Gilbertson et al present a considered analysis of the abstract problem of ‘sedation’ at the end of life,1 and it is reassuring to see the separation of multiple practises that are often grouped under the heading terminal sedation. In their work, the authors attempt to introduce and justify a new practice in the care of those dying with significant suffering—expanded terminal sedation (ETS). This analysis will not, however, help our colleagues at the bedside. Here, we will focus on the flaws (...) which are most relevant to clinicians: jurisdiction, uncertainty and reversibility. The authors’ focus on a jurisdiction that does already allow medically assisted in dying confuses their analysis. For example, either an instance of their proposed ETS does amount to intentionally hastening death, in which case it should be treated as a means of euthanasia and practised only where that is permitted, subject to its limits and regulations; or it does not amount to intentionally hastening death, in which case there is no reason to specify such jurisdictions. To explain that the most controversial elements of terminal sedation have been tacitly ‘accepted’ by the society in question does not invalidate the concerns. We read with interest the extended essay published from Riisfeldt and are encouraged by an empirical ethics article which attempts to ground theory and its claims in the real world. However, such attempts also have real-world consequences. We are concerned to read the paper’s conclusion that clinical evidence weakens the distinction between euthanasia and normal palliative care prescribing. This is important. Globally, the most significant barrier to adequate symptom control in people with life-limiting illness is poor access to (...) opioid analgesia. Opiophobia makes clinicians reluctant to prescribe and their patients reluctant to take opioids that might provide significant improvements in quality of life. We argue that the evidence base for the safety of opioid prescribing is broader than that presented, restricting the search to palliative care literature produces significant bias as safety experience and literature for opioids and sedatives exists in many fields. This is not acknowledged in the synthesis presented. By considering additional evidence, we reject the need for agnosticism and reaffirm that palliative opioid prescribing is safe. Second, palliative sedation in a clinical context is a poorly defined concept covering multiple interventions and treatment intentions. We detail these and show that continuous deep palliative sedation is a specific practice that remains controversial globally and is not considered routine practice. Rejecting agnosticism towards opioids and excluding CDPS from the definition of routine care allows the rejection of Riisfeldt’s headline conclusion. On these grounds, we reaffirm the important distinction between palliative care prescribing and euthanasia in practice. (shrink)

