The relation between art and morality is one of the vexed issues of aesthetics; it has a history at least from Plato and has been written about, or commented on, by most if not all the luminaries in aesthetics—it is not coincidence that one of the most influential papers on these debates is also one of the most cited papers of this journal. Also, the (im)pertinence of moral concerns for the assessment of artworks is arguably one of the most discussed (...) philosophical issues in the public opinion (albeit not always informed by philosophical insights). The prompt for this Special Issue was the publication, over a short space of time, of four books in the area: James Harold’s Dangerous Art: On Moral Criticisms of Artwork (2020), Erich Hatala Matthes’s Drawing the Line: What to Do with the Work of Immoral Artists from Museums to Movies (2022), Ted Nannicelli’s Artistic Creation and Ethical Criticism (2020), and Mary Beth Willard’s Why It’s OK to Enjoy the Art of Immoral Artists (2021). In this issue, each of these authors provides a précis of their own book, a criticism of one of the other books, and then a defence of their own work against this criticism. Although each book is, obviously, very different, there are some overlapping concerns that make for an especially productive interaction. In particular, one thread that runs through is the current vexed issue of what attitude an audience should take on a work of art in the light of facts about the moral character of its creator. With the wars over ‘cancel culture’ raging in the popular discourse, it is important to subject this issue to detailed philosophical examination. (shrink)

This article reviews four recently published books which help to deepen one’s understanding of the various ways white Christians (mostly in America) have often unknowingly propagated a form of Christianity that is built on a foundation of ‘whiteness’. While each book is aimed at different audiences, they collectively offer a substantive introduction to the nature of theological discourse around race and the challenges of confronting a racialised Christian mindset. Whether it is Willie Jennings’s unmasking of the white male values of (...) self-sufficiency and mastery in higher education, Miguel De La Torre’s scathing appraisal of the ways white Christians contributed to the spectacle that was the Trump presidency, Esau McCaulley’s demonstration of the valuable insights gained when the biblical text is interpreted by non-whites, or the diverse scholars gathered by Love L. Sechrest, Johnny Ramírez-Johnson and Amos Yong, it is clear that churches (and the theologians who serve them) will need to reckon with what it means to fulfil their calling in a way that faithfully attends to the concerns addressed by people from non-white backgrounds. To introduce this collection of research studies, which stem from the pro grams conducted by The World Phenomenology Institute, we need say a few words about our aims and work. This will bring to light the significance of the present volume. The phenomenological philosophy is an unprejudiced study of experience in its entire range: experience being understood as yielding objects. Experi ence, moreover, is approached in a specific way, such a way that it legitima tizes itself naturally in immediate evidence. (...) As such it offers a unique ground for philosophical inquiry. Its basic condition, however, is to legitimize its validity. In this way it allows a dialogue to unfold among various philosophies of different methodologies and persuasions, so that their basic assumptions and conceptions may be investigated in an objective fashion. That is, instead of comparing concepts, we may go below their differences to seek together what they are meant to grasp. We may in this way come to the things them selves, which are the common objective of all philosophy, or what the great Chinese philosopher Wang Yang Ming called "the investigation of things". It is in this spirit that the Institute's programs include a "cross-cultural" dialogue meant to bring about a profound communication among philosophers in their deepest concerns. Rising above artificial cultural confinements, such dialogues bring scholars, thinkers and human beings together toward a truly human community of minds. Ostension is bodily movement that manifests our engagement with things, whether we wish it to or not. Gestures, glances, facial expressions: all betray our interest in something. Ostension enables our first word learning, providing infants with a prelinguistic way to grasp the meaning of words. Ostension is philosophically puzzling; it cuts across domains seemingly unbridgeable -- public--private, inner--outer, mind--body. In this book, Chad Engelland offers a philosophical investigation of ostension and its role in word learning by infants. Engelland (...) discusses ostension (distinguishing it from ostensive definition) in contemporary philosophy, examining accounts by Quine, Davidson, and Gadamer, and he explores relevant empirical findings in psychology, evolutionary anthropology, and neuroscience. He offers original studies of four representative historical thinkers whose work enriches the understanding of ostension: Wittgenstein, Merleau-Ponty, Augustine, and Aristotle. And, building on these philosophical and empirical foundations, Engelland offers a meticulous analysis of the philosophical issues raised by ostension. He examines the phenomenological problem of whether embodied intentions are manifest or inferred; the problem of what concept of mind allows ostensive cues to be intersubjectively available; the epistemological problem of how ostensive cues, notoriously ambiguous, can be correctly understood; and the metaphysical problem of the ultimate status of the key terms in his argument: animate movement, language, and mind. However, he contends that “better meeting young people’s learning and developmental needs will require far more than a reconceptualized high school experience. It will mean a fundamentally different understanding of where learning can take place and the wholehearted participation of a variety of institutions and sectors of society.” The book’s initial chapters explore the nature of productive learning experiences for adolescents. The volume then looks at how various institutions—including schools, after-schools, businesses, and nonprofit and civic organizations—can make unique and indispensable contributions to those crucial learning experiences. Halpern also considers how other countries “structure learning” during these formative years, and he concludes with an exploration of