Many individuals with disabling conditions have difficulty with gait and balance control that may result in a fall. Exoskeletons are becoming an increasingly popular technology to aid in walking. Despite being a significant aid in increasing mobility, little attention has been paid to exoskeleton features to mitigate falls. To develop improved exoskeleton stability, quantitative information regarding how a user reacts to postural challenges while wearing the exoskeleton is needed. Assessing the unique responses of individuals to postural perturbations while wearing an (...) exoskeleton provides critical information necessary to effectively accommodate a variety of individual response patterns. This report provides kinematic and neuromuscular data obtained from seven healthy, college-aged individuals during posterior support surface translations with and without wearing a lower limb exoskeleton. A 2-min, static baseline standing trial was also obtained. Outcome measures included a variety of 0 dimensional measures such as center of pressure RMS, peak amplitude, velocities, pathlength, and electromyographic RMS, and peak amplitudes. These measures were obtained during epochs associated with the response to the perturbations: baseline, response, and recovery. T-tests were used to explore potential statistical differences between the exoskeleton and no exoskeleton conditions. Time series waveforms of the COP and EMG data were also analyzed. Statistical parametric mapping was used to evaluate the 1D COP and EMG waveforms obtained during the epochs with and without wearing the exoskeleton. The results indicated that during quiet stance, COP velocity was increased while wearing the exoskeleton, but the magnitude of sway was unchanged. The OD COP measures revealed that wearing the exoskeleton significantly reduced the sway magnitude and velocity in response to the perturbations. There were no systematic effects of wearing the exoskeleton on EMG. SPM analysis revealed that there was a range of individual responses; both behaviorally and among neuromuscular activation patterns. Using both the OD and 1D measures provided a more comprehensive representation of how wearing the exoskeleton impacts the responses to posterior perturbations. This study supports a growing body of evidence that exoskeletons must be personalized to meet the specific capabilities and needs of each individual end-user. (shrink)

Abstract:Therapeutic misconception (TM)—when clinical research participants fail to adequately grasp the difference between participating in a clinical trial and receiving ordinary clinical care—has long been recognized as a significant problem in consent to clinical trials. We suggest that TM does not primarily reflect inadequate disclosure or participants’ incompetence. Instead, TM arises from divergent primary cognitive frames. The researchers’ frame places the clinical trial in the context of scientific designs for assessing intervention efficacy. In contrast, most participants have a cognitive frame (...) that is personal and focused primarily on their medical problems. To illustrate this, we draw on interview material from both clinical researchers and participants in clinical trials. We suggest that reducing TM requires encouraging subjects to adjust their frame, not just add information to their existing frame. What is necessary is ascientific reframingof participation in a clinical trial. (shrink)

ABSTRACT: How can we think about a universal ethics that could be adopted by any intelligent being, including the rising population of cyborgs, intelligent machines, intelligent algorithms or even potential extraterrestrial life? We generally give value to complex structures, to objects resulting from a long work, to systems with many elements and with many links finely adjusted. These include living beings, books, works of art or scientific theories. Intuitively, we want to keep, multiply, and share such structures, as well as (...) prevent their destruction. Such objects have value not because more information would simply mean more value. Instead, they have value because they require a long computational history, numerous interactions for their construction that we can assimilate to a computation, and they display what we call organized complexity. To propose the foundations of a universal ethics based on the intrinsic value of organized complexity, we first discuss conceptions of complexity, and argue that Charles Bennett’s logical depth is certainly a first approximation of what we are looking for. We then put forward three fundamental imperatives: to preserve, augment and recursively promote organized complexity. We show a broad range of applications with human, non-human and non-living examples. Finally, we discuss some specific issues of our framework such as the distribution of complexity, of managing copies and erasures, and how our universal ethics tackles classical ethical issues. In sum, we propose a clear, homogenous and consistent ethical foundation that can integrate many universal ethics desiderata. (shrink)

