The work of the French philosopher Jean-Luc Nancy shares with the thinkers of the ‘theological turn in phenomenology’ the programmatic desire to place the ‘theological’, in the broad sense of rethinking the religious traditions in our secular time, back on the agenda of critical thought. Like those advocating a theological turn in phenomenology, Nancy’s deconstructive approach to philosophical analysis aims to develop a new sensibility for the other, for transcendence, conceptualized as the non-apparent in the realm of appearing phenomena. This (...) is why Nancy launches a project looking for the ‘unthought’ and unexpected within the Christian traditions, called deconstruction of Christianity. However, the deconstructive approach to the non-apparent differs fundamentally from that of the thinkers of the turn (1) in its being non-apologetic and non-restorative with regard to religion, because it starts from a problematization of the—typically modern, that is romantic—desire to defend and protect what would be ‘lost’ and possibly to restore this, (2) in its focus on the complex difference-at-work (différance) between religion and secularism, a difference that can be termed entanglement and complicity between these two, (3) in its hypothesis that this entanglement is essentially one between (the meaning and experience of, the rituality around) presence and absence in modern culture, (4) in its conviction that the philosophy and history of culture must join, support, complete and maybe even turn around phenomenology when dealing with the difficult task of determining what exactly would be ‘left’ of the ‘theological’ in our time. The paper argues for a pragmatist understanding of the reasonable doubt standard in law. It builds on the idea that our dispositions to act signal the epistemic states we are in. This helps clarify the notion of a reasonable doubt and the idea of being certain beyond it. More specifically, the paper points out three major standards of proof used in legal contexts and the rationale of their distinction. It articulates the received view according to which the reasonable doubt standard (...) is superior to allegedly subjective standards as the French “intime conviction”; then it addresses what I call the “rampant critique” of the reasonable doubt standard, namely the view that, as the notion of a reasonable doubt is obscure and undetermined, the standard is irremediably subjective. The paper finally presents a pragmatist understanding and defense of the standard, building on the idea of beliefs as dispositions to act. (shrink)

Ses réflexions en la matière, nombreuses, sont beaucoup plus profondes et autrement plus originales qu'on ne le croit généralement, et l'inventeur des Propos est bien davantage que le simple « philosophe du bonheur pour classe terminale » qu'on a coutume de présenter - et de citer, beaucoup plus que de lire. Circonstance aggravante, sa philosophie politique, quoiqu'authentiquement démocrate, apparaît dans le même temps viscéralement individualiste et (...) libérale ; ce qui s'avère être une tare rédhibitoire aux yeux de beaucoup d'intellectuels français, et ce qui a certainement joué un rôle non négligeable dans l'oubli presque complet dans lequel est tombé cet aspect de son oeuvre au XXe siècle, c'est-à-dire à l'époque tragique des totalitarismes et de l'État-roi. Or, c'est précisément cette dimension de la pensée d'Alain que nous entendons ici mettre en valeur, avec l'intime conviction que cette oeuvre politique a encore beaucoup de choses à nous apprendre et qu'elle mérite sans le moindre doute de figurer au panthéon des plus grands classiques de la pensée libérale. Il devient difficile de rendre compte des livres ou même des articles publiés ces dernières années sur la Cappadoce, du moins si on tient à faire un compte-rendu qui ne soit pas simplement un résumé sommairement commenté du livre et impliquant, au contraire, une prise de position personnelle sur les problèmes débattus. En effet, sur la plupart des questions encore disputées sur les églises byzantines de Cappadoce, on constate des prises de positions tranchées et contradictoires, souvent d'ailleurs appuyées sur des (...) arguments qui paraissent intéressants et ne peuvent pas être écartés facilement, mais qui, si l'on regarde de près, ne prennent pas en compte toutes les données possibles et ne suffisent pas à démontrer que les opinions contraires sont erronées. Peut-être d'ailleurs, faudra-t-il un jour admettre que la nature de la documentation ne permet pas, dans certains cas, de dépasser l'intime conviction des uns et des autres, mais, pour l'instant, la réflexion doit continuer à se développer. Cette réflexion ne peut qu'être facilitée par les livres parus ces dernières années sur la Cappadoce qui permettent à la fois à leurs auteurs de développer de manière plus systématique leurs points de vue et de retrouver plus facilement une bibliographie largement dispersée en attendant que les instruments de travail électroniques soient autant au point dans les études byzantines que dans des domaines voisins. Cet article examine l’attitude de Socrate tel qu’il se présente dans les dialogues platoniciens, face à la religion officielle d’Athènes. Ensuite, nous présentons les positions adoptées par Platon dans ses cités idéales concernant les citoyens qui s’écartent des attitudes religieuses établies par la loi. Enfin, nous mettons en évidence les similitudes et les différences entre Socrate et Platon sur les rapports entre la religion publique et les croyances personnelles. Contrairement aux avis courants, nous défendons l’idée que Platon est resté fidèle (...) du début jusqu’à la fin de son oeuvre aux principes socratiques concernant le divin. En fait, dans ses cités idéales, Platon « renverse » les rôles : les croyances de Socrate, définies dialectiquement par le logos, deviennent le fondement de la législation et sont les seules acceptées officiellement.Public Religion and personal beliefs. Plato against Socrates? The present paper examines first Socrates’ attitude towards the official religion of Athens, as it appears in the Platonic dialogues. We then analyse Plato’s position concerning the citizens who diverged from the religious representations established by law in the ideal cities. Finally, we formulate what we consider to be the similarities and differences between Socrates and Plato himself concerning the relations between public religion and personal beliefs. Against the current interpretations, we defend the idea that Plato conserved from the beginning till the end of his work his devotion to Socratic principles concerning divinity. In fact, in the ideal cities Plato “reverses” the roles: the intimate convictions of Socrates regarding the gods, defined dialectically by the logos, become the foundation of legislation and are the only ones officially accepted. Bill Cosby’s immorality has raised intriguing aesthetic and ethical issues. Do the crimes that he has been convicted of lessen the aesthetic value of his stand-up and, even if we can enjoy it, should we? This article first discusses the intimate relationship between the comedian and audience. The art form itself is structurally intimate, and at the same time the comedian claims to express an authentic self on stage. After drawing an analogy between the question of the moral character of (...) comedians and the aesthetic value of their stand-up and the debate over the ethical criticism of art, this article argues that it is reasonable to find a comedian’s performance less funny, because stand-up’s artistic success relies on this intimacy. It contrasts the comedy of Bill Cosby with that of Louis C.K. C.K.’s moral flaws are much more present in his comedy, and it is therefore more difficult to find him funny. Last, it is ethically permissible to enjoy their comedy, if no harm to others results, both because it does not corrupt the audience’s character and because amusement is valuable. (shrink)

