To many contemporary scholars, Émile Meyerson is a footnote in an obscure history: early twentieth-century French philosophy of science. While the traditions of épistémologie are beginning to enjoy the scrutiny they deserve, Meyerson’s role remains overlooked. This article provides an overview of Meyerson’s philosophical project to help sow the seeds for a more systematic recuperation of its legacy. By orienting his work historically, I elucidate the nature of Meyerson’s critique of positivism, his distinctive method, and the implications these have for (...) the relation between science and philosophy. In particular, I show that for Meyerson positivisme refers not only to the doctrine of Auguste Comte but to a general philosophical tendency. Inseparable from Meyerson’s critique of this tendency is his implementation of a new methodology—épistémologie—according to which reason must be understood through the historical development of science. Épistémologie reveals that positivism not only is an incomplete account of science but is detrimental to its progress. Accordingly, Meyerson hopes to secure science’s right to function according to its own immanent principles, thereby providing prolegomena to all future metaphysics through a historical determination of the nature and limits of human reason. Despite the praise his writing garnered during his lifetime, e.g., from readers such as Einstein and de Broglie, Émile Meyerson has been largely forgotten. The rich tradition of French épistémologie has recently been taken up in some Anglo-American scholarship, but Meyerson—who popularized the term épistémologie through his historical method of analyzing science, and criticized positivism long before Quine and Kuhn—remains overlooked. If Meyerson is remembered at all, it is as a historian of classical science. This paper attempts to rectify both (...) states of affairs by explicating one of Meyerson׳s last and untranslated works, Réel et déterminisme dans la théorie quantique, an opuscule on quantum physics.I provide an overview of Meyerson׳s philosophy, his critique of Max Planck׳s interpretation of quantum physics, and then outline and evaluate Meyerson׳s neo-Kantian alternative. I then compare and contrast this interpretation with Cassirer׳s neo-Kantian program. Finally I show that, while Meyerson believes the revolutionary new physics requires "profoundly" modifying our conception of reality, ultimately, he thinks, it secures the legitimacy of his thesis: that science seeks explanations in the form of what he calls "identification." I hope my research will enable a more general and systematic engagement with Meyerson׳s work, especially with a view to assessing its viability as a philosophical method today. (shrink)

If we accept that surveillance by the State and ‘sousveillance’ by the media in Western democracies tend towards a relative equilibrium, or ‘equiveillance’ supported by the function of journalism as a watchdog and that the rule of law largely protects fundamental freedoms, this paper argues that the act of ‘mutual watching’ is undesired by the State and comes at a very high cost to journalists. The combination of technological capacity, legislative change and antidemocratic sentiments of the State, in the context (...) of its willingness and ability to collect and process Big Data on an unprecedented scale, disrupt the preconditions for a strong democracy based on free media and free citizens. This paper examines the politics of investigative journalism under the conditions of dominance of the State by investigating the experiences of journalists with surveillance. Our interviews with 48 journalists show that journalists are acutely aware of surveillance and its noxious impact. Well beyond simple ‘watching’ these experiences are remarkably similar in non-Western and Western countries. Journalists are engaging increasingly with technological and other communities, as they aim to defend journalism and their lives. Their activism is operationalised in three areas: in reluctant often-fraught cooperation with hacktivists, in self-directed protection of communications and sources and in not always willingly acting as dissenters vis-a-vis the State. This paper explores the extent to which journalists consider equilibrium to be distorted, and how they are countering any slide into subdued democracy. (shrink)

