This study starts from the observation that there are relatively few controversial issues in corporate social responsibility (CSR). Given its strong normative background, CSR is rather an atypical discipline, especially in comparison with moral philosophy or applied ethics. Exploring the mainstream CSR agenda, this situation was echoed by widespread consensus on what was considered to be "good practice": reducing pollution, shutting down sweatshops, discouraging tax evasion, and so on. However, interpretation of these issues through the lens of moral (...) pluralism unveils latent controversies. The moral appraisal of good practices within CSR depends on key moral concepts (such as harm, responsibility, intention, and consequences), which have various—and often incompatible—interpretations. Philosophical treatments of scientific controversies usually focus on theory, excluding important practice related aspects. However, scientists in conflict often appeal to extra-theoretical and extra-empirical elements. To understand better the role that non-empirical elements play in scientific controversies, we introduce the notion of borrowed epistemic credibility, illustrating our proposal with a recent controversy in a field of evolutionary biology known as phylogeography. Our analysis shows how scientific controversies that spring from disagreements about methodological issues potentially involve deeper debates regarding what (...) constitutes good science, prompting the re-examination of more general issues, such as the nature of inference, rationality, and objectivity. Although there is increasing recognition that theory and practice in science are often inseparably intertwined, discussions of scientific controversies often continue to focus on theory, and not practice or methodologies. As a contribution to constructing a framework towards understanding controversies linked to scientific practices, we introduce the notion of borrowed epistemic credibility, to describe the situation in which scientists exploit fallacious similarities between accepted tenets in other fields to garner support for a given position in their own field. Our proposal is based on the analysis of a recent controversy in phylogeography, a biological subdiscipline concerned with the study of the historical causes of variation in genetic diversity within species in concrete biogeographical locations. Through a review of the arguments that support the two conflicting phylogeographic schools, we show that ‘theory’ plays essentially no role as a foundation of the controversy, whereas both sides borrow epistemic credibility from sources such as formal logic, similarity of results to those in other scientific areas, the authority of prominent scientists, or the presumed superiority of quantitative vs. verbal reasoning. Our case study underscores the indivisibility of theory and practice and provide a means to re-examine important philosophical issues such as the meaning of inference, rationality, justification, and objectivity in scientific practice. This paper studies the controversy on Fehr and Schmidt's model of inequity aversion. It borrows insights from disciplines such as philosophy and the sociology of science that have specialized in studying scientific controversies. Our goal is to contribute to the historical and methodological literature on behavioral economics, which happens to have neglected behavioral economists' research on social preferences. In this paper, we investigate how data about public preferences may be used to inform policy around the use of controversial novel technologies, using public preferences about autonomous vehicles (AVs) as a case study. We first summarize the recent ‘Moral Machine’ study, which generated preference data from millions of people regarding how they think AVs should respond to emergency situations. We argue that while such preferences cannot be used to directly inform policy, they should not be disregarded. We defend (...) an approach that we call ‘Collective Reflective Equilibrium in Practice’ (CREP). In CREP, data on public attitudes function as an input into a deliberative process that looks for coherence between attitudes, behaviours and competing ethical principles. We argue that in cases of reasonable moral disagreement, data on public attitudes should play a much greater role in shaping policies than in areas of ethical consensus. We apply CREP to some of the global preferences about AVs uncovered by the Moral Machines study. We intend this discussion both as a substantive contribution to the debate about the programming of ethical AVs, and as an illustration of how CREP works. We argue that CREP provides a principled way of using some public preferences as an input for policy, while justifiably disregarding others. (shrink)