This essay begins with a puzzle in metaphysics, the unity dilemma . The enduring debate between monists and pluralists can be understood in terms of a single problem, the supposed impossibility of including the bulk of our naive ontology in a single, all-embracing ontological category. Either one insists, as the monist does, on a unified ontology at the cost of surrendering much of our naive ontology to reduction or non-existence, or one accommodates the bulk of our naive ontology by accepting (...) more than one fundamental ontological category. ;For a suggestion of how we might resolve the dilemma, we turn to the case of photography. Because photographs---like symphonies, novels, words, and species---have occurrences, there is a temptation to think they must belong to a different ontological category from paintings and other central members of our ontology. I investigate a received view about such 'multiple' works of art, that they should be understood within the framework of types and tokens. I argue that the type approach fails to correctly account for photographs precisely because it ignores a sustained analogy between photographs and paintings. Unlike types, both photographs and paintings are temporal items, subjects of change and modal possibility, and are ontologically grounded in the physical world. ;I then generalize the lessons of photography and formulate a distinction between real and idealized objects. Real objects are genuinely historical objects, those which exist temporally, are subject to temporal and modal alteration, are susceptible to causal interaction, and are ontologically grounded in the physical world. Idealized objects lack one or more of these features, either because they lack a genuine history or because their existence is cut loose from any ontological grounding in this world. I argue that this distinction is independent of traditional distinctions between physical and mental, concrete and abstract, and particular and universal, and suggest that there are examples of real objects in all these categories. The category of the real is a promising candidate for resolving the unity dilemma because it shows us how seemingly disparate members of our naive ontology turn out to category-matcs after all. Psychiatry presents a unique array of difficult ethical questions. However, a major challenge is to approach psychiatry in a way that does justice to the real ethical issues. Recently there has been a growing body of research in empirical psychiatric ethics, and an increased interest in how empirical and philosophical methods can be combined. In this unusual and much-needed reappraisal of Freud's clinical technique, M. Guy Thompson challenges the conventional notion that psychoanalysis promotes relief from suffering and replaces it with a more radical assertion, that psychoanalysis seeks to mend our relationship with the real that has been fractured by our avoidance of the same. Thompson suggests that, while avoiding reality may help to relieve our experience of suffering, this short-term solution inevitably leads to a split in our existence. M. Evidentialism as its leading proponents describe it has two distinct senses, these being evidentialism as a conceptual analysis of epistemic justification, and as a prescriptive ethics of belief—an account of what one ‘ought to believe’ under different epistemic circumstances. These two senses of evidentialism are related, but in the work of leading evidentialist philosophers, in ways that I think are deeply problematic. Although focusing on Richard Feldman’s ethics of belief, this chapter is critical of evidentialism in both senses. However, I (...) share with authors like Feldman and Earl Conee, that epistemology has important prescriptive functions, and that a sound, civic ethics of belief is of more than merely philosophic importance. One reason why an ethics of belief might be important to problems of practice is the need we have for tools to more effectively mediate the renewed round of ‘culture wars’ we are experiencing in Anglo-American cultures. I mean especially that grand cultural clash between science and religion, reason and faith, secularist atheism and religious fundamentalism, etc. Let us start with the genealogical question of why there is such a grand cultural debate in the first place, and why the debate especially as played out in public and popular forums and even in the courtrooms seems so volatile and so often to confusedly drag everything—beliefs, values, passions, etc., with it. These are questions that I think Sigmund Freud’s classic Civilization and its Discontents can help us understand. Freud was a major voice in criticism of the stern and often hypocritical Victorian morality, a voice pointing out the price of its sometimes high-handed, guiltinducing curtailments of the satisfactions sought by the individual. But for Freud while there are real differences in the moral demands that different societies or traditions place upon people, there is something inevitable about the conflict itself, for “replacement of the power of the individual by the power of a community constitutes the decisive step of civilization... Critics and defenders of William James both acknowledge serious tensions in his thought, tensions perhaps nowhere more vexing to readers than in regard to his claim about an individual’s intellectual right to their “faith ventures.” Focusing especially on “Pragmatism and Religion,” the final lecture in Pragmatism, this chapter will explore certain problems James’ pragmatic pluralism. Some of these problems are theoretical, but others concern the real-world upshot of adopting James permissive ethics of belief. Although Jamesian permissivism is qualified in (...) certain ways in this paper, I largely defend James in showing how permissivism has philosophical advantages over the non-permissivist position associated with evidentialism. These advantages include not having to treat disagreement as a sign of error or irrationality, and mutual support relations between permissivism and what John Rawls calls the "reasonable pluralism" at the heart of political liberalism. In this paper I argue that the trolley method of moral philosophy has three shortcomings not yet adequately addressed in the literature. First, trolley problems highlight high stakes ethical decisions. These decisions do not represent the majority of ethical decisions made by most people, and thus, the trolley method ignores most of moral life. Second, the trolley method operates by way of a faux-anonymization of moral agents. This process leads to descriptions of moral agents being unwittingly supplied by those to (...) whom the problems are presented and thereby the formation of a paradigmatic moral agent which excludes a considerable number of real world moral persons. Lastly, the trolley method mischaracterizes what most moral decision-making is like by presenting a moral agent's decision as isolated, uninfluenced, and made with full self-awareness. (shrink)

Some people want their lives to possess importance on a large scale. Some crave fame, or at least wide recognition. And some even desire glory that will only be realised after their death. Such desires are either ignored or disparaged by many philosophers. However, although few of us have a real shot at importance and fame on any grand scale, these can be genuine personal goods when they meet certain further conditions. Importance that relates to positive impact and reflects (...) our agency answers a distinctive existential concern for one's life to matter. And since what is important merits wide appreciation, the step from wanting to be significant and wanting that significance widely appreciated is small. Still, desires for importance and fame can take a more vicious character when they are not properly structured, and when they are not dominated by more impartial aims. If we accept the personal value of importance and fame, it is hard to see why that value cannot extend beyond our death. The temporal distribution of glory is actually irrelevant to its value. But it is also a mistake to identify a concern with posthumous glory with the wish to leave a trace after our death. (shrink)

