Preoperative informed consent is a legal and ethical requirement that ensures patients understand a procedure, its associated risks and benefits, alternative treatment options, and potential complications to make an informed decision about their care. This cross‐sectional study evaluated the informed consent process for major orthopaedic surgeries at a tertiary hospital in Nigeria. A self‐administered questionnaire was used to collect data from 120 adult participants. Results showed that many patients do not read the consent form before signing it, and surgeons do (...) not adequately explain the alternatives to surgery, potential risks, and available anaesthetic options. Higher‐educated patients are more likely to read the consent form. Surgeons performed well in explaining the nature of the condition and prognosis, the procedure's potential benefits, and answering patients' questions. The study emphasises the need to improve the informed consent process to ensure patients understand and can make rational decisions about their healthcare. (shrink)

Construction process stages are argued to be vulnerable to the prevalence of corrupt practices. However, the validity of this argument has not been empirically explored in the extant literature of construction management. Therefore, this study examines the stages of the construction process susceptibility to corruption and its most prominent forms of corrupt activities. A total of forty-four project-related professionals were involved in an expert survey to assess such susceptibilities and the criticality of the identified corrupt activities at each stage. A (...) comparative study of expert views from developing regions against experts from developed regions is conducted. Expert scoring results revealed that three stages are most susceptible, namely: project execution, pre-qualification and tender stages. Such results were confirmed by application of the Mann–Whitney U test statistics tool, showing wide disparities in seven out of eleven identical stages. This study is intended to incite polemic discussions and greater empirical, evidence-based research from scholars in both developed and developing countries. This study adds to the extant literature corruption-related works on the construction process through deeper understanding of the dynamic nature of corrupt practices involved in the stages of the construction process in developing countries. Practically, it intends to offer a veritable plethora of information on the critical stages of the construction process for industry practitioners, policymakers and anti-corruption bodies to careen their attention towards the fight against corruption. L'oeuvre du philosophe Paul Gilbert, jésuite belge professeur de métaphysique depuis vingt-cinq ans à l'Université Grégorienne, est considérable et mérite d'être mieux connue. Après avoir étudié les écrits de saint Anselme (Dire l'ineffable, 1984), Paul Gilbert a questionné la métaphysique classique, sous l'influence de la philosophie réflexive (La Simplicité du principe, 1994). Il a ensuite souligné les chances offertes à la réflexion fondamentale par l'analogie, thème classique mais oublié (La Patience d'être, 1996, et Sapere e sperare, 2003). Plus récemment, il (...) a abordé la question de la violence, ce mal- être si commun (Violence et compassion, 2009). En 1997 déjà, son travail a été récompensé du prix Cardinal Mercier de l'U.C.Louvain-la-Neuve. Durant de nombreuses années, Paul Gilbert a été professeur invité à l'Institut catholique de Paris. A l'occasion de son éméritat dans cette institution, un colloque y a été organisé. Dans leurs communications, S. Bonanni, Ph. Capelle-Dumont, S. D'Agostino, E. Gabellieri, J. de Gramont, 1. Many fields of study have shown that group discussion generally improves reasoning performance for a wide range of tasks. This article shows that most of the population, including specialists, does not expect group discussion to be as beneficial as it is. Six studies asked participants to solve a standard reasoning problem—the Wason selection task—and to estimate the performance of individuals working alone and in groups. We tested samples of U.S., Indian, and Japanese participants, European managers, and psychologists of reasoning. Every (...) sample underestimated the improvement yielded by group discussion. They did so even after they had been explained the correct answer, or after they had had to solve the problem in groups. These mistaken intuitions could prevent individuals from making the best of institutions that rely on group discussion, from collaborative learning and work teams to deliberative assemblies. Despite the proliferation of studies on corporate social responsibility (CSR), there is a lack of consensus and a cardinal methodological base for research on the quality of CSR communication. Over the decades, studies in this space have remained conflicting, unintegrated, and sometimes overlapping. Drawing on semiotics—a linguistic-based theoretical and analytical tool, our article explores an alternative perspective to evaluating the quality and reliability of sustainability reports. Our article advances CSR communication research by introducing a theoretical-cum-methodological perspective which provides unique insights (...) into how to evaluate the quality of CSR communication. Particularly, we illustrate the application of our proposed methodology on selected U.K. FTSE 100 companies. Our two-phased analysis employed the Greimas Canonical Narrative Schema and the Semiotic Square of Veridiction in drawing meanings from selected sustainability/csr reports. In addition, we present a distinctive CSR report quality model capable of guiding policy makers and firms in designing sustainability/csr reporting standards. (shrink)