van der Pijl et al 1 argue that if ‘stakes are high’ and there is ‘clear conviction by the care provider’ that it is ‘necessary’, episiotomy may be given after ‘opt-out consent’. Here I caution against the applicability of their approach to vaginal examination (VE): another routine intervention in birth to which they suggest their discussion may apply. I highlight three concerns: first, the subjective and unjustified nature of assessments of ‘necessity’; second, the inadequacy of current consent practices in (...) relation to VE; and third, the significant risk of perpetuating under-recognised harms associated with unwanted or unconsented VE. I argue that opt-out consent cannot be ethically justified for VE. Its use would result in further weakening of consent practices, circumvention of individuals’ autonomy, and greater harm for women and birthing people. At the outset, it is important to recognise that the authors do not claim that their approach should be applied to VE, merely that their discussion may have relevance to consent for other interventions beyond episiotomy ‘where consent is also frequently lacking, and which are under-researched’, including VE.1 Nonetheless, it is easy to assume that episiotomy and VE are sufficiently similar that their analysis might be transferred wholesale. In late September 1838, Darwin read Malthus's Essay on Population, which left him with “a theory by which to work.”115 Yet he waited some twenty years to publish his discovery in the Origin of Species. Those interested in the fine grain of Darwin's development have been curious about this delay. One recent explanation has his hand stayed by fear of reaction to the materialist implications of linking man with animals. “Darwin sensed,” according to Howard Gruber, “that some would object to (...) seeing rudiments of human mentality in animals, while others would recoil at the idea of remnants of animality in man.”116 With this link closed, Darwin hung the materialist chain around his own neck, where it rested most uncomfortably. Stephen Gould, supporting Gruber's argument, finds evidence for this reconstruction in Darwin's M and N notebooks, whichinclude many statements showing that he espoused but feared to expose something he perceived as far more heretical than evolution itself: philosophical materialism-the postulate that matter is the stuff of all existence and that all mental and spiritual phenomena are its by-products. No notion could be more upsetting to the deepest traditions of Western thought than the statement that mind-however complex and powerful-is simply a product of brain.117The proferred hypothesis suggests, then, that Darwin was acutely sensible of the social consequences of equating men with animals and therefore mind with brian, and that he thus shied from publically revealing his views until the intellectual climate became more tolerant.The history I have examined makes this hypothesis implausible. Even if Darwin warily explored the implications of his emerging theory in his notebooks, his subsequent study of Fleming, Wells, Brougham, and Kirby should have quieted any trepidation. If these natural theologians did not flinch at seeing human reason prefigured in the mind of a worm, should Darwin have? Moreover, he recognized in his M notebook that the thesis of evolutionary continuity between men and animals did not require an explicit avowal of his conviction that brain was the agent of thought.118 And in any case, his materialism was of a rather benign sort; at least he so expressed it in an annotation in Abercrombie's Inquiries concerning the Intellectual Powers (1838): “By materialism I mean, merely the intimate connection of thought with form of brain — like kind of attraction with nature of element.”119 This belief would have held little terror for British intellectuals, who were quite familiar — some even comfortable-with Locke's anti-Cartesian argument that there was nothing contradictory in supposing God could make matter to think.120 Finally, even if the intellectual atmosphere of early nineteenth-century Britain were inhospitable to Darwin's brand of materialism, there is little reason to believe he breathed a different air at mid-century while preparing his manuscript.That Darwin should not have feared suspicions of materialism, of course, does not mean that he did not. But I think there were other, more persistent sources of anxiety that kept him from rushing to publish: namely, the several conceptual obstacles he had to overcome if his theory of evolution by natural selection were to be made scientifically acceptable. Prominent among these were the problems surrounding his changing notions of instinct.The inertia of his older ideas about instinct at first made it hard for Darwin to gauge how far the theory of natural selection might be applied to behavior. By the early 1840s he finally felt ready to meet the challenge of the natural theologians by providing a naturalistic explanation for the wonderful instincts of animals. In his “Essays” of 1842 and 1844 one sort of instinct is, however, not considered-that of neuter insects. Yet Darwin seems to have appreciated the difficulties such instincts entailed at least by 1843, when he read Kirby and Spence. He simply required time to work out a solution to a problem he initially perceived as “fatal to my whole theory.” Even while writing the “Species Book” in the summer of 1857, he was still juggling several possible solutions compatible with natural selection. It was only a short time before he actually turned to work on the Origin of Species that he appears to have settled on a single explanation for the difficulties posed by the instincts of worker bees and ants. The force of his theory of community selection snapped the last critical support of the creationist hypothesis and, conveniently enough, also fractured the generalized Lamarckian account of the evolution of behavior. In lieu of an abstract, here is a brief excerpt of the content:RELIGION AND SYMBOLIC VIOLENCE Paul Ricoeur Université de Nanterre Paris X These are issues that I take very much to heart, so I will risk my own thoughts on the relation between religion and violence, not excluding the violence in and ofreligion. This is to say that I am not evading the objection made by Jean-Pierre Changeux in a recent discussion, namely, that religion as such produces violence. I (...) do not wish to evade the objection nor to hide behind the collateral explanation that it is when religion is detoured by politics that it produces violence. It is the presupposition that religion produces violence that brings me into discussion with René Girard. I encountered his work several decades ago and I have met him intermittently, with moments of distancing and rediscovery. This is the case for me again today regarding one of his later books, The Scapegoat. I cannot forget the dazzling excitement of 1972 when Violence and the Sacred first appeared. And then for me came a moment of hesitation, of doubt: isn't this explanation too psychologizing? Aren't the Gospels too easily exonerated ofthe accusation ofviolence? But I thereafter experienced disappointment with alternative accounts, principally sociological ones, and in particular with the one given by Maurice Bloch in La Violence du religieux. I am going to take the risk of a personal interpretation ofthe intimate relation between religion and violence. My own conviction, at bottom, is that I have been able, by broadening and deepening the issue, to discern the point where this very movement of going deeper bifurcates and branches out toward external