The Free Energy Principle (FEP) states that all biological self-organizing systems must minimize variational free energy. The acceptance of this principle has given rise to a popular and far-reaching theoretical and empirical approach to the study of the brain and living organisms. Despite the popularity of the FEP approach, little discussion has ensued about its ontological status and implications. By understanding physicalism as an interdisciplinary research program that aims to offer compositional explanations of mental phenomena, this paper articulates what it (...) would mean for the FEP approach to be part of research program physicalism and to corroborate a physicalist outlook. In doing so, this paper contributes both to philosophical discussions regarding the FEP approach and to the literature on physicalism. It does the former by explicating the metaphysical standing of the FEP approach. Israeli courts were recently faced with the question whether an employer is allowed to voice objections to unionization during an organizing drive. Since the legislation fails to provide an answer to this question, it was up to the courts to come up with a solution. The National Labor Court in Histadrut v. Pelephone held that employers have no say and must refrain from any communications whatsoever with the workers regarding the decision whether or not to join the union. The Supreme (...) Court later affirmed this decision. This Article explores this legal question and examines whether this decision was justified, and whether it should be adopted in other countries as well. It first discusses the justifications for the conflicting freedoms in this scenario — the workers’ freedom of association and the employer’s freedom of speech — to appreciate their relative strength in the circumstances. It then examines whether it is possible to achieve a certain balance. To this end, the Article critically reviews the legal mechanisms adopted by other legal jurisdictions in this regard, shedding light on their effectiveness and the difficulties of organizing in practice in each jurisdiction. The main argument advanced in this Article is that the solution has to be purposive — to advance the goals of labor law, specifically freedom of association — and that the purposive analysis must be contextual. A rule prohibiting the employer from voicing opinions is surely an infringement of freedom of speech, and strong reasons are needed to justify it. Whether strong enough reasons exist depends on several contextual factors. Essentially, the question is whether it is possible, given the current context, to secure real freedom of association without such a rule. By context we mean two main things: first, the real-life current experience concerning the struggles of organizing; and second, the existence of alternative legal mechanisms that might address this problem. The purpose of this paper is to examine, from the point of view of C. S. Peirce's categories, the question whether there are real possibilities, such as those that are implicit in any moral statement suggesting that we could have acted differently. An inquiry into these categories shows that, according to Peirce, real possibilities are the truthmakers of a particular sort of general conditional statements.

Philosophers have long been involved in the pursuit of a goal shared by researchers in psychiatry and the cognitive sciences: understanding the relationship between the functioning of the human mind and human well-being or suffering. For this reason there is a very large area of overlap between philosophical and psychiatric research. The overlap is particularly significant in the domain of practical ethics, which is concerned with understanding the moral dimension of policies and actions in the real world. This chapter (...) reviews two distinct domains in which psychiatry and practical ethics overlap. First, issues in practical ethics arise out of new advances in psychopharmacology, including clinical and non-clinical use of new antidepressants drugs, the clinical use of placebo medications, and psychiatric drugs which enhance human cognition; these issues are frequently grouped under the banner of "neuroethics." Second, the understanding of fundamental questions in moral philosophy is being driven forward by evidence from psychology and psychiatry. Evidence from autism and the personality disorders is shedding light on the nature of moral motivation, while evidence from addiction and compulsion is generating progress in understanding moral responsibility. Natural syllogisms are expressed in terms of classes and properties of the real world. They exploit a categorisation present in semantic memory that provides a class inclusion structure. they are enthymematic and typically occur within a dialogue. Their form is identical to a formal syllogism once the minor premise is made explicit. It is claimed that reasoners routinely execute natural_syllogisms in an effortless manner based on ecthesis, which is primed by the class inclusion structure kept in long term memory.

BackgroundDecisions about withdrawal of life support for infants have given rise to legal battles between physicians and parents creating intense media attention. It is unclear how we should evaluate when life is no longer worth living for an infant. Public attitudes towards treatment withdrawal and the role of parents in situations of disagreement have not previously been assessed.MethodsAn online survey was conducted with a sample of the UK public to assess public views about the benefit of life in hypothetical cases (...) similar to real cases heard by the UK courts. We then evaluated these public views in comparison with existing ethical frameworks for decision-making.ResultsOne hundred and thirty participants completed the survey. The majority agreed that an infant’s life may have no benefit when well-being falls below a critical level. Decisions to withdraw treatment were positively associated with the importance of use of medical resources, the infant’s ability to have emotional relationships, and mental abilities. Up to 50% of participants in each case believed it was permissible to either continue or withdraw treatment.ConclusionDespite the controversy, our findings indicate that in the most severe cases, most people agree that life is not worth living for a profoundly disabled infant. Our survey found wide acceptance of at least the permissibility of withdrawal of treatment across a range of cases, though also a reluctance to overrule parents’ decisions. These findings may be useful when constructing guidelines for clinical practice. (shrink)

The current process towards formalization within evaluation research, in particular the use of pre-set standards and the focus on predefined outcomes, implies a shift of ownership from the people who are actually involved in real clinical ethics support services in a specific context to external stakeholders who increasingly gain a say in what ‘good CESS’ should look like. The question is whether this does justice to the insights and needs of those who are directly involved in actual CESS practices, (...) be it as receivers or providers. We maintain that those actually involved in concrete CESS practices should also be involved in its evaluation, not only as respondents, but also in setting the agenda of the evaluation process and in articulating the criteria by which CESS is evaluated. Therefore, we propose a participatory approach to CESS evaluation. It focuses on the concrete contexts in which CESS takes place, reflective and dialogical learning processes, and how to be democratic and inclusive. In particular, this approach to CESS evaluation is akin to realist evaluation, dialogical evaluation, and responsive evaluation. An example of a participatory approach to evaluating CESS is presented and some critical issues concerning this approach are discussed. (shrink)

