Le crime de viol conjugal, très récemment incriminé par le droit français, n’existe pas sous l’Ancien Régime. La sexualité conjugale est définie par le droit canon et séculier comme un sacrement dont la validité repose sur le principe de l’échange d’un consentement libre. La consommation nuptiale vient confirmer ce consentement initial et ratifie le mariage mais elle impose également aux époux le devoir conjugal. Ainsi, le consentement sexuel inaugural prévaut pour l’ensemble de la vie maritale, empêchant en théorie toute évocation (...) de viol conjugal. L’absence d’incrimination spécifique des violences sexuelles entre époux n’empêche pourtant pas leur poursuite judiciaire par des voies détournées. Par la mobilisation d’un corpus d’affaires matrimoniales variées entre 1600 et 1750 (requêtes de séparation d’habitation, de nullité de mariage pour impuissance sexuelle ou de mariage forcé), cette enquête permet d’accéder à de rares témoignages et expériences féminines de ces violences, de mieux comprendre ce qui était considéré comme violent dans la sexualité conjugale et de réfléchir à ce que ces comportements et leur répression disent de l’ordre de genre patriarcal. Pour Descartes comme pour Spinoza la finitude de notre entendement rend impossible l'adéquation de la connaissance. À la connaissance adéquate, Descartes substitue la connaissance complète : certaine, mais non-absolue, vérifiée, mais seulement provisoire. La mise au (...) jour de cette première origine cartésienne de la théorie spinoziste de l'idée adéquate conduit l'auteur à l'hypothèse suivante : cette théorie accomplirait au sein de la métaphysique rationnelle développée dans l'Éthique la doctrine de la révélation et de la grâce présente dans la pensée théologique chrétienne. David Lewis [1988; 1996] canvases an anti-Humean thesis about mental states: that the rational agent desires something to the extent that he or she believes it to be good. Lewis offers and refutes a decision-theoretic formulation of it, the 'Desire-as-Belief Thesis'. Other authors have since added further negative results in the spirit of Lewis's. We explore ways of being anti-Humean that evade all these negative results. We begin by providing background on evidential decision theory and on Lewis's negative results. We (...) then introduce what we call the indexicality loophole: if the goodness of a proposition is indexical, partly a function of an agent's mental state, then the negative results have no purchase. Thus we propose a variant of Desire-as-Belief that exploits this loophole. We argue that a number of meta-ethical positions are committed to just such indexicality. Indeed, we show that with one central sort of evaluative belief--the belief that an option is right--the indexicality loophole can be exploited in various interesting ways. Moreover, on some accounts, 'good' is indexical in the same way. Thus, it seems that the anti-Humean can dodge the negative results. (shrink)

In 2016, Colin Kaepernick, a quarterback for the San Francisco 49ers, remained seated during the national anthem in order to protest racial injustice and police brutality against African-Americans. After consulting with National Football League and military veteran Nate Boyer, Kaepernick switched to taking a knee during the anthem for the remainder of the season. Several NFL players and other professional athletes subsequently adopted this gesture. This article brings together complementary Confucian and phenomenological analyses to elucidate the significance of Kaepernick’s gesture, (...) and in the process provide a phenomenological characterization of the connection between the Confucian notions of sagehood and ritual. Kaepernick’s gesture subverts the anthem ritual from within while simultaneously remaining faithful to the ideals it is meant to express. People can look at non-conforming behaviour in two ways: either the person is acting immorally or the moral theory that condemns the behaviour is mistaken. To choose the former is to reflect a confidence in the existing moral theory, while choosing the latter is evidence that moral theory for that particular behaviour is wrong. This point says a lot about the link between the descriptive and evaluative enterprises of law. The development of basic moral principles, which draws from moral intuition, (...) is a similar process when it comes to developing social practices, which in turn draw from human behaviour. Legal positivism has contributed much to clarifying the kind of social facts that characterize legal systems, specifically the kind of normative claims that legal systems typically make. Legal positivism provides much of the descriptive front. The first part outlines Marx’s concept of alienation because of the central role that the fourth kind of alienation plays in Dyer-Witheford’s original conception of biocommunism. The second part briefly elaborates on the discussion of species in the Kyoto School. This volume presents the long-awaited edition of the Cave 4 manuscripts of Serekh Ha-Yahad or The Rule of the Community, in which the Essenes detailed the guidelines for membership in their community. Also known as the Manual of Discipline, a complete scroll was found in Cave 1 at Qumran and this edition illuminates the textual and redactional history of Dead Sea literature. The document is extremely important for understanding the nature, practice, and ideology of the Qumran covenanters.