This study explores teachers’ personal practical knowledge and curricular-instructional gatekeeping as they relate to the teaching of controversial issues in public elementary school settings, particularly the issue of immigration. The study took place in the urban setting of Houston and, using a case study design, documented how three elementary school teachers made curricular-instructional decisions by making use of their personal practical knowledge. Findings illuminate that personal practical knowledge plays a role in teacher's curricular-instructional gate keeping in socially divisive contexts. (...) The concept of infinity has a long and troubled history. Thus it is a promising concept with which to explore rejection, disagreement, controversy and acceptance in mathematical practice. This paper briefly considers four cases from the history of infinity, drawing on social constructionism as the background social theory. The unit of analysis of social constructionism is conversation. This is the social mechanism whereby new mathematical claims are proposed, scrutinised and critiqued. Minimally, conversation is based on the two roles of (...) proponent and critic. The proponent puts forward a proposal, which is reacted to and evaluated by those in the role of critic. There is a continuum of contexts in which such conversations take place from inner conversations the mathematician has within themselves, and casual face-to face interactions between mathematicians at the chalkboard, all the way to the formal responses of referees and editors to submitted journal papers. Such responses vary from unconditional acceptance, partial acceptance through to outright rejection. There may be disagreements between proponents and critics, among those in the joint role of critic, and broader, community-wide disagreements and controversies, according to specific mathematical proposal and the critical judgements of it. Every healthcare organisation enacts a multitude of policies, but there has been no discussion as to what procedural and substantive requirements a policy writing process should meet in order to achieve good outcomes and to possess sufficient authority for those who are asked to follow it.Using, as an example, the controversy about patient’s refusal of blood transfusions, I argue that a hospital wide policy is preferable to individual decision making, because it ensures autonomy, quality, fairness, and efficiency.Policy writing for morally (...) controversial medical practices needs additional justification compared to policies on standard medical practices and secures legitimate authority for HCO members by meeting five requirements: all parties directed by the policy are represented; the deliberative process encompasses all of the HCO’s obligations; the rationales for the policy are made available; there is a mechanism for criticising, and for evaluating the policy. These two small works are a good supplement to Rescher’s recent trilogy. Whereas the systems-theoretic approach is employed in Methodological Pragmatism in dealing with the problem of the legitimation of claims to factual knowledge or cognitive rationality, Dialectics deals with the argumentation aspect of thesis-introduction rather than the logical aspect of thesis-derivation. Although some key notions such as the idea of burden of proof and presumption have been stated in the former work, what is offered here is a systematic discussion (...) of a disputational model of inquiry. The principal aims are "to exhibit the sociocommunal roots of the foundations of rationality, to provide an instrument for the critique of scepticism implicit in the cognitive solipsism of the Cartesian approach, and to illuminate the communal and controversy-oriented aspects of rational argumentation and inquiry—scientific inquiry in particular." Again, Rescher limits his discussion to "the probative mechanism in the factual domain." This book, if it were not for its price, should be a good supplement to a course in "informal" logic which focuses on argumentation rather than on mere evaluation of arguments. Plausible Reasoning provides the mechanism for evaluation of plausibility claims as distinct from probabilistic ones. The basic differences between these two types of claims are clearly discussed. "Plausibility is essentially a classificatory concept which ranks theses in terms of the standing and solidity of their cognitive basis. Plausibility grades theses by an external or extrinsic standard of the hierarchical nature of their supporting bases. It classifies propositions by the status of the evidential sources or validating principles that vouch for them. Probability weighs alternatives and evaluates theses by this relative contentual weight of the supporting considerations."—A.S.C. (shrink)

In this article, I build upon Jean-Albert Vinel’s account of Augustine’s “liturgical argument” against the Pelagians by exploring how and why Augustine uses both the givenness of the practice of infant baptism and its ritual components as evidence for his theological conclusions in opposition to those of the Pelagians. First, I explore infant baptism in the Roman North African Church before and during Augustine’s ministry. Second, I interpret Augustine’s rhetorical adaptation of the custom in his attempt to delineate the (...) defining characteristics of Catholic Christianity in the early fifth century. I show how Augustine mobilizes his belief in the efficacy of the Church’s practice of infant baptism to make explicit a boundary marker of “Catholic” Christianity, which was long implicit in the practice itself. Perceiving the consequences of Pelagianism, Augustine organizes his anti-Pelagian soteriology around the central node of infant baptism, the most theologically and rhetorically strategic means by which he could refute the Pelagian heresy and underwrite what he understood to be the traditional vision of sin and salvation evident in the baptismal rite. In this paper, I will examine John Smeaton’s contribution to the vis viva controversy in Britain, focusing on how the hybridization of science, technology, and industry helped to establish vis viva, or mechanic power, as a measure of motive force. Smeaton, embodying the ‘hybrid expert’ who combined