The tendency towards an increasing integration of the informational web into our daily physical world (in particular in so-called Ambient Intelligent technologies which combine ideas derived from the field of Ubiquitous Computing, Intelligent User Interfaces and Ubiquitous Communication) is likely to make the development of successful profiling and personalization algorithms, like the ones currently used by internet companies such as Amazon, even more important than it is today. I argue that the way in which we experience ourselves necessarily goes through (...) a moment of technical mediation. Because of this algorithmic profiling that thrives on continuous reconfiguration of identification should not be understood as a supplementary process which maps a pre-established identity that exists independently from the profiling practice. In order to clarify how the experience of one’s identity can become affected by such machine-profiling a theoretical exploration of identity is made (including Agamben’s understanding of an apparatus, Ricoeur’s distinction between idem- and ipse-identity, and Stiegler’s notion of a conjunctive–disjunctive relationship towards retentional apparatuses). Privacy, Due process and the Computational Turn: The Philosophy of Law Meets the Philosophy of Technology engages with the rapidly developing computational aspects of our world including data mining, behavioural advertising, iGovernment, profiling for intelligence, customer relationship management, smart search engines, personalized news feeds, and so on in order to consider their implications for the assumptions on which our legal framework has been built. The contributions to this volume focus on the issue of privacy, which is often equated with data (...) privacy and data security, location privacy, anonymity, pseudonymity, unobservability, and unlinkability. Here, however, the extent to which predictive and other types of data analytics operate in ways that may or may not violate privacy is rigorously taken up, both technologically and legally, in order to open up new possibilities for considering, and contesting, how we are increasingly being correlated and categorizedin relationship with due process – the right to contest how the profiling systems are categorizing and deciding about us. If religion once seemed to have played out its role in the intellectual and political history of Western secular modernity, it has now returned with a vengeance. In this engaging study, Hent de Vries argues that a turn to religion discernible in recent philosophy anticipates and accompanies this development in the contemporary world. Though the book reaches back to Immanuel Kant, Martin Heidegger, and earlier, it takes its inspiration from the tradition of French phenomenology, notably Emmanuel Levinas, Jean-Luc Marion, (...) and, especially, Jacques Derrida. Tracing how Derrida probes the discourse on religion, its metaphysical presuppositions, and its transformations, de Vries shows how this author consistently foregrounds the unexpected alliances between a radical interrogation of the history of Western philosophy and the religious inheritance from which that philosophy has increasingly sought to set itself apart. De Vries goes beyond formal analogies between the textual practices of deconstruction and so-called negative theology to address the necessity for a philosophical thinking that situates itself at once close to and at the farthest remove from traditional manifestations of the religious and the theological. This paradox is captured in the phrase adieu ( à dieu ), borrowed from Levinas, which signals at once a turn toward and a leave-taking from God -- and which also gestures toward and departs from the other of this divine other, the possibility of radical evil. Only by confronting such uncanny and difficult figures, de Vries claims, can one begin to think and act upon the ethical and political imperatives of our day. (shrink)

The introduction of genomics and biobanking methodologies to the African research context has also introduced novel ways of doing science, based on values of sharing and reuse of data and samples. This shift raises ethical challenges that need to be considered when research is reviewed by ethics committees, relating for instance to broad consent, the feedback of individual genetic findings, and regulation of secondary sample access and use. Yet existing ethics guidelines and regulations in Africa do not successfully regulate research (...) based on sharing, causing confusion about what is allowed, where and when. In order to understand better the ethics regulatory landscape around genomic research and biobanking, we conducted a comprehensive analysis of existing ethics guidelines, policies and other similar sources. We sourced 30 ethics regulatory documents from 22 African countries. We used software that assists with qualitative data analysis to conduct a thematic analysis of these documents. Surprisingly considering how contentious broad consent is in Africa, we found that most countries allow the use of this consent model, with its use banned in only three of the countries we investigated. In a likely response to fears about exploitation, the export of samples outside of the continent is strictly regulated, sometimes in conjunction with regulations around international collaboration. We also found that whilst an essential and critical component of ensuring ethical best practice in genomics research relates to the governance framework that accompanies sample and data sharing, this was most sparingly covered in the guidelines. There is a need for ethics guidelines in African countries to be adapted to the changing science policy landscape, which increasingly supports principles of openness, storage, sharing and secondary use. Current guidelines are not pertinent to the ethical challenges that such a new orientation raises, and therefore fail to provide accurate guidance to ethics committees and researchers. (shrink)

