Artificial Intelligence and algorithms are increasingly able to replace human workers in cognitively sophisticated tasks, including ones related to justice. Many governments and international organizations are discussing policies related to the application of algorithmic judges in courts. In this paper, we investigate the public perceptions of algorithmic judges. Across two experiments (N = 1,822), and an internal meta-analysis (N = 3,039), our results show that even though court users acknowledge several advantages of algorithms (i.e., cost and speed), they trust human (...) judges more and have greater intentions to go to the court when a human (vs. an algorithmic) judge adjudicates. Additionally, we demonstrate that the extent that individuals trust algorithmic and human judges depends on the nature of the case: trust for algorithmic judges is especially low when legal cases involve emotional complexities (vs. technically complex or uncomplicated cases). This anthology of essays on the work of David Kaplan, a leading contemporary philosopher of language, sprang from a conference, "Themes from Kaplan," organized by the Center for the Study of Language and Information at Stanford University.

Since the 1950s, Terence Penelhum has been a leading contributor to studies on the thought of David Hume. In this collection, he presents a selection of the best of his essays on Hume. Most of the essays are quite recent and three are previously unpublished.

Representing Stephen Davies's best shorter writings, these essays outline developments within the philosophy of music over the last two decades, and summarize the state of play at the beginning of a new century. Including two new and previously unpublished pieces, they address both perennial questions and contemporary controversies, such as that over the 'authentic performance' movement, and the impact of modern technology on the presentation and reception of musical works. This new book takes an innovative and novel approach to the study of jurisprudence. Drawing together a range of specialists, making original contributions, it provides a summary, analysis, and critique of basic themes in, and major contributions to, the study of jurisprudence. The book explores issues and ideas in jurisprudence in a way that integrates them with legal study more broadly, avoiding the tendency in recent years for the subject to become overly inward-looking, specialist and technical, leaving students and the (...) subject adrift. It picks up mid-range concepts such as rights, sovereignty, and adjudication and charts their interrelation and uses in law and legal theory. The approach taken to the subject is an interdisciplinary one, and involves making linkages with contemporary issues in political and social theory, such as the changing role of the state, forms of dispute resolution and the courts. It also addresses topics not normally covered, or covered only indirectly in other jurisprudence textbooks, such as globalisation and legal culture. Australia and New Zealand boast an active community of scholars working in the field of history, philosophy and social studies of science. Australasian Studies in History and Philosophy of Science aims to provide a distinctive publication outlet for their work. Each volume comprises a group of thematically-connected essays edited by scholars based in Australia or New Zealand with special expertise in that particular area. In each volume, a majority ofthe contributors are from Australia or New Zealand. Contributions from elsewhere are (...) by no means ruled out, however, and are actively encouraged wherever appropriate to the balance of the volume in question. The main theme of Nietzsche’s first published work, The Birth of Tragedy, is that the affirmation of life requires ‘illusion’ which allows us to cope with the ‘insight into the horrible truth’ of our condition. This article argues that Nietzsche held the same position in his later works: that illusion is a necessary to affirm life. The discussion is organized as follows. Section 1 sets out the core thesis of BT vis-à-vis the relationship between affirmation and illusion. Section 2 examines (...) the role of illusion in one of Nietzsche’s litmus tests of affirmation found in The Gay Science of 1882, ‘amor fati’—that is, the ability ‘to see as beautiful what is necessary in things’. Sections 3, 4, and 5 consider Nietzsche’s understanding of ‘self-creation’ and how, through the employment of ‘distance’ and ‘pretence’, it engenders an affirmation of existence. Christopher Hookway presents a series of studies of themes from the work of the great American philosopher and pragmatist, Charles S. Peirce (1839-1913). These themes center on the question of how we are to investigate the world rationally. Hookway shows how Peirce's ideas about this continue to play an important role in contemporary philosophy.

