Western European liberal democracies have recently enacted laws that prohibit the diffusion of fake news on social media. Yet, many consider that such laws are incompatible with freedom of expression. In this paper, I argue that democratic governments have strong pro tanto reasons to prohibit fake news, and that doing so is compatible with free speech. First, I show that fake news disrupts a mutually beneficial form of epistemic dependence in which members of the public are engaged with journalists. Second, (...) I contend that laws against fake news enhance rather than thwart personal autonomy. If these suggestions are plausible, then the same considerations about truth and autonomy that underpin the value of free speech give us reasons to prohibit fake news. (shrink)

Kant’s discussion of the highest good is subject to continuous disagreement between the proponents of two interpretations of this concept. According to the secular interpretation, Kant conceived of the highest good as a political ideal which can be realized through human agency alone, albeit only from the Critique of the Power of Judgement onwards. By way of contrast, proponents of the theological interpretation find Kant’s treatment of the highest good in his later works to be wholly coherent with the discussions (...) of this concept found in the second Critique. In their view, however, Kant never conceived of the highest good as a political ideal, and some go as far as to argue that it is the work of God alone. In this article, I defend a theologico-political account of the highest good that avoids the pitfalls of both readings. (shrink)

If citizens are to make enlightened collective decisions, they need to rely on true factual beliefs, but misinformation impairs their ability to do so. Although some cases of misinformation are deliberate and amount to propaganda, cases of inadvertent misinformation are just as problematic in affecting the beliefs and behavior of democratic citizens. A review of empirical evidence suggests that this is a serious problem that cannot entirely be corrected by means of deliberation.

Aristotelian virtue theorists are currently engaged in a discussion with philosophers who use psychological findings to question some of their main assumptions. In this article, I present and argue against one of these psychological challenges—Jesse Prinz’s Normativity Challenge—which rests on the claim that findings in cultural psychology contradict the Aristotelian thesis that the normativity of virtues derives from nature. First, I demonstrate that the Normativity Challenge is based on three problematic assumptions about contemporary Aristotelianism. Many neo-Aristotelians argue that practical identities are normative, that is, they provide us with reasons for action and create binding obligations. Kantian constructivists agree with this insight but argue that contemporary Aristotelians fail to fully justify it. Practical identities are normative, Kantian constructivists contend, but their normativity necessarily derives from the normativity of humanity. In this paper, I shed light on this underexplored similarity between neo-Aristotelian and Kantian constructivist accounts of the normativity of practical identities, and argue that both ultimately (...) fail. In a recent contribution to conceptual ethics, Joshua Habgood-Coote argues that philosophers should refrain from using the term “fake news,” which is commonly employed in public discussions focusing on the epistemic health of democracies. In this short discussion note, I take issue with this claim, discussing each of the three arguments advanced by Coote to support the conclusion that we should abandon this concept. First, I contend that although “fake news” is a contested concept, there is significant agreement among contemporary (...) philosophers about its key feature. Second, I argue against the claim that “fake news” is an unnecessary concept by underlying that it is not reducible to other terms we customarily use to describe the epistemic dysfunctions of democracies. Lastly, I suggest that using the term “fake news” need not serve propagandistic aims, and that philosophers can use this concept without engaging in epistemic policing, that is, commanding their interlocutors not to believe specific news stories or sources. One central objection to philosophical defences of liberal neutrality is that many neutrally justified laws and policies are nonetheless discriminatory as they unilaterally impose costs or confer unearned privileges on the bearers of a particular conception of the good. Call this the false neutrality objection. While liberal neutralists seldom consider this objection to be a serious allegation, and often claim that it rests on a misunderstanding, I argue that it is a serious challenge for proponents of justificatory neutrality. Indeed, a (...) careful examination of recent French and Canadian laws which impede the members of cultural minorities from freely practising their religion reveals that the state can hide its discriminatory aims by cloaking the policies it enacts in neutral language. In order to avoid the problem of false neutrality, I contend, liberal neutralists should defend a combination of neutrality of justification and neutrality of aim and operationalize neutrality of aim through a practical test that has been a defining feature of American jurisprudence on religious freedom in the last thirty years: the general applicability requirement. Jeffrey Friedman convincingly argues that technocrats may often lack the knowledge required to enact public policies that will effectively promote their consequentialist goals. Friedman’s argument is strong enough to produce technocratic paralysis, in many cases, but “epistemic gambles” may present a way out of this problem. His discussion of exitocracy also raises the question of how to square his internal form of technocratic critique with the question of democratic legitimacy.

