On May, 1996, two of the journalism profession's best known and most articulate speakers spent 90 minutes in what was billed as a Heavyweight Bout. The subject was public journalism; The audience, a Society of Professiona1 Journalists regional conference; the venue, Macon, Georgia.

This chapter argues that Kant’s aesthetic theory of the sublime has particular relevance for his ethics of virtue. Kant contends that our readiness to revel in natural sublimity depends upon a background commitment to moral ends. Further lessons about the emotional register of the sublime allow us to understand how Kant can plausibly contend that the temperament of virtue is both sublime and joyous at the same time.

Abstract: My aim is to reconstruct Kant's argument for the principle of the synthetic unity of apperception. I reconstruct Kant's argument in stages, first showing why thinking should be conceived as an activity of synthesis (as opposed to attention), and then showing why the unity or coherence of a subject's representations should depend upon an a priori synthesis. The guiding thread of my account is Kant's conception of enlightenment: as I suggest, the philosophy of mind advanced in the Deduction belongs (...) to an enlightenment epistemology. Kant's conception of enlightenment turns on the requirement that a subject be able to recognize herself as the source of her cognitions. The argument for the apperception principle is reconstructed under the guidance of this conception of the ideal of enlightenment. (shrink)

This article responds to Professor Romano’s piece in this issue. It concerns our ongoing debate with regard to the desirability of permitting issuers to choose the securities regulation regime by which they are bound. Romano favors issuer choice, arguing that it would result in jurisdictional competition to offer issuers share value maximizing regulations. I, in contrast, believe that abandoning the current mandatory system of federal securities disclosure would likely lower, not increase, U.S. welfare. Each issuer, I argue, would select a (...) regime requiring a level of disclosure less than is socially optimal because its private costs of disclosure would be greater than the social costs of such disclosure. Professor Romano and I agree on most of the basic analytic building blocks for deciding whether issuer choice is a desirable reform: belief in analyzing the problem in terms of the broadly accepted principles of modern financial economics; recognition that disclosure has costs as well as benefits; and acknowledgment that incentives exist for issuers to provide at least some disclosure. We nevertheless reach the opposite conclusion on the desirability of issuer choice. To start, Romano believes that issuers’ private costs of disclosure will not generally be greater than the social costs of such disclosure, whereas I show they will be. Romano argues as well that this is a special case in which any divergence of private and social costs that does exist will not lead to a market failure, at least one possibly correctable by public regulation. I show her argument to be unpersuasive. Finally, Romano interprets the existing empirical evidence as proving mandatory disclosure’s lack of social value, while I show that the evidence in fact does not point in either direction. Where, as here, the theoretical case for the existence of a market failure is strong and the current program for dealing with it is widely admired, the advocate of change should have the burden of proof. Professor Romano has not met this burden. If she is serious about advancing her proposal for issuer choice, she needs to show that despite the market failure inherent in issuer choice, there is inevitably an even greater failure in the regulatory response. Absent such a showing, mandatory disclosure should be retained. (shrink)

This Element considers Kant's account of the sublime in the context of his predecessors both in the Anglophone and German rationalist traditions. Since Kant says with evident endorsement that 'we call sublime that which is absolutely great' and nothing in nature can in fact be absolutely great, Kant concludes that strictly speaking what is sublime can only be the human calling to perfect our rational capacity according to the standard of virtue that is thought through the moral law. The Element (...) takes account of the difference between respect and admiration as the two main varieties of sublime feeling, and concludes by considering the role of Stoicism in Kant's account of the sublime, particularly through the channel of Seneca. I discuss the relevance of the current predicament in cosmology to the debate over scientific realism. I argue that the existence of two, empirically successful but ontologically inconsistent cosmological theories presents difficulties for the realist position.