In healthcare practice, care providers are confronted with decisions they have to make, directly affecting patients and inevitably harmful. These decisions are tragic by nature. This study investigates the role of Moral Case Deliberation in dealing with tragic situations. In MCD, caregivers reflect on real-life dilemmas, involving a choice between two ethical claims, both resulting in moral damage and harm. One element of the reflection process is making explicit the harm involved in the choice. How harmful are our decisions? (...) We investigated how facilitators of MCD experience the importance of addressing harm in MCD and what participants learn from reflecting on harm. The study was qualitative, focusing on the views and experiences of the facilitators of MCD. Semi-structured interviews were conducted with facilitators of MCD. The research focuses on the subjective experiences of facilitators. Grounded Theory was used for analysis. The results show two main categories. The first concerns the awareness of tragedy. Within this category, five themes were discerned: making explicit that there is no solution, visualizing consequences, uncovering pain, focusing on emotion, and exploring perspectives on harm. The second category concerns the support for healthcare professionals in dealing with the tragedy of the choices they face. In this category, five themes came forward: acknowledging, offering comfort, managing harm, consideration through dialogue and repairing harm. Our study shows that addressing harm in MCD in tragic situations provides an important moral learning opportunity for participants. By formulating and becoming aware of harm, MCD aids healthcare professionals in the task they are faced with, namely making difficult and painful choices. MCD helps healthcare professionals to repair moral damage, making clear at the same time that harm cannot be undone. (shrink)

In lieu of an abstract, here is a brief excerpt of the content:Review Essay:Aquinas, Modern Theology, and the TrinityGuy Mansini O.S.B.As one would expect from his Incarnate Lord, Thomas Joseph White's Trinity is no exercise in historical theology, although of course it calls on history, but aims to give us St. Thomas's theology as an enduring and so contemporary theology that both respects the creedal commitments of the Catholic Church and offers a more satisfying understanding of the Trinity than anything (...) proposed by the great theologians, Catholic and Protestant, of the past hundred years.1 The Trinity, however, gives a more complete and satisfying view of its subject than does The Incarnate Lord.Can St. Thomas really be fruitfully located within the dialectic of nineteenth- and twentieth-century Trinitarian speculation? Yes, and it is one of White's principal contributions to show how St. Thomas's medieval contemporaries, the early Franciscans on the one hand and William of Ockham on the other, remotely but really adumbrate nineteenth- and twentieth-century theological positions, once due attention is paid to the key issues of the analogical naming of God and his knowability. The reader is thus assured that Aquinas's original project was composed with some awareness of temptations and alternatives repeated (though not exactly, of course) in modern thought. Recent models in quantum cosmology make use of the concept of imaginary time. These models all conjecture a join between regions of imaginary time and regions of real time. We examine the model of James Hartle and Stephen Hawking to argue that the various no-boundary attempts to interpret the transition from imaginary to real time in a logically consistent and physically significant way all fail. We believe this conclusion also applies to quantum tunneling models, such as that proposed (...) by Alexander Vilenkin. We conclude, therefore, that the notion of emerging from imaginary time is incoherent. A consequence of this conclusion seems to be that the whole class of cosmological models appealing to imaginary time is thereby refuted. (shrink)

What does political science tell us about important real-world problems and issues? And to what extent does and can political analysis contribute to solutions? This is the challenge addressed by leading political scientists in this original text which will be essential reading for students and scholars alike.

In this chapter, I present some philosophical reflections on the theme of the imagination. The main inspiration for these reflections comes from two writers, both of whom are mentioned in Alain de Botton’s (2003) The Art of Travel: Joris-Karl Huysmans and Xavier de Maistre. De Botton uses both of these writers in his book as ‘guides’, people whose work prompts his own ruminations, Huysmans in the first chapter and de Maistre in the last. Speculatively, I infer from this structure that (...) de Botton has identified a similarity in the two writers’ attitudes to the relationship between travel and the imagination such that he regards it as appropriate to begin with one and to end with the other. There is a sense, I speculate, in which the wheel is meant to come full circle in de Botton’s book. Both Huysmans and de Maistre seem to be of the opinion that the nature of the imagination is such that it makes travel possible anywhere, notably and counter intuitively, in the place where travel typically both begins and ends: in the traveller’s own home. As I shall shortly suggest in more detail, Huysmans and de Maistre seem to agree that travelling in the imagination alone is preferable in certain ways to the real thing. Whether or not I am right in my speculative attribution of this observation to de Botton, I want, in this chapter, to extend it. I want to suggest that, although Huysmans and de Maistre do indeed draw similar conclusions about travel, they do so for very different reasons. I argue that Huysmans and de Maistre have radically opposing views of the nature of the relationship between the world of the imagination and the real world and therefore of the relationship between travel and the imagination. Using this contrast as a point of departure, I examine the role of the imagination in de Maistre’s travel literature and draw out its philosophical significance, articulating some philosophical insights de Maistre provides about the nature of the imagination per se and its role in human life. Individual athletes, coaches and sports teams seek continuously for ways to improve performance and accomplishment in elite competition. New techniques of performance analysis are a crucial part of the drive for athletic perfection. This paper discusses the ethical importance of one aspect of the future potential of performance analysis in sport, combining the field of biomedicine, sports engineering and nanotechnology in the form of ‘Nanobiosensors’. This innovative technology has the potential to revolutionise sport, enabling real time biological data to (...) be collected from athletes that can be electronically distributed. Enabling precise real time performance analysis is not without ethical problems. Arguments concerning data ownership and privacy; data confidentiality; and athlete welfare are presented alongside a discussion of the use of the Precautionary Principle in making ethical evaluations. We conclude, that although the future potential use of Nanobiosensors in sports analysis offers many potential benefits, there is also a fear that it could be abused at a sporting system level. Hence, it is essential for sporting bodies to consider the development of a robust ethically informed governance framework in advance of their proliferated use. (shrink)