Teaching about technology, at all levels of education, can only be done properly when those who teach have a clear idea about what it is that they teach. In other words: they should be able to give a decent answer to the question: what is technology? In the philosophy of technology that question is explored. Therefore the philosophy of technology is a discipline with a high relevance for those who teach about technology. Literature in this field, though, is not always (...) easy to access for non-philosophers. This book provides an introduction to the philosophy of technology for such people. It offers a survey of the current state-of-affairs in the philosophy of technology, and also discusses the relevance of that for teaching about technology. The book can be used in introductory courses on the philosophy of technology in teacher education programs, engineering education programs, and by individual educators that are interested in the intriguing phenomenon of technology that is so important in our contemporary society. ABSTRACT In ethics, the use of empirical data has become more and more popular, leading to a distinct form of applied ethics, namely empirical ethics. This ‘empirical turn’ is especially visible in bioethics. There are various ways of combining empirical research and ethical reflection. In this paper we discuss the use of empirical data in a special form of Reflective Equilibrium (RE), namely the Network Model with Third Person Moral Experiences. In this model, the empirical data consist of the moral (...) experiences of people in a practice. Although inclusion of these moral experiences in this specific model of RE can be well defended, their use in the application of the model still raises important questions. What precisely are moral experiences? How to determine relevance of experiences, in other words: should there be a selection of the moral experiences that are eventually used in the RE? How much weight should the empirical data have in the RE? And the key question: can the use of RE by empirical ethicists really produce answers to practical moral questions? In this paper we start to answer the above questions by giving examples taken from our research project on understanding the norm of informed consent in the field of pediatric oncology. We especially emphasize that incorporation of empirical data in a network model can reduce the risk of self‐justification and bias and can increase the credibility of the RE reached. (shrink)

