Although the Federal Common Rule requires that informed consent documents include all material information, it does not specify the content of materials used to recruit human subjects. In particular, there is no federal regulation relating to how payment for research participation is to be advertised. Rather, the FDA has issued guidance, advising researchers not to emphasize payment information. In order to determine how IRBs have interpreted this guidance, we coded the policies of the top 100 institutions by receipt of NIH (...) funding, in order to determine whether they require, permit, or forbid researchers to disclose the amount of compensation in their recruitment materials. We found that the vast majority of institutions implicitly or explicitly permit such disclosures; however, there are a significant number of IRBs at each extreme, some discouraging or forbidding with others encouraging or mandating such disclosures. Such heterogeneity in local regulations suggests that IRB discretion may be imposing costs on human subjects and the scientific enterprise that outweigh the benefits. We suggest that this heterogeneity should be resolved towards a national consensus on permissibility. (shrink)

The payment of human subjects is an area where Institutional Review Boards have wide discretion. Although the “Common Rule” requires the provision of full information to human research participants to secure valid consent, the Rule is silent on the issue of payment. Still, some federal agencies offer guidance on the matter. For example, the National Science Foundation cautions that high payments for risky research “may induce a needy participant to take a risk that they normally would prefer not to take.” (...) For research under its purview, the Food and Drug Administration guidance provides that “[a]dvertisements may state that subjects will be paid, but should not emphasize the payment or the amount to be paid, by such means as larger or bold type.” One might read the FDA guidance to permit the advertisement for human subjects to state the specific amount of payment, as long as it is not emphasized. Efforts to institutionalize ethics in corporations have been discussed without first addressing the desirability of norm conformity or the possibility that the means used to elicit conformity will be coercive. This article presents a theoretical context, grounded in models of social control, within which ethics initiatives may be evaluated. Ethics initiatives are discussed in relation to variables that already exert control in the workplace, such as environmental controls, organizational controls, and personal controls.

Microbiologists are transitioning from the study and characterization of individual strains or species to the profiling of whole microbiomes and microbial ecology. Equipped with high-throughput methods for studying the taxonomic and functional characteristics of diverse samples, they are just beginning to encounter the conceptual, theoretical, and experimental problems of comparing taxonomy to function, and extracting useful measures from such comparisons. Although still unresolved, these problems are well studied in macro-ecology and are reiterated here as an historical precautionary for microbial ecologists. (...) Beyond expected and unresolved terminological vagueness, we argue that assessments and comparisons of taxonomic and functional profiles in micro-ecology suffer from theoretically unresolvable arbitrariness and ambiguities. We divide these into problems of scale, individuation, and commensurability. We argue that there is no technically/theoretically “correct” scale, individuation, or comparison of taxonomy and function, but there are nonetheless better and worse methodologies for profiling. ‘The Debauched Commons: A Dark Parable’ summarizes issues regarding intellectual property rights and immaterial culture through a nuanced reading of how First Nations Peoples worldwide have been forced by forms of neoliberal-capitalist exploitation of the knowledge commons to ring-fence and/or commodify their lived traditions, in many cases dating back 100,000 years and clearly predating any and all Western (First World) concepts of ownership. The intention of the structuralist-inspired reading of this enforced defensive position is to emphasize and clarify issues concerning (...) prior art and moral rights, two of the most ambiguous and gamed elements of copyright and patent law. Drawing upon the international context of the _Declaration on the Rights of Indigenous Peoples_ (2007) and the _Convention for Safeguarding Intangible Heritage_ (2003), this essay will focus, in part, on the travails of Aboriginals in Australia as representative of First Peoples worldwide and their long-exploited and long-expropriated traditions, inclusive of land, but foremost _lived knowledge_, but also their often compromised position _vis-à-vis_ various Australian state and Commonwealth legislation concerning recognition of their copyright, moral rights, and intellectual property rights. In this complex dance between tradition, heritage, and law, the so-called public domain often also becomes a de facto warehouse for the eventual conversion of intangible rights to collectively held and stored cultural