The editors of the JRE solicited short essays on the COVID‐19 pandemic from a group of scholars of religious ethics that reflected on how the field might help them make sense of the complex religious, cultural, ethical, and political implications of the pandemic, and on how the pandemic might shape the future of religious ethics.

“I would prefer not”HERMAN MELVILLE, BARTLEBY THE SCRIVENER: A STORY OF WALL STREET (1853), reprinted in THE PIAZZA TALES 32, 48 (London, Sampson Low, Son & Co. 1856). Scholars have recently challenged the claim in classical deterrence theory that law influences behavior only through the expected sanction imposed. Some go further and argue that law may also “shape preferences,” changing people’s wants and values. In this Article, we analyze existing claims that criminal and civil law alter preferences and conclude that (...) none suggest that the law shapes preferences. We first clarify this preference-shaping claim by elaborating the structure of rational choice theory generally and “preference” in particular. We then investigate three mechanisms of legal influence suggested by the preference-shaping literature: (1) the “serious harm” mechanism; (2) the “social norm” mechanism; and (3) the “self-improvement” mechanism. We then show that each of these mechanisms operates by changing the agent’s beliefs about the attributes or consequences of her choice options rather than by changing her preferences. (shrink)

How much injustice and oppression must be tolerated before a revolution is justified? In theory, the United States’ political structure, by design, makes the question of revolution obsolete: by putting political power into the hands of the people via democratic mechanisms such as voting, the division of power among separate branches of government, and representative influence and control, there should be no need for revolution because everything the government does either has the consent of the people or is (relatively swiftly) (...) checked by their dissent. In practice, the United States’ political structure has failed to bring about such democratic justice. Given structural, systemic failures of justice (which promise to be ongoing), it is worth asking when, if ever, a revolution in the United States would be justified. To begin answering this question, we first turn to three traditional theories of revolution prominent in Western political theory, all of which have serious theoretical and practical problems, many of which are exacerbated by the contemporary American context in which our discussion is situated. We conclude that, if the aim of revolution is to bring about justice more equally enjoyed by all, then classic Western justifications of revolution are deeply flawed and possibly untenable. We propose a Confucian-inspired account of revolution, which promises to provide criteria for engaging in revolution that are neither solely directly democratic nor completely rights-based. This relational, virtue-theoretic account of revolution enables us to take into consideration not only the role of government, the nature of the ruler, and the nature of the governed, but also the nature of the relationship between the ruler and the governed. We contend that our proposal provides more, and better, resources for thinking through when, and under what conditions, a revolution would be justified in the contemporary United States. (shrink)

Recent events have directed public attention to the issue of whether there should be so-called “statutes of limitations” on oppressive transgressions committed in the past. We ask: in such cases, is sociopolitical forgiveness (or “forgetfulness”) owed to transgressors? We detail two moral-political narratives that might help address this issue: one constructed around the values and perspectives of justice, rights, and autonomy-based views (the JRA approach), and another oriented around the values and perspectives of care ethics, virtue ethics, and relationality, drawing (...) additionally on several non-Western traditions including Buddhist and Confucian thought (the CVR approach). We maintain that while each approach has strengths, their essential tenets lead to serious shortcomings, such that neither is able to provide a wholly satisfactory solution to this pressing sociopolitical question. The resulting stalemate should be taken as a call to action for new theorizing by social and political theorists. How should we, as a society, handle the fact that people can do oppressive things at one age and then either forget about them or sincerely regret them at another age? Is there another approach out there that might solve this problem? (shrink)

Contemporary arguments about private paramilitary organizations often focus on the threat of physical violence that they pose to the state: if such organizations garner enough physical power, then they can overtake the state via violent coup. Inspired by the legalist scholar Han Feizi’s position, we contend that such organizations also represent a sociopolitical, existential threat to the state. Specifically, their tendency for ideological expansion and subsequent gathering of political influence undermines state institutions, even without the use of overt physical force. (...) Consequently, the sociopolitical enterprise of having a unified, stable state is incompatible with the existence of, and public political support for, private paramilitary organizations, regardless of their actual or potential physical power. This argument succeeds regardless of the moral status of such paramilitary groups. Such groups, when they match the essential components of the description Han Feizi provides, are practically and politically antithetical to the integrity of the state. (shrink)

