In the forties, he borrowed from Bergson the expressions « société ouverte I société close », but gave them a rationalist interpretation, criticizing fiercely Bergson's mysticism, as well as his vitalism, regarded as an essentialist historicism à la Hegel. But eventually in the sixties Popper gave his epistemology an evolutionary turn, somewhat rehabilitating the Bergsonian idea of a « creative evolution » and even the idea of an « élan vital ». He argued that an « activist » understanding of Darwinian mechanisms was able to simulate the latter idea, without presupposing it. He proposed a cosmology of the « Open Universe », stressing the reality and irreversibility of time. He went on to use the concept of emergence and tried to give an account of man's freedom, regarded as a power to create genuine novelty in the world, as Bergson had proposed. But Popper eliminated all substantialist spiritualism, and he gave no religious background to his vision of the world. Boyer's model posits that ownership intuitions are delivered by combining input representations of resource conflict and cooperative value, necessary to solve coordination dilemmas over resource access. Here I evaluate the implications of this claim for early social cognition and argue that cognitively frugal possession concepts can be leveraged to the same inferential end, making the ascription of ownership proper unnecessary.

Research ethics review is a critical aspect of the research governance framework for human subjects research. This usually requires that research protocols be submitted to a research ethics committee for review and approval. This has led to very rapid developments in the domain of research ethics, as RECs proliferate all over the globe in rhyme with the explosion in human subjects research. The work of RECs has increasingly become elaborate, complex, and in many cases urgent, necessitating supporting rules and procedures (...) of operation. Guidelines for elaborating standard operating procedures for the functioning of RECs have also been proposed. The SOPs of well-placed and well-resourced RECs have tended to pay much attention to details, resulting, as a consequence, in generally long, elaborate, intricate and complex SOPs; a model that can hardly be replicated by other committees, equally under ethics review pressures, but working under much more constraining conditions in resource-destitute environments. In this paper, we looked at the content and length of SOPs from African RECs and compared them to the World Health Organization ’s guidelines as the gold standard. We also looked at the SOPs from the Ethics Review and Consultancy Committee of the Cameroon Bioethics Initiative that we elaborated in a simplified way in 2013, and compared them to the WHO’s guidelines and to the other SOPs. Sixteen SOPs from 14 African countries were collected from various sources. Their average length was of 30 pages. By comparison to the guidance of the WHO, only six of them were found acceptable with more than 70 % of the criteria from the gold standard that were fully described. Among those six, two of them were very long and detailed, while the four remaining SOPs ranged from 16 to 24 pages. The ERCC SOPs are seven pages long but maintain all that is of essence for the rigorous, efficient and timely review of protocols. We are convinced that, because of their brevity, simplicity, clarity and user-friendliness, the ERCC SOPs recommend themselves as a model template to, at least, committees similarly situated and/or circumstanced as the ERCC of the Cameroon Bioethics Initiative is. In fact, brevity, clarity, simplicity and user-friendliness are recognized values. Whatever is brief and clear is better than what is not and saves time. What is simple and user-friendly is better than what is not even though the two have the same aims because it saves both time and mental energy. And if this be true in general, it is even truer of the context and its peculiar constraints that we are addressing. (shrink)

