Celebrating the remarkable career of jurist Harold J. Berman, the essays in this volume demonstrate that Berman's contributions to Russian studies, international trade law, legal history, philosophy of law, and law and religion have firmly established him as part of the tradition of our greatest American jurists.

There are many prominent examples of artists with autism. However, even when confronted with evidence of these accomplished autistic savants, pragmatic aesthetic theories cannot adequately account for the work of these accomplished artists as artists. This article first examines the nature of autism and explores a prominent psychological theory that purports to explain autistic symptoms. This prominent theory, the theory of mind thesis, holds that autistic symptoms are the result of the failure of persons with autism to make certain types (...) of secondorder propositional attitude attributions. Second, the article describes the work of three visual artists with autism. There can be no doubt that these individuals are in fact artists. Third, the article examines pragmatic aesthetic theory and demonstrates why the pragmatic theory fails to adequately account for the accomplishment of autistic artists. The unique psychological deficits that characterize autism present a challenge to pragmatic aesthetic theories in particular. The conclusion is that the pragmatic theory’s inability to accommodate the artist autistic artist is a profound shortcoming. A revision of the pragmatic theory is called for, as is embracing of the development of the special talents of persons with autism. (shrink)

The paper opens by recounting the beginnings of Buddhism in Dawei as preserved in local chronicles and sustained in stupas marking the episodes of the chronicle narrative. The chronicles start with a visit of the Buddha whose arrival triggers a series of events bringing together pre-existing tutelary figures, weiza, a hermit and offspring born of a golden fish, culminating in the establishment of the first Buddhist kingdom circa the eighth to tenth century CE. The enshrinement of sacred hairs gifted by (...) the Buddha also includes patronage by a king of the ‘Suvaṇṇabhūmi’ lineage. Associated with the monks Sona and Uttara from Sri Lanka sent by King Asoka's son Mahinda, ‘Suvaṇṇabhūmi’ literally can refer to the archaeology of Thaton, a walled site in the present day Mon State, or, as is the case here, more widely to the missionary tradition associated with Asoka (Sao Saimong Mengrai 1976). The third story in the establishment of the Buddhist king at Thagara is the longest of the chronicle, the tale of a royal hunter who failed to capture a golden peacock for the queen. The hunter became a hermit living by a pond with a golden fish and as he urinated in the pond, two children were born from the fish. The boy becomes the first Buddhist king of Thagara, 11 km north of Dawei, where artefacts from survey and excavation confirm the chronology of the chronicle, with the closest archaeological parallels found not at the ancient sites of the Mon State but to the first millennium CE Buddhist ‘Pyu’ heritage of Upper Myanmar which is notably absent in the chronicle compilation. This essay explores the viability of theologies of nonviolent peacebuilding through reflection on constructive agents under duress. John Howard Yoder’s messianic theology was once a default model of peacebuilding in Christian ethics, but he mixes eschatologies, with problematic results. This essay extends insights from participant observation in Colombia to suggest that if we relate distinct accounts of messianic and gradual eschatologies without mixing them, we articulate a relationship between church and state that is fruitful for theological peacebuilding. In this paper, I plan to show that the use of a specific population concept—Millstein’s Causal Interactionist Population Concept (CIPC)—has interesting and counter-intuitive ramifications for discussions of the reality of biological race in human beings. These peculiar ramifications apply to human beings writ large and to individuals. While this in and of itself may not be problematic, I plan to show that the ramifications that follow from applying Millstein’s CIPC to human beings complicates specific biological racial realist accounts—naïve or otherwise. I conclude with the notion that even if biological races do exist—by fulfilling all of the criteria needed for Millstein’s population concept (which, given particular worries raised by Gannett (Synthese 177:363–385, 2010), and Winther and Kaplan (Theoria 60:54–80, 2013) may not)—the lower-bound limit for the scope of biological racial realism is at the level of populations, and as such they cannot say anything about whether or not individual organisms themselves have races. Philosophical accounts of the nature of belief, at least in the western tradition, are framed in large part by two ideas. One is that believing is a form of representing. The other is that a belief plays a causal role when a person acts on it. The standard picture of belief as a mental entity with representational properties and causal powers merges these two ideas. We are to think of beliefs as things that are true or false and that interact (...) with desires, intentions, and emotions to bring about rational action. Both ideas, I think, are ill-founded. One effect of abandoning them is a further blurring of the distinction between what is inside and what is outside our minds. Another is a shift towards a less mentalistic picture of the roots of rational action. (shrink)

