The potential to collect brain data more directly, with higher resolution, and in greater amounts has heightened worries about mental and brain privacy. In order to manage the risks to individuals posed by these privacy challenges, some have suggested codifying new privacy rights, including a right to “mental privacy.” In this paper, we consider these arguments and conclude that while neurotechnologies do raise significant privacy concerns, such concerns are—at least for now—no different from those raised by other well-understood data collection (...) technologies, such as gene sequencing tools and online surveillance. To better understand the privacy stakes of brain data, we suggest the use of a conceptual framework from information ethics, Helen Nissenbaum’s “contextual integrity” theory. To illustrate the importance of context, we examine neurotechnologies and the information flows they produce in three familiar contexts—healthcare and medical research, criminal justice, and consumer marketing. We argue that by emphasizing what is distinct about brain privacy issues, rather than what they share with other data privacy concerns, risks weakening broader efforts to enact more robust privacy law and policy. BackgroundEthics consult services are well established, but often remain underutilized. Our aim was to identify the barriers and perceptions of the Ethics consult service for physicians, advance practice providers (APPs), and nurses at our urban academic medical center which might contribute to underutilization.MethodsThis was a cross-sectional single-health system, anonymous written online survey, which was developed by the UCSD Health Clinical Ethics Committee and distributed by Survey Monkey. We compare responses between physicians, APPs, and nurses using standard parametric and non-parametric statistical (...) methods. Satisfaction with ethics consult and likelihood of calling Ethics service again were assessed using a 0–100 scale using a 5-likert response structured (0 being “not helpful at all” to 100 being “extremely helpful”) and results presented using box plots and interquartile ranges (IQR).ResultsFrom January to July 2019, approximately 3800 surveys were sent to all physicians, APPs and nurses with a return rate of 5.5—10%. Although the majority of respondents had encountered an ethical dilemma (85–92.1%) only approximately half had ever requested an Ethics consult. The primary reason for physicians never having requested a consult was that they never felt the need for help (41%). For APPs the primary reasons were not knowing an Ethics consult service was available (33.3%) or not knowing how to contact Ethics (27.8%). For nurses, it was not knowing how to contact the Ethics consult service (30.8%) or not feeling the need for help (26.2%). The median satisfaction score (IQR) for Ethics consult services rated on a 0–100 scale, from physicians was 76 (29), for AAPs 89 (49), and nurses 70 (40) (p = 0.62). The median (IQR) of likelihood of consulting Ethics in the future also on a 0–100 scale was 71 (47) for physicians, 69 (45) for APPs, and 61 (45) for nurses (p = 0.79). APP’s and nurses were significantly more likely than physicians to believe that the team did not act on the Ethics consult’s recommendations.ConclusionsBased on the results presented, we were able to identify actionable steps to better engage healthcare providers—and in particular APPs and nurses—and scale up institutional educational efforts to increase awareness of the role of the Ethics consult service at our institution. Actionable steps included implementing a system of ongoing feedback that is critical for the sustainability of the Ethics service role. We hope this project can serve as a blueprint for other hospital-based Ethics consult services to improve the quality of their programs. (shrink)

In this paper we address a frontier topic in the humanities, namely how the cultural and natural construction that we call landscape affects well-being and health. Following an updated review of evidence-based literature in the fields of medicine, psychology, and architecture, we propose a new theoretical framework called “processual landscape,” which is able to explain both the health-landscape and the medical agency-structure binomial pairs. We provide a twofold analysis of landscape, from both the cultural and naturalist points of view: in (...) order to take into account its relationship with health, the definition of landscape as a cultural product needs to be broadened through naturalization, grounding it in the scientific domain. Landscape cannot be distinguished from the ecological environment. For this reason, we naturalize the idea of landscape through the notion of affordance and Gibson’s ecological psychology. In doing so, we stress the role of agency in the theory of perception and the health-landscape relationship. Since it is the result of continuous and co-creational interaction between the cultural agent, the biological agent and the affordances offered to the landscape perceiver, the processual landscape is, in our opinion, the most comprehensive framework for explaining the health-landscape relationship. The consequences of our framework are not only theoretical, but ethical also: insofar as health is greatly affected by landscape, this construction represents something more than just part of our heritage or a place to be preserved for the aesthetic pleasure it provides. Rather, we can talk about the right to landscape as something intrinsically linked to the well-being of present and future generations. (shrink)

