The chapter replies to Paul Guyer’s (2020) account of the debate between Mendelssohn and Kant about whether humankind makes continual moral progress. Mendelssohn maintained that progress can only be the remit of individuals, and that humankind only “continually fluctuates within fixed limits”. Kant dubs Mendelssohn’s position “abderitism” and explicitly rejects it. But Guyer contends that Kant’s own theory of freedom commits him, malgré lui, to abderitism. Guyer’s risky interpretive position is not supported by examination of the relevant texts in their (...) intellectual context. I first identify the historical origins of the term abderitism, which here signifies the independence of individual progress from social conditions. By contrast, Kant argues that individual progress cannot be independent of the progress of the species, acting as a corporate agent. This arresting position, I argue, must be understood in light of the Stoic ethical-teleological presuppositions generally accepted in eighteenth-century German discussion of human progress. (shrink)

Kant’s arguments for the reality of human freedom and the normativity of the moral law continue to inspire work in contemporary moral philosophy. Many prominent ethicists invoke Kant, directly or indirectly, in their efforts to derive the authority of moral requirements from a more basic conception of action, agency, or rationality. But many commentators have detected a deep rift between the _Groundwork for the Metaphysics of Morals_ and the _Critique of Practical Reason_, leaving Kant’s project of justification exposed to conflicting (...) assessments and interpretations. In this major re-reading of Kant, Owen Ware defends the controversial view that Kant’s mature writings on ethics share a unified commitment to the moral law’s primacy. Using both close analysis and historical contextualization, Owen Ware overturns a paradigmatic way of reading Kant’s arguments for morality and freedom, situating them within Kant’s critical methodology at large. The result is a novel understanding of Kant that challenges much of what goes under the banner of Kantian arguments for moral normativity today. (shrink)

This paper attempts to shed light on Kant’s notion of autonomy in his moral philosophy by considering Kant’s critique of the rationalist theories of morality that Kant discussed in his lectures on practical philosophy from the 1760s to the time of the Groundwork. The paper first explains Kant’s taxonomy of moral theories and his perspective on the history of ethics. Second, it considers Kant's arguments against the two main variants of ‘rationalism’ as he construes it, that is, perfectionism and theological (...) voluntarism, pointing out the similarities to previous criticisms. Third, the paper argues that Kant’s discussion of the 'rationalist' views does not amount to an unqualified dismissal, but to an attempt at working out a novel rationalist position. Kant’s criticisms of rationalist views suggest that his project emerges from the failures of previous rationalism, with the aim to work out a rationalist view that can account for moral obligation by integrating insights from the theological conception. The combination of perfectionism and theological views yields the basic outline of the idea of autonomy, consisting in the lawgiving function of a rational will as a key to the legislation of a necessary law. This article provides a transcription and analysis of a newly located fragment of Kant’s autograph fair copy of his essay on Perpetual Peace. The 4-page manuscript is part of the John Wild Autograph Collection at Princeton University (USA) and constitutes the immediate sequel to a similar fragment preserved in the Staatsarchiv Hamburg and published in Kant-Studien 77 (1986). The Princeton fragment was not included in volume 23 of the Akademie-Ausgabe and was unavailable to recent editors; it presents a number of (...) textual variants and allows new insights into Kant’s writing process. The secular interpretation of Kant is widespread and Kant is viewed as the most prestigious founding father of liberal secularism. At the same time, however, commentators note that Kant’s position on secularism is in fact much more complex, and some go as far as to talk about an ambiguous secularism in his work. This paper defends a refined version of the secular interpretation. According to this refined version, Kant can offer a limited, political secularism on the basis of a simple (...) argument which focuses on the distinct epistemic statuses of political and religious claims; however, the paper argues, a more general secularism is unwarranted on the basis of the same argument. If my argument is correct, then it will account at least in part for the plurality of interpretations. Moreover, any further attempt to show that Kant’s relation to secularism is ambiguous or dismissive should take into consideration the argument from epistemic grounds presented here. (shrink)