Summary This paper examines the entomological investigations carried out by the French naturalist Henri-Louis Duhamel du Monceau during a series of insect epidemics that ravaged France in the second half of the eighteenth century.1 This article began as a paper for Pamela H. It shows how a particularly fierce invasion of caterpillars in the Angoumois region in the 1760s sparked theoretical debates about the nature of animal generation between academic naturalists, farmers, provincial officials and amateur naturalists. As part of a wider effort to reform agricultural production in France, Duhamel du Monceau sought to eliminate vernacular understandings of insect generation and to reform local pest control techniques. In his attempt to develop a body of pest-control knowledge grounded in the systematic observation of insect generation, however, Duhamel du Monceau relied heavily on the efforts of amateur naturalists. The paper shows how he mobilized a nation-wide network of entomological observers, and collected specimens and observational reports from farmers, improving landlords and local officials throughout France. Some informants did not only act as ?mere? observers, but formulated their own causal claims about insect generation that sometimes contradicted those of their metropolitan counterpart. Finally, it demonstrates that a ?patriotic? discourse that joined agricultural improvement and civic virtue provided a powerful impetus for the formation of collaborative relationships between academic naturalists, state officials and enlightened agricultural improvers. ABSTRACT In Habgood-Coote : 1033–1065) I argued that we should abandon ‘fake news’ and ‘post-truth’, on the grounds that these terms do not have stable public meanings, are unnecessary, and function as vehicles for propaganda. Jessica Pepp, Eliot Michaelson, and Rachel Sterken and Étienne Brown : 144–154) have raised worries about my case for abandonment, recommending that we continue using ‘fake news’. In this paper, I respond to these worries. I distinguish more clearly between theoretical and political reasons (...) for abandoning a term, assemble more evidence that ‘fake news’ is a nonsense term, and respond to the worries raised by Pepp, Michaelson and Sterken, and Brown. I close by considering the prospects for anti-fascist and anti-authoritarian conceptual engineering. (shrink)

Scepticism about ought simpliciter is the view that there is no such thing as what one ought simpliciter to do. Instead, practical deliberation is governed by a plurality of normative standpoints, each authoritative from their own perspective but none authoritative simpliciter. This paper aims to resist such scepticism. After setting out the challenge in general terms, I argue that scepticism can be resisted by rejecting a key assumption in the sceptic’s argument. This is the assumption that standpoint-relative ought judgments bring (...) with them a commitment to act in accordance with those judgments. Instead, I propose an alternative account of our normative concepts according to which only ought simpliciter judgments commit one to acting in accordance with those judgments. In addition to answering the sceptical challenge, the proposal offers an independently motivated account of what makes a concept normatively authoritative. (shrink)

Algorithms wield increasing control over our lives—over which jobs we get, whether we're granted loans, what information we're exposed to online, and so on. Algorithms can, and often do, wield their power in a biased way, and much work has been devoted to algorithmic bias. In contrast, algorithmic neutrality has gone largely neglected. I investigate three questions about algorithmic neutrality: What is it? Is it possible? And when we have it in mind, what can we learn about algorithmic bias?

The recent philosophy of Quantum Bayesianism, or QBism, represents an attempt to solve the traditional puzzles in the foundations of quantum theory by denying the objective reality of the quantum state. Einstein had hoped to remove the spectre of nonlocality in the theory by also assigning an epistemic status to the quantum state, but his version of this doctrine was recently proved to be inconsistent with the predictions of quantum mechanics. In this essay, I present plausibility arguments, old and new, (...) for the reality of the quantum state, and expose what I think are weaknesses in QBism as a philosophy of science. (shrink)

With his usual lucidity, Etienne Gilson addresses the idea that "art is the making of beauty for beauty's own sake." By distinguishing between aesthetics, which promotes art as a form of knowledge, and philosophy, which focuses on the presence of the artist's own talent or genius, Gilson maintains that art belongs to a different category entirely, the category of "making." Gilson's intellectually stimulating meditation on the relation of beauty and art is indispensable to philosophers and artists alike.

