The prominent call to legalise same-sex marriage in Australia raises questions concerning whether its achievement will result in amplified societal acceptance of lesbian, gay, bisexual, and transgender (LGBT) people, and on what grounds this acceptance will take place. Same-sex marriage may not challenge heteronormative and patriarchal features typically associated with marriage, and may serve to reinforce a hierarchy that promotes traditional marriage as the ideal relationship structure. This may result in only assimilationist acceptance of LGBT people. However, the consequence of (...) inclusion to marriage ought to reflect social acceptance of LGBTs as people worthy of equal treatment in dignity and in rights, regardless of perceived differences or similarities to a supposed majority standard. This article argues that justice would be best served by introducing and promoting a variety of State-sanctioned unions whilst simultaneously introducing same-sex marriage. This ‘pluralisation strategy’ would increase awareness and legitimacy of other relationship-recognition options, promoting respectful acceptance of LGBT and heterosexual people alike. (shrink)

Increasing use is made of techniques which are supposed to make policy decisions more ‘rational’. Rather little attention, however, has been paid to the relation between these techniques and the logic of choice, the political process, value judgements and assumptions. This short paper will investigate these questions in relation to a particularly fashionable technique, that of cost-benefit analysis.

Only recently have ethicists been invited into the clinical setting to offer recommendations about patient care decisions. This paper discusses this new role for ethicists from the perspective of content and process issues. Among content issues are the usual ethical dilemmas such as the aggressiveness of treatment, questions about consent, and alternative treatment options. Among process issues are those that relate to communication with the patient. The formal ethics consult is discussed, the steps taken in such a consult, and whether (...) there should be a fee charged. Whether ethics is too important to be left to the experts or so important that it must be is an age-old question. The emergence of clinical ethicists raises it again, as a question about professionalism. What role clinical ethicists should play in healthcare decision making – teacher, mediator, or consultant – is a question that has generated considerable debate but no consensus.

Responding rationally to the information that others disagree with one’s beliefs requires assessing the epistemic credentials of the opposing beliefs. Conciliatory accounts of disagreement flow in part from holding that these assessments must be independent from one’s own initial reasoning on the disputed matter. I argue that this claim, properly understood, does not have the untoward consequences some have worried about. Moreover, some of the difficulties it does engender must be faced by many less conciliatory accounts of disagreement.

Because Dasein, as conceived by Heidegger, is inherently temporal, the "who" of Dasein can never be defined simply in terms of a present identity but must have the character of what Derrida calls "différance." Dasein 's authenticity, then, must be an embracing of this, its character as différance. This means that the "self" is "neither a substance nor a subject " but a resolution. The anticipatory resoluteness of authenticity, however, is a unique kind of resolve: it is the resolve to (...) be open to transformation. For that reason, Dasein 's proper self-appropriation—authenticity—is found precisely in its inherent inappropriability. Because Dasein is always being-in-the-world, the openness of its own "who" is equally an openness of being's "what." This essay presents a critique of what Robert Hanna has recently called the ‘sensibility first’ reading of Kant. I first spell out, in agreement with Hanna, why the contemporary debate among Kant scholars over conceptualism and non-conceptualism must be understood only from within the perspective of what I dub the ‘priority question’—that is, the question whether one or the other of our “two stems” of cognition may ground the objectivity and normativity of the other. I then spell out why the (...) priority question may be asked only from within the perspective of self-consciousness. Specifically, the central issue to be dealt with is how what Kant calls the original combination of understanding and sensibility is a synthesis internal to an act of self-consciousness. Only then can we ask what that original synthesis might tell us about the possibility of prioritizing one capacity over another in a story of cognition generally. Once we see the central issue more clearly, then I will look at the ‘sensibility first’ view in its most general form and propose that it should be criticized for its failure to account for Kant’s notion of an objective unity of self-consciousness. The Patient Self-Determination Act imposes new requirements on health care providers for informing patients of their rights to make decisions concerning their medical care. The Act is intended to, and is likely to, encourage patients and residents of certain healhtcare facilities to consider their treatment preferences in advance of incapacity and, in particular, to determine the circumstances in which life-sustaining treatment will be provided to them. However, many questions concerning how healthcare providers will implement the Act remain unanswered.