ABSTRACT:In a series of reports the United Nations Special Representative on the issue of Human Rights and Transnational Corporations has emphasized a tripartite framework regarding business and human rights that includes the state “duty to protect,” the TNC “responsibility to respect,” and “appropriate remedies” for human rights violations. This article examines the recent history of UN initiatives regarding business and human rights and places the tripartite framework in historical context. Three approaches to human rights are distinguished: moral, political, and legal. (...) It is argued that the tripartite framework’s grounding of the responsibility of TNCs to respect human rights is properly understood as moral and not merely as a political or legal duty. A moral account of the duty of TNCs to respect basic human rights is defended and contrasted with a merely strategic approach. The main conclusion of the article is that only a moral account of the basic human rights duties of TNCs provides a sufficiently deep justification of “the corporate responsibility to respect human rights” feature of the tripartite framework. Within anthropology, as elsewhere in the human sciences, there is a tendency to divide knowledge making into two separate poles: conceptual (theory) vs. empirical (ethnography). In Theory Can Be More than It Used to Be, Dominic Boyer, James D. Faubion, and George E. Marcus argue that we need to take a step back from the assumption that we know what theory is to investigate how theory—a matter of concepts, of analytic practice, of medium of value, of professional ideology—operates in (...) anthropology and related fields today. They have assembled a distinguished group of scholars to diagnose the state of the theory-ethnography divide in anthropology today and to explore alternative modes of analytical and pedagogical practice. Continuing the methodological insights provided in Fieldwork Is Not What It Used to Be, the contributors to this volume find that now is an optimal time to reflect on the status of theory in relation to ethnographic research in anthropology and kindred disciplines. Together they engage with questions such as, What passes for theory in anthropology and the human sciences today and why? What is theory's relation to ethnography? How are students trained to identify and respect anthropological theorization and how do they practice theoretical work in their later career stages? What theoretical experiments, languages, and institutions are available to the human sciences? Throughout, the editors and authors consider theory in practical terms, rather than as an amorphous set of ideas, an esoteric discourse of power, a norm of intellectual life, or an infinitely contestable canon of texts. Meslin (bio), Elizabeth J. Thomson (bio), and Joy T. Boyer (bio)Organizers of the Human Genome Project (HGP) understood from the beginning that the scientific activities of mapping and sequencing the human genome would raise ethical, legal, and social issues that would require careful attention by scientists, health care professionals, government officials, and (...) the public. The establishment of the ELSI (ethical, legal, and social implications) programs at the National Human Genome Research Institute (NHGRI) and the Department of Energy (DOE) was thought to be vital to the success of the HGP in the United States. It also provided a novel approach to the simultaneous study of ethical, legal, and social issues and basic scientific issues. Eric Juengst, the first director of the ELSI program, described its origins in a previous issue of the Kennedy Institute of Ethics Journal (Juengst 1991). Now in its seventh year, the ELSI program has accomplished much. This article summarizes the evolution and goals of the ELSI program at NHGRI, outlines the program’s current research priorities with examples of activities within each priority area, and provides a look to the future, including the initiation of a strategic planning process.Evolution and Goals of the ELSI Research ProgramThe HGP’s “genomic” goals are unique: to map and sequence the entire human genome—some 3 billion base pairs that make up approximately 80–100,000 genes—and the genomes of related model organisms by the year 2005. This goal was particularly ambitious since, when it was proposed, the technologies for mapping and sequencing had yet to be developed. When the HGP was first established, its organizers also elaborated a set of ELSI goals, which they saw as vital to the success of the genome project. The original ELSI goals were: (1) to anticipate and address the implications of the HGP for individuals and society and (2) to examine the ELSI consequences of mapping and sequencing the human genome in order to stimulate public discussion. To meet these goals, the NHGRI created its ELSI research program in 1990. Along with mapping, sequencing, [End Page 291] and mammalian genetics, ELSI was one of four original branches in the NHGRI Division of Extramural Research that funded research in those areas. Although the individual “branches” no longer exist, the mechanisms for funding research remain much the same. While the overall goals of the program have not changed, the specific ways of achieving the goals have continued to evolve. The importance of the ELSI program lies not in the collection of a full set of data that will be valuable in and of itself, but in the value of using and interpreting this new set of information.Early on, the NHGRI described a set of somewhat more specific goals: (1) to develop a program to help understand the ethical, legal, and social implications of the human genome project and (2) to identify and define the major issues of concern and develop policy options to address them. These more specific goals have been largely met. As the most recent biennial NHGRI Progress Report notes, “a robust ELSI research and education program has been established, many of the most urgent ELSI issues have been identified, and many policy options to address these issues have been proposed” (NCHGR 1995, p. 21). Between 1990 and 1996, ELSI provided more than $32.5 million in funding through 128 research and education grants in more than 30 states and in Canada (Table 1). The ELSI research budget is unique in that when originally created, it was specifically tied to the amount of money provided for the overall NHGRI budget. The NHGRI originally devoted 3 percent of its extramural budget to fund ELSI projects, but in FY 1991, it increased the ELSI budget to 5 percent, a figure that remains today. Table 2 lists the expenditures for each fiscal year since 1990 and the cumulative expenditures to date. The ELSI research budget at NHGRI this year will be about $7 million. This study is about Brentano’s criticism of a version of phenomenalism that he calls “mental monism” and which he attributes to positivist philosophers such as Ernst Mach and John Stuart Mill. I am interested in Brentano’s criticism of Mill’s version of mental monism based on the idea of “permanent possibilities of sensation.” Brentano claims that this form of monism is characterized by the identification of the class of physical phenomena with that of mental phenomena, and it commits itself to a (...) form of idealism. Presents results of free‐recall experiments conducted in France, Gabon and Nepal, to test predictions of a cognitive model of religious concepts. The world over, these concepts include violations of conceptual expectations at the level of domain knowledge (e.g., about ‘animal’ or ‘artifact’ or ‘person’) rather than at the basic level. In five studies we used narratives to test the hypothesis that domain‐level violations are recalled better than other conceptual associations. These studies used material constructed in the same way as religious (...) concepts, but not used in religions familiar to the subjects. Experiments 1 and 2 confirmed a distinctiveness effect for such material. Experiment 3 shows that recall also depends on the possibility to generate inferences from violations of domain expectations. Replications in Gabon (Exp. 4) and Nepal (Exp. 5) showed that recall for domain‐level violations is better than for violations of basic‐level expectations. Overall sensitivity to violations is similar in different cultures and produces similar recall effects, despite differences in commitment to religious belief, in the range of local religious concepts or in their mode of transmission. However, differences between Gabon and Nepal results suggest that familiarity with some types of domain‐level violations may paradoxically make other types more salient. These results suggest that recall effects may account for the recurrent features found in religious concepts from different cultures. (shrink)