Las personas se alejan de la sociedad sin percatarse que podrían estar camino a su autodestrucción, en tanto se forjen débiles frente al poder del Estado. Serán los actores estatales quienes aprovechen este escenario de desconexión para tomar decisiones que controlen esa “individualidad”. Ello podría estar beneficiando (...) a una clase política perversa – plagada de actores individualistas – que aprovecha estos espacios de indiferencia ciudadana para su favorecimiento. En ese sentido, Taylor desarrolla su “Teoría de los tres malestares de la Modernidad”, donde describe aspectos sobre el individualismo y la razón instrumental que han trascendido a los gobiernos por ser de suma importancia, aislando a los individuos de la sociedad y permitiendo que emerja el despotismo blando como un poder tutelar que deja a los ciudadanos indefensos frente al Estado, siendo la participación política su única manera de defenderse. After a brief summary of the 17 essays in Sally Haslanger’s (2012) collection, Resisting Reality: Social Construction and Social Critique, I raise questions in two areas, the defense of constructionism and the definition of gender and race in terms of social oppression. I cite Robin Andreasen’s and Philip Kitcher’s essays arguing (in different ways) that races are both biologically real and socially constructed, and also Joshua Glasgow’s claim that constructionist arguments ultimately fail. I then cite Jennifer Saul’s critique that “oppression” (...) definitions of gender and race run into problematic counterexamples, and add some other points arising from the different histories of gender and racial categories and realities. As someone sympathetic to constructionism myself, my aim is not a critique of Haslanger but rather an inquiry as to how she thinks (we) constructionists should answer such challenges. (shrink)

In this paper I consider Stich's principle of autonomy argument (From Folk Psychology To Cognitive Science) as an argument that computationalism is an incorrect approach to explanation and prediction in cognitive science. After considering the principle of autonomy argument in light of several computational systems and psychological examples, I conclude that the argument is unsound. I formulate my reasons for rejecting Stich's argument as unsound into the conjunction argument. Finally, I argue that the conjunction argument is sound, and that its (...) soundness adds additional plausibility to computationalism as an explanatory schema in cognitive science. (shrink)

Many believe that colleges of business have a role to play in improving the level of marketing ethics practiced in the business world, while others believe that by the time students reach the level of university education, their ethical beliefs are so ingrained as to be virtually unalterable. The purpose of this study is to add to the literature regarding university students' ethical value judgments. It utilizes scenario studies to assess base line ethical values of junior level undergraduate business administration (...) students, then techniques are employed to influence students' perceptions of the ethics of various marketing practices, and students' values are reassessed. A total of 667 junior and senior level students majoring in business administration participated in the pre-tests and 525 students participated in the post-tests. The results of the before/after studies indicate that some experimental techniques are more effective than others in affecting change, but it is difficult to affect long-run change in those predisposed to unethical behavior. Our paper contributes to Science, Technology and Society scholarship on the practices and technologies of containment. We build on existing work in STS that has analyzed containment as a performative sociotechnical system that generates and sustains new realities, new systems, and new relationships. Our contribution draws from the problem of containment in salmon aquaculture. The stakes for containing salmon are very high. Farmed salmon escapes are environmentally damaging to ecosystems and wild salmon populations, and they put additional pressure on an (...) industry that has a very poor environmental record. We consider in detail Newfoundland and Labrador’s “Code of Containment” that works to keep farmed salmon in cages and prevent them from escaping into the wild. Through our analysis of the Code, we argue that containment is not only about holding inside. It is also about holding together, an obsolete meaning of the term “to contain.” We add to STS scholarship by arguing that containment and its associated Code in Newfoundland holds together a large scale, industrial aquaculture sector that tolerates persistent farmed salmon escapes into the wild from ocean-based cages. We conclude by examining the broader implications of our analysis for STS scholarship on the practices and technologies of containment. (shrink)

Can an explanation of a set of beliefs cast doubt on the things believed? In particular, can an evolutionary explanation of religious beliefs call the contents of those beliefs into question? Yes - under certain circumstances. I distinguish between natural histories of beliefs and genealogies. A natural history of a set of beliefs is an explanation that puts them down to naturalistic causes. (I try to give an account of natural explanations which favors a certain kind of ‘methodological atheism’ without (...) begging any crucial questions against theists.) A genealogy is an explanation which somehow subverts the claims believed, usually by putting down the beliefs to unreliable causal mechanisms. Some genealogies are natural histories, such as Aquinas’s explanation of the prevalence of Islam and Gibbon’s explanation of the prevalence of Christianity. But not all genealogies are natural histories and not all natural histories are genealogies: witness the Primitive Christians’ explanation of the prevalence of Paganism which relies crucially on supernatural agencies and Hume’s explanation of our moral beliefs which defines moral truth in terms of the idealized outputs of our natural belief-forming mechanisms. However both believers and non-believers postulate a natural propensity of to devotion on the part of human beings a ‘sensus divinitatis’ which often results in false positives and is therefore unreliable. Thus the evolutionary explanation of this propensity does not add much to the skeptical case against religion. I conclude by arguing, as against Plantinga that since on his own showing our sensus divinitatis often malfunctions under optimum conditions, its unreliability constitutes a defeater for the claim that Christian beliefs are properly basic. In The Scientific Image B. C. van Fraassen argues that a theory of explanation ought to take the form of a theory of why-questions, and a theory of this form is what he provides. Van Fraassen's account of explanation is good, as far as it goes. In particular, van Fraassen's theory of why-questions adds considerable illumination to the problem of alternative explanations in psychodynamics. But van Fraassen's theory is incomplete because it ignores those classes of explanations that are answers not (...) to why-questions but to how-questions. In this article I provide a unified theory of explanatory questions that comprehends both how-questions and why-questions, and I show that a question-theoretic approach to explanation can be defended independently of van Fraassen's programme of Constructive Empiricism. In 1998 I asked my friend Tjiniman, who is a stone-age hunter, to give us his non-western perspective on ‘Tucson III’ (Murinbata&Whitehead, 1998).Most people thought I just made Tjiniman up and the whole thing was intended as a joke, and he has spent the last two years worrying about this. Since then he has gained a modest BSc in Social Anthropology, though in my view the examiners failed to appreciate some of his less obvious insights, and he deserved a higher (...) mark. He now has a better understanding of us white people and our ways, and this is his second attempt to make us see the truth. He did ask me to edit his text and take out anything that white people might mistake for a joke, but in many cases he accused me of cutting the best bits and made me put them back in. Dear Comrades, On Saturday the 18th of September, I received what purports to be a ‘backgrounder’ on Alliance revenue policy. I say ‘purports’ because as a backgrounder it leaves a lot to be desired. a) Anyone not already familiar with the issues would have considerable difficulty working out what the dispute is all about. b) You would expect a REAL backgrounder on what is a controversial matter within the federal Party to present BOTH sides of the question. This ‘backgrounder’ is (...) a one-sided polemic in favour of one option, an option which breaks with previous Alliance policy and which is vehemently opposed by at least ONE of the federated parties (the NLP). It is true that the document is a badly argued and not very convincing polemic, but its defects as a polemic don’t add up to virtues as a backgrounder. This reply is an attempt a) to explain the issues, b) to argue for the alternative option and c) to respond to the backgrounder. It is a labour I perform with some reluctance and not a little difficulty since I don’t have access to much of the relevant data. I resent the fact that I have had to spend so much time on this task when a more even-handed backgrounder or a companion piece explaining the NLP’s alternative would have saved me the trouble. Undemocratic attempts to manipulate the debate - which is what this backgrounder seems to be - are not just shabby in themselves: they tend to waste the time and the energy of party workers. This paper deals with what I take to be one woman’s literary response to a philosophical problem. The woman is Jane Austen, the problem is the rationality of Hume’s ‘sensible knave’, and Austen’s response is to deepen the problem. Despite his enthusiasm for virtue, Hume reluctantly concedes in the EPM that injustice can be a rational strategy for ‘sensible knaves’, intelligent but selfish agents who feel no aversion towards thoughts of villainy or baseness. Austen agrees, but adds that ABSENT CONSIDERATIONS (...) OF A FUTURE STATE, other vices besides injustice can be rationally indulged with tolerable prospects of worldly happiness. Austen’s creation Mr Elliot in Persuasion is just such an agent – sensible and knavish but not technically ‘unjust’. Despite and partly because of his vices – ingratitude, avarice and duplicity – he manages to be both successful and reasonably happy. There are plenty of other reasonably happy knaves in Jane Austen, some of whom are not particularly sensible. This is not to say that either Austen or Hume is in favor of knavery It is just that they both think that only those with the right sensibility can be argued out of it. (shrink)

In this paper we examine the thesis that the probability of the conditional is the conditional probability. Previous work by a number of authors has shown that in standard numerical probability theories, the addition of the thesis leads to triviality. We introduce very weak, comparative conditional probability structures and discuss some extremely simple constraints. We show that even in such a minimal context, if one adds the thesis that the probability of a conditional is the conditional probability, then one trivializes (...) the theory. Another way of stating the result is that the conditional of conditional probability cannot be represented in the object language on pain of trivializing the theory. (shrink)

Magnetic resonance imaging is a noninvasive imaging tool that utilizes a strong magnetic field and radio frequency waves to visualize in great detail organs, soft tissue, and bone. Unlike conventional x-rays, there is no exposure to ionizing radiation and at most field strengths the procedure is considered safe for nearly every age group. Because it is non-invasive and possesses excellent spatial resolution, the use of MRI as a research tool has increased exponentially over the past decade. Uses have ranged from (...) add-ons to a clinical study to studies of brain development in typically developing children. In addition, a major effort has been made in recent years to use MRI to study brain function. Because the clinical utility of fMRI has not yet been realized, fMRI is still considered highly exploratory, and we cannot yet identify incidental findings of a functional nature. (shrink)

Martin was a twenty-nine-year-old anthropologist working on animism in Siberia when a bear leaped on her. He raked her with his claws, put her head into his mouth, and was about to crush her skull when she stabbed him with her ice axe. He loped off into the woods, carrying part of Martin's lower jaw and, if Martin is right, half of her soul—but leaving half of his soul in return. Martin lay bleeding in the snow. She managed to fashion (...) a tourniquet that slowed the bleeding from her leg. Miles away, a friend was fishing. He fell backward and blacked out. When he came to, he knew that something bad had happened to Martin.But was it bad?It certainly seemed so for a while. A Russian helicopter lifted her to hospital. Her wounds were treated, but the hospital seemed more brutal than the bear. She was strapped to the bed, unable to move her arms or legs. She wheezed through a tracheostomy tube. A malevolent nurse rammed food agonizingly into her with a syringe. Copulating doctors and nurses moaned and grunted in the side room next to her. Her jaw was roughly screwed together. On the plane back to France, the low cabin pressure reopened her scars. Her weeping mother dabbed at the blood with a tissue. In the French hospital, Martin took off her bandages in front of the mirror and wept “for my bear, for my old, lost face.”She had been invaded. She was now half-human, half-bear, a Siberian friend had told her: “He didn't want to kill you, he wanted to mark you. Now you are medka, she who lives between the worlds.” To be healed, she had to forgive the bear, for she would not otherwise forgive herself. At night she went “underground” to “speak to my bear.” Her head was “a ball scored with swollen red-claw marks and sutures. I am nothing like myself anymore, and yet I've never looked more like my own spirit; it has been imprinted on my body.”The invading bear had created a bridgehead into her. Other entities followed. The most immediately dangerous were bacteria and surgical scalpels. The surgeons did not know what they were toying with: “My body has become a territory where Western surgeons parley with Siberian bears. Or rather, where they try to establish communication.”The surgeons never did establish communication, and so their sort of healing would not work. Martin knew that she would only find healing in her “lair” in the Siberian forest, from those “who know bears and the questions they bring with them, who still speak with them in their dreams, who know that nothing happens by chance.” And so back she went.There was no epiphany. But there was the quiet healing that comes from recruiting all the agencies in the tundra; in distilling agency itself and dripping it over her wounds. And asking the right questions can heal too. The right questions are questions that are too big for answers.What is this book about? Martin is clear that what did not happen was that “a bear attack[ed] a French anthropologist somewhere in the mountains of Kamchatka.” What did happen was that “a bear and a woman [met] and the frontiers between two worlds implode[d].... Mythical time meets reality; past time joins the present moment; dream meets flesh.”Eye of the Wild poses an unnerving set of fundamental questions about what it means to say, as we all blithely do: “I am”—about how many souls we can accommodate, how we can broker a respectful or at least tolerable conversation between them; about our porosity to the cosmos we comfortingly assert is out there. This book is plangent, frigid, and chilling. It is a mosaic of jagged fragments that, viewed in the right light, perhaps add up to the scarred face of a young woman, all the lovelier for the scars. Yet the fragments do not add up to a proposition, for this is a book about what happens when you are brave enough to go to a place where no proposition could ever land. (shrink)

In a recent article entitled “Scepticism and Knowing That One Knows”, Michael Hall poses a sceptical argument based upon two rules of inference:where ‘Kp’ stands for ‘it is known that p'. The argument goes:Hall attacks R2, but he says little about R1. I wish to add a few words of warning about R1 as well.

Two studies reported in the Journal of Medical Ethics add to the growing body of qualitative evidence relating to the use of sedatives at the end of life.1 ,2 Respondents in the two studies affirm a number of important concerns, most of which have been elaborated in the philosophy and palliative care literature, relating to the use of sedation. There seems little doubt that the common moral thread to most of these concerns is the possibility that end-of-life sedation can resemble (...) assisted death.Most of the Dutch respondents in the paper by Reitjens et al1 were reported to believe that sedation does not hasten death. That is an oversimplification. Were it not for the potential to hasten death, I doubt we would be discussing the use of sedatives so frequently in ethics journals. It is true that there is little evidence that sedation significantly hastens death when doses are carefully titrated against symptoms—giving only that amount of a drug necessary to make the patient feel less distressed, and preserving consciousness as far as possible.3 Probably most sedative …. In this first volume of original essays on rhetorical criticism to appear in many years, the authors stress active engagement in the critical process. Bearing in mind the complaint frequently leveled at rhetorical criticism—that method as method has taken precedence over understanding and appreciation—the editors encouraged innovation, and the contributors responded by moving beyond the merely theoretical to explore implications through implied criticism, participating in the activity rather than merely talking about it. Consequently, these essays avoid further lamentation over the (...) current state of the art and concentrate instead on constructive presentations. Not only do the essays add significantly to knowledge about rhetorical criticism, but they also serve liberal education by helping to bring understanding, discrimination, and appreciation to the entire process of human communication. The central view of this dissertation is that a more comprehensive theory of scientific learning must incorporate insights from the disciplines of methodology and sociology. The standards of methodology play an indispensible role in learning by providing some of the principles necessary for theoretical evaluation. But such principles are not sufficient for socially embedded learning and they do not exclude the operation of social interests within science. It is the institutional structure of science that helps make up what abstract standards (...) alone lack: the material means with which to affect the advancement of learning. Institutions add something of their own dynamic to learning by helping to realize the abstract principles of methodology--they are never simply neutral husks. ;The views of a number of methodologists and sociologists are examined to demonstrate that this view of learning has not always been appreciated. Some methodologists have thought that by developing a theory of scientific method they were ensuring science's insulation from society at large. Such projects expect too much of methodology and the best methodology we have--fallibilism--leaves science open to social influence. Some sociologists have seen the role of a social theory as cutting across that of methodology--as if a social account of learning could only be at the expense of methodology. This had led some to deny methodology any explanatory power and others to limit sociology to accounting for merely the external aspects of scientific development. ;I throughout try to suggest how learning may be best accounted for by a fallibilist methodology combined with an institutional social theory. Such a dual view of learning is helpful because the advancement of learning is at times as dependent on its material constraints as on its intellectual ones. Thus, a comprehensive theory of learning can help science be a more critical enterprise and so contribute to its advancement. (shrink)

