I reconstruct the notion of significance [_Sinnhaftigkeit_] in the later Husserl, with attention to his conceptions of judgment and transcendental logic. My analysis is motivated by the idea that an account of significance can help to connect analytic, Anglo-American conceptions of meaning as a precise, law-governed phenomenon investigated via linguistic analysis and Continental European conceptions of meaning in a broader “existential” sense. I argue that Husserl’s later work points to a transcendental-logical conception of a founding level of _significance_ (...) [_Sinnhaftigkeit_] prior to language, and that this conception meets characteristically analytic demands for precision and governance by logical constraints. At the same time, since it is based in descriptions of perceptual intentionality at the level of essential possibility, it leaves room for an account of meaning as a partially undetermined phenomenon of lived experience, and not just of our language and concepts, and thereby meets the characteristically Continental demand to take at face value meaning’s vagueness and indeterminacy in everyday human life. Among the main concerns of 20th century philosophy was that of the foundations of mathematics. But usually not recognized is the relevance of the choice of a foundational approach to the other main problems of 20th century philosophy, i.e., the logical structure of language, the nature of scientific theories, and the architecture of the mind. The tools used to deal with the difficulties inherent in such problems have largely relied on set theory and its “received view”. There are (...) specific issues, in philosophy of language, epistemology and philosophy of mind, where this dependence turns out to be misleading. The same issues suggest the gain in understanding coming from category theory, which is, therefore, more than just the source of a “non-standard” approach to the foundations of mathematics. But, even so conceived, it is the very notion of what a foundation has to be that is called into question. The philosophical meaning of mathematics is no longer confined to which first principles are assumed and which “ontological” interpretation is given to them in terms of some possibly updated version of logicism, formalism or intuitionism. What is central to any foundational project proper is the role of universal constructions that serve to unify the different branches of mathematics, as already made clear in 1969 by Lawvere. Such universal constructions are best expressed by means of adjoint functors and representability up to isomorphism. In this lies the relevance of a category-theoretic perspective, which leads to wide-ranging consequences. One such is the presence of functorial constraints on the syntax–semantics relationships; another is an intrinsic view of (constructive) logic, as arises in topoi and, subsequently, in more general fibrations. But as soon as theories and their models are described accordingly, a new look at the main problems of 20th century’s philosophy becomes possible. The lack of any satisfactory solution to these problems in a purely logical and set-theoretic setting is the result of too circumscribed an approach, such as a static and punctiform view of objects and their elements, and a misconception of geometry and its historical changes before, during, and after the foundational “crisis”, as if algebraic geometry and synthetic differential geometry – not to mention algebraic topology – were secondary sources for what concerns foundational issues. The objectivity of basic geometrical intuitions also acts against the recent version of structuralism proposed as ‘the’ philosophy of category theory. On the other hand, the need for a consistent and adequate conceptual framework in facing the difficulties met by pre-categorical theories of language and scientific knowledge not only provides the basic concepts of category theory with specific applications but also suggests further directions for their development (e.g., in approaching the foundations of physics or the mathematical models in the cognitive sciences). This ‘virtuous’ circle is by now largely admitted in theoretical computer science; the time is ripe to realise that the same holds for classical topics of philosophy. (shrink)

This article is composed of three sections that investigate the epistemological foundations of Husserl’s idea of logic from the Logical Investigations . First, it shows the general structure of this logic. Husserl conceives of logic as a comprehensive, multi-layered theory of possible theories that has its most fundamental level in a doctrine of meaning. This doctrine aims to determine the elementary categories that constitute every possible meaning (meaning-categories). The second section presents the main idea of (...) Husserl’s search for an epistemological foundation for knowledge, science and logic. Their epistemological clarification can only be reached through a detailed analysis of the structure of those intentions that give us what is meant in our intentions. To reveal the intuitive giveness of logical forms is the ultimate aim of Husserl’s epistemology of logic. Logical forms and meaning-categories can only be given in a certain higher-order intuition that Husserl calls categorical intuition. The third section of this article distinguishes different kinds of categorical intuition and shows how the most basic logical categories and concepts are given to us in a categorical abstraction. This essay examines the reasons for Hegel's frequently professed claim that Kant's Critique of Judgment simultaneously reveals the internal limits of critical philosophy and opens the door to his own system of speculative idealism. It evaluates Hegel's contention that the conceptions of aesthetic experience, organic purposiveness, and the intuitive intellect developed in the third Critique together conspire to undermine the epistemological and metaphysical foundations of the theories of nature and freedom advanced in the first and second Critiques . Finally (...) it explains how Hegel understands his logic and real philosophy as a realist and quasi-naturalistic alternative to Kant's subjective idealism, one that purports to generate a system of categories adequate not only to dead matter but also to organic life and free self-conscious spirit. This book presents a formal and philosophical analysis of language syntax. It refers to some ideas of E.Husserl and G. Frege, to S. Leśniewski's theory of syntactic categories and K. Ajdukiewicz's conception of formal grammar, also to Ch.S. Pierces's distinction between tokens (concrete linguistic entities) and types (ideal linguistic entities) and to A.A. Markov's theory of algorithms. The central aim of the book is - in the spirit of these ideas - to provide both strict yet comprehensive lectures (...) on two axiomatic theories of languages (grammars) irrespective of specific structure of their expression and the notation used in them. The main feature of these theories are that definitions of well-formed expression allow the formulation of algorithms for the examination of syntactic correctness of expressions and that their formalizations are bi-level, in reference to opposite philosophical orientations: nominalistic and idealistic. The theoretical considerations in the book speak in favour of the former. The book contains a translation of the basic contents of the book in Polish "Teorie języków syntaktycznie kategorialnych ("Theories of syntactically categorial languages"), PWN, Warszawa-Wrocław 1985, and extensive Introduction and Final Remarks. In Introduction are discussed the main assumptions, objectives and conditionings of presented theories and intuitive foundations of these theories. By taking into account some texts published between the first and the second edition of the Critique of Pure Reason that have been neglected by most of those who have dealt with the deduction of the categories, I argue that the core of the deduction is to be identified as the ‘almost single inference from the precisely determined definition of a judgment in general’, which Kant adumbrates in the Metaphysical Foundations in order to ‘make up for the deficiency’ of (...) the A-deduction. Whereas the first step of the B-deduction is an attempt to show that the manifold of an intuition belongs to the ‘necessary unity of self-consciousness’ by means of the synthesis of the understanding, the second step has the task of showing that the very same synthesis is responsible for the spatio-temporal unity of the manifold. Thus, Kant's ‘answer to Hume’ is that no spatio-temporal objects of experience at all are merely ‘given’, independently of the conceptual activities of the understanding. Against the established view I substantiate the claim that with this ‘almost single inference’ of the second proof step the distinction between judgments of perception and judgments of experience consequently vanished from Kant's thinking. I formulate and defend a realist theory of the truth of moral judgements according to which moral properties are synthetically but necessarily determined by natural properties of people, actions, or states of affairs. This view can be found in Moore's later ethical writings. The view reconciles two apparently conflicting intuitions: Moral properties supervene upon natural properties, but judgements about moral properties are generally not entailed by any judgements about natural properties. The view is realist in the sense that moral (...) judgements possess a truth-value independently of our means of knowing it. They are true or false in virture of a reality existing independently of us. ;One promising way of understanding this synthetic, necessary connection between moral and natural properties is in terms of the Kripke-Putnam account of natural kinds: Moral properties are type-identical with configurations of natural properties. But this turns out to be unsatisfactory. Another promising way of understanding this connection is on analogy with the connection between the mental and physical. I reject a token-identity theory of the moral and natural, but the analogy itself is helpful in understanding the relationship between the moral and natural. It offers a model for that relationship. ;I distinguish two senses in which supervenience could be understood in morality--ascriptive and descriptive--and argue that ascriptive supervenience depends on descriptive. A realist must defend descriptive supervenience. Moral properties decriptively supervene upon natural properties because moral differences must be explicable and justifiable in terms of natural differences. ;I construct an epistemology for moral properties in which natural properties are criteria, in Wittgenstein's sense, of moral properties. This conforms with the metaphysics of moral properties, and can be reconciled with the phenomenon of moral conflict. Finally, a careful formulation of moral realism is defended against Dummett's objections to realism generally. The moral realist cannot be forced to hold that there are moral truths that humans could not, even in principle, come to know. Yet this is what seems objectionable about realism in other realms. In later works, Vattimo insisted on the epistemological virtues of mimetic theory to reform the classical theory of adequacy2 and the theological implications of this reform.3 Mimetic theory definitely