Arguably the most influential models of human decision-making today are based on the assumption that two separable systems – intuition and deliberation – underlie the judgments that people make. Our recent work is among the first to present neural evidence contrary to the predictions of these dual-systems accounts. We measured brain activations using functional magnetic resonance imaging (fMRI) while participants were specifically instructed to either intuitively or deliberately judge the authenticity of emotional facial expressions. Results from three different analyses revealed (...) both common brain networks of activation across decision mode and differential activations as a function of strategy adherence. We take our results to contradict popular dual-systems accounts that propose a clear-cut dichotomy of the processing systems, and to support rather a unified model. According to this, intuitive and deliberate judgment processes rely on the same rules, though only the former are thought to be characterized by non-conscious processing. (shrink)

ABSTRACTThis article studies multi-stakeholder initiatives as spaces for both deliberation and contestation between constituencies with competing discourses and disputed values, beliefs, and preferences. We review different theoretical perspectives on MSIs, which see them mainly as spaces to find solutions to market problems, as spaces of conflict and bargaining, or as spaces of consensus. In contrast, we build on a contestatory deliberative perspective, which gives equal value to both contestation and consensus. We identify four types of internal contestation which can be (...) present in MSIs—procedural, inclusiveness, epistemic, and ultimate-goal—and argue that embracing contestation and engaging in ongoing revision of provisional agreements, criteria, and goals can enhance the democratic quality of MSIs. Finally, we explore the implications of this perspective for theorizing about the democratic quality in MSIs and about the role of corporations in transnational governance. (shrink)

Die Debatte genießt in liberalen Demokratien einen hohen Stellenwert. Das gilt nicht nur für den öffentlichen Raum, sondern auch für den Schulunterricht, der Heranwachsende auf die Teilnahme an dieser Praxis vorbereiten soll. Wie kontrovers soll und darf es im Klassenzimmer selbst aber zugehen? Wie steht es etwa mit antidemokratischen oder illiberalen Positionen? Sollen auch sie kontrovers diskutiert werden, oder sollen die Lernenden hier vielmehr von vornherein zur Übernahme der als legitim vorausgesetzten Position gebracht werden? Wenn ja, auf welche Weise? Diese (...) Fragen werden in der Bildungsphilosophie intensiv diskutiert. Der Beitrag befasst sich mit der sogenannten Kontroverse um Kontroversitätsgebote. Konkret widmet er sich Johannes Drerups Versuch, den Raum der Kontroverse im Klassenzimmer zu eröffnen und zugleich zu begrenzen. Zunächst wird betrachtet, wie er die Grenzen des Diskurses zieht und inwieweit er diese Grenzziehung überzeugend begründet. Dann werden die unterrichtspraktischen Konsequenzen, die er selbst daraus ableitet, und das Konzept eines „direktiven Unterrichtens“ im Kontext ethischer Debatten beleuchtet. Schließlich wird eine alternative Herangehensweise angedeutet: Statt zu versuchen, den Lernenden anhand kontroverser Themen top down einen fixen Wertekanon zu vermitteln, können Lehrpersonen solche Kontroversen auch zum Anlass nehmen, die Wertvorstellungen der Schüler:innen gemeinsam mit ihnen aufzudecken, zu explizieren und kritisch zu durchdenken. Eine solche Praxis dialogischer Wertebildung ist zwar für alle Beteiligten herausfordernder, scheint aber besser zur Idee der Demokratiebildung zu passen. (shrink)

This paper draws on the philosophies of Maurice Merleau‐Ponty and Hannah Arendt in order to explore the nature of free action. Part one outlines three familiar ways in which we often understand the nature of freedom. Part two argues that these common understandings of freedom are rooted in impoverished conceptions of time and subjectivity. Part three engages with Arendt’s conception of natality alongside Merleau‐Ponty’s conception of expression in order to argue that the freely acting self draws in improvisational manners on (...) the resources of a shared past in order to open unprecedented spaces of meaning for the future, and in so doing at once discovers and institutes herself as the self that she is. Part four draws on an example of anti‐oppressive political action in order to argue that free action not only has the power to inaugurate new spaces of shared meaning for the future, but also to change the sens of the shared past. By the same token, free action is vulnerable in its ontological status and ethical meanings to the events and judgments of the future. Part five argues with both Merleau‐Ponty and Arendt that ethical‐political actors can do no better than to cultivate a political virtù while facing up to the inherently transgressive dimensions of free action in a shared historical world. The discovery of conjunctive causes--factors that act in concert to produce or prevent an effect--has been explained by purely covariational theories. Such theories assume that concomitant variations in observable events directly license causal inferences, without postