Throughout an illustrious career of teaching and writing that spans five decades, philosopher Needleman has always tackled the "big questions" of life. In this collection of six feature interviews that began in the 1980s, Miller and Needleman discuss "Making Sense of Mysticism, The Secrets of Time and Love, The Meanings of Money, Searching for the Soul of America, Meeting God without Religion, " and "The Need for Philosophy.".
Medical nihilism is the view that we should have little confidence in the effectiveness of medical interventions. Jacob Stegenga argues persuasively that this is how we should see modern medicine, and suggests that medical research must be modified, clinical practice should be less aggressive, and regulatory standards should be enhanced.
Are evolution and creation irreconcilably opposed? Is 'intelligent design' theory an unhappy compromise? Is there another way of approaching the present-day divide between religious and so-called secular views of the origins of life? Jacob Klapwijk offers a philosophical analysis of the relation of evolutionary biology to religion, and addresses the question of whether the evolution of life is exclusively a matter of chance or is better understood as including the notion of purpose. Are there key respects in which character and character defects are voluntary? Can agents with serious vices be rational agents? Jonathan Jacobs answers in the affirmative. Moral character is shaped through voluntary habits, including the ways we habituate ourselves, Jacobs believes. Just as individuals can voluntarily lead unhappy lives without making unhappiness an end, so can they degrade their ethical characters through voluntary action that does not have establishment of vice as its end. Choosing Character presents an account of ethical (...) disability, expanding the domain of responsibility and explicating the role of character in ethical cognition. Jacobs contends that agents become ethically disabled voluntarily when their habits impair their ability to properly appreciate ethical considerations. Such agents are rational, responsible individuals who are yet incapable of virtuous action. The view develops and modifies Aristotelian claims concerning the fixity of character. Jacobs' interpretation is developed in contrast to the overlooked work of Maimonides, who also used Aristotelian resources but argued for the possibility of character change. Many economists and philosophers assume that status quo bias is necessarily irrational. I argue that, in some cases, status quo bias is fully rational. I discuss the rationality of status quo bias on both subjective and objective theories of the rationality of preferences. I argue that subjective theories cannot plausibly condemn this bias as irrational. I then discuss one kind of objective theory, which holds that a conservative bias toward existing things of value is rational. This account can fruitfully explain (...) some compelling aspects of common sense morality, and it may justify status quo bias. (shrink)

How do Dutch people let each other know that they disagree? What do they say when they want to resolve their difference of opinion by way of an argumentative discussion? In what way do they convey that they are convinced by each other’s argumentation? How do they criticize each other’s argumentative moves? Which words and expressions do they use in these endeavors? By answering these questions this short essay provides a brief inventory of the language of argumentation in Dutch.
Opponents of male circumcision have increasingly used human rights positions to articulate their viewpoint. We characterize the meaning of the term “human rights.” We discuss these human rights arguments with special attention to the claims of rights to an open future and to bodily integrity. We offer a three-part test under which a parental decision might be considered an unacceptable violation of a child's right. The test considers the impact of the practice on society, the impact of the practice on (...) the individual, and the likelihood of adverse impact. Infant circumcision is permissible under this test. We conclude that infant circumcision may be proscribed as violating local norms, even though it does not violate human rights. (shrink)
In recent debates about the nature of non-conceptual content, the Kantian account of intuition in the first Critique has been seen as a sort of founding doctrine for both conceptualist and non-conceptualist positions. In this paper, I begin by examining recent representative versions of the Kantian conceptualist (John McDowell) and Kantian non-conceptualist (Robert Hanna) positions, and suggest that the way the debate is commonly construed by those on both sides misses a much broader and more important conception of non-conceptual content, (...) one for which resources can be found in Husserl’s later thought. Husserl’s account of the object as “transcendental clue” [Transzendentaler Leitfaden] in the context of his later genetic phenomenology suggests a less reductive account of non-conceptual aspects of experience that respects central insights of Kant’s transcendental idealism but does not reduce the role of the non-conceptual to a mere formally-determined, not-yet-conceptualized “fodder.”