Eric Nelson has recently argued that John Rawls’ interpretation of the maxim to respect persons as ends in themselves which grants priority to our least-advantaged citizens violates the liberal commitment to neutrality towards each person’s capability to choose her or his conception of the good. This violation is revealed by the sectarian character of Martha Nussbaum’s list of capabilities, her Aristotelian extension of Rawls’ distributive ethics. I argue that Nelson advances an elitist interpretation of the non-violability of persons, in which (...) the capabilities of oneself are set in opposition to those of an other. He thus overlooks for his purposes the anti-sacrificial telos of the Rawlsian principles of justice which articulates the capabilities of oneself as another. Nelson’s elitism may itself be traced to Nussbaum’s rejection of Rawls’ distributive figuration of capability, the Aristotelian heritage of which is developed by Paul Ricoeur and which underwrites civic phronēsis on societal norms of reciprocity. Kate Manne claims that her account of gaslighting rectifies regrettable deficiencies in existing theories. However, Manne hasn’t done enough to demonstrate the novelty of her view given that she fails to seriously engage with a significant portion of the gaslighting literature. This is an issue in the politics of methodology. Many theorists working on gaslighting exist within the margins, attempting to centre their perspectives over dominant points of view. We must listen to marginalised folk when aiming to understand a phenomenon (...) that disproportionately affects them. If Manne had listened, she would have come to see difficulties with some of her suggestions, such as the possibility of unintentional gaslighting. (shrink)

Murray Gell-Mann and James Hartle have made an original proposal for a version of decoherent histories quantum mechanics which is specifically tailored so as not to imply the emergence of multiple quasi-classical worlds. I argue that there is an explanatory gap in the proposal but that there remains an important insight which might be used to tackle what can be seen as an outstanding problem for Hugh Everett III’s “relative state” interpretation of quantum mechanics, if it is understood as (...) giving ontic priority to the wavefunction. Parecemos condenados a recaer en el dualismo cartesiano del que emerge la identidad autorreferencial del cogito, o bien en el reduccionismo neurocientífico o filosófico en el que la identidad personal deviene algo indiscernible. Nuestra hipótesis es que Die vertauschten Köpfe es una novela sobre la (...) identidad personal en el sentido de la "identidad narrativa" defendida por Ricoeur principalmente en Temps et récit III, "L'identité narrative" y Soi-même comme un autre. From what scarce philosophical readings there are of Thomas Mann's Die vertauschten Köpfe, one can conclude that it is a novel about personal identity, even if it is hard to determine in what manner. It would appear that we are condemned to fall back on the Cartesian dualism that yields the cogito's self-referential identity or on the neuroscientific or philosophical reductionism in which personal identity becomes indiscernible. Our hypothesis is that Die vertauschten Köpfe is a novel about personal identity in the sense of "narrative identity" explored by Ricoeur mainly in Temps et récit III, "L'identité narrative" and Soi-même comme un autre. JOURNAL OF THE HISTORY OF PHILOSOPHY PRIZE for the best published book in the history of philosophy [Awarded in 2010] _______________ -/- Although it is widely recognized that David Hume's A Treatise of Human Nature (1739-40) belongs among the greatest works of philosophy, there is little agreement about the correct way to interpret his fundamental intentions. It is an established orthodoxy among almost all commentators that skepticism and naturalism are the two dominant themes in this work. The difficulty has been, (...) however, that Hume's skeptical arguments and commitments appear to undermine and discredit his naturalistic ambition to contribute to "the science of man". This schism appears to leave his entire project broken-backed. The solution to this riddle depends on challenging another, closely related, point of orthodoxy: namely, that before Hume published the Treatise he removed almost all material concerned with problems of religion. Russell argues, contrary to this view, that irreligious aims and objectives are fundamental to the Treatise and account for its underlying unity and coherence. It is Hume's basic anti-Christian aims and objectives that serve to shape and direct both his skeptical and naturalistic commitments. When Hume's arguments are viewed from this perspective we can solve, not only puzzles arising from his discussion of various specific issues, we can also explain the intimate and intricate connections that hold his entire project together. This "irreligious" interpretation provides a comprehensive fresh account of the nature of Hume's fundamental aims and ambitions in the Treatise. It also presents a radically different picture of the way in which Hume's project was rooted in the debates and controversies of his own time, placing the Treatise in an irreligious or anti-Chrisitan philosophical