In Erwiderung auf Kohlbergs Theorie moralischer Entwicklung betont Gilligan (1982, 2. Aufl.: 1993, S. 18 – 9), dass seine Theorie völlig von ihrem postulierten Ziel abhänge, nämlich einer prinzipien-geleiteten Urteilskraft. Hier wird nun analysiert, inwiefern Gilligans Diagnose nur die Spitze eines moralischen sowie theoretischen Eisbergs dadurch beleuchtet, dass ihre Untersuchungen der Klärung dienen, inwiefern Kohlbergs Etappen „Fünf“ und „Sechs“ eine spezifische Theorie des „moralischen Standpunkts“ voraussetzen, bei der Fragen der Gerechtigkeit und zu viel von dem, was wir einander und auch (...) uns selbst schulden, vernachlässigt werden. Um dies zu zeigen, untersuche ich zunächst, wie klassische Gerechtigkeitsfragen für teleologische Ethiktheorien nicht nur einmal, sondern zweimal verloren gegangen sind (§ 2). Ein wichtiges Beispiel dafür ist die radikale Kehre in der „ethischen Theorie“ zu Beginn des anglophonen 20. Jahrhunderts (C.E.), repräsentiert durch die Kehre von Moore, Prichard und Ross hin zu Partikularismus und Intuitionismus und deren prinzipielle Missachtung des tatsächlichen Verhaltens im tatsächlichen Kontext eines jeglichen Agenten (§ 3). Ein zweiter wichtiger Fall betrifft die liberal-individualistische Grundlage von Untersuchungen zu „der“ moralischen Sichtweise aus der Mitte des 20. Jahrhunderts (C.E.) und Vorstellungen von „Unparteilichkeit“, die Kant oft, aber fälschlicherweise zugeschrieben werden (§§ 4 – 7). Diese Überlegungen ermöglichen es, einige zentrale methodologische Verwirrungen zu identifizieren (§ 8), die unvermeidlich auch einige schwerwiegende moralische Verwirrungen erzeugen – Verwirrungen, die Kohlbergs Theorie der moralischen Entwicklung zugrunde liegen, von denen einige durch Gilligans Einwände gegen seine Theorie identifiziert werden (§ 9). Diese kritischen Überlegungen erlauben es mir dann, wesentliche Züge von Kants kritischem Ansatz zur Moralphilosophie zu charakterisieren (§ 10). Kants scharfsinnige Theorie moralischer Urteile und moralischer Rechtfertigung erfordert keine Berufung auf den einzigen inkommensurablen Wert der „Würde“; auch ist seine Darstellung nicht individualistisch: Die „Universalität“, die erforderlich ist, um Prinzipien, Handlungen und unsere moralischen Verpflichtungen, Erlaubnisse oder Verbote zu identifizieren und zu bewerten, ist im Prinzip und in der Praxis kosmopolitisch. Kants ‚konstruktiver‘ Ansatz zu diesen Fragen ist nicht der von Rawls; er wird vielmehr von Onora O’Neill korrekt identifiziert. Kants Explikation des rationalen Urteils und der rationalen Rechtfertigung kann das Pyrrhonsche Kriteriumsdilemma auflösen; alternative Methoden, die in der Moralphilosophie bevorzugt worden sind, können dies nicht. That they are ‘following the science’ has become the watchword of many politicians during the present pandemic, especially when imposing or prolonging lockdowns or other liberty-restricting regulations. The scientists who advise politicians however are usually careful to add that the decision what to restrict and when is ultimately a political one. In science, as in medical practice, there is a delicate balance to be maintained between confidence in the best available information, and the necessary caveat that the assumptions and calculations (...) on which that information is based are subject to further scientific enquiry. For politicians and the public, moreover, as for patients, whether those informing them are judged to be trustworthy is a necessary consideration, a judgement determined by a variety of personal and political contingencies and circumstances. Ethics, by contrast, unable to appeal to scientific consensus or political authority, let alone a confidence-inspiring bedside manner, must rest the case for its essentially contestable assumptions and arguments being judged trustworthy, on its willingness to admit all reasoned voices to a conversation that is potentially unending, but in the process often highly enlightening. That conversation is contributed to in this issue of the Journal by several reasoned voices, mostly on ethical aspects of the COVID-19 pandemic. Relevant to issues on which politicians claim to be ‘following the science’, but also raising fundamental ethical questions, is this month’s feature article. In Ethics of Selective Restriction of Liberty in a Pandemic, 1 Cameron and colleagues consider ‘if and when it may be ethically acceptable to impose selective liberty-restricting measures in order to reduce the negative impacts of a pandemic by preventing particularly vulnerable groups [for example, the elderly in COVID-19] of the community from contracting the disease’ [and thereby, for example, increasing …. Few if any of Kant’s critics were more trenchant than Hegel. Here I reconstruct some objections Hegel makes to Kant in a text that has received insufficient attention, the chapter titled ‘the Moral World View’ in the