Las oraciones con predicados evaluativos son sensibles a la valoración realizada según un parámetro evaluativo contextual. Dos teorías han proporcionado explicaciones para este tipo de sensibilidad: el contextualismo y el relativismo de apreciación. En este trabajo presentaré una tercera opción que logra lo mismo que estas de una manera más sencilla. La teoría se centrará en dos pilares: una reconsideración del contenido expresado por las oraciones con predicados de gusto que parte de la articulación del parámetro evaluativo como una función (...) diádica, y los compromisos que la aserción de este tipo de oraciones impone sobre los hablantes y sobre el auditorio. Con ambas herramientas se logrará una teoría que podrá dar cuenta de acuerdos, desacuerdos y usos ecóicos de las oraciones evaluativas sin apelar a contextos de apreciación suplementarios a la teoría semántica estándar o a presupuestos de comunidad de los parámetros evaluativos. Sentences with evaluative predicates are sensitive to the valuation carried on under an evaluative parameter in the context. Two theories have provided an account for this kind of context-sensitivity: contextualism and assessment relativism. In this paper I will present a third alternative that achieves the same results in a simpler way. This theory is based on two main ideas: understanding the content expressed on the basis of an articulation of the evaluative parameter as a dyadic function, and the practical and linguistic commitments that the assertion of these sentences imposes over speakers and hearers. Both tools will result in a theory that can manage agreements, disagreements and echoic uses of evaluative sentences without the need to supplement the standard semantic theory with contexts of assessment or with presuppositions of commonality of the evaluative standard. Although there seems to be an agreement on what slurs are, many authors diverge when it comes to classify some words as such. Hence, many debates would benefit from a technical definition of this term that would allow scholars to clearly distinguish what counts as a slur and what not. Although the paper offers different definitions of the term in order to allow the reader to choose her favorite, I claim that ‘slurs’ is the name given to a grammatical category, (...) and I consequently trace a difference in kind between slurs and other kinds of group pejoratives. I rely on a novel approach to slurs that characterizes them based on their membership to a particular kind of register category, an often neglected sociolinguistic notion determining the social contexts in which registered terms are expected, tolerated or unacceptable. The paper also points out to the close link between words registered as [+derogatory] and their usage in the context of dominance relations of different kinds between users and recipients of slurs. By pointing out to this link I hope to underscore the political significance of slur usage, as well as to contribute further to the explanation why slurs are so damaging and unacceptable in most social contexts. A recent quarrel over faultless disagreements assumes that disputes over evaluative sentences should be understood as regular, factual disagreements. Instead, I propose that evaluative disagreements should be understood in Lewisian terms. Language use works like a rule-governed game. In it, the assertion of an evaluative sentence is an attempt to establish one value as default in the conversation; its rejection, in turn, is in most cases the refusal to accept this move.

The relation between slurs and their neutral counterparts has been put into question recently by the fact that some slurs can be used to refer to subsets of the referential classes determined by their associated counterparts. This paper aims to reinforce this relation by offering a way of explaining referential restriction that distinguishes between two kinds of slurs: those performing a normalizing role upon (some) individuals inside a class (mostly, a gender) and those used to derogate a marginalized out- group.

Most theories of slurs fall into one of two families: those which understand slurring terms to involve special descriptive/informational content (however conveyed), and those which understand them to encode special emotive/expressive content. Our view is that both offer essential insights, but that part of what sets slurs apart is use-theoretic content. In particular, we urge that slurring words belong at the intersection of a number of categories in a sociolinguistic register taxonomy, one that usually includes [+slang] and [+vulgar] and always (...) includes [-polite] and [+derogatory]. Thus, e.g., what distinguishes ‘Chinese’ from ‘chink’ is neither a peculiar sort of descriptive nor emotional content, but rather the fact that ‘chink’ is lexically marked as belonging to different registers than ‘Chinese’. It is, moreover, partly such facts which makes slurring ethically unacceptable. (shrink)