Infallibilism is the view that a belief cannot be at once warranted and false. In this essay we assess three nonpartisan arguments for infallibilism, arguments that do not depend on a prior commitment to some substantive theory of warrant. Three premises, one from each argument, are most significant: if a belief can be at once warranted and false, then the Gettier Problem cannot be solved; if a belief can be at once warranted and false, then its warrant can be transferred (...) to an accidentally true belief; if a belief can be at once warranted and false, then it can be warranted and accidentally true. We argue that each of these is either false or no more plausible than its denial. Along the way, we offer a solution to the Gettier Problem that is compatible with fallibilism. (shrink)

In this essay, I draw out some implications of a position called “Wittgensteinian Quasi-Fideism” for the theory and practice of interreligious communication. After setting out the main tenets of that position, I articulate what its theoretical and practical implications in this area would be if it were true. I thereby sketch a new, Wittgensteinian model of interreligious communication, concluding with a number of suggestions as to some points of focus for further work in this area.

This paper examines the debate that has arisen in connection with J. L. Schellenberg's work on divine hiddenness. It singles out as especially deserving of attention Paul Moser's proposal that the debate distinguish more clearly between classical theism and Hebraic theisms. This worthwhile proposal, I argue, will be unlikely to exert its full potential influence upon the debate unless certain features of Christian incarnation belief are recognized and addressed in connection with it.

The paper presents a realist account of the epistemic objectivity of science. Epistemic objectivity is distinguished from ontological objectivity and the objectivity of truth. As background, T.S. Kuhn’s idea that scientific theory-choice is based on shared scientific values with a role for both objective and subjective factors is discussed. Kuhn’s values are epistemologically ungrounded, hence provide a minimal sense of objectivity. A robust account of epistemic objectivity on which methodological norms are reliable means of arriving at the truth is presented. (...) The problem remains that deliberative judgement is required to determine the relevance and relative significance of a range of methodological norms. Published in 1982 by CUP (pb. 2009) it discusses the forms of materialism then current, including Davidson, early Rorty, but concentrating on Smart and Armstrong, and arguing that central state materialism fails to give a better 'occurrent' account of conscious states than does behaviourism/functionalism, as Armstrong claims. The book starts with a version of the 'knowledge argument' and ends with a chapter claiming that our conception of matter/the physical is more problematic than our conception of mind.

Ineffability—that which cannot be explained in words—lies at the heart of the Christian mystical tradition. It has also been part of every discussion of religious experience since the early twentieth century. Despite this centrality, ineffability is a concept that has largely been ignored by philosophers of religion. In this book, Bennett-Hunter builds on the recent work of David E. In this chapter I defend a methodological view about how we should conduct substantive ethical inquiries in the fields of normative and practical ethics. I maintain that the direct plausibility and implausibility of general ethical principles – once fully clarified and understood – should be foundational in our substantive ethical reasoning. I argue that, in order to expose our ethical intuitions about particular cases to maximal critical scrutiny, we must determine whether they can be justified by directly plausible principles. To (...) expose apparently plausible principles to maximal critical scrutiny, we must determine whether their direct plausibility can survive careful clarification of what they are really saying. This means that intuitions about cases are useful only in (a) suggesting principles that must stand on their own two feet, and (b) illustrating or otherwise helping us clarify what a principle is really saying. We should not reject principles that seem most directly plausible after we have fully clarified their content simply because they conflict with our intuitions about cases, because to do so is to side with uncritical prejudices over the teachings of critical scrutiny. Some rules seem more important than others. The moral rule to keep promises seems more important than the aesthetic rule not to wear brown with black or the pool rule not to scratch on the eight ball. A worrying number of metaethicists are increasingly tempted to explain this difference by appealing to something they call “authoritative normativity” – it’s because moral rules are “authoritatively normatively” that they are especially important. The authors of this chapter argue for three claims concerning “authoritative (...) normativity”: (1) that motivation for it originates in a parochial conception of “normative flavours”; (2) that arguments against alternative ways of explaining e.g., morality’s importance are overblown; and (3) that there are strong reasons against theorizing in terms of “authoritative normativity”. The overarching aim is not to show that “authoritative normativity” is incoherent or entirely unmotivated. Rather, it is to discuss some of “authoritative normativity’s” deeper commitments to correct the impression that is it largely benign or that it is entailed by familiar and popular “metanormative” positions. Authoritative normativity, it seems to us, is a solution in search of a problem. (shrink)