Court D. Lewis, author of Repentance and the Right to Forgiveness, presents a rights-based theory of ethics grounded in eirenéism, a needs-based theory of rights (inspired by Nicholas Wolterstorff) that seeks peaceful flourishing for all moral agents. This approach creates a moral relationship between victims and wrongdoers such that wrongdoers owe victims compensatory obligations. However, one further result is that wrongdoers may be owed forgiveness by victims. This leads to the “repugnant implication” that victims may be wrongdoers who do (...) not forgive. Author Lewis addresses the “repugnant implication” by showing that victims are obligated to work toward forgiveness, if not forgiveness itself. Critic Gregory L. Bock argues that victims are not the only ones who can forgive, that the personal dimensions of forgiveness are overlooked, and that the force of the “repugnancy implication” may be questioned. Instead of rights-based eirenéism, Bock supports a virtue ethics framework. Instead of rights-based eirenéism, Bock encourages virtue ethics. Critic David Boersema raises questions about the binding nature of relationships, the dependency of flourishing upon forgiveness, and the nature of needs or rights. Boersema also questions the wisdom of a rights-based approach to forgiveness. Critic Jennifer Kling asks whether a rights-based approach is necessary to ground obligations to meet the needs of others: why not an ethics of care? If a rights-based approach is taken, perhaps a wrongdoer is obligated to not make forgiveness a life good. By disengaging this obligation, we avoid constraining a victim’s work toward forgiveness, especially when the wrongdoing is oppressive. Author Lewis responds to these objections. (shrink)

ABSTRACT:A wide range of research uses patterns of genetic variation to infer genetic similarity between individuals, typically referred to as genetic ancestry. This research includes inference of human demographic history, understanding the genetic architecture of traits, and predicting disease risk. Researchers are not just structuring an intellectual inquiry when using genetic ancestry, they are also creating analytical frameworks with broader societal ramifications. This essay presents an ethics framework in the spirit of virtue ethics for these researchers: rather than focus on (...) rule following, the framework is designed to build researchers’ capacities to react to the ethical dimensions of their work. The authors identify one overarching principle of intellectual freedom and responsibility, noting that freedom in all its guises comes with responsibility, and they identify and define four principles that collectively uphold researchers’ intellectual responsibility: truthfulness, justice and fairness, anti-racism, and public beneficence. Researchers should bring their practices into alignment with these principles, and to aid this, the authors name three common ways research practices infringe these principles, suggest a step-by-step process for aligning research choices with the principles, provide rules of thumb for achieving alignment, and give a worked case. The essay concludes by identifying support needed by researchers to act in accord with the proposed framework. (shrink)

While a number of valid molecular targets have been discovered for tumours over the past decade, finding an effective way of delivering therapeutic genes specifically to tumours has proved more problematic. A variety of viral and non‐viral delivery vehicles have been developed and applied in anti‐cancer gene therapies. However, these suffer from either inefficient and/or short‐lived gene transfer to target cells, instability in the bloodstream and inadequate tumour targeting. Recently, various types of non‐pathogenic obligate anaerobic and facultative anaerobic bacteria have (...) been shown to infiltrate and selectively replicate within solid tumours when delivered systemically. This has prompted the development of cancer gene therapy protocols that use such bacteria as gene delivery vehicles. Here, we review the evidence for the success of these in pre‐clinical models and clinical trials, as single modality treatments and in combination with conventional cancer therapies. When the COVID-19 surge hit New York City hospitals, the Division of Medical Ethics at Weill Cornell Medical College, and our affiliated ethics consultation services, faced waves of ethical issues sweeping forward with intensity and urgency. In this article, we describe our experience over an eight-week period (16 March through 10 May 2020), and describe three types of services: clinical ethics consultation (CEC); service practice communications/interventions (SPCI); and organizational ethics advisement (OEA). We tell this narrative through the prism of time, (...) describing the evolution of ethical issues and trends as the pandemic unfolded. We delineate three phases: anticipation and preparation, crisis management, and reflection and adjustment. The first phase focused predominantly on ways to address impending resource shortages and to plan for remote ethics consultation, and CECs focused on code status discussions with surrogates. The second phase was characterized by the dramatic convergence of a rapid increase in the number of critically ill patients, a growing scarcity of resources, and the reassignment/ redeployment of staff outside their specialty areas. The third phase was characterized by the recognition that while the worst of the crisis was waning, its medium- and long-term consequences continued to pose immense challenges. We note that there were times during the crisis that serving in the role of clinical ethics consultant created a sense of dis-ease as novel as the coronavirus itself. In retrospect we learned that our activities far exceeded the familiar terrain of clinical ethics consultation and extended into other spheres of organizational life in novel ways that were unanticipated before this pandemic. To that end, we defined and categorized a middle level of ethics consultation, which we have termed service practice communication intervention (SPCI). This is an underappreciated dimension of the work that ethics consult services are capable of in times of crisis. We believe that the pandemic has revealed the many enduring ways that ethics consultation services can more robustly contribute to the ethical life of their institutions moving forward. (shrink)

