This book provides much new thinking on the phenomenon of whole person education, a phenomenon which features strongly in East Asian universities, and which aims to develop students intellectually, spiritually, and ethically, to master critical thinking skills, to explore ethical challenges in the surrounding community and to acquire a broad based foundation of knowledge in humanities, society and nature. The book considers different approaches to whole person education, including Confucian, Buddhist, and Chinese perspectives, Western philosophy and religion and interdisciplinary approaches. (...) In philosophical debates on human rights between the East and the West, scholars argue whether rights in the Universal Declaration of Human Rights (UDHR) and other international documents (in short, “international human rights”) are universal or culturally relative. Some scholars who emphasize the importance of East Asian cultures (such as the Confucian tradition) have different attitudes toward civil and political rights (CP rights) than toward economic, social, and cultural rights (ESC Rights). They argue that at least some international human rights (...) on the list of CP rights are not universal and believe that East Asian cultures can contribute to the moral justification of ESC rights. This chapter introduces a philosophical argument to support a normative account of human rights. This normative account, called “the minimal account of human rights,” is based on the ideas of minimal values, especially essential necessities of dignity. Based on this account, we can explain why international human rights are both universal and justified by East Asian cultures, especially the Confucian tradition. To explain this minimal account and illustrate how it can be applied to debates on international human rights, this chapter focuses on debates on the international human rights to liberty on the list of CP rights and the human rights to health on the list of ESC rights. There are many East and West debates on human rights. One of them is whether all civil and political rights are human rights. On one hand, scholars generally agree that rights to physical security are human rights. On the other hand, some scholars argue that rights to political liberty are only Western rights but not human rights because political liberty conflicts with some East Asian cultural factors, especially the Confucian tradition. I argue that physical security also conflicts with some parts (...) of the Confucian tradition, but rights to physical security are still human rights because physical security is a minimal value. I then argue that political liberty, similar to physical security, is also a minimal value. Therefore, similar to rights to physical security, rights to political liberty are also human rights, even though political liberty also conflicts with some parts of the Confucian tradition. Balfe argues against enhanced interrogation. He particularly focuses on the involvement of U.S. healthcare professionals in enhanced interrogation. He identifies several empirical and normative factors and argues that they are not good reasons to morally justify enhanced interrogation. I argue that his argument can be improved by making two points. First, Balfe considers the reasoning of those healthcare professionals as utilitarian. However, careful consideration of their ideas reveals that their reasoning is consequential rather than utilitarian evaluation. Second, torture is a (...) serious human rights abuse. When healthcare professionals become involved in enhanced interrogation, they violate not only human rights against torture but also human rights to health. Considering the consequential reasoning against human rights abuses, healthcare professionals’ involvement in enhanced interrogation is not morally justified. Supplementing Balfe’s position with these two points makes his argument more complete and convincing, and hence it can contribute to the way which shows that enhanced interrogation is not justified by consequential evaluation. The purpose of this essay is to review and evaluate chapters in Fan and Cherry’s _Sex Robots: Social Impact and the Future of Human Relations_. In this edited volume, the authors of the various chapters present dialogues from the East and West to explore the social and cultural implications of sex robots. They also discuss whether sex robots have a positive, negative, or neutral impact on society and human relationships. This essay examines the key ideas presented in the book’s chapters, (...) evaluates their arguments, and identifies research directions for the ethics of sex robots in the future. Specifically, this essay provides a detailed analysis of certain schools of thought, including the capability approach, Confucianism and Daoism, and their relevance to the topic of sex robots. For the role of utilitarianism in the ethics of war and peace, Shaw suggests there is a Utilitarian War Principle (UWP) and argues that the principles of the just war theory should be treated as intermediate principles that are subordinated to UWP. He also argues that the state should be the primary legitimate authority to wage war and holder of the right of national defense. I argue that the utilitarian approach should be specifically linked with contingent pacifism, a new understanding (...) of pacifism from within the just war tradition, and the utilitarian contingent pacifism only endorses individual self-defense but not national defense. This finding is not only theoretically important but has practical implications for the debate on Article 9 of the Japanese Constitution. Utilitarian contingent pacifism supports the idealist position that Article 9 is morally significant because it makes Japan a pioneer of the new kind of pacifism. (shrink)