the social and cultural challenges ahead—challenges we must meet, he argues, if we are to enlist and sustain the necessary participation of institutions and adults in an expanded and enriched program for preparing young people for adult life and success. In research on humans, the onus of disclosure by study sponsors and principal investigators is much greater than in patient care precisely because the purpose of research is not patient care. In addition, the participant may carry a heavy risk burden in relationship to any testing of a newly designed drug or device as part of their experiences in the research study. Seminar/project Idea Draw a timeline of the development of the basic concepts of consent and informed consent in patient care and in patient research. On this timeline, first place the dates of the key court cases in England, the United States, Canada, and Australia on consent and informed consent. Then place the date of the development of the Belmont Report. Why do differences exist between these four countries in terms of the legal requirements of informedness of a patient (in medical care) and a study participant (in medical research)? What roles if any do the concepts of self‐determination and self‐decision have in consent and informed consent in patient care and in informed consent in research on humans among the four countries of interest? What are the realities of research on human participants that require a new standard of informed consent, the reasonable volunteer standard, to be developed beyond the two standards in patient care, the professional standard, and the reasonable person standard? Counterpoint Arguments The following are counterpoint arguments that need to be appreciated to more fully understand the concepts that impact the thesis that ‘raw data’ should be open to the public to allow the opportunity of checking of the results of its associated scientific paper and for further analysis. De‐Identified (Anonymized) Raw Data A current approach to identifying (anonymizinig) raw data is based on the Health Insurance Portability and Accountability Act (HIPAA) of 1996 (P.L.104‐191). HIPAA was enacted by the U.S. Congress in 1996 to keep a person’s medical information private. In a research study, a person’s private medical information can become research data. HIPAA’s Privacy Rule allows a covered entity to de‐identify data by removing all 18 elements that could be used to identify the individual or the individual’s relatives, employers, or household members; these elements are enumerated in the Privacy Rule. The covered entity must also have no actual knowledge that the remaining information could be used alone or in combination with other information to identify the individual who is the subject of the information. Under this method, the identifiers that must be removed are the following: 1 Names. 2 All geographic subdivisions smaller than a state, including street address, city, county, precinct, ZIP Code, and their equivalent geographical codes, except for the initial three digits of a ZIP Code if, according to the current publicly available data from the Bureau of the Census: 2a. The geographic unit formed by combining all ZIP Codes with the same three initial digits contains more than 20,000 people. 2b. The initial three digits of a ZIP Code for all such geographic units containing 20,000 or fewer people are changed to 000. 3 All elements of dates (except year) for dates directly related to an individual, including birth date, admission date, discharge date, and date of death, and all ages over 89 and all elements of dates (including year) indicative of such age, except that such ages and elements may be aggregated into a single category of age 90 or older. 4 Telephone numbers. 5 Facsimile numbers. 6 Electronic mail addresses. 7 Social security numbers. 8 Medical record numbers. 9 Health plan beneficiary numbers. 10 Account numbers. 11 Certificate/license numbers. 12 Vehicle identifiers and serial numbers, including license plate numbers. 13 Device identifiers and serial numbers. 14 Web universal resource locators (URLs). 15 Internet protocol (IP) address numbers. 16 Biometric identifiers, including fingerprints and voiceprints. 17 Full‐face photographic images and any comparable images. 18 Any other unique identifying number, characteristic, or code, unless otherwise permitted by the Privacy Rule for re‐identification. Even though ‘raw data’ can be de‐identified (anonymized) so that there is no way to trace back the data to the study participant from which it was drawn, there are still questions whether the ‘de‐identified raw data’ can be given to other researchers or made public without the original study participant’s approval. It may be the case that this approval could be done at the start of any research study where the individual considering study participation would be counseled on what the process of de‐identification consists of and would be asked whether the participant would allow use of the data by other researchers or made available to the public in a de‐identified state. However, there may be questions of the study participants as to whether the data are truly de‐identified and untraceable back to the study participant since the participant would not be able to see the process actually being carried out in detail in all relevant circumstances. Using Raw Data in Context Simply being in possession of raw data is never enough to build on that data from a research perspective. Researchers need to understand the context of the scientific research study in which the data were collected. This research context includes (but is not limited to): (i) the scientific hypothesis of the research study, (ii) the inclusion and exclusion criteria selected by the research designers of the study to determine which study participants were included and which were excluded from the study, (iii) the methods used to collect the data and possibilities of errors in the data collection processes, and (iv) answers to questions regarding whether any data were excluded from the study data and why these data were excluded. Ownership Rights Over Data There are ownership rights over data. Ownership rights include court decision making related to the question which parties are to be considered as the owners of the data. Possible owners here include (but are not limited to) (i) the study sponsor whose only role was to fund that study, (ii) the principal investigator(s) who developed the scientific hypothesis, and (iii) individual study participants through special contracts made by individual participants who negotiate such