Franz Brentano’s impact on the philosophy of his time and on 20th-century philosophy is considerable. The “sharp dialectician” (Freud) and “genial master” (Husserl) influenced philosophers of various allegiances, being acknowledged not only as the “grandfather of phenomenology” (Ryle) but also as an analytic philosopher “in the best sense of this term” (Chisholm). The fourteen new essays gathered together in this volume give an insight in three core issues of Brentano’s philosophy: consciousness (sect.1), intentionality (sect. 2) and ontology and metaphysics (sect. (...) 3). Two further sections of the volume deal with the posterity of his philoso¬phy: in section 4, the legacy of his account of sense perception and feeling is discussed, while the history of Brentano’s unpublished manuscripts is discussed in section 5. This section also presents an edition of a manuscript from 1899 on relations, along with the letters from Brentano to Marty which discuss this manuscript. Philosophy has always been concerned with mental health and mental disorder, and many prominent historical figures have held views that have drawn attention to these issues. In recent years, however, there has been a surge of interest in philosophical issues surrounding psychiatry. As a result, the philosophy of psychiatry has emerged as a distinct, well-established field of inquiry.

The thirty chapters work through various fundamental metaphysical issues, sometimes focusing more on scholastic thought, sometimes on the seventeenth century.

This volume is a collective exploration of major themes in the work of Crispin Wright, one of today's leading philosophers. This paper examines a dilemma within the Confucian tradition wherein one is forced to choose between upholding moral virtue and preserving one's own life. The mainstream view valorises and exalts the act of sacrificing one's life in order to uphold moral virtue. There are many supporters of this view, spanning across different periods, including but not limited to Confucius, Mencius, the Cheng brothers, Zhu Xi, and so on. There is, however, an opposing voice within the Confucian tradition. Wang Gen, a (...) Neo-Confucian thinker and founder of the Taizhou School of thought, opposes the mainstream position by arguing for the primacy of life and against the glorification of these acts of sacrifice. This paper has two aims. The first aim is to trace the development of the mainstream view within the Confucian tradition. This paper introduces the _Global Philosophy_ symposium on Giuseppe Primiero’s book _On the Foundations of Computing_ (2020). The collection gathers commentaries and responses of the author with the aim of engaging with some open questions in the philosophy of computer science. Firstly, this paper introduces the central themes addressed in Primiero’s book; secondly, it highlights some of the main critiques from commentators in order to, finally, pinpoint some conceptual challenges indicating future directions for the philosophy of computer science.

Following its initial development in the 1920’s and 1930’s, by mid-century the concept of “levels of organization” began to disperse throughout the life science textbook literature. Among other early textbooks that first applied the levels concept, Eugene P. Odum’s usage of the notion in his textbook series Fundamentals of Ecology (and his later series Ecology) stands out due to the marked emphasis placed on the concept as a foundational, erotetically-oriented organizing principle. Willard Van Orman Quine's work revolutionized the fields of epistemology, semantics and ontology. At the heart of his philosophy are several interconnected doctrines: his rejection of conventionalism and of the linguistic doctrine of logical and mathematical truth, his rejection of the analytic/synthetic distinction, his thesis of the indeterminacy of translation and his thesis of the inscrutability of reference. Although the importance of spirituality is increasingly recognized in clinical medicine, spirituality is rarely mentioned in the practice, literature, or training programs of global health. To understand the role of spirituality in global health practice and identify factors that influence and limit its expression, I initiated conversations and informal interviews with more than 300 global health leaders, students, and practitioners during 2010-2014. Four spiritual themes or challenges emerged: compassion at a distance; dichotomous thinking; conspiracy of silence; and compulsion to save (...) the world. Practitioners expressed strong interest in bringing spirituality more fully into global health discourse, which could help the field realize its potential. (shrink)

