Das Embryonenschutzgesetz von 1990 erfasst die neuesten technischen Entwicklungen nicht, ist in manchen Bereichen unstimmig und lückenhaft, setzt die betroffenen Frauen, Paare und Kinder unnötigen gesundheitlichen Risiken aus, erschwert paradoxerweise die Durchsetzung von Kinderrechten und erzeugt Gerechtigkeitsprobleme und Rechtsunsicherheit für die betroffenen Paare und die behandelnden Ärztinnen und Ärzte.Das Embryonenschutzgesetz enthält zudem nur strafrechtliche Verbote. Diese erlauben keine angemessene Reaktion auf die medizinische Entwicklung und den gesellschaftlichen Wandel und werden der Komplexität der (...) Materie nicht gerecht.Diese Probleme müssen gelöst werden. Der Bundesgesetzgeber verfügt seit mehr als 20 Jahren über die Kompetenz zur Regelung der Fortpflanzungsmedizin. Er sollte in der kommenden Legislaturperiode ein umfassendes Fortpflanzungsmedizingesetz schaffen. (shrink)

Through a wide-ranging international collection of papers, this volume provides theoretical and historical insights into the development and application of phenomenological sociology and ethnomethodology and offers detailed examples of research into social phenomena from these standpoints. All the articles in this volume join together to testify to the enormous efficacy and potential of both phenomenological sociology and ethnomethodology.

It now seems technically feasible to culture human embryos beyond the “fourteen‐day limit,” which has the potential to increase scientific understanding of human development and perhaps improve infertility treatments. The fourteen‐day limit was adopted as a compromise but subsequently has been considered an ethical line. Does it remain relevant in light of technological advances permitting embryo maturation beyond it? Should it be changed and, if so, how and why? What justifications would be necessary to expand the limit, particularly given that (...) doing so would violate some people's moral commitments regarding human embryos? Robust stakeholder engagement preceded adoption of the fourteen‐day limit and should arguably be part of efforts to reassess it. Such engagement could also consider the need for enhanced oversight of human embryo research. Objectives:Social isolation is increasing in aging societies and several studies have shown a relation with worse cognition in old age. However, less is known about the association in the oldest-old (85+); the group that is at highest risk for both social isolation and dementia. Methods:Analyses were based on follow-up 5 to 9 of the longitudinal German study on aging, cognition, and dementia in primary care patients (AgeCoDe) and the study on needs, health service use, costs, and health-related quality of life (...) in a large sample of oldest-old primary care patients (AgeQualiDe), a multi-center population-based prospective cohort study. Measurements included the Lubben Social Network Scale (LSNS-6), with a score below 12 indicating social isolation, as well as the Mini-Mental Status Examination (MMSE) as an indicator of cognitive function. Results:Dementia-free study participants (n = 942) were M = 86.4 (SD = 3.0) years old at observation onset, 68.2% were women. One third (32.3%) of them were socially isolated. Adjusted linear hybrid mixed effects models revealed significantly lower cognitive function in individuals with smaller social networks (β = 0.5, 95% CI = 0.3-0.7, p <.001). Moreover, changes in an individual's social network size were significantly associated with cognitive changes over time (β = 0.2, 95% CI = 0.1-0.4, p =.003), indicating worse cognitive function with shrinking social networks. Conclusion:Social isolation is highly prevalent among oldest-old individuals, being a risk factor for decreases in cognitive function. Consequently, it is important to maintain a socially active lifestyle into very old age. Likewise, this calls for effective ways to prevent social isolation. (shrink)