tradition that includes Hobbes, Spinoza and freethinking followers. Emmanuel Lévinas (1906-1995) zählt nicht nur zu den wichtigsten Ethikern im 20. Jahrhundert. Vor allem entwirft er einen anderen Anfang der Ethik, die nicht auf der gesellschaftlichen Ebene oder als grosse Idee und Erzählung entsteht. Ethik entspringt vielmehr in der konkreten Zwischenmenschlichkeit, wenn man vom Anderen in die Verantwortung gerufen wird - und zwar durch die Verletzlichkeit seines nackten Gesichtes wie durch die Anrede. Die ethische Beziehung verdankt sich dabei nicht etwa der Gleichheit, der Nähe oder der Geschwisterlichkeit, sondern der (...) Andersheit des Anderen, seiner Ferne und vor allem seiner Fremdheit, die sich nicht hintergehen lassen. Damit gründet Lévinas die Gesellschaft nicht nur auf die Zwischenmenschlichkeit, sondern auch auf die Pluralität. So wenig wie die Ethik universelle Ansprüche erheben kann, lässt sich Gerechtigkeit als ein allgemeines Prinzip entwerfen. Vielmehr muss sie den Individuen in deren unendlicher Andersheit gerecht werden. In dieser Unendlichkeit blitzt im nackten Gesicht das Antlitz Gottes auf, denkt Lévinas aus der jüdischen Tradition heraus. Das lässt sich auch rein säkular verstehen, dass alle Menschen anders sind. Sie als Gleiche zu behandeln, unterwirft sie totalen politischen Ansprüchen, macht sie zu gehorsamen Untertanen. Many of our most important goals require months or even years of effort to achieve, and some never get achieved at all. As social psychologists have lately emphasized, success in pursuing such goals requires the capacity for perseverance, or "grit." Philosophers have had little to say about grit, however, insofar as it differs from more familiar notions of willpower or continence. This leaves us ill-equipped to assess the social and moral implications of promoting grit. We propose that grit has an (...) important epistemic component, in that failures of perseverance are often caused by a significant loss of confidence that one will succeed if one continues to try. Correspondingly, successful exercises of grit often involve a kind of epistemic resilience in the face of failure, injury, rejection, and other setbacks that constitute genuine evidence that success is not forthcoming. Given this, we discuss whether and to what extent displays of grit can be epistemically as well as practically rational. We conclude that they can be (although many are not), and that the rationality of grit will depend partly on features of the context the agent normally finds herself in. In particular, grit-friendly norms of deliberation might be irrational to use in contexts of severe material scarcity or oppression. (shrink)

Recent advances in medical and information technologies, the availability of new types of medical data, the requirement of increasing numbers of study participants, as well as difficulties in recruitment and retention, all present serious problems for traditional models of specific and informed consent to medical research. However, these advances also enable novel ways to securely share and analyse data. This paper introduces one of these advances—blockchain technologies—and argues that they can be used to share medical data in a secure and (...) auditable fashion. In addition, some aspects of consent and data collection, as well as data access management and analysis, can be automated using blockchain-based smart contracts. This paper demonstrates how blockchain technologies can be used to further all three of the bioethical principles underlying consent requirements: the autonomy of patients, by giving them much greater control over their data; beneficence, by greatly facilitating medical research efficiency and by reducing biases and opportunities for errors; and justice, by enabling patients with rare or under-researched conditions to pseudonymously aggregate their data for analysis. Finally, we coin and describe the novel concept of prosent, by which we mean the blockchain-enabled ability of all stakeholders in the research process to pseudonymously and proactively consent to data release or exchange under specific conditions, such as trial completion. Drugs used to provide improvement of cognitive functioning have been shown to be effective in healthy individuals. It is sometimes assumed that the use of these drugs constitutes cheating in an academic context. We examine whether this assumption is ethically sound. Beyond providing the most up-to-date discussion of modafinil use in an academic context, this contribution includes an overview of the safety of modafinil use in greater depth than previous studies addressing the issue of cheating. Secondly, we emphasize two crucial, (...) but hitherto nearly overlooked, nuances to the issues: the potential for modafinil to decrease inequality and disadvantage in academic settings, and the fact that how modafinil is used dramatically impacts its effects on health, coercion, fairness, authenticity and effort. Generative AI programs can produce high-quality written and visual content that may be used for good or ill. We argue that a credit–blame asymmetry arises for assigning responsibility for these outputs and discuss urgent ethical and policy implications focused on large-scale language models.