This article examines privacy issues that emerged during the COVID-19 pandemic from the perspective of applied ethics. It focuses on two specific examples of privacy issues that emerged in higher education and social policy amid attempts to prevent and control the disease. Based on the moral framework of consequential evaluation, (...) this article discusses the concepts of privacy and privacy rights and the difference between maximization and optimization in the context of an incomplete ranking of options. This article also discusses two ways that the loss of privacy has been understood: the control account and the access account. Another important discussion in the article is the place of privacy in the context of intimate relationships, and why the resolution of some issues concerning privacy requires a discussion of the concept of intimacy. Based on the above analysis, this article concludes with a discussion of how to evaluate the privacy issues in the two examples. (shrink)

A large body of research links testosterone and cortisol to male-male competition. Yet, little work has explored acute steroid hormone responses to coalitional, physical competition during middle childhood. Here, we investigate testosterone, dehydroepiandrosterone, androstenedione, and cortisol release among ethnically Chinese boys in Hong Kong, aged 8–11 years, during a soccer match and an intrasquad soccer scrimmage, with 63 participants competing in both treatments. The soccer match and intrasquad soccer scrimmage represented out-group and in-group treatments, respectively. Results revealed that testosterone showed (...) no measurable change. DHEA increased during both treatments in the majority of participants and the degree of change had no relation to independent variables or covariate measures. Most boys experienced androstenedione increases during match play, but no significant differences during the intrasquad soccer scrimmage competitions. The magnitude of change differed significantly between treatments and was positively associated with age. These latter findings suggest boys’ androstenedione responses may be sensitive to competitor type. For most subjects, cortisol significantly increased during match play, decreased during the intrasquad soccer scrimmage, and differed significantly between treatments, suggesting each treatment promoted a different psychological state among competitors. Cortisol/DHEA molar ratio decreased during the intrasquad scrimmage, suggestive of a more relaxed mental state. These data shed new light on potential proximate mechanisms associated with coalitional competition among prepubescent boys, with relevance to adrenarche and life history theory. (shrink)

Background The use of lengthy, detailed, and complex informed consent forms is of paramount concern in biomedical research as it may not truly promote the rights and interests of research participants. The extent of information in ICFs has been the subject of debates for decades; however, no clear guidance is given. Thus, the objective of this study was to determine the perspectives of research participants about the type and extent of information they need when they are invited to participate in (...) biomedical research. Methods This multi-center, cross-sectional, descriptive survey was conducted at 54 study sites in seven Asia-Pacific countries. A modified Likert-scale questionnaire was used to determine the importance of each element in the ICF among research participants of a biomedical study, with an anchored rating scale from 1 to 5. Results Of the 2484 questionnaires distributed, 2113 were returned. The majority of respondents considered most elements required in the ICF to be ‘moderately important’ to ‘very important’ for their decision making. Major foreseeable risk, direct benefit, and common adverse effects of the intervention were considered to be of most concerned elements in the ICF. Conclusions Research participants would like to be informed of the ICF elements required by ethical guidelines and regulations; however, the importance of each element varied, e.g., risk and benefit associated with research participants were considered to be more important than the general nature or technical details of research. Using a participant-oriented approach by providing more details of the participant-interested elements while avoiding unnecessarily lengthy details of other less important elements would enhance the quality of the ICF. BackgroundIn the Canadian Alliance for Healthy Hearts and Minds (CAHHM) cohort, participants underwent magnetic resonance imaging (MRI) of the brain, heart, and abdomen, that generated incidental findings (IFs). The approach to managing these unexpected results remain a complex issue. Our objectives were to describe the CAHHM policy for the management of IFs, to understand the impact of disclosing IFs to healthy research participants, and to reflect on the ethical obligations of researchers in future MRI studies.MethodsBetween 2013 and 2019, 8252 participants (...) (mean age 58 ± 9 years, 54% women) were recruited with a follow-up questionnaire administered to 909 participants (40% response rate) at 1-year. The CAHHM policy followed a restricted approach, whereby routine feedback on IFs was not provided. Only IFs of severe structural abnormalities were reported.ResultsSevere structural abnormalities occurred in 8.3% (95% confidence interval 7.7–8.9%) of participants, with the highest proportions found in the brain (4.2%) and abdomen (3.1%). The majority of participants (97%) informed of an IF reported no change in quality of life, with 3% of participants reporting that the knowledge of an IF negatively impacted their quality of life. Furthermore, 50% reported increased stress in learning about an IF, and in 95%, the discovery of an IF did not adversely impact his/her life insurance policy. Most participants (90%) would enrol in the study again and perceived the MRI scan to be beneficial, regardless of whether they were informed of IFs. While the implications of a restricted approach to IF management was perceived to be mostly positive, a degree of diagnostic misconception was present amongst participants, indicating the importance of a more thorough consent process to support participant autonomy.ConclusionThe management of IFs from research MRI scans remain a challenging issue, as participants may experience stress and a reduced quality of life when IFs are disclosed. The restricted approach to IF management in CAHHM demonstrated a fair fulfillment of the overarching ethical principles of respect for autonomy, concern for wellbeing, and justice. Drawing on evolutionary realism as a guiding framework and using relevant theoretical bases at macro-, meso-, and micro- levels, we investigate the relative variance explained by each level on selection and retention of Benefit Corporations. Based on a sample of 5052 observations of certified B-Corps and 1403 observations of decertified B-Corps, relative to the country and industry differences, firm-level differences explain most of the variance in non-economic performance, especially for workers and community impact areas. Industry-level differences explain small differences in (...) customers and environmental performance while country differences do not explain meaningful performance differences. The results also show a similar pattern in relative effects for decertified B-Corps. Our findings point to the value of disaggregating the relative effects of multilevel factors in further understanding drivers of non-economic performance and the decertification of B-Corps. (shrink)