This paper argues that Kant’s distinction between “civil union” and “ethical community” can be of great value in dealing with a problem that causes considerable trouble in contemporary political and social philosophy, namely the question of the normative significance and role of religion in political and social life. The first part dwells upon the third part of Kant`s Religion within the Boundaries of Mere Reason with the intention of exposing the general features of ethical community. It highlights the fact that (...) Kant considers publicity, and indeed public authority, to be constitutive of the ethical community. The second part discusses his argument that we have a unique ethical duty to enter into an ethical community. This discussion clarifies the constitutive purpose of ethical community and sets forth why Kant thought that the ethical community should have a religious form. The third part presents an account of the constitutive purpose of the state in light of the Doctrine of Right. Throughout these steps, as is concluded, the essentials of a model for the relations between law, ethics, and religion emerge, which shows the way in which both religious and secularist worries can be met on a principled basis. The focus of this paper is on Kant and on a text which has often been drawn upon when talking about the present situation of philosophy at university, namely his 'The Conflict of the Faculties' of 1798. Kant’s claims, though not applicable to the contemporary situation directly, can indeed be worked out in a way which can assign a distinct and clearly identifiable role for university-based philosophy. I need to emphasize, though, that I am not suggesting that this is the (...) only way Kant’s thoughts in this respect can be adapted to and utilized for such an account. Quite the contrary, Kant’s text offers a manifold of highly important options here. In my article I will seek to establish the following claims: a) Kant, in his later years, which therefore amounts to something like his “mature” position, subscribed to a conception of a public use of reason which mainly referred to the Faculties of Philosophy at universities. b) Kant’s dismissal of philosophy according to the school conception of it must not be taken as a dismissal of academic philosophy altogether. Philosophy practiced at university by professionals is vital for Kant to build philosophy as a fully worked out discipline and to answer questions revolving around the issue of the compatibility of the theoretical standpoint and Kant’s own moral theory. c) Neither a) nor b) can be immediately applied to the contemporary situation we find ourselves in. Combining elements of a) and b), however, a possible route for the actualization of Kant’s ideas may open up. At least one of the functions for which university-based philosophy is uniquely qualified is the assessment of the implications of progress in the natural sciences for the conception of a moral standpoint in general, and as such for a core element of our self-understanding as rational beings. This paper aims to highlight the role played by uncertainties in global justice theories. It will start by identifying four kinds of uncertainties that could potentially have an impact on the nature, content and very existence of global duties: first, uncertainties regarding the causes of global injustices; second, uncertainties regarding the consequences of global justice initiatives; third, uncertainties pertaining to the 'imperfect' character of certain global duties; and fourth, uncertainties regarding the conduct of others. It will discuss each of these (...) uncertainties in turn, with particular attention to their normative implications, their distinctively 'global' source, and the possibility of their being addressed. It will conclude with some reflections on how the normative issues raised by uncertainties related to spatial distance compare to those raised by uncertainties related to temporal distance. (shrink)

This article turns to early modern and Enlightenment advocates of tolerance in order to discover and lay bare the line of argument that informed their commitment to free speech. This line of argument will subsequently be used to assess the shift from free speech to the contemporary ideal of free self-expression. In order to take this assessment one step further, this article will finally turn to Immanuel Kant’s famous defense of the public use of reason. In the wake of Katerina (...) Deligiorgi’s readings of Kant, it will show that the idea of free speech requires a specific disposition on behalf of speakers and writers that is in danger of being neglected in the contemporary prevailing conception of free speech as freedom of self-expression. Most ethical decisions are conditioned by formidable uncertainty. Decision makers may lack reliable information about relevant facts, the consequences of actions, and the reactions of other people. Resources for dealing with uncertainty are available from standard forms of decision theory, but successful application to decisions under risk requires a great deal of quantitative information: point-valued probabilities of states and point-valued utilities of outcomes. When this information is not available, this paper recommends the use of a form of decision theory that (...) operates on a bare minimum of information inputs: comparative plausibilities of states and comparative utilities of outcomes. In addition, it proposes a comparative strategy for dealing with second-order uncertainty. The paper illustrates its proposal with reference to a well-known ethical dilemma: Kant’s life-saving lie. In line with familiar portrayals of Kant's ethics, interpreters of his philosophy of education focus essentially on its intellectual dimension: the notions of moral catechism, ethical gymnastics and ethical ascetics, to name but a few. By doing so, they usually emphasise Kant's negative stance towards the role of feelings in moral education. Yet there seem to be noteworthy exceptions: Kant writes that the inclinations to be honoured and loved are to be preserved as far as possible. This statement is not (...) only at odds with Kant's general claim that education should not encourage feelings, but more importantly, it encourages a feeling that is in many ways paradigmatically un-Kantian. How are we to understand the fact that of all feelings, the love of honour should be preserved? To answer this question, I begin by clarifying the reasons behind Kant's negative stance towards feelings in moral education. I then turn to his account of the feeling of love of honour. After distinguishing between its good and its bad forms, I consider two ways of making sense of the positive role Kant assigns to it. The first, modest reading will suggest that the feeling of love of honour is morally useful because it has two functions: an epistemic one, and a motivational one. The second, more ambitious reading will suggest that the feeling of love of honour enables the child to experience her inner worth as bearer of value. (shrink)