Le chapitre suivant se veut une réflexion plus générale sur les motivations philosophiques qui commandent des jugements si opposés sur le statut ontologique et épistémologique de la psychologie du sens commun. IV dresse un tableau de ces différents programmes et des grands courants de la philosophie de l'esprit, en commençant par le behaviorisme, le physicalisme, le fonctionnalisme et le connexionnisme. Les trois chapitres suivants porteront sur les problèmes et débats liés à la naturalisation des trois propriétés principales de l'esprit, des trois problèmes principaux de la philosophie de l'esprit, soit les concepts d'intentionnalité, de rationalité et de conscience. What is attention? On one influential position, attention constitutively is the selection of some stimulus for coupling with a response. Wayne Wu has proposed a master argument for this position that relies on the claim that cognitive science commits to an empirical sufficient condition (ESC), according to which, if a subject S perceptually selects (or response-couples) X to guide performance of some experimental task T, she therein attends to X. In this paper I show that this claim about cognitive science (...) is false. Cognitive science allows for inattentive selection-for-task, or inattentive response-coupling. Franz Brentano’s impact on the philosophy of his time and on 20th-century philosophy is considerable. The “sharp dialectician” (Freud) and “genial master” (Husserl) influenced philosophers of various allegiances, being acknowledged not only as the “grandfather of phenomenology” (Ryle) but also as an analytic philosopher “in the best sense of this term” (Chisholm). The fourteen new essays gathered together in this volume give an insight in three core issues of Brentano’s philosophy: consciousness (sect.1), intentionality (sect. 2) and ontology and metaphysics (sect. (...) 3). Two further sections of the volume deal with the posterity of his philoso¬phy: in section 4, the legacy of his account of sense perception and feeling is discussed, while the history of Brentano’s unpublished manuscripts is discussed in section 5. This section also presents an edition of a manuscript from 1899 on relations, along with the letters from Brentano to Marty which discuss this manuscript. Ritualized behavior, intuitively recognizable by its stereotypy, rigidity, repetition, and apparent lack of rational motivation, is found in a variety of life conditions, customs, and everyday practices: in cultural rituals, whether religious or non-religious; in many children's complicated routines; in the pathology of obsessive-compulsive disorders (OCD); in normal adults around certain stages of the life-cycle, birthing in particular. Combining evidence from evolutionary anthropology, neuropsychology and neuroimaging, we propose an explanation of ritualized behavior in terms of an evolved Precaution System geared (...) to the detection of and reaction to inferred threats to fitness. This system, distinct from fear-systems geared to respond to manifest danger, includes a repertoire of clues for potential danger as well as a repertoire of species-typical precautions. In OCD pathology, this system does not supply a negative feedback to the appraisal of potential threats, resulting in doubts about the proper performance of precautions, and repetition of action. Also, anxiety levels focus the attention on low-level gestural units of behavior rather than on the goal-related higher-level units normally used in parsing the action-flow. Normally automatized actions are submitted to cognitive control. This “swamps” working memory, an effect of which is a temporary relief from intrusions but also their long-term strengthening. Normal activation of this Precaution System explains intrusions and ritual behaviors in normal adults. Gradual calibration of the system occurs through childhood rituals. Cultural mimicry of this system's normal input makes cultural rituals attention-grabbing and compelling. A number of empirical predictions follow from this synthetic model. Epistemic accounts of scientific collaboration usually assume that, one way or another, two heads really are more than twice better than one. We show that this hypothesis is unduly strong. We present a deliberately crude model with unfavorable hypotheses. We show that, even then, when the priority rule is applied, large differences in successfulness can emerge from small differences in efficiency, with sometimes increasing marginal returns. We emphasize that success is sensitive to the structure of competing communities. Our results suggest (...) that purely epistemic explanations of the efficiency of collaborations are less plausible but have much more powerful socioepistemic versions. (shrink)