Many philosophers and psychologists argue that out everyday ability to predict and explain the actions and mental states of others is grounded in out possession of a primitive 'folk' psychological theory. Recently however, this theory has come under challenge from the simulation alternative. This alternative view says that human beings are able to predict and explain each other's actions by using the resources of their own minds to simulate the psychological aetiology of the actions of the others. This book and (...) the companion volume Folk Psychology: The Theory of Mind Debate together offer a richly woven fabric of philosophical and psychological theory, which promises to yield real insights into the nature of our mental lives. In Logik der Forschung (1934) and later works, Karl Popper proposed a set of methodological rules for scientists. Among these were requirements that theories should evolve in the direction of increasing content, and that new theories should only be accepted if some of their novel predictions are experimentally confirmed. There are currently two, viable theories of cosmology: the standard cosmological model, and a theory due to Mordehai Milgrom called MOND. Both theories can point to successes and failures, but only MOND (...) has repeatedly made novel predictions that were subsequently found to be correct. Standard-model cosmologists, by contrast, have almost always responded to new observations in a post-hoc manner, adjusting or augmenting their theory as needed to obtain correspondence with the facts. I argue that these methodological differences render a comparison of the two theories in terms of their ‘truthlikeness’ or ‘verisimilitude’ essentially impossible since the two groups of scientists achieve correspondence with the facts in fundamentally different ways, and I suggest that a better guide to the theories’ progress toward the truth might be the methodologies themselves. The idea that virtue can be profitably conceived as a certain sort of skill has a long history. My aim is to examine a neglected episode in this history — one that focuses on the pivotal role that Moses Mendelssohn played in rehabilitating the skill model of virtue for the German rationalist tradition, and Immanuel Kant’s subsequent, yet significantly qualified, endorsement of the idea. Mendelssohn celebrates a certain automatism in the execution of skill, and takes this feature to be instrumental (...) in meeting an objection against perfectionist, agent-based ethics: namely, that a virtuous person would seem to act for the sake of realising his own perfection in everything that he does, thereby taking a morally inappropriate interest in his own character. Kant rejects the automatism featured in Mendelssohn’s account, on grounds that it would make virtue mindless and unreflective. But he does not reject the skill model of virtue wholesale. Rather, he calls for considering how reflection can be embedded in the expression of certain kinds of skill, enabling him to endorse, and arguably adopt, the model on his own terms. (shrink)

Alix Cohen argues that the function of feeling in Kantian psychology is to appraise and orient activity. Thus she sees feeling and agency as importantly connected by Kant’s lights. I endorse this broader claim, but argue that feeling, on her account, cannot do the work of orientation that she assigns to it.

Unethical pro-organizational behaviors are unethical, but prosocially-motivated, acts intended to benefit one’s organization. This study examines the extent to which employees are willing to perform UPB to benefit a liked leader. Based on social exchange theory, we hypothesized that LMX would mediate the association of interpersonal justice with UPB willingness. Moral identity and positive reciprocity beliefs were examined as moderators. Higher LMX was significantly and positively related to UPB willingness, and the indirect effect of interpersonal justice on UPB via LMX (...) was significant and positive. These findings suggest that LMX and interpersonal justice could have a previously-unexplored dark side. Moral identity had a negative direct relationship with UPB, but it did not moderate the relationship of LMX with UPB. Thus, LMX facilitates UPB willingness even when employees are high in moral identity. LMX is associated with many positive outcomes, but our results show that high LMX may also increase willingness to perform unethical behaviors to benefit one’s leader. These results contribute to the literature by identifying a potential negative outcome associated with high LMX. (shrink)

It has been insufficiently remarked that Murdoch deems “Kant’s ethical theory” to be “one of the most beautiful and exciting things in the whole of philosophy” in her 1959 essay “The Sublime and the Good”. Murdoch specifically has in mind the connection between Kant’s ethics and his theory of the sublime, which runs via the moral feeling of respect (Achtung). The chapter examines Murdoch’s interest in Kant on this point as a way to tease out the range of issues that (...) complicate Kant’s significance for the development of Murdoch’s distinctive conception of ethics as it is articulated in _The Sovereignty of Good_ and earlier essays. It focuses on her particular concerns about the moral dangers of consolation, and why this led her to propose reworking the Kantian theory of the sublime as a theory of art, and specifically of tragedy. The chapter replies to Paul Guyer’s (2020) account of the debate between Mendelssohn and Kant about whether humankind makes continual moral progress. Mendelssohn maintained that progress can only be the remit of individuals, and that humankind only “continually fluctuates within fixed limits”. Kant dubs Mendelssohn’s position “abderitism” and explicitly rejects it. But Guyer contends that Kant’s own theory of freedom commits him, malgré lui, to abderitism. Guyer’s risky interpretive position is not supported by examination of the relevant texts in their (...) intellectual context. I first identify the historical origins of the term abderitism, which here signifies the independence of individual progress from social conditions. By contrast, Kant argues that individual progress cannot be independent of the progress of the species, acting as a corporate agent. This arresting position, I argue, must be understood in light of the Stoic ethical-teleological presuppositions generally accepted in eighteenth-century German discussion of human progress. (shrink)