Emmanuel Lévinas (1906-1995) zählt nicht nur zu den wichtigsten Ethikern im 20. Jahrhundert. Vor allem entwirft er einen anderen Anfang der Ethik, die nicht auf der gesellschaftlichen Ebene oder als grosse Idee und Erzählung entsteht. Ethik entspringt vielmehr in der konkreten Zwischenmenschlichkeit, wenn man vom Anderen in die Verantwortung gerufen wird - und zwar durch die Verletzlichkeit seines nackten Gesichtes wie durch die Anrede. Die ethische Beziehung verdankt sich dabei nicht etwa der Gleichheit, der Nähe oder der Geschwisterlichkeit, sondern (...) der Andersheit des Anderen, seiner Ferne und vor allem seiner Fremdheit, die sich nicht hintergehen lassen. Damit gründet Lévinas die Gesellschaft nicht nur auf die Zwischenmenschlichkeit, sondern auch auf die Pluralität. So wenig wie die Ethik universelle Ansprüche erheben kann, lässt sich Gerechtigkeit als ein allgemeines Prinzip entwerfen. Vielmehr muss sie den Individuen in deren unendlicher Andersheit gerecht werden. In dieser Unendlichkeit blitzt im nackten Gesicht das Antlitz Gottes auf, denkt Lévinas aus der jüdischen Tradition heraus. Das lässt sich auch rein säkular verstehen, dass alle Menschen anders sind. Sie als Gleiche zu behandeln, unterwirft sie totalen politischen Ansprüchen, macht sie zu gehorsamen Untertanen. In Auseinandersetzung mit Sartre entwickelt Lévinas eine individualistische Ethik der Verantwortung, die jeden Menschen betrifft, indem sie aus der Zwischenmenschlichkeit heraus die Mündigkeit konstituiert. So verfolgt der Einzelne nicht primär seine Interessen, sondern übernimmt Verantwortung für den Anderen: Die Wende der Ethik im 20. Jahrhundert - von Sartre, de Beauvoir und Lacan inspiriert, von Derrida und Butler fortgeschrieben, bestehen zudem Parallelen zu Arendt und Foucault. (shrink)

Asimismo, se expone cómo, para Lévinas, la subjetividad y el lenguaje se implican mutuamente para cuestionar la primacía del discurso ontológico e idealizante en la tradición filosófica. Suszko’s problem is the problem of finding the minimal number of truth values needed to semantically characterize a syntactic consequence relation. Suszko proved that every Tarskian consequence relation can be characterized using only two truth values. Malinowski showed that this number can equal three if some of Tarski’s structural constraints are relaxed. By so doing, Malinowski introduced a case of so-called mixed consequence, allowing the notion of a designated value to vary between the premises and the conclusions of an argument. (...) In this article we give a more systematic perspective on Suszko’s problem and on mixed consequence. First, we prove general representation theorems relating structural properties of a consequence relation to their semantic interpretation, uncovering the semantic counterpart of substitution-invariance, and establishing that mixed consequence is fundamentally the semantic counterpart of the structural property of monotonicity. We use those theorems to derive maximum-rank results proved recently in a different setting by French and Ripley, as well as by Blasio, Marcos, and Wansing, for logics with various structural properties. We strengthen these results into exact rank results for nonpermeable logics. We discuss the underlying notion of rank, and the associated reduction proposed independently by Scott and Suszko. As emphasized by Suszko, that reduction fails to preserve compositionality in general, meaning that the resulting semantics is no longer truth-functional. We propose a modification of that notion of reduction, allowing us to prove that over compact logics with what we call regular connectives, rank results are maintained even if we request the preservation of truth-functionality and additional semantic properties. Presupposition, vagueness, and oddness can lead to some sentences failing to have a clear truth value. The homogeneity property of plural predication with definite descriptions may also create truth-value gaps: The books are written in Dutch is true if all relevant books are in Dutch, false if none of them are, and neither true nor false if, say, half of the books are written in Dutch. We study the projection property of homogeneity by deploying methods of general interest to identify (...) truth-value gaps. Method A consists in collecting both truth judgments and, independently, falsity judgments. The second method, employed in experiment series B and C, is based on one-shot ternary judgments: completely true vs. completely false vs. neither. After a calibration of these methods, we use them to demonstrate that homogeneity projects out of negation, the scope of universal sentences and the scope of non-monotonic quantifiers such as exactly two, to some extent. We assess our results in light of different theoretical approaches to homogeneity—approaches based on presuppositions, scalar implicatures, and something like supervaluations, respectively. We identify free parameters in these theories and assess various variants of them based on our results. Our experimental paradigms may be of broader significance insofar as they can be applied to other phenomena which result in the failure of a sentence to have a definite truth value. (shrink)