This article consisting of four points, shows the subject of multiple relationships between the realities of politics, ethics and the Catholic Church. The issue was presented on the basis of the writings and speeches of Joseph Ratzinger, the current Pope Benedict XVI. Article begins with a presentation of the relationship between politics and ethics as seen in historical perspective. The second section presents the so-called „political ethics” of the first Christian communities in the light of the indications contained in (...) some of the New Testament writings (cf. 1 Thess; 1 Peter) being the basis for the Christian way of acting in the area of policy. The third section indicates some realities like: progress, science and freedom – considered sometimes as an unquestioned idols and that`s why named once by Ratzinger „myth of modernity” – as a threat to connectivity between politics and ethics. The fourth section discusses the teaching of the Catholic Church on politics and the need for its ethical practice. In addition it contains some concrete proposals of Ratzinger that can be used in contemporary debates on the fundamental values of a democratic state in contemporary pluralistic societies. In contemporary Anglo-American political philosophy, perfectionism is widely understood as the idea that the state may, or should, promote valuable conceptions of the good life and discourage conceptions that are worthless or bad. As such, debates over perfectionism occupy a central place in contemporary political philosophy because political philosophers are deeply concerned about whether or not a liberal state is permitted to promote any particular ethical or religious doctrine or impose it on its citizens. -/- In general, contemporary perfectionists do (...) not argue for the state’s pursuit of any religious doctrine. They only maintain that the state is permitted to make a wide range of public policies with the aim of promoting the good life. These policies, commonly found in liberal democratic societies, may include subsidizing museums and art galleries, preserving cultural heritage, setting up public libraries and providing free access to reading materials, encouraging athletic excellence, conserving nature and biodiversity, and educating citizens about the harm of recreational drugs. Nevertheless, perfectionism remains controversial among philosophers and political scientists. -/- It might be beneficial to take a sympathetic view of perfectionism and consider how perfectionists might defend their position against some of the common objections. These objections mainly include: (a) that the state does not possess legitimate authority to make decisions about the good life and seek to promote it; (b) that perfectionist policies are generally illiberal and paternalistic; and (c) that conceptions of the good life are objects of reasonable disagreement and hence cannot legitimately be promoted by the state. In addition, the nature and importance of perfectionist policies and politics will be discussed. (shrink)