Phenomenology of Spirit. I show that Kant holds virtually all the tenets Hegel ascribes to ‘the moral world view’. I concentrate on five of Hegel’s main objections to Kant’s practical metaphysics. First, Kant’s problem of coordinating happiness with virtue (as worthiness to be happy) (...) is contrived. Kant denies that there is any inherent connection between acting rightly and being happy, but his denial depends on his defining happiness in terms of satisfying inclinations, rather than in terms of achieving ends in general. Second, Kant’s view of moral motivation is contrived; he ultimately admits that we cannot resolve to act without taking inclinations into account. (We cannot resolve to act apart from the matter of our maxim.) Third, Kant’s idea about perfecting our virtue in an infinite progress is incoherent. Kant defines virtue, and evidence of virtue, in terms of overcoming inclinations. Inclinations die with the body. Therefore there can be neither virtue nor evidence of virtue after death. Fourth, Kant’s view of the autonomy of moral agency is inconsistent with viewing the moral law as a divine command. Fifth, Kant’s moral principles cannot be put into practice in concrete circumstances because he supplies inadequate guidance for classifying acts. I conclude that Hegel’s objections to Kant’s practical metaphysics are sound, and I show that the problems Hegel raised against Kant’s account of autonomy and moral motivation are still current, since they have not been resolved, e.g., by Onora O’Neill’s Constructions of Reason. Hume and contemporary Humeans contend that moral sentiments form the sole and sufficient basis of moral judgments. This thesis is criticised by appeal to Hume’s theory of justice, which shows that basic principles of justice are required to form and to maintain society, which is indispensable to human life, and that acting according to, or violating, these principles is right, or wrong, regardless of anyone’s sentiments, motives or character. Furthermore, Hume’s theory of justice shows how the principles of justice are (...) artificial without being arbitrary. In this regard, Hume’s theory belongs to the unjustly neglected modern natural law tradition. Some key merits of this strand in Hume’s theory are explicated by linking it to Kant’s constructivist method of identifying and justifying practical principles (à la O’Neill), and by showing how and why Hegel adopted and further developed Kant’s constructivism by re-integrating it with Hume’s central natural law concern with our actual social practices. Onora O’Neill has contributed enormously to moral philosophy (broadly speaking, including both ethics and political philosophy) by identifying Kant’s unique and powerful form of normative constructivism. Frederick Neuhouser has contributed similarly by showing that all of Hegel’s standards of moral rationality aim to insure the complete development of three distinct, complementary forms of personal, moral and social freedom. However, Neuhouser’s study does not examine Hegel’s justificatory methods and principles. The present article aims to reinforce and extend Neuhouser’s findings by (...) explicating Hegel’s basic principles for justifying practical norms. Surprisingly, Hegel’s basic principles of normative justification are rooted in Kant’s constructivism, as explicated by O’Neill. Hegel’s adaptation and development of Kant’s constructivism results in a powerful form of constructivism about moral principles which merits contemporary interest because it is more powerful and more objectivist than familiar contemporary forms of constructivism. Hegel identified in Kant’s practical philosophy precisely the powerful kind of constructivism about the identification and justification of norms that has recently been explicated by Onora O’Neill. If so (I have argued elsewhere this is so), what then did Hegel contribute to practical philosophy? This essay partly answers this question by examining Kant’s and Hegel’s views of the aim and structure of practical philosophy, and what is required to determine specific duties. This theme is specified by examining these issues: (...) two oversights in Kant’s justification of rights to possession (§2), the role of philosophical anthropology in Kant’s universalization tests (§3), the roles of social institutions in specifying our ethical obligations (§4), Kant’s under-developed view of government (§5), and Hegel’s claim that, in contrast to Kant’s Rechtslehre, his Rechtsphilosophie provides an „immanent“ doctrine of duties (§6). I argue that Hegel attempted to respond to his own criticisms of Kant’s Categorical Imperative, and in doing so, Hegel contributed to practical philosophy in ways that Kantians and other moral, social and legal philosophers should consider seriously. Capturing the lively modernist milieu of Kenneth Burke's early career in Greenwich Village, where Burke