The chapter shows how Kant’s ethical thought as reflected in the lectures, responds to Baumgarten’s works on moral philosophy. I argue that Kant chose Baumgarten’s textbooks for his classes for genuinely philosophical reasons. The thorough discussion of Baumgarten’s views provided Kant with important clues for developing an original position, even if mostly in opposition to Baumgarten. I illustrate this complex role of Baumgarten with a few significant examples, that also highlight some original aspects of Baumgarten’s position in comparison to Wolff’s: (...) (1) Kant follows Baumgarten’s in focusing on obligation as the crucial issue in moral philosophy, but Kant regards Baumgarten’s account as not satisfying. (2) Baumgarten’s sharply theistic foundation of morality is rejected by Kant. (3) Kant rejects also several significant aspects of Baumgarten’s division of ethical duties, thereby revealing profound differences in their conceptions of morality. (shrink)

This is the first book devoted to an examination of Kant's lectures on ethics, which provide a unique and revealing perspective on the development of his views. In fifteen newly commissioned essays, leading Kant scholars discuss four sets of student notes reflecting different periods of Kant's career: those taken by Herder, Collins, Mrongovius and Vigilantius. The essays cover a diverse range of topics, from the relation between Kant's lectures and the Baumgarten textbooks, to obligation, virtue, love, the highest good, freedom, (...) the categorical imperative, moral motivation and religion. Kierkegaard and Kant on Radical Evil and the Highest Good is a major study of Kierkegaard's relation to Kant that gives a comprehensive account of radical evil and the highest good, two controversial doctrines with important consequences for ethics and religion.

Immanuel Kant is known for his ideas about duty and morally worthy acts, but his conception of virtue is less familiar. Nevertheless Kant’s understanding of virtue is quite distinctive and has considerable merit compared to the most familiar conceptions. Kant also took moral education seriously, writing extensively on both the duty of adults to cultivate virtue and the empirical conditions to prepare children for this life-long responsibility. Our aim is, first, to explain Kant’s conception of virtue, second, to highlight some (...) distinctive and potentially appealing features of the Kantian account of virtue, third, to summarize and explain Kant’s prescriptions for educating young children and youth as well as the duty of moral self-improvement that he attributes to all adults, and, fourth, to respond to some common objections that we regard as misguided or insubstantial. In the first section, I articulate FUL and what I mean by a positive duty. In the second section, I set out an intuitive version of the standard reading of FUL and argue that it does not work. Chinese translation of a revised version of a conference paper originally entitled "Kant on the Prudential Status of Historical Faith". Here is the original abstract in English: Because his ethical theory is grounded on the assumption that actions are virtuous only to the extent that they are motivated by the moral law, Kant has rarely, if ever, been regarded as a friend of prudence. That he is also not an enemy of prudence has been demonstrated by several recent studies of (...) Kant’s moral philosophy. What has heretofore gone unnoticed, however, is that in explaining the genuine (and possibly indispensable) role played by empirical religious traditions, Kant appeals explicitly to the prudential status of what he calls “historical faith”. This paper will carefully examine Kant’s references to prudence in his book, Religion within the Bounds of Bare Reason, demonstrating that the prudential status of historical faith is the key to understanding both its limitations (as no more than the vehicle of true religion, not the moral core) and its real value. The wise person will be religious, in one form or another, because to abandon any and all prudential appeals to a faith-based vehicle for morality would render the goal of living a good life extremely difficult, if not impossible, for embodied beings to achieve. At 6:26n Kant famously (or infamously) claims that humanity and personality are not necessarily coextensional. This claim has been characterized in the secondary literature as Kant's worst mistake and as an unnecessary repudiation of his earlier (and more plausible) ethical thought. I argue that this characterization of 6:26n rests on a misinterpretation of the term `humanity'. I try to show that Kant's claim at 6:26n not only is not problematic; it constitutes a powerful reminder of the kind of epistemic modesty (...) that Kant argues for in the Critique of Pure Reason. Many Kantian scholars have debated what normative guidance the formula of the law of nature provides. There are three ways of understanding the role of FLN in Kant’s ethics. The first line of interpretation claims that FLN and FLU are logically equivalent. The second line claims that there are only subjective differences, meaning that FLN is easier to apply than the abstrct method of FUL. The third line of interpretation claims that there are objective differences between FLN and FUL in (...) the sense that each formula has an irreducible role in Kant’s ethics. In this article I will show that the first and second lines of interpretation cannot fully explain Kant’s account of FLN and I will propose a new interpretation which pertains to the third type. I will explore the schematism model to understand the role of FLN and argue that it is an intermediary principle that fills in a practical gap between the moral law and action. In the end, I will consider a possible objection against this understanding which claims that the schematism model is not applicable to practical judgment since nothing is given in experience. : Most contemporary attempts to draw inspiration from Kant's cosmopolitan project focus exclusively on the prescriptive recommendations he makes in his article, ‘On Perpetual Peace’. In this essay, I argue that there is more to his cosmopolitan point of view than his normative agenda. Kant has a unique and interesting way of problematizing the way individuals and peoples relate to one another on the stage of world history, based on a notion that human beings who share the earth in common (...) ‘originally’ constitute a ‘commercium’ of thoroughgoing interaction. By unpacking this concept of ‘commercium’, we can uncover in Kant a more critical perspective on world history that sets up the cosmopolitan as a specific kind of historical-political challenge. I will show that we can distinguish this level of problematization from the prescriptive level at which Kant formulates his familiar recommendations in ‘Perpetual Peace’. I will further show how his particular way of framing the cosmopolitan problematic can be expanded and expatiated upon to develop a more critical, reflexive, and open-ended conception of cosmopolitan thinking. In this paper, I provide an interpretation of the latitude of wide duties by analyzing Kant’s reinterpretation of Horace’s adage insani sapiens nomen habeat; aequus iniqui - ultra quam satis est virtutem si petat ipsam (the wise man has the name of being a fool, the just man of being iniquitous, if he seeks virtue beyond what is sufficient”, MS VI: 404n., 409 and 433n) and his criticism of Aristotle’s doctrine of the mean. In support of my interpretation I also (...) analyze Kant’s distinction between lying and reticence in his correspondence with Maria von Herbert and between openheartedness and reticence in the Religion. I argue that since there is no upper limit to the extent we may realize moral ends it may be morally permissible to take one’s prudential considerations into account when deciding how to comply with wide duties. In contrast, the deliberate disregard of one’s permissible prudential interests may reflect what Kant calls a fantastic conception of virtue, according to which agents vainly believe that they can completely achieve virtue in this life. I call attention to the fact that for Kant the wise (sapiens) is also a prudens, a person who does not think fantastically in matters of virtue and consequently does not attempt to “maximize virtue” at the expense of one’s permissible prudential interests as a finite being. This article tries to make sense of the concept of the highest good (eternal bliss) in Søren Kierkegaard by comparing it to the analysis of the highest good found in Immanuel Kant. The comparison with Kant’s more systematic analysis helps us clarify the meaning and importance of the concept in Kierkegaard as well as to shed new light on the conceptual relation between Kant and Kierkegaard. The article argues that the concept of the highest good is of systematic importance in (...) Kierkegaard, although previous research has tended to overlook this, no doubt due to Kierkegaard’s cryptic use of the concept. It is argued that Kierkegaard’s concept of the highest good is much closer to Kant’s than what previous research has indicated. In particular, Kant and Kierkegaard see the highest good not only as comprising of virtue and happiness (bliss), but also as being the Kingdom of God. (shrink)

In Kant's Human Being, Robert B. Louden continues and deepens avenues of research first initiated in his highly acclaimed book, Kant's Impure Ethics.