Different ideas of the normative relevance of autonomy can give rise to profoundly different action-guiding principles in healthcare. If autonomy is seen as a value rather than as a right, it can be argued that patients’ decisions should sometimes be overruled in order to protect or promote their own autonomy. We refer to this as paternalism in the name of autonomy. In this paper, we discuss different elements of autonomy (decision-making capacity, efficiency, and authenticity) and arguments in favor of paternalism (...) for the sake of autonomy that have been proposed in the bioethical debate. We argue that if autonomy is valuable, then paternalism for the sake of autonomy may be justified. However, policies allowing paternalism in the name of autonomy may be self-defeating. (shrink)

Although thinkers of the past might have started from presumptions of fundamental difference and inequality between (say) the genders, or people of different races, this is no longer the case. At least in mainstream political philosophy, we are all now presumed to be, in some fundamental sense, basic equals. Of course, what follows from this putative fact of basic equality remains enormously controversial: liberals, libertarians, conservatives, Marxists, republicans, and so on, continue to disagree vigorously with each other, despite all presupposing (...) some kind of basic equality. They may argue about who gets what, how much, and why, but the starting point - that all people are in some sense deserving of prima facie equal consideration - has become an axiom of our moral and political thinking. But why? Why are we basic equals? The trouble is that as soon as one asks for an explanation of this foundational premise, it begins to look shaky. After all, on any conceivable metric human beings are notably unequal, and often to striking degrees. Philosophers in this area tend to talk of equal worth, but often without trying to specify what exactly that means. Philosophically, basic equality is neither acceptable nor rejectable. It is not rejectable because we appear to be, as a matter of fact, profoundly committed to the truth of the claim that we are all one another's basic equals. But to the extent that there appear to be no philosophical arguments for believing in the truth of basic equality, it is not acceptable either. The aim of this book is to try and show why basic equality is acceptable. To do so, however, it will also contend that we need to approach the question rather differently to how it has mostly been handled so far. What's required is an exercise in what Bernard Williams called 'impure philosophy': it must include insights from other areas of human intellectual endeavour, whether psychology and history or even what we learn from how we go about practicing basic equality in our collective lives. In this chapter, we analyze the relationships between the Internet and its users in terms of situated cognition theory. We first argue that the Internet is a new kind of cognitive ecology, providing almost constant access to a vast amount of digital information that is increasingly more integrated into our cognitive routines. We then briefly introduce situated cognition theory and its species of embedded, embodied, extended, distributed and collective cognition. Having thus set the stage, we begin by taking an embedded (...) cognition view and analyze how the Internet aids certain cognitive tasks. After that, we conceptualize how the Internet enables new kinds of embodied interaction, extends certain aspects of our embodiment, and examine how wearable technologies that monitor physiological, behavioral and contextual states transform the embodied self. On the basis of the degree of cognitive integration between a user and Internet resource, we then look at how and when the Internet extends our cognitive processes. We end this chapter with a discussion of distributed and collective cognition as facilitated by the Internet. (shrink)

So entwickelt sich ein hochaktuelles Staatsverstandnis, wie es sich als partizipatorische Demokratie im spaten 20. Jahrhunderts verbreitet. Dieses Staatsverstandnis vertreten vor allem die (...) franzosischen emanzipatorischen Existentialisten, findet sich aber auch bei Randgangern wie Arendt und Bataille und kann sich auf Wegbereiter wie Kierkegaard und Stirner sowie Nietzsche berufen. Ein metaphysisch religioser Existentialismus von Marcel, Jaspers, Cioran oder am Rande Heidegger und als Vorlaufer Bergson insistiert auf einem traditionellen Staatsverstandnis, das lebens- oder seinsphilosophisch renoviert wird. There are three lines of argument in defence of coercive treatment of patients with mental disorders: arguments regarding (1) societal interests to protect others, (2) the patients' own health interests, and (3) patient autonomy. In this paper, we analyse these arguments in relation to an idealized case, where a person with a mental disorder claims not to want medical treatment for religious reasons. We also discuss who should decide what in situations where patients with mental disorders deny treatment on seemingly (...) rational grounds.We conclude that, in principle, coercive treatment cannot be defended for the sake of protecting others. While coercive actions can be acceptable in order to protect close family and others, medical treatment is not justified for such reasons but should be given only in the interest of patients. Coercive treatment may be required in order to promote the patient's health interests, but health interests have to waive if they go against the autonomous interests of the patient. We argue that non-autonomous patients can have reasons, rooted in their deeply-set values, to renounce compulsory institutional treatment, and that such reasons should be respected unless it can be assumed that their new predicaments