theoretical knowledge and practical knowhow, demonstrated that the notion of vis viva possessed a greater explanatory power than momentum, because it could be used to explain the difference in efficiency between overshot and undershot (...) waterwheels. Smeaton’s conclusions were correct since waterwheel efficiency was already measured in terms that were proportional to vis viva, not momentum, as a result of the industrial applications of waterwheel technology, which favored measuring efficiency by the product of mass and vertical displacement. Toward the end of the eighteenth century, the loss of motive force in the inelastic collision driving the undershot wheel began to be seen as equivalent to the expenditure of labor in the manufacture of commodities, further underlining how strictly scientific conclusions about motive force could have their origin in industrial practices. Raphael Cohen-Almagor’s Just, Reasonable Multiculturalism offers a different way of approaching multiculturalism from the systematic theoretical treatments that anchor the literature. While strongly committed to liberal democratic values, it presents not so much a theory or moral argument justifying minority or majority cultural rights as a set of values and principles for adjudicating controversial cases and oft-heard arguments against multicultural accommodation. After noting distinctive features of the approach, I discuss three areas of tension in the analysis. First, between its (...) appeals to Rawlsian justice and state neutrality and its support of state multiculturalism. Second, between its stated theoretical principles and its adjudication of some cases. Third, regarding how we think about a state’s entanglement with culture and, specifically, whether that should be in terms of an incomplete liberal neutrality, liberal perfectionism, or liberal nationalism. I suggest that as helpful as Cohen-Almagor’s liberal-democratic guidelines are, there remain some contextual factors which are no less important in justly responding to the pointy end of multiculturalism. SummaryAn account is given of one of the most heated controversies in nineteenth-century British geology—the battle between Archibald Geikie and John Judd concerning the interpretation of the Palaeogene igneous rocks of the Inner Hebrides, particularly those of the Cuillins and the Red Hills of Skye. The controversy erupted in the first instance over the question of the respective ‘territories’ of the two geologists, then developed into disagreement as to the origin of the plateau lavas of Skye: were they formed from (...) fissure eruptions (Geikie's view) or from the outpourings of great volcanoes (Judd's view)? Debate then focused on the question of the relative age of the gabbro of the Cuillins and the granite (granophyre) of the Red Hills. A certain locality at Druim Hain (Druim an Eihdne) at the junction between the two rock-types became crucial for the dispute. Following earlier observers, Judd held that the granite was older and had been intruded by the gabbro. Geikie took the opposite view. Geikie's work relied particularly on field observations, for which he was assisted by several other geologists. Judd, who worked by himself, rested his argument more on the evidence furnished by petrology, using thin sections. Both geologists were influenced by Ferdinand von Richthofen. Geikie's work appeared to be vindicated in his own lifetime by the map work of Alfred Harker, which effectively closed the controversy. But later commentators such as Walker hold that in a sense both were correct. There were indeed great volcanoes active in the Inner Hebrides in the Palaeogene, as well as fissure eruptions. Moreover, recent mapping does not support all the observations of Geikie and Harker. The controversy illustrates different styles in nineteenth-century geology, with petrological arguments, based on the examination of thin sections, pitted against field observations. It may also be seen as being linked with the ongoing rivalry in the nineteenth century between the members of the Geological Survey (particularly the Directors General) and the ‘amateur’ university geologists. Geikie prevailed in the debate in part because he was able to draw on more resources for its prosecution, being helped by various friends and members of the Geological Survey. The study draws on the newly discovered Geikie archive at Haslemere, which contains his complete outgoing official correspondence, and 27 of his field notebooks, previously missing. With the help of this material, it is possible to gain a clearer insight into the methods deployed by Geikie in his fieldwork, and his ways of working and thinking. (shrink)

: This article explores debate as a key scientific practice among the medical elite in nineteenth-century Paris, with an emphasis on academic debate and debate in the scientific/medical press. I use the debate over the microscope, which took place in the Paris Academy of Medicine in 1854-55 and concurrently in the medical press, to illustrate the role of debate as scientific practice. Focusing on the debate in the press, I show how medical journalists used the debate in the (...) Academy to raise larger questions about the nature of science and medicine and to legitimate French microscopy. I suggest that debate was an important scientific practice in nineteenth-century Paris, not only owing to a longstanding belief that truth emerges through disputation but also depending on and exemplifying a shared masculine culture of honor. How should