This chapter will examine the themes of nihilism, pessimism, and optimism as they feature in the thought of the Nigerian philosophers, Innocent Asouzu and Ada Agada. While endorsing Asouzu’s basic optimistic vision of reality, I will, nevertheless, point out the inadequacy of an almost entirely optimistic theory of human existence in accounting for the phenomena of nihilism and pessimism. I will compare Asouzu’s ibuanyidanda philosophy with Agada’s consolation philosophy. I will show that consolation philosophy supplies a broader vision of the (...) world that attempts the reconciliation of the optimistic and pessimistic outlooks. Finally, I will sketch a theory of meaning in life, based on the submissions of ibuanyidanda and consolation philosophies and present this outline as promising much for the development of an African philosophy of life. New York: Oxford University Press, 2003, 283 pp., hardcover. Over the last few decades, there has been a remarkable output of several books and articles on the philosophy of music. Stephen Davies is one of the leading contributors to this growing literature in the Philosophy of Music. This (...) important and thought-provoking volume collects fifteen of Davies's essays on various philosophical issues pertaining to music such as ontology, performance, expression, and appreciation. With the exception of two, all of the essays have been published before. There is not enough space here to do justice to all fifteen essays, and thus I focus on those that strike me as most important and where I disagree with Davies.First a word about the book's relevance to aesthetic education and itspotential for use in aesthetic education. Davies's book strikes me as having immense potential for aesthetic education. I can easily see the various essays as being of great value in educating performers, composers, musicologists, and music lovers about various aspects of performance and appreciation especially. Here is a brief list of questions pertinent to aesthetic education that Davies's work raises and addresses: Why is performance on authentic instruments important? What is involved in understanding musical works? Is technical training necessary to appreciate musical works fully? To what degree can the performer create her own interpretation of a work, and how much does the score constrain her?Now on to the essays themselves. The first part of Davies's volume concerns ontology, and the first essay "John Cage's 4'33": Is it Music?" addresses this very famous musical work. Davies argues that 4'33" is not music but rather a theatrical piece about music because it does not exclude anysounds as being ambient noise, as Davies thinks musical works should do. Davies does not deny, however, that this work is an artwork. He thinks instead that the work is not organized sound, as all music must be, for it does not exclude any sonic events during performance as ambient; even sounds made by the performer of this work, claims Davies, are mistakes and not ambient. Thus neither Cage nor the performer organize (select, appropriate) sounds. Davies also suggests that while Cage wants us to have an aesthetic interest in the sonic properties of 4'33," he failed in his intention for we hear the work instead in musico-historical terms.Contrary to Davies's view, one mustwonder if 4'33" just is a theatrical piece about music, not a musical work as such. Unlike theater and theatrical works which are meant to be both seen and heard, Cage's work is only meant to be heard. Davies's view would seem to neglect this important auditory aspect in claiming that the work is just theater not music. Besides, why must all musical works exclude some soundsas ambient, and why might Cage's [End Page 108] work not be an exception to this? Why couldn't 4'33" be a limiting case of music, at one extreme of a range of musical works? As for Davies's claim that any sounds made by the performer who is supposed to be silent are mistakes not ambient noise, one must wonder if Cage intended instead that sounds made by the performer (such as musical tones or coughs) be bracketed by listeners as not part of the work while sounds made by the audience are part of the work, thus undermining the audience-performer distinction. Moreover, against Davies's claim that Cage intended us to have an aesthetic interest in sonic properties, I submit that Cage was Zen-influenced and not committed to such dualisticaesthetic concepts (such as beautiful vs. ugly) or any concepts for that matter, whether musico-historical or not. Instead, Cage intended us to simplylisten, with an open mind and openears, without adhering rigidly to concepts or hearing 4'33" in musico-historical terms, difficult as that may be. Some Pragmatist Themes in Hegel’s Idealism:Negotiation and Administration in Hegel’sAccount of the Structure and Content ofConceptual NormsRobert B. BrandomThis paper could equally well have been titled ‘Some Idealist Themes in Hegel’sPragmatism’. Both idealism and pragmatism are capacious concepts, encompassingmany distinguishable theses. I will focus on one pragmatist thesis and one ideal-ist thesis (though we will come within sight of some others). The pragmatistthesis (what I will call ‘the semantic pragmatist thesis’) is that the use of conceptsdetermines their content, that is, (...) that concepts can have no content apart from thatconferred on them by their use. The idealist thesis is that the structure and unityof the concept is the same as the structure and unity of the self. The semantic prag-matist thesis is a commonplace of our Wittgensteinean philosophical world. Theidealist thesis is, to say the least, not. I don’t believe there is any serious contem-porary semantic thinker who is pursuing the thought that concepts might best beunderstood by modelling them on selves. Indeed, from the point of view ofcontemporary semantics it is hard to know even what one could mean by such athought: what relatively unproblematic features of selves are supposed to illumi-nate what relatively problematic features of concepts? Why should we think thatunderstanding something about, say, personal identity would help us under-stand issues concerning the identity and individuation of concepts? From acontemporary point of view, the idealist semantic thesis is bound to appearinitially as something between unpromising and crazy.My interpretive claim here will be that the idealist thesis is Hegel’s way of makingthe pragmatist thesis workable, in the context of several other commitments andinsights. My philosophical claim here will be that we actually have a lot to learn fromthis strategy about contemporary semantic issues that we by no means see our wayto the bottom of otherwise. In the space of this essay, I cannot properly justify thefirst claim textually, nor the second argumentatively. I will confine myself of neces-sity to sketching the outlines and motivations for the complex, sophisticated, andinteresting view on the topic I find Hegel putting forward. (shrink)