This article applies the Kantian doctrine of respect for persons to the problem of sweatshops. We argue that multinational enterprises are properly regarded as responsible for the practices of their subcontractors and suppliers. We then argue that multinationalenterprises have the following duties in their off-shore manufacturing facilities: to ensure that local labor laws are followed; to refrain from coercion; to meet minimum safety standards; and to provide a living wage for employees. Ownership is universal and ubiquitous in human societies, yet the psychology underpinning ownership intuitions is generally not described in a coherent and computationally tractable manner. Ownership intuitions are commonly assumed to derive from culturally transmitted social norms, or from a mentally represented implicit theory. While the social norms account is entirelyad hoc, the mental theory requires prior assumptions about possession and ownership that must be explained. Here I propose such an explanation, arguing that the intuitions result from the interaction of (...) two cognitive systems. One of these handles competitive interactions for the possession of resources observed in many species including humans. The other handles mutually beneficial cooperation between agents, as observed in communal sharing, collective action and trade. Together, these systems attend to specific cues in the environment, and produce definite intuitions such as “this is hers,” “that is not mine.” This computational model provides an explanation for ownership intuitions, not just in straightforward cases of property, but also in disputed ownership (squatters, indigenous rights), historical changes (abolition of slavery), as well as apparently marginal cases, such as the questions, whether people own their seats on the bus, or their places in a queue, and how people understand “cultural appropriation” and slavery. In contrast to some previous theories, the model is empirically testable and free ofad hocstipulations. (shrink)

Skilled action typically requires that individuals guide their activities toward some goal. In skilled action, individuals do so excellently. We do not understand well what this capacity to guide consists in. In this paper I provide a case study of how individuals shift visual attention. Their capacity to guide visual attention toward some goal (partly) consists in an empirically discovered sub-system – the executive system. I argue that we can explain how individuals guide by appealing to the operation of this (...) sub-system. Understanding skill and skilled action thus requires appreciating the role of the executive system. (shrink)

A part of the scientific literature consists of intermediate results within a longer project. Scientists often publish a first result in the course of their work, while aware that they should soon achieve a more advanced result from this preliminary result. Should they follow the proverb “a bird in the hand is worth two in the bush”, and publish any intermediate result they get? This is the normative question addressed in this paper. My aim is to clarify, to refine, and (...) to assess informal arguments about the choice whether to publish intermediate results. To this end, I adopt a rational decision framework, supposing some utility or preferences, and I propose a formal model. The best publishing strategy turns out to depend on the research situation. In some simple circumstances, even selfish and short-minded scientists should publish their intermediate results, and should thus behave like their altruistic peers, i. e. like society would like them to behave. In other research situations, with inhomogeneous reward or difficulty profiles, the best strategy is opposite. These results suggest qualified philosophical morals. (shrink)