violence. I have clarified my position in La Critique et la conviction and in my more recent debate with J.R Changeux, Ce quifait que nouspensons on this complicity between religion and violence. And it was in pursuing the direction opened up in La Critique et la conviction that I rediscovered an 2 Paul Ricoeur interest in The Scapegoat. I found his interpretation not only to be complementary to my own, but its necessary complement. I will now proceed to show how René Girard's thesis is necessary to my own thinking. So now I will go directly to my interpretive proposal, then I will turn to the position of Bloch in La Violence du religieux, a sociological interpretation, in order to come back in the end to Girard. It is by way of reflection on tolerance considered as a progressive initiation that I arrived at the interpretation I am going to present. At its minimal state, we find only the tolerance ofthe intolerant person, who states, "I don't agree with what you believe, I disapprove of it, but I cannot prevent it. I tolerate it in the sense of not being able to prevent it; I would like to prevent it, but I do not have the power to do so." At a second level, tolerance is more positive, saying, "I maintain the conviction that I am the one who has the truth, but I recognize, by way of being accommodating, that you have the right to profess what I hold as false, and I do this in the name ofjustice. That is to say, you certainly have the right, and it is one equal to mine, to profess what you believe, although I take it as false." I would say that the force of the principle ofjustice as thus expressed is this: any other life is worth as much as mine. Let us say that what I recognize here is the right to error. But at this stage I am torn within by the truth that I believe to be unilaterally mine and the justice that entails recognition ofthe other, which I place on another level from that oftruth. I make a further step in pursuing the issue, at a level farther advanced, when I say, "My adversary has perhaps a part ofthe truth but I don't know what it is." I would say that this is the perspectival version oftolerance: the other person sees a side of things, which I cannot see. But our positions cannot be substituted for each other. This essay builds on a review of Iain Thomson’s recent monograph, Heidegger, Art, and Postmodernity, the theme of which is Heidegger’s post-Kehre thinking. Through a series of close textual exegeses, and attentive analyses of concepts, Thomson traces the philosopher’s concern to envisage a means of escaping the late-modern comprehension of being. The latter is characterized, in Thomson’s interpretation, by the ‘technological’ or Nietzschesque understanding of ontology in terms of the eternally recurring will-to-power, according to which objects are identified as intrinsically (...) meaningless, optimifically available, utilitarian resources. Thomson argues that Heidegger’s engagement with modern painting seeks to develop an alternative paradigm, characterized as a concrete, phenomenological attempt to show how modernity can be transcended from within through reflection on art. Thomson amplifies Heidegger’s conviction that modernity implicitly influences the conceptual substrate of modern aesthetics into a critique of the motivating framework that continues to normatively determine the continuing grounding assumptions of the philosophy of art. I show that Thomson’s book, by revisiting Heidegger in this form, importantly intimates a way of transcending the philosophical disenfranchisement of art, by releasing art from its alethic alienation and reversing the inured philosophical narrative that still defines the relationship between representation and truth and, in the process, leads to a potentially radical reevaluation of aesthetic value. I argue that desires and emotions have a cognitive element that leaves them open to direct moral assessment. I maintain that a wide range of affects enter into moral reasoning as initial mappings of practical reasons onto the world. This suggests a way of characterizing conflicts between persistent desires and all-things-considered practical judgments. Such conflicts indicate that our considered judgments lack the status of wholehearted convictions. The dissertation culminates in a distinctive account of certain interpersonal obligations that builds upon this (...) idea of wholehearted conviction. ;In Chapter 1, I examine the conception of moral worth and the companion conception of virtue at work in Kant's seminal moral writings. I argue that these conceptions leave Kant without resources to explain the critical distinction between self-interested and malicious violations of duty. ;In Chapter 2, I ask how significant a revision must be made to Kantian moral theory in order to accommodate my criticisms. I argue that there are demanding affective preconditions for the full recognition of the equal moral standing of other humans, and that these provide the core of a more plausible conception of moral virtue than is usually associated with Kant. I maintain that the Kantian who accepts this picture of virtue must give up the attractive claim that we can always voluntarily will to do whatever morality requires. Such a Kantian might still preserve the essential Kantian equation of dutiful action and autonomy--here understood as self-governance in accordance with laws we wholeheartedly accept. ;In the course of Chapters 1 and 2, I argue that when there are conflicts between our desires and our all-things considered judgments of what we have reason to do, this shows that our considered beliefs are not wholehearted convictions. In Chapters 3 and 4, I attempt to show that the obligations which bind together intimates and fellow members of certain face-to-face communities are best analyzed in terms of wholehearted convictions. I argue that this approach is truer to the phenomenology of moral deliberation than rival analyses. (shrink)

It has become commonplace within feminist theory to claim that women’s lives are constructed by multiple, intersecting systems of oppression. In this thesis, I challenge the consensus that oppression is aptly captured by the theoretical model of “intersectionality.” While intersectionality originates in Black feminist thought as a purposive intervention into US antidiscrimination law, it has been detached from that context and harnessed to different representational aims. For instance, it is often asserted that intersectionality enables a representational politics that overcomes legacies (...) of exclusion within hegemonic Anglo-American feminism. I argue that intersectionality reinscribes the political exclusion of racialized women as a feature of their embodied identities. That is, it locates the failure of political representation in the “complex” identities of “intersectional” subjects, who are constructed as unrepresentable in terms of “race” or “gender” alone. Further, I argue that intersectionality fails to supplant race- and class-privileged women as the normative subjects of feminist theory and politics. In Chapter One, I demonstrate that intersectionality illicitly imports unitary concepts of “race,” “gender,” and “class.” In Chapter Two, I argue that intersectionality lacks a theory of hierarchy: it is a “flat geography” which cannot capture vertical and horizontal lines of power. In Chapter Three, I explore the role of analogical reasoning in rendering racialized women invisible both as gendered and as racialized subjects in twentieth-century social movements. To concretize this argument, I turn to Simone de Beauvoir’s use of race-sex analogies to describe (white, bourgeois) “women’s” situation in The Second Sex. In Chapter Four, I advance a programmatic unified account of oppression. I suggest