This paper aims to analyze the ethical challenges in experimental drug use during the early stage of the COVID-19 pandemic, using Germany as a case study. In Germany uniform ethical guidelines were available early on nationwide, which was considered as desirable by other states to reduce uncertainties and convey a message of unity. The purpose of this ethical analysis is to assist the preparation of future guidelines on the use of medicines during public health emergencies. The use of hydroxychloroquine, remdesivir (...) and COVID-19 convalescent plasma in clinical settings was analyzed from the perspective of the ethical principles of beneficence, non-maleficence, justice and autonomy. We observed that drug safety and drug distribution during the pandemic affects all four ethical principles. We therefore recommend to establish ethical guidelines (i) to discuss experimental treatment options with patients from all population groups who are in urgent need, (ii) to facilitate the recording of patient reactions to drugs in off-label use, (iii) to expand inclusion criteria for clinical studies to avoid missing potentially negative effects on excluded groups, and (iv) to maintain sufficient access to repurposed drugs for patients with prior conditions. The selected articles mainly focus on three topics of the current debate: (1) the relationship between conceptual and nonconceptual ways of self-representation; (2) the role of intersubjectivity for the development of self-consciousness; (3) the temporal structure of self-consciousness. A number of previously underexposed, yet important connections between different approaches are explored. The (...) articles not only represent the state of the art in their respective areas of research and make new insights available, but also provide an overview of different methodologies: ranging from philosophy of language and mind to phenomenology and cognitive science. Today, there is a recrudescence of interest in his thought, especially in light of his later work, published in English as Philosophy of the Encounter (Verso, 2006). This has led to renewed debates on the reformulation of conflicting notions of materialism, on the event as both philosophical concept and political construction, and on the nature of politics and the political. Wieviel Ethik braucht der Mensch, wieviel Ethik braucht die Wissenschaft? Vor dem aktuellen Hintergrund einer gewandelten Wissenschaftsgesellschaft von hoher Entwicklungsdynamik geht es darum, Anleitung zu ethischer Selbst- und Situationsreflexion zu geben. Denn die spektakulären Errungenschaften nicht nur im Bereich der Biomedizin haben jedenfalls vorübergehend Zonen von moralischer und ethischer Ratlosigkeit geschaffen. Sie eröffnen Spielräume, von denen nicht sicher ist, ob sie genutzt werden dürfen und sollten. Die Empfindlichkeit gegenüber den Nachteilen und Risiken der technisch-wissenschaftlichen Zivilisation ist jedenfalls dort, wo die (...) Möglichkeiten verfügbar sind, so weit gestiegen, dass sich ihre praktische Nutzung längst nicht mehr von selbst versteht. Auch das Recht ist derzeit weder auf der nationalen noch auf der internationalen Ebene in der Lage, überzeugende Handlungsanleitung zu geben. Welche Ziele und Mittel mit den neuen Möglichkeiten aber verfolgt werden dürfen, ist in der Tat eine Frage nach der Legitimität von Bedürfnissen und der Angemessenheit der Mittel. Nicht zuletzt appelliert sie (die Empfindlichkeit gegenüber den Errungenschaften der wissenschaftlich-technischen Gesellschaften?) potentiell auch an die Tugend der Selbstbeschränkung, die vielleicht dort noch wirksam wird, wo andere Steuerungsmechanismen versagen oder zu schwach sind. Dieses Werk stellt das Denken zweier Geistesgrößen, Leibnizens und Fichtes sich gegenüber und vergleicht es. Fichte sieht in Leibniz einen Vorläufer und erwähnt ihn mit liebevoller Bewunderung. Fichtes Wissenschaftslehre von 1801/02 wird Leibnizens „Monadologie“ aufgreifen und Leibnizens Gedanken einer prästabilierten Harmonie. Beide Philosophen verstehen sich als Freiheitsapostel, wobei bei Leibniz Gott eine genaue Notion jedes Individuums hat, die Freiheit ein mentaler Akt ist, bei Fichte jedes Individuum ein je bestimmtes Soll hat, das es, Freiheit verwirklichend, im Leben zu erfüllen gilt. (...) Fichte erkennt in Leibniz einen Vorläufer der eigenen Transzendentalphilosophie. Ein Unterschied zwischen den beiden Denkern besteht darin, dass Leibniz stets die Individualität im Auge hat, wo Fichte vom reinen Vernunftwesen ausgeht, dessen individuelle Pathologien ihn nicht interessieren. Beide Philosophen supponieren, dass die Welt ein Ende habe, Leibniz, auf dass das Weltgericht stattfinden könne, Fichte, auf dass in einer neuen Welt nur noch die sittlichen Individuen wiedergeboren werden. Der vorliegende Text versucht auch, den Bogen zu schlagen von der philosophischen Tradition des Abendlandes, und insbesondere von Leibniz, Kant und Fichte zu einer Gotteslehre auf Grund der modernen Physik. Die hochenergetische Urmaße wird gefasst als psychophysische Energeia, die sich – im Leibnizschen Sinne Wissen, Macht und Wollen – aus dem Nichts kontrahiert hat und nun ins All explodiert. In der Kontraktion aus dem ursprünglich Verwobenen hat das Absolute sich vom Nichts, das Gute sich vom Bösen geschieden, entsteht das Übel als privatio boni. (shrink)