We invoke the ideal of tolerance in response to conflict, but what does it mean to answer conflict with a call for tolerance? Is tolerance a way of resolving conflicts or a means of sustaining them? Does it transform conflicts into productive tensions, or does it perpetuate underlying power relations? To what extent does tolerance hide its involvement with power and act as a form of depoliticization? Wendy Brown and Rainer Forst debate the uses and misuses of tolerance, an (...) exchange that highlights the fundamental differences in their critical practice despite a number of political similarities. Both scholars address the normative premises, limits, and political implications of various conceptions of tolerance. Brown offers a genealogical critique of contemporary discourses on tolerance in Western liberal societies, focusing on their inherent ties to colonialism and imperialism, and Forst reconstructs an intellectual history of tolerance that attempts to redeem its political virtue in democratic societies. Brown and Forst work from different perspectives and traditions, yet they each remain wary of the subjection and abnegation embodied in toleration discourses, among other issues. The result is a dialogue rich in critical and conceptual reflections on power, justice, discourse, rationality, and identity. (shrink)

The important work, exquisitely translated by Mark Wauck, brings the essential elements of philosophy into view as a cohesive, readily understandable, and erudite structure, and does so rigorously in the best tradition of St. Thomas.

The paper, which retains a hypothetical character, argues that Spinoza's propositions referring to God (or involving the use of the name ‘God’, essentially in the Ethics), can be read in a fruitful manner apart from any pre-established hypothesis concerning his own ‘theological preferences’, as definite descriptions of three ‘ideas of God’ which have the same logical status: one (akin to Jewish Monotheism) which identifies the idea of God with the idea of the Law, one (akin to a heretic ‘Socinian’ version (...) of Christianity) which identifies it with the idea of Human Love, and one (akin to a form of Cosmotheism, rather than ‘Pantheism’) which identifies it with Nature. Evidence of this analytic tripartition can be found in the letter of the texts themselves. If accepted (at least as a thought experiment), it would carry three interesting consequences: 1) to renew our understanding of the theory of the ‘three kinds of knowledge’, which have obvious affinities with the three possible ways of understanding the idea of God; 2) to emphasize the critical move associated by Spinoza with each of the three ideas of God (passing from an anthropomorphic legislator to an impersonal command, passing from an imaginary community of similarities to a practical community of singularities, and passing from a teleological and harmonious idea of nature to a causal, even conflictual, idea of its infinite power); 3) to locate the essential ethical and political questions associated with religion on the ‘vectors’ which lead from one idea to another, and represent themselves practical conatus: obedience, utility, order. It is also assumed that such a reading enhances the relevance of Spinoza's philosophy with respect to contemporary debates about religion and secularism. (shrink)

He considers the nature of practical reasoning, friendship, and the role and importance of the moral virtues in the best life. This new edition features a revised translation and valuable new introduction and notes.

This paper examines the general prospects for conceptual role expressivism, expressivist theories that embrace conceptual role semantics. It has two main aims. The first aim is to provide a general characterisation of the view. The second aim is to raise a challenge for the general view. The challenge is to explain why normative concepts are not a species of defective concepts, where defective concepts are those that cannot meaningfully embed and participate in genuine inference. After rejecting existing attempts to answer (...) the challenge, I propose an alternative solution. However, the solution leaves conceptual role expressivism a far less distinctive and interesting position than its proponents claim. I conclude that we should be sceptical about how much expressivists gain by appealing to conceptual role semantics. (shrink)

First published in French in 2010, _Equaliberty_ brings together essays by Étienne Balibar, one of the preeminent political theorists of our time. The book is organized around _equaliberty_, a term coined by Balibar to connote the tension between the two ideals of modern democracy: equality and liberty. He finds the tension between these different kinds of rights to be ingrained in the constitution of the modern nation-state and the contemporary welfare state. At the same time, he seeks to keep (...) rights discourse open, eschewing natural entitlements in favor of a deterritorialized citizenship that could be expanded and invented anew in the age of globalization. Deeply engaged with other thinkers, including Arendt, Rancière, and Laclau, he posits a theory of the polity based on social relations. In _Equaliberty_ Balibar brings both the continental and analytic philosophical traditions to bear on the conflicted relations between humanity and citizenship. (shrink)