Widowhood is common in old age, can be accompanied by serious health consequences and is often linked to substantial changes in social network. Little is known about the impact of social isolation on the development of depressive symptoms over time taking widowhood into account. We provide results from the follow-up 5 to follow-up 9 from the longitudinal study AgeCoDe and its follow-up study AgeQualiDe. Depression was measured with GDS-15 and social isolation was assessed using the Lubben Social Network Scale (LSNS-6). (...) The group was aligned of married and widowed people in old age and education through entropy balancing. Linear mixed models were used to examine the frequency of occurrence of depressive symptoms for widowed and married elderly people depending on the risk of social isolation. Our study shows that widowhood alone does not lead to an increased occurrence of depressive symptoms. However, "widowed oldest old", who are also at risk of social isolation, have significantly more depressive symptoms than those without risk. In the group of "married oldest old", women have significantly more depressive symptoms than men, but isolated and non-isolated do not differ. Especially for people who have lost a spouse, the social network changes significantly and increases the risk for social isolation. This represents a risk factor for the occurrence of depressive symptoms. (shrink)

The integration of ethics into the day-to-day work of research and innovation is an important but difficult challenge. However, with the Aachen method for identification, classification and risk analysis of innovation-based problems an approach from an engineering perspective is presented that enables the integration of ethical, legal and social implications into the day-to-day work of R&I practitioners. AMICAI appears in particular capable of providing a procedural guidance for R&I practitioners based on a method established in engineering science, breaking down the (...) object of consideration into partial aspects and prioritizing the innovation-based problems in dependence of potential risk. This enables the user to apply AMICAI continuously during all stages of the research and development process and to analyze and choose between certain sociotechnical alternatives. In this way, problems that affect ethical, legal, and social aspects can be understood, reflected and considered in the mostly technically focused R&D process. The paper gives a general guidance about AMICAI by describing principles and assumptions, providing the steps of analysis and application aids, giving an example application, explaining the necessary adjustments of AMICAI compared to the methodical basis of failure mode, effects, and criticality analysis and discussing the advantages and limits. AMICAI’s simple applications can stimulate interdisciplinary cooperation in the R&D process and be a starting point for the development of an “open RRI risk analysis platform” allowing society to evaluate innovation-based problems. In this essay, Heidegger's theses on art, as he develops them in the text "On the Origin of the Work of Art," are reconstructed, interpreted, and critically evalua- ted. In doing so, we pursue a threefold goal. First, his theses on art are put in relation to the main theme of his philosophy: the question of being. Second, the different ways in which Heidegger takes art to be epistemically valuable are dif- ferentiated and reconstructed in detail. There has been considerable progress in investigating collective actions in the last decades. However, the real progress is different from what many scholars take it to be. It lies in the fact that there is by now a wealth of different approaches from a variety of fields. Each approach has carved out fruitful mechanisms for explaining collective action, but is also faced with limitations. Given that situation, we submit that the next step in investigating collective action is to acknowledge the (...) plurality of approaches and bring them into dialogue. With this aim in mind, the present article discusses the strengths and weaknesses of some of the to our mind most relevant approaches to collective action in current debates. We begin with the collective intentionality framework, the team reasoning approach, and social identity theory. Then, we move to ecological social psychology, participatory sense-making, and, through the lenses of those frameworks, dynamical systems theory. Finally, we discuss practice theory. Against this background, we provide a proposal for a synthesis of the successful explanatory mechanisms as they have been carved out by the different research programs. The suggestion is, roughly, to understand collective action as dynamical interaction of a self-organizing system with its environment, shaped by a process of collective sense-making. (shrink)