we teach controversial issues? And which issues should we teach as controversies? In this paper, I argue that educators should heed what I call a ‘psychological condition’ in their practical efforts to address these questions. In defending this claim, I engage with the various decision criteria that have been advanced in the controversial issues literature: the epistemic criterion, behavioral criterion, political criterion and politically authentic criterion. My argument is that the supporters of these various criteria have (...) focused too closely on the socio-political and epistemic qualities of controversial issues in deriving their controversial issues pedagogies and have thereby overlooked the necessary subjective conditions for teaching controversial issues. If our pedagogical efforts to cultivate students’ reason by means of controversial issues are to be successful, then we must understand controversy as fundamentally a psychological phenomenon consisting in an intellectual tension in the minds of students. In the final pages, I conclude by recommending several forms of directive teaching that promise to be instrumental for creating such intellectual tension. (shrink)

Controversies in science are an essential feature of scientific practice: defined here as current problems that are unresolved because there are no accepted procedures by which they can be resolved or there are differing assumptions that affect the interpretation of evidence. Although there has been much attention in science education literature addressing socio-scientific and historical controversies in science, less has been paid to the teaching of contemporary scientific controversies. Using semi-structured qualitative interviews with 18 teachers at different career stages (...) in England, we investigated teachers’ social representations of scientific controversies using the discourse of the collective subject. We found a lack of controversy in teachers’ responses. Whilst scientific controversies were seen as an essential feature of how science works, they were not viewed as essential in science education and were represented as a distraction and dealt with informally, outside the planned curriculum and in response to students’ questions. Subject knowledge was considered a barrier. We argue that teaching about carefully selected scientific controversies has the potential to contribute to teachers’ and students’ understandings of science and the nature of science. There are perceived to be few opportunities for teachers to exercise this in the English context. We suggest how the collective subject discourses might be used to open up a discussion about teaching controversies in professional learning situations. Materials to stimulate discussion of scientific controversies could be useful in future curriculum development in science, but these would need to address the barriers of subject knowledge, access to literature and conflict with assessment-related priorities and a perceived need to advocate for trust in science. There are a number of agricultural farming practices that are controversial. These may include using chemical fertilizers, pesticides, and herbicides, and planting genetically modified crops, as well as the decision to dehorn cattle rather than raise polled cattle breeds. We use data from a survey of Missouri crop and livestock producers to determine whether a farmer’s ethical framework affects his or her decision to engage in these practices. We find that a plurality of farmers prefer an agricultural policy that (...) reflects principles based on rights rather than principles of utilitarianism or justice. Furthermore, after controlling for personal and farm characteristics, we find a positive correlation between farmers preferring a rights-based policy and a farmer’s use of chemical farm inputs and polled rather than horned cattle. We also find that a combination of ethical framework and farm and farmer characteristics correlate with decisions to use farm chemicals, while only farm and farmer characteristics affect the decision to plant GM crops and only a farmer’s ethical framework affects the decision to use polled cattle. This chapter reviews fundamental ethical controversy surrounding the ongoing effort to revise the Uniform Determination of Death Act in the United States. Instead of focusing on the process of the revision itself, the chapter explores the underlying ethical debate over brain death that has been ongoing for many decades and finally culminated in this revision. Three issues are focused: the requirement for consent and personal exemptions before applying brain death for the diagnosis of death; redefining the areas of the brain (...) that have ceased to function in the definition of brain death; and codifying the American Academy of Neurology as the authority to issue the standards of the diagnosis of brain death. The chapter concludes that allowing the personal choice of death determination gives a pragmatic compromise to the disputed definition and practice of diagnosing brain death. So long as all risks and imperfections of the diagnosis are accepted through the consenting process, there is nothing ethically objectionable to continuing the current practice of diagnosing brain death as a successful tool to facilitate heart-beating organ donation without violating the dead-donor rule. By contrast, precluding personal choice and imposing legal restrictions to consent and exemptions would further erode public trust. (shrink)