In this major reinterpretation, Howard Caygill argues that all of Benjamin's work is characterized by its focus on a concept of experience derived from Kant but applied by Benjamin to objects as diverse as urban experience, visual art, literature and philosophy. The book analyzes the development of Benjamin's concept of experience in his early writings showing that it emerges from an engagement with visual experience, and in particular the experience of colour. By representing Benjamin as primarily a thinker of (...) the visual field, Caygill is able to bring forward previously neglected texts on inscription and the visual field and to cast many of his more familiar texts, for instance the Work of Art in an Age of Mechanical Reproduction in a new light. Merging Maurice Merleau-Ponty's phenomenology of perception with Gilles Deleuze's image-philosophy, Vaughan applies a rich theoretical framework to a comparative analysis of Jean-Luc Godard's films, which critique the audio-visual illusion of empirical observation (objectivity), and the cinema of Alain Resnais, in which the sound-image generates innovative portrayals of individual experience (subjectivity). Both filmmakers radically upend conventional film practices and challenge philosophical traditions to alter our (...) understanding of the self, the world, and the relationship between the two. Films discussed in detail include Godard's _Vivre sa vie_ (1962), _Contempt_ (1963), and _2 or 3 Things I Know About Her_ (1967); and Resnais's _Hiroshima, mon amour_ (1959), _Last Year at Marienbad_ (1961), and _The War Is Over_ (1966). Situating the formative works of these filmmakers within a broader philosophical context, Vaughan pioneers a phenomenological film semiotics linking two disparate methodologies to the mirrored achievements of two seemingly irreconcilable artists. In this paper, I try to make sense of the idea that true knowledge attributions characterize something that is more valuable than true belief and that survives even if, as Contextualism implies, contextual changes make it no longer identifiable by a knowledge attribution. I begin by sketching a familiar, pragmatic picture of assertion that helps us to understand and predict how the words “S knows that P” can be used to draw different epistemic distinctions in different contexts. I then argue (...) that the examples provided by Cohen and DeRose meant to illustrate Contextualism fail to do so, and I construct an example that does. I conclude by considering the response that an objective assessment of skepticism depends, not on what we might use sentences of the form “S knows that P” to say, but on what such sentences themselves say—on their literal, context-invariant meanings. I argue that there is little reason to believe that our words have such context-invariant meanings, and I suggest that the pragmatic picture of assertion can secure a rich enough conception of objectivity to address the skeptic. This chapter aims to bring to the fore some of the ontological presuppositions that undergird the concepts of race and racism as they are used in public health. Included are discussions of differing accounts for race in public health, the ways in which racism is understood to be a public health issue, and where future research in public health, as it relates to the concepts of race and racism, is headed.

The paper concentrates on two questions: first, the problem of how to introduce students to philosophical argument in a contextualised and pluralist manner; and, second, the question of what kind of texts such a pedagogy requires at its disposal. The two questions are of course intimately related, as the dominance of the single-aim present-centred approach brings with it a highly selective publication of the archive, in editions typically suited to the aims of rational reconstruction rather than historical investigation.

Though largely neglected by philosophers, the concept of ineffability is integral to the Christian mystical tradition, and has been part of almost every philosophical discussion of religious experience since the early twentieth century. After a brief introduction, this article surveys the most important discussions of divine ineffability, observing that the literature presents two mutually reinforcing obstacles to a coherent account of the concept, creating the impression that philosophical reflection on the subject had reached an impasse. The article goes on to (...) survey some more recent work, which draws on the conceptual resources of existential phenomenology, pragmatism, and the later Wittgenstein. It shows that this work has made possible a new philosophical account of divine ineffability that surmounts the obstacles, overcomes the impasse and makes divine ineffability, once again, a live option in philosophy of religion. The article concludes with some brief remarks on how this alternative approach reflects recent trends in the discipline as a whole and has the potential to make a valuable contribution to live research questions in epistemology of religion. In this new lexical survey of Kant's works, Howard Caygill presents Kantian concepts and terminology in terms that will introduce and clarify his ideas for students and general readers alike.

Presently, there is a movement in the UK research governance framework towards what is referred to as proportional ethical review. Proportional ethical review is the notion that the level of ethical review and scrutiny given to a research project ought to reflect the level of ethical risk represented by that project. Relatively innocuous research should receive relatively minimal review and relatively risky research should receive intense scrutiny. Although conceptually attractive, the notion of proportional review depends on the possibility of effectively (...) identifying the risks and ethical issues posed by an application with some process other than a full review by a properly constituted research ethics committee. In this paper, it is argued that this cannot be achieved and that the only appropriate means of identifying risks and ethical issues is consideration by a full committee. This implies that the suggested changes to the National Health Service research ethics system presently being consulted on should be strenuously resisted. (shrink)

The aim of this paper is to document Laudan's rejection of the appeal to intuition in the context of his development of normative naturalism. At one point in the development of his methodological thinking, Laudan appealed to pre-analytic intuitions, which might be employed to identify episodes in the history of science against which theories of scientific methodology are to be tested. However, Laudan came to reject this appeal to intuitions, and rejected this entire approach to the evaluation of a theory (...) of method.