Australia II became the first foreign yacht to win the America's Cup in 1983. The boat had a revolutionary wing keel and a better underwater hull form. In official documents, Ben Lexcen is credited with the design. He is also listed as the sole inventor of the wing keel in a patent application submitted on February 5, 1982. However, as reported in _New York Times_, _Sydney Morning Herald_, and _Professional Boatbuilder_, the wing keel was in fact designed by engineer Peter (...) van Oossanen at the Netherlands Ship Model Basin in Wageningen, assisted by Dr. Joop Slooff at the National Aerospace Laboratory in Amsterdam. Based on telexes, letters, drawings, and other documents preserved in his personal archive, this paper presents van Oossanen’s account of how the revolutionary wing keel was designed. This is followed by an ethical analysis by Martin Peterson, in which he applies the American NSPE and Dutch KIVI codes of ethics to the information provided by van Oossanen. The NSPE and KIVI codes give conflicting advice about the case, and it is not obvious which document is most relevant. This impasse is resolved by applying a method of applied ethics in which similarity-based reasoning is extended to cases that are not fully similar. The key idea, presented in Peterson’s book _The Ethics of Technology_ (Peterson, The ethics of technology: A geometric analysis of five moral principles, Oxford University Press, 2017), is to use moral paradigm cases as reference points for constructing a “moral map”. En el presente trabajo, utilizaremos el concepto althusseriano de problemática para repensar al estructuralismo. Nuestra pregunta será: ¿cómo comprender al estructuralismo? ¿Cómo indicar sus límites cuando se trató de un conjunto de propuestas teóricas que atravesó disciplinas, que sufrió cruces con diversas teorías y cuyas premisas nunca fueron establecidas con claridad? A partir del concepto de problemática, desarrollado por Althusser fundamentalmente en La revolución teórica de Marx, se nos abrirá la posibilidad de interrogar al conjunto de propuestas teóricas que lo (...) conformaron, no tanto como un canon aplicable a las más diversas materias sino como un espacio teórico atravesado por contradicciones. Así, nos apoyaremos en la noción de problemática porque la consideramos particularmente fértil para pensar un campo teórico más como un conjunto de problemas y preguntas que como un compendio de respuestas a dificultades teóricas claramente delimitadas.Pretendemos destacar las contradicciones que vertebran al estructuralismo porque nos conducirán a plantear que es posible emplazar una distancia en su interior, distancia que mostrará como una de sus variantes aquella que afirma la imposibilidad de pensar una estructura de estructuras final que las totalice a todas. The goal of inquiry in this essay is to ascertain to what extent the Principle of Compositionality – the thesis that the meaning of a complex expression is determined by the meaning of its parts and its mode of composition – can be justifiably imposed as a constraint on semantic theories, and thereby provide information about what meanings are. Apart from the introduction and the concluding chapter the thesis is divided into five chapters addressing different questions pertaining to the overarching (...) goal of inquiry. Chapter Two is an attempt to determine whether the Principle of Compositionality is a trivial principle. It is argued that this is not the case in the context of providing the semantics of natural languages since it is an open question whether the best theories that respect available syntactic and semantic data are compositional. Chapter Three and Chapter Four ask whether there are reasons to think that the Principle of Compositionality is true. It is argued that the three most commonly cited reasons for thinking that correct semantic theories must be compositional – Linguistic Creativity, Productivity and Systematicity – in fact only give us reasons to think that the meaning of complex expressions depend on the meanings of their parts and their modes of composition, but not that the meaning of complex expressions depend ONLY on those factors. Chapter Five asks whether there are any reasons to think that the Principle of Compositionality is false. It is argued that all the phenomena that have been suggested entail non-compositionality are in fact compatible with some versions of compositionality. Even if this conclusion is reached in this chapter, the conclusion of the previous two chapters entails that we are not justified in imposing the Principle of Compositionality as an adequacy constraint on Semantic theories. Chapter Six explores the ways in which information about what meanings are can be derived by imposing constraints on semantic theories. It is argued that the distinction emphasized in Chapter Three and Chapter Four between depending on and depending ONLY on is of critical importance. It is demonstrated that the informative potential of the Principle of Compositionality goes far beyond that of the principle we are in fact justified in imposing on semantic theories. So not only is it the case that we cannot learn anything about meanings from the justified imposition of the Principle of Compositionality – since we cannot justifiably impose it as a constraint on semantic theories – what we could have learned from it had we been justified in imposing it is very different from what we can learn from the principle that we are justified in imposing. According to the principle of Conjunction Closure, if one has justification for believing each of a set of propositions, one has justification for believing their conjunction. The lottery and preface paradoxes can both be seen as posing challenges for Closure, but leave open familiar strategies for preserving the principle. While this is all relatively well-trodden ground, a new Closure-challenging paradox has recently emerged, in two somewhat different forms, due to Backes :3773–3787, 2019a) and Praolini :715–726, 2019). This paradox synthesises elements (...) of the lottery and the preface and is designed to close off the familiar Closure-preserving strategies. By appealing to a normic theory of justification, I will defend Closure in the face of this new paradox. Along the way I will draw more general conclusions about justification, normalcy and defeat, which bear upon what Backes :2877–2895, 2019b) has dubbed the ‘easy defeat’ problem for the normic theory. A physician and spokesman for the French Ideologues, Pierre-JeanGeorges Cabanis (1757-1808) stands at the crossroads of several influential developments in modern culture--Enlightenment optimism about human perfectibility, the clinical method in medicine, and the formation and adaptation of liberal social ideals in the French Revolution. The Journal of Aesthetics and Art Criticism, Volume 78, Issue 1, Page 101-105, Winter 2020.