Research attention to date has focused upon how to improve process and structural configurations, while there has been scant attention devoted to an examination of the ethical and leadership perspective. This article breaks new ground by exploring the applicability of the Rule of St. Benedict (RSB) to modern employment relationships. The Chinese philosophical tradition aims at a departure from the imperfect reality for the sake of the ideal. But it is also clear to the Chinese philosophers that most people would not follow their footsteps in discarding reality and seeking the ideal. The weakness of the ideal in its incapacity to change the uncultivated man defines a common thread of philosophical thinking in China, and constitutes a bitter truth which these philosophers do not make explicit. Seven philosophers from the fifth (...) to the third centuries B.C.E. are analyzed in order to develop a fresh understanding of the dialectic between the ideal and the uncultivated man: Lao Tzu, Confucius, Mo Tzu, Mencius, Chuang Tzu, Hsun Tzu, and Han Fei. Although I treat them individually rather than group similar topics for comparison, I employ a consistent mode of analysis to study each of them. ;I find that Mo Tzu perceives reality as an oppressive order and attributes it to the egoism of the uncultivated man; and under his system, oppression will prevail since Mo Tzu's proposals of political and religious controls are imperfectly designed. Mencius shows that the uncultivated man is driven by profit and is repulsed by the demands of morality, making it difficult to found a moral polity. Hsun Tzu believes that the irrationality in man withdraws the popular support from a ritual and rational regime. ;Lao Tzu argues that reality is divided between "good" and "evil," which are themselves defined by conventions. Both "good" and "evil" acquire perpetuity, and even Lao Tzu's proposal of primitivism cannot destroy them. Han Fei similarly conceives reality as composed of both moral and immoral men. His statecraft either lends support to morality or is unable to curb wickedness; accordingly, he is incapable of improving reality. ;Confucius observes that his gentlemanly ideal splits into halves as his students appropriate one mode or the other. The gentleman is underappreciated because those embodying one half or the other of the good are not sympathetic to the full ideal. Chuang Tzu thinks that most people are gripped by partisan points of view, while only a few have transcended partisanship. His ideal personality, combining both partisan and nonpartisan standpoints, would appear suspect to most people. (shrink)

I aim to explode a famous thesis about “the rise of fictionality,” argued in an essay of that title by Catherine Gallagher. I also have in mind related claims that the eighteenth or the nineteenth century first distinguished fiction from nonfiction or first differentiated literature from other modes of discourse. Gallagher places the rise of fictionality exactly where Ian Watt placed the rise of the novel—England, 1720 to 1740—and she connects it to the development of a credit economy. This article (...) argues that the relationship between fiction and credit goes deeper than this, insofar as fiction was classically theorized in relation to modal concepts like probability and as such had a direct relationship to what Aristotle called endoxa: what is believed by all or by most. Probability was understood in relation not to what happens but to what is thought to happen: that is, to a socially constituted sense of what and who is credible. The article takes account of the multiple disciplines in which fictionality was theorized in the premodern period, but it emphasizes the centrality of rhetoric and the dissemination of a model of fictionality through the early modern grammar schools. Finally, it reads Shakespeare’s Othello to show that probable fiction was not only an available concept but a crucial tool for the analysis of social life. In Othello, ideologies of race and gender define the unequal terms on which credibility is established. Probable fiction is directly tied to the work of making and unmaking social worlds. (shrink)

Arguably, no historical thinker has had as varied and fractious a reception within modern Judaism as Baruch (Benedict) Spinoza (1632-77), the seventeenth-century philosopher, pioneering biblical critic, and Jewish heretic from Amsterdam. Revered in many circles as the patron saint of secular Jewishness, he has also been branded as the worst traitor to the Jewish people in modern times. Jewish philosophy has cast Spinoza as marking a turning point between the old and the new, as a radicalizer of the medieval (...) tradition and table setter for the modern. He has served as a perennial landmark and point of reference in the construction of modern Jewish identity. This volume brings together excerpts from central works in the Jewish response to Spinoza. True to the diversity of Spinoza's Jewish reception, it features a mix of genres, from philosophical criticism to historical fiction, from tributes to diary entries, providing the reader with a sense of the overall historical development of Spinoza's posthumous legacy. Focusing on the thought of Mencius and Xunzi, this essay reconstructs and examines the classical Confucian position on the legitimate use of military force. It begins by sketching historically important political concepts, such as types of political leaders, politics of the kingly way versus politics of the hegemonic way, and the controversial role of lords-protector. It then moves on to explore Confucian criteria for justifying resort to the use of force, giving special attention to undertaking punitive expeditions to interdict and (...) punish aggression and tyranny. Following this discussion, the essay then attends to important Confucian moral constraints on how military force is properly employed, including prohibitions on attacking the defenseless, indiscriminate slaughter of enemy forces, destruction of civilian infrastructure, prisoner abuse, and non-consensual annexation of territory. The essay concludes by first discussing an illustrative case from Mencius and then comparing its reconstruction of the Confucian position to those offered by other scholars. (shrink)