During the set-up phase of an international study of genetic influences on outcomes from sepsis, we aimed to characterise potential differences in ethics approval processes and outcomes in participating European countries. Between 2005 and 2007 of the FP6-funded international Genetics Of Sepsis and Septic Shock project, we asked national coordinators to complete a structured survey of research ethic committee approval structures and processes in their countries, and linked these data to outcomes. Survey findings were reconfirmed or modified in 2017. Eighteen (...) countries participated in the study, recruiting 2257 patients from 160 ICUs. National practices differed widely in terms of composition of RECs, procedures and duration of the ethics approval process. Eight countries used a single centralised process for approval, seven required approval by an ethics committee in each participating hospital, and three required both. Outcomes of the application process differed widely between countries because of differences in national legislation, and differed within countries because of interpretation of the ethics of conducting research in patients lacking capacity. The RECs in four countries had no lay representation. The median time from submission to final decision was 1.5 months; in nine approval was received within 1 month; six took over 6 months, and in one 24 months; had all countries been able to match the most efficient approvals processes, an additional 74 months of country or institution-level recruitment would have been available. In three countries, rejection of the application by some local RECs resulted in loss of centres; and one country rejected the application outright. The potential benefits of the single application portal offered by the European Clinical Trials Regulation will not be realised without harmonisation of research ethics committee practices as well as national legislation. Formalised knowledge systems, including universities and research institutes, are important for contemporary societies. They are, however, also arguably failing humanity when their impact is measured against the level of progress being made in stimulating the societal changes needed to address challenges like climate change. In this research we used a novel futures-oriented and participatory approach that asked what future envisioned knowledge systems might need to look like and how we might get there. Findings suggest that envisioned future systems will need (...) to be much more collaborative, open, diverse, egalitarian, and able to work with values and systemic issues. They will also need to go beyond producing knowledge about our world to generating wisdom about how to act within it. To get to envisioned systems we will need to rapidly scale methodological innovations, connect innovators, and creatively accelerate learning about working with intractable challenges. We will also need to create new funding schemes, a global knowledge commons, and challenge deeply held assumptions. To genuinely be a creative force in supporting longevity of human and non-human life on our planet, the shift in knowledge systems will probably need to be at the scale of the enlightenment and speed of the scientific and technological revolution accompanying the second World War. This will require bold and strategic action from governments, scientists, civic society and sustained transformational intent. (shrink)

“It Seems natural to suppose”, wrote Mill, “that rules of action must take their whole character … from the end to which they are subservient”. Many moralists have agreed. If we could establish the Summum Bonum, the foundation of morality, the rational basis of moral thinking, this would constitute a criterion, a rule, by means of which men could actually make good practical judgments. This view is radically mistaken. I first try to show this by means of an a priori (...) argument, and then urge the replacement of the “rational model” of practical thinking embodied in this view by an “empirical model”, which should take account of man's actual capacities and limitations. In his Philosophical Inquiry concerning Human Liberty (1717), the English deist Anthony Collins proposed a complete determinist account of the human mind and action, partly inspired by his mentor Locke, but also by elements from Bayle, Leibniz and other Continental sources. It is a determinism which does not neglect the question of the specific status of the mind but rather seeks to provide a causal account of mental activity and volition in particular; it is a ‘volitional determinism’. Some decades (...) later, Diderot articulates a very similar determinism, which seeks to recognize the existence of “causes proper to man” (as he says in the Réfutation d’Helvétius). The difference with Collins is that now biological factors are being taken into account. Obviously both the ‘volitional’ and the ‘biological’ forms of determinism are noteworthy inasmuch as they change our picture of the nature of determinism itself, but my interest here is to compare these two determinist arguments, both of which are broadly Spinozist in nature – and as such belong to what Jonathan Israel called in his recent book “the radical Enlightenment,” i.e. a kind of underground Enlightenment constituted by Spinozism – and to see how Collins’ specifically psychological vision and Diderot’s specifically biological vision correspond to their two separate national contexts: determinism in France in the mid-1750s was a much more medico-biological affair than English determinism, which appears to be on a ‘path’ leading to Mill and associationist psychology. Following Anthony Downs’s classic economic analysis of democracy, it has been widely noted that most voters lack the incentive to be well-informed. Recent empirical work, however, suggests further that political partisans can display selectively lazy or biased reasoning. Unfortunately, political knowledge seems to exacerbate, rather than mitigate, these tendencies. In this paper, I build on these observations to construct a more general skeptical challenge which affects what I call creedal beliefs. Such beliefs share three features: (i) the costs to (...) the individual of being wrong are negligible, (ii) the beliefs are subject to social scrutiny, and (iii) the evidential landscape relevant to the beliefs is sufficiently complex so as to make easy verification difficult. Some philosophers and social scientists have recently argued that under such conditions, beliefs are likely to play a signaling, as opposed to a navigational role, and that our ability to hold beliefs in this way is adaptive. However, if this is right, I argue there is at least a partial debunker for such beliefs. Moreover, this offers, I suggest, one way to develop the skeptical challenge based on etiological explanation that John Stuart Mill presents in On Liberty when he claims that the same causes which lead someone to be a devout Christian in London would have made them a Confucian in Peking. Finally, I contend that this skeptical challenge is appropriately circumscribed so that it does not over-extend in an implausible way. (shrink)