This paper examines the issue of acid mine drainage in South Africa and environmental decision making processes that could be taken to mitigate the problem in the context of both conventional risk assessment and the precautionary principle. It is argued that conventional risk assessment protects the status quo and hence cannot be entirely relied upon as an effective tool to resolve environmental problems in the context of South Africa, a developing country with complex environmental health concerns. The complexity of the (...) environmental issues is discussed from historical and political perspectives. An argument is subsequently made that the precautionary principle is an alternative tool, and its adoption can be used to empower local communities. This work, therefore, adds to new knowledge by problematising conventional risk assessment and proposing the framing of the acid mine drainage issues in a complex and contextual scenario of a developing country—South Africa. Monetary Intelligence theory asserts that individuals apply their money attitude to frame critical concerns in the context and strategically select certain options to achieve financial goals and ultimate happiness. This study explores the bright side of Monetary Intelligence and behavioral economics, frames money attitude in the context of pay and life satisfaction, and controls money at the macro-level and micro-level. We theorize: Managers with low love of money motive but high stewardship behavior will have high subjective well-being: pay satisfaction and (...) quality of life. Data collected from 6586 managers in 32 cultures across six continents support our theory. Interestingly, GDP per capita is related to life satisfaction, but not to pay satisfaction. Individual income is related to both life and pay satisfaction. Neither GDP nor income is related to Happiness. Our theoretical model across three GDP groups offers new discoveries: In high GDP entities, “high income” not only reduces aspirations—“Rich, Motivator, and Power,” but also promotes stewardship behavior—“Budget, Give/Donate, and Contribute” and appreciation of “Achievement.” After controlling income, we demonstrate the bright side of Monetary Intelligence: Low love of money motive but high stewardship behavior define Monetary Intelligence. “Good apples enjoy good quality of life in good barrels.” This notion adds another explanation to managers’ low magnitude of dishonesty in entities with high Corruption Perceptions Index. In low GDP entities, high income is related to poor Budgeting skills and escalated Happiness. These managers experience equal satisfaction with pay and life. We add a new vocabulary to the conversation of monetary intelligence, income, GDP, happiness, subjective well-being, good and bad apples and barrels, corruption, and behavioral ethics. (shrink)

Previous research has demonstrated that ratings of the perceived pleasantness and quality of odors can be modulated by auditory stimuli presented at around the same time. Here, we extend these results by assessing whether the hedonic congruence between odor and sound stimuli can modulate the perception of odor intensity, pleasantness, and quality in untrained participants. Unexpectedly, our results reveal that broadband white noise, which was rated as unpleasant in a follow-up experiment, actually had a more pronounced effect on participants’ odor (...) ratings than either the consonant or dissonant musical selections. In particular, participants rated the six smells used as being less pleasant and less sweet when they happened to be listening to white noise, as compared to any one of the other music conditions. What is more, these results also add evidence to support the existence of a close relationship between an odor’s hedonic character and the perception of odor quality. So, for example, independent of the sound condition, pleasant odors were rated as sweeter, less dry, and brighter than the unpleasant odors. These results are discussed in terms of their implications for the understanding of crossmodal correspondences between olfactory and auditory stimuli. (shrink)

The extant clinical literature indicates profound problems in the assessment, monitoring, and documentation of care in long-term care facilities. The lack of adequate resources to accommodate higher staff-to-resident ratios adds additional urgency to the goal of identifying more costeffective mechanisms to provide care oversight. The ever expanding array of electronic monitoring technologies in the clinical research arena demands a conceptual and pragmatic framework for the resolution of ethical tensions inherent in the use of such innovative tools. CareMedia is a project (...) that explores the utility of video, audio and sensor technologies as a continuous real-time assessment and outcomes measurement tool. In this paper, the authors describe the seminal ethical challenges encountered during the implementation phase of this project, namely privacy and confidentiality protection, and the strategies employed to resolve the ethical tensions by applying principles of the interest theory of rights. Early nineteenth century systematists sought to describe what they called the Natural System or the Natural Classification. In the nineteenth century, there was no agreement about the basis of observed patterns of similarity between organisms. What did these systematists think they were doing, when they named taxa, proposed relationships between taxa, and arranged taxa into representational schemes? In this paper I explicate Charles Frederic Girard’s (1822–1895) theory and method of systematics. A student of Louis Agassiz, and subsequently (1850–1858) a (...) collaborator with Spencer Baird, Girard claimed that natural classificatory methods do not presuppose either a special creationist or an evolutionary theory of the natural world. The natural system, in Girard’s view, comprises three distinct ways in which organisms can be related to each other. Girard analyzed these relationships, and justified his classificatory methodology, by appeal to his embryological and physiological work. Girard offers an explicit theoretical answer to the question, what characters are evidence for natural classificatory hypotheses? I show that the challenge of simultaneously depicting the three distinct types of relationship led Girard to add a third dimension to his classificatory diagrams. (shrink)