The first objective of this article is to demonstrate that ethics committee members can learn a great deal from a forensic analysis of two classic psychology studies: Zimbardo’s Stanford Prison Study and Milgram’s Obedience Study. Rather than using hindsight to retrospectively eradicate the harm in these studies, the article uses a prospective minimization of harm technique. Milgram attempted to be ethical by trying to protect his subjects through debriefing and a follow-up survey. He could have done more, however, by carrying (...) out what ethics committees routinely insist on today for those researching sensitive topics. The establishment of counselling supports to identify harm to participants would have minimized additional harm. Were these in place, or in Zimbardo’s case had the Stanford Ethics Committee properly identified Zimbardo’s conflict of interest – he was both a principal investigator and the prison warden – how much harm could have been minimized? The second aim is to examine how some qualitative authors routinely demonize these classic studies. It might appear that there are too few cases of unethical qualitative research to justify such an examination; however, this article identifies a number of recent examples of ethically dubious qualitative research. This would suggest that qualitative research should examine its own ethics before poaching from psychology. (shrink)

The study of Austrian and German modernist literature has a long and venerable history in this country. There have been no attempts yet, however, to reassess German and Austrian literary modernism in light of current discussion of modernity and postmodernity. Addressing a set of historical and theoretical questions central to current reevaluations of modernism, this volume presents American readers with a state-of-the-art account of German modernism studies in the eighties. Essays by Jochen Schulte-Sasse, Russell A. Berman, Peter Uwe Hohendahl, (...) Judith Ryan, Mark Anderson, Klaus R. Scherpe, Biddy Martin, Klaus L. Berghahn and Acbar Abbas, center around German and Austrian literary and philosophical prose of the early twentieth century. texts by well-known authors -Kafka, Rilke, Musil, Doblin, Benjamin, Benn, and Junger - and less well-known ones -Franz Jung, Carl Einstein, Ernst Bloch, Lou Andreas-Salome, are examined. Particular attention is paid to the processes and strategies by which certain experiences of "modern life" are translated into modern aesthetic forms. The unique contribution of this volume is that it combines theory with an attempt to reintroduce an historical and contextual dimension. A de minimis risk is defined as a risk that is so small that it may be legitimately ignored when making a decision. While ignoring small risks is common in our day-to-day decision making, attempts to introduce the notion of a de minimis risk into the framework of decision theory have run up against a series of well-known difficulties. In this paper, I will develop an enriched decision theoretic framework that is capable of overcoming two major obstacles to the modelling (...) of de minimis risk. The key move is to introduce, into decision theory, a non-probabilistic conception of risk known as normic risk. (shrink)