En su trabajo acerca del debate Putnam-Rorty, Luis Robledo supone una concepción reduccionista de la justificación en Rorty, y defiende contra ella la indepen-dencia entre justificación y consenso, a través del argumento de la posibilidad de un consenso sin justificación. A su juicio, el no sostener una independencia tal conduciría a problemas desfavorables para el pragmatismo. En este trabajo buscaré presentar una interpretación alternativa y no reduccionista de la justificación rortiana, que aún sin reconocer una total independencia entre ambas instancias, (...) no sólo evita estos proble-mas, sino que además muestra que es poco pragmático el ejemplo proporcionado por Robledo en su argumentación. En The Varieties of Reference, Evans sostiene que el contenido perceptual posee una naturaleza no conceptual. Precisamente, los vínculos informacionales entre sujeto y objeto habilitan el pensamiento singular, al permitir la localización del objeto en un entorno egocéntrico. Anclados en algunos casos en estos vínculos, los pensamientos singulares contienen Ideas adecuadas del objeto, dependientes de una determinada clasificación del mismo. Nada en el contenido perceptual equivale a este recorte conceptual del objeto en el pensamiento. Sostendré entonces la necesidad de introducir (...) la idea de una representación no conceptual de cosa que recortaría, de dicho contenido, un punto de anclaje para la representación informacional. In The Varieties of Reference, Evans claims that perceptual content has a non-conceptual nature. Concretely, the informational links between subject and object allow singular thought by permitting the localization of the object in an egocentric space. Anchored in some cases in these links, singular thoughts contain adequate Ideas of the object that depend on a certain classification of it. Nothing in the perceptual content corresponds to this conceptual cut of the object in thought. I will therefore underline the need to introduce the idea of a non-conceptual representation of thing that will cut, in that content, an anchoring point for the informational representation. Evaluative sentences (moral judgments, expressions of taste, epistemic modals) are relative to the speaker's standards. Lately, a phenomenon has challenged the traditional explanation of this relativity: whenever two speakers disagree over them they contradict each other without being at fault. Hence, it is thought that the correction of the assertions involved must be relative to an unprivileged standard not necessarily the speaker's. I will claim instead that so far, neither this nor any other proposal has provided an explanation of the (...) phenomenon. I will point out several problems presented by them and I will hint to how this phenomenon could be explained by making minor adjustments to our semantic theory. Sentenças avaliativas (julgamentos morais, expressões de gosto, modos epistêmicos) são relativas aos padrões do falante. Recentemente, um fenômeno desafiou a explicação tradicional dessa relatividade: sempre que dois falantes discordam entre si, eles contradizem um ao outro sem estarem errados. Por isso, pensa-se que a correção das asserções envolvidas deve ser relacionada a um padrão desprovido de privilégio e não necessariamente ao padrão do falante. Eu sustentarei, ao contrário, que até agora nem esta nem alguma outra proposta forneceu uma explicação do fenômeno. Eu assinalarei diversos problemas apresentados por essas propostas e sugerirei o modo como este fenômeno poderia ser explicado ao fazer pequenos ajustes em nossa teoria semântica. (shrink)

Michael Devitt claims that the predicative material that constitutes complex referential expressions makes a semantic contribution to the proposition expressed. He thus deviates from direct referentialism, according to which every referential expression -either simple or complex- contributes just with an object to the proposition expressed, leaving the predicative material out of the semantic content. However, when dealing with misdescriptions, Devitt has suggested a pragmatic way out: the audience can understand what the speaker is referring to even if the object does (...) not fall under the corresponding description. From my perspective, this proposal questions the semantic validity of the predicative material, together with Devitt's original claim. In this paper, I propose a way to solve the problem posed by misdescriptions that appeals to the idea of epistemically relativized properties, according to which the properties ascribed to the object -by means of the predicative material- correspond to the way the speaker thinks of it and not to the way the object really is. Michael Devitt sostiene que el material predicativo que constituye las expresiones referenciales complejas hace un aporte semántico a la proposición expresada, alejándose así del referencialismo directo, para el cual toda expresión referencial -sea ésta simple o compleja- contribuye sólo con un objeto singular a la proposición expresada. Sin embargo, al enfrentarse al problema de las descripciones fallidas, Devitt ofrece una salida pragmática: el oyente comprende a qué se refiere el hablante aun cuando el objeto referido no caiga bajo la descripción utilizada. Esto pone en cuestión la validez semántica del material predicativo, desestimando la postura original de Devitt. En el trabajo propongo una solución a este problema, apelando a la idea de propiedades epistémicamente relativizadas, de acuerdo con la cual lo que se predica del objeto por medio del material predicativo corresponde a las creencias del hablante, y no a lo que el objeto realmente es. La teoría de los hacedores de verdad, como la vieja teoría correspondentista, intenta comprender la relación que, ligando proposiciones y hechos, resulta en la verdad (o falsedad) de las primeras. Esta teoría presenta una versión débil, que da cuenta de dicha relación en términos de la noción de implicación, y una fuerte, fundada en la relación de "ser verdadero en virtud de". La diferencia fundamental entre ambas es la adhesión y el rechazo, respectivamente, del Principio de Implicación, según el cual (...) dos proposiciones ligadas por implicación serán hechas verdaderas por el mismo hecho. El presente trabajo muestra cómo esta adhesión conduce a las versiones débiles al colapso, por lo cual sólo las versiones fuertes tienen oportunidades de prosperar. (shrink)