Il existe, en français, un ouvrage de référence sur la pensée anthropologique de Humboldt (Jean Quillien, 1991, réédité en 2015) mais rien de tel sur sa pensée du langage. Ce livre souhaite donc combler cette lacune tout en remettant à leur place certaines idées fausses. Il se révèle, à ce titre, triplement provocateur. D'une part, cet ouvrage rappelle que Humboldt se situe entièrement dans le prolongement de la tradition généraliste des grammaires philosophiques qu'il ne renie jamais entièrement. Il relit au (...) contraire cette tradition au moyen des conceptions de la philosophie allemande de Kant et Fichte. D'autre part, il souligne que Humboldt ne s'est pas contenté de formuler quelques idées générales sur le langage, mais a effectué un immense travail empirique sur près de 80 langues, rédigeant plus de 30 grammaires. Denis Thouard donne un aperçu de ce travail en évoquant l'édition des grammaires américaines effectuée ces dernières années à l'Académie de Berlin-Brandebourg, et développe le cas du basque, du chinois et de l'égyptien. C'est l'occasion de découvrir un linguiste véritable. Enfin, il permet de remettre en lumière le rôle essentiel et le plus souvent ignoré qu'a joué pour la pensée de Humboldt sa réflexion sur la traduction en analysant son travail de traducteur de l'Agamemnon d'Eschyle dans son contexte culturel. Une réflexion sur la question de la diversité des langues dans l'Europe actuelle, le renouveau des études sur l'origine des langues et les mésusages des idées de Humboldt accompagnent une présentation sélective et approfondie des points essentiels de sa pensée. Entry on the influence of Stumpf et Brentano on Husserl's early phenomenology during the Halle period.

Religions “in the wild” are the varied set of religious activities that occurred before the emergence of organized religions with doctrines, or that persist at the margins of those organized traditions. These religious activities mostly focus on misfortune; on how to remedy specific cases of illness, accidents, failures; and on how to prevent them. I present a general model to account for the cross-cultural recurrence of these particular themes. The model is based on features of human psychology—namely, epistemic vigilance, the (...) set of systems whereby we evaluate the quality of information and of sources of information, and threat-detection psychology, the set of evolved systems geared at detecting potential danger in the environment. Given these two sets of systems, the dynamics of communication will favor particular types of messages about misfortune. This makes it possible to predict recurrent features of religious systems, such as the focus on nonphysical agents, the focus on particular cases rather than general aspects of misfortune, and the emergence of specialists. The model could illuminate not just why such representations are culturally successful, but also why people are motivated to formulate them in the first place. (shrink)

The domain of “folk-economics” consists in explicit beliefs about the economy held by laypeople, untrained in economics, about such topics as, for example, the causes of the wealth of nations, the benefits or drawbacks of markets and international trade, the effects of regulation, the origins of inequality, the connection between work and wages, the economic consequences of immigration, or the possible causes of unemployment. These beliefs are crucial in forming people's political beliefs and in shaping their reception of different policies. (...) Yet, they often conflict with elementary principles of economic theory and are often described as the consequences of ignorance, irrationality, or specific biases. As we will argue, these past perspectives fail to predict the particular contents of popular folk-economic beliefs and, as a result, there is no systematic study of the cognitive factors involved in their emergence and cultural success. Here we propose that the cultural success of particular beliefs about the economy is predictable if we consider the influence of specialized, largely automatic inference systems that evolved as adaptations to ancestral human small-scale sociality. These systems, for which there is independent evidence, include free-rider detection, fairness-based partner choice, ownership intuitions, coalitional psychology, and more. Information about modern mass-market conditions activates these specific inference systems, resulting in particular intuitions, for example, that impersonal transactions are dangerous or that international trade is a zero-sum game. These intuitions in turn make specific policy proposals more likely than others to become intuitively compelling, and, as a consequence, exert a crucial influence on political choices. (shrink)