Teaching responsible conduct of research (RCR) to PhD students is crucial for fostering responsible research practice. In this paper, we show how the use of Moral Case Deliberation—a case reflection method used in the Amsterdam UMC RCR PhD course—is particularity valuable to address three goals of RCR education: (1) making students aware of, and internalize, RCR principles and values, (2) supporting reflection on good conduct in personal daily practice, and (3) developing students’ dialogical attitude and skills so that they can (...) deliberate on RCR issues when they arise. What makes this method relevant for RCR education is the focus on values and personal motivations, the structured reflection on real experiences and dilemmas and the cultivation of participants’ dialogical skills. During these structured conversations, students reflect on the personal motives that drive them to adhere to the principles of good science, thereby building connections between those principles and their personal values and motives. Moreover, by exploring personal questions and dilemmas related to RCR, they learn how to address these with colleagues and supervisors. The reflection on personal experiences with RCR issues and questions combined with the study of relevant normative frameworks, support students to act responsibly and to pursue RCR in their day-to-day research practice in spite of difficulties and external constraints. As part of the rationality debate, we examine the impact of deliberative and intuitive thinking styles on diversity preference behavior. A sample of 230 students completed the Rational Experiential Inventory and the Diversity Preference Questionnaire, an original measure of diversification behavior in different real-life situations. In cases where no normative solution was available, we found a clear preference for diversity-seeking in the gain domain and diversity-aversion in the loss domain, regardless of cognitive thinking style. However, in cases where one (...) alternative normatively dominated the other, participants high in deliberative thinking style were more calibrated to normative behavior, regardless of whether their intuitive tendency preference and the normative solution were contradictory or pointed in the same direction. Our findings support a model in which deliberative but not intuitive thinking style is the crucial predictor of rational behavior, since it enables people to better adjust their intuitive preference anchor when normative considerations require doing so. Background The first COVID-19 wave started in February 2020 in France. The influx of patients requiring emergency care and high-level technicity led healthcare professionals to fear saturation of available care. In that context, the multidisciplinary Ethics- Support Cell (EST) was created to help medical teams consider the decisions that could potentially be sources of ethical dilemmas. Objectives The primary objective was to prospectively collect information on requests for EST assistance from 23 March to 9 May 2020. The secondary aim was (...) to describe the Cell’s functions during that period. Research design This observational, real-time study of requests for Cell consultations concerned ethical dilemmas arising during a public health crisis. The EST created a grid to collect relevant information (clinical, patient’s/designated representative’s preferences and ethical principles strained by the situation), thereby assuring that each EST asked the same questions, in the same order. Participants and research context Only our university hospital’s clinicians could request EST intervention. Ethical considerations The hospital Research Ethics Committee approved this study (no. CER-2020-107). The patient, his/her family, or designated representative was informed of this ethics consultation and most met with EST members, which enabled them to express their preferences and/or opposition. Findings/results 33 requests (patients’ mean age: 80.8 years; 29 had COVID-19: 24 with dyspnea, 30 with comorbidities). 17 Emergency Department solicitations concerned ICU admission, without reference to resource constraints; others addressed therapeutic proportionality dilemmas. Discussion Intervention-request motives concerned limited resources and treatment intensity. Management revolved around three axes: the treatment option most appropriate for the patient, the feasibility of implementation, and dignified care for the patient. Conclusions COVID-19 crisis forced hospitals to envisage prioritization of ICU access. Established decision-making criteria and protocols do not enable healthcare professionals to escape ethical dilemmas. That acknowledgement highlights ethical risks, enhances the added-value of nursing and encourages all players to be vigilant to pursue collective deliberations to achieve clear and transparent decisions. The International Competition on Computational Models of Argumentation (ICCMA) focuses on reasoning tasks in abstract argumentation frameworks. Submitted solvers are tested on a selected collection of benchmark instances, including artificially generated argumentation frameworks and some frameworks formalizing real-world problems. This paper presents the novelties introduced in the organization of the Third (2019) and Fourth (2021) editions of the competition. In particular, we proposed new tracks to competitors, one dedicated to dynamic solvers (i.e., solvers that incrementally compute solutions of frameworks (...) obtained by incrementally modifying original ones) in ICCMA’19 and one dedicated to approximate algorithms in ICCMA’21. From the analysis of the results, we noticed that i) dynamic recomputation of solutions leads to significant performance improvements, ii) approximation provides much faster results with satisfactory accuracy, and iii) classical solvers improved with respect to previous editions, thus revealing advancement in state of the art. The intellectual climate of postmodernism has not been particularly encouraging for the development of an evolutionary theory of the arts. Concentrated in constructionist modes of analysis and interpretation for (...) the past thirty years, the social sciences and humanities have asserted that aesthetic objects and practices are produced and regulated by social and cultural structures, and serve overwhelmingly to reinforce those structures. In its most extreme form, postmodern constructionism claims that all meaning or significance derives from social and cultural factors, and that perceived truth is a matter of agreement or a function of power. If, for instance, we like Edward Weston's photographs and Georgia O'Keefe's paintings because we observe striking similarities between the organic forms represented in them and features of the human form, postmodernism counsels us that our preferences are dictated by social and cultural regulators, such as current discourses about nature and art, and not in any way by predisposed attractions to types of natural objects or to the relationships between them.Certainly, it would be foolhardy to argue that social and cultural context have no influence on either the type of art that is produced or its reception in any given culture, but a thoroughgoing or strong [End Page 155] constructionism is another matter. 1 Strong constructionism cannot explain--or, to be more accurate, refuses to explain--why we have art in the first place. Recent intellectual fashion has dictated, in sum, that the most interesting questions about art, the truly thought-provoking and hard questions, should not be asked. So it is that within the past twelve years Ellen Dissanayake has published three books that together stand as the major contribution to an evolutionary understanding of the arts.Dissanayake's three books--What Is Art For? (1988); Homo Aestheticus: Where the Arts Come From and Why (1992); and, most recently, Art and Intimacy: How the Arts Began (2000)--build on one another, elaborating a functional account of the genesis and adaptive value of the arts. 2 It is fitting that each volume amplifies Dissanayake's central theory, representing, as it were, a new stage in that theory's evolution, for elaboration is a key concept in Dissanayake's work.First and foremost, Dissanayake establishes the need for a functional account of art in What Is Art For? before developing her central thesis. Pointing out that what we know of pre-industrial cultures is inconsistent with the traditional approach to aesthetics, Dissanayake fruitfully suggests we readjust our intellectual lens. Whereas aestheticians have been preoccupied for centuries with discovering a transcendent essence for art, a functional and evolutionary account reveals the myopia of such an approach. Premodern cultures, because they do not separate life into discrete categories including the real and everyday, the imaginative and aesthetic, and the religious, have no concept of art apart from everyday activities or utilitarian considerations and, therefore, the study of these cultures calls the existence of a transcendent art essence into question. As constructionist colleagues would be happy to point out, the quest for essences does indeed attest to a cultural bias, that particular bias being an overwhelming tendency to conceptualize in rigid dualities within modern western culture; simultaneously, the quest for essences conflicts with an evolutionary understanding of human beings and their practices. This paper tries to explore a gongfu ethics on the basis of traditional Chinese ethical theories. Used in the sense that the Song-Ming Neo-Confucians did, “gongfu” means the art of life in general and not merely the martial arts, although martial arts can be taken as a paradigm example of gongfu. The paper begins with the question “can bad guys have good gongfu,” which leads to three answers, each representing one stage of the dynamic relationship between morality and gongfu: The (...) first is yes, since gongfu and morality belong to two different categories, i.e., the art of life and moral responsibilities. The second is no, because each moral goodness or badness corresponds to a respective gongfu virtuosity or the lack of it. The third answer is that moral persons, as long as they still have to invoke morality, are not true gongfu masters. Those who have real good gongfu transcend moral duties and become amoral. The analysis suggests a gongfu ethics that can include, but goes beyond moral goodness. The rest of the essay articulates the rich implications of this gongfu ethics by comparing it with virtue ethics, consequentialist ethics, and relativism-subjectivism. (shrink)