unmasks the violence of the "strong metaphysic," to enable the advent of a weak metaphysics and a kenotic theology based on love: "According to him, it is the survival of the victim-based mechanism, albeit in attenuated form, that explains the recurrence of violence in the history of Christianity. To complete Girard's argument, we learn from Heidegger that what Girard calls the victim-based mechanism is metaphysical objectivism."4 The Erlebnis (non-conceptualized experience) of this theological weakening [End Page 147] has occurred as an event from a previous epistemological weakening, which mimetic theory itself contributes to consolidating.5This drift toward the epistemological nihilism generated a debate between Gianni Vattimo and René Girard, who rejected this conclusion drawn from his mimetic theory.6 The transcript of this controversy first appeared in Verità o fede debole? Dialogo su cristianesimo e relativismo (2006) [Christianity, Truth, and Weakening Faith (2011)], a compilation of three dialogues on three fundamental concepts: truth, secularization, and relativism. In the first part, focused on the epistemological question of truth, Girard affirms he isn't accurately recognized in Vattimo´s thought, showing his distance and warning that, unlike the Italian thinker, his thinking is primarily realistic: "Personally, I agree with Vattimo when he says that Christianity is a revelation of love, but I do not exclude that it is also a revelation of truth. Because truth and love coincide and are one in Christianity."7 In the same chapter, Vattimo challenges René Girard for not having extracted the ultimate consequences of his mimetic theory, because he stays trapped in the realistic ontology of a pre-mimetic mentality: [Vattimo:] "In sum, the only thing I really can't go along with in Girard is his faith in the salvific power of truth, whether it be revealed or discovered by science."8However, in the controversy René Girard could not fail to recognize the central thesis of Gianni Vattimo, according to which his work involved a critique of the classical interpretation of judgment: "I think that there is some kind of incompatibility between traditional philosophy and mimetic theory. I feel, for instance, that scholars influenced by Thomism are handicapped in regard to mimetic theory, because they have to work with neatly distinguished categories. Philosophy is looking for logical foundation as well. It is difficult for philosophers to accept a mechanism that triggers opposite effects. Contemporary analytic theories of law attempt to provide hermeneutic answers to the metaphysical question about the nature of law with intuition playing a pivotal role in these attempts. It is doubtful, however, whether intuition can meet metaphysical and hermeneutic expectations of such theories. The article points out divergent ways of understanding intuition in analytic theories of law. Moreover, such theories face a dilemma of choosing between the „hard” ontology of law, to which intuition would have a privileged epistemic access, and (...) „soft” ontology which entails multiple types of intuition. If collective consciousness, to which the intuitions that constitute the concept of law allegedly belong, is indeed the metaphysical foundation of contemporary analytic theories, they are hardly discernible from empiricism. A promising complementary approach to such a way of theorizing about law—where the vocabulary of intuitions is prioritized—can be provided by analytic pragmatism extending analysis to the practices in which words acquire their meanings. This volume develops a theory of meaning and a semantics for both mathematical and empirical sentences inspired to Chomsky’s internalism, namely to a view of semantics as the study of the relations of language not with external reality but with internal, or mental, reality. In the first part a theoretical notion of justification for a sentence A is defined, by induction on the complexity of A; intuitively, justifications are conceived as cognitive states of a particular kind. The main (...) source of inspiration for this part is Heyting’s explanation of the intuitionistic meaning of logical constants. In the second part the theory is applied to the solution of several foundational problems in the theory of meaning and epistemology, such as Frege’s puzzle, Mates’ puzzle about synonymy, the paradox of analysis, Kripke’s puzzle about belief, the de re/de dicto distinction, the specific/non-specific distinction, Gettier’s problems, the paradox of knowability, and the characterization of truth. On a more general philosophical level, throughout the book the author develops a tight critique of the neo-verificationism of Dummett, Prawitz and Martin-Löf, and defends a mentalist interpretation of intuitionism. In his Prolegomena to the History of the Concept of Time (1925), Heidegger develops what at first sight could be seen as a masterful presentation of the “three fundamental discoveries” of Husserl’s Phenomenology: intentionality, categorial intuition, and the new conception of the a priori. Nevertheless, closer examination of the text discloses a series of subtle but serious problems. Our interest here will be restricted to Heidegger’s presentation of his understanding of Husserl’s theory regarding the intentionality of perception and (...) of categorial intuition. In §6 of that work (48/64), we read that Husserl’s discovery of categorial intuition means two things. Firstly, it means that there is an experience of objectities in which we also have a simple apprehension of categorial constituents, i.e., of the elements which the tradition, in a “crude” fashion, called “categories” (48/64). Secondly, it means that this apprehension is already present in every experience and, as Heidegger explains a few lines later, according to what he has “already suggested” in his preceding analyses of the fundamental discovery of intentionality (in §5), categorial intuition is found even in every perception (48/64). Heidegger insists on this claim, and at several points of his presentation (see, e.g., §6.b.“), he repeats the idea that the intentional act of perception is, after all, permeated with categorial elements, with “categorial intuition.” Now, how should we understand this dense and heavy idea? Is it a hidden criticism of Husserl’s views on perception, or is it Heidegger’s sincere understanding of Husserl’s original discovery? The relevant literature seems to take Heidegger’s reading as a true depiction of Husserl’s theory of categorial intuition. However, as we will see, this reading of the latter theory is far from self-evident, a fact that also casts doubt on the corresponding stance regarding its actual motive. In this chapter, I plan to cast new light on the details of Husserl’s theory, and thus also on this fold of the philosophical relation between Husserl and Heidegger. (shrink)

The key concept in Kant’s aesthetics is “aesthetic reflective judgment,” a critique of which is found in Part 1 of the Critique of the Power of Judgment (1790). It is a critique inasmuch as Kant unravels previous assumptions regarding aesthetic perception. For Kant, the comparative edge of a “judgment” implicates communicability, which in turn gives it a public face; yet “reflection” points to autonomy, and the “aesthetic” shifts the emphasis away from objective properties to the subjective response evoked by the (...) object. Contrary to the view he had inherited, Kant did not treat aesthetic judgments as confused perceptions or inferior cognitions, but rather put them in a category of their own. For Kant, aesthetic reflective judgments implicated not only the processes involved in understanding the empirical world but also the processes involved in ascribing ideas or meaning to experience (which go beyond what is given in perception/cognition). This “going beyond cognition” may have been referred to by Kant as non-cognitive, but it is conditioned on a way of cognizing the object. Kant describes the features of such judgments in the Analytic of the Beautiful before addressing their possibility in subtle ways throughout the Deduction of Pure Aesthetic Judgments. Kant’s critique gives rise to three apparent dichotomies: immediate intuition and prior learning; autonomy and communicability; and non-cognitive response and aesthetic ideas. An interpretation of Kant’s theory can be deemed correct to the degree that it succeeds in showing that the contradictions are only apparent. I will argue that the resulting positive account of Kant’s aesthetic theory offers an understanding of aesthetic reflective judgment that is quite different from the standard formalism that the critics of formalism usually target and by which they misrepresent Kant’s aesthetic theory. When I refer to Kant’s formalism, then, I mean something quite different by this than what is meant by “standard formalism.” The latter is the representation given Kant’s formalism by its contemporary critics and is the typical account of formalism found in the art theory and philosophy of art literature, as will be demonstrated. The Critique of the Quantum Power of Judgement analyzes the a priori principles which underlie the empirical knowledge provided by quantum theory. In contrast to other transcendental approaches to quantum physics, none of the transcendental principles established by Kant is modified in order to cope with the new epistemological situation that arises with the asumption of the quantum postulate. Rather, by considering Bohr's views, it is argued that classical concepts provide the mathematical formalism of quantum theory with physical (...) reference through symbolic analogies in the strict Kantian sense. The main result of the investigation is the determination of the highest principle under which quantum objects are subsumed. This principle states that the conditions of the possibility of the systematic unity of contextual experience are at the same time the conditions of the possibility of quantum objects. Upon this principle rests the possibility of any a priori synthetic knowledge of quantum objects. Therefore, the Critique of the Quantum Power of Judgement yields the prolegomena to any future quantum metaphysics. (shrink)

Neuhouser’s book is one of the most important contributions to the revival of Hegelian philosophy that has been taking place in Anglo-American philosophy over the last few years. Much of the debate in moral and political philosophy of the last few years has been set in terms of “the right” versus “the good,” and it is tempting to want to put Hegel in one of those categories and thereby also to classify him as either a “liberal,” a “communitarian,” or perhaps (...) a “romantic.” Neuhouser develops a powerful case for understanding him as none of these things. Instead he wants to understand Hegel as developing a social and political philosophy around the central conception of “self-determi- nation.” At first blush, that makes Hegel sound very much like the post-Kantian many now take him to be, but Neuhouser argues that, however true that might be, Hegel is best understood as continuing and developing certain key Rousseauian insights. In Neuhouser’s treatment, both Hegel and Kant are “post- Rousseauians,” and his understanding of what this means throws new and great light on understanding why Hegel’s social philosophy may still be of importance to us. This article draws from Charles Taylor’s work of retrieval to advance moral foundations theory (MFT). Taylor’s contribution to MFT lies in his insistence that we retrieve the moral sources that have helped constitute, substantiate, and give meaning to individuals’ moral sensibilities. Applying Taylor’s insights to MFT, this article seeks to advance a view of moral foundations that connects them more explicitly to their underlying moral sources. Using this retrieved account of moral foundations, this article then (...) addresses current issues within moral foundations research and theory. Finally, this article suggests ways in which Taylor’s philosophy can contribute to three areas within business ethics: ethical leadership, behavioral ethics, and ethics pedagogy. (shrink)