arrived in 1915 fresh from high school in Pittsburgh, this book discovers him as an intellectual apprentice conversing with "the moderns." Burke found himself in the midst of an avant-garde peopled by Malcolm Cowley, Marianne Moore, Jean Toomer, Katherine Anne Porter, William Carlos Williams, Allen Tate, Hart Crane, Alfred Stieglitz, and a host of other fascinating figures. Burke himself, who died in 1993 at the (...) age of 96, has been hailed as America's most brilliant and suggestive critic and the most significant theorist of rhetoric since Cicero. Many schools of thought have claimed him as their own, but Burke has defied classification and indeed has often been considered a solitary, eccentric genius immune to intellectual fashions. But Burke's formative work of the 1920s, when he first defined himself and his work in the context of the modernist conversation, has gone relatively unexamined. Here we see Burke living and working with the crowd of poets, painters, and dramatists affiliated with Others magazine, Stieglitz's "291" gallery, and Eugene O'Neill's Provincetown Players; the leftists associated with the magazines The Masses and Seven Arts; the Dadaists; and the modernist writers working on literary journals like The Dial, where Burke in his capacity as an associate editor saw T. S. Eliot's "The Wasteland" into print for the first time and provided other editorial services for Thomas Mann, e.e. cummings, Ezra Pound, and many other writers of note. Burke also met the iconoclasts of the older generation represented by Theodore Dreiser and H. L. Mencken, the New Humanists, and the literary nationalists who founded Contact and The New Republic. Jack Selzer shows how Burke's own early poems, fiction, and essays emerged from and contributed to the modernist conversation in Greenwich Village. He draws on a wonderfully rich array of letters between Burke and his modernist friends and on the memoirs of his associates to create a vibrant portrait of the young Burke's transformation from aesthete to social critic. O'Neill begins by reconsidering Kant's conceptions of philosophical method, reason, freedom, autonomy and action. This paper provides a critical overview of recent work on epistemic blame. The paper identifies key features of the concept of epistemic blame and discusses two ways of motivating the importance of this concept. Four different approaches to the nature of epistemic blame are examined. Central issues surrounding the ethics and value of epistemic blame are identified and briefly explored. The connection between whole and part is intimate: not only can we share the same space, but I’m incapable of leaving my parts behind; settle the nonmereological facts and you thereby settle what is a part of what; wholes don’t seem to be an additional ontological commitment over their parts. Composition as identity promises to explain this intimacy. But it threatens to make the connection too intimate, for surely the parts could have made a different whole and the whole have (...) had different parts. In this paper I attempt to offer an account of parthood that is intimate enough but not too intimate: the parts generate the whole, but they are not themselves the whole. (shrink)

At the beginning of his Metaphysics, Aristotle attributed several strange-sounding theses to Plato. Generations of Plato scholars have assumed that these could not be found in the dialogues. In heated arguments, they have debated the significance of these claims, some arguing that they constituted an 'unwritten teaching' and others maintaining that Aristotle was mistaken in attributing them to Plato. In a prior book-length study on Plato's late ontology, Kenneth M. Sayre demonstrated that, despite differences in terminology, these claims correspond (...) to themes developed by Plato in the Parmenides and the Philebus. In this book, he shows how this correspondence can be extended to key, but previously obscure, passages in the Statesman. He also examines the interpretative consequences for other sections of that dialogue, particularly those concerned with the practice of dialectical inquiry. (shrink)

Many would argue that since Kant's day, the study of the starry heavens has advanced while ethics has stagnated, and in particular that Kant's ethics offers an empty formalism that tells us nothing about how we should live. In Acting on Principle Onora O'Neill shows that Kantian ethics has practical as well as philosophical importance. First (...) published in 1975, the book is regarded as a classic account and defence of the Kantian ethical position. It addresses Kant's account of reasoning about action, in particular his controversial claim that the Categorical Imperative guides action and is basic to ethics and justice. It is widely agreed among broadly Anselmian theists that God is in some sense the 'delimiter of possibilities.' In other words, the