property, which is then leveraged and/or converted to cultural capital by both public institutions and private companies. The primary premise of the analytic to be applied is that commodification of knowledge is more or less co-equal to the digitization of culture and the regimes of expropriation and/or outright theft associated with platform cultures. Platform culture, in turn, implicates otherwise benign, or apparently benign institutions (for example, academia and the art world) claiming to advance understanding and resolution of the twin nemeses of post-contemporary cultural politics—diversity and justice. The subtle machinations of what has come to be called the art-academic industrial complex will thus be analyzed for implicit and explicit practices that are reducible to the appropriation of native rites and rights, and laws and lores, for self-serving reasons inclusive of radical-chic posturing and politically correct tokenism. In this paper, we present an ethical and strategic approach to managing organizational crises. The proposed crisis management model (1) offers a new approach to guide an organization’s strategic and ethical response to crisis, and (2) provides a two-by-two framework for classifying organizational crises. The ethically rational approach to crisis draws upon strategic rationality, crisis, and ethics literature to understand and address organizational crises. Recent examples of corporate crises are employed to illustrate the theoretical claims advanced. The huge bailouts launched by governments are symptomatic of the crisis in political economy, just as they were post-2008. “Too big to fail” has sponsored monsters that refuse to back off without threatening the collapse of the entire system. Francisco Goya’s “The sleep of Reason produces monsters …” comes to mind. -/- Physical and immaterial culture, in our current Western civilisation, are intimately linked. Yet the focus for urban design is generally on the material or physical side, with the immaterial left to its own devices. Increasingly, urban design measures are merely ameliorative and aesthetic, with the larger share shaped by a political economy dictated by market ideology or “politicalology.” What transpires, nonetheless, is an immaterial commons that constitutes a public or private intellectual commons – often a mix of the two; but, in the case of domination by market ideology, the privatization of “general intellect” proceeds by abject appropriation. In such a technocratically driven model, subjective states become increasingly important. As Indian architect Balkrishna Vithaldas Doshi once said, “Smart cities are smart people.” -/- How might these two otherwise contiguous and synchronous systems be brought back into a properly civic-minded rapport with or without crisis-driven change? The idea of the “film essay,” from Alexandre Astruc to Harun Farocki, concerns arguments for and/or against cinema and its truth-telling apparatuses. For example, as discordant and often-dark elegy for themes present in everyday cultural criticism, yet themes often eclipsed by rationalist and neo-positivist biases, the subjective states of the “film essay” hold considerable promise toward new visual methodologies or procedures for psychogeographical inquiry in landscape-architectural discourse – through foregrounding novel forms of so-called vision plans toward the much-needed short circuit (...) of persistent analytical models grounded in programmatic hubris. When applied to environmental design disciplines, the reverie-inducing “film essay” acts as a critique of the usual rules and biases of project design development and presentation methodologies, conjuring possible futures for sites that do not automatically default to utilitarian concerns and/or mere political expediency. Alain Badiou’s theoretical work maintains an ambiguous relation to Marx’s critique of political economy. In seemingly refusing the Marxian analytical strategy of displacement and referral across the fields of politics and economy, Badiou is frequently seen to be lacking a rigorous theoretical grasp of capitalism itself. In turn, this is often seen as a consequence of his understanding of political subjectivity. But the origins of this ‘lack’ of analysis of the social relation called ‘capital’ in his work can also be (...) investigated by means of a detour into the economic writings of theUnion des communistes de France marxiste-léniniste, the political organisation in which Badiou played a leading rôle throughout the 1970s in particular. By excavating this theoretical work of the 1970s, we can identify more precisely the historical and political reasons behind Badiou’s ambiguous relation to Marx and specifically to Marx’s systematic grasp of the logic of capital. This excavation will consequently lead us to a reflection on the limits and openings in Badiou’s thought for the Marxian critique of political economy. (shrink)

Simple heuristics that make us smart presents a valuable and valid interpretation of how we make fast decisions particularly in situations of ignorance and uncertainty. What is missing is how this intersects with thinking under even greater uncertainty or ignorance, such as novice problem solving, and with the development of expert cognition.