Speakers’ intuitive judgements about meaning provide important data for many debates in philosophy of language and pragmatics, including contextualism vs. relativism in semantics; ‘faultless’ disagreement; the limits of truth-conditional semantics; vagueness; and the status of figurative utterances. Is the use of speakers intuitive judgments about meaning justified? Michael Devitt has argued that their use in philosophy of language is problematic because they are fallible empirical judgements about language that reflect speakers’ folk theories about meaning rather than (...) class='Hi'>meaning itself. In this paper I respond to Devitt’s criticism and propose a positive account explaining the nature and evidential status of such judgements. I argue that speakers’ intuitive judgements about meanings of utterances provide valuable evidence for various debates in philosophy of language because they are importantly connected to the linguistic performance of speakers. Arguably, the connection is reliable due to a constant monitoring of the interpretations ascribed to linguistic utterances. I call this the voice of performance view. My account restores prominence to speakers’ intuitive judgements about meaning while avoiding Devitt’s worries. (shrink)

The way in which mathematics relates to experience has deeply engaged philosophers from the scientific revolution to the present. It has strongly influenced their views on epistemology, mathematics, science, and the nature of reality. Kant's views on the nature of mathematics and its relation to experience both influence and are influenced by his epistemology, and in particular the distinction Kant draws between concepts and intuitions. My dissertation contributes to clarifying the role of intuition in Kant's theory of mathematical cognition. (...) It focuses in particular on Kant's theory of magnitudes. This theory explains the applicability of mathematics to experience while bridging his philosophy of mathematics and his philosophy of science; it is therefore central. Kant's views on magnitudes, however, have been neglected. ;The dissertation divides into four parts. It begins by analyzing Kant's concept of magnitude and the closely related concepts of quanta, quantitas, quantity and number. These clarifications lay the groundwork for reconstructing and evaluating Kant's views. ;Understanding Kant's theory of mathematical cognition requires understanding how the quantitative forms of judgment and the categories of quantity are employed in mathematics. I argue for an interpretation that reflects the influence of 18$\sp{\rm th}$ Century metaphysics on Kant's thought, and reveals Kant's attempt to find a place for a mathematical conception of the world within that metaphysics. ;I also examine Kant's arguments for two fundamental properties of space--infinite divisibility and unlimited extent. I argue that intuition plays a perceptual role that can only be understood within the context of Kant's theory of imagination. ;Finally, I argue that according to Kant, a homogeneous manifold in intuition is required to represent composition and a mathematical version of the part/whole relation. The dissertation uses a modern understanding of the properties of relations to analyze the part/whole relations Kant refers to in his logic, and contrast them with the part/whole relations in his theory of magnitudes. Modern measurement theory aids in identifying Kant's insights into the conditions for the applicability of mathematics to experience. In the thesis I proposed what would now be called an expressivist account of judgements of the form ‘It is probable that p’. Foundations of Relational Realism presents an intuitive interpretation of quantum mechanics, based on a revised decoherent histories interpretation, structured within a category theoretic topological formalism. -/- If there is a central conceptual framework that has reliably borne the weight of modern physics as it ascends into the twenty-first century, it is the framework of quantum mechanics. Because of its enduring stability in experimental application, physics has today reached heights that not only inspire wonder, but arguably exceed the limits of (...) intuitive vision, if not intuitive comprehension. For many physicists and philosophers, however, the currently fashionable tendency toward exotic interpretation of the theoretical formalism is recognized not as a mark of ascent for the tower of physics, but rather an indicator of sway—one that must be dampened rather than encouraged if practical progress is to continue. -/- In this unique two-part volume, designed to be comprehensible to both specialists and non-specialists, the authors chart out a pathway forward by identifying the central deficiency in most interpretations of quantum mechanics: That in its conventional, metrical depiction of extension, inherited from the Enlightenment, objects are characterized as fundamental to relations—i.e., such that relations presuppose objects but objects do not presuppose relations. The authors, by contrast, argue that quantum mechanics exemplifies the fact that physical extensiveness is fundamentally topological rather than metrical, with its proper logico-mathematical framework being category theoretic rather than set theoretic. -/- By this thesis, extensiveness fundamentally entails not only relations of objects, but also relations of relations. Thus, the fundamental quanta of quantum physics are properly defined as units of logico-physical relation rather than merely units of physical relata as is the current convention. Objects are always understood as relata, and likewise relations are always understood objectively. In this way, objects and relations are coherently defined as mutually implicative. The conventional notion of a history as “a story about fundamental objects” is thereby reversed, such that the classical “objects” become the story by which we understand physical systems that are fundamentally histories of quantum events. -/- These are just a few of the novel critical claims explored in this volume—claims whose exemplification in quantum mechanics will, the authors argue, serve more broadly as foundational principles for the philosophy of nature as it evolves through the twenty-first century and beyond. These supporting concepts enable us to much more adequately understand the meaning of apoha. First, a sharp distinction is drawn between the real and the conceptual; the real is particular, unique, momentary and the basis of perception, while the conceptual is universal, general, only supposedly objective and the basis of language. Second, the complex nature of negation discloses the kind of negation meant by apoha. Negation by implication is seen as disclosing the necessary relation between simple affirmations and simple (...) negations. It is in this sense that Dignaga asserts that the meaning of words lies in the negation of the opposite. Third, the idea of apoha as the differentiation of concepts is to be distinguished from the Nyāya-Vaiśe $$\underset{\raise0.3em\hbox{$\smash{\scriptscriptstyle\cdot}$}}{s}$$ ika notion of exclusion as a materially present quality in objects.Ratnakirti, and Mok $$\underset{\raise0.3em\hbox{$\smash{\scriptscriptstyle\cdot}$}}{s}$$ ākaragupta following him, use the idea of negation by implication to explain apoha as the simultaneity of and logical relation between a positive assertion concerning an epistemological object and a negative assertion concerning all things which are not that epistemological object. For example, Ratnakirti in accordance with the theory of apoha explains that the term cow “harbors” the negation of non-cow in the same way that blue is harbored in the term blue lotus. The exclusion of the other, i.e., the negation of the non-cow, is held by Ratnakirti to be an actually apprehended attribute of the cow cognized (as distinct from the cow in itself). He says “... discrimination of non-cow inevitably arises simultaneously with the perception of the cow, for (the negation of non-cow) is the qualifier (of the individual).” This interaction between the positive and the negation of the other, i.e., the relation of negation by implication, as a simultaneous interaction is necessary lest when, e.g., asked to tie up a cow one ties up a horse instead.Mok $$\underset{\raise0.3em\hbox{$\smash{\scriptscriptstyle\cdot}$}}{s}$$ ākaragupta denies three possible interpretations of apoha before putting forth his own definition. The first is that when an external object is conceptualized this is done as “the other (the dissimilar) is discriminated from this.”The second is much the same, only it is in terms of the mental image, i.e., the epistemological object rather than the ontological object as in the first. The third is that apoha means the negation of an assertion, i.e., the simple absence of the other. All three of these interpretations are unacceptable to Mok $$\underset{\raise0.3em\hbox{$\smash{\scriptscriptstyle\cdot}$}}{s}$$ ākaragupta. He defines apoha as “the affirmation (of a positive entity) qualified by discrimination (of it from all other entities).”Mok $$\underset{\raise0.3em\hbox{$\smash{\scriptscriptstyle\cdot}$}}{s}$$ ākaragupta goes on to explain this simultaneity more fully: ... those who stress affirmation think that after we have known the cow, we consequently determine the discrimination of the essence of the cow from that of the non-cow; those who stress the negative function of apoha are of the opinion that we first know the discrimination of the dissimilar thing and then consequently confirm the thing which is discriminated from others, viz., the cow. Thus (both interpretations) are wrong. For at the time of judgment we do not experience an order of comprehension in which (negation or affirmation) occurs first. In fact, it is not the case that one, having understood the affirmation, later confirms the negation by implication, or that one having understood the negation later confirms what is discriminated (from the dissimilar). Therefore, we say that the very understanding of the cow is the same as the understanding of what is discriminated from the dissimilar.We can see from this that for Ratnakirti and Mok $$\underset{\raise0.3em\hbox{$\smash{\scriptscriptstyle\cdot}$}}{s}$$ ākaragupta apoha meant the simultaneous affirmation of and negation of the dissimilar from the (epistemological) object. Mok $$\underset{\raise0.3em\hbox{$\smash{\scriptscriptstyle\cdot}$}}{s}$$ ākaragupta's concern with the “time of judgment” also shows that the idea of apoha was understood by them as being psychologically descriptive. In the process of identifying an epistemological object as some particular thing, neither the negative nor the positive function have priority but are, rather, complementary one to the other. This simultaneity and complementarity are supported by the examination of mind “at the time of judgment,” i.e., it is a psychological description of the process of identification of an epistemological object as some particular thing.It is this fact of apoha describing the process of identification which, as described above, places apoha in the inference category of sources of truth. Apoha is clearly, therefore, involved with words and concepts rather than being on the perception side where it would have to be a metaphysical concept describing the real or absolute.Putting the idea of apoha into contemporary terms we can say that it is a psychological descriptor for the bipolar relation of concepts. Dignaga and the other Buddhist logicians are then to be understood here as being involved in producing a phenomenological description of linguistic thought processes. More broadly, as in the discussion of perception, they are involved in the phenomenological description of consciousness, a favorite Buddhist undertaking. As such, the work of the Buddhist logicians fits into the larger soteriological intention of all Buddhist thinkers, since enlightenment is understood to follow from insight into the nature of consciousness as productive of suffering.Some authors have criticized the logicians as being overly concerned with the un-Buddhist occupation of arguing. However, when their work is seen as expanding our understanding of the nature and working of consciousness, the logicians are certainly worthy of our respect. (shrink)