The aim of this paper is to introduce a correction into the notion of self-directed adult learning by way of conjoining it with philosophically elaborated notions of autonomy, self-reflectiveness, and maturity. The basic premise of this intervention is that in andragogical theorizing, learners’ self-directedness ought not to be thought as obvious and thus beyond question. Since adult selves are not transparent but socially, culturally, and discoursively constructed, adult educators are encouraged to think of themselves as facilitators of adult learners’ self-awareness (...) and self-directedness in their learning processes. Adult learners need to be assisted in developing critical skills that can be used to eliminate distortions in their perception of social reality, in understanding their own personalities, their needs and decisions concerning continuing education. The problematization of the concept of human autonomy amid external influences, is first discussed in Immanuel Kant’s idea of maturity as an ability to use one’s understanding without guidance from another. Outstanding among the social problems facing urban centers of the world in general and Nigeria is the problem of crime. The increasing rate of criminal activities has become a major concern across the globe. Today, lives and properties are no longer safe for both the rich and the poor. All seem to live one day at a time. Content Analysis is used as the method of data analysis. The method adopted was more of an exposition, critical analysis and evaluation. More (...) specifically, this paper gave a general background about violence, urban violence and the question of self-defense. Furthermore, a philosophical answer was given in the light of the medieval thinker St. Thomas Aquinas. It was concluded that there is a need for social living. A good citizen is one who has an unselfish love for the common good of his state; a love issuing forth in an efficacious desire to see that good is procured and furthered. Thus, a good citizen realizes that he is part of a social and political society. Thus, his personal goodness, and the goodness of his actions contributes to the good of all. Currently, the most influential accounts of personal autonomy, at least in the English-speaking world, focus on providing conditions under which agents can be said to exercise self-control. Two distinct accounts of personal autonomy have emerged in this tradition: firstly, hierarchical models grounded in the work of Harry Frankfurt; and secondly, systems division models most famously articulated by Gary Watson. In this paper, I will show the inadequacies of both of these models by exploring the problematic views of the self and (...) self-control underlying each model. This essay examines Wolfhart Pannenberg’s defense of metaphysics’ foundational importance for philosophy and theology. Among all the modern philosophers whose claims Pannenberg challenges, Martin Heidegger’s discourse against Western metaphysics receives the major portion of criticism. The first thing one concludes from this criticism is an affirmation of a wide intellectual gap that separates Pannenberg’s thought from Heidegger’s, as if each stands at the very opposite corner of the other’s school of thought. The questions this essay tackles are: is this seemingly (...) irreconcilable difference between Pannenberg and Heidegger fully justifiable? What if there is a reading of Panneberg’s and Heidegger’s view of metaphysics that can reveal deeper similarities between the two thinkers than the first reading of Pannenberg’s criticism of Heidegger allows us to see? It then answers these questions by showing that both thinkers actually share a common emphasis on the concepts of ‘time/history’, ‘self-disclosure’ and ‘anticipation’, and their reliance on these notions reveals that Heidegger’s and Pannenberg’s approaches to the phenomenon of understanding and to metaphysical ontology are not fully contradictory but rather hold noticeable hermeneutical similarities. This study analyzes Siyāsatnāma tradition in Sunnī political thought in terms of exploring the problem of just ruling. In the relevant literature, the dominant approach considers Siyāsatnāmas as ethical advice in general and regards them as ineffective against an unjust ruler who has no ethical concern. This study criticizes this dominant view by claiming that in addition to the religious/ethical argument to promote a just rule, the Siyāsatnāma tradition develops a second argument designed specifically for an unjust ruler who ignores (...) ethical advice. This second argument is ignored by the dominant position about the Siyāsatnāma tradition. I have called it self-interest argument in this study. An unjust ruler’s self-interest is to maintain, empower, and hand down his power to his descendants. The self-interest argument tries to convince a ruler who dismisses ethical advice to adopt just ruling by revealing that even for an unjust ruler the best strategy is just ruling to reach for his worldly aims. Summary: Earlier civilizations generated a Siyāsatnāma tradition to provide ethical and practical advice to rulers about a just and efficient ruling in a society. This tradition played an important role in classical Islamic political thought. Muslim rulers and thinkers who are acquainted with this tradition as a result of early Islamic conquests. In the beginning, some Siyāsatnāmas were translated into Arabic but later Muslim administrators and thinkers wrote original Siyāsatnāmas by including their experiences and other Islamic sources. The Siyāsatnāmas put forward both ethical advice and practical methods for rulers to rule justly and efficiently their states. While ethical advises are mainly derived from religious sources and individuals considered to be holy, practical methods are gathered from experiences of rulers who became successful in establishing just, efficient, and strong states in history. The Siyāsatnāma tradition does not seek theoretical, abstract, and philosophical models of just ruling. Rather it relies on experimental reason, common sense, historical wisdom, and ethical reasoning. This tradition is called “Mirrors for Princes” in Western political thought. In the relevant literature, the Siyāsatnāma tradition is seen as ethical advice in essence. This approach argues that this tradition simply relies on ethical and religious arguments to promote just ruling without devising any institutional measures such as a check and balance system to constraint the authority of the ruler. In the absence of any institutional control over the power of the ruler, the ethical argument means that: If the ruler rules justly, he would be awarded in the afterlife, while if he rules unjustly he would be punished in the afterlife. According to this approach, without any institutional measure, the Siyāsatnāma tradition, in reality, leaves the problem of just ruling to personal preference and the conscious of the ruler. It is up to the ruler whether he rules justly or unjustly, for there is not any external constraint over his power, given that he does not care about the afterlife. If he has a concern about his salvation in the afterlife, ethical advice would be effective, otherwise, those advice would not have any influence over him. As a result, according to this approach, the ethical argument fails in the final analysis against the unjust ruler who has no ethical concern. This dominant view ignores a second approach developed in the Siyāsatnāma tradition specifically to convince the ruler who has not any ethical concern to rule justly. I call it self-interest argument in this study. Unlike the dominant approach’s claim, the Siyāsatnāma tradition takes the problem of unjust ruler seriously and appeals to his self-interest to convince him to rule justly. The self-interest argument is clearly aware of the limits of the ethical argument against the ruler who does not care about the afterlife. An unjust ruler’s self-interest is to maintain, empower, and then hand down his dynasty to his descendants. The self-interest argument tries to convince a ruler ignoring ethical advice to adopt the just ruling by revealing that even for an unjust ruler the best strategy is just rule to reach for his worldly aims. Many historical examples are given to make it clear that unjust rules are short-lived.The essence of the self-interest argument is that: The just rule creates trust both among individuals and the state and society, then this widespread trust awakens the desire of attaining a comfortable life in human nature. The efforts of the individuals with the purpose of attaining a comfortable life lead to social and economic development in society, which in turn increases the financial sources of the state. That is why a just rule is the only solution to create a strong state as well as a developed society. The unjust ruling on the other hand, leads to distrust between the state and society and among individuals. This distrust and fear from the state lead to deterioration of the economic situation, for the desire embedded in human nature to attain a comfortable life would not awaken in such a society. As a result, the ruler could not have the necessary financial resources, which would weaken his power. That is why the just ruling is the only solution that serves to the interest of a ruler who only wants worldly power. This study analyzes Mâwardî’s and Ghazâlî’s political theories to reveal the self-interest argument in the Siyāsatnāma tradition. This self-interet argument could be seen in Hobbes’ political theory also. Hobbes, as one of the founders of modern political thought, takes the civil wars created by different religious sects and ideologies in the 17th century Europe as his starting point to formulate his model of the state. Hobbes thinks that without social peace and order, there would not be a society. He offers a strong monarchy which relies on the unity of powers as a solution to establish a peaceful society. The only responsibility of Leviathan as a strong and effective state is to establish and maintain peace and order in society. Any restriction over individuals is acceptable to reach that goal according to Hobbes. The source of the authority of the ruler is not just rule but social peace and order. Yet, after securing peace and order, Hobbes argues, it is the best policy for the ruler to rule justly, for a just rule leads to both social and economic development and increases financial sources of the state. The Hobbesian argument is also self-interest argument that we could find within the Siyāsatnāma tradition. He tells the ruler that even though he does not have to rule justly, it is the best policy to serve his self-interest. (shrink)