In this novel re-examination of the archetype construct, philosopher Jon Mills and psychiatrist Erik Goodwyn engage in spirited dialogue on the origins, nature, and scope of what archetypes actually constitute, their relation to the greater questions of psyche and worldhood, and their relevance for Jungian studies and analytical psychology today. Arguably the most definitive feature of Jung's metapsychology is his theory of archetypes. It is the fulcrum on which his analytical depth psychology rests. With recent trends in post-Jungian and (...) neo-Jungian perspectives that have embraced developmental, relational, social justice, and postmodern paradigms, classical archetype theory has largely become a drowning genre. There is currently intense debate about the significance of user consent to data practices. Consent is often taken to legitimate virtually any data practice, no matter how invasive. Many scholars argue, however, that user consent is typically so defective as to be ‘meaningless’ and that user privacy should thus be protected by substantive legislation that does not rely (or does not rely heavily) on consent. I argue that both views rest on serious mistakes about the validity conditions for consent. User (...) consent is sufficiently impoverished that it does not guarantee legitimacy but is not so impoverished as to be ‘meaningless’; it can legitimate data practices that are independently reasonable but not those that are exploitative. Since many valuable data practices must be consented to if they are to be legitimate (or so I argue), our privacy legislation should continue emphasizing the importance of user consent, even if auxiliary protections are also desirable. In this article, we develop a new approach to integrating philosophical phenomenology with qualitative research. The approach uses phenomenology’s concepts, namely existentials, rather than methods such as the epoché or reductions. We here introduce the approach to both philosophers and qualitative researchers, as we believe that these studies are best conducted through interdisciplinary collaboration. In section 1, we review the debate over phenomenology’s role in qualitative research and argue that qualitative theorists have not taken full advantage of what philosophical phenomenology (...) has to offer, thus motivating the need for new approaches. In section 2, we introduce our alternative approach, which we call Phenomenologically Grounded Qualitative Research (PGQR). Drawing parallels with phenomenology’s applications in the cognitive sciences, we explain how phenomenological grounding can be used to conceptually front-load a qualitative study, establishing an explicit focus on one or more structures of human existence, or of our being in the world. In section 3, we illustrate this approach with an example of a qualitative study carried out by one of the authors: a study of the existential impact of early parental bereavement. In section 4, we clarify the kind of knowledge that phenomenologically grounded studies generate and how it may be integrated with existing approaches. (shrink)

_Contract and Domination_ offers a bold challenge to contemporary contract theory, arguing that it should either be fundamentally rethought or abandoned altogether. Since the publication of John Rawls's _A Theory of Justice_, contract theory has once again become central to the Western political tradition. But gender justice is neglected and racial justice almost completely ignored. Carole Pateman and Charles Mills's earlier books, _The Sexual Contract_ and _The Racial Contract_, offered devastating critiques of gender and racial domination and the contemporary (...) contract tradition's silence on them. Both books have become classics of revisionist radical democratic political theory. Now Pateman and Mills are collaborating for the first time in an interdisciplinary volume, drawing on their insights from political science and philosophy. They are building on but going beyond their earlier work to bring the sexual and racial contracts together. In _Contract and Domination_, Pateman and Mills discuss their differences about contract theory and whether it has a useful future, excavate the settler contract that created new civil societies in North America and Australia, argue via a non-ideal contract for reparations to black Americans, confront the evasions of contemporary contract theorists, explore the intersections of gender and race and the global sexual-racial contract, and reply to their critics. This iconoclastic book throws the gauntlet down to mainstream white male contract theory. Among the objections to the implementation of what I will call "genome editing in human reproduction" is that it does not address any unmet medical need, and therefore fails to meet an important criterion for introducing an unproven procedure with potentially adverse consequences. To be clear: what I mean by GEHR is the use of any one of a number of related biological techniques, such as the CRISPR-Cas9 system, deliberately to modify a functional sequence of DNA in a cell of (...) a human embryo, so that the modified sequence is replicated in the cells of a resulting child and may, without further intervention, be passed on to that child's biological descendants. Despite the fact that ethics consultations are an accepted practice in most healthcare organizations, many clinical ethicists continue to feel marginalized by their institutions. They are often not paid for their time, their programs often have no budget, and institutional leaders are frequently unaware of their activities. One consequence has been their search for concrete ways to evaluate their work in order to prove the importance of their activities to their institutions through demonstrating their efficiency and effectiveness.