scope of possibility is explained by the manner in which the universe emanates from God. However, existing accounts of God's role here—in terms of freedom, choice, or power—face serious difficulties. The present paper provides a new account of God's role as the delimiter of possibilities in terms of the different manner in which the non-actuality of non-actual states of (...) affairs is explained. Intuitively and metaphorically, we can think of the menu of states of affairs being 'whittled down' in successive stages of a process of divine decision-making, with the different species of impossibility corresponding to when and how the states of affairs are ruled out. I argue that this approach provides genuine contingency while also preserving the Principle of Sufficient Reason. (shrink)

Decades of research conducted in Western, Educated, Industrialized, Rich, & Democratic (WEIRD) societies have led many scholars to conclude that the use of mental states in moral judgment is a human cognitive universal, perhaps an adaptive strategy for selecting optimal social partners from a large pool of candidates. However, recent work from a more diverse array of societies suggests there may be important variation in how much people rely on mental states, with people in some societies judging accidental harms just (...) as harshly as intentional ones. To explain this variation, we develop and test a novel cultural evolutionary theory proposing that the intensity of kin-based institutions will favor less attention to mental states when judging moral violations. First, to better illuminate the historical distribution of the use of intentions in moral judgment, we code and analyze anthropological observations from the Human Area Relations Files. This analysis shows that notions of strict liability—wherein the role for mental states is reduced—were common across diverse societies around the globe. Then, by expanding an existing vignette-based experimental dataset containing observations from 321 people in a diverse sample of 10 societies, we show that the intensity of a society's kin-based institutions can explain a substantial portion of the population-level variation in people's reliance on intentions in three different kinds of moral judgments. Together, these lines of evidence suggest that people's use of mental states has coevolved culturally to fit their local kin-based institutions. We suggest that although reliance on mental states has likely been a feature of moral judgment in human communities over historical and evolutionary time, the relational fluidity and weak kin ties of today's WEIRD societies position these populations' psychology at the extreme end of the global and historical spectrum. Physicians generally recommend that patients resuscitated with naloxone after opioid overdose stay in the emergency department for a period of observation in order to prevent harm from delayed sequelae of opioid toxicity. Patients frequently refuse this period of observation despiteenefit to risk. Healthcare providers are thus confronted with the challenge of how best to protect the patient’s interests while also respecting autonomy, including assessing whether the patient is making an autonomous choice to refuse care. Previous studies have shown that physicians (...) have widely divergent approaches to navigating these conflicts. This paper reviews what is known about the effects of opioid use disorder on decision-making, and argues that some subset of these refusals are non-autonomous choices, even when patients appear to have decision making capacity. This conclusion has several implications for how physicians assess and respond to patients refusing medical recommendations after naloxone resuscitation. (shrink)

Is there a distinctively epistemic kind of blame? It has become commonplace for epistemologists to talk about epistemic blame, and to rely on this notion for theoretical purposes. But not everyone is convinced. Some of the most compelling reasons for skepticism about epistemic blame focus on disanologies, or asymmetries, between the moral and epistemic domains. In this paper, I defend the idea that there is a distinctively epistemic kind of blame. I do so primarily by developing an account of the (...) nature of epistemic blame. My account draws on a prominent line of theorizing in moral philosophy that ties blame to our relationships with one another. Does Aristotle offer a definition of the soul? In fact, he rejects the possibility of defining the soul univocally. Because “life” is a homonymous concept, so too is “soul”. Given the specific causal role that Aristotle envisages for form and essence, the soul requires multiple different definitions to capture how it functions as a cause in each form of life. Aristotle suggests demonstrations can be given which express these causal definitions; I reconstruct these demonstrations in the paper.

