Abstract

In all actions concerning children, whether undertaken by public or private social welfare institutions, courts of law, administrative authorities or legislative bodies, the best interests of the child shall be a primary consideration.In 2014, Belgium Became the first country in the world to allow euthanasia of minors, irrespective of their age. This article explores whether this legislation enhances minors' rights or negates them.Do minors have capacity for agency? Are they able to make decisions concerning life and death? Can minors understand death? Are minors capable of weighing various alternatives for treatment? Is there a difference between adult euthanasia and child euthanasia? Does life experience matter?...