This article discusses the quest for the mechanical advantage of the wedge in the eighteenth century. As a case study, the wedge enlightens our understanding of eighteenth-century mechanics in general and the controversy over “force” or vis viva in particular. In this article, I show that the two different approaches to mechanics, the one that favoured force in terms of velocities and the one that primarily used displacements—known as the ‘Newtonian’ and ‘Leibnizian’ methods, respectively—were not at all on par in (...) their ability to solve the problem of the wedge. In general, only those who used the Leibnizian concept of force or some related notion were able to get to the conventional results. This article thus rebuts the received view that the vis viva controversy was merely a semantic one. Instead, it shows that different understandings of “force” led to real and pragmatic differences in eighteenth-century mechanics. (shrink)

It is argued that the emergence of controversial views in discussions of theoretical medicine and bioethics is best explained by the assumption of moral realism within those discursive practices. Neither of the main alternatives of realism in contemporary meta-ethics — moral expressivism and anti-realism — can account for the rise of controversies in the bioethical debate. This argument draws from the contemporary expressivist or anti-representationalist pragmatism as advanced by Richard Rorty and Huw Price, as well as the pragmatist scientific (...) realism and fallibilism of the founder of pragmatism, Charles S. Peirce. In accordance with the fallibilist view, it is proposed that presenting controversial positions may serve epistemic purposes within bioethical debates, providing opportunities for inquiry by pointing towards problems to be solved and arguments and evidence for and against to be put forward. The new class of anti-inflammatory drugs, the COX-2 inhibitors, have been commercially successful to the point of market dominance within a short time of their launch. They attract a price premium on the basis that they are associated with fewer adverse gastric events than traditional anti-inflammatory drugs. This marketing continues even though a pivotal safety study with one of the COX-2 inhibitors, rofecoxib, showed a significant increase in myocardial infarction with rofecoxib use compared with a traditional anti-inflammatory drug. This finding (...) has led to a series of publications containing pooled analyses of existing data that both support and refute the possibility of increased cardiovascular risk with COX-2 inhibitors.These medical journal publications have served to obfuscate rather than provide guidance for medical practitioners. Consideration of a research ethics committee approach to this issue suggests that it would deal with the controversy in a straightforward manner—namely, it would simply inform research participants of the trial results with rofecoxib. The certainty of this research ethics committee approach raises the issue of whether it should be applied in normal medical practice outside of the research environment. A consideration of the legal tests for disclosure of information suggests that therapeutic medical practice should mirror that within the research environment, in this case. (shrink)

This thesis examines philosophical controversies surrounding the evaluation of medical treatments, with a focus on the evidential roles of randomised trials and mechanisms in Evidence-Based Medicine. Current 'best practice' usually involves excluding non-randomised trial evidence from systematic reviews in cases where randomised trials are available for inclusion in the reviews. The first paper challenges this practice and evaluates whether adding of evidence from non-randomised trials might improve the quality and precision of some systematic reviews. The second paper compares (...) the alleged methodological benefits of randomised trials over observational studies for investigating treatment benefits. It suggests that claims about the superiority of well-conducted randomised controlled trials over well-conducted observational studies are justified, especially when results from the two methods are contradictory. The third paper argues that postulating the unpredictability paradox in systematic reviews when no detectable empirical differences can be found requires further justification. The fourth paper examines the problem of absence causation in the context of explaining causal mechanisms and argues that a recent solution is incomplete and requires further justification. Solving the problem by describing absences as causes of 'mechanism failure' fails to take into account the effects of absences that lead to vacillating levels of mechanism functionality. The fifth paper criticises literature that has emphasised functioning versus 'broken' or 'non-functioning' mechanisms emphasising that many diseases result from increased or decreased mechanism function, rather than complete loss of function. Mechanistic explanations must account for differences in the effectiveness of performed functions, yet current philosophical mechanistic explanations do not achieve this. The last paper argues that the standard of evidence embodied in the ICE theory of technological function is too permissive for evaluating whether the proposed functions of medical technologies have been adequately assessed and correctly ascribed. Dordrecht: Springer, 121-132. -/- Abstract: This chapter is a comment on the contribution of Rebecca Klein in this volume, preceded by a