Many see the mithnagdim as total rationalists. Therefore it has been assumed that R. Hayyim of Volozhin’s approach to Torah study was the same. Although rationalism may be a correct characterization of the method he used in talmudic study, it does not capture how R. Hayyim understood the essence of Torah study. Some have described Nefesh ha-Hayyim as demystifying Kabbalah. I agree that R. Hayyim opposes ecstatic Kabbalah. However, already in 1972 Norman Lamm noticed that R. Hayyim saw Torah study (...) as a form of clinging to God. In my article, I go further and demonstrate how torah lishmah for R. Hayyim is a radical idea that includes a legitimate path to unio mystica, and even a way to divine inspiration. (shrink)

Mayr’s proximate–ultimate distinction has received renewed interest in recent years. Here we discuss its role in arguments about the relevance of developmental to evolutionary biology. We show that two recent critiques of the proximate–ultimate distinction fail to explain why developmental processes in particular should be of interest to evolutionary biologists. We trace these failures to a common problem: both critiques take the proximate–ultimate distinction to neglect specific causal interactions in nature. We argue that this is implausible, and that the distinction (...) should instead be understood in the context of explanatory abstractions in complete causal models of evolutionary change. Once the debate is reframed in this way, the proximate–ultimate distinction’s role in arguments against the theoretical significance of evo-devo is seen to rely on a generally implicit premise: that the variation produced by development is abundant, small and undirected. We show that a “lean version” of the proximate–ultimate distinction can be maintained even when this isotropy assumption does not hold. Finally, we connect these considerations to biological practice. We show that the investigation of developmental constraints in evolutionary transitions has long relied on a methodology which foregrounds the explanatory role of developmental processes. It is, however, entirely compatible with the lean version of the proximate–ultimate distinction. (shrink)

Building on the idea that philosophers employ the term ‘reduction’ to reconcile diversity and directionality with unity, without relying on elimination, the book offers a powerful explication of an “ontological” notion of reduction the extension of which is (primarily) formed by properties, kinds, individuals, or processes. It argues that related notions of reduction, such as theory-reduction and functional reduction, should be defined in terms of this explication. The paper offers an account of the structure of information provided by models that relevantly deviate from reality. It is argued that accounts of scientific modeling according to which a model’s epistemic and pragmatic relevance stems from the alleged fact that models give access to possibilities fail. First, it seems that there are models that do not give access to possibilities, for what they describe is impossible. In Memory of Ed PellegrinoEuthanasia in Belgium is not limited to terminally ill patients. It may be applied to patients with chronic degenerative diseases. Currently, people in Belgium wish to make it possible to euthanize incompetent patients who suffer from dementia. This article explains the Belgian law and then explores arguments for and against euthanasia of patients with dementia. It probes the dementia paradox by elucidating Dworkin’s distinction between critical and experiential interests, arguing that at the end-of-life this distinction is (...) not clearcut. It argues against euthanasia for patients with dementia, for respecting patients’ humanity and for providing them with more care, compassion, and good doctoring. (shrink)

The essay opens with some background information about the period in which J.S. Mill wrote. The discussion revolves around the concept of blasphemy which Mill considered to be highly problematic. Tagging unpopular views as ‘blasphemous’ amounted to abuse of governmental powers and infringed on the basic liberties of the out-of-favour speakers. The discussion on blasphemy sets the scene to the understanding of Mill's concerns, his priorities and consequently his emphasis on the widest possible liberty of expression. Section 2 presents the (...) Millian principles that are pertinent to his philosophy of free speech: liberty and truth. Section 3 analyzes Mill's very limited boundaries to freedom of expression, asserting that the consequentialist reasoning had led Mill to ignore present tangible harm. The present paper argues that there is a structural difference between classical cases involving knowledge-undermining environmental luck, and cases where a subject acquires understanding in the presence of environmental luck. This difference appears to bear on arguments against the reductionist thesis that understanding is a special form of knowledge.

When a linear order has an order preserving surjection onto each of its suborders, we say that it is strongly surjective. We prove that the set of countable strongly surjective linear orders is a [Formula: see text]-complete set. Using hypotheses beyond ZFC, we prove the existence of uncountable strongly surjective orders.

In this paper, I argue that a particular assertion-based account of lying, which rests on Stalnaker’s theory of assertions, proposed by Andreas Stokke, is both too broad and too narrow. I tentatively conclude that the account fails because lying does not necessarily involve a conversational purpose.

I develop a theodicy (Non-Identity Theodicy) that begins with the recognition that we owe our existence to great and varied evils. I develop two versions of this theodicy, with the result that some version is available to the theist regardless of her assumptions about the existence and nature of free will. My defense of Non-Identity Theodicy is aided by an analogy between divine creation and human procreation. I argue that if one af rms the morality of vol- untary human procreation, (...) one should af rm the morality of divine creation; conversely, deny- ing the morality of divine creation commits one to denying the morality of human procreation. This paper reflects on the articles submitted for the Symposium Confronting the Internet’s Dark Side. I discuss some of the criticisms of the book’s theory and my treatment of hate speech. The responsibilities of Internet Service Providers and Web-Hosting Services are in the fore, arguing that as they are the gatekeepers, they need to be proactive far more than they are now. This paper, like my book, strives to suggest an approach that harnesses the strengths and capabilities of the public (...) and the private sectors in offering practical solutions to pressing problems. This paper analyses J.S. Mill's theory on the relationships between individual autonomy and State powers. It will be argued that there is a significant discrepancy between Mill's general liberal statements aimed to secure individual largest possible autonomy and the specific examples which provide the government with quite wide latitude for interference in the public and private spheres. The paper outlines the boundaries of government interference in the Millian theory. Subsequently it describes Mill's elastic paternalism designed to prevent people from inflicting (...) harm upon others as well as upon themselves, from soft paternalism on issues like compulsory education to hard paternalism on very private matters such as marriage, having children, and divorce by consent. The German Act on Autonomous Driving constitutes the first national framework on level four autonomous vehicles and has received attention from policy makers, AI ethics scholars and legal experts in autonomous driving. Owing to Germany’s role as a global hub for car manufacturing, the following paper sheds light on the act’s position within the ethical discourse and how it reconfigures the balance between legislation and ethical frameworks. Specifically, in this paper, we highlight areas that need to be more worked out (...) in the future either through ethical conventions, corporate measures or legal measures and examine how the law can be incorporated into the existing discourse on the regulation of technologies. Based on this examination, we derive implications for future discourse and elaborate on companies’ responsibilities in developing autonomous driving technologies in an ethical sense. (shrink)

L'obiettivo del presente articolo è l'osservazione storica delle politiche della memoria nel Brasile contemporaneo, con particolare attenzione al periodo tra il 2019 e il 2022 (governo Bolsonaro). Dall'analisi delle azioni giudiziarie proposte da diversi attori sociali e politici, l'articolo propone una riflessione sulle temporalità coinvolte nelle politiche della memoria nel contesto post-dittatoriale, soprattutto dalla prospettiva delle vittime del regime.

In order to do justice to the intuition that medical treatments as such do not form proper instances of bio-enhancement, as the notion is employed in the ethical debate, we should construe bio-enhancements as interventions, which do not aim at states that, other things being equal, ought to obtain. In the light of this clarification, we come to see that cases of moral enhancement are not covered by the notion of bio-enhancement, properly construed.

The article deals with the Dawson College Massacre, focusing on the story of Kimveer Gill, a 25-year-old man from Laval, Montreal who wished to murder young students in Dawson College. It is argued that the international community should continue working together to devise rules for monitoring specific Internet sites, as human lives are at stake. Preemptive measures could prevent the translation of murderous thoughts into murderous actions. Designated monitoring mechanisms of certain websites that promote violence and seek legitimacy as well (...) as adherents to the actualization of murderous thoughts and hateful messages have a potential of preventing such unfortunate events. Our intention is to draw the attention of the multifaceted international community to the shared interest and need in developing monitoring schemes for certain websites, in order to prevent hideous crimes. Il s’agit toujours d’endiguer leur dangereux excès asymbolique en les déchiffrant, en leur imposant symboles et prédicats. Le présent essai propose une analyse d’ Un re (...) in ascolto [ Un roi à l’écoute ] d’Italo Calvino (1976), redéfinissant à nouveaux frais la notion de souveraineté afin de mieux comprendre la nature d’une telle stratégie herméneutique, et les raisons de son échec. Le souverain tel que nous le décrit Calvino est-il en mesure de conférer un sens à la musique et au chant en les intégrant au sein d’un système sémantique clos? The goal of this paper is to reconstruct Nagel’s approach to idealization in the sciences and present his views as a viable option. In a nutshell, the theory that emerges can be described as follows: There are various types of idealization, which can be found in theoretical and experimental laws, and which, according to Nagel, play various important epistemic roles. In particular, they help organize complex knowledge and allow for approximations to truth. A cognate of idealization, which Nagel does not (...) refer to under this label but describes in terms of assimilation to the familiar and in terms of analogy, is key to scientific models, whose value is primarily heuristic in nature. The fact that theories involve idealization supports an instrumentalist perspective on science, a perspective which also determines a particular scope of the account of idealization. By these lights, particular types of questions simply do not arise, for instance: questions pertaining to the alleged peculiarity of scientific representation, the truth of law statements, etc. (shrink)

In this article I analyze some of the troubling issues in Canadian media ethics, based on in-depth interviews with more than 50 experts on Canadian media. I begin by reflecting on the cultural considerations involved in the Canadian media's proximity to the United States. Subsequently, I discuss the problems of excessive ownership of the media by a few organizations, arguing that the right to exercise free expression does not include the right to own as many media organizations as money can (...) buy. In this context are considered the work of two Royal Commissions: the 1970 Davey Commission and the 1980 Kent Commission. Finally, I am concerned with excessive intrusion of individual privacy. When news becomes entertainment and private stories become public spectacle, individual lives can be mercilessly exposed to the glaring spotlight of unwanted publicity. In delineating the boundaries of intrusion, there is a need to distinguish between public figures and ordinary citizens, and between those who choose to live in the spotlight and ordinary citizens who stumble into the public eye.