In the debates on phenomenal consciousness that occurred over the last 20 years, Sartre’s analysis of pre-reflective consciousness has often been quoted in defence of a distinction between first- and third-personal modes of givenness that naturalists reject. This distinction aims both at determining the specificity of the access one has to their own thoughts, beliefs, intentions, or desires, and at justifying the particular privilege that one enjoys while making epistemic claims about their own mental states. This chapter defends an interpretation (...) of Sartre’s theory of pre-reflective consciousness that does not put him completely at odds with the naturalist critique and stresses that one’s pre-reflective experience should not be understood in terms of first-/third-person differentiation. This pre-reflective dimension of experience nevertheless allows a peculiar access to oneself, which grants no infallible epistemic privilege to the first-person, but lays the ground for a transformative process that makes self-knowledge possible. I argue in this paper that philosophers have tended to neglect most autobiographies, even explicitly philosophical ones, due to invalid presuppositions about genre demarcations, and that they would do well to consider them for the resources they offer in terms of constituting positions on selfhood and agency. I further argue that Jacques Derrida offers a productive theoretical framework for understanding philosophical autobiographies as performances, or instances of "making" the truth (Augustine's veritatem facere) by "testifying" or "witnessing," and analyze both Derrida's (...) "Circumfession" and Søren Kierkegaard's 'On My Work as an Author' as examples of this kind of performance. (shrink)