The introduction of genomics and biobanking methodologies to the African research context has also introduced novel ways of doing science, based on values of sharing and reuse of data and samples. This shift raises ethical challenges that need to be considered when research is reviewed by ethics committees, relating for instance to broad consent, the feedback of individual genetic findings, and regulation of secondary sample access and use. Yet existing ethics guidelines and regulations in Africa do not successfully regulate research (...) based on sharing, causing confusion about what is allowed, where and when. In order to understand better the ethics regulatory landscape around genomic research and biobanking, we conducted a comprehensive analysis of existing ethics guidelines, policies and other similar sources. We sourced 30 ethics regulatory documents from 22 African countries. We used software that assists with qualitative data analysis to conduct a thematic analysis of these documents. Surprisingly considering how contentious broad consent is in Africa, we found that most countries allow the use of this consent model, with its use banned in only three of the countries we investigated. In a likely response to fears about exploitation, the export of samples outside of the continent is strictly regulated, sometimes in conjunction with regulations around international collaboration. We also found that whilst an essential and critical component of ensuring ethical best practice in genomics research relates to the governance framework that accompanies sample and data sharing, this was most sparingly covered in the guidelines. There is a need for ethics guidelines in African countries to be adapted to the changing science policy landscape, which increasingly supports principles of openness, storage, sharing and secondary use. Current guidelines are not pertinent to the ethical challenges that such a new orientation raises, and therefore fail to provide accurate guidance to ethics committees and researchers. (shrink)

Human agents happen to judge that a conjunction of two terms is more probable than one of the terms, in contradiction with the rules of classical probabilities—this is the conjunction fallacy. One of the most discussed accounts of this fallacy is currently the quantum-like explanation, which relies on models exploiting the mathematics of quantum mechanics. The aim of this paper is to investigate the empirical adequacy of major quantum-like models which represent beliefs with quantum states. We first argue that they (...) can be tested in three different ways, in a question order effect configuration which is different from the traditional conjunction fallacy experiment. We then carry out our proposed experiment, with varied methodologies from experimental economics. The experimental results we get are at odds with the predictions of the quantum-like models. This strongly suggests that this quantum-like account of the conjunction fallacy fails. Future possible research paths are discussed. (shrink)

Executive functioning has been said to bear on a range of traditional philosophical topics, such as consciousness, thought, and action. Surprisingly, philosophers have not much engaged with the scientific literature on executive functioning. This lack of engagement may be due to several influential criticisms of that literature by Daniel Dennett, Alan Allport, and others. In this paper I argue that more recent research on executive functioning shows that these criticisms are no longer valid. ABSTRACTDeliberative and decisional groups play crucial roles in most aspects of social life. But it is not obvious how to organize these groups and various socio-cognitive mechanisms can spoil debates and decisions. In this paper we focus on one such important mechanism: the misrepresentation of views, i.e. when agents express views that are aligned with those already expressed, and which differ from their private opinions. We introduce a model to analyze the extent to which this behavioral pattern can warp deliberations (...) and distort the decisions that are finally taken. We identify types of situations in which misrepresentation can have major effects and investigate how to reduce these effects by adopting appropriate deliberative procedures. We discuss the beneficial effects of holding a sufficient number of rounds of expression of views; choosing an appropriate order of speech, typically a random one; rendering the deliberation dissenter-friendly; having agents express fined-grained views. These applicable procedures help improve deliberations because they dampen conformist behavior, give epistemic minorities more opportunities to be heard, and reduce the number of cases in which an inadequate consensus or majority develops. This article applies the Kantian doctrine of respect for persons to the problem of sweatshops. We argue that multinational enterprises are properly regarded as responsible for the practices of their subcontractors and suppliers. We then argue that multinationalenterprises have the following duties in their off-shore manufacturing facilities: to ensure that local labor laws are followed; to refrain from coercion; to meet minimum safety standards; and to provide a living wage for employees.
