instituição para fundamentar as suas decisões. (shrink)

We aimed to characterize the age of onset of training, age at menarche, menstrual periodicity, and performance perception during the menstrual cycle and examined the impact of these reproductive variables on body composition, morphology, and body weight satisfaction in Brazilian elite futsal players. The study consisted of 115 female Brazilian elite futsal players from the top national teams. Data were collected during the twentieth Women’s Brazil Futsal Cup. Players were interviewed and self-reported their age of onset of training, age at (...) menarche, menstrual periodicity, and the menstrual period, where they performed best. We also asked for what they considered to be their ideal body weight as well as information related to their training. Subsequently, anthropometric measurements were performed to estimate the body composition and determine morphological characteristics. Fifty-nine players were postmenarche-trained and 52 were premenarche-trained. Eighteen, 65, and 28 were classified as early, normal, and late menarche, respectively. Only 11 and 1 had irregular menstrual cycles and were amenorrheic, respectively. Seventy-three, 23, and 9 reported that their game performance was the best at the follicular phase, menses, and luteal phase of the menstrual cycle, respectively. No associations between the four reproductive-related variables were found. Postmenarche-trained players had significant lower age at menarche and higher percentage body fat. The somatotype profile registered lower ectomorphy rate for the postmenarche-trained participants after controlling for covariates. Early menarche group presented higher sum of six skinfold thickness and endomorphy rate compared to normal and late menarche groups. No differences were found when menstrual periodicity groups and best performance groups were compared, except for higher femur width in the regular menstrual cycle group compared to the irregular one. The association between body weight satisfaction and the four reproductive-related variables were not observed. Premenarche-trained Brazilian elite futsal players had the menarche later than the postmenarche-trained athletes. Most of the participants had menarche age classified as “normal,” presented “regular” menstrual cycles and perceived to perform better during the follicular phase of the menstrual cycle. (shrink)

ABSTRACT The following review presents some of the themes developed in Evolving Enactivism - basic minds meet content. Hutto and Myin's new book on the Radical Enactive approach to Cognition aims to provide a thoroughy naturalistic explanation for cognitive phenomena. The main themes investigated here concern Hutto and Myin's criticisms of the nature and role that the notion of content traditionally plays in mainstream cognitive science explanations of cognition and their attempt to provide an account for a variety of cognitive (...) phenomena in which the questionable notion of content is not necessary. It is argued that REC is a promising research framework for cognitive phenomena and deserves further investigation. (shrink)

Since Jews rejected the miraculous account of Jesus' birth, they assumed that Mary conceived through illicit sexual activity, sometimes expressed in vulgar terms. Some Jews refuted the possibility of virgin birth by use of philosophical arguments, and others offered scriptural arguments against Mary's perpetual virginity. Despite generally negative views of Mary, there is evidence of an attraction to the idea of a semi-divine female role model and it is possible that certain Kabbalistic interpretations of the divine presence have Marian overtones.

O estudo do tipo, do arquétipo e dos subtipos da Virgem de Fátima, primeiramente produzidos em oficinais (...) trabalhos de santeiros e, em fase posterior, interpretados por artistas, permite entender os contornos do nascimento de uma realidade imagética, isto é, de uma iconografia ex nihilo e o seu, necessariamente, tardio desenvolvimento estético. “X-Firsters” hold that there is some normative feature that is fundamental to all others (and, often, that there’s some normative feature that is the “mark of the normative”: all other normative properties have it, and are normative in virtue of having it). This view is taken as a starting point in the debate about which X is “on first.” Little has been said about whether or why we should be X-Firsters, or what we should think about normativity if we aren’t (...) X-Firsters. Hence the chapter’s two main goals. First, to provide a simple argument that one shouldn’t be an X-Firster about the normative domain, which starts with the observation that analogous views have dubious merits in analogous domains. Second, to offer an alternative view—taking normativity to be a determinable explained in terms of its determinates—that offers an interesting way to think about the structure and unity of normativity. The potential to collect brain data more directly, with higher resolution, and in greater amounts has heightened worries about mental and brain privacy. In order to manage the risks to individuals posed by these privacy challenges, some have suggested codifying new privacy rights, including a right to “mental privacy.” In this paper, we consider these arguments and conclude that while neurotechnologies do raise significant privacy concerns, such concerns are—at least for now—no different from those raised by other well-understood data collection (...) technologies, such as gene sequencing tools and online surveillance. To better understand the privacy stakes of brain data, we suggest the use of a conceptual framework from information ethics, Helen Nissenbaum’s “contextual integrity” theory. To illustrate the importance of context, we examine neurotechnologies and the information flows they produce in three familiar contexts—healthcare and medical research, criminal justice, and consumer marketing. We argue that by emphasizing what is distinct about brain privacy issues, rather than what they share with other data privacy concerns, risks weakening broader efforts to enact more robust privacy law and policy. I ask you to X. You now have a reason to X. My request gave you a reason. How? One unpopular theory is the epistemic account, according to which requests do not create any new reasons but instead simply reveal information. For instance, my request that you X reveals that I desire that you X, and my desire gives you a reason to X. Peter Schaber has recently attacked both the epistemic account and other theories of the reason-giving force of (...) requests. Schaber defends a new theory of the reason-giving force of requests according to which request give reasons because it is valuable for requesters and requestees that requests have this power. In this paper I argue that Schaber's attack on the epistemic account fails, and that his own theory ought to be rejected because it faces compelling objections. (shrink)