Some commentators have condemned Kant’s moral project from a feminist perspective based on Kant’s apparently dim view of women as being innately morally deficient. Here I will argue that although his remarks concerning women are unsettling at first glance, a more detailed and closer examination shows that Kant’s view of women is actually far more complex and less unsettling than that attributed to him by various feminist critics. My argument, then, undercuts the justification for the severe feminist critique of Kant’s (...) moral project. (shrink)

In his Anthropology from a Pragmatic Point of View, Kant formulates the idea of the empirical investigation of the human being as a free agent. The notion is puzzling: Does Kant not often claim that, from an empirical point of view, human beings cannot be considered as free? What sense would it make anyway to include the notion of freedom in science? The answer to these questions lies in Kant’s notion of character. While probably all concepts of character are involved (...) in the description and explanation of human action, Kant develops a specific notion of character by distinguishing character as a “mode of thought” (Denkungsart) from character as a “mode of sensing” (Sinnesart). The former notion is distinctively Kantian. Only mode of thought reveals itself in human action such that actions can be seen as linked to an agent’s first-person perspective and the capacity to rationally reflect one’s own intentions and desires. By reference to this concept human actions can be empirically explained qua free actions. The point of this paper is not only to rule out the interpretation that Kant is an incompatibilist concerning the dilemma of freedom and causal determinism. It is also argued that Kant defends a version of soft determinism which is more sophisticated and more adequate for the human sciences than Hume’s. (shrink)

Published in 1797, the Doctrine of Right is Kant's most significant contribution to legal and political philosophy. As the first part of the Metaphysics of Morals, it deals with the legal rights which persons have or can acquire, and aims at providing the grounding for lasting international peace through the idea of the juridical state. A better appreciation of Kant’s commitments in a variety of disciplines reveals Kant had a deeper understanding of human and non-human animals than generally recognized, and this sheds new light on Kant’s claims about the nature and scope of moral status and helps to address, at least from Kant’s perspective, many of the familiar objections to his notorious account of “duties regarding animals.” Kant’s core principles about the nature of moral obligation structure his thoughts about the moral status of human (...) beings and non-human animals. Kant’s commitments in biology, psychology, anthropology and physical geography support his account of the nature of and distinction between humans and non-human animals. This account supports Kant’s judgment that we have duties to every human being and significant duties regarding non-human animals, duties which involve direct concern for animals because of their nature. A comparison of Kant’s account with some recently proposed Kantian alternatives provides additional perspective on some of the distinctive features, and strengths and weaknesses, of Kant’s approach. Kant’s project in ethics is to defend the conception of morality that he takes to be embedded in ordinary thought. The principal aims of his foundational works in ethics – the Groundwork of the Metaphysics of Morals and the Critique of Practical Reason – are to state the fundamental principle of morality, which he terms the “Categorical Imperative”, and then to give an account of its unconditional authority – why we should give moral requirements priority over non-moral reasons – by (...) grounding it in the nature of free rational agency. Roughly the principle of morality gets its authority from the fact that it is by acting from this principle that we exercise our free agency. In these works Kant develops a distinctive account of the content of moral requirement (which is filled out in his later work, The Metaphysics of Morals). According to one version of the Categorical Imperative, we determine what sorts of actions are permissible or required in various situations by asking whether a principle of action is rationally willed as universal law for agents with autonomy. A second version of the Categorical Imperative derives the content of morality from the principle that we are to respect “humanity”, or “rational nature”, as an “end in itself” and never merely as a means. “Humanity” is the capacity for autonomous rational choice, and it includes the capacity to act from one’s own judgment of what one has reason to do, to set ends for oneself, and to guide one’s actions by values one finds it reasonable to accept. To hold that this capacity is an end in itself is to claim that it has an absolute value – a value that Kant terms “dignity” – that sets limits on the.. (shrink)

Scholars have long debated the relationship between Kant’s doctrine of right and his doctrine of virtue (including his moral religion or ethico-theology), which are the two branches of his moral philosophy. This article will examine the intimate connection in his practical philosophy between perpetual peace and the highest good, between political and ethico-religious communities, and between the types of transparency peculiar to each. It will show how domestic and international right provides a framework for the development of ethical communities, including (...) a kingdom of ends and even the noumenal ethical community of an afterlife, and how the transparency and trust achieved in these communities is anticipated in rightful political society by publicity and the mutual confidence among citizens that it engenders. Finally, it will explore the implications of this synthesis of Kant’s political and religious philosophies for contemporary Kantian political theories, especially those of Jürgen Habermas and John Rawls. Kant’s example of lying to the murderer at the door has been a cherished source of scorn for thinkers with little sympathy for Kant’s philosophy and a source of deep puzzlement for those more favorably inclined. The problem is that Kant seems to say that it’s always wrong to lie – even if necessary to prevent a murderer from reaching his victim – and that if one does lie, one becomes partially responsible for the killing of the victim. If this (...) is correct, then Kant’s account seems not only to require us to respect the murderer more than the victim, but also that we somehow can become responsible for the consequences that ultimately result from someone else’s wrongdoing. After World War II our spontaneous negative reaction to this apparently absurd line of argument is brought out even more starkly by making the murderer at the door a Nazi officer looking for Jews hidden in people’s homes. This paper argues that Kant’s discussion of lying to the murderer at the door has been seriously misinterpreted. The suggested root of the problem is that the Doctrine of Right has been given insufficient attention in Kant interpretation. It is in this work we find many of the arguments needed to understand Kant’s analysis of lying to the murderer in “On a Supposed Right to Lie from Philanthropy”. When we interpret this essay in light of Kant’s discussion in the Doctrine of Right, we can make sense of why lying to the murderer isn’t to wrong the murderer, why we nevertheless become responsible for the consequences of the lie and why choosing to lie to do wrong ‘in the highest degree’. Finally, the Doctrine of Right account of rightful relations makes it possible for us to analyze the example when we make the murderer at the door a Nazi officer. (shrink)

This article analyses the teleological argument justifying historical progress in Kant's Guarantee of Perpetual Peace. It starts by examining the controversies produced by Kant's claim that the teleology of nature supports the idea of a providential development of humanity towards moral progress and the possibility of achieving a cosmopolitan political constitution. It further illustrates how Kant's teleological argument in Perpetual Peace needs to be assessed with reference to two systematically relevant issues: first, the problem of coordination linked to the necessity (...) of realizing the ‘highest good’ as a historical end of practical reason, and secondly the problem of continuity posed by the temporal limitation of all individual efforts to cultivate moral dispositions. To illustrate the implications of both issues for the teleological argument in Perpetual Peace, the article draws attention to some important developments in Kant's analysis of teleology following the Critique of Judgment. The aim of this paper is to determine whether Kant’s account of freedom fits with his theory of the human sciences. Several Kant scholars have recently acknowledged a tension between Kant’s metaphysics and his works on anthropology in particular. I believe that in order to clarify the issue at stake, the tension between Kant’s metaphysics and his anthropology should be broken down into three distinct problems. Firstly, Kant’s Anthropology studies the human being “as a freely acting being”. This approach thus (...) presupposes that such an inquiry can acknowledge freedom and appeal to it in its accounts of human behaviour. Yet, the Critique of Pure Reason clearly asserts that “as regard [man’s] empirical character there is no freedom; and yet it is only in the light of this character that man can be studied”. This, in contrast, seems to indicate that the human sciences should be carried out independently of freedom. Secondly, the Anthropology seems to suggest that empirical factors encompassed by culture, civilisation and mores can have an impact on the human being’s moral status by generating some form of moral progress. Yet if freedom and moral agency are restricted to the domain of the intelligible, they cannot be influenced by anything empirical. Thirdly, the Anthropology provides numerous moral and prudential recommendations as to how one should behave in particular circumstances. Thus, it seems to presuppose that anthropological knowledge, as well as the practical guidance based on this knowledge, can have an impact on the free choices we make. Yet how can the human sciences be legitimately, and efficaciously, prescriptive vis-à-vis our free choices? Regarding the first problem, which I tackle in section 1, I will hold that the human sciences can legitimately refer to ‘practical freedom’ understood as the power to determine one’s aims and to act independently of sensuous impulses, through intentions and the representation of purposes. I will address the second and third problems in two steps. Section 2 will tackle them negatively through a distinction between the conditions of moral agency and the conditions of moral improvement. It will allow me to argue that the possibility of any direct influence of the empirical on the intelligible is metaphysically invalid in principle, and hence, that empirical factors cannot effect any direct change in one’s moral character. In the third section, I will turn to the positive side of my account by focusing on the issue of the moral relevance of culture and civilisation as well as that of the human sciences (which study their influence), and suggest that they are morally relevant insofar as they make us more morally efficacious. Although Kant is not usually counted among the forerunners of social sciences, any look at the work of the most prominent social theorists of the past century shows the pervasive influence of Kant's philosophy. This influence is obvious and crucial at the epistemological level, if only because Kant himself set the frame for subsequent discussion of the difference between human and natural sciences. Yet, Kant's work is also rich in substantive contributions to social theory, which may be articulated around his (...) conception of culture and cultural progress. (shrink)