Based on three empirical studies, this research sets out to conceptualise and subsequently operationalise the construct of consumer perceived ethicality (CPE) of a company or brand. Study 1 investigates consumer meanings of the term ethical and reveals that, contrary to philosophical scholars' exclusively consequentialist or nonconsequentialist positions, consumers' ethical judgments are a function of both these evaluation principles, illustrating that not any one scholarly definition of ethics alone is capable of capturing the content domain. The resulting conceptualisation identifies six key (...) themes explicating the construct. Building upon these findings, studies 2 and 3 were conducted to operationalise CPE. Such operationalisation is an essential prerequisite for future explorations and theory development given the absence of a suitable tool to capture and quantify the strength and direction of CPE. The key focus was on developing a valid and reliable multi-item measurement tool that is practical, parsimonious and easy to administer. The scale's general applicability allows deployment in academic and business contexts as well as different research areas and doing thus facilitates the much-needed theory building in this new research area. Recent research on moral decision-making has suggested that many common moral judgments are based on immediate intuitions. However, some individuals arrive at highly counterintuitive utilitarian conclusions about when it is permissible to harm other individuals. Such utilitarian judgments have been attributed to effortful reasoning that has overcome our natural emotional aversion to harming others. Recent studies, however, suggest that such utilitarian judgments might also result from a decreased aversion to harming others, due to a deficit in empathic concern and social (...) emotion. The present study investigated the neural basis of such indifference to harming using functional neuroimaging during engagement in moral dilemmas. A tendency to counterintuitive utilitarian judgment was associated both with ‘psychoticism’, a trait associated with a lack of empathic concern and antisocial tendencies, and with ‘need for cognition’, a trait reflecting preference for effortful cognition. Importantly, only psychoticism was also negatively correlated with activation in the subgenual cingulate cortex (SCC), a brain area implicated in empathic concern and social emotions such as guilt, during counterintuitive utilitarian judgments. Our findings suggest that when individuals reach highly counterintuitive utilitarian conclusions, this need not reflect greater engagement in explicit moral deliberation. It may rather reflect a lack of empathic concern, and diminished aversion to harming others. (shrink)

Academic publications of empirical public health research often entail recommendations for moral action that address practitioners and policy makers. These recommendations are regularly based on implicit moral judgments with the underlying reasons not explicitly stated. In this paper, we elaborate on the moral relevance of such judgments and the need to explain them in order to account for academic argumentation. We argue for an explicit reporting of bridge principles to increase the transparency of the reporting of public health research. The (...) reporting of bridge principles can inform readers, support them in understanding the relationship between empirical and normative claims in a specific paper, and may pave new ways for the rigorous reporting of empirical research that has moral implications. Furthermore, it can be used to classify studies to systematically address the justification for their argumentation. (shrink)

Although religious belief is often claimed to help with physical ailments including pain, it is unclear what psychological and neural mechanisms underlie the influence of religious belief on pain. By analogy to other top-down processes of pain modulation we hypothesized that religious belief helps believers reinterpret the emotional significance of pain, leading to emotional detachment from it. Recent findings on emotion regulation support a role for the right ventrolateral prefrontal cortex, a region also important for driving top-down pain inhibitory circuits. (...) Using functional magnetic resonance imaging in practicing Catholics and avowed atheists and agnostics during painful stimulation, here we show the existence of a context-dependent form of analgesia that was triggered by the presentation of an image with a religious content but not by the presentation of a non-religious image. As confirmed by behavioral data, contemplation of the religious image eneabled the religious group to detach themselves from the experience of pain. Critically, this context-dependent modulation of pain specifically engaged the right VLPFC, whereas group-specific preferential liking of one of the pictures was associated with activation in the ventral midbrain. We suggest that religious belief might provide a framework that allows individuals to engage known pain-regulatory brain processes. (shrink)

This article deploys Peircean approach to bodily skills, foregrounding motricity as a semiotically mediated and a “suprasubjective” process. By examining two contrasting skills – javelin and martial arts – I draw out the relevance of dynamic movement to the semiotics of sport and embodiment. These contrasting movements expose different epistemological assumptions since they emerge in distinct cultural traditions. To attend to the cultural dimension of movement practices – including the mediation of signs making certain movement forms seem reasonable or desirable (...) in the first place – I highlight ecological dimensions of each somatic tradition. This ecological focus aligns with Peirce’s project of tracking how semiotic signs are positioned and mediated. To make ecological factors of motricity more recognizable, I contrast somatic engagements that take place on synthetic, predictable substrates and somatic engagements that take place on variable, unpredictable ground. In a similar way to the classic gestalt figure-ground relations, where perception of a figure depends on the particulars of the ground, I suggest that the ground upon which somatic action occurs shapes the way we make sense of it epistemologically. These different grounds – both literally and figuratively – operate representationally via thirdness: they lead us to conceptualize movement in culturally and historically particular ways. (shrink)