This book characterizes a notion of type that covers both linguistic and non-linguistic action, and lays the foundations for a theory of action based on a Theory of Types with Records (TTR). Robin Cooper argues that a (...) class='Hi'>theory of language based on action allows the adoption of a perspective on linguistic content that is centred on interaction in dialogue; this approach is crucially different to the traditional view of natural languages as essentially similar to formal languages such as logics developed by philosophers or mathematicians. At the same time, he claims that the substantial technical advantages made by the formal language view of semantics can be incorporated into the action-based view, and that this can lead to important improvements in both intuitive understanding and empirical coverage. This enterprise uses types rather than possible worlds as commonly employed in studies of the semantics of natural language. Types are more tractable than possible worlds and offer greater potential for understanding the implementation of semantics both on machines and in biological brains. (shrink)

The overwhelming majority of the attempts in exploring the problems related to quantum logical structures and their interpretation have been based on an underlying set-theoretic syntactic language. We propose a transition in the involved syntactic language to tackle these problems from the set-theoretic to the category-theoretic mode, together with a study of the consequent semantic transition in the logical interpretation of quantum event structures. In the present work, this is realized by representing categorically the global structure of a quantum algebra (...) of events (or propositions) in terms of sheaves of local Boolean frames forming Boolean localization functors. The category of sheaves is a topos providing the possibility of applying the powerful logical classification methodology of topos theory with reference to the quantum world. In particular, we show that the topos-theoretic representation scheme of quantum event algebras by means of Boolean localization functors incorporates an object of truth values, which constitutes the appropriate tool for the definition of quantum truth-value assignments to propositions describing the behavior of quantum systems. Effectively, this scheme induces a revised realist account of truth in the quantum domain of discourse. We also include an Appendix, where we compare our topos-theoretic representation scheme of quantum event algebras with other categorial and topos-theoretic approaches. (shrink)

Arthur Kaufmann is one of the most prominent figures among the contemporary philosophers of law in German speaking countries. For many years he was a director of the Institute of Philosophy of Law and Computer Sciences for Law at the University in Munich. Presently, he is a retired professor of this university. Rare in the contemporary legal thought, Arthur Kaufmann's philosophy of law is one with the highest ambitions — it aspires to pinpoint the ultimate foundations of law by (...) explicitly proposing an ontology, a general theory of knowledge and concept of a person. Kaufmann's work derives, first of all, from the thinking of Gustav Radburch, his teacher, and then from ideas of Karl Engish and Hans-Georg Gadamer. The philosophy undertakes to pursue the ultimate foundation of law, law which is understood by Kaufmann, first of all, as a "concrete judgement" that is, what is right in a concrete situation. Justice belongs to the essence of law and "unjust law" is contradictio in adiectio. Kaufmann opposes all those theories, which as the only foundation for establishing just law (Recht) adopt legal norms (Gesetz). In Kaufmann's opinion , such theories are powerless in the face of all types of distortions of law rendered by political forces. He suggests that the basic phenomenon which needs to be explained and which cannot be disregarded by a philosopher of law is so-called "legal lawlessness" ("Gestzliches Unrecht"). "Legal lawlessness" which forms a part of life experience for the people of twentieth century totalitarian states. It proved "with the accuracy of scientific experiment" that the reality of law consists of something more than bare conformity with legal norms. The existence of lex corrupta indicates that law contains something "non-dispositive" which requires acknowledgment of both law-maker and judge. Kaufmann, accepting the convergent concept of truth and cognition, assumes that "non-dispositive" content, emerging as the conformity of a number of cognitive acts of different subjects (inter-subjective communicativeness and verifiability), indicates the presence of being in this cognition. The questions "What is law?" and "What are the principles of a just solution?" lead straight to the ontology of law, to the question about the ontological foundations of law. Kaufmann discerns the ontological foundations of law in the specifically understood "nature of things" and, ultimately, in a "person". He proposes a procedural theory of justice, founded on a "person". In my work, I undertake to reconstruct the train of thought which led Kaufmann to the recognition of a "person" as the ontological foundation of law. In the first part, the conception of philosophy adopted by Kaufmann, initial characteristics of law — of reality which is the subject of analysis, as well as, the requirements for proper philosophical explanation of law posed by Kaufmann are introduced. In the second, Kaufmann's reconstruction of the process of the realisation of law is presented. Next, the conception of analogy which Kaufmann uses when explaining law is analyzed. In the fourth part, Kaufmann's conception of ontological foundations of law is discussed. A critical analysis is carried out in which I demonstrate that the theory of the ontological foundation of law proposed by Kaufmann and the concept of a person included in it do not allow a satisfac¬tory explanation of the phenomenon of "legal lawlessness" and lead to a number of difficulties in the philosophical explanation of law. Finally, the perspectives of a proper formulation of the issue of the ontological foundations of law are drafted in the context of the analyzed theory. My interest is centered on the conception of philosophy adopted by Kaufmann, according to which the existence of the reality is inferred on the basis of a certain configuration of the content of consciousness, whereas at the point of departure of philosophy of law, the data to be explained is a certain process, which is, basically, a process of cognition, while the reality appears only as a condition for the possibility of the occurrence of the process. I wish to argue that the difficulties which appear in the explanation of law are a consequence of the assumed fundamental philosophical solu¬tions, which seem to be characteristic, though usually not assumed explicitly, in philoso¬phy and theory of law dominant at present in continental Europe. Thereby, I wish to show the significance of ontological and epistemological solutions to the possibility of a proper formulation of the problems posed by philosophy and theory of law. Kaufmann proclaims himself in favour of a philosophy which poses questions about the ultimate foundations of understanding of the reality. In epistemology, he assumes that answers to the questions "What is reality like?" and ultimately "What is real?" are inferred on the basis of uniformity of a cognitive acts of different subjects. Cognition of the reality is accomplished exclusively through the content of conceptual material. The two fundamental questions posed by philosophy of law are "What is just law?" and "How is the just law enacted?" The latter is a question about the process of achieving a solution to a concrete case. Since, in Kaufmann's opinion, law does not exist apart from the process of its realisation, an answer to the question about the manner of realisation of law is of fundamental significance to answering the question: "What is law?" and to the explanation of the question about the ontological grounding of law, which is, as well, the foundation of justice. The proper solution has to take into account the moment of "non-dispositive" content of law; its positiveness understood as the reality and, at the same time, it has to point to the principles of the historical transformation of the content. Law, in the primary meaning of the word, always pertains, in Kaufmann's opinion, to a concrete case. A legal norm is solely the "possibility" of law and the entirely real law is ipsa res iusta, that which is just in a given situation. Determination of what is just takes place in a certain type of process performed by a judge (or by man confronted with a choice). Kaufmann aims to reconstruct this process. A question about the ontological foundation of law is a question about the ontological foundations of this process. In the analyzed theory it is formulated as a question about the transcendental conditions, necessary for the possibility of the occurrence of the process: how the reality should be thought to make possible the reconstructed process of the realisation of law. Kaufmann rejects the model for finding a concrete solution based on simple subsump¬tion and proposes a model in which concrete law ensues, based on inference by analogy, through the process of "bringing to conformity" that which is normative with that which is factual. Kaufmann distinguishes three levels in the process of the realisation of law. On the highest level, there are the fundamental legal principles, on the second legal norms, on the third — concrete solutions. The fundamental principles of law are general inasmuch as they cannot