Michel’s Foucault’s later work has been the subject of much critical interest regarding the question of whether it provides a normative stance that prescribes how the self ought to act. Having first outlined the nature of the debate, I engage with Foucault’s comparative analysis of the ethical systems of ancient Greeks and Christianity to show that he holds that the former maintains that the ethical subject was premised not on adherence to a priori rules as in Christianity, but from and (...) around an on-going process of practical experimentation. From this, Foucault goes on to describe the practices through which the self acted to make and re-make itself, which leads to the question of whether such descriptions also contain prescriptions as to how the self should act. I argue that they do contain a prescriptively normative stance, but in a very specific sense. Rather than delineating the specific ethical commitments we should adopt, Foucault takes off from the example of the ancient Greeks to insist that individuals should adopt an indeterminate orientating principle based on absolute openness to each context, with this principle given content through a context-specific, spontaneous, on-going, and inherently individual, albeit socially situated, process of practical experimentation. The result is a highly original account of normativity that makes individuals absolutely responsible for themselves and their ethical activities in each moment. (shrink)

Despite signifying a negative self-appraisal, shame has traditionally been thought by philosophers to entail the presence of self-respect in the individual. On this account, shame is occasioned by one’s failure to live up to certain self-standards—in displaying less worth than one thought one had—and this moves one to hide or otherwise inhibit oneself in an effort to protect one’s self-worth. In this paper, I argue against the notion that only self-respecting individuals can experience shame. Contrary to the idea that shame (...) presupposes the presence of self-worth, I contend that shame merely requires that one have the desire, rather than the expectation, that one is worthy. Furthermore, I suggest that the desire for concealment fueled by shame is not an inherently self-protective mechanism but can alternatively be understood as an effort to safeguard one’s connection with others. Self-reported data are regarded by medical researchers as invalid and less reliable than data produced by experts in clinical settings, yet individuals can increasingly contribute personal information to medical research through a variety of online platforms. In this article we examine this ‘participatory turn’ in healthcare research, which claims to challenge conventional delineations of what is valid and reliable for medical practice, by using aggregated self-reported experiences from patients and ‘pre-patients’ via the internet. We focus on 23andMe, a genetic testing (...) company that collects genetic material and self-reported information about disease from its customers. Integral to this research method are relations of trust embedded in the information exchange: trust in customers’ data; trust between researchers/company and research subjects; trust in genetics; trust in the machine. We examine the performative dimension of these trust relations, drawing on Shapin and Schaffer’s discussion of how material, literary and social technologies are used in research in order to establish trust. Our scepticism of the company’s motives for building trust with the self-reporting consumer forces us to consider our own motives. How does the use of customer data for research purposes by 23andMe differ from the research practices of social scientists, especially those who also study digital traces? By interrogating the use of self-reported data in the genetic testing context, we examine our ethical responsibilities in studying the digital selves of others using internet methods. How researchers trust data, how participants trust researchers, and how technologies are trusted are all important considerations in studying the social life of digital data. (shrink)

Curiosity motivates the search for missing information, driving learning, scientific discovery, and innovation. Yet, identifying that there is a gap in one's knowledge is itself a critical step, and may demand that one formulate a question to precisely express what is missing. Our work captures the integral role of self‐generated questions during the acquisition of new information, which we refer to as active‐curiosity‐driven learning. We tested active‐curiosity‐driven learning using our “Curiosity Question & Answer Task” paradigm, where participants (N=135) were asked (...) to generate questions in response to novel, incomplete factual statements and provided the opportunity to forage for answers. We also introduce new measures of question quality that express how well questions capture stimulus and foraging information. We hypothesized that active question asking should influence behavior across the stages of our task by increasing the probability that participants express curiosity, forage for answers, and remember what they had thereby discovered. We found that individuals who asked a high number of quality questions experienced elevated curiosity, were more likely to pursue missing information that was semantically related to their questions, and more likely to retain the information on a later cued recall test. Additional analyses revealed that curiosity played a predominant role in motivating participants to forage for missing information, and that both curiosity and satisfaction with the acquired information boosted memory recall. Overall, our results suggest that asking questions enhances the value of missing information, with important implications for learning and discovery of all forms. (shrink)

This essay interprets the aesthetic with respect to conceptions of an individual, sensitive self which came to the fore since 18th-century anthropology. Fei Xiaotong's thoughts on the Confucian system of interpersonal relationships actually indicated that the Confucian theory of social cooperation leads itself to an unsettled paradox, that is, there is a lack of universal theoretical construction in the Confucian moral system. Confucian theory does not extend beyond practical circumstances. Instead, its universal principles always disappear in specific circumstances.