Christmas gives us that 'sweet little Jesus Boy' and Lent follows that with the 'gentle Jesus, meek and mild.' He was neither of those. In point of fact, he was the 'tough guy from Nazareth.' He was consistently abrasive, if not abusive, to his mother (Lk 2:49; Jn 2:4; Mt 12:48) and aggressively hard on males, particularly those in authority. In Mark 8 he cursed and damned Peter for failing to get Jesus' esoteric definition of Messiah correct. Nobody else understood (...) it either. Jesus had made it up himself and not adequately explained it to anybody until then. He called the religious authorities snakes, corrupt tombs, filthy chinaware, fakes, and Mosaic legalists who had forgotten God's real revelation of universal grace and salvation in the Abraham Covenant. He tore up the temple in the middle of a worship service and cursed those present for turning God's house of prayer into a den of thieves, when actually they were kind, helping out-of-town tourists obtain the proper sacrifices for the liturgical rituals. Jesus was persistently aggressive, often angry and not infrequently irrational, killing an innocent fig tree with his curse, for example. He constantly attacked the Pharisees and their proposals for renewing the spiritual vitality of the Jewish Community. He abused numerous people by healing them on the Sabbath just to make his political point against the religious leaders. He could just as well have healed them on Tuesday, if he really wanted to heal them. By healing the blind man in John 9 on the Sabbath, for example, he caused the man to be driven out of his synagogue, his family, and his community of faith; isolated and abandoned as if he were a leper. Even when he said surprising things about children, his focus was not on the children but on his disciples, using the children as tools for making an assertive teaching point. Jesus' life was one of perpetually aggressive claims for his vision of God's reign. He constantly and intentionally provoked conflict and disruption of the status quo, spiritually and politically. He refused to negotiate, compromise, palliate, or mollify his insistence upon keeping his elbow perpetually in the eye of the people in power. In all this he would not back down. The principle by which Jesus operated was absolute and that is why he did not back down, even though they killed him for this very reason. His principle was simply that the renewal of Jewish spirituality could only come from a return to the Abrahamic Covenant, which declared (Gn 12; Rm 8) that God is gracious and universally forgiving towards all humankind, unconditional to our conduct and behaviour, and radically in that it removes all fear, guilt, and shame from the equation of our relationship with God (Mi 7:18-20). He saw that the Pharisees and Scribes were absolutely wrong in assuming that the Mosaic legal system would renew the Jewish relationship with God. He was not the gentle Jesus, meek and mild. He was that tough guy from Nazareth! He had good reason and he was willing to go the distance for what he stood for, even to death on the cross. (shrink)