Abstract.I chart the considerable changes in the status and conception of the Lenz-Ising model from 1920 to 1950 in terms of three phases: In the early 1920s, Lenz and Ising introduced the model in the field of ferromagnetism. Based on an exact derivation, Ising concluded that it is incapable of displaying ferromagnetic behavior, a result he erroneously extended to three dimensions. In the next phase, Lenz and Ising’s contemporaries rejected the model as a representation of ferromagnetic materials because of its (...) conflict with the new quantum mechanics. In the third phase, from the early 1930s to the early 1940s, the model was revived as a model of cooperative phenomena. I provide more detail on this history than the earlier accounts of Brush (1967) and Hoddeson, Schubert, Heims, and Baym (1992) and question some of their conclusions. Moreover, my account differs from these in its focus on the development of the model in its capacity as a model. It examines three aspects of this development: (1) the attitudes on the degree of physical realism of the Lenz-Ising model in its representation of physical phenomena; (2) the various reasons for studying and using it; and (3) the effect of the change in its theoretical basis during the transition from the old to the new quantum mechanics. A major theme of my study is that even though the Lenz-Ising model is not fully realistic, it is more useful than more realistic models because of its mathematical tractability. I argue that this point of view, important for the modern conception of the model, is novel and that its emergence, while perhaps not a consequence of its study, is coincident with the third phase of its development. In this paper I respond to Marcello Di Bello’s criticisms of the ‘normic account’ of the criminal standard of proof. In so doing, I further elaborate on what the normic account predicts about certain significant legal categories of evidence, including DNA and fingerprint evidence and eyewitness identifications.

One of the most intriguing claims in Sven Rosenkranz’s Justification as Ignorance is that Timothy Williamson’s celebrated anti-luminosity argument can be resisted when it comes to the condition ~K~KP—the condition that one is in no position to know that one is in no position to know P. In this paper, I critically assess this claim.

Kant was a keen psychological observer and theorist of the forms, mechanisms and sources of self-deception. In this Element, the author discusses the role of rationalizing/Vernünfteln for Kant's moral psychology, normative ethics and philosophical methodology. By drawing on the full breadth of examples of rationalizing Kant discusses, the author shows how rationalizing can extend to general features of morality and corrupt rational agents thoroughly. Furthermore, the author explains the often-overlooked roles common human reason, empirical practical reason and even pure practical (...) reason play for rationalizing. Kant is aware that rationality is a double-edged sword; reason is the source of morality and of our dignity, but it also enables us to seemingly justify moral transgressions to ourselves, and it creates an interest in this justification in the first place. Finally, this Element discusses whether Kant's ethical theory itself can be criticised as a product of rationalizing. (shrink)

Obgleich das von Adorno selbst als opus magnum verstandene Werk unvollendet blieb und nur als posthumes Kompilat erschien, entfaltete es in der zweiten Hälfte des 20. Jahrhundert eine enorme Wirkung, die weit über den Bereich der philosophischen Ästhetik hinausging. Renommierte Autoren und Autorinnen unterschiedlicher Disziplinen nehmen das Jubiläum des erstmaligen Erscheinens der Ästhetischen Theorie zum Anlass, diesen Klassiker aus (...) verschiedenen Perspektiven noch einmal neu in den Blick zu nehmen. Neben Essays zur Relevanz und Aktualität der Ästhetischen Theorie für die philosophische Ästhetik im 21. In a recent paper in this journal Duncan Pritchard responds to an objection to the modal account of risk pressed by Ebert, Smith and Durbach ( 2020 ). In this paper, I expand upon the objection and argue that it still stands. I go on to consider a more general question raised by this exchange – whether risk is ‘objective’, or whether it is something that varies from one perspective to another.