Charles Mills makes visible in the world of mainstream philosophy some of the crucial issues of the black experience.

Since mitochondrial replacement techniques were developed and clinically introduced in the United Kingdom, there has been much discussion of whether these lead to children borne of three parents. In the UK, the regulation of MRT has dealt with this by stipulating that egg donors for the purposes of MRT are not genetic parents even though they contribute mitochondrial DNA to offspring. In this paper, I examine the way that the Human Fertilisation and Embryology Act in the UK manages the question (...) of parentage. I argue that the Act breaks the link typically made between genetic causation and genetic parenthood by redefining genetic causation solely in terms of nuclear genetics. Along with this, mtDNA is construed as a kind of supplement to the nuclear family. Drawing on the account of the supplement developed by Jacques Derrida, I argue that mtDNA and the women who donate it are seen as both essential to establishing the nuclear family but also exterior to and insignificant for it. One cannot deny the fact that we all have some understanding of moral issues. Each one of us can be said to have some sense of what is right, what is wrong, what is good, what is bad, what ought to be done, and what ought not to be done. This moral understanding can be in the form of some vague idea, notion, or simply a gut feeling. No matter who the person is, from which culture or community the person (...) belongs to, everybody faces a moral quandary sometime or other in one’s life. All of this presupposes that there is some fundamental sense or understanding of what is right and what is wrong. We all seem to have some understanding about actions that are right and those that are wrong. Some actions, for instance, torturing babies just for fun, killing an innocent person, raping, etc. are exemplars of morally wrong actions. Assisting a person in need, giving to famine relief, etc. on the other hand are examples of morally right actions. The present essay is an attempt to delve into the question of the source of moral knowledge. Three sources, experience, reason, and intuition have been identified. Views of philosophers like G.E Moore, WD Ross, Immanuel Kant, JS Mill, Plato, Samuel Clarke, Aristotle Hume, and Anthony Ashley Cooper have been discussed to gain clarity about the issue. (shrink)

My aim in this paper is to show that and how animal organisms are appropriate subjects of normative evaluation, on Hegel's view. I contrast my reading with the interpretive positions of Sebastian Rand and Mark Alznauer. I disagree with Rand and agree with Alznauer that animal organisms are normatively evaluable for Hegel. I substantiate my disagreement with Rand, and supplement Alznauer's interpretation, by spelling out the role that the ‘generic process’ or ‘genus process [Gattungsprozess]’ plays within Hegel's account of animal (...) organisms and their normative evaluability. In the course of my discussion, I highlight the main differences that Hegel purports to identify between animal and vegetable organisms and suggest that the upshot of those differences is that some but not all plants are normatively evaluable, by his lights. I also situate Hegel's discussion of theGattungsprozesswithin the debate on biological functions in the philosophy of biology over the last few decades. (shrink)

Fichte assigns ‘intellectual intuition’ a new meaning after Kant. But in 1799, his doctrine of intellectual intuition is publicly deemed indefensible by Kant and nihilistic by Jacobi. I propose to defend Fichte’s doctrine against these charges, leaving aside whether it captures what he calls the ‘spirit’ of transcendental idealism. I do so by articulating three problems that motivate Fichte’s redirection of intellectual intuition from being to acting: (1) the regress problem, which states that reflecting on empirical facts of consciousness leads (...) only to further facts and so cannot yield a first principle; (2) the rhapsody problem, which states that the categories form a haphazard set and so lack necessity unless they derive from a first principle; and (3) the nihilism problem, which states that a first principle cannot lie outside our cognition of it, lest it be the cause of our cognition and, being first, the cause of all our actions, reducing us to machines. Crucially, Fichte’s three motivating problems are in fact aspects of a single problem. Leaving any aspect unsolved spoils putative solutions to the other two. Consequently, Fichte requires a single unified solution to all three, which his doctrine of intellectual intuition provides. (shrink)