be "applied" directly to concrete conditions of life, however, they play an important part in establishing norms. A judge encounters a concrete situation and a system of legal norms. A life situation and norms are situated on inherently different levels of factuality and normativeness. In order to acquire a definite law both a norm (system of norms) and a life situation (Lebenssachverhalt) should undergo a kind of "treatment" which would allow a mutual conformity to be brought to them. Legal norms and definite conditions of life come together in the process of analogical inference in which the "factual state" ("Tatbestand") — which represents a norm, and in the "state of things" ("Sachverhalt") — which represents a specific situation are constructed. A "factual state" is a sense interpreted from a norm with respect to specific conditions of life. The "state of things" is a sense constructed on the basis of concrete conditions of life with respect to norms (system of norms). Legal norms and concrete conditions of life meet in one common sense established during the process of realisation of law. Mutatis mutandis the same refers to the process of composition of legal norms: as the acquisition of concrete law consists in a mutual "synchronization" of norms and concrete conditions of life, so acquisition of legal norms consists of bringing to conformity fundamental principles and possible conditions of life. According to Kaufmann, both of these processes are based on inference through analogy. As this inference is the heart of these processes it is simultaneously a foundation finding just law and justice. How does Kaufmann understand such an inference? As the basis for all justice he assumes a specifically interpreted distributive justice grounded on proportionality. Equality of relations is required between life conditions and their normative qualification. Concrete conditions of life are ascribed normative qualification not through simple application of a general norm. More likely, when we look for a solution we go from one concrete normative qualified case to another, through already known "applications" of norms to a new "application". The relation between life conditions and their normative qualifica¬tion has to be proportional to other, earlier or possible (thought of) assignments of that which is factual to that which is normative. Law as a whole does not consist of a set of norms, but only of a unity of relations. Since law is a, based on proportion, relative unity of a norm and conditions of life, in order to explain law in philosophical manner, the question about ontological base of this unity has to be asked. What is it that makes the relation between a norm and conditions of life "non-dispositive"? What is the basis for such an interpretation of a norm and case which makes it possible to bring a norm and conditions of life into mutual "conformity"? This is a question about a third thing (next to norms and conditions of life), with respect to which the relative identity between a norm and conditions of life occurs, about the intermediary between that which is normative and that which is factual and which provides for the process of establishing of norms, as well as, finding solutions. It is the "sense" in which the idea of law or legal norm and conditions of life have to be identical to be brought to mutual "conformity". In Kaufmann's opinion such a sense is nothing else but the "nature of things" which determines the normative qualification of the reality. Since establishment of this "sense" appears to be "non-dispositive" and controlled inter-subjectively (namely, other subjects will reach a similar result) so, in conformity with the convergent concept of truth, the "nature of things" must be assigned a certain ontological status. According to Kaufmann this is a real relation which occurs between being and obligation, between the conditions of life and normative quality. However, it should be underlined that from the point of view of the analyzed system the "nature of things" is a correlate of constructed sense, a result of a construction which is based on the principle of consistent understanding of senses ("non-normative" and "normative") and is not a reality which is transcendent against the arrangement of senses. In Kaufmann's theory, inference from analogy appears to be a process of reshaping the concepts (senses) governed by tendency to understand the contents appearing in relations between that which is factual and that which is normative in a consistent way. The analogical structure of language (concepts) and recognition of being as composed of an essence and existence is an indispensable requirement for the possibility of the realisation of law, based on specifically understood inference from analogy. It is necessary to assume a moment of existence without content which ensures unity of cognition. Existence emerges thus as a condition of the possibility of cognition. According to Kaufmann, the "nature of things" is the heart of inference through analogy and the basis for establishment of finding of law. Inference from the "state of things" to a norm or from a norm to the "state of things" always means inference through the "nature of things". The "nature of things" is the proper medium of objective legal sense sought in every cognition of law. In Kaufmann's view, the question whether the "nature of things" is ultima ratio of interpretation of law or is only a means of supplement gaps in law or whether it is one of the sources of law, is posed wrongly. The "nature of things" serves neither to supplement the gaps nor is it a source of law as, for example, a legal norm may be. It is a certain kind of "catalyst" necessary in every act of making law and solving a concrete case. Owing to "nature of things" it is possible to bring to a mutual conformity the idea of law and possible conditions of life or legal norms and concrete conditions of life. In Kaufmann's conception the "nature of things" is not yet the ultimate basis for understanding the "non-dispositiveness" of law. The relation between obligation and being is determined in the process of the realisation of law. Both the process itself and that which is transformed in this process are given. A question about the ontological bases of "material" contents undergoing "treatment" in the process of the realisation of law and about being which is the basis of regularity of the occurrence of the process arises. Only this will allow an explanation that the result of the process is not optional. Thus, a question about reality to which law refers and about the subject realising the law has to be formed. To this, Kaufmann gives the following answer: that which is missing is man but not "empirical man" but man as a "person". A "person" understood as a set of relations between man and other people and things. A "person" is the intermediary between those things which are different — norm and case are brought to conformity. A "person" is that which is given and permanent in the process of the realisation of law. It determines the content of law, is "subject" of law; this aspect is described by Kaufmann as the "what" of the process of realisation of law. A "person" consists of precisely just these relations which undergo "treatment" in the process. On the other hand, a "person" is "a place" in which the processes of realisation of law occur, it is the "how" of normative discourse, a "person" is that which determines the procedure of the process, being "outside" of it. This aspect of a "person" is connected with the formal moment of law. A "person" being, at the same time, the "how" and the "what" of the process of the realisation of law, is also, to put it differently, a structural unity of relation and that which constitutes this relation (unity of relatio and relata). According to this approach a "person" is neither an object nor a subject. It exists only "in between". It is not substance. Law is the relation between being and obligation. That which is obligatory is connected with that which is general. That which is general does not exist on its own, it is not completely real. Accordingly, a "person" as such is also not real. It is relational, dynamic and historical. A "person" is not a state but an event. In Kaufmann's opinion, such a concept of a "person" helps to avoid the difficulties connected with the fungibility of law in classical legal positivism. A "person" is that which is given, which is not at free disposal and secures the moment of "non-dispositiveness" of law. Kaufmann concludes: "The idea (»nature«) of law is either the idea of a personal man or is nothing". Theory points at the structure of realising law and explains the process of adoption of general legal norms for a concrete situation. The analysis has shown however, that in this theory a satisfactory answer to the question about the ultimate foundations of law is not given. It seems that in the analyzed theory the understanding of human being takes place through understanding of law. What is good for man as a "person", what is just, what a "person" deserves may be determined only against the existing system of law. A "per¬son" adopted as a basis of law is the reality postulated in the analysis of the process of the realisation of law. It is a condition of possibility of this process ( explaining, on one hand, its unity and, on the other hand, the non-dispositive moments stated in this process). A "person" in the discussed theory is entirely defined by the structure of law, it can be nothing more than that which is given in law, what law refers to, what law is about. Being, which is a "person", is constituted by relations between people and objects, the relations which are based on fundamental links between norms and conditions of life established in a process of bringing them to conformity. It has to be assumed that man as a "person" is a subject of law only as far as realising law "treats" given senses according to their current configuration. The system of law is a starting point and it describes in content what man is as a "person". Moreover, being a "person" is the condition for entering legal relations. Consistently, Kaufmann writes that "empirical man" is not the subject of law, man is not "out of nature" a "person". People become "persons" due to the fact that they acknowledge each other as "persons" — acknowledging, at the same time, law. This acknowledgement is a con¬dition of existence, of the possibility of the occurrence of process of realisation of law and of constituting legal relations which ultimately constitute a "person". Kaufmann assumes, that law tends towards a moral aim: it may and must create an external freedom, without which the internal freedom to fulfil moral obligations cannot develop. However, this postulate is not based on the necessary structure of human being. From the point of view of his system, it is nothing more than only a condition for the possibility of the occurrence of the process of the realisation of law — lack of freedom would destroy the "how" of this process. Thus, the postulate to protect the freedom of personal acts has to be interpreted, in accordance with the analyzed theory, as a postulate, the fulfilment of which aims ultimately at the accomplishment of the very same process of realisation of law itself and not the realisation of a given man. Kaufmann considers a "person" to be an