The author will look at aspects of thinking about the idea of Europe at the crossroads of the digital and post-digital epochs – through Edgar Morin’s text Thinking Europe and Guy Debord’s Comments on the Society of the Spectacle, published in the late 1980s, in an attempt to understand their fundamental positions and implicit views on how to approach and pursue something like the political and supranational union of European countries in parallel with the rapid development of digital technologies and (...) new media, which fundamentally change our experience of the world. The very idea of a united Europe appears here as a Kantian “suspicious pleonasm”, whose value is questioned today, especially with the development of new global policies and post-cultural virtual environments that make – notions such as Europe, the Mediterranean, and the Western world – only artifacts of decadent Occidental cultures whose real ruins are overshadowed by an overly real spectacle of virtual abundance. ABSTRACTThe new paradigm in the psychology of reasoning redirects the investigation of deduction conceptually and methodologically because the premises and the conclusion of the inferences are assumed to be uncertain. A probabilistic counterpart of the concept of logical validity and a method to assess whether individuals comply with it must be defined. Conceptually, we used de Finetti's coherence as a normative framework to assess individuals' performance. Methodologically, we presented inference schemas whose premises had various levels of probability that contained non-numerical (...) expressions and, as a control, sure levels. Depending on the inference schemas, from 60% to 80% of the participants produced coherent conclusions when the premises were uncertain. The data also show that except for schemas involving conjunction, performance was consistently lower with certain than uncertain premises, the rate of conjunction fallacy was consistently low (not exceeding 20%,.. This paper describes a cubic water tank equipped with a movable partition receiving various amounts of liquid used to represent joint probability distributions. This device is applied to the investigation of deductive inferences under uncertainty. The analogy is exploited to determine by qualitative reasoning the limits in probability of the conclusion of twenty basic deductive arguments (such as Modus Ponens, And-introduction, Contraposition, etc.) often used as benchmark problems by the various theoretical approaches to reasoning under uncertainty. The probability bounds imposed (...) by the premises on the conclusion are derived on the basis of a few trivial principles such as "a part of the tank cannot contain more liquid than its capacity allows", or "if a part is empty, the other part contains all the liquid". This stems from the equivalence between the physical constraints imposed by the capacity of the tank and its subdivisions on the volumes of liquid, and the axioms and rules of probability. The device materializes de Finetti's coherence approach to probability. It also suggests a physical counterpart of Dutch book arguments to assess individuals' rationality in probability judgments in the sense that individuals whose degrees of belief in a conclusion are out of the bounds of coherence intervals would commit themselves to executing physically impossible tasks. ABSTRACT While a common view in the literature is that Nietzsche cannot successfully argue against Schopenhauer’s pessimism, a detailed explanation of why this is so is lacking. In this paper I provide such a detailed analysis. Specifically, a consideration of three of Nietzsche’s strategies for a revaluation of pain and suffering reveals two problems: the problem of ‘the direction of revaluation’ and the ‘dilemma of the intransigence of hedonism’. According to the first, the success of a revaluation cannot be guaranteed (...) on strictly argumentative grounds and can in principle bring about a revaluation that proceeds in the opposite direction than the one desired. According to the second, Nietzsche’s revaluations are of no significance since they either ground an un-Nietzschean affirmation of life, or they do not engage pessimism’s hedonistic perspective on the basis of which it condemns life. I then examine two strategies that Nietzsche can be seen to employ in his attempts to revalue the hedonistic perspective itself and explain why they too are unsatisfactory. The analysis illuminates the nature of the dialectical stand-off between Nietzsche and Schopenhauer and clarifies the limitations of Nietzschean revaluations as a philosophical tool. (shrink)