In this contribution, Balibar follows his seminal 1993 work applying the notion of the transindividual to Spinoza’s work, to produce a broader history of thinking the transindividual that brings both Karl Marx and Sigmund Freud into relation with Spinoza, devoting a section to each of these thinkers. Balibar positions the notion of the transindividual, here, as a solution to the opposing ontological errors of philosophical individualism that fails to attend to the social constitution of the individual, and the social organicism (...) that reduces the individual to the effect of larger forces. For Balibar, following Gilbert Simondon, the individual is to be understood as always already extending beyond themselves. (shrink)

Etienne Balibar, one of the foremost living French philosophers, builds on his landmark work 'Spinoza and Politics' with this exploration of Spinoza's ontology. Balibar situates Spinoza in relation to the major figures of Marx and Freud as a precursor to the more recent French thinker Gilbert Simondon's concept of the transindividual. Presenting a crucial development in his thought, Balibar takes the concept of transindividuality beyond Spinoza to show it at work at both the individual and the collective level.

étienne Balibar has been one of Europe's most important philosophical and political thinkers since the 1960s. His work has been vastly influential on both sides of the Atlantic throughout the humanities and the social sciences. In We, the People of Europe?, he expands on themes raised in his previous works to offer a trenchant and eloquently written analysis of "transnational citizenship" from the perspective of contemporary Europe. Balibar moves deftly from state theory, national sovereignty, and debates on multiculturalism and (...) European racism, toward imagining a more democratic and less state-centered European citizenship. Although European unification has progressively divorced the concepts of citizenship and nationhood, this process has met with formidable obstacles. While Balibar seeks a deep understanding of this critical conjuncture, he goes beyond theoretical issues. For example, he examines the emergence, alongside the formal aspects of European citizenship, of a "European apartheid," or the reduplication of external borders in the form of "internal borders" nurtured by dubious notions of national and racial identity. He argues for the democratization of how immigrants and minorities in general are treated by the modern democratic state, and the need to reinvent what it means to be a citizen in an increasingly multicultural, diversified world. A major new work by a renowned theorist, We, the People of Europe? offers a far-reaching alternative to the usual framing of multicultural debates in the United States while also engaging with these debates. Background and aims: Recent investigations have highlighted the value of neuropsychological testing for the assessment and screening of Alcohol-Related Brain Damage. The aim of the present study was to evaluate the suitability of the Addenbrooke’s Cognitive Examination and the Repeatable Battery for the Assessment of Neuropsychological Status for this purpose. Methods: Comparing 28 participants with ARBD and 30 alcohol-dependent participants without ARBD we calculated Area Under the Curve statistics, sensitivity and specificity values, base-rate adjusted predictive values, and likelihood ratios for (...) both tests. Results: High levels of screening accuracy were found for the total scores of both the ACE-III and RBANS at multiple cut-off points. Removing participants with a history of polysubstance from the samples improved the diagnostic capabilities of the RBANS substantially, while only minor improvements to the ACE-III’s accuracy were observed. Conclusions: Overall, both the ACE-III and RBANS are suitable tools for ARBD screening within an alcohol-dependent population, though the RBANS is the superior of the two. Clinicians using these tools for ARBD screening should be cautious of false-positive outcomes and should therefore combine them with other assessment methods and more detailed neuropsychological testing before reaching diagnostic decisions. The purpose of this article is to outline a Kantian form of cosmopolitan law and the jurisprudence involved in the creation of a cosmopolitan constitution. This article explores and discusses Kantian cosmopolitan law, the idea of cosmopolitan right, the laws of hospitality and a Kantian approach to constitutional cosmopolitanism. In doing so, the article argues beyond Kant's discussion of constitutionalism, suggesting that a written constitution not only articulates many of Kant's cosmopolitan concerns, but also provides a reasonable ethical foundation for (...) an international society. Throughout this discussion, more particular aspects of Kant's legal conception of cosmopolitanism are examined, focusing on the possibility of an ethical cosmopolitan order based on jurisprudence, the necessity of a minimal consensus bound by constitutional provisions, and the corresponding legal obligations maintained by cosmopolitan law.