The present collection of essays has as its primary aim to evaluate past women’s published philosophical work, and to introduce readers to newly recovered female figures; the collection will also make contributions to the history of the philosophy of gender, and to the history of feminist social and political philosophy, insofar as the collection will discuss women’s views on these (...) issues. The volume contains contributions by an international group of leading historians of philosophy and political thought, whose scholarship represents some of the very best work being done in North and Central America, Canada, Europe and Australia. One challenge in developing an account of the nature of epistemic blame is to explain what differentiates epistemic blame from mere negative epistemic evaluation. The challenge is to explain the difference, without invoking practices or behaviors that seem out of place in the epistemic domain. In this paper, I examine whether the most sophisticated recent account of the nature of epistemic blame—due to Jessica Brown—is up for the challenge. I argue that the account ultimately falls short, but does so in (...) an instructive way. Drawing on the lessons learned, I put forward an alternative approach to the nature of epistemic blame. My account understands epistemic blame in terms of modifications to the intentions and expectations that comprise our “epistemic relationships” with one another. This approach has a number of attractions shared by Brown’s account, but it can also explain the significance of epistemic blame. (shrink)

In this short paper, I critically examine Veli Mitova’s proposal that social-identity groups can have collective epistemic reasons. My primary focus is the role of privileged access in her account of how collective reasons become epistemic reasons for social-identity groups. I argue that there is a potentially worrying structural asymmetry in her account of two different types of cases. More specifically, the mechanisms at play in cases of “doxastic reasons” seem fundamentally different from those at play in cases of “epistemic-conduct (...) reasons”. The upshot is a need for further explanation of what unifies these dimensions of the account. (shrink)

Plato’s references to Empedocles in the myth of the Statesman perform a crucial role in the overarching political argument of the dialogue. Empedocles conceives of the cosmos as structured like a democracy, where the constituent powers ‘rule in turn’, sharing the offices of rulership equally via a cyclical exchange of power. In a complex act of philosophical appropriation, Plato takes up Empedocles’ cosmic cycles of rule in order to ‘correct’ them: instead of a democracy in which rule is shared cyclically (...) amongst equal constituents, Plato’s cosmos undergoes cycles of the presence and absence of a single cosmic monarch who possesses ‘kingly epistēmē’. By means of a revision of Empedocles’ democratic cosmology, Plato’s richly woven myth is designed precisely to reject the appropriateness of democracy as a form of human political association and legitimate monarchy in its stead. ABSTRACT:Deliberative democratic theory, commonly used to explore questions of “political” corporate social responsibility, has become prominent in the literature. This theory has been challenged previously for being overly sanguine about firm profit imperatives, but left unexamined is whether corporate contexts are appropriate contexts for deliberative theory in the first place. We explore this question using the case of Starbucks’ “Race Together” campaign to show that significant challenges exist to corporate deliberation, even in cases featuring genuinely committed firms. We return to (...) the underlying social theory to show that this is not an isolated case: for-profit firms are predictably hostile contexts for deliberation, and significant normative and strategic problems can be expected should deliberative theory be imported uncritically to corporate contexts. We close with recent advances in deliberative democratic theory that might help update the PCSR project, and accommodate the application of deliberation to the corporate context, albeit with significant alterations. Biologists seems to hold two fundamental beliefs: Organisms are organized into levels and the individuals at these levels differ in their properties. Together these suggest that there will be massive multiple realization, i.e. that many human psychological properties are multiply realized at many neurobiological levels. This paper provides some documentation in support of this suggestion.

The chapter develops a taxonomy of views about the epistemic responsibilities of citizens in a democracy. Prominent approaches to epistemic democracy, epistocracy, epistemic libertarianism, and pure proceduralism are examined through the lens of this taxonomy. The primary aim is to explore options for developing an account of the epistemic responsibilities of citizens in a democracy. The chapter also argues that a number of recent attacks on democracy may not adequately register the availability of a minimal approach to the epistemic responsibilities (...) of citizens in a democracy.