contracts with study sponsors and principal investigators to share in the ownership of data. Examples of such data are participant sources of unique gene lines or unique cell lines to be used in future research. Objections to Data Sharing Finally, individual researchers may simply object to sharing data. A researcher’s arguments here may be simply stating that he or she has a right to fully analyze the data since the collection of the data was the researchers’ idea in the first place. These researchers may argue that they have the right to mine the data as fully as they can before deciding to make the data open to the public for others to analyze. Bringing together the histories of mathematics, computer science, and linguistic thought, Language and the Rise of the Algorithm reveals how recent developments in artificial intelligence are reopening an issue that troubled mathematicians long before the computer age. How do you draw the line between computational rules and the complexities of making systems comprehensible to people? Here Jeffrey M. Binder offers a compelling tour of four visions (...) of universal computation that addressed this issue in very different ways: G. W. Leibniz's calculus ratiocinator; a universal algebra scheme Nicolas de Condorcet designed during the French Revolution; George Boole's nineteenth-century logic system; and the early programming language ALGOL, whose name is short for algorithmic language. These episodes show that symbolic computation has repeatedly become entangled in debates about the nature of communication. To what extent can meaning be controlled by individuals, like the values of a and b in algebra, and to what extent is meaning inevitably social? By attending to this long-neglected question, we come to see that the modern idea of the algorithm is implicated in a long history of attempts to maintain a disciplinary boundary separating technical knowledge from the languages people speak day to day. Machine learning, in its increasing dependence on words, now places this boundary in jeopardy, making its stakes all the more urgent to understand. Peter Abbs begins by deploring “the cultural catastrophe” of British education in the mid-1990s. He states in his always lucid and accessible prose: “I want to come clean; I (...) want to place the general argument of the book in the current arena of public debate, and to do so without apology and without equivocation.” He bemoans today’s massive denial of spiritual energy, of intellectual enquiry, of aesthetic beauty and public virtue. In a better world, he says, education would serve, “willingly and lovingly... the transcendent ends” of culture and society. Abbs decisively rejects the “Cato” model where teachers are unquestioning skill-based technicians who employ [End Page 393] “managerial” language. Instead, he advocates a Socratic view, which is “to reaffirm that education should be primarily concerned with critical reflection, with personal development and with the sustained enquiry into the various forms of meaning.”Subsequent chapters apply this approach to the arts curriculum. Its failure to gain proper recognition and the absurd and continued conflation of Dance and Physical Education are indicted. Abbs convincingly attacks the notion of “self-expression” in art and language long upheld by educationalists. Its application at the expense of reason, abstract thinking, and the study of “the truly significant writers through the centuries” has in his view helped to trivialize and to marginalize the arts. Nowhere is this more apparent than in so-called “educational drama.” For three generations it has denied “the aesthetic field of drama, the symbolic field of its own form,” and has elevated one genre, improvisation, and made it the totality.Abbs is committed to reconciling “the creative energies of the individual and the creative energies of the culture.” Who would argue with that? And who could deny the value of critical reflection or indeed public virtue? He declares, rather ponderously: “The vested interests of Coca-Cola manufacturers or political missionaries have to be seen as too ‘recent and relevant’ to be allowed” to shape education. The Abbs academy requires “a formally protected place, an institutional space more like the theatre than Tesco [a supermarket chain], more like the cathedral than the Stock Exchange.” For all this patent seriousness and sincerity, here is an educationalist irrevocably and irreconcilably out of joint with the present. The austere modernism of Herbert Read profoundly influenced Abbs in his teens; he also admires F. R. Leavis, Richard Hoggart, and David Holbrook, whose writing at its most influential spans the 1930s and the 1960s. Abbs’s most recent source of inspiration is the art critic Peter Fuller, whose abiding legacy was a romantic nationalism that eloquently celebrated an “essentially symbolic and figurative” tradition in British art from J. M. W. Turner to Henry Moore.Modern Painters, which Fuller edited, could afford to eschew popular culture and its connections with “higher” arts. Fine for a periodical, but how could such a fastidious approach be applied to the classroom experience? Abbs describes an experiment that he performed on student-teachers at the University of Sussex to understand their aesthetic responses. Among the events and objects that the students were asked to consider were John Constable’s The Haywain, Richard Strauss’s The Four Last Songs, a visit to Claude Monet’s garden and a performance of Coriolanus. Abbs’s list does not, however, contain Pulp Fiction, a Courtney Love concert, or an S. E. Hinton novel. What place, if any, do the latter have in the arts curriculum? Must they be ruled out for being too “recent and relevant”? Can student responses to them be brought to bear on their comprehension of higher culture? Or is there a great and ultimately irreconcilable divide? This article is to examine the way of harmony that is initiated in the Analects of Confucius, and further elaborated in the other three of the Four Books. It will argue that the Confucian harmony is a philosophy defining the relation between the self and the other and among the elements of the unity, that it is a way of living and behaving that leads to modesty and flexibility, and that it is a moral process starting from the self and (...) reaching the Middle Way. It concludes that the way of harmony is not only theoretically important for Confucian philosophy but also practically significant for Chinese culture because it later became central to the doctrinal foundation on which all philosophical schools operated.