A previous observational study suggested that when faced with a partner with its back turned, chimpanzees tend to move around to the front of a non-attending partner and then gesture — rather than gesturing once to attract attention and then again to convey a specific intent. We investigated this preference experimentally by presenting six orangutans, five gorillas, nine chimpanzees, and four bonobos with a food begging situation in which we varied the body orientation of an experimenter with respect to the (...) subject and the location of the food. These manipulations allowed us to measure whether subjects preferred to move around to face E or to use signals to attract her attention before they begged for food. Results showed that all species moved around to face E and then produced visual gestures, instead of using tactile/ auditory gestures behind E to call her attention. Species differences were apparent particularly when the food and E were in different locations. Unlike gorillas and orangutans, chimpanzees and bonobos produced their gestures in front of E in all conditions, including that in which subjects had to leave the food behind to communicate with her. Implications of these results are discussed in the context of the evolution of social cognition in great apes. (shrink)

The threat simulation theory of dreaming states that dream consciousness is essentially an ancient biological defence mechanism, evolutionarily selected for its capacity to repeatedly simulate threatening events. Threat simulation during dreaming rehearses the cognitive mechanisms required for efficient threat perception and threat avoidance, leading to increased probability of reproductive success during human evolution. One hypothesis drawn from TST is that real threatening events encountered by the individual during wakefulness should lead to an increased activation of the system, a threat simulation (...) response, and therefore, to an increased frequency and severity of threatening events in dreams. Consequently, children who live in an environment in which their physical and psychological well-being is constantly threatened should have a highly activated dream production and threat simulation system, whereas children living in a safe environment that is relatively free of such threat cues should have a weakly activated system. We tested this hypothesis by analysing the content of dream reports from severely traumatized and less traumatized Kurdish children and ordinary, non-traumatized Finnish children. Our results give support for most of the predictions drawn from TST. The severely traumatized children reported a significantly greater number of dreams and their dreams included a higher number of threatening dream events. The dream threats of traumatized children were also more severe in nature than the threats of less traumatized or non-traumatized children. (shrink)

Background Decisions on limiting life-sustaining treatment for patients in the vegetative state (VS) are emotionally and morally challenging. In Germany, doctors have to discuss, together with the legal surrogate (often a family member), whether the proposed treatment is in accordance with the patient's will. However, it is unknown whether family members of the patient in the VS actually base their decisions on the patient's wishes. Objective To examine the role of advance directives, orally expressed wishes, or the presumed will of (...) patients in a VS for family caregivers' decisions on life-sustaining treatment. Methods and sample A qualitative interview study with 14 next of kin of patients in a VS in a long-term care setting was conducted; 13 participants were the patient's legal surrogates. Interviews were analysed according to qualitative content analysis. Results The majority of family caregivers said that they were aware of aforementioned wishes of the patient that could be applied to the VS condition, but did not base their decisions primarily on these wishes. They gave three reasons for this: (a) the expectation of clinical improvement, (b) the caregivers' definition of life-sustaining treatments and (c) the moral obligation not to harm the patient. If the patient's wishes were not known or not revealed, the caregivers interpreted a will to live into the patient's survival and non-verbal behaviour. Conclusions Whether or not prior treatment wishes of patients in a VS are respected depends on their applicability, and also on the medical assumptions and moral attitudes of the surrogates. We recommend repeated communication, support for the caregivers and advance care planning. (shrink)

Employment is critical for refugees’ positive integration into a receiving country. Enabling employment requires cross-sector collaborations, that is, employers collaborating with different stakeholders such as refugees, local employees, other employers, unofficial/official supporters, and authorities. A vital element of cross-sector collaborations is trust, yet the complexity of cross-sector collaborations may challenge the formation and maintenance of trust. Following a theory elaboration approach, this qualitative study with 37 employers and 27 support workers in Germany explores how employers’ experiences in cross-sector collaborations on (...) refugees’ labor market integration affect their trust in other stakeholders in this cross-sector space. Specifically, we explored employers’ perceptions of trust breaches, and how these perceptions affect their further engagement in cross-sector collaborations on refugee integration. Based on our findings, we propose a process model that describes how unmet collaboration expectations and negative assessments of collaborators’ attitudes and behaviors lead to perceived trust breaches which, in turn, lead to employers’ hesitancy to hire refugees and/or to engage in cross-sector collaborations. In doing so, we extend existing theory on trust within organizations to the cross-sector context of refugee integration, uncovering context-specific meanings to trustworthiness dimensions and illustrating how breaches of different trustworthiness dimensions can interact. Moreover, we show how social policies, resources, and trustors’ perceived vulnerability in collaborations shape their risk perceptions. This study highlights the central role of trust for refugee integration and illustrates how missing goals and process clarity endanger sustainable collaborations. (shrink)

These manipulations allowed us to measure whether subjects preferred to move around to face E or to use signals to attract her attention before they begged for food. Results showed that all species moved around to face E and then produced visual gestures, instead of using tactile/ auditory gestures behind E to call her attention. Species differences were apparent particularly when the food and E were in different locations. Unlike gorillas and orangutans, chimpanzees and bonobos produced their gestures in front of E in all conditions, including that in which subjects had to leave the food behind to communicate with her. Implications of these results are discussed in the context of the evolution of social cognition in great apes. (shrink)

Despite the variety of theories suggesting how human language might have evolved, very few consider the potential role of emotions in such scenarios. The few existing theories jointly highlight that gaining control over the production of emotional communication was crucial for establishing and maintaining larger social groups. This in turn resulted in the development of more complex social emotions and the corresponding sophisticated socio-cognitive skills to understand others’ communicative behavior, providing the grounds for language to emerge. Importantly, these theories propose (...) that the ability of controlling emotional communication is a uniquely human trait, an assumption that we will challenge. By taking a comparative approach, we discuss recent findings from behavioral and neurobiological studies from our closest relatives, the non-human primates, on the extent of control over their gestural, facial and vocal signals. This demonstrates that research foci differ drastically across these modalities, which further enhances the traditional dichotomy between emotional, involuntary facial and vocal expressions in contrast to intentionally, voluntarily produced gestures. Based on this brief overview, we point to gaps of knowledge in primate communication research and suggest how investigating emotional expressions in our closest relatives might enrich the road map towards the evolution of human language. Modern bioethics was born in the West and thus reflects, not surprisingly, the traditions of Western moral philosophy and political and social theory. When the work of bioethics was confined to the West, this background of socio-political theory and moral tradition posed few problems, but as bioethics has moved into other cultures – inside and outside of the Western world – it has become an agent of moral imperialism. ABSTRACT:The relationship between culture and corruption has been the focus of various studies, producing inconsistent results. We suggest that these inconsistencies might be due to the conceptualization and measurement of culture. Drawing on the possible value/fact dichotomy discussed in ethical philosophy, we introduce the construct of cultural discrepancy—the difference between cultural values and practices —as a predictor of pervasive and arbitrary corruption. Examining the relationship between the discrepancies observed in the GLOBE cultural dimensions and the Corruption Perception Index shows that (...) in-group collectivism discrepancy is negatively related to pervasive corruption; future orientation discrepancy is positively related to arbitrary corruption. Further, we show that these relationships are contingent on national wealth. The negative relationship for in-group collectivism discrepancy is most pronounced in poor and moderately wealthy countries, and the positive relationship for future orientation discrepancy is most pronounced in rich countries. Belief and Truth: A Skeptic Reading of Plato explores a Socratic intuition about belief, doxa -- belief is "shameful." In aiming for knowledge, one must aim to get rid of beliefs. Vogt shows how deeply this proposal differs from contemporary views, but that it nevertheless speaks to intuitions we are likely to share with Plato, ancient skeptics, and Stoic epistemologists.

This chapter first considers the more formal basis for the relationship between international law and European Union (EU) law by looking at the international law framework of EU law. It then discusses the approach of the EU legal order to international law and the various ways in which the two legal orders interact within the EU legal order. The chapter also considers reasons for and implications of the CJEU's approach. The Court of Justice of the European Union (CJEU) has held (...) that customary international law (CIL), just like treaty law, is a standard of assessment in the review of the validity of EU secondary legislation, thus ranking CIL more highly within the EU legal order than secondary legislation.