. Do you ever feel the need to make a stand against those who are favourably inclined toward your plays but whose comments seem to you to be stupid? EI: Well, for better or worse, that's what I've always done: I wrote Notes and Counter-Notes, had discussions with Claude Bonnefoy, I've written articles; and in each case what I've said, in short, is that critics who gave me their approval, (...) did so because they misunderstood me and were mistaken about my intentions. GJ: Finally, are you at all bitter about the critics? EI: No. Many have become good friends of mine. But it is a bit disheartening; when I began, a critic who, shall we say, is on the Right, a conservative critic who is very well-known and has since become a friend of mine, called me an impostor, a fraud, and a dummy; and now, twenty-five years later, the Leftists still call me an impostor, a fraud, and a dummy. I argue that comparisons of Stoic virtue to stochastic skills — now standard in the secondary literature on Stoicism — are based on a misreading of the sources and distort the Stoic position in two respects. In paradigmatic stochastic skills such as archery, medicine, or navigation the value of the skill’s external end justifies the existence and practice of the skill and constitutes an appropriate focus of rational motivation. Neither claim applies to virtue as the Stoics understand it. The stochastic (...) model of virtue almost certainly originated with Carneades and should be distinguished clearly from the Stoic account. Doing so clarifies the Stoic position and shows that it anticipates what Thomas Hurka calls a modern view of value. (shrink)
In an age of constitutional revolutions and reforms, theory and practice are moving in opposite directions. As a matter of constitutional practice, human dignity has emerged in jurisdictions around the world as the organizing idea of a groundbreaking paradigm. By reconfiguring constitutional norms, institutional structures and legal doctrines, this paradigm transforms human dignity from a mere moral claim into a legal norm that persons have standing to vindicate. As a matter of constitutional theory, however, human dignity remains an enigmatic idea. (...) Some explicate its meaning in abstraction from constitutional practice, while others confine themselves to less exalted ideas. The result is a chasm that separates constitutional practice from a theory capable of justifying its innovations and guiding its operation. By expounding the connection between human dignity and the constitutional practices that justify themselves in its light, Jacob Weinrib brings the theory and practice of constitutional law back together. Robustness is a common platitude: hypotheses are better supported with evidence generated by multiple techniques that rely on different background assumptions. Robustness has been put to numerous epistemic tasks, including the demarcation of artifacts from real entities, countering the “experimenter’s regress,” and resolving evidential discordance. Despite the frequency of appeals to robustness, the notion itself has received scant critique. Arguments based on robustness can give incorrect conclusions. ABSTRACT In this journal, Middleton and Murgueitio Ramírez argue that absolute velocity is measurable, contrary to the received wisdom. Specifically, they claim that ‘there exists at least one reasonable analysis of measurement according to which the speedometer in [a world called “the Basic World”] measures the absolute velocity of the car.’ In this note, I critically respond to that claim: the analysis of measurement that Middleton and Murgueitio Ramírez propose is not reasonable; nor does it entail that absolute velocities are (...) measurable. British liberal philosophy is widely regarded as a tradition that has been shaped by science and philosophy of science. Through detailed study of writings by Locke, Bentham, Mill, and Popper on epistemology, politics and related subjects, Science and British Liberalism assesses that view. It is shown that the seminal minds have been vitally interested in science, committed to explaining and developing it, and to seeing its influence extended. But it is also found that scientific theories and ideas on science are (...) often irrelevant to, sometimes even in conflict with, the four distinctive formulations to liberalism, and only occasionally drawn on to explicate and support them. Of these thinkers, among the chief architects of British liberal doctrine, only Popper has systematically and significantly used science as a resource in defending preferred political ideas. (shrink)
Philosophers have committed sins while studying science, it is said – philosophy of science focused on physics to the detriment of biology, reconstructed idealizations of scientific episodes rather than attending to historical details, and focused on theories and concepts to the detriment of experiments. Recent generations of philosophers of science have tried to atone for these sins, and by the 1980s the exculpation was in full swing. Marcel Weber’s Philosophy of Experimental Biology is a zenith mea culpa for philosophy of (...) science: it carefully describes several historical examples from twentieth century biology to address both ‘old’ philosophical topics, like reductionism, inference, and realism, and ‘new’ topics, like discovery, models, and norms. Pursuing equality is an important challenge for any modern democratic society but this challenge faces two sets of difficulties: the theoretical question of what sort of equality to pursue and for whom; and the practical question concerning which legal and political institutions are the most appropriate vehicles for implementing egalitarian social policy and thus realizing egalitarian justice. This book offers original and innovative contributions to the debate about equality of opportunity. The first part of the book sets out a theory (...) of equality of opportunity that presents equal opportunities as a normative device for the regulation of competition for scarce resources. The second part shifts the focus to the consideration of the practical application by courts or legislatures or public policy makers of policies for addressing racial, class or gender injustices. Hobbes believed that the state of nature would be a war of all against all. Locke denied this, but acknowledged that in the absence of government, peace is insecure. In this paper, I analyse both accounts of the state of nature through the lens of classical and experimental game theory, drawing especially on evidence concerning the effects of punishment in public goods games. My analysis suggests that we need government not to keep wicked or relentlessly self-interested individuals in line, but (...) rather to maintain peace among those who disagree about morality. Margaret Jacob and Larry Stewart examine the profound transformation that began in 1687. From the year when Newton published his Principia to the Crystal Palace Exhibition of 1851, science gradually became central to Western thought and economic development. The book aims at a general audience and examines how, despite powerful opposition on the Continent, a Newtonian understanding gained acceptance and practical application. By the mid-eighteenth century the new science had achieved ascendancy, and the race was on to apply Newtonian (...) mechanics to industry and manufacturing. They end the story with the temple to scientific and technological progress that was the Crystal Palace exhibition. Choosing their examples carefully, Jacob and Stewart show that there was nothing preordained or inevitable about the centrality awarded to science. "It is easy to forget that science might have been stillborn, or remained the esoteric knowledge of court elites. Instead, for better and for worse, science became a centerpiece of Western culture.". An astonishing volume and diversity of evidence is available for many hypotheses in the biomedical and social sciences. Some of this evidence—usually from randomized controlled trials (RCTs)—is amalgamated by meta-analysis. Despite the ongoing debate regarding whether or not RCTs are the ‘gold-standard’ of evidence, it is usually meta-analysis which is considered the best source of evidence: meta-analysis is thought by many to be the platinum standard of evidence. However, I argue that meta-analysis falls far short of that standard. Different meta-analyses (...) of the same evidence can reach contradictory conclusions. Meta-analysis fails to provide objective grounds for intersubjective assessments of hypotheses because numerous decisions must be made when performing a meta-analysis which allow wide latitude for subjective idiosyncrasies to influence its outcome. I end by suggesting that an older tradition of evidence in medicine—the plurality of reasoning strategies appealed to by the epidemiologist Sir Bradford Hill—is a superior strategy for assessing a large volume and diversity of evidence. This contribution is an examination of so-called “religious antisemitism” vis-à-vis the various Christian religious communities and/or denominations at the present time, framed by the recognition that, over the last several years, an increase in antisemitism in the United States has been shown by figures compiled by both the Federal Bureau of Investigation and the Anti-Defamation League. It is further framed by examining the 2015 Pew Research Center Report “America’s Changing Religious Landscape,” and its 2016 “If the U.S. had 100 people: (...) The ‘expropriation of the expropriators’ is a delicious turn of phrase, one that Marx even compares to Hegel’s infamous ‘negation of the negation’. But what does it mean, and is it still relevant today? Before I analyse the content of Marx’s expression, I briefly consider contemporary legal understandings of expropriation, as well as some examples of it. In the remainder of the essay, I spell out different kinds of expropriation in Marx and focus on an ambiguity at the core of (...) the notion of ‘expropriating the expropriators’, namely, whether it describes an immanent and objective tendency within the development of the capitalist mode of production or else actively prescribes a form of revolutionary political praxis for the working class. My answer is that it does both, though not without tension. Finally, I develop some implications of these reflections by showing how the concept of expropriation can be put to use today, in struggles around housing, climate and work. (shrink)
Almost alone among nineteenth-century historians, Jacob Burckhardt saw the totalitarian direction that history could take. This book (first published in English in 1943 as "Force and Freedom") is a guide to the study and comprehension of historical processes. Burckhardt makes a clear distinction between the state and the voluntary activities of society. He focuses on the nature and reciprocal interactions of the state, religion, and culture.