that the possibility of a unified theory (as opposed to an intersectional one) is intimated in the concrete articulation of race, class, and gender. My point of departure is a phenomenology of capitalism, which reveals that these are all fundamentally modes of exploitation and appropriation. In Chapter Five, I theorize how they are made visible (and invisible) on the body. I extend Frantz Fanon’s account of “epidermalization,” drawing upon the marxian concepts of “fetishism” and “mode of appearance” to elaborate four structures of gendered racialized perception: first, the “miscegenation taboo” structures perceptions of the “purity” of whiteness and the “polluting” effects of blackness. Whiteness, theorised as a “possessive investment” and as “property” is defined by the right to exclude. Second, the “episteme of tellable differences” produces the conviction that we can automatically “tell the difference” between a body placed in one “racial” or gender category, and another—while bodies that temporarily confound classification cause fear and consternation. Third, the “race/reproduction bind” names the axiomatic assumption that “race” is reproduced through (heterosexual) procreation and that “race” is, therefore, biologically inheritable. Finally, the “fear/criminalisation reflex” refers to the bidirectional equation of particular racialised-gendered bodies with crime, and of crime with those bodies; this a function of the discursive use of ‘crime’ as an alibi for “race’” the systemic racialisation of punitive carceral institutions, and the historical origins of “race” in transatlantic chattel slavery, which shaped perceptual-cognitive associations of freedom with whiteness and captivity with blackness. Yet even in this lengthy and (...) variegated history of Sterne appreciation, "side by side" has more often than not proved to be a question of reading philosophy as literature's source and the key to its logic. In most secondary work on the novel, Sterne's references to empirical psychology appear as clues to a line of influence which leads, depending on the turn of the critic and his or her milieu, either back to a Lockean faith in self-knowledge and to a Humean skepticism with its residual stress on the realm of social accountability and the merits of mental association, or forward to the terrain of modernism, with its insistence on the constitutive power of language itself. From the ongoing measured attempts to monitor Sterne's use of Locke to the conviction, instigated by John Traugott in 1954, that Sterne's dramatization of rationalism shares much with David Hume's positive account of association, this complex critical history is well rehearsed, and its variants soundly warranted by Sterne's liberal borrowing from each of the well-stocked Rabelaisian, empiricist, and Augustan shelves of his own library.In recent decades, this critical debate runs towards a view of Sterne working self-consciously with an emergent sense of the aesthetic as a response to the epistemological quandaries of rationalism under pressure. The belief has led to very illuminating accounts of Hume's analysis of the emotional life and ita relationship to his more famous theories in epistemology.2 In spite of these, I think there is an egregious gap in Hume's psychology which we should not be tempted to suppose he has filled. He has, of course, been accused of such inconsistencies.3 His account in book 1 has itself been said to be inconsistent because he ascribes to the self there a tendency to confuse invariance and succession in telling us how we come to generate the fiction of continuing identity; such a story seems to ascribe a continuing reality to the mind in the very process ofshowing how the beliefin it can come toexistwhen there are onlysuccessive perceptions toconstitute it. This is a special application of a wider charge sometimes levelled against him, thatalthoughhisassociationism appearstoreduce allexplanation to relationships between perceptions, he is bound to depart from this restriction in ascribing tendencies and mistakes to the mind. Accordingly, Hume regards the three principles or laws of the association of ideas as a "kind of ATTRACTION, which in the mental world will be found to have as extraordinary effects as in the natural" (T, 12-13). In pursuit of his investigations Hume commences, in the first part of the Treatise, by insisting on the principle that all our simple ideas are derived from simple impressions and that impressions always precede their correspondent ideas (T, 4, 7). Consequently, even so able an interpreteter as Kemp Smith has been puzzled "why it was that [Hume] did not take the more easy line of allowing 'extensity' to the sensations of sight and touch. I begin with the romantic vision of aesthetic education as embodied in Friedrich Schiller, which Kierkegaard himself inherited, though in a critical and nuanced manner. Next, I explore Kierkegaard’s pointed critique of the romantics, namely through his conviction that they had misrepresented the role of imagination to the detriment of harmony in the individual. Finally, I present Kierkegaard’s positive (...) view of the simultaneity of factors, emphasizing his improvement on the romantics through the central category of “inwardness.” Throughout, I underline that Kierkegaard gave higher status neither to emotion nor reason, taking them as complimentary aspects of human existence and thereby inviting their reunion in the history of philosophy. The parable has much to say regarding holiness. It treats how to become holy and distinct acts of holiness, the exemplar of holiness, and the reality and effects of sin. In the history of interpretation, the parable (...) is taken to offer a model of the relationship between the fallen man and grace, the devil and the garment of virtue, the law and love, Christ and the Church. In short, the parable allegorizes salvation history.1I focus conversation about this parable through two interpretations-Pope Francis's Fratelli Tutti [FT], promulgated October 3, 2020, and William Langland's Piers Plowman [PP] circulating circa 1380. Some might hold that Francis's interpretation of the parable is ethical while Langland's is theological.2 Both interpretations of the parable are works of moral theology that intimate distinct understandings of what it means to embody [End Page 541] the Gospel and answer the universal call to holiness. In this essay, I outline the parable of the Good Samaritan as treated in Fratelli Tutti and Piers Plowman (first section), compare the major figures of the parable (second section), and compare their visions of charity (third section). In sum, I argue the encyclical sidelines crucial elements in the medieval figuration of the parable. Pope Francis elides critical issues of sin, agency, Christology, and the Church traditionally associated with this parable—all center on the Samaritan as Christ.Two Interpretations in OutlineFratelli Tutti's Parable of the Good SamaritanPope Francis's third encyclical, Fratelli Tutti, is unique in its genre. The encyclical includes all brothers and sisters in its scope of fraternity and social friendship and is addressed to all (§1). The inspiration for the encyclical includes St. Francis's visit to the Sultan some eight hundred years ago and the 2019 Document on Human Fraternity for World Peace and Living Together, a statement signed by Pope Francis and Sheikh Ahmed el-Tayeb, Grand Imam of Al-Azhar. Indeed, the joint document plays a critical role in the encyclical, sharing a common framework of a doctrine of creation and doctrine of God (FT §5). Because Pope Francis includes all of humanity in the audience of this encyclical and its sources of inspiration are broadly humanitarian, it is fair to raise a question about distinctively