element which unites the system of law as a whole. Law is a structure of relations, which are interdependent and inter-contingent. Consequently, a "person" which is to form the ontological basis of law has to be entity consisting of all relations. Being also the "how" of the process of realisation of law, if a "person" is to warrant its unity, it has to be a common source for all procedures. Hence, a single "person" would constitute a subject of law. Man appears to be only a moment of a certain entirety, realisation of which should be an aim of his actions. Law, creating a "person" as an object and subject of law becomes a primary entity. In the analyzed theory, the basis for determination of aims which law sets to man is not the allocation of man-subject to something which improves him but rather, such relation is only just constituted by law. A question appears, why should aims set in law also be the aims of "empirical man"? Why is this "empirical man" to be punished in the name of a "person" understood in such a way? If, however, it is assumed that what is man is determined by a system which is superior to him, then man has to be understood only as a part of a whole and there are no grounds to prohibit istrumental treatment of man and so the road to all aspects of totalitarianism might be opened. A problem of the application of created theory to the reality arises, the reality which the theory pretends to explain. Ultimately in his theory Kaufmann does not give any systemic grounds for a radical questioning of the validity of any legal norms. Every new norm becomes an equal part of system of norms. It is only its interpretation and application to given conditions of life that may be disputable, however, this refers to all norms without exception. Cohesive inter-pretation of norms and applications is necessary and sufficient for the acquisition of just law. New norms have to be interpreted in the light of others, correspondingly, the other norms require reinterpretation in the light of the new ones. Contradiction in interpretation of a norm does not form a basis for questioning norms but may serve only to question the manner of their interpretation (understanding). Therefore, no grounds exist to assume any legal norm as criminal or unjust, and in consequence, to question any consistently realised system based on formally, properly established norms, as "legal lawlessness". As law and a "person" do not exist without the process of realisation of law, the role of legal safety becomes crucial as the condition for the possibility of the occurrence of the process of realisation of law. Denying legal safety would be tantamount to negation of law in general (also of moral law) as negation of safety takes away, at the same time, the basis for occurrence of the process of realisation of law. Moreover, any lack of legal safety would also mean lack of a basis for the existence of man as a "person". Kaufmann's thesis, that civil disobedience is legalized only when it has a chance to lead to success, consistent with his concept of the foundations of law, seems to point directly to conclusions which deny the facts taken under consideration and doubtlessly Kaufmann's own intentions, since it would have to be assumed that accordingly there are no grounds to question a legal system in force based on violence which secures its operation. Force finally seems to determine which one of the mutually irreconcilable normative systems constitute law and which does not. A legitimate position is one which leads to success, it is the weaker system which is negated. If so, then basically violent imposition of law is not an act directed against the law in force but, to the contrary, realisation of law. In the context of the new system the former system of law may be talked about as unjust solely in the sense of being incapable of being consistently united with the new. However, at the base, ultimately, lies force which reaffirms differences and excludes from the process of realisation of law certain norms and their interpretations. Kaufmann was aiming at grounding of that which is "non-dispositive" in a certain given framework of interpretation. Nevertheless, he does not provide foundations for the understanding of phenomena, which he undertakes to explain at a point of departure. Instead of explaining them the theory negates the possibility of their existence. The reality postulated in regard to "non-dispositive" moments of the reconstructed process of acquiring law consist of a specifically understood "person", which appears in Kaufmann's conceptions as a condition of the possibility of the realisation of law. According to this approach understanding of a "person" may be only a function of law. To understand "legal lawlessness" and foundations of justice it is necessary to look for such theory of law in which understanding of man as a "person" and being is not a function of understanding of law (in which a "person" is not only a condition for possibility of reconstructed process of realisation of law; for possibility of cognition processes). It seems necessary to start from theory of being and a "person" based on broader experience than the one assumed by Kaufmann and reconstruct the ontological foundations of the process of realisation of law only in such perspective. Kaufmann points out that that to which law refers is ipsa res iusta a concrete relation of man to other people and things. This relation, in his theory, appears to be basically only just constituted by law (normative senses "applied" to conditions of life). Therefore, understanding the relation between a given man and other people and things which constitute the aim of his actions, that is understanding of good, is enacted against the background of constitution of senses; constitution which is a result of a process aiming towards consistent understanding of particular contents (of nor¬mative and non-normative senses). "Being" is secondary towards constructed senses it is only their correlate. The primary relation consists of relation of a man to law (system of norms), while the secondary relation is one of man to something which is the aim of his action (relation between man and good). Considering such approach it is difficult to envision a satisfying answer to the fundamental question: why does law put concrete man under any obligation to obey it? The source of this problem can be seen in reduction of the base for understanding good to content of obligation formulated in auto-reflection. Such reduction seems to be a consequence of Kaufmann's adoption of "convergent concept of truth" and in con¬sequence his recognition of indirect, essentialistic grasp of reality formulated in concepts as the basic and only foundation of theory of being and of law. In view of such an approach, analogy of law, concepts and being is the condition for the possibility of the process of transformation of senses which aims at consistent interpretation of all law. Existence is postulated with respect to the possibility of unity of experience and cognition. However, also a different approach to understanding of the problem of being and good is possible. In spontaneous cognition being is affirmed, first of all, not as a certain, non-contradictory, determined content, but as something existing. Together with a cer¬tain content (passed indirectly through notions) existence of being is co-given. The basis for unity of being is not formed by the consistence of content, as it is in the case of the theories departing from the analysis of cognition processes, but by an act of existence realising content (essence). Such an approach makes it also possible to go beyond the convergent concept of truth. It is worth mentioning that allocation of an agent to good is realised not only by the content of duty. A statement that something is good is primary with respect to determination of this good in content. The recognised good always bears some content, however, there are no reasons to base the concept of good exclusively on indirect, formulated in concepts cognition. As primary, can be adopted the relation of man to good and not of man to law. Determination in content appears to be only an articulation of aspectual cognition of being, as an object of action. In such a case the basis for relative unity of norm and conditions of life is not the "nature of things" understood as correlate of sense but it is relation to good based on internal constitution of man as potential, not self-sufficient being. It does not mean, that the moments of the process of realisation of law singled out by Kaufmann are not important to determination of what is just. He, quite rightly, points to significant role played by norms in the evaluation of concrete situations, in man's search for closer specification in content of good innate to him. The structure of process of determining law for a concrete situation, to a great degree corresponds to the processes of determining law which take place not only in the legal sciences. Kaufmann's analyses of the process of realisation of law show the complexity of the structure of these processes and point towards important moments allowing a better understanding of law and man. Nevertheless, these analyses cannot be a basis for construction of philosophical theory of law, theory which hopes to point out the ultimate, ontological foundations for understanding law. Kaufmann's results may become fully valid only in a more general perspective including broader experience at the point of departure. (shrink)

A Constructivist Foundation of the Objects of Scientific Empirical Theories. The following considerations are guided by the assumption that the objects of any scientific empirical theory are constructs as well as the theories themselves, the construction of these object-constructs being fundamentally dependent on the theories' functioning in the provision of practically relevant empirical explanations. The relevance of these explanations consists in their contribution to the improvement of at least one practical capacity through enabling the invention of at least one (...) improving kind of practical actions. In an excursus on the origination and the development of the notion of theory within human history the view is held, in contrast to Aristotle, that theorization has always aimed at practical relevance, however in a broader sense of "practical" than that in which Aristotle uses the term "πρακτικός", and that only the practical functions of theory-construction have changed over the times, and their object-constructs correspondingly. The latest form of theory with the above-mentioned function in the development of social practice is the scientific explanatory empirical theory with the descriptive empirical theory now no longer fulfilling a practical function of its own, but only a service-function of data acquisition for the explanatory theory. The object-constructs of strictly scientific empirical theories in the sense of explanatory theories for the improvement of practical capacities are here considered to be empirical quasi-actions, those of the dependent descriptive empirical theories either quasi-instruments or quasi-products or quasi-materials of the respective kind of quasi-actions of the explanatory theory. The empirical quasi-action is here conceived as the latest in a sequence of developing object-constructs that have resulted from