In their article ’Is Pregnancy a Disease? A Normative Approach’, Anna Smajdor and Joona Räsänen contend that, on several of the most prominent accounts of disease, pregnancy should be considered a disease. More specifically, of the five accounts they discuss, each renders pregnancy a disease or suffers serious conceptual problems otherwise. They take issue specifically with the dysfunction account of disease and argue that it suffers several theoretical difficulties. In this response, we focus on defending the dysfunction account against their (...) main objections and show why a version of the dysfunction account is viable on account of the indispensability of normativity in biology and medicine. After disarming their main objections to the dysfunction account, we briefly respond to their treatment of the normality of pregnancy and then draw a distinction between adverse symptoms and underlying causes to show why even though pregnancy may have ’disease-like’ features, it is not a disease. This book provides an introduction to the emerging field of continental philosophy of religion by treating the thought of its most important representatives, including its appropriations by several thinkers in the United States. Part I provides context by examining religious aspects of the thought of Martin Heidegger, Emmanuel Levinas, and Jacques Derrida. Christina Gschwandtner contends that, although the work of these thinkers is not apologetic in nature, it prepares the ground for the more religiously motivated work of more recent (...) thinkers by giving religious language and ideas some legitimacy in philosophical discussions. Part II devotes a chapter to each of the contemporary French thinkers who articulate a phenomenology of religious experience: Paul Ricoeur, Jean-Luc Marion, Michel Henry, Jean-Louis Chrétien, Jean-Yves Lacoste, and Emmanuel Falque. In it, the author argues that their respective philosophies can be read as an apologetics of sorts--namely, as arguments for the coherence of thought about God and the viability of religious experience--though each thinker does so in a different fashion and to a different degree. Part III considers the three major thinkers who have popularized and extended this phenomenology in the U.S. context: John D. Caputo, Merold Westphal, and Richard Kearney. The book thus both provides an introduction to important contemporary thinkers, many of whom have not yet received much treatment in English, and also argues that their philosophies can be read as providing an argument for Christian faith. For a long time, Gilbert Simondon’s work was known only as either a philosophy restricted to the problem of technology or as an inspirational source for Gilles Deleuze’s philosophy of difference. As Simondon’s thinking is now finally in the process of being recognized in its own right as one of the most original philosophies of the twentieth century, this also entails that some critical work needs to be done to disentangle it from an all too hasty identification with Deleuzian categories. While both Simondon and Deleuze have made crucial contributions towards a theory of differential individuation that significantly diverges from other authors associated with French poststructuralism insofar as they insist on the dynamic and vital dimension of difference, they also differ on crucial points. According to Wiredu, the Akan profess secular esteem rather than religious worship to supra-natural beings, who they perceive in an empirical sense. He backs this up by re-reading what he sees as the Akan general ontology in a way that denies them of the concepts of the supernatural, the transcendental, the mental, the spiritual, and an ontologically distinct mind. At the end of denying the three criteria of worship as well as all of these other concepts which might otherwise be (...) available to the Akan, one might struggle to find any evidence that the Akan even had a religion. I dispute this secular reading, and I more generally demonstrate that the characterizations of the Akan attitude to divinity as non-worshipping, non-supernatural, non-transcendent, and non-spiritual, are either conceptually flawed, factually incorrect, or both. In his plea for consensual democracy in Africa, Kwasi Wiredu recommends unanimity about what is to be done, not what ought to be done, or unanimity on action rather than unanimity of values, beliefs and opinion. I caution the use of this procedural instrument by showing that some issues are so value-laden that a group decision cannot be value-neutral. It may sometimes be more productive to entertain value differences to keep them from going underground and becoming dangerous. Deconstruction both by its friends and enemies has come to be associated with a set of cliches that completely misunderstands its ethical aspiration. It is particularly within the field of law that we can see the ethical force of deconstruction, and also illuminate its concrete and practical importance. In The Philosophy of the Limit Drucilla Cornell examines the relationship of deconstruction to questions of ethics, justice and legal interpretation. She argues that renaming deconstruction "the philosophy of the limit" will allow (...) us to be more precise about what deconstruction actually is philosophically and hence to articulate more clearly its significance for law. Cornell explores the ethical and juridical significance of the so-called postmodern rebellion against metaphysics. A shared ethical rebellion links philosophers as different as Theodor Adorno, Jacques Derrida, Jacques Lacan, and Emmanuel Levinas. Together they present a new ethical configuration, new in its difference from both the critical social theory of J$u$urgen Habermas and the analytic jurisprudence of Nagel and Rawls. A key aspect of this newness is the centrality given to the relationship between questions of ethics and sexual difference. Cornell argues that the appeal of Lacan's analysis to feminists is that it helps to explain the profound hold the gender hierarchy has over Western culture, including its theories of political transformation. Under a Lacanian analysis the law of gender identity will be replicated in the laws of an existing legal system. This means that we cannot hope to sustain legal reforms unless the gender hierarchy is challenged. Cornell examines Derrida's position on the significance of the gender hierarchy in philosophy and explores its ethical and political importance. Derrida's intervention against legal positivism has important implications for the legal reforms necessary to protect marginalized groups. His emphasis