ABSTRACT:The articles in the special issue ofBusiness Ethics Quarterly, “Normative Business Ethics in a Global Economy: New Directions on Donaldsonian Themes,” were written by a set of outstanding scholars: Margaret M. Blair, Joseph P. Gaspar, Nien-hê Hsieh, Peter L. Jennings, Marietta Peytcheva, Andreas Georg Scherer, Amy J. Sepinwall, Andrew Stark, Danielle E. Warren, and Manuel Velasquez. In this commentary I reply to my colleagues, arranging my reply around the following themes: 1) the corporate moral agent; 2) the idea of a (...) social contract for business; 3) managing ethics within corporations; and 4) values in business. I discuss each in turn. However, I reflect first on my idiosyncratic approach to business ethics. (shrink)

Most of Terence Penelhum’s essays collected in his Themes in Hume are already recognized as classics in Hume scholarship. Bringing them together only reinforces their strengths: clarity and sensitivity in exposition combined with charity and acuity in criticism. Penelhum wrote them over a course of almost fifty years, and we can see in them the evolution in his attitude towards Hume. In the earliest essay — the 1955 ‘Hume on Personal Identity’ — Penelhum offers a quick and local diagnosis of (...) Hume’s errors: he has mistakenly assumed that an object must be unchanging for it to be identical through time. But in the later essays, especially the three new ones, Penelhum recognizes that his earlier local insights must be balanced by a wider reading of Hume. After all, he does not, for example, talk about the self only to say that it is a bundle of perceptions; it is also crucial to his treatment of the passions, especially the indirect, person-oriented passions, and is an essential component in his explanation of sympathy, the ultimate source of our moral judgments. Moreover, as Penelhum notes, seeing the self as constituted out of its perceptions, rather than standing over them so as to judge their legitimacy as guides to action or knowledge, is what allows Hume to attempt a ‘science of man’ — a quasi-Newtonian project of discovering the principles governing the perceptions in the mind-bundle. It has become typical to read Kant and Merleau-Ponty as offering competing approaches to perceptual experience. Kant is interpreted as an ‘intellectualist’ who regards perception as conceptual ‘all the way out’, while Merleau-Ponty is seen as Kant’s challenger, who argues that perception involves non-conceptual, embodied ‘coping’. In this paper, however, I argue that a closer examination of their views of perception, especially with respect to the notion of ‘schematism’, reveals a great deal of historical and philosophical continuity between them. By (...) analyzing Kant’s theory of schematism, the interpretation of it by the Neo-Kantian Pierre Lachièze-Rey, and Merleau-Ponty’s theory of the body schema, we find that aspects of Merleau-Ponty’s theory of perception are better understood as a development of Kant’s theory of perception.