different and successively more effective attempts at better survival of human beings and even from prehuman stages of evolution. The author envisages a differentiation of empirical quasi-actions into further sub-categories to provide the conceptual bases for the construction of objects of new kinds of scientific explanatory empirical theories that might become practically relevant for the improvement of new kinds of practical capacities to be preferably improved for the advancement of social practice: Beside the already relevant category of empirical processes are here proposed the further categories of empirical originations of meaning and of empirical originations of practical actions as conceptual bases for object-constructs of future scientific empirical theories. As it emerged in the late twentieth century, Empire promised a new era of global cooperation and stability through a seamless integration of late capitalism and neoliberal technocracy. Premised as an end to history itself, all that was left to accomplish was to tinker at the margins, stimulate corporate enterprise, embrace financialization and technological innovation, and encourage liberal rights and inclusion. As we enter the third decade of the twenty-first century, the narrative fictions sustaining Empire have broadly collapsed at the (...) level of symbolic identification and belief. Empire has entered into a period of global emergency and mutation. Engaging with Michael Hardt and Antonio Negri’s work, this paper considers what might emerge when we read education into the circuitry of Empire’s decay. First, we locate Empire within foundational tensions in modernity, using Kantian philosophy and colonialism as examples, to foreground the idea of education as immanent to historical processes of creativity, resistance, and innovation. Second, we highlight dead-end responses, from space colonization to neo-fascism, as representations of how modes of education circulate to stabilize and contain Empire’s crises, specifically in relation to capitalism, nationalism, and identity. Lastly, the paper develops a political ontology of education after Empire. (shrink)

��Is moral judgment accomplished by intuition or conscious reasoning? An answer demands a detailed account of the moral principles in question. We investigated three principles that guide moral judgments: (a) Harm caused by action is worse than harm caused by omission, (b) harm intended as the means to a goal is worse than harm foreseen as the side effect of a goal, and (c) harm involving physical contact with the victim is worse than harm involving no physical contact. Asking whether (...) these principles are invoked to explain moral judgments, we found that subjects generally appealed to the first and third principles in their justifications, but not to the second. This finding has significance for methods and theories of moral psychology: The moral principles used in judgment must be directly compared with those articulated in justification, and doing so shows that some moral principles are available to conscious reasoning whereas others are not. Cette étude essaye d’établir qu’il y a deux notions très différentes de « fondation » à l’œuvre dans les Recherches logiques de Husserl. Dans la IIIème Recherche, où le terme est formellement introduit, lorsqu’il se demande quels sont les contenus qui peuvent exister d’une manière autonome (indépendants) et lesquels peuvent exister uniquement en tant que moments d’autre chose (dépendants), Husserl suit ce que j’appelle un « modèle ontologique ». Selon ce modèle, le concret possède une priorité sur à l’abstrait qui (...) est fondé en lui. Dans la VIème Recherche, en revanche, Husserl s’oriente principalement sur un « modèle gnoséologique » qui voit le complexe comme fondé sur ce qui est relativement simple, étant donné que les expériences d’ordre supérieur (telles les perceptions de types d’objets plus complexes) sont « fondées sur » des expériences plus simples, bien qu’elles ne puissent pas y être réduites. L’exemple principal ici est celui des intuitions catégoriales : fondées sur les intuitions sensibles, elles n’y sont pas réductibles. Mais cette distinction entre deux sens différents du terme de « fondation » peut également nous aider à mieux comprendre de nombreuses thèses husserliennes plutôt controversées. Par exemple, elle peut nous permettre de mieux comprendre dans quelle mesure faire l’expérience d’un être humain comme un tout se fonde sur l’expérience d’un corps physique, et cela même si l’étant que nous rencontrons inclut à la fois des aspects corporels et des aspects spirituels – les deux étant vus, d’une manière essentielle, comme des moments de cette unique personne qui fait l’objet de notre expérience. This article is about a coming project concerning a coherentist approach to ethics in school. The project has two main parts; one theoretical and one empirical. The former focuses on philosophical problems and issues concerning coherentism as a metaethical position in general, and particularly when applied to the field of value education, and the latter aims to study some consequences of a coherentist approach to the study of discussing ethical matters with children.Metaethical coherentism is a position in the discussion about (...) justification of moral judgements. According to coherentism, we build some kind of web in which different moral judgements are connected by some justification‐relation or the like. Some judgements might be more central than others, but these can be justified by the more particular and peripheral ones, and vice versa. Coherentism differs from foundationalism, according to which there are some foundational judgements that are not justified by any other judgements. The rest of our judgements are justified if they are justified by this foundation. We wish to study what benefits a coherentist approach might have in the study of ethical discussions in school. In Sweden, the educational system has as one of its main purposes to mediate a "value foundation" based on "Christian ethical tradition and western humanism" to the pupils. Suppose now that you have a foundationalist approach to ethical discussion in schools, as many seem to have had historically, and that some pupil expresses the judgement that some of his classmates have a lower value than him, due to the colour of their skin. This judgement conflicts with the judgement that the colour of ones skin does not have any bearing of ones value, included in the value foundation of the school. According to a foundationalist, we here have a conflict between foundational values, or so we can suppose. In this case, there is nothing obvious to do to resolve this conflict, because the foundational values cannot be justified; it is supposed that we simply realise the correctness of them by our moral intuition, or the like. A coherentist, on the other side, could point to how these two different judgements gain different amount of justification from other judgements, and thereby hopefully find consensus, and hence dissolve the conflict.Coherentism is not theoretically unproblematic, though. One problem is how to understand the justification‐relation. What does it mean that two propositions justify each other? Philosophers have discussed several different proposals. We give a new proposal, based on some of Arne Naess' theories. With regard to methods for ethical discussion in relation to a coherentistic approach, it seems as a "philosophy with children" approach will seem as a natural choice. (shrink)

The recent investigations into knowledge and its elements viz facts, skills and objects have become prominent in various subfields of philosophy and other areas like linguistics, cognitive science, neuroscience and artificial intelligence. These investigations have been mainly on understanding the relation between the intentionality and its referential entities to know how they enrich knowledge with their existence. This article starts with an exploration of the fundamental aspects of judgemental sense from the knowledge origins perspective. To explain the consequences of this, (...) I start with reconstructing the notion of categorial intuitions described in Husserl’s sixth Logical Investigations by relating it to ‘knowledge origination’ as an intuitive fulfilment of signifying acts. This offers a relation of perceptual synthesis, operating implicitly among the signifying intentions upon grasping intended objects, in view of language structures such as copulas. This leads to the synthesis of intuitive aspects mainly from the categorial elements for a judgemental sense or thinking and the attitude from the very sphere of perception. The tension between categorial intuitions is understood as foundational acts and founded acts. Husserl’s sixth Logical Investigation describes the notion of passive synthesis, the genesis of categoriality in every realm of sensibility that allows one to formulate the relational role among the ‘act of knowing’ and phenomenological approaches to the judgemental sense. Thus, the investigation focuses on perceptual judgements and categories, which fulfils the judgemental sense of categorial elements and attitude. (shrink)

Is there a circular relationship between trust and ethics? Is it possible to alter their relationship, changing the perception that social actors have of them? How has trust changed in the transition from modernity to post-modernity and how does it change in times of crisis? Starting from the epistemological assumption that progress in the social sciences is determined by the change in the theoretical horizon produced by “a reformulation of metaphysical assumptions” [1] and combining this path with the relational perspective, (...) according to which “not the facts, but the relationship between the facts is what requires analysis” [2], we will examine definitions, meanings, functions and relationships between trust and ethics. Following the theoretical logical method, we will understand that trust and ethical behaviour are particular forms of gift [3] that co-own each other. As such, they are ambivalent in nature and their circle can also produce dysfunctional outcomes that depend on the ability of social systems to modify collective perceptions through forms of communication, in the awareness that distrust constitutes an ineliminable and, paradoxically, preparatory element for the restoration of the trust circle. The relational circle between gift, trust, collective ethics and personal morality does not end with distrust, but changes in a contingent way, determining perverse effects: correct behaviour could produce, unintentionally, a disaster; incorrect actions could generate unforeseen positive effects.The perverse effects cannot be defined as exceptional - as is believed in the theory of rational choice - but recurrent because daily practices are marked by an intuitive, emotional and moralistic trust circle that prevails over logical reasoning, as ascertained by both relational theory and behavioural economics. Despite extensive stigma mitigation efforts, infectious disease stigma remains common. So far, little attention has been paid to the moral psychology of stigmatizing practices (i.e. beliefs, attitudes, actions) rather than the experience of being stigmatized. Addressing the moral psychology behind stigmatizing practices seems necessary to explain the persistence of infectious disease stigma and to develop effective mitigation strategies. Our article proposes building on Jonathan Haidt’s moral foundations theory, which states that moral judgements follow from intuitions rather than conscious (...) reasoning. Conceptual analysis was conducted to show how Haidt’s five moral foundations can be connected to (i) moral judgements about stigmatizing practices and (ii) stigmatizing practices themselves. We found that care/harm, fairness/cheating, loyalty/betrayal and sanctity/degradation intuitions can inform moral judgements about stigmatizing practices. Loyalty/betrayal and sanctity/degradation intuitions can sometimes also feed stigmatizing practices. Authority/subversion intuitions can inform moral judgements and stigmatizing practices towards people who disrespect authoritative rules meant to protect public health. Moral dumbfounding and posthoc reasoning might explain the persistence of stigmatizing practices. In conclusion, this study demonstrates the relevance of Haidt’s approach to infectious disease stigma research and mitigation strategies. We hope that this study motivates researchers to further test and assess this approach. (shrink)