I argue that, alongside the already well-established prohibition against treating persons as mere means, Kant’s Formula of Humanity requires a prohibition against treating persons as mere things. The former captures ethical violations due to someone’s (perceived) instrumental value, e.g. exploitation, the latter captures cases in which I mistreat others because they have no instrumental value to me. These are cases in which I am indifferent and complacent towards persons in need; forms of mistreatment frequently suffered by the world’s poorest. I (...) explain why we need the category of treating others as mere things and what the prohibition against such treatment entails. Prohibitions against treating as mere means and as mere things are both essential for understanding the specific nature and extent of our duties to the world’s poorest. (shrink)

ZusammenfassungIm vorliegenden Artikel wird das von historischer Seite wenig erforschte Ereignis der Magdalenenflut von 1342 unter Einbeziehung administrativer Überlieferung, vor allem aus Urkunden und Rechnungsbüchern, und durch Heranziehung naturwissenschaftlicher Proxydaten, insbesondere aus Baumring-Niederschlagsrekonstruktionen, neu ausgeleuchtet. So gelingt es nicht nur, einen wesentlich differenzierteren Verlauf einer insgesamt zweijährigen Hochwasserkatastrophe mit peaks im Februar und Juli 1342, aber auch im Juli 1343 zu gewinnen, sondern auch mehrmonatige Trockenphasen im März bis Juni 1342 erstmals zu fassen, die den (auch in Schriftquellen nachgewiesenen) Erosionseffekt (...) der Starkregenfälle im Juli 1342 besser erklären als bislang. Dabei wird klar, dass 1342/43 ein multifaktorieller compound event vorliegt, der erst durch die Koinzidenz natürlicher Extremereignisse mit sozio-ökonomischen Faktoren zur Katastrophe führt. Die bewusste Ausweitung des Quellenspektrums lässt beispielsweise erstmals eine überregionale Teuerung bei Lebensmitteln im Nachklang der Flutereignisse feststellen, die aber wesentlich im zufälligen Auftreten des Hochwassers noch vor der Getreideernte begründet liegt. Der Fokus des Beitrags liegt auf infrastrukturellen Anpassungsmaßnahmen, etwa veränderten Brückendesigns (am Bsp. der Balduinbrücke in Koblenz) und großer Wasserbaumaßnahmen (am Beispiel des Donaudurchstichs von Oberalteich), oder normativen Reaktionen wie den Würzburger Polizeisätzen 1342/43 und der Errichtung von Deichbaugemeinschaften am Niederrhein, die zumindest als indirekte Reaktionen auf die Hochwasserereignisse verstanden werden müssen. Diese technisch-normativen Adaptionsvorgänge können einerseits im Luhmann’schen Sinn als Umweltbeobachtungen zweiter Ordnung verstanden werden, andererseits erläutern sie die Bedeutung von natürlichen Extremereignissen als Taktgeber für vormoderne Infrastrukturentwicklung aufgrund ihrer als kritisch erlebten, ungenügenden Ausgestaltung oder gar ihres völligen Fehlens. Nordalpin sehen wir nach 1342/43 im Bereich des Hochwasserschutzes zaghafte Anfänge obrigkeitlicher Daseinsvorsorge jenseits lokaler Zuständigkeiten. (shrink)

The paper presents different approaches to the relationship of life and death among selected authors as a review of their articles within the last volume of the Ethics & Bioethics (in Central Europe) journal. The resource of the review is an article by Peter Singer The challenge of brain death for the sanctity of life ethics. Firstly, I try to analyze the issue when death occurs and when we can talk about death as a phenomenon that each and every living (...) human being must come to terms within the course of their lives. Ethics of social consequences is used to analyze different approaches and states a conclusion defending the principles of humanity and human dignity within the scope of this ethical theory applied to various problem cases. I strive to support the question of the quality of life through the paternalistic approach of physicians influenced by their humane and dignified understanding of their relationship towards the patients. Ethics of social consequences offers many solutions to the discussed issues throughout the reviewed articles. (shrink)