on the limit, she argues, is crucial to thosewhose well-being and very lives may depend on legal transformation, women and homosexuals, for example. In an important contribution to legal philosophy, Cornell explores the affinities of Derrida's writings with recent liberal analytic jurisprudence. She also explores the differences. Comparing Rawls's and Derrida's accounts of justice, she argues that Derrida gives greater attention to the necessary utopian moment in his insistence on maintaining the divide between law, established norms, and justice. Cornell's focus on the importance of the limit and the centrality of the gender hierarchy allows her to offer a view of jurisprudence different from both critical social theory and analytic jurisprudence. As we watch the long-fought-for civil rights of women systematically overturned, we have reason to think about how the connections she makes shed light on an underlying truth of our social, political, and legal reality. A simplistic image of twentieth century French philosophy sees Merleau-Ponty’s death in 1961 as the line that divides two irreconcilable moments in its history: existentialism and phenomenology, on the one hand, and structuralism on the other. The structuralist generation claimed to recapture the dimension of objectivity and impersonality, which the previous generation was supposedly incapable of. As a matter of fact, in 1962, Derrida’s edition of Husserl’s The Origin of Geometry was taken to be a turning point that announced the (...) structuralist revolution by introducing a reflection on the historicity and the materiality of impersonal idealities. And yet, the 1998 publication of Merleau-Ponty’s notes from his Collège de France lecture course on the same topic make manifest that he was already taking phenomenology in another direction. His 1959 reading of The Origin of Geometry shows how unexpectedly close the early Derrida is to the late Merleau-Ponty. By identifying the tension between archaeology and teleology as the basic problem of Husserlian phenomenology, Merleau-Ponty and Derrida each disclose the fundamental importance of history and of writing. Comparing the two readings in their specific context not only brings about a more complex picture of the intellectual debates of the time, but also shows how, with Merleau-Ponty’s interpretation of The Origin of Geometry, Derrida’s “différance” predates itself and receives another genealogy. Bernard Matolino argues that the communal foundation of classical African communitarianism should be discarded if communitarian theories would be of any use to modern African political theory. He sets out to propose a theory of communitarianism that not only suits modern African realities but would also be useful to any people including non-Africans. I argue that what he ends up doing is proposing cosmopolitanism, calling into question the “Afro” designation of the title of his theory. I also argue that his (...) position on the relationship between the individual and the community is technically not communitarianism of any sort, calling into question the “communitarian” appellation in his theory. His attempt to divorce communitarianism from communalism is unsuccessful, making communitarianism as unsuitable as a theory of world relations as Matolino claims it is unsuitable for contemporary multiethnic African societies. Prevailing literature argues that arguing is the only appropriate mode of deliberation. The literature acknowledges bargaining, story telling, and other forms of communication, but is unwilling to describe these as deliberation, properly speaking. The claim is that describing them as such would amount to concept stretching. In this article I argue that arguing exhausts neither the legitimate modes of deliberation nor the modes for effective deliberation. The demand for more transparency is hardly ever questioned. When it is, it is generally questioned in the name of a protection of privacy. In a traditional liberal understanding, there is a non-alienable “right to privacy” (Warren/Brandeis, 1890). Many political struggles, however, involved ignoring such boundaries, and making public things that were meant to remain private (domestic violence, gender oppression, child abuse etc.). While holding that the distinction between private and public is necessary, it must remain mobile and subject to (...) renegotiation. Civil inattention highlights the importance of disregarding: disregarding what others we share the same public space with do, as long as it is not of public relevance; and disregarding such rules of privacy if a violation of basic human rights is taking place, in order to make such behaviour public. In some cases, disregard and ignorance can thus be a moral virtue. (shrink)

« C’est une question de point de vue… » On associe aujourd’hui la perspective à l’individualisme, à l’affirmation d’une vérité privée et indépassable. C’est oublier la tradition de la perspectiva communis, celle qui fait de la perspective le vecteur d’un horizon commun. Au croisement de la science, de l’art et de la philosophie, le livre exhume une tradition que l’on se doit de redécouvrir : le point de vue, ce n’est pas seulement ce qui divise, c’est aussi ce qui se (...) partage. Au lieu d’incriminer le perspectivisme d’avoir fait le lit de la post-vérité, et de la perte d’une référence à un monde réel, il est temps de retrouver en quoi la perspective n’est pas qu’une affaire de relativisation, mais de réalisation. C’est à la perspective que nous devons notre perspicacité : « à travers » – voilà le mot-clé pour comprendre son opération. Une mise en regard d’enjeux anciens et contemporains, où s’entrecroisent les arts visuels, l’architecture, la phénoménologie et l’anthropologie sociale. Autant de manières de faire l’éloge d’une perspective qui se décline invariablement au pluriel. (shrink)