In this paper I argue that if one is to do justice to reason's unity in Kant, then one must acknowledge that reason's practical ends are presupposed in every theoretical investigation of nature. Thus, contrary to some other commentators, I contend that the notion of the metaphysical ground of the unity of nature should not be attributed to the “dynamics of reason” and its “own practical purposes.” Instead, the metaphysical ground of the unity of nature is in fact an indispensable (...) and necessary notion for reason in both its theoretical and practical functions, but this need of reason to presuppose such a notion can only find its adequate proof in the practical. By offering a synopsis of Kant's accounts of nature's systematicity in the Transcendental Ideal of the Critique of Pure Reason (Part I), the Appendix to the Dialectic of the Critique of Pure Reason (Part II), and in the Critique of Judgment (Part III), I identify in each section Kant's theoretical and practical arguments for reason's presupposition of the “unconditioned,” demonstrate their structural interdependence, and show a general continuity in Kant's position on this issue throughout his critical system. Since more than 50 years Kant scholars debate the question whether the Law of Right as introduced in the Metaphysics of Morals by Kant can be justified by the Categorical Imperative. On the one hand we have those who think that Kant's theory of right depends from the Categorical Imperative, on the other hand we find a growing group of scholars who deny this. However, the debate has been flawed by confusion and misunderstanding of the crucial terms and principles. Therefore, (...) my first task will be to clarify these terms and principles by introducing distinctions that have been neglected too often. After this I try to show a) that the Law of Right can in fact be justified by using the testing method the Categorical Imperative prescribes and b) that there is no other way to justify it. Doing this I criticize in detail the new arguments adherents of the independence thesis have recently put forward. (shrink)

This article argues that Fichte is correct in claiming, as he does in the Foundations of Natural Right, that a derivation of the law of right from the moral law is impossible because the former relies on lex permissiva. I focus on Kant’s deduction of the concept of merely intelligible possession in the Metaphysics of Morals precisely because Kant attempts what Fichte says is not possible. By illustrating the problems involved in the concept of the lex permissiva, one is then (...) in a position to see why Fichte believes the derivations mustremain separate and why Fichte stresses that the law of right must be argued for without reference to morality or the moral law. The author argues that despite universal and formal character of the foundation of Kant's ethics, its principles appear to be compatible with recognition of the possibility of lying for philanthropic reason. To have an effect in the world, our obligations must necessarily have empirical components that point to specific conditions, under which the maxim will have a moral worth. One of such condition may be the requirement that probable consequences of the action will not clash with other obligations.

Recently, there has been some discussion about the relationship between Kant's conception of right (the sphere of juridical rights and duties) and his moral theory (with the Categorical Imperative as its fundamental norm). In section 1, I briefly survey some recent contributions to this debate and distinguish between two different questions. First, does Kant's moral theory (as developed in the Groundwork and the Critique of Practical Reason ) imply , or validate, a Kantian conception of right (as developed in the (...) first part of the Metaphysics of Morals , the Doctrine of Right)? In other words, is the Categorical Imperative sufficient to show that the fundamental principles of right are normatively valid? Second, does Kant's conception of right presuppose his moral theory? In other words, is the Categorical Imperative necessary to show that the basic principles of right are normatively valid? In this paper, I will be primarily concerned with defending a negative answer to the first of these questions. In section 2, I will discuss Paul Guyer's attempt to vindicate a positive answer to the same question. In section 3, reasons will be given why any attempt to derive Kant's conception of right from the Categorical Imperative must fail because of the analytic connection between right and coercion.