Competing theories on the semantics of group pejorative terms (also known as‘slurs’)comprise both advocates and opponents to the Identity Thesis (IT), according to whichthese terms and their neutral counterparts do not differ in semantic value. In the oppo-nents’camp, Christopher Hom has offered an argument based on substitution of slurs andneutral counterparts that both supports his semanticist approach and cast doubts on all IT-based approaches to slurs. We aim to point to a dilemma triggered by this argument based on evidence showing (...) that substitution of some words (including but not restricted to slurs)for non-problematically co-referential pairs may fail to preserve truth-values in some linguistics contexts. Why would we argue about taste, norms or morality when we know that these topics are relative to taste preferences, systems of norms or values to which we are committed? Yet, disagreements over these topics are common in our evaluative discourses. I will claim that the motives to discuss rely on our attitudes towards the standard held by the speakers in each domain of discourse, relating different attitudes to different motives –mainly, conviction and correction. Una de las críticas dirigidas a la teoría contrafáctica de la causación es el problema de la necesidad, según el cual la relación de dependencia contrafáctica entre causa y efecto no es necesaria para la existencia de relaciones causales. Este problema es, empero, fácilmente resoluble por la estrategia de fijación desarrollada por Yablo. En uno de sus escritos sobre el tema, Carolina Sartorio menciona un segundo problema, el problema de la suficiencia de dicha relación, que se instancia en casos de (...) causación que involucran eventos negativos. En el trabajo pretendo mostrar que, dado el modo en que Sartorio plantea estos casos, la teoría contrafáctica puede evadirse del problema apelando a la estrategia de fijación siempre que adopte, para ello, un reduccionismo moderado que no contradiga las intuiciones principales de la autora y un criterio mixto para la individuación de eventos, que combine tanto un criterio causal como un criterio regional. Existe un tipo particular de usos de términos discriminatorios en el que las emociones negativas típicamente asociadas a él no se hallan de hecho presentes. Aun así, lo incorrecto o inadecuado sigue resonando en esos usos. Este tipo de ``uso distante'' resulta interesante per se, en cuanto fenómeno conversacional rara vez advertido. Sin embargo, también presta apoyo a una aproximación a los términos discriminatorios basada en el concepto sociolingüístico de ``registro'', de la cual se sigue esta relación entre emociones e (...) incorrección. Para ello, se someterán a falsacionismo las tesis según las cuales la cualidad estructural es, primero, estructuralista y no analítica y, segundo, empírica, de acuerdo con la metodología holista de la ciencia. La crítica, así, se desarrollará a partir de los siguientes interrogantes. Inicialmente, ¿el autor acude al holismo o al reduccionismo como enfoques metodológicos de desarrollo? One of the main strategies against conceivability arguments is the so-called phenomenal concept strategy, which aims to explain the epistemic gap between physical and phenomenal truths in terms of the special features of phenomenal concepts. Daniel Stoljar has recently argued that the phenomenal concept strategy has failed to provide a successful explanation of this epistemic gap. In this paper my aim is to defend the phenomenal concept strategy from his criticisms. I argue that Stoljar has misrepresented the resources of the (...) strategy, which can indeed accomplish the required explanatory task, once it is properly understood. (shrink)

The hard problem of consciousness is about how we could explain in physicalist terms why we are conscious. The meta-problem of consciousness is about how we could explain why we have a hard problem of consciousness. In this note I argue that the phenomenal concept strategy can in principle provide a satisfactory solution to the meta-problem.

This paper investigates the role that universities play in supporting social entrepreneurs (SEs) across their ecosystem. Adopting the resource-based view (RBV) approach, we argue that universities attract, mobilize, and deploy multiple resources that benefit SEs through four main mechanisms (i.e., teaching, research, outreach, and the development of partnerships). We use a qualitative approach of 62 semi-structured interviews and 8 focus groups in Ecuador, Bolivia, and Colombia. Our contribution shows that employing different resources and engaging in supportive activities of universities towards (...) SEs facilitate the development of university capabilities, such as an increased reputation, development of leadership skills for students and staff, and wider access to ecosystem resources that support other university activities related to teaching, research, and community outreach. The role that partnerships play in the development of these capabilities is fundamental, thanks to the different strategic alliances and mobilization of resources between universities and other actors while supporting SEs. This study contributes to our understanding of the role universities can play to intensify the nature of supportive ecosystems for SEs. This contribution is relevant not only to academics but also to practitioners, as this will shed light on the building, development, and scaling of a supportive ecosystem for SEs. (shrink)

Socially responsible human resource management (SR‐HRM) is becoming increasingly important for academics and managers. The interface between HRM and corporate social responsibility (CSR) is the subject of analysis in this article. It adopts a contextual perspective to analyze whether the institutional context influences the implementation of socially responsible HRM (SR‐HRM). Considering the differences in the national institutional contexts across Europe, this study explores the different models of SR‐HRM in that region. The research is focused on a sample of 153 companies (...) headquartered in Germany, Spain, Sweden, and the United Kingdom. The findings evidence the influence exerted by the national institutional context on the implementation of SR‐HRM. Differences among country clusters suggest the existence of different models of SR‐HRM in Europe. However, these models do not correspond to the blocks on HRM or on CSR identified by the literature but instead provide a novel categorization. (shrink)

In this study, we examine the philosophical bases of one of the leading clinical psychological methods of therapy for anxiety, anger, and depression, Cognitive Behavioral Therapy (CBT). We trace this method back to its philosophical roots in the Stoic, Buddhist, Taoist, and Existentialist philosophical traditions. We start by discussing the tenets of CBT, and then we expand on the philosophical traditions that ground this approach. Given that CBT has had a clinically measured positive effect on the psychological well-being of individuals, (...) it becomes important to study the philosophical foundations on which this therapy is based. A cognitive assessment strategy that is not limited to examining a set of summary test scores may be more helpful for early detection of emergent illness such as Alzheimer’s disease (AD) and may permit a better understanding of cognitive functions and dysfunctions in those with AD and other dementia disorders. A revisit of the work already undertaken by Kaplan and colleagues using the Boston Process-Approach provides a solid basis for identifying new opportunities to capture data on neurocognitive processes, test-taking strategies (...) and response styles. Thus, this critical review will combine traditional process-based assessment strategies with support provided or offered by newer technologies that have the potential to add value to data collection and interpretation. There is now considerable interest in neuropsychological test administration using computer/digital technology, both in research and in clinical settings. To add value, any computerized version of an existing cognitive test should respect the administration procedure for which normative data were obtained, should be time-saving in terms of scoring and interpretation, and should, we argue, facilitate gathering information about the processes and strategies followed in test completion. This article will offer an overview of the steps needed when implementing computerization of neuropsychological tests using a Process-Based Approach (PBA) to these technology-based adaptations and will discuss further developments in this area by linking it to future technological developments that may be possible in the area of neuropsychological assessment. Additionally, an overview of neuropsychological tests that may benefit from computerization will be presented, together with suggestions on the specific processes, strategies and features that may be captured with the aid of such computerization. Finally, hypotheses on how virtual reality could be an asset for the future of the PBA to neuropsychological assessment will also be discussed. (shrink)

What does it mean to say that some features, such as gender, race and sexual orientation, are socially constructed? Many scholars claim that social constructionism about a kind is a version of realism about that kind, according to which the corresponding kind is a social construction, that it, it is constituted by social factors and practices. Social constructionism, then, is a version of realism about a kind that asserts that the kind is real, and puts forward a particular view about (...) the nature of the kind, namely, that it is constituted by social factors and practices. Social constructivists about human kinds such as gender, race and sexual orientation often make an additional claim, namely, that these kinds are social constructions but they are typically believed to be biological kinds (that is, people are typically wrong about the nature of these kinds). Ron Mallon (2017) calls social constructions that are (falsely) taken to be biological kinds covert social constructions. This paper is about how we could have terms in our natural language that come to refer to covert social constructions. (shrink)

A proliferation of tests exists for the assessment of auditory-verbal memory processes. However, from a clinical practice perspective, the situation is less clear when it comes to the ready availability of reliable and valid tests for the evaluation of visual/visuo-spatial memory processes. While, at face value, there appear to be a wide range of available tests of visual/visuo-spatial memory, utilizing different types of materials and assessment strategies, a number of criticisms have been, and arguably should be, leveled at the majority (...) of these tests. The criticisms that have been directed toward what are typically considered to be visual/visuo-spatial memory tests, such as the potential for verbal mediation, over-abstraction of stimuli, the requirement of a drawing response, and the lack of sensitivity to unilateral brain lesions, mean that, in reality, the number of readily available valid tests of visual/visuo-spatial memory is, at best, limited. This article offers a critical, historical review on the existing measures and resources for the neuropsychological assessment of visual/visuo-spatial memory, and it showcases some examples of newer tests that have aimed to overcome the challenges of assessing these important aspects of memory. The article also identifies new trends and examples of how technological advances such as virtual reality may add value to overcome previous obstacles to assessment, thereby offering professionals more reliable, accurate means to evaluate visual/visuo-spatial memory in clinical practice. In his genetic phenomenology, Husserl introduces types, pre-predicative frames of experience that guide the perception and cognition of objects. In this essay, I argue that there are two types that are functionally almost identical to Kant’s schemata. To support this conclusion, I first present an interpretation of Kant’s discussion of schemata. I argue that we must see schemata as pure, a priori cognitions that involve only pure intuition, pure concepts of the understanding, and the imagination. I offer two analogies to (...) explain how schemata function to subsume objects under concepts and to anticipate possible objects of experience before moving on to discuss the schema of substance. Next, I present a brief explanation of Husserl’s genetic phenomenology, organizing my presentation around the idea of apperception. This paves the way for a demonstration of how the fundamental type is best understood as standing at the center of a cluster of concepts, including apperception, passive belief, natural bodies, and the one spatio-temporal horizon of experience. I argue that the fundamental type is central to Husserl’s attempt to ground logic in pre-predicative experience. Finally, I compare two specific types with schemata on the grounds cultivated in the previous sections. The first of these types, the fundamental type, functions to pre-predicatively anticipate objects of possible experience, just as schemata do. The second of these types, which is implied by but never discussed in Husserl’s work, serves to mediate between a formal system of rules and an intuitive grasp of the world, just as schemata do. El presente artículo trata sobre cómo la fenomenología del dolor físico puede entablar un dialogo con las ciencias médicas, brindando, por un lado, un marco teórico sobre la relación mente-cuerpo que no sea reduccionista y, por otro lado, algunos aspectos que mejoren la posibilidad de la cuantificación del dolor mediante test de evaluación del dolor, a partir del refinamiento de los reportes subjetivos. We study 944 shareholder proposals submitted to 343 U.S. firms on climate change issues during 2009–2022. We use logistic and two-stage regression to estimate the propensity for a firm to be targeted or subjected to a vote at the annual general meeting and, for voted proposals, the determinants of that vote. We also examine whether climate-related proposals affect investor returns and how they relate to firms’ future environmental performance and greenhouse gas emissions. Compared to a matched sample, we first find (...) that activists target larger, more carbon-intensive, and less R&D-active firms. Second, voting likelihood is higher for firms with repeated and operations-related proposals and lower pre-proposal environmental ratings. By contrast, disclosure-related proposals are likelier to be negotiated and withdrawn. Third, repeated and operations-related proposals receive higher votes in favor, whereas votes on carbon-intensive firms do not. Fourth, building on the theory that investors act as if they distinguish among the different shareholder proposals based on the expected cost to the firm, we find evidence to support this idea. We find that investors respond negatively to ex-ante costlier proposals, such as those that relate to emissions reduction and target carbon-intensive firms. Fifth, targets’ future environmental performance rating is almost twenty percent higher after a proposal than before compared to the matched sample, whereas emissions do not budge appreciably. Three arguments summarize opposition to laws protecting LGBTQ+ persons from discrimination: (1) The pseudo-democratic argument (social change should be free of governmental coercion); (2) The clinical argument (homosexuality is an illness); (3) The choice argument (homosexuality is a choice). My purpose is to show the three are vulnerable to damaging objections. This article reflects conditions as they were in 1987 in the USA. For example, the expression LGBTQ+ had not been coined. I argue that Husserl’s account of passive synthesis can be developed into a phenomenology of peripheral experience. Peripheral experiences are not defined by their location in visual space but by their phenomenal and intentional character, by what these experiences are like and how they present things in the world. Further, I argue that peripheral experience is of a piece with our most basic background convictions about the world. As such, the periphery is epistemically neutral, but not therefore empty of meaning. (...) It is meaningful as holding open the possibility of further activity, both practical and intellectual. I explore these ideas by focusing on peripheral color experience. Husserl’s discussions of associative synthesis, affection, and doxic and nondoxic forms of attention prove key to detailing peripheral color experience. I end by arguing that at the periphery, intentional content and phenomenal content come apart. (shrink)