Plato’s Symposium contains two accounts of eros which explicitly aim to reach a telos. The first is the technocratic account of the doctor Eryximachus, who seeks an exhaustive account of eros, common to all things with a physical nature. For him medical techne can create an orderly erotic harmony; while religion is defined as the curing of disorderly eros. Against this Socrates recounts the priestess Diotima finding a telos, not in technical exhaustiveness, but in a dialectical definition of eros in (...) the light of the good. What is common to all human beings is the desire to be in eternal relation to the good. All technai are forms of poiesis, by which things pass from being to not being. The erotic harmony recommended by Eryximachus, no less than the Aristophanes” recommendation of eros as “of a half, or of a whole’, is subject to the question whether “it happens to be good’. A self-harmonisation produced by techne can no more evade the sovereignty of good, than can projects of self-completion with a beloved in our likeness. (shrink)

In this paper, I use two films—Les Statues MeurrentAussi directed by Resnais and Marker and Sans Soleil as representatives of Left Bank cinema to show how they construct experiences of time and memory using various modernist strategies. Key to this is the use of a mental journey genre in modernist cinema and the construction of a facial dispositif which leads to a perceptual experiencing of inner states. Les Statues MeurrentAussi is a key film in the history of French cinema as (...) it highlights Alain Resnais’ and Chris Marker’s early commitment towards a politically avant-garde filmmaking style. The film was banned for many decades because it was highly critical of France’s colonial interests. The film is also a proof to the less emphasised collaboration between two pioneering directors and especially in their use of the essay film genre. Sans Soleil on the other hand is considered as a philosophical masterpiece because of its meditations on time and memory. In taking these two films, I hope not only to demonstrate cinema’s capability to generate affective spatio-temporal states but also to highlight a piece of film history which is often misappropriated under the tag of the French New Wave. It not only examines the problems of corruption in Nigeria and the implications of this for national security, but also, discusses the role of an ethical idea of citizenship in tackling corruption and reinventing the political community. In Nigeria, corruption has played a key role in aggravating the political and economic crisis besetting the country. Depreciation of (...) human dignity and collapse of infrastructures have ensured the systematic elite misappropriation of state power, the primitive accumulation of capital, ethno-cultural intolerance and political manipulation in the society. This paper searches for a set of norms capable of mitigating needless dehumanization and inequalities, and improving welfare of the majority by evolving public citizens oriented to the common good. This paper examines the problem of nationalism in Nigeria construed as the search for a basis on which the members of the society can claim a sense of belonging, identity and common purpose. There is a problem of the national question here because ethnicity, corruption, disobedience to law and order, disdain for the rule of law and accountability and the disregard for the value of human life have undermined the social order and eventually created an army of the vulnerable and (...) marginal peoples that can be manipulated for parochial ends. The apparent underperformance of the various instruments of the state such as the police, national assembly, appointed ministers, law courts, prisons, etc, due to inefficiency, injustice, under-funding, politicization and social dissatisfaction have threatened the unity of Nigeria and highlighted deficits in the social order that have made Nigeria to appear as a contested construct or category. Given the above we seek a philosophical approach to building a social system or social philosophy of national integration. (shrink)

The thesis according to which the meaning of a mathematical sentence is given by its proof was held by both Wittgenstein and the intuitionists, following Heyting and Dummett. In this paper, we clarify the meaning of this thesis for Wittgenstein, showing how his position differs from that of the intuitionists. We show how the thesis originates in his thoughts, from the middle period, about proofs by induction, and we sketch his answers to a number of objections, including the idea that, (...) given the particular meaning he gives to this thesis, he cannot account for mathematical conjectures. We conclude by showing how his views find a favourable echo today in the paradigm of “proposition-as-type” and extensions of the Curry-Howard isomorphism from which this paradigm originates. Dans ce texte, je pars de l’analyse intuitionniste de la vérité mathématique, « A est vrai si et seulement s’il existe une preuve de A » comme cas particulier de l’analyse de la vérité en termes de « vérifacteur », et je montre pourquoi Wittgenstein partageait celle-ci avec les intuitionnistes. Cependant, la notion de preuve à l’oeuvre dans cette analyse est, selon l’intuitionnisme, celle de la « preuve-comme-objet », et je montre par la suite, en interprétant son argument sur le (...) caractère « synoptique » des preuves, que Wittgenstein avait plutôt en tête une conception de la « preuve-comme-trace ».In this paper, I start with the intutionist analysis of mathematical truth, « A is true if and only if there exists a proof of A », as a particular case of the analysis of truth in terms of « truth-makers », and I show why Wittgenstein shared it with the intuitionists. However, the notion of proof at work in this analysis is, according to intuitionism, that of « proof-as-object », and I then show, with an interpretation of his argument on the « surveyability » of proofs, that, instead, Wittgenstein had in mind a notion of « proof-as-trace ».