Benedict Spinoza is feted as the philosopher par excellence of the popular democratic multitude by Antonio Negri and others. But Spinoza himself expresses a marked ambivalence about the multitude in brief asides, and as for his thoughts on what he calls “the rule of multitude,” that is, democracy, these exist only as meager fragments in his unfinished Tractatus Politicus or Political Treatise. This essay addresses the problem of Spinoza’s multitude. First, I reconstruct a vision of power that is found (...) in the Ethics but that tends to be overlooked in the scholarly literature: power is not just sheer efficacy or imposition of will, but rather involves a capacity for being-affected; I call this the conception of power as sensitivity. The second part of my argument shows how, given Spinoza’s emphatic political naturalism, the conception of power as sensitivity can be extended to his political philosophy to shed light on what Spinoza calls potentia multitudinis, or “the power of the multitude”—a term found solely in the Political Treatise and nowhere else in his oeuvre. This juxtaposition reveals significant qualifications to the liberatory potential of the multitude currently claimed in the scholarly literature. (shrink)

Abstract Building on the authors' previous work regarding the classical Confucian position on the legitimate use of military force as represented by Mencius and Xunzi, this paper probes their understanding of punitive expeditions undertaken against tyrants in particular ? aims, justification, preconditions, and limits. It compares this understanding with contemporary Western models of humanitarian intervention, and argues that the Confucian punitive expedition aligns most closely with the emerging ?responsibility to protect? model in Western discussions, although it also differs from the (...) latter in certain respects. For example, the Confucian expedition explicitly forwards as legitimate aims regime change and the punishment of tyrants, in addition to rescue of an abused population and assistance in rebuilding a decent society. The Confucian understanding also appears to set a lower threshold standard (well short of genocide, ethnic cleansing, or large-scale massacre) for what counts as severe tyranny warranting intervention, and it explicitly speaks of an obligation (beyond mere permissibility) to intervene when that threshold is exceeded. In its concluding section, the paper discusses some possible contemporary implications of the classical Confucian understanding of a punitive expedition against tyrants. (shrink)

I find Joseph Chan’s Confucian Perfectionism: A Political Philosophy for Modern Times to be bold and illuminating, and, as always with his work, lucid in an exemplary fashion. I find much more to agree with than to differ with, but in the spirit of a conception of he 和 or harmony that places importance on the need for difference as well as agreement, I will point out some complications or reservations that can be raised about Chan’s proposals and (...) put forward some more friendly amendments and suggested amplifications of some of his lines of thought. This article provides a survey of Walker Percy's criticism of what Pope Benedict XVI calls “scientificity,” which entails a constriction of the dynamic interaction of faith and reason. The process can result in the diminishment of ethical considerations raised by science's impact on public policy. Beginning in the 1950s, Percy begins speculating about the negative influence of scientificity. The threat of a political regime using weapons of mass destruction is only one of several menacing developments. The desacrilization of human (...) life from cradle to grave leads Percy to assert that modern science's impact is often radically incoherent. In The Moviegoer, Percy finds his existential and theistic voice that would enable him to advance his critique of science. (shrink)

Some propositional attitude verbs require that the complement contain some “subjective predicate”. In terms of the theory proposed by Lasersohn, these verbs would seem to identify the “judge” of the embedded proposition with the matrix subject, and there have been suggestions in this direction. I show that it is possible to analyze these verbs as setting the judge and doing nothing more; then according to whether a judge index or a judge argument is assumed, unless the complement contains a subjective (...) predicate, the whole matrix is redundant or there is a type conflict. I further show that certain clear facts argue for assuming a judge argument which can be filled by a contextually salient entity–or by the subject of a subjective attitude verb. (shrink)