Plato's dialogues frequently criticize traditional Greek myth, yet Plato also integrates myth with his writing. Daniel S. Werner confronts this paradox through an in-depth analysis of the Phaedrus, Plato's most mythical dialogue. Werner argues that the myths of the Phaedrus serve several complex functions: they bring nonphilosophers into the philosophical life; they offer a starting point for philosophical inquiry; they unify the dialogue as a literary and dramatic whole; they draw attention to the limits of language and the limits (...) of knowledge; and they allow Plato to co-opt cultural authority as a way of defining and legitimating the practice of philosophy. Platonic myth, as a species of traditional tale, is thus both distinct from philosophical dialectic and similar to it. Ultimately, the most powerful effect of Platonic myth is the way in which it leads readers to participate in Plato's dialogues and to engage in a process of self-examination. (shrink)

Supporters of open borders sometimes argue that the state has no pro tanto right to restrict immigration, because such a right would also entail a right to exclude existing citizens for whatever reasons justify excluding immigrants. These arguments can be defeated by suggesting that people have a right to stay put. I present a new form of the exclusion argument against closed borders which escapes this “right to stay put” reply. I do this by describing a kind of exclusion that (...) has not been discussed in depth, which I call “territorial exclusion.” Territorial exclusion is the process according to which the group that wishes to exclude current citizens secedes from the territory in which those citizens reside. I argue that the wrongness of territorial exclusion explains why there is no pro tanto right for a state to exclude immigrants, because otherwise there would be a pro tanto right for the state to kick people out by seceding from the territory they inhabit. Because kicking people out like this is typically wrong, borders cannot be closed. (shrink)

O presente texto procura colocar em diálogo reflexões do campo da Filosofia da Infância com os da Educação Infantil. Além das contribuições teóricas pretende fazer conexões com situações observadas em uma pesquisa de doutorado na qual as relações com o espaço e o tempo são entrelaçadas com as do corpo como experiência que surgem nas relações que as crianças estabelecem com seus machucados, ou como elas definem, seus ‘dodóis’. Nessas relações duas particularidades podem ser observadas: uma primeira é que as (...) crianças percebem o corpo como uma experiência contextualizada com o mundo social e material, ou seja, elas não percebem seus corpos separados dos espaços. Uma segunda particularidade é que as crianças trazem a possibilidade do tempo aión como uma aproximação à experiência, uma compreensão do tempo entrelaçado com pessoas, espaços, lugares e ações em que evidencia também relações, emoções e encontros. Dando seqüência as reflexões o texto pretende trazer para o diálogo também situações nas quais são tema entre as crianças as expressões dos sentimentos e das emoções e ainda situações que envolvem suas excreções como as ‘melecas’ e os ‘ranhos’ trazendo uma potencialidade para se pensar as relações entre corpo, infância e educação. A partir da compreensão de uma infância como experiência, como acontecimento que rompe com a história, pretende pensar indicações para uma infância da educação e não já apenas uma educação da infância. Essa necessidade de se pensar uma infância da educação, e não já apenas uma educação da infância parece simples, mas requer um outro ‘olhar’, requer ‘jogar fora’, ou pelo menos questionar, problematizar parte de nossa história para que seja possível pensar em condições de outras ordens, outros valores, enfim, outra educação. Ou seja, uma educação, em que se ‘olha’ não apenas os processos de desenvolvimento das crianças, mas também os seus conhecimentos, as suas produções, as suas manifestações, as suas preferências, as suas interações e particularmente as suas experiências. Motion—and, in particular, local motion or change in location—plays a central role in Kenelm Digby’s natural philosophy and in his arguments for the immateriality of the soul. Despite this, Digby’s account of what motion consists in has yet to receive much scholarly attention. In this paper, I advance a novel interpretation of Digby on motion. According to it, Digby holds that for a body to move is for it to divide from and unify with other bodies. This is a view (...) of motion—as change in relations of parthood—that Alison Peterman attributes to Digby’s contemporary and acquaintance, Margaret Cavendish. Having shown that Digby’s presentation of the view predates Cavendish’s by more than a decade, I make a case that Digby’s work influenced Cavendish’s on this topic. In developing and defending my reading, I consider to what extent the Digbean account of motion and the arguments for it accord with the ideals of the mechanical philosophy emerging in the early modern period. Abstract This paper offers an appraisal of Phillip Pettit's approach to the problem how a merely finite set of examples can serve to represent a determinate rule, given that indefinitely many rules can be extrapolated from any such set. I argue that Pettit's so-called ethnocentric theory of rule-following fails to deliver the solution to this problem he sets out to provide. More constructively, I consider what further provisions are needed in order to advance Pettit's general approach to the problem. I (...) conclude that what is needed is an account that, whilst it affirms the view that agents' responses are constitutively involved in the exemplification of rules, does not allow such responses the pride of place they have in Pettit's theory. This book is a study of the role of intellect in human action as described by Thomas Aquinas. One of its primary aims is to compare the interpretation of Aristotle by Aquinas with the lines of interpretation offered in contemporary Aristotelian scholarship. The book seeks to clarify the problems involved in the appropriation of Aristotle's theory by a Christian theologian, including such topics as the practical syllogism and the problems of akrasia. Westberg argues that Aquinas was much closer to Aristotle (...) than is often recognized, and he puts forward important new interpretations of the relation of intellect and will in the stages of intention, deliberation, decision, and execution. In the concluding section of the book, he shows how this new interpretation yields fruitful insights on a range of theological topics, including sin, law, love, and the moral virtues. (shrink)