Early in the 1980s, a new category of crime appeared in the criminal law lexicon. In response to what was said to be an epidemic of prejudice-motivated violence, Congress and many state legislatures passed a wave of 'hate crime' laws that required the collection of statistics and enhanced the punishment of crimes motivated by certain prejudices. This book places in socio-legal perspective both the hate crime problem and society's response to it. From the outset, Jacobs and Potter adopt a skeptical (...) if not critical stance. They argue that hate crime is a hopelessly muddled concept and that legal definitions of the term are riddled with ambiguity and subjectivity. Moreover, no matter how hate crime is defined, the authors find no evidence to support the claim that the US is experiencing a hate crime epidemic—nor that the number or rate of hate crimes is at an historic zenith. W. G. Sebald's writing has been widely recognized for its intense, nuanced engagement with the Holocaust, the Allied bombing of Germany in WWII, and other episodes of violence throughout history. Through his inventive use of narrative form and juxtaposition of image and text, Sebald's work has offered readers new ways to think about remembering and representing trauma. In _Sebald's Vision_, Carol Jacobs examines the author's prose, novels, and poems, illuminating the ethical and aesthetic questions that shaped his remarkable oeuvre. Through (...) the trope of "vision," Jacobs explores aspects of Sebald's writing and the way the author's indirect depiction of events highlights the ethical imperative of representing history while at the same time calling into question the possibility of such representation. Jacobs's lucid readings of Sebald's work also consider his famous juxtaposition of images and use of citations to explain his interest in the vagaries of perception. Isolating different ideas of vision in some of his most noted works, including _Rings of Saturn_, _Austerlitz_, and _After Nature_, as well as in Sebald's interviews, poetry, art criticism, and his lecture _Air War and Literature_, Jacobs introduces new perspectives for understanding the distinctiveness of Sebald's work and its profound moral implications. 'Leading economists presenting fundamentally important issues in economic theory' is the theme of the Nancy Schwartz lectures series held annually at the J. L. Kellogg Graduate School of Management of Northwestern University. Reporting on lectures delivered in the years 1983 through 1997, this collection of essays discusses economic behavior at the individual and group level and the implications to the performance of economic systems. Using non-technical language, the speakers present theoretical, experimental, and empirical analysis of decision making under uncertainty and (...) under full and bounded rationality, the influence of economic incentives and habits, and the effects of learning and evolution on dynamic choice. Perfect competition, economic development, social insurance and social mobility, and negotiation and economic survival, are major economic subjects analyzed through our understanding of economic behavior. Wigner’s quantum-mechanical classification of particle-types in terms of irreducible representations of the Poincaré group has a classical analogue, which we extend in this paper. We study the compactness properties of the resulting phase spaces at fixed energy, and show that in order for a classical massless particle to be physically sensible, its phase space must feature a classical-particle counterpart of electromagnetic gauge invariance. By examining the connection between massless and massive particles in the massless limit, we also derive a classical-particle (...) version of the Higgs mechanism. (shrink)
Disappointed by the indifferent reception of his 1739 Treatise of Human Nature, particularly in view of his commitment to vividness and convincingness as epistemological criteria, Hume recast crucial arguments from his Treatise in “The Epicurean,” “The Stoic,” “The Platonist,” and “The Sceptic,” four pieces from his 1741–2 Essays Moral and Political. Locating these texts within both the dialogue and essay genres, I demonstrate how Hume continues the project of the Treatise by showing, rather than telling, his views: he blends rhetoric (...) and reasoned argument to show that they are in many cases indistinguishable; he depicts his speakers' conclusions as consequences of their personalities to show his skepticism about human freedom; and he concludes, in a moment strongly reminiscent of the famous end of Book I of the Treatise, by showing the limits of philosophy itself. In this paper, we review a general technique for converting the standard Lagrangian description of a classical system into a formulation that puts time on an equal footing with the system's degrees of freedom. We show how the resulting framework anticipates key features of special relativity, including the signature of the Minkowski metric tensor and the special role played by theories that are invariant under a generalized notion of Lorentz transformations. We then use this technique to revisit a classification of (...) classical particle-types that mirrors Wigner's classification of quantum particle-types in terms of irreducible representations of the Poincaré group, including the cases of massive particles, massless particles, and tachyons. Along the way, we see gauge invariance naturally emerge in the context of classical massless particles with nonzero spin, as well as study the massless limit of a massive particle and derive a classical-particle version of the Higgs mechanism.