have caused them to change their views. Free Will & The Tragic Predicament : Making Sense of Williams -/- The discussion in this paper aims to make better sense of free will and moral responsibility by way of making sense of Bernard Williams’ significant and substantial contribution to this subject. Williams’ fundamental objective is to vindicate moral responsibility by way of freeing it from the distortions and misrepresentations imposed on it by “the morality system”. What Williams rejects, in particular, are the efforts of “morality” to further “deepen” (...) or “refine” the notion of the voluntary, with a view to securing “ultimate justice”. It is these aims and aspirations, he argues, that take us to the precipice of scepticism. In Shame and Necessity (1993) Williams advances a vindicatory genealogy that unmasks the “illusions” and “fantasies” of our current ethical ideas as they relate to agency and responsibility. What we are then left with is the task of “recasting our ethical conceptions” . It is here that Williams is especially insistent on the importance and value of historical consciousness and reflection. The role of our reflections about the Greeks and tragedy is precisely to show that in order to move forward, into the future, we need to first look back at where we have come from. The value of these “untimely” observations is that they provide us with alternatives and options that we might otherwise lack. What we discover, when we consider the Greeks, is their commitment to a “pessimism of strength” that rests on rejecting scepticism. It is this two-sided perspective on our ethical predicament that delivers a more truthful account of our human situation, one that will help us discard those illusions and fantasies of "morality" that we are “better off” without. An account of this kind refuses to accept an optimism that insists that any form of responsible ethical life must be one that is immune to the influence of luck and fate. This is the fundamental lesson that we can learn from the ancient Greeks and that Williams seeks to “recover” for us. (shrink)

David Hume (1711-1776) is widely recognized as one of the most influential and significant critics of religion in the history of philosophy. There remains, nevertheless, considerable disagreement about the exact nature of his views. According to some, he was a skeptic who regarded all conjectures relating to religious hypotheses to be beyond the scope of human understanding – he neither affirmed nor denied these conjectures. Others read him as embracing a highly refined form of “true religion” of some kind. On (...) the other side of this spectrum, it is claimed that Hume was committed to atheism, although due to social conditions at the time, this had to be (thinly) concealed or masked. The aim of this article is to provide an overview of Hume’s core concerns and arguments on this subject and to provide the reader with a framework for interpreting and assessing his various contributions. A commitment to truth requires that you are open to receiving new evidence, even if that evidence contradicts your current beliefs. You should be open to changing your mind. However, this truism gives rise to the paradox of empathy. The paradox arises with the possibility of mental corruption through transformative change, and has consequences for how we should understand tolerance, disagreement, and the ability to have an open mind. I close with a discussion of how understanding this paradox provides a (...) new explanation for a certain kind of standoff between the believer and the skeptic with regard to religious belief. BackgroundInvoluntary treatment is a key issue in healthcare ethics. In this study, ethical issues relating to involuntary psychiatric treatment are investigated through interviews with Swedish psychiatrists.MethodsIn-depth interviews were conducted with eight Swedish psychiatrists, focusing on their experiences of and views on compulsory treatment. In relation to this, issues about patient autonomy were also discussed. The interviews were analysed using a descriptive qualitative approach.ResultsThe answers focus on two main aspects of compulsory treatment. Firstly, deliberations about when and why it was justifiable (...) to make a decision on involuntary treatment in a specific case. Here the cons and pros of ordering compulsory treatment were discussed, with particular emphasis on the consequences of providing treatment vs. refraining from ordering treatment. Secondly, a number of issues relating to background factors affecting decisions for or against involuntary treatment were also discussed. These included issues about the Swedish Mental Care Act, healthcare organisation and the care environment.ConclusionsInvoluntary treatment was generally seen as an unwanted exception to standard care. The respondents’ judgments about involuntary treatment were typically in line with Swedish law on the subject. However, it was also argued that the law leaves room for individual judgments when making decisions about involuntary treatment. Much of the reasoning focused on the consequences of ordering involuntary treatment, where risk of harm to the therapeutic alliance was weighed against the assumed good consequences of ensuring that patients received needed treatment. Cases concerning suicidal patients and psychotic patients who did not realise their need for care were typically held as paradigmatic examples of justified involuntary care. However, there was an ambivalence regarding the issue of suicide as it was also argued that risk of suicide in itself might not be sufficient for justified involuntary care. It was moreover argued that organisational factors sometimes led to decisions about compulsory treatment that could have been avoided, given a more patient-oriented healthcare organisation. (shrink)