This philosophical treatise on the foundations of semantics is a systematic effort to clarify, deepen, and defend the classical doctrine that words are conventional signs of mental states, principally thoughts and ideas, and that meaning consists in their expression. This expression theory of meaning is developed by carrying out the Gricean program, explaining what it is for words to have meaning in terms of speaker meaning, and what it is for a speaker to mean something in terms of intention. But (...) Grice's own formulations are rejected and alternatives developed. The foundations of the expression theory are explored at length, and the author develops the theory of thought as a fundamental cognitive phenomenon distinct from belief and desire, argues for the thesis that thoughts have parts, and identifies ideas or concepts with parts of thoughts. A methodology of science must satisfy two requirements: (i) It must be ampliative: the theories which it generates must make statements that go far beyond any data or observations that may have motivated those theories in the first place. (ii) It must be epistemically probative: it must somehow provide a warrant for believing that the theories so produced are correct, or at least partially correct, even if they can never be fully confirmed. These two requirements pull in opposite directions, and (...) attempts to specify the “scientific method” often focus on one to the exclusion of the other. On a few points there now exists something approaching a consensus. (i) Scientific hypotheses — including, particularly, statements about unobserved or unobservable entities or mechanisms — remain conjectural, no matter how frequently predictions based on those hypotheses are found to coincide with data. (ii) A good (best?) indicator of a theory’s verisimilitude is its ability to successfully predict phenomena which it was not specifically designed to predict. I discuss these ideas with particular reference to cosmological theories. (shrink)

This paper addresses a problem about epistemic warrant. The problem is posed by philosophical arguments for externalism about the contents of thoughts, and similarly by philosophical arguments for architecturalism about thinking, when these arguments are put together with a thesis of first person authority. In each case, first personal knowledge about our thoughts plus the kind of knowledge that is provided by a philosophical argument seem, together, to open an unacceptably ‘non-empirical’ route to knowledge of empirical facts. Furthermore, this unwelcome (...) prospect of transferring a ‘non-empirical’ warrant from premises about our own mental states and about philosophical theory to a conclusion about external environment or internal architecture seems to depend upon little more than the possibility of knowledge by inference. It is often thought that traditional recidivism prediction tools used in criminal sentencing, though biased in many ways, can straightforwardly avoid one particularly pernicious type of bias: direct racial discrimination. They can avoid this by excluding race from the list of variables employed to predict recidivism. A similar approach could be taken to the design of newer, machine learning-based (ML) tools for predicting recidivism: information about race could be withheld from the ML tool during its training phase, ensuring that the (...) resulting predictive model does not use race as an explicit predictor. However, if race is correlated with measured recidivism in the training data, the ML tool may ‘learn’ a perfect proxy for race. If such a proxy is found, the exclusion of race would do nothing to weaken the correlation between risk (mis)classifications and race. Is this a problem? We argue that, on some explanations of the wrongness of discrimination, it is. On these explanations, the use of an ML tool that perfectly proxies race would (likely) be more wrong than the use of a traditional tool that imperfectly proxies race. Indeed, on some views, use of a perfect proxy for race is plausibly as wrong as explicit racial profiling. We end by drawing out four implications of our arguments. (shrink)

Grice’s Razor is a methodological principle that many philosophers and linguists have used to help justify pragmatic explanations of linguistic phenomena over semantic explanations. A number of authors in the debate over contextualism argue that an invariant semantics together with Grice’s (1975) conversational principles can account for the contextual variability of knowledge claims. I show here that the defense of Grice’s Razor found in these “Gricean invariantists,” and its use against epistemic contextualism, display all the problems pointed out earlier in (...) Davis (1998). The everyday variation in acceptable knowledge claims is better explained in terms of implicature than indexicality, but general conversational principles shed little light on whether ‘know’ is used hyperbolically, meiotically, or loosely in a context, although this issue is crucial in deciding what if anything ‘S knows p’ implicates. I present reasons favoring an account of the representative bank case in terms of loose use, making clear how they differ from Grice’s Razor. (shrink)

This article describes our efforts to screen and enrol clinical trial participants conscientiously in the COVID-19 pandemic setting. We present the standard screening and enrolment process prior to, and our process of adapting to, the pandemic. Our goal was to develop a way to screen and enrol people for clinical trials that was both equitable and effective. In addition, we outline the steps our research department took to ensure that ethical, clinical and logistical factors were considered when matching a patient (...) to a clinical trial. (shrink)

Utilitarianism has an apparent pedigree when it comes to animal welfare. It supports the view that animal welfare matters just as much as human welfare. And many utilitarians support and oppose various practices in line with more mainstream concern over animal welfare, such as that we should not kill animals for food or other uses, and that we ought not to torture animals for fun. This relationship has come under tension from many directions. The aim of this article is to (...) add further considerations in support of that tension. I suggest three ways in which utilitarianism comes significantly apart from mainstream concerns with animal welfare. First, utilitarianism opposes animal cruelty only when it offers an inefficient ratio of pleasure to pain; while this may be true of eating animal products, it is not obviously true of other abuses. Second, utilitarianism faces a familiar problem of the inefficacy of individual decisions; I consider a common response to this worry, and offer further concerns. Finally, the common utilitarian argument against animal cruelty ignores various pleasures that humans may get from the superior status that a structure supporting exploitation confers. (shrink)