Catholic elements to the encyclical.The encyclical chapter devoted to the parable of the Good Samaritan (chapter 2 [§§56–86], treating Luke 10:25–37) intensifies these theological questions. A sign of the (...) esteem in which beauty is held can be gauged by the fact that so few articles significantly address any conception of beauty in education. Yet outside a purely educational regime, matters are treated somewhat differently albeit confusedly. In contrast to a virtual silence on this issue, a defense of beauty is modestly made in this article—one that claims that education is considerably ineffective without beauty and would be a poorer and unjust system of practice if beauty were merely seen as an irrelevance, a distraction from the serious stuff of management practice. What is broadly pursued is an attempt to portray an educational praxis that involves the suggestion that an active being in the world is someone who shows themselves to be in some exhortation of its beauty. An attempt is made to map out a few of the reasons why the sense of beauty is an important condition of being, a position few educationalists, so the arguments go in this article, can choose to take lightly. In what can be seen at times as a rather tasteless, aggressive, and doctrinaire educational climate, an education that is culturally alive and buzzing with the sounds, smells, images, rhythms, freedoms, play, knowledge, and rationalities that accompany and are inseparable from social and individual existence at intimate levels of being can revitalize teaching practice in more sensitive and magical ways. By exploring some of the reasons why we should not desensitize ourselves to beauty in education, it is possible to counter-argue for a greater retention and conviction of this experience. My supposition is that beauty as a poetic force should be regarded [End Page 94] as one of the defining characteristics central to pedagogic practice. In making this claim I draw upon a few of Charles Dickens's and William Wordsworth's ideas in support of the importance of beauty in education.IEnjoyment is not a psychological state among others, the affective tonality of empiricist psychology, but the very pulsation of the I.Emmanuel Levinas, Totality and Infinity2If it is the case that beauty is nothing other than the proper releasing of the human spirit, the grasping of delights, something fundamental to the capacity of our minds and body—"the form under which the intellect prefers to study the world"3 —then, we may wonder, why is current educational practice preoccupied with things of arguably less importance? The thought that "beauty is the basic impulse underlying education"4 —or as Carritt5 puts it, beauty instigates that which is morally worth cultivating, a recognition of something universally valid for humanity—strikes a certain agreement between Emerson, Scarry, and Carritt: namely, that beauty matters educationally. Indeed, Freud6 surmised that civilization could not survive without it, and Plato remarked that education "ought to end in the love of the fine and beautiful."7 Although these remarks may seem platitudinous, they may still nevertheless arouse within us a feeling that beauty is something quite immense, faithful, and necessary. With these ideas in mind, the aim here is to explain how certain aspects of beauty can be important for transcending some of the dystopia affecting educational practices together with some of the reasons why the intimacy of beauty is good for us. When the delicateness of beauty appears to be losing its appeal, it is perhaps no coincidence that a major reason why some students are disenchanted with education is because they fail to see the beauty in it. If beauty in society is losing its grip, what harshness or sadness will result?Let us begin with the obvious observation that a pluralist conception of beauty is a fact of life. Searle restricted intrinsic intentionality to occurrent neurophysiological states that are conscious in the sense that their owner has awareness of them when they occur; all occurrent nonconscious states of the brain have, at most, a derivative intentionality by reliably producing, unless obstructed, conscious intentional states. The grounds for thus restricting intrinsic intentionality are explored, and traced to Searle's conviction that aspectual shapes must be "manifest" whenever actually exemplified by an instance of any mental brain-occurrence. By "manifest," Searle seems to (...) mean that aspectual shapes must be not only contents but also, at the same time, objects of the very states whose contents they are. This is accomplished due to the self-intimating character of all conscious states, that is, their individually including awareness of the state itself. The question is why manifestation in this sense is necessary for an occurrent mental state to possess intentionality. Why cannot an occurrent mental state possess intentionality without also "manifesting" the aspectual shape that it exemplifies? If contents depend for existence on the individual's being aware, why must this be inner rather than outer awareness? Why can the essential awareness not be awareness of something outside the mental state, rather than awareness of the state's intentional content itself? Philosophers have almost always said something about emotions and passions whenever they have discussed human mental life. Many have asserted that it is some emotions or, more broadly, passions, that are to be primarily valued and sought. These valued passionate states of mind might include emotions, moods, desires, belief-like feelings of conviction and commitment, and romantic or erotic love, which are typically scarcely distinguished. Not only are these states of mind lumped together, but the reasons why they are valued (...) may likewise be various: they may be valued because of their intrinsic feeling (especially insofar as they are intense), through their long-term or deep effects on the rest of our practical and mental lives, through their effects on others’ lives, or even in the glimpse they give us of an object that transcends our mundane and superficial concerns, as in love, peak experiences, or intimations of God, Beauty, or Nature. Others have claimed that it is in the subduing or elimination of some or all of these passions that the ideal human life consists. Again, what precisely are the objectionable passions is typically not delineated, and why such mental states are objectionable may be diverse and even unspecified. One might resent their "disruptive" nature on our mental life, especially insofar as some of them stem from external, uncontrollable sources, and instead seek a calm state that is within one’s control and not subject to these whimsical externalities. Or one can see many or all passions as disruptive of control and success in our inner or outer life, or in the lives of others. MacMullan Introduction Lucius Outlaw and Shannon SuUivan are prominent contemporary philosophers of race who follow in the footsteps of W.E.B. Du Bois as they search for a theoretical understanding of race and a political solution to the problem of racism. They agree that the solution to racism is not found in the elimination of (...) the idea of race from our discourses as suggested by Naomi Zack and Anthony Appiah, but in a critical conservation of race that is nonhierarchical and committed to addressing the suffering of non-white racial groups.1 This moral and critical conservation of race makes Sullivan and Outlaw standard bearers for Du Bois's idea of the racial gift, which John Shuford writes is rooted in the conviction that, "'race' and race-consciousness are not the causes of racism and racial injustice, [and] that 'race' may be employed toward collective and mutual liberation."2 However, despite their inteUectual kinship regarding their broad approach to race, Outlaw and SuUivan come to a significant and iUuminating disagreement over the issue of whiteness. In Du Boisian terms, they disagree about whether white people, qua white, have a racial gift worth conserving. Outlaw recognizes the illegitimacy of the hierarchical racial taxonomies established during the Enlightenment era but accepts race as a real and meaningful feature of our social landscape. Revealing a strong affinity for Du Bois' approach to race, Outlaw imagines his work as, an inquiry into raciality and ethnicity via a treacherous "third path" between racism and invidious ethnocentrism, on the one side, and anti-racism and antiinvidious ethnocentrism, on the other. I want to argue…that to read Rossetti’s religious poetry with understanding requires a more or less conscious investment in the peculiarities of its Christian orientation, in the social and historical particulars which feed and shape the distinctive features of her work. Because John O. Waller’s relatively recent essay on Rossetti, “Christ’s Second Coming: Christina Rossetti and the Premillenarianist William Dodsworth,” focuses on some of the most important of these particulars, it seems to me one of the most useful pieces of (...) scholarship ever written on the poet. The essay locates the special ground of Rossetti’s religious poetry in that peculiar Adventist and premillenarian context which flourished for about fifty years in mid nineteenth-century culture. In point of historical fact—and it is a historical fact which has enormous significance for the aesthetic character of Rossetti’s poetry—her religious verse is intimately meshed with a number of particular, even peculiar, religious ideas.18 From the vantage of her strongest poetry, the most important of these ideas were allied to a once powerful religious movement which later—toward the end of the century—slipped to a marginal position in English culture.The whole question [of premillenarianism] was overshadowed first and last by the Tractarian Movement, Anglo-Catholicism, and the resulting Protestant reaction. And we can see in retrospect that all through the years [1820-1875] the theological future actually belonged to liberal, or Broad Church, principles. By the middle 1870s, apparently [the issues raised through the premillenarian movement] were no longer very alive.19­­In this context we may begin to understand the decline of Rossetti’s reputation after the late nineteenth century, when she was still regarded as one of the most powerful and important contemporary English poets. Her reputation was established in the 1860s and 1870s, when Adventism reached the apogee of its brief but influential career. Introduction Descartes held that reflection on "the commonest matters", for example our recognition of a piece of wax, reveals our more fundamental awareness of ourselves. And further, if the [notion or] perception of the wax has seemed to me clearer and more distinct, not only after the sight or the touch, but also after many other causes have (...) rendered it quite manifest to me, with how much more [evidence] and distinctness must it be said that I now know myself, since all the reasons which contribute to the knowledge of wax, or any other body whatever, are yet better proofs of the nature of my mind!2 Even if I only seem to see a piece of wax, when I have no eyes to see and there is no wax before me, I still know something. I know myself. When I judge that the wax is soft I am aware of myself as so judging. When I judge that the wax is hard, I am aware that I_ judge it so. I cannot have knowledge of external bodies without having certain knowledge of myself, because even my mere beliefs reveal my self-knowledge. Descartes exploited the insight that he is more intimately conscious of his own mind than anything else to establish that he is "a mind or a soul... a thing which thinks".3 Philosophers who did not share Descartes' rationalism still held the view that we are intimately conscious of ourselves, and that our awareness of other things enhances our self-awareness, and is epistemically dependent on it. Butler claimed that our awareness of ourselves was beyond doubt, since to doubt that awareness presupposes that we already have it. Whenever we "turn our thoughts upon ourselves" we have 48 "certain conviction, which necessarily and every moment, rises within us" of our personal identity. In A Treatise of Human Nature Hume argues against both the intelligibility of the notion of immaterial substance, and the claim that we have simple awareness of our selves independently of our awareness of other objects. when Hume turns his attention squarely to the topic of personal identity in the Treatise, he has already dismissed the rationalist notion of immaterial substance or soul. He attacks the view which tempted rationalists and empiricists alike, that our awareness of ourselves is distinct from our feeling and thinking, but is often enhanced by such experience. Hume's argument has been and continues to be influential. Recent Wittgenstein interpretation suggests that the Tractatus discussion of the unencounterability of the self in experience is directly borrowed from Hume.5 Chisholm's views concerning self-awareness are motivated in part by problems he locates in Hume's negative argument. Chisholm argues that the report that he finds no impression of self commits Hume to the existence of a subject of experience.6 Most recently, Nozick suggests that Hume did not consider the possibility that our awareness of ourselves might be isolated by employing •7 special techniques, such as yoga or meditation. In this paper I will focus on the passage in the Treatise where Hume reports his failure to find an impression of the self and presents this as an argument against the theory of self-awareness which many philosophers found irresistible. Although Hume's argument has been influential and is often discussed in contemporary literature, the Treatise passage in which it occurs appears confused. The confusion is cleared up only when it is seen that Hume really presents two 49 different arguments against the view that we are intimately conscious of ourselves. Finally I suggest how Hume's actual arguments pave the way for his positive views. 2. The Difficulty Hume's discussion of personal identity in the Treatise begins with his consideration of the view of "some philosophers, who imagine we are every moment intimately conscious of what we call our SELF."8 After characterizing the view, Hume rejects it, having found that we have no idea of self "after the manner it is here explain'd". Dwayne Giles shot and killed Brenda Avie, his ex-girlfriend, and claimed self-defense. At trial, to rebut Giles's testimony that she was the aggressor, prosecutors introduced statements that Avie had made three weeks before the shooting to a police officer responding to a report of domestic violence. Crying while she spoke, Avie told the officer that Giles had choked, punched, and threatened to kill her. After he was convicted of murder, Giles claimed that the admission of Avie's hearsay statement was a (...) violation of the Confrontation Clause. The state responded that the defendant had forfeited his right to confront Avie by killing her. In the last week of its last Term, the United States Supreme Court considered these arguments in California v. Giles. The case was decided in the wake of Crawford v. Washington and Davis v. Washington, which together transformed the Confrontation Clause and, as a consequence, the prosecution of domestic violence. Giles, which generated five opinions and exposed a Court deeply ambivalent about the reinterpreted confrontation right, has done little to impose order on this chaos. This Essay, which will be published in Lewis and Clark's symposium issue on Giles, contemplates the future of domestic violence prosecution in a period of uncertainty. My analysis endeavors to guide lower courts in the task of application and to map a course for the evolution of prosecutorial approaches to battering. I conclude that Giles represents a significant opportunity for those concerned about the constraints Crawford and Davis had seemed to place on the prosecution of domestic violence. For the first time, the Court has identified "the domestic violence context" as a relevant construct, thereby compelling lower courts to grapple with the particularities of violence between intimates. This is a remarkable shift in relatively short order, and it allows us to glimpse the possibility of a jurisprudence informed by the realities of battering. (shrink)