The mathematical works of the French philosopher Charles de Bovelles have received little attention from historians of scientific thought. At the University of Paris, Bovelles studied under Jacques Lefèvre d'Étaples, sharing with him a high regard for the Christian Neoplatonic philosophy of Nicholas of Cusa. One aspect of Cusanus's philosophy was particularly favoured by Lefèvre and Bovelles: the use of geometrical symbolism to provide mathematical guidance to the divine. While Lefèvre was preparing an edition of Cusanus's works , Bovelles (...) wrote a treatise of his own, in which the geometry of the five polyhedra was used to provide an approach to the mystery of the Trinity. Seen in the context of Renaissance syncretism of Platonism and Christianity, Bovelles's treatise adds a theological layer of interpretation to the literal meaning of the polyhedral physics described by Plato in the Timaeus. In so doing, it contributes to the discussion of a problem that was later to concern several Renaissance philosophers and cosmologists, including, at the end of the century, Johannes Kepler. These reflections elaborates the theory of The Idea of Human Rights by addressing a topic that theory attempts to bracket: international and regional judicialization in the form of international courts and tribunals. Using the method of reflective equilibrium, the article argues that this exclusion is inconsistent. Including these international courts and tribunals (‘ICs’) prompts several changes to the original theory, and opens new research questions. The original theory is on the one hand too narrow regarding both the objectives and tools (...) of international mechanisms of corrective concern. The account should consider further subsidiary modes of support. On the other hand the theory is too broad, in that it gives insufficient guidance to the judges of ICs and others able to effect changes. This leaves the theory incomplete, and open to similar criticism as the book raised against others. Accounts of the theory presented in The Idea of Human Rights,and of ICs and their roles regarding human rights allow us to explore some implications of ICs for The Idea of Human Rights.We then consider how if at all The Idea of Human Rights can guide international judges. This article further systematizes the existential body, contributing to the ethnographic model of embodied objectivity. It situates embodiment as the foundation of knowledge, demonstrating its underdevelopment in anthropological literature. The paper explores the philosophical relationship between being-in-the-world and Merleau-Ponty’s body-proper, emphasizing the central role of embodied pre-objective signification in representational ethnographic knowing. This aspect is often insufficiently addressed, particularly in light of certain ethnographic applications of the epoché. The paper concludes that, given the oscillatory apprehension of embodiment, the use of (...) terms like “systematizing” and “inter-objectivity” adequately enhances its portrayal as a pre-objective phenomenon rather than an objective one. This article focuses on defective conditionals ? namely indicative conditionals whose antecedents are false and whose truth-values therefore cannot be determined. The problem is to decide which formal connective can adequately represent this usage. Classical logic renders defective conditionals true whereas traditional mathematics dismisses them as irrelevant. This difference in treatment entails that, at the propositional level, classical logic validates some sentences that are intuitively false in plane geometry. With two proofs, I show that the same flaw is shared by (...) a family of trivalent logics. I go on to examine the strict conditional and its derivatives. This family is the only one to avoid the faulty inference but it does so without addressing the status of the truth-value assigned to defective conditionals. (shrink)

At the very beginning of L’Homme-Machine, La Mettrie claims that Leibnizians with their monads have “rather spiritualized matter than materialized the soul”; a few years later Pierre-Louis Moreau de Maupertuis, President of the Berlin Academy of Sciences and natural philosopher with a strong interest in the modes of transmission of ‘genetic’ information, conceived of living minima which he termed molecules, “endowed with desire, memory and intelligence,” in his Système de la nature ou Essai sur les corps organisés. This text first (...) appeared in Latin in 1751 under the title Dissertatio inauguralis metaphysica de universali naturae systemate, with the pseudonym Dr Baumann; it was translated by Maupertuis in 1754 as Essai sur la formation des corps organisés and was later included in his 1756 Œuvres under the title Système de la nature. Now, it is clear that Maupertuis was a kind of Leibnizian; and that his molecule possessed higher-level, ‘mental’ properties. In that sense he falls under the first category described by La Mettrie. But he was also involved in a debate on this issue with Diderot, who put forth a sustained critique of Maupertuis’ theory of the molecule in the additions to his 1753 Pensées sur l’interprétation de la nature. Where Maupertuis attributes higher-level properties to his living minima, Diderot argues that these properties are ‘organizational’, i.e., they can only be properties of the whole. At issue here is the degree of commitment to a form of materialism. (shrink)