Throughout the biological and biomedical sciences there is a growing need for, prescriptive ‘minimum information’ (MI) checklists specifying the key information to include when reporting experimental results are beginning to find favor with experimentalists, analysts, publishers and funders alike. Such checklists aim to ensure that methods, data, analyses and results are described to a level sufficient to support the unambiguous interpretation, sophisticated search, reanalysis and experimental corroboration and reuse of data sets, facilitating the extraction of maximum value from data sets (...) them. However, such ‘minimum information’ MI checklists are usually developed independently by groups working within representatives of particular biologically- or technologically-delineated domains. Consequently, an overview of the full range of checklists can be difficult to establish without intensive searching, and even tracking thetheir individual evolution of single checklists may be a non-trivial exercise. Checklists are also inevitably partially redundant when measured one against another, and where they overlap is far from straightforward. Furthermore, conflicts in scope and arbitrary decisions on wording and sub-structuring make integration difficult. This presents inhibit their use in combination. Overall, these issues present significant difficulties for the users of checklists, especially those in areas such as systems biology, who routinely combine information from multiple biological domains and technology platforms. To address all of the above, we present MIBBI (Minimum Information for Biological and Biomedical Investigations); a web-based communal resource for such checklists, designed to act as a ‘one-stop shop’ for those exploring the range of extant checklist projects, and to foster collaborative, integrative development and ultimately promote gradual integration of checklists. The increasing use of pharmacotherapy raises specific ethical concerns for psychologists working with vulnerable populations. Due to a shortage of trained specialists, professionals without training in mental health, such as primary care providers, are increasingly prescribing and monitoring psychotropic medications. Vulnerable populations face additional barriers to mental health treatment and are at heightened risk when these factors intersect. Hence, these patients experience unique barriers to receiving optimal psychopharmacological care and are differentially vulnerable to deleterious outcomes associated with misdiagnosis and overmedication. (...) Taken together, these factors fuel inequities in the access, quality, and utilization of mental health care. Psychologists working with these patients are ethically mandated to protect patients from harm and ensure equitable care across patient populations. Specifically, psychologists must respond to the dilemma of how to effectively treat patients within these vulnerable populations who have been misdiagnosed or poorly medicated while remaining within the bounds of their competence. This article recommends pathways to address these dilemmas through education, training, research, and advocacy. (shrink)

Education is experiencing a case of misplaced accountability, where an exclusive reliance on high stakes tests overlooks the more subtle judgments of teachers and professional educators and, because of its simplicity, passes as democratic. This article investigates the theoretical underpinnings of current accountability initiatives and draws upon extensive teacher interviews to reveal the practical aspects of accountability pressures in schools today. We provide a discussion of local teacher knowledge that exposes teachers' commitments to a deeper sense of successful education that (...) is eclipsed by testing and that offers a richer resource for improving classrooms and educational outcomes. We provide a discussion of educational foundations and policy that rethinks democratic goals and encourages educationists to shift the current debate in order to make accountability truly democratic. This article suggests that the contemporary climate of accountability may be misplaced in its intentions. (shrink)