Through a series of texts and phone calls, Michelle Carter encouraged her boyfriend Conrad Roy to act on his suicidal thoughts, and after Roy killed himself, Carter was convicted of involuntary manslaughter. The case has received widespread attention, generating reactions ranging from rage at Ms. Carter to disbelief that she was convicted. An issue emphasized up to now is what it might mean for the First Amendment right of free speech if we hold that words can kill. In presenting the (...) case against punishing Ms. Carter, I show how the free speech issue intertwines with several others: Should the intimate exchanges between Carter and Roy have remained private? While privacy is valuable, it should not be a shield for harmful conduct, but did Ms. Carter, through her words, cause harm? If she believed that suicide would relieve Conrad of unbearable suffering, did she even act badly? And should the fact that society judges an individual’s actions to be immoral mean that the individual should be legally punished? The case serves as a touchstone for addressing fundamental issues of political, moral and legal theory with implications broader than whether Ms. Carter goes to prison. (shrink)

We have sought to expound how Jan van Ruusbroec goes about representing the relationship of love between God and human beings by proceeding from God’s inner life of love. Therefore, in the first part of our paper we elucidated Ruusbroec’s view of the inner love reality of the Triune God. In the second part we explained how genuine Christian mystical life is founded within the intra-trinitarian life of love. Prior to discussing the characteristics of Ruusbroec’s trinitarian position, we dwelled upon (...) the author’s development of his idea of the Trinity from a personal perception of his relation with God, the embedding of Ruusbroec’s love-mysticism in traditional Christian faith and his repeated clarification of the Triune God from two perspectives: God’s nature and God’s essence. We found that, in his explanation of God’s nature, Ruusbroec underlines its fruitfulness as a way of demonstrating that God is one dynamic of love, without beginning or end, which ceaselessly and simultaneously consists in “flowing out” and “being flowed back”. This phenomenon, we stated, he associates with the concept, “oneness in threeness” and “threeness in oneness”. Through an exposition on the differing features of unity and the Persons of the Trinity, we came to the conclusion that the author in all of his works combines both the origin of “flowing out” and “flowing-back” with the Holy Spirit as the bond or unity of love of Father and Son. From this we concluded that none of the Persons is the principle or source of regiratio, i.e. return, to the unity. The view that God’s unity of Persons is the principle of exitus-reditus – and not only the third Person as recent scientific research has sought to demonstrate – is what we consider to be the heart of Ruusbroec’s trinitarian way of thinking. We ascertained, further, that the author not only links the unity of the Persons with fruitfulness; he believes that the same “fruitful” unity, drawing in the divine Persons on the level of God’s nature, is the “enjoying” unity on the level of God’s essence. By means of the distinction between God’s enjoying unity and the unity of God’s fruitful nature, Ruusbroec explicates the true facts of the intra-trinitarian life of love. The perception leads him to conclude that God, as a unity of Persons, is ceaselessly and simultaneously working and enjoying. In the second part, we illustrated how Ruusbroec’s trinitarian thought mirrors the basis of his mystical doctrine: the conviction that mystics are unified with the divine Persons both in working and enjoying, and that they are one reality of love with God. We explained how the author, first of all, maintains that mystics, who bear a full likeness to God’s fruitful nature, ceaselessly turn to good works and virtues, just as God, ceaselessly, through the divine Persons, flows out in love. We then avered that the likeness to God’s nature is not the result of human effort and that it arises from God’s touch within the human mind. Moreover, we showed that Ruusbroec, in accordance with his intuition that God’s fruitful unity is both out-flowing and inwarddrawing, believes that God is both impelling humans outward toward virtues and drawing them into God’s unity of love. In analogy with the first part of our argument – as far as the “return” of humans is concerned – we ascertained that our author is stressing the initiative of God’s unity of the Holy Spirit, i.e. the mutual love between the Father and the Son. We found the emphasis on God’s inward-drawing unity to be of great significance, because God’s unity of love also plays a crucial role with respect to the transition to “enjoyment” of human beings in God’s essence. We clarified how human beings, according to Ruusbroec, through the likeness to God’s nature, participate in the enjoyment of God’s essence with the divine Persons. We pointed out that the union in God’s essence is the most intimate experience, but not the end-point of the mystical life as, according to our author, contemplatives are directed, again and again, to good works. Lastly, we arrived at the conclusion that Ruusbroec considers the mystical life, like the life of God, to be ceaselessly consisting of action and enjoyment. However, it is not primarily the analogy with God’s trinitarian reality of love that Ruusbroecs stresses. Basically, he accentuates the fact that mystics ceaselessly experience unification with the divine Persons, both in working and enjoying. This means that mystics, united with the divine Persons in one enjoyment on the level of God’s essence, concurrently experience that, with the divine Persons, they also “share” in God’s “flowing” and “ebbing” on the level of God’s nature. On the basis of this we have affirmed that, according to Ruusbroec, God’s activity and enjoyment in the “Divinity Itself” is God’s activity and enjoyment in the human being, and the inverse. Moreover, we have shown how the author considers both moments to occur simultaneously, both in God and in human beings, meaning that the mystical life is continuously one reality of love with God. It represents his first major foray into the field of historiography, preceding by a few (...) months his completion of the first book of the more famous History of Florence. 2 The Cicero contains many of the features upon which Bruni's reputation as a historian was later to be based. It is written in concise, elegant Latin; it demonstrates a high degree of sophistication in its handling of a wide range of source material; it reveals the workings of a mature, critical intelligence capable of formulating judgments that often go against the grain of accumulated tradition. 