Big Data has been variously defined in the literature. In the main, definitions suggest that Big Data possess a suite of key traits: volume, velocity and variety, but also exhaustivity, resolution, indexicality, relationality, extensionality and scalability. However, these definitions lack ontological clarity, with the term acting as an amorphous, catch-all label for a wide selection of data. In this paper, we consider the question ‘what makes Big Data, Big Data?’, applying Kitchin’s taxonomy of seven Big Data traits to 26 datasets (...) drawn from seven domains, each of which is considered in the literature to constitute Big Data. The results demonstrate that only a handful of datasets possess all seven traits, and some do not possess either volume and/or variety. Instead, there are multiple forms of Big Data. Our analysis reveals that the key definitional boundary markers are the traits of velocity and exhaustivity. We contend that Big Data as an analytical category needs to be unpacked, with the genus of Big Data further delineated and its various species identified. It is only through such ontological work that we will gain conceptual clarity about what constitutes Big Data, formulate how best to make sense of it, and identify how it might be best used to make sense of the world. Sullivan presents a novel examination of Wittgenstein’s later writings by (...) providing historical detail about the uptake, understanding and use of Wittgenstein’s remarks and method in psychology and related areas of social science, examining persistent sources of conceptual confusion and showing how to apply his insights in investigations of collectives, social life, emotions, subjectivity, and development. In doing so, he reveals the value for psychologists in adopting a philosophical method of conceptual investigation to work through and become more reflexive about prominent theories, methods, therapies and practices in their respective, multiple fields and thereby create a resource for future theoretical, empirical and applied psychologists. This work will be of particular relevance to students and academics engaged in the history of psychology and to practitioners interested in understanding the continued importance of Wittgenstein’s work within the practices of psychology. While Jacques Derrida’s influence on posthumanist theory is well established in the literature, given Martin Heidegger’s influence on Derrida, it is surprising to find that Heidegger’s relationship to posthumanist theory has been largely ignored. This article starts to fill this lacuna by showing that Heidegger’s writings not only influences but also has much to teach posthumanism, especially regarding the relationship between humanism and posthumanism. By first engaging with Heidegger’s destruction of metaphysics and related critique of anthropocentrism, I show that, while (...) rejecting Heidegger’s conclusions for being too humanist, posthumanism shares, and indeed is largely unreflectively defined by, Heidegger’s critique of the binary logic underpinning anthropocentric humanism. With this, posthumanism aims to go beyond Heidegger by overcoming all forms of humanist understanding, an attempt that brings us back to the relationship between humanism and posthumanism and Heidegger’s notion of trace. With this, I not only show that Heidegger influences posthumanism through his destruction of metaphysics, critique of anthropocentrism and notion of trace, but also point towards an understanding of posthumanism that distinguishes it from humanism and transhumanism. The present and future rapid increase in the hospital population of geriatric patients is discussed with particular reference to the problem of advanced brain degeneration. The consequences of various clinical management options are outlined and it is suggested that extreme attempts either to preserve or terminate life are medically, morally and socially unacceptable. The preservation of life in senile patients has important economic consequences. In achieving a decision on the medical management of patients with advanced brain decay it is suggested (...) that substantial help would be derived from: knowledge of the previously declared wishes of individual patients; improvements in geriatric assessments; broader consultation with relatives, and greater use of inter-disciplinary discussion in the preparation of criteria for terminating medical efforts to maintain survival. Today’s bodies are akin to ‘walking sensor platforms’. Bodies either host, or are the subjects of, an array of sensing devices that act to convert bodily movements, actions and dynamics into circulative data. This article proposes the notions of ‘disembodied exhaust’ and ‘embodied exhaustion’ to conceptualise processes of bodily sensorisation and datafication. As the material body interfaces with networked sensor technologies and sensing infrastructures, it emits disembodied exhaust: gaseous flows of personal information that establish a representational data-proxy. It is this (...) networked actant that progressively structures how embodied subjects experience their daily lives. The significance of this symbiont medium in determining the outcome of interplays between networked individuals and audiences necessitates that it is carefully contrived. The article explores the nature and function of the data-proxy, and its impact on social relations. Drawing on examples that depict individuals engaging with their data-proxies, the article suggests that managing a virtual presence is analogous to a work relation, demanding diligence and investment. But it also shows how the data-proxy operates as a mode of affect that challenges conventional distinctions made between organic and inorganic bodies, agency and actancy, mortality and immortality, presence and absence. This concept, which has often resurfaced in works by Negri, Spivak, Virno and numerous other contemporary thinkers, has a long prehistory in the work of Marx and subsequent Marxist theorists, perhaps most importantly in the work of Uno Kōzō, arguably the most influential and widely known Marxist thinker in modern Japan. Uno’s work, and (...) particularly his major theoretical works of the 1950s, developed an entirelogicalanalysis of the peculiar position of the labour-power commodity within capital’s drive, noting that this site marks the place wherein capital’slogical interiorand itshistorical exteriorinterpenetrate each other, generating a volatile force of excess at the core of capital’s supposedly smooth and pure circuit-process. By developing around this point an extensive theoretical discussion of its dynamics ofimpossibilityorirrationality, centred on a term –muri– that he raises to the level of a concept, Uno formulates a series of original theses in methodology, on the concept of population, and particularly around the figures of thelogicaland thehistoricalin the critical analysis of capitalism. Focusing in particular on this ‘impossibility’ ormurithat is nevertheless constantly ‘passing through’ the capital-relation, this essay investigates the entire range of Uno’s analysis, revealing not only a crucial thread of theoretical inquiry that remains contemporary for us today, but also another set of possibilities linking the critique of political economy to the renewal of revolutionary politics. In the operation of a health care system, defining the limits of medical care is the joint responsibility of many parties including clinicians, patients, philosophers and politicians. It is suggested that changes in the potential for prolonging life make it necessary to give doctors guidance which may have to incorporate certain features of utilitarianism, individualism and patient-autonomy.

This paper explores the embedding of data producing technologies in people's everyday lives and practices. It traces how repeated encounters with digital data operate to naturalise these entities, while often blindsiding their agentive properties and the ways they get implicated in processes of exploitation and governance. I propose and develop the notion of ‘data doxa’ to conceptualise the way in which digital data – and the devices and platforms that stage data – have come to be perceived in Western societies (...) as normal, necessary and enabling. The ‘data doxa’ concept also accentuates the enculturation of many individuals into a data sharing habitus which frames digital technologies in simplistic terms as panaceas for the problems associated with contemporary life, figures of progress and convenience, and mediums of knowledge, pleasure and identity. I suggest that three types of data-based relations contribute to the formation of this doxic sensibility: fetishisation, habit and enchantment. Each of these relations come to mediate public understandings of digital devices and the data they generate, obscuring the multifaceted nature and hidden depths of data and their propensity to double up as technologies of exposure and discipline. As a result of this situation, imaginative educational programs and revamped regulatory frameworks are urgently needed to inform individuals about the contribution of data to the leveraging of value and power in today's digital economies, but also to protect them from experiencing data-based harms. In this article, I criticize environmental sociology’s conventional diagnosis of its methodological situation and overly narrow definition of its field. I argue for a greater engagement with the natural science base and consideration of anthropological approaches. I start with conceptual analysis, identifying the human-environment relationship as a pro-active two-way interaction. I then present an outline of global environmental dynamics, highlighting the unequal size of human activities on geosphere and biosphere scale, and the role of the biosphere as manager of the (...) geosphere, this as context for the human population problem. Three types of environmental problems are next identified: urban-industrial, rural-agrarian, and high hazard exposure. These are seen as forming a continuum, with anthropogenic and natural factors synergizing at the centre. I comment on their geographic distribution, noting Europe’s limited and specific environmental experience. Lastly I attempt an overview without biological metaphors of the humanenvironment relationship through time, commenting on its inherent imbalances and how these might be diagnosed. I conclude that sociology’s bias to modernity and the West renders it inadequate to the global environmental question. A wider and deeper spacio-temporal consideration is needed, with the whole continuum of environmental problems considered. For this, environmental sociology should seek a synthesis with cultural anthropology centring on the anthropological concept of culture, an approach, I argue, that is accessible through the sociology of Max Weber.