A multi-method, multi-informant method was used to collect data from diverse stakeholders about school climate to inform school improvement efforts as part of the Positive Behaviour Intervention Supports framework. Teachers, administrators, school staff and students completed surveys and parents participated in focus groups to gather perspectives about school climate. Respondents identified safety as a strength at the school, staff and student results suggested interpersonal relationships as an area for improvement and staff identified parent involvement as an area for growth. Both (...) positive and negative perceptions of school climate emerged from the parent focus group. While there are limitations to the generalisability of the results, this case study provides a useful approach for schools to assess their school climate and establish goals for improvement. Background: Post-traumatic stress disorder is a prevalent, debilitating, and costly psychiatric disorder. Evidenced-based psychotherapies, including Cognitive Processing Therapy, are effective in treating PTSD, although a fair proportion of individuals show limited benefit from such treatments. CPT requires cognitive demands such as encoding, recalling, and implementing new information, resulting in behavioral change that may improve PTSD symptoms. Individuals with PTSD show worse cognitive functioning than those without PTSD, particularly in acquisition of verbal memory. Therefore, memory dysfunction may limit treatment gains in (...) CPT in some individuals with PTSD. Methods and Analysis: Here, we present a protocol describing the Cognition and PsychoTherapy in PTSD study, a prospective, observational study examining how cognitive functioning affects treatment response in CPT for PTSD. The study aims to recruit 105 outpatient veterans with PTSD between the ages of 18 and 70 years. Prior to beginning 12 sessions of CPT, Veteran participants will have standardized assessments of mood and functioning and complete a comprehensive neurocognitive battery assessing episodic learning, attention and speed of processing, language ability, executive control, and emotional functioning. This study aims to fill gaps in the current literature by: examining the specificity of memory effects on treatment response; exploring how baseline cognitive functioning impacts functional outcomes; and examining potential mechanisms, such as memory for treatment content, that might explain the effects of baseline memory functioning on PTSD symptom trajectory. Discussion: If successful, this research could identify clinically relevant neurocognitive mechanisms that may impact PTSD psychotherapy and guide the development of individualized treatments for PTSD. Actualist counterpart theory replaces David Lewis’s concrete possible worlds and individuals with ersatz worlds and individuals, but retains counterpart theory about de re modality. While intuitively attractive, this view has been rejected for two main reasons: the problem of indiscernibles and the Humphrey objection. I argue that in insisting that ersatz individuals play the same role as Lewisian individuals, actualists commit the particularist fallacy. The actualist should not require stand-ins for every Lewisian individual. Ersatz individuals should instead be construed (...) as representations of actually existing qualitative ways for individuals to be, or qualitative properties individuals can instantiate. This necessitates changes elsewhere. Non-instrumental uses of Kripke semantics and standard counterpart semantics also require stand-ins for particular non-actual individuals. I argue that the actualist should instead adopt a non-standard counterpart semantics that more clearly illuminates the role that actual properties and relations play in explaining de re possibilities and necessities. The result is an intuitive and forceful reply to both the problem of indiscernibles and the Humphrey objection. (shrink)