3 Nor should we be surprised that Bruni's breakthrough into such territory took place within the framework of biography. As early as 1928 Baron had found a place for the work within the scheme of "civic humanism," or Bürgerhumanismus as he then called his emerging concept. In his edition of Bruni's selected writings, Baron included a section from the Cicero, that dealing with the Roman statesman's literary output. 11 The decision to publish this extract rather than the whole work was in part dictated by Baron's conviction that most of Bruni's Cicero was a mere reworking of Plutarch and therefore unworthy of further attention. 12 But the choice of the section on Cicero's literary activity also depended on the fact that it contained statements which appeared to confirm Baron's view of Bruni as a "civic humanist." In particular, Baron emphasized Bruni's presentation of Cicero's literary studies as intimately connected with his political activity. In later years Baron often quoted these same passages in support of his "civic" thesis. 13This is not the place to discuss the wider implications of Baron's thesis itself. It will be enough to note that with regard to Bruni's Cicero, the "civic" focus was purchased at the expense of the work as a whole. One does not have to look very far into Bruni's Cicero to realize that it can hardly be described as subservient to Plutarch. Moreover, it contains passages in which Bruni shows himself to be much less sanguine than Baron about the supposed healthiness of the connection between letters and political life. Philosophers and doctors from the period immediately after Aristotle down to the second century CE were particularly focussed on the close relationships of soul and body; such relationships are particularly intimate when the soul is understood to be a material entity, as it was by Epicureans and Stoics; but even Aristotelians and Platonists shared the conviction that body and soul interact in ways that affect the well-being of the living human being. These philosophers were interested in the nature of (...) the soul, its structure, and its powers. They were also interested in the place of the soul within a general account of the world. This leads to important questions about the proper methods by which we should investigate the nature of the soul and the appropriate relationships among natural philosophy, medicine, and psychology. Politics is on the one hand an attempt to implement certain good, a desire for achieving agreed objectives, on the other hand – as Max Weber says – a simultaneous a#empt to avoid a particular evil. If in defining the notion of politics there are references to good and evil, purpose and desire, it has to include the non-political spheres – culture, axiology, religion. Mark Lilla argues that for decades we have been aware of the great and final separation that (...) has taken place in Western Europe between political and religious life. This awareness implies a conviction, which is obligatory today in most countries and societies, that to separate politics from religion is a great achievement. For many thinkers and politicians this is an undisputed success from which the West learns to benefit while preparing other regions of the world for such separation. Therefore it seems that modern politics should be free from religious inspiration and temptation. On the other hand, many sociologists and political scientists show the vitality of religious attitudes, proving that in its deepest essence religion is an expression of human behaviour. Each person and each community always has an element of irreducibility which is an internal defence against reducing man to “here and now”, restricting his world to what is useful and usable. We experience that in man there is a natural opening to what is transcendent. Thus, if man is ever to achieve individual and social reconciliation with himself, he will always look for rational and moral meanings. This situation creates a platform for the emergence of a completely new a#itude in society and politics – to seek and pursue spirituality in a world without religion. Increasingly, the understanding of religion reveals itself in a wide etymological sense, sociological and ethnological: religare – “to connect”, “to bind”, “to build community ties”. Religion so understood would be a great solution to the dilemma of separation – the adoption of religion (bonds) without the doctrine, while ensuring social cohesion, strengthening the feeling of being together, maintaining a spiritual connection. Many thinkers are convinced that we cannot base social life only on fear, discipline and economy; we need a deeper and stronger foundations for Community Cohesion. But is such a project possible at all? Is politics becoming a place for the formation of relationships, education and conservation of values, a narrative space which tells citizens what is good and right and what is wrong and alien? Can it replace religion in its deepest essence – in its intimate sense of an exploration and discovery of transcendence? Will it not become a caricature of religion, and a caricature of politics, and ultimately a trap for freedom? (shrink)

In studies on pre-modern South Asian religions, the Brāhmaṇical tradition is often singled out as being particularly restrictive of women’s independent agency, as evidenced in epic and dharmaśāstric passages prescribing men’s guardianship over women. Buddhism and Jainism are assumed to have offered women a greater degree of independence since they allowed women the option of pursuing monastic life. However, this article demonstrates that Jain texts, at least, share the ethos and sometimes even the language of the Brāhmaṇical guarding verses. Examining (...) discussions of male guardianship of women in post-canonical Śvetāmbara Jain monastic commentaries in light of dharmaśāstric treatments of the same theme demonstrates that Jain authors were no less concerned with guarding and protecting women in their communities. In the context of monastic life, monks must fulfill the role of the male guardian and overseer for the female members of their order, even though the resulting close involvement with the nuns presents problems for a community of professedly celibate men. The concern with community honor, and the conviction that women’s honor is intimately interlinked with it, overrides all other concerns even for Jain monastic communities. (shrink)

Luft’s contribution to this emerging wing of Husserl scholarship lies in the way he forces us to consider the possibility that certain fundamental Husserlian principles—most importantly, the “principle of all principles,” that is, the notion that intuitive demonstration is the indispensable bedrock of phenomenological philosophy—must be called into question when one attempts to advance beyond mere phenomenological description and develop a phenomenological system. It is both a basic conviction and a central conclusion of the book that “when one harbors (...) pronounced systematic aspirations, as Husserl does, one cannot dispense with speculative thinking”. Drawing on his intimate knowledge of Husserl’s late manuscripts on the reduction, Luft attempts to demonstrate this conclusion by contrasting Husserl’s approach to the issue of phenomenology’s systematic character with Fink’s outline of a phenomenological system in the Sixth Cartesian Meditation. Fink’s “merit,” Luft argues, is to have shown that phenomenology “cannot do without reflection on its systematic character”. More controversially, however, Fink also claims that such reflection “cannot itself proceed phenomenologically—or at least not only phenomenologically”. Husserl no doubt disagreed, but Luft, following Fink, argues that the systematic character of phenomenology “cannot be analyzed in the ‘straightforward’ manner” of standard phenomenological analysis.