The article is devoted to the nature of the topological intuition and disclosure of the specifics of topological heuristics in the framework of philosophical theory of knowledge. As we know, intuition is a one of the support categories of the theory of knowledge, the driving force of scientific research. Great importance is mathematical intuition for the solution of non-standard problems, for which there is no algorithm for such a solution. In such cases, the mathematician addresses the so-called heuristics, (...) built on the basis of guesswork, obtained by intuition. The author substantiates the conclusion that topological intuition significantly specific compared to a traditional mathematical intuitions of Euclidean geometry. Today topology is a rapidly developing field of modern mathematics, integrates nicely with other sections of mathematical science. In its most general form of the topology can be defined as the branch of mathematics that studies the properties of spatial figures, does not change under deformations. The topological intuition is an instrument for development of topology on the basis of typological heuristics, which is the result of applying topological intuition to the objects topology. The author demonstrates in detail providing with the examples the specificity of topological heuristics and establishes its interconnection with Euclidean geometry. The author draws the conclusion about the fundamentality of topological intuition, and that it, perhaps, is primary in relation to traditionally understood mathematical intuition. (shrink)

With our state-guaranteed or internationally recognized human rights, liberalism is rather a common basis of political discussion today. John Rawls’s theory of justice, which set a framework for liberal theory of justice in the last decades of the twentieth century, is notably contractarian. Martha Nussbaum, although claiming to be a neo-Aristotelian, argues that her capabilities approach (hereafter CA) can upgrade the liberal theory of justice, particularly that of political liberalism, to deal with unsolved problems of justice, namely, (...) disability, nationality, and species membership. However, this paper argues that her proposal issuccessful only when her CA-based theory proves its affiliation with political liberalism in more detail. As defined by Rawls, political liberalism produces “free-standing” political conceptions and rejects any metaphysical or religious ideas. It halts conceptions of justice that promote conceptions of good derived from particular comprehensive doctrines. I do not believe a mere convergence between CA and contractarianism is sufficient enough to secure the rational acceptability of her CA-based theory. I suggest that if she wishes to maintain her CA-based theory’s being politically liberal, she either has to prove more of the public, in particular the global public, acceptability of her intuitive ideas of human dignity without relying on her intuitions or alter the meaning of political liberalism itself so that it allows a room for some sort of comprehensive doctrine. Value and reasons for action are often cited by rationalists and moral realists as providing a desire-independent foundation for normativity. Those maintaining instead that normativity is dependent upon motivation often deny that anything called "value" or "reasons" exists. According to the interest-relational theory, something has value relative to some perspective of desire just in case it satisfies those desires, and a consideration is a reason for some action just in case it indicates that something of value will be accomplished (...) by that action. Value judgements therefore describe real properties of objects and actions, but have no normative significance independent of desires. ;It is argued that only the interest-relational theory accounts for the practical significance of value and reasons. Against the Kantian hypothesis of prescriptive rational norms, I attack the alleged instrumental norm or hypothetical imperative, showing that the normative force for taking the means to our ends is explicable in terms of our desire for the end, and not as a command of reason. This analysis also provides a solution to the puzzle concerning the connection between value judgement and motivation. While it is possible to hold value judgements without motivation, the connection is more than accidental. This is because value judgements are usually but not always made from the perspective of desires that actually motivate the speaker. In the normal case judgement entails motivation. But often we conversationally borrow external perspectives of desire, and subsequent judgements do not entail motivation. ;This analysis drives a critique of a common practice as a misuse of normative language. The "absolutist" attempts to use and, as philosopher, analyze normative language in such a way as to justify the imposition of certain interests over others. But these uses and analyses are incoherent---in denying relativity to particular desires they conflict with the actual meaning of these utterances, which is always indexed to some particular set of desires. The book is multidisciplinary and empirically informed. It is organized around three “groundbreaking intuitions” of emotion theory—(1) expression, (2) subjectivity, and (3) action. Each (...) section corresponds to a different thinker—Charles Darwin, William James, and John Dewey, respectively—and each section concludes with a discussion of relevant debates. This book is outstanding. It is clearly written, well organized, and impressive in its scope. In what follows, I outline key ideas and raise questions generated by each section, then conclude with general reflections on the text.Campeggiani begins with the “scandal” of emotion research: There is no agreement about what an emotion is. In part, this lack of consensus is due to the imprecise ways we employ concepts like feelings, emotions, affect, and passions in ordinary discourse. In part, it is due to empirical difficulties. For example, Campeggiani describes how implicit assumptions and a forced-choice format compromised an experiment about expression universality.Additionally, Campeggiani points out that the category “emotions” has an internal structure that lacks clear-cut boundaries. There are paradigmatic examples of emotions, such as fear and anger, but there are also ambiguous phenomena, such as respect and modesty, which we may or may not recognize as such. Throughout the text, Campeggiani introduces and evaluates numerous accounts of emotions, drawing our attention to the strengths, limitations, and empirical adequacy of each.Part 1 begins with Charles Darwin’s contributions to emotion theory—an emphasis on the biological origins of emotions and a focus on expression. This section examines emotions in connection to adaptive fitness, exploring phenomena such as blushing when we are ashamed and the biological bases of emotions. A highlight of this section is an exploration of the social or communicative character of the emotions, which Darwin described as “only a secondary effect” of expression. Campeggiani examines emotional contagion and imitation, as well as the [End Page 141] phenomenon of feeling more pain when we express pain on our faces. There is also a rich discussion about constructionism as an alternative to basic emotions theory.Part 2 opens with William James on subjective experience. Campeggiani describes the limitations of James’s position—of understanding emotions to be reducible to feelings. For starters, this position is not empirically well supported. Campeggiani cites Walter Cannon’s observation that “many of the autonomic changes that are symptomatic of a given emotion can also occur in its absence.” Additionally, James fails to “properly flesh out the link between emotions and evaluations.” Campeggiani then describes the cognitive turn in emotion theory that emerged in response to the lack of attention paid to evaluation. Cognitive accounts of emotion deemphasize the bodily dimensions of emotional experiences in favor of the intentional properties, or “aboutness,” of emotions. Emotions see things as things.From my vantage, this was the best part of the book. Campeggiani highlights Damasio’s point that decision-making depends on having a “correct affective perception of the values at stake in a given situation.” For instance, feeling outsized or misdirected fear may undermine our decision-making. Campeggiani also introduces debates about whether emotions are appraisals, and whether emotions entail judgments or make judgments more likely. In the introduction, she mentions that “decision-making processes are always and inevitably underpinned by emotions, for good and for ill.” We see what she means in this section. Emotions participate in reason, impede reason, and have cognitive content themselves.That emotions involve or participate in our judgments raises two kinds of concerns—epistemic and normative. The epistemic worry is that inaccurate appraisals may undermine our understanding of the world. This is especially worrisome for the class of emotions Campeggiani calls “recalcitrant,” or closed off to other mental states, and for the emotions she says are “heavily influenced by our needs and goals.” Emotions are imperfectly truth-tracking, as was made clear earlier, in part 1, regarding their adaptive nature. The aim of this paper is to clarify the role of category theory in the foundations of mathematics. There is a good deal of confusion surrounding this issue. A standard philosophical strategy in the face of a situation of this kind is to draw various distinctions and in this way show that the confusion rests on divergent conceptions of what the foundations of mathematics ought to be. This is the strategy adopted in the present paper. It is (...) divided into 5 sections. We first show that already in the set theoretical framework, there are different dimensions to the expression foundations of. We then explore these dimensions more thoroughly. After a very short discussion of the links between these dimensions, we move to some of the arguments presented for and against category theory in the foundational landscape.