Disturbances of consciousness, including fluctuations in attention and awareness, are a common and clinically important symptom in dementia with Lewy bodies. In the present study we investigate potential mechanisms of such disturbances of consciousness in a clinicopathological study evaluating specific components of the cholinergic system. [3H]Epibatidine binding to the high-affinity nicotinic receptor in the temporal cortex differentiated DLB cases with and without DOC, being 62–66% higher in those with DOC. The were no differences between DLB patients with or without DOC (...) in 125I-labeled α-bungaratoxin binding to the low-affinity nicotinic receptor, [3H]pirenzepine binding to the muscarinic M1 receptor, or in choline acetyltransferase activity. These findings provide support for the hypothesis that cholinergic activity is an important neural correlate if consciousness and suggest a mechanism of DOC in DLB involving alterations in the nicotinic receptor, composed of predominantly α4 and β2 subunits. Reeder's 1978 essay on “Religious Ethics as a Field and Discipline,” this essay explores debates surrounding the original intentions for the Journal of Religious Ethics (JRE) and for the field of religious ethics, as these have played out over the decades among an influential group of scholars involved with the JRE since its inception: Arthur Dyck, Ronald Green, Stanley Hauerwas, and Jeffrey Stout. While the JRE and its founding mission are in need of ongoing critique (...) and transformation, we might well still affirm the journal's ongoing importance as a site for the negotiation of a commons, the identification of possibilities for shared life, imagined beyond exclusion and domination. Someone saw someone who knew someone, who’d remembered someone, and again the stories were abroad, the whisperings, only this time it was with heavy sighs of regret and anxious handwringing: How could we not have known better? How could our parents not have known? And if they, the parents, had known—and surely some of them had—they were too busy themselves, and perhaps too ashamed, too abashed to see it for what it was, and after all, busy and perplexed with their own lives, their own divorces or philandering husbands or careers that felt like prison, with alcoholism and dying parents, with inheritances and bright futures withered to nothing. All those bright promises of their bright and perfect childhoods curling like so many brown November leaves. His name was Mr. Bryce—Evan Bryce, as we later came to call him—and he was among the most popular, perhaps the most popular, of the upper-school teachers, with a yearly following of students lucky enough not only to have been enrolled in one of his classes, but allowed, as if by virtue of their own charmed stars, their own charming uniqueness, to lean against his desk during free time, or joke around with him as he walked, his battered book bag in hand, toward the lunchroom. He 492 Jennifer Anne Moses taught history and geography; his classroom was the first on the left as you rounded the corner from the art room to the open-air corridor that the upper school classrooms abutted. Beyond that strip of covered poured white concrete was a kind of rough lawn, made patchy by years of boys tackling each other there or throwing a Frisbee around, and beyond that, on the other side of a narrow gravel road used only, as far as we could tell, by the school’s groundskeepers whose names, despite their ubiquitous presence, we didn’t know, was the first of the playing fields, used for hockey and soccer. Beyond the playing field was a covered sports arena with a huge swooping roof like the wings of a swan, and beyond that, hills covered with mowed green grass—perfect for tumbling down on bright spring days—and others still wooded, watered with streams and crisscrossed with trails. We knew the trails of course— some of our natural science classes took place in the woods—and we knew each of the hills and fields as well, each tree, each row of boxwoods or pines, until finally, out there, beyond the school grounds, was where the residents of the town lived in red-brick development houses of two and sometimes one-and-a-half floors, in modified colonials and California-style split-levels, each on its own small patch of lawn, and a garage. We felt sorry for the people who lived in those developments (we always called them developments, never neighborhoods, which is where we lived), but we rarely wondered what their lives might be like, or where their children, if they had them, might go to school. Our houses weren’t like that, of course. Susie Bluestone’s house was old, tall and thin, in a neighborhood of other old, tall, thin houses, with Oriental carpets running up the stairways, and a laundry shoot that the children were forbidden to play in and played in anyway. My best friend Nan Jones lived in a farmhouse on the top of a hill and wasn’t allowed to use the guestroom bathroom, even though her room was right next to it; her mother kept horses and her father had once been some kind of fencing champion. John Dewey began his career as an absolute idealist, holding that the universe is a construct of an absolute mind in which human minds participate; human ideas are true when they reproduce the absolute's ideas; and human conduct is right when it realizes the absolute's goals for human progress. Twenty years later Dewey had abandoned idealism for instrumentalism, asserting that ideas are instruments for the manipulation of human experience and that conduct is right when it generates a satisfactory relationship between (...) agents and their environments. However, scholars disagree about when, why, and how this transformation of Dewey's thought occurred. I review the development of Dewey's moral epistemology from 1884 to 1908 to answer these questions. ;In chapters I and II, I examine the sources and nature of Dewey's early idealism, relating it to the views of contemporary idealists such as T. H. Green, F. H. Bradley, G. S. Morris, and to the views of A. Comte. By the latter Dewey was inspired to seek a reconciliation of physical science and morals, despite the reservations of his fellow idealists. In Chapters III and IV, I discuss Dewey's first two ethics texts , each an attempt to overcome idealist objections to reconciling ethics and science. Both were critical failures, forcing Dewey to rethink his position. In chapter V, I argue that collaboration with experimental psychologists at the University of Chicago transformed Dewey's understanding of science. He then came to see scientific ideas and principles as instruments for manipulating human experience and, gradually, all ideas in the same light. By 1902, Dewey had abandoned his earlier idealist notions for instrumentalism and begun to construct new arguments for reconciling science and ethics. In chapters VI and VII, I explicate and defend the reconciliation Dewey achieved through use of his new instrumentalist moral epistemology in his 1908 Ethics. (shrink)

Across the European Union, the receipt of agricultural subsidisation is increasingly being predicated on the delivery of public goods. In the English context, in particular, these changes can be seen in the redirection of money to the new Environmental Land Management scheme. Such shifts reflect the changed expectations that society is placing on agriculture—from something that provides one good (food) to something that supplies many (food, access to green spaces, healthy rural environment, flood resilience, reduced greenhouse gas emissions). Whilst (...) the reasons behind the changes are well documented, understanding how these shifts are being experienced by the managers expected to deliver on these new expectations is less well understood. Bourdieu’s social theory and the good farmer concept are used to attend to this blind spot, and to provide timely insight as the country progresses along its public goods subsidy transition. Evidence from 65 interviews with 40 different interviewees (25 of whom gave a repeat interview) show a general willingness towards the transition to a public goods model of subsidisation. The optimisation and efficiency that has historically characterised the productivist identity is colouring the way managers are approaching the delivery of public goods. Ideas of land sparing and land sharing (and the farming preference for the former over the latter) are used to help understand these new social and attitudinal realities. The policy implications of these findings are discussed, with reference to the new scheme’s ‘priority themes’. (shrink)
