Criminal violence is one of the most pressing problems in Latin America and the Caribbean, with profound political consequences. Its effects on social policy preferences, however, remain largely unexplored. This article argues that to understand such effects it is crucial to analyze victimization experiences and perceptions of insecurity as separate phenomena with distinct attitudinal consequences. Heightened perceptions of insecurity are associated with a reduced demand for public welfare provision, as such perceptions reflect a sense of the state’s failure to provide (...) public security. At the same time, acknowledging the mounting costs and needs that direct experience with crime entails, victimization is expected to increase support for social policies, particularly for health services. Survey data from twenty-four Latin American and Caribbean countries for the period 2008–12 show that perceptions of insecurity indeed reduce support for the state’s role in welfare provision, whereas crime victimization strongly increases such preferences. Resumo: A partir da disseminação das políticas educacionais inclusivas observa-se um aumento de matrículas de estudantes em situação de deficiência no Ensino Superior, elegíveis aos serviços de Educação Especial, no Brasil. Este artigo objetiva analisar os critérios institucionais utilizados para delinear o perfil desses universitários nos dados Censitários da Universidade e, de que modo tais dados comungam com as políticas educacionais inclusivas vigentes. Por conseguinte, buscará compreender como as políticas institucionais da universidade se correlacionam com as do Censo do Ensino (...) Superior e Políticas Educacionais Inclusivas no que refere aos apoios e medidas protetivas de acesso e participação dos estudantes a esta etapa de ensino à população mencionada. Trata-se de um estudo documental balizado na descrição do perfil de universitários da graduação e de pós-graduação, de uma universidade pública paulista no a) anuário institucional, b) formulário de identificação de matrícula de estudantes e, c) das designações desta população, descrita no Censo do INEP. Os resultados demonstraram um descompasso na caracterização dos marcadores que retratam o perfil do público em relação as designações referenciadas na Lei Brasileira de Inclusão. A escassez de práticas institucionais inclusivas dirigidas a este tema, somadas a falta de clareza na compreensão sobre as demandas educacionais específicas, declaradas pelos estudantes contribuem para manter um clima de instabilidade das tratativas de respostas à permanência deste público na universidade investigada. Policy for the identification of students with SEN at a public Brazilian university Abstract: From the dissemination of inclusive educational policies, there is an increase in enrollment of students with Special Educational Needs (SEN) in Higher Education, users of Special Education services, in Brazil.The article aims to analyze the institutional criteria used to delineate the profile of these university students in the University's Census data and how these data are in line with the current inclusive educational policies. Therefore, it will seek to understand how the university's institutional policies correlate with those of the Higher Education Census and Inclusive Educational Policies regarding support and protective measures to access this stage of education for the population mentioned. This is a documentary study based on the description of the profile of undergraduate and graduate students, of a public university in São Paulo in a) institutional yearbook, b) student enrollment identification form, and c) the designations of this population, described in the INEP Census. The results demonstrated a disparity in the characterization of the markers that portray the public's profile in relation to the designations referenced in the Brazilian Inclusion Law. The shortage of inclusive institutional practices aimed at this theme, added to the lack of clarity in understanding about the especific educational demands, declared by students at the time contribute to maintaining a climate of instability in the treatment of responses to the permanence of this public in the investigated university. Se trata de un estudio documental basado en la descripción del perfil de estudiantes de grado y posgrado, de una universidad pública de São Paulo en a) anuario institucional y b) formulario de identificación de matrícula y, c) las designaciones de esta población, descritas en Censo del INEP. Los resultados demostraron un desajuste en la caracterización de los marcadores que retratan el perfil del público en relación a las designaciones referenciadas en la Ley de Inclusión brasileña. Las huelgas que han protagonizado en los últimos años los trabajadores subcontratados de la gran minería revelan que la ley de subcontratación no ha cumplido el objetivo de disminuir el conflicto entre trabajadores subcontratados, empresas subcontratistas y grandes empresas mineras. Este artículo analiza la subcontratación en la minería en Chile, entregando antecedentes teóricos y empíricos que permitan explicar tales conflictos. Desde un punto de vista sociológico, se alude a la pérdida de centralidad del trabajo asalariado y consiguiente aumento de formas (...) de empleo atípicas. La empiria indica por otro lado un alto porcentaje de trabajadores en régimen de subcontratación en la minería. Se concluye que en algunas situaciones se presenta un encubrimiento laboral, que llevaría a la creación de trabajadores de primera y segunda categoría. Los trabajadores subcontratados afirman que deberían tener los mismos derechos y privilegios que sus pares contratados, porque realizan exactamente el mismo tipo de trabajo. (shrink)

ABSTRACT:This article assesses the proliferation of international accountability standards (IAS) in the recent past. We provide a comprehensive overview about the different types of standards and discuss their role as part of a new institutional infrastructure for corporate responsibility. Based on this, it is argued that IAS can advance corporate responsibility on a global level because they contribute to the closure of some omnipresent governance gaps. IAS also improve the preparedness of an organization to give an explanation and a justification (...) to relevant stakeholders for its judgments, intentions, acts and omissions when appropriately called upon to do so. However, IAS also face a variety of problems impeding their potential to help address social and environmental issues. The contribution of the four articles in this special section is discussed in the context of standards’ problems and opportunities. The article closes by outlining a research agenda to further develop and extend the scholarly debate around IAS. (shrink)