One of the best-known aspects of José Carlos Mariátegui’s philosophy is his concept of a revolutionary myth. What does this revolutionary myth entail, how and why did Mariátegui develop this idea? The following article situates Mariátegui’s thought in both the historical and intellectual context of the 1920’s in order to answer these questions. This is relevant because Mariátegui’s philosophy and his revolutionary myth have influenced several Latin American revolutionaries such as Ernesto Che Guevara and Sendero Luminoso (Shining Path). Mariátegui’s ideas (...) have thus changed the lives and history of Latin Americans and it is important that we neither demonize nor idolize Mariátegui’s intellectual work without first attempting to understand it. Background and Objectives People living with dementia have historically been excluded from qualitative research and their voices ignored due to the perception that a person with dementia is not able to express their opinions, preferences and feelings. Research institutions and organizations have contributed by adopting a paternalistic posture of overprotection. Furthermore, traditional research methods have proven to be exclusionary towards this group. The objective of this paper is to address the issue of inclusion of people with dementia in research and (...) provide an evidence-based framework for dementia researchers based on the five principles of human rights: Participation, Accountability, Non-discrimination and equality, Empowerment and Legality (PANEL). Design This paper adapts the PANEL principles to the research context, and uses evidence from the literature to create a framework for qualitative research in people with dementia. This new framework aims to guide dementia researchers in designing studies around the needs of people with dementia, to improve involvement and participation, facilitate research development and maximize research outcomes. Results A checklist is presented with questions related to the five PANEL principles. These questions cover ethical, methodological and legal issues that researchers may need to consider while developing qualitative research for people with dementia. Conclusions The proposed checklist offers a series of questions and considerations to facilitate the development of qualitative research in patients with dementia. It is inspired by current human rights work of recognized dementia researchers and organizations who have been directly involved in policy development. Future studies need to explore its utility in improving participation, facilitating ethics approvals and ensuring that outcomes are relevant to people with dementia. (shrink)

How can we ameliorate the current immigration policies toward Mexican people immigrating to the United States? This study re-examines how the development of scenarios assisted South Africa to dismantle apartheid without engaging in a bloody civil war. Following the scenario approach, we articulate positions taken by different interest groups involved in the debate concerning immigration from Mexico. Next, we formulate a set of scenarios which are evaluated as to how well each contributes to the well-being of the populace both of (...) Mexico and of the United States. The South African scenario model has proven to be an effective tool in times of political disagreement. It fosters a common language among competing groups, non-hierarchal communication among groups, and acknowledgement of the concerns of each group involved. (shrink)

After two years of discussions and revisions, the World Anti-Doping Agency (WADA) published the 2021 World Anti-Doping Code on June 16, 2020. Among the most significant additions to this iteration of the Code was the inclusion of new categories of athletes subject to differential treatment by WADA, including the “protected person” category. In this paper, we examine the recent case of figure skater Kamila Valeryevna Valieva, the first athlete given differential treatment due to her being categorized as a “protected person.” (...) We apply a relational justice framework to the case to provide a nuanced, descriptive analysis of the case generally, and the application of the “protected person” category in particular.We first describe details of the athlete, her performances and anti-doping rule violation, and the “protected person” category, to provide context. We then describe and analyze the relations between several institutional actors, principally WADA and the International Court for the Arbitration of Sport (CAS), the athlete and her team, and other figure skating athletes at the Beijing Winter Olympic Games. To do so, we use two concepts of justice, conservative and ideal, and their component parts, entitlement, desert, and need.Our description and analyses demonstrate that (1) WADA’s notions of justice are essentially conservative, while CAS acted toward more ideal notions, creating a fundamental disagreement in what was owed and to whom. We show (2) that CAS’ decision may have nonetheless caused harm to the athlete, raising questions about the efficacy and capability of the “protected person” category. Finally, (3) our analyses show the influence that notions of justice necessarily have these actors shape each other, thus change the sporting institutions and activities themselves. (shrink)