In his Philosophical Inquiry concerning Human Liberty (1717), the English deist Anthony Collins proposed a complete determinist account of the human mind and action, partly inspired by his mentor Locke, but also by elements from Bayle, Leibniz and other Continental sources. It is a determinism which does not neglect the question of the specific status of the mind but rather seeks to provide a causal account of mental activity and volition in particular; it is a ‘volitional determinism’. Some decades later, (...) Diderot articulates a very similar determinism, which seeks to recognize the existence of “causes proper to man” (as he says in the Réfutation d’Helvétius). The difference with Collins is that now biological factors are being taken into account. Obviously both the ‘volitional’ and the ‘biological’ forms of determinism are noteworthy inasmuch as they change our picture of the nature of determinism itself, but my interest here is to compare these two determinist arguments, both of which are broadly Spinozist in nature – and as such belong to what Jonathan Israel called in his recent book “the radical Enlightenment,” i.e. a kind of underground Enlightenment constituted by Spinozism – and to see how Collins’ specifically psychological vision and Diderot’s specifically biological vision correspond to their two separate national contexts: determinism in France in the mid-1750s was a much more medico-biological affair than English determinism, which appears to be on a ‘path’ leading to Mill and associationist psychology. Kierkegaard’s ideal supports a radical form of “deep diversity,” to use Charles Taylor’s expression. It is radical because it embraces not only irreducible conceptions of the good but also incompatible ones. This is due to its paradoxical nature, which arises from its affirmation of both monism and pluralism, the One and the Many, together. It does so in at least three ways. First, in terms of the structure of the self, Kierkegaard describes his ideal as both unified (the “positive (...) third”) and plural (a “negative unity”). Second, he affirms a process which brings together unity, as implied by the linear notion of “stages”, with plurality, in the form of “spheres of existence” (aesthetic, ethical, and religious). And third, the culmination of the process implies that we should embrace both a unified dialectic (“Religiousness A”) alongside the plural remnants of the ethical/aesthetic, that is, both the infinity of the former and the finitudes of the latter. Unsurprisingly, while Kierkegaard describes those who are able to exemplify his ideal in practice as “always joyful,” he also considers the ideal to be “extremely hard, the hardest task of all.” This is why those such as Hubert L. Dreyfus are wrong to claim that it provides an experience of bliss; on the contrary, those who realize it “are always in danger.” As I shall show, one form this danger takes is that it threatens to dirty the hands of those who manage to uphold Kierkegaard’s ideal. Moreover, it does so in ways that, I claim, tend to be missed by Kierkegaard himself. Nevertheless, the danger is also essential to the creativity of his approach, and I conclude by pointing out how this creativity makes it capable of tackling one of the profoundest challenges in contemporary ethics: that arising from what just war theorists call a “supreme emergency.” . En este artículo me propongo abordar el problema del tiempo en las sociedades contemporáneas desde un diálogo entre las construcciones teóricas de Moishe Postone y Hartmut Rosa y el trabajo de Michel Foucault. Los dos primeros se han centrado en explicar cómo la temporalidad se ha convertido en un tipo de dominación abstracta, impersonal y cuasiobjetiva a partir de conceptos como la densificación temporal, la aceleración o la hibridación. Foucault, en cambio, concibe el tiempo bajo el prisma de la racionalidad (...) política neoliberal, por la cual el tiempo pasa a ser un recurso que debe gestionarse por los sujetos en términos empresariales y que termina por configurar una ética neoliberal de la administración del tiempo. Este diálogo ejemplifica de manera privilegiada la tensión entre la coacción o la presión temporal y la administración estratégica del tiempo propia de las sociedades contemporáneas. (shrink)

ABSTRACT Legal certainty is a central requirement for the rule of law. Legal systems should both enable those subject to law to predict human behaviour and institutional reactions and to prevent an arbitrary use of state power against them. The value of legal certainty is usually conceived as a formal value opposed to the values of freedom or equality. The purpose of this paper is to discuss this idea and to explore a less formal conception of the value of legal (...) certainty. In this sense, I will argue that we need to depart from a purely formal understanding of the requirements imposed by such value and to consider the need to provide them with a substantive content. So, legal certainty is not completely independent of legal substantive justice and it implies that it is impossible to define ex ante which concrete aspects of justice should not be the law’s concern.