This volume explores the reorganisation of knowledge taking place in the course of Galileo's research process extending over a period of more than thirty years, pursued within a network of exchanges with his contemporaries, and documented by a vast collection of research notes. It has revealed the challenging objects that motivated and shaped Galileo's thinking and closely followed the knowledge reorganization engendered by theses challenges. It has thus turned out, for example, that the problem of reducing the properties of pendulum (...) motion to the laws governing naturally accelerated motion on inclined planes was the mainspring for the formation of Galileo's comprehensive theory of naturally accelerated motion. This is the second in a series of three papers that charts the history of the Lenz–Ising model (commonly called just the Ising model in the physics literature) in considerable detail, from its invention in the early 1920s to its recognition as an important tool in the study of phase transitions by the late 1960s. By focusing on the development in physicists’ perception of the model’s ability to yield physical insight—in contrast to the more technical perspective in previous historical accounts, (...) for example, Brush (Rev Modern Phys 39: 883–893, 1967) and Hoddeson et al. (Out of the Crystal Maze. Chapters from the History of Solid-State Physics. Oxford University Press, New York, pp. 489–616, 1992)—the series aims to cover and explain in depth why this model went from relative obscurity to a prominent position in modern physics, and to examine the consequences of this change. In the present paper, which is self-contained, I deal with the development from the early 1950s to the 1960s and document that this period witnessed a major change in the perception of the model: In the 1950s it was not in the cards that the model was to become a pivotal tool of theoretical physics in the following decade. In fact, I show, based upon recollections and research papers, that many of the physicists in the 1950s interested in understanding phase transitions saw the model as irrelevant for this endeavor because it oversimplifies the nature of the microscopic constituents of the physical systems exhibiting phase transitions. However, one group, Cyril Domb’s in London, held a more positive view during this decade. To bring out the basis for their view, I analyze in detail their motivation and work. In the last part of the paper I document that the model was seen as much more physically relevant in the early 1960s and examine the development that led to this change in perception. I argue that the main factor behind the change was the realization of the surprising and striking agreement between aspects of the model, notably its critical behavior, and empirical features of the physical phenomena. According to act-consequentialism the right action is the one that produces the best results as judged from an impersonal perspective. Some claim that this requirement is unreasonably demanding and therefore consequentialism is unacceptable as a moral theory. The article breaks with dominant trends in discussing this so-called Overdemandingness Objection. Instead of focusing on theoretical responses, it empirically investigates whether there exists a widely shared intuition that consequentialist demands are unreasonable. This discussion takes the form of examining what people think about (...) the normative significance of consequentialist requirements. In two experiments, the article finds that although people are sensitive to consequentialist requirements and, on average, find more extreme demands less reasonable, the level of disagreement with consequentialism falls short of qualifying as a widely shared intuition, even when demands are the highest. The article then ends with a general discussion of possible objections to its methods and its findings. (shrink)

Research is increasingly highlighting the influence of school contexts on school processes and student achievement. This article reviews a range of social justice rationales for taking school contexts into better account, and highlights the challenges contextualisation currently poses for practice and for policy. It notes important constraints on contextualised practice and limited developments in contextualising policy. There is now increasing concern to recognise and understand context in school effectiveness and school improvement research but such research needs to consider school context (...) much more, in order to provide a stronger underpinning for contextualised policy and practice. School composition research is potentially most insightful because it addresses the issue most directly. Nevertheless future large-scale studies in this area need to overcome a number of limitations within the existing literature. (shrink)

A moral requirement R1 is said to be lexically prior to a moral requirement R2 just in case we are morally obliged to uphold R1 at the expense of R2 – no matter how many times R2 must be violated thereby. While lexical priority is a feature of many ethical theories, and arguably a part of common sense morality, attempts to model it within the framework of decision theory have led to a series of problems – a fact which is (...) sometimes spun as a ‘decision theoretic critique’ of lexical priority. In this paper, I develop an enriched decision theoretic framework that is capable of modelling lexical priority while avoiding all extant problems. This will involve introducing several new ingredients into the standard decision theoretic framework, including multidimensional utilities, de minimis risks, and the means to represent two different conceptions of risk.