African jurisprudence, like African philosophy, continues to be hotly debated. This article contends that the debate straddles the uniqueness claim which either emphasises the existence or possibility of a peculiar legal framework on the continent, and a historical co-extensional position reiterating that African jurisprudence is a continuum of other legal traditions. The article argues that there is no uniquely African jurisprudence, and that what obtains within the structures of jurisprudence on the continent also exists within various legal traditions elsewhere, and (...) as such can at best be described as ‘jurisprudence in Africa’ rather than ‘African jurisprudence’. It defends this thesis through analytic and comparative explications of the content of natural law theory and legal positivism as experienced on the continent. It concedes that relics of the colonial legal experience create contestations that inform scholars’ calls for a return to traditional legal systems. It concludes that a reconstructive jurisprudence in Africa must take cognisance of the continent’s historical and evolutionary legal experiences, but that a unified or monolithic theory may not be sufficient to address the choice of functional jurisprudence. Plato believed that behind everything in the universe lie mathematical principles. Plato was inspired by Pythagoras (571 BCE), who developed a school of mathematics at Crotona that studied sacred geometry as a form of religion. The school’s motto was “God is number,” or “All is Number”. Pythagoras believed that numbers represented God in pattern, symmetry, and infinity. When one of its students, Hippasus told the world the secret of the existence of irrational numbers, Greek geometry was born and Pythagoras’ idea (...) of divinity in numbers died because how could God not be perfect and symmetrical? In Plato’s Republic he discusses something called The Divided Line, which is a map, of sorts, for reaching what he calls the highest Good, which is the ultimate truth where one realizes the true state of the universe and can see the world for what it really is. Many mathematicians have attempted to plot Plato’s Divided Line only to come across a litany of problems and conundrums. Some have said that it the Divided Line cannot be plotted and is merely an allegory not meant to be plotted. This paper discusses some of the conundrums preventing the plotting of Plato’s Divided Line (not an exhaustive list), including Whole ‘vs’ Separate, Equality ‘vs’ Ontological Dissimilarity, Linear ‘vs’ Non-linear, and Infinity ‘vs’ Finite. This paper also explores a new understanding of the Allegory of the Cave in light of ‘the problem of the irrational.’ In exploring the link between the Divided Line and the ‘the problem of the irrational,’ I was able to plot it. It was found that the Divided Line is not a line in the linear sense, but a spiral, the Golden Ratio! This paper is an example of a new category of scholarly inquiry I call “Math Theory” based on scholarly mathematical axioms in theory, rather than including actual maths. In my papers I use existing mathematical equations and place them in an encompassing theory, rather than finding new formulae to fit an existing theory. Since approval of the EU General Data Protection Regulation (GDPR) in 2016, it has been widely and repeatedly claimed that the GDPR will legally mandate a ‘right to explanation’ of all decisions made by automated or artificially intelligent algorithmic systems. This right to explanation is viewed as an ideal mechanism to enhance the accountability and transparency of automated decision-making. However, there are several reasons to doubt both the legal existence and the feasibility of such a right. In contrast to the (...) right to explanation of specific automated decisions claimed elsewhere, the GDPR only mandates that data subjects receive meaningful, but properly limited, information (Articles 13-15) about the logic involved, as well as the significance and the envisaged consequences of automated decision-making systems, what we term a ‘right to be informed’. Further, the ambiguity and limited scope of the ‘right not to be subject to automated decision-making’ contained in Article 22 (from which the alleged ‘right to explanation’ stems) raises questions over the protection actually afforded to data subjects. These problems show that the GDPR lacks precise language as well as explicit and well-defined rights and safeguards against automated decision-making, and therefore runs the risk of being toothless. We propose a number of legislative and policy steps that, if taken, may improve the transparency and accountability of automated decision-making when the GDPR comes into force in 2018. (shrink)

Music Criticism in Vienna records a culture in which musical criticism had achieved the status of a minor art form. The period covered - October 1896 to December 1897 - was an eventful time in Vienna. Bruckner died, then Brahms; Mahler arrived; premieres of works by Czech composers coincidedwith increasing tension in the Empire between Czechs and Germans; Puccini's La Boheme reached Vienna on its sensational progress around the world; and the great programme music debate continued. These events and issues (...) were recorded and debated by some two dozen critics ranging from Eduard Hanslick,widely credited with (and blamed for) raising music criticism to an art, to Heinrich Schenker. The focus of Sandra McColl's monograph is unashamedly on the critics themselves, and her reconstruction of the climate of debate about whatever music or musicians came to their notice. Drawing on everyday telephone and video interactions, this book surveys how English speakers use grammar to formulate responses in ordinary conversation. The authors show that speakers build their responses in a variety of ways: the responses can be longer or shorter, repetitive or not, and can be uttered with different intonational 'melodies'. Biological knowledge does not fit the image of science that philosophers have developed. Many argue that biology has no laws. Here I criticize standard normative accounts of law and defend an alternative, pragmatic approach. I argue that a multidimensional conceptual framework should replace the standard dichotomous law/ accident distinction in order to display important differences in the kinds of causal structure found in nature and the corresponding scientific representations of those structures. To this end I explore the dimensions of stability, (...) strength, and degree of abstraction that characterize the variety of scientific knowledge claims found in biology and other sciences. By combining a flanker task and a cuing task into a single paradigm, the authors assessed the effects of orienting and alerting on conflict resolution and explored how normal aging and Alzheimer’s disease (AD) modulate these attentional functions. Orienting failed to enhance conflict resolution; alerting was most beneficial for trials without conflict, as if acting on response criterion rather than on information processing. Alerting cues were most effective in the older groups— healthy aging and AD. Conflict resolution was impaired only (...) in AD. Orienting remained unchanged across groups. These findings provide evidence of different life span developmental and clinical trajectories for each attentional network. (shrink)