conceptual analysis of the argument that is developed in the Homo Amans position paper. The main question that is raised is twofold and concerns the relation between science and worldview on the one hand, and between science and economic life on the other. (...) With respect to the science – worldview relationship, it is doubted that science can play the role the authors of the Homo Amans project expect it can have. What they have in mind is that science helps in validating and legitimizing a biblically informed concept of love. This author disagrees, to a large extent. Science can indeed orient itself on ideas and intuitions that are based on one’s worldview. But it cannot prove the truth of these intuitions and ideas. To think so, is to commit a naturalistic fallacy. With respect to the relationship between science and economic life, the author is also not convinced that science and philosophy as academic disciplines will by themselves be able (and should be expected to be able) to transform deeply ingrained, institutionally anchored economic practices. New theories, concepts, and paradigms are a precondition for change, but they do not bring about change by themselves. What is needed is a change in the practices themselves, a change that is both personal and comprehensive. What is needed is a clear, succinct, and encompassing view on the intrinsic normativity of economic interactions between relevant stakeholders in what we call ‘the’ economy. This is a huge undertaking, that requires painstaking ‘phenomenological’ analyses of a wide variety of economic practices. The chapter agrees with most of Klein’s observations and concerns with respect to the position paper. These observations and concerns gain even more depth and relief given the conceptual distinctions that are made in the chapter. (shrink)

Although scientific practice sometimes encounters philosophical dif- ficulties, it cannot shoulder the burden of resolving them. This can lead to controversies. An unavoidable difficulty is rooted in the linguistic attitude, i.e., in the fact that to a considerable extent we express our thoughts in words. I will attempt to illuminate some important characteristics of linguistic expres- sion which lead to paradoxical situations, identifiable thanks to philosophy. In my argument, I will investigate how the notion of consciousness has altered over (...) the course of philosophical investigation and how it relates to recent scientific practice. In conclusion, I will focus on a few recent so-called radical positions in philosophy with regard to a framework within which consciousness and more generally mental phenomena can be regarded in a new light, as well as on the barriers we face when trying to unify scientific results. This book uses controversies as a gateway through which to explore the origins, ethics, key moments and people in the history of anthropology. It draws on a variety of cases including complicity in 'human zoos', Malinowski's diaries, and the Human Terrain System to explore how anthropological controversies act as a driving force for change, how they offer a window into the history of and research practice in the discipline, and how they might frame wider debates such as those around (...) reflexivity, cultural relativism, and the politics of representation. The volume provokes discussion about research ethics and practice with tangible examples where grey areas are brought into sharp relief. How can controversy promote mutual respect in analytical psychology? Analytical psychology is a broad church, and influences areas such as literature, cultural studies, and religion. Nowadays, the forms assumed by knowledge indicate an unhinging of traditional structures conceived on the model of discipline. Consequently, what was once strictly disciplinary becomes interdisciplinary, what was homogeneous becomes heterogeneous and what was hierarchical becomes heterarchical. When we look for a matrix of interdisciplinarity, that is to say, a primary basis or an essential dimension of all the complex phenomena we are surrounded by, we see the need to break with the disciplinary self-restraint in which, often completely inadvertently, many (...) of us lock ourselves up, remaining anchored to our own competences, ignoring what goes beyond our own sphere of reference. What are preferences and are they reasons for action? Is it rational to cooperate with others even if that entails acting against one's preferences? The dominant position in philosophy on the topic of practical rationality is that one acts so as to maximize the satisfaction of one's preferences. This view is most closely associated with the work of David Gauthier, and in this collection of essays some of the most innovative philosophers working in this field explore the controversies surrounding Gauthier's (...) position. Several essays argue against influential conceptions of preference, while others suggest that received conceptions of rational action misidentify the normative significance of rules and practices. The article purports to show that the preference of theôria in Nicomachean Ethics X 7–8 does not represent Aristotle's definitive conception of the best form of life, because it is compatible neither with his overall conception of happiness in the EN nor with its political framework. The critical chapters rather recall an early contribution of Aristotle's to a controversy on the best form of life in the Academy, attested to in Politics VII 2–3; its central point is resolved in Politics (...)
