The Doctrine of the Trinity says that there is one God, that there are three divine Persons, and that each divine Person is God. The Logical Problem of the Trinity is that these claims seem logically inconsistent. We argue that any coherent and orthodox solution to the Logical Problem must use the technique of paraphrase: a logically or metaphysically more perspicuous reformulation. If so, discussions of paraphrase deserve more prominence in the literature on the Doctrine of the Trinity. The dominant account of propositions holds that they are structured entities that have, as constituents, the semantic values of the constituents of the sentences that express them. Since such theories hold that propositions are structured, in some sense, like the sentences that express them, they must provide an answer to what I will call Soames’ Question: “What level, or levels, of sentence structure does semantic information incorporate?”. As it turns out, answering Soames’ Question is no easy task. I argue in (...) this paper that the two most promising ways of answering it, the Logical Form Account and the LF Account, are both unsatisfactory. Positive mental health involves not the absence of mental disorder but rather the presence of certain mental goods. Institutions, practitioners, and theorists often identify positive mental health with well‐being. There are strong reasons, however, to keep the concepts of well‐being and positive mental health separate. Someone with high positive mental health can have low well‐being, someone with high well‐being can have low positive mental health, and well‐being and positive mental health sometimes conflict. But, while positive mental health and well‐being are (...) not identical, there is an informative conceptual connection between them. Lists foreground multiplicity: both of objects to be pursued and, for distant objects, of far-flung networks enabling their pursuit. The future-oriented or projective list stretches such networks not only around the world but forward through time. Research agendas are one kind of future-oriented, projective list. Sketching how such lists have functioned over time, from Francis Bacon's “The New World of Sciences, or Desiderata” to today's desiderata lists, suggests how an early modern model of imperial expansion has shaped, in unintended ways, (...) a scientific rhetoric of collaborative advance on shared targets. Kant's philosophy must be understood nonnaturalistically and anti-psychologistically. Self-consciousness must be interpreted as preceding the distinction between different persons. Kant departs from the traditional idea that I thoughts are always mediated by a certain specific I sense or conceptualization of oneself. At the same time the so-called paradoxes of self-consciousness are resolved. The possibility of a pre-personal self-consciousness is what links the way all objects are given to finite beings to the way they are conceptualized by those beings. It serves (...) as the unifying basis for intuitions and concepts. Intuitions and concepts of objects are connected by their relation to a numerically identical self. ;The subject construed impersonally provides the frame for any possible experience and is one in the same in all possible experience. As such it can never be experienced as a distinct entity. It is the condition under which it is possible to have a point of view at all. One must be in a position to become conscious of the numerical identity of this logical subject of all representation if is to be possible to communicate indeed to compare and contrast representational contents at all. ;Self-consciousness is inherently empty and yet also necessarily in relation to contents of consciousness. This means that its numerical identity can only be sustained if all potential contents of consciousness present themselves to the self in such a way that they sustain the possibility of consciousness of the self as having a discrete empirical identity. Kant's argument in the First Analogy and the Refutation of Idealism fulfills this demand for a correlate to the numerical identity of pre-personal consciousness in the data presented to self-consciousness spatio-temporally. We must view self-construction and construction of objects existing outside of us as part of a single process which presupposes an impersonal self-consciousness. (shrink)

This article is about the justifiability of accepting worse cost effectiveness for orphan drugs, that is, treatments for rare diseases, in a publicly financed health care system. Recently, three arguments have been presented that may be used in favour of exceptionally advantageous economic terms for orphan drugs. These arguments share the common feature of all referring to considerations of justice or fairness: the argument of the irrelevance of group size, the argument from the principle of need, and the argument of (...) identifiability. It is argued that all of these arguments fail to support the conclusion that orphan drugs should be subsidized to a larger extent than treatments for common diseases. The argument of the irrelevance fails to distinguish between directly and indirectly relevant considerations of fairness or justice. The recent attempt to revive the moral relevance of identifiability has provided no novel reasons to think that identifiability is morally relevant in itself or due to considerations of fairness and justice. The argument from the principle of need does not fail due to any inherent flaw in the principle as such. Rather, this principle can be interpreted in different ways, and none of these interpretations support exceptionally advantageous terms economically for treating rare diseases specifically. It is concluded that we are awaiting justice based reasons for the preferential treatment of orphan drugs. (shrink)

This work represents Niklas Luhmann's definitive application of systems theory to the understanding of law. In it Luhmann reviews past attempts to create a theory of law and argues they all fail to capture how law operates in modern society. He presents an alternative, critical theory through analysing law as a system of communication.

Bereits mit Anfang Zwanzig, wohl zwischen 1829 und 1831, verfasst John Stuart Mill fünf Essays, die seine ersten ökonomischen Schriften darstellen. Mit der Ausnahme des fünften Essays werden diese allerdings erstmals 1844 veröffentlicht, zwei Jahre nach dem Erfolg von A System of Logic. Diese frühen Texte zeugen von Mills Fähigkeiten als Synthetisierer unterschiedlicher theoretischer Ansätze, aber ebenso von seiner oft verkannten Innovationskraft auf dem Feld der Ökonomie. Zudem zeigen sie ihn als Autor des Übergangs vom klassischen zum neoklassischen Paradigma. Mill (...) ist offen gegenüber Ideen, die nicht ohne Weiteres mit der Klassischen Nationalökonomie zu vereinbaren sind. Entsprechend findet sogar Karl Marx, trotz aller berechtigten Kritik an den Essays, lobende Worte für das „Schriftlein, das in der Tat alle originellen Ideen des Herrn J[ohn] St[uart] Mill über political economy enthält“ (MEW 26.3, 190). Für John R. Hicks sind die Essays „perhaps the freshest of Mill’s economic writings“ (Hicks 1983, 60). (shrink)

Children have special duties to their parents: there are things that we ought to do for our parents, but not for just anyone. Three competing accounts of filial duty appear in the literature: the debt theory, the gratitude theory and the friendship theory. Each is unsatisfactory: each tries to assimilate the moral relationship between parent and child to some independently understood conception of duty, but this relationship is different in structure and content from any that we are likely to share (...) with anyone apart from a parent. A more promising account will concentrate on what is unique about the parent-child relationship. I articulate and defend the 'special goods theory', according to which filial duties arise from the distinctive kinds of goods that healthy parent-child relationships typically involve. (shrink)

Niklas Luhmann is widely recognized as one of the most original thinkers in the social sciences today. This major new work further develops the theories of the author by offering a challenging analysis of the relationship between society and the environment. Luhmann extends the concept of "ecology" to refer to any analysis that looks at connections between social systems and the surrounding environment. He traces the development of the notion of "environment" from the medieval idea--which encompasses both human and (...) natural systems--to our modern definition, which separates social systems from the external environment. In Luhmann's thought, human beings form part of the environment, while social systems consist only of communications. Utilizing this distinctive theoretical perspective, Luhmann presents a comprehensive catalog of society's reactions to environmental problems. He investigates the spheres of the economy, law, science, politics, religion, and education to show how these areas relate to environmental issues. Ecological Communication is an important work that critically examines claims central to our society--claims to modernity and rationality.