This paper aims to understand Hegel’s claim in the introduction to his Philosophy of Mind that mind is an actualization of the Idea and argues that this claim provides us with a novel and defensible way of understanding Hegel’s naturalism. The problem known as Buridan’s Ass says that a hungry donkey equipoised between two identical bales of hay will starve to death. Indecision kills the ass. Some philosophers worry about human analogs. Computer scientists since the 1960s have known about the computer versions of such cases. From what Leslie Lamport calls ‘Buridan’s Principle’—a discrete decision based on a continuous range of input-values cannot be made in a bounded time—it follows that the possibilities for human analogs of Buridan’s Ass are far (...) more wide-ranging and securely provable than has been acknowledged in philosophy. We are never necessarily decisive. This is mathematically provable. I explore four consequences: first, increased interest of the literature’s solutions to Buridan’s Ass; second, a new asymmetry between responsibility for omissions and responsibility for actions; third, clarification of the standard account of akrasia; and, fourth, clarification of the role of credences in normative decision-theory. According to ethical objectivism, what a person should do depends on the facts, as opposed to their perspective on the facts. A long-standing challenge to this view is that it fails to accommodate the role that norms play in guiding a person’s action. Roughly, if the facts that determine what a person should do lie beyond their ken, they cannot inform a person’s deliberations. This paper explores two recent developments of this line of thought. Both focus on the epistemic counterpart (...) to ethical objectivism, according to which what a person should believe depends on the facts, as opposed to their perspective on the facts. The suggestion in each case is that epistemic objectivism faces a distinctive problem in accommodating guidance. Insofar as objectivism concerning the epistemic domain stands or falls with objectivism concerning the ethical domain, this is a problem for objectivism more generally. In this paper, I show that those arguments are not successful. The upshot is that the objectivist – whether ethical or epistemic – need not reject the idea that norms serve a guiding function. This essay considers the critical response to Hegel's view of Socrates we find in Kierkegaard's dissertation, The Concept of Irony. I argue that this dispute turns on the question whether or not the examination of particular thinkers enters into Socrates’ most basic aims and interests. I go on to show how Kierkegaard's account, which relies on an affirmative answer to this question, enables him to provide a cogent defence of Socrates' philosophical practice against Hegel's criticisms.

A famous painter of the 18th century, Joshua Reynolds presented throughout the years 1769-1790 speeches to the Royal Academy of Arts. In them, he exhibits a conception of painting that privileges historical paintings. However, Reynolds himself practices portrait painting. Analyzing to what extent the making of portraits does not contradict the argument that historical pictures are the ones that best represent the pictorial genre is what we seek to problematize in this text.

Can a liberal state exclude illiberal immigrants in order to preserve its liberal status? Hrishikesh Joshi has argued that liberalism cannot require a commitment to open borders because this would entail that liberalism is committed to its own demise in circumstances in which many illiberal immigrants aim to immigrate into a liberal society. I argue that liberalism is committed to its own demise in certain circumstances, but that this is not as bad as it may appear. Liberalism’s commitment to its (...) own demise is merely a reflection of the fact that it must take into account the rights of outsiders, not just the rights of existing citizens, and of the fact that circumstances of injustice can sometimes leave liberal societies with no correct choice. O objetivo do trabalho é analisar os processos relacionais entre os indígenas Migueleno, o território e o Estado brasileiro na região do atual Estado de Rondônia. O SPI Pautado na teoria da aculturação, no ano de 1928, considerou os Migueleno como grupos extintos, alegando a sua integração à sociedade nacional. A partir desse período, parte do grupo passou a constituir moradia na Vila do Limoeiro, a margem esquerda do rio São Miguel. Em 1982, o Governo brasileiro criou a Reserva Biológica (...) do Guaporé, deslocando os Migueleno e parte de seringueiros para um assentamento a margem direita no baixo São Miguel, classificando o grupo como “colonos assentados” pelo Instituto Nacional de Colonização e Reforma Agrária - INCRA. A partir do ano de 2000, os Migueleno através do movimento indígena estão reivindicando sua etnicidade e procurando caminhos para retornar ao seu território de “ocupação tradicional”, atualmente sobreposto à Reserva Biológica do Guaporé. A pesquisa pautada em estudos etnográficos analisa os processos situacionais, a dispersão dos Migueleno e a relação deles com o território de “ocupação tradicional”, atualmente sobreposto por uma Reserva Biológica.