_Ressentiment_—the hateful desire for revenge—plays a pivotal role in Nietzsche’s _On the Genealogy of Morals_. _Ressentiment _explains the formation of bad conscience, guilt, asceticism, and, most importantly, it motivates the "slave revolt" that gives rise to Western morality’s values. _Ressentiment_, however, has not enjoyed a thorough treatment in the secondary literature. This book brings it sharply into focus and provides the first detailed examination of Nietzsche’s psychology of _ressentiment_. Unlike other books on the _Genealogy_, it uses _ressentiment_ as a key (...) to the _Genealogy_ and focuses on the intriguing relationship between _ressentiment_ and justice. It shows how _ressentiment_, despite its blindness to justice, gives rise to moral justice—the central target of Nietzsche’s critique. This critique notwithstanding, the _Genealogy_ shows Nietzsche’s enduring commitment to the virtue of _non-moral_ justice: a commitment that grounds his provocative view that moral justice spells the ‘end of justice’. The result provides a novel view of Nietzsche's moral psychology in the _Genealogy_, his critique of morality, and his views on justice. (shrink)

Two notions from philosophical logic and linguistics are brought together and applied to the psychological study of defeasible conditional reasoning. The distinction between disabling conditions and alternative causes is shown to be a special case of Pollock’s (1987) distinction between ‘rebutting’ and ‘undercutting’ defeaters. ‘Inferential’ conditionals are shown to come in two varieties, one that is sensitive to rebutters, the other to undercutters. It is thus predicted and demonstrated in two experiments that the type of inferential conditional used as the (...) major premise of conditional arguments can reverse the heretofore classic, distinctive effects of defeaters. On the basis of an interpretation of key passages in The Gay Science, this paper examines Nietzsche's idea of amor fati—love of fate. Nietzsche's idea of amor fati involves the wish to be able to learn how to see things as beautiful. This gives the impression that amor, love, is supposed to play some role in the beautification of fate. But Nietzsche also explains amor fati in relation to his desire to be a devoted “Yes-sayer.” This pulls the interpretation of (...) amor in a different direction; for now it seems as if the love Nietzsche wants to cultivate is supposed to be expressed in a positive, affirmative attitude toward one's fate. How to think this duality under the single idea of amor fati? I develop a novel reading of amor fati as a form of practice, as something that we can do, and explain in its light how the two moments of love are to be brought together. The relation of amor fati to the “Eternal Recurrence of the Same” is also addressed: mastering the practice of amor fati can enable one to pass successfully the test of the Eternal Recurrence of the Same. For decisions between many alternatives, the benchmark result is Hick's Law: that response time increases log-linearly with the number of choice alternatives. Even when Hick's Law is observed for response times, divergent results have been observed for error rates—sometimes error rates increase with the number of choice alternatives, and sometimes they are constant. We provide evidence from two experiments that error rates are mostly independent of the number of choice alternatives, unless context effects induce participants to trade speed for accuracy (...) across conditions. Error rate data have previously been used to discriminate between competing theoretical accounts of Hick's Law, and our results question the validity of those conclusions. We show that a previously dismissed optimal observer model might provide a parsimonious account of both response time and error rate data. The model suggests that people approximate Bayesian inference in multi-alternative choice, except for some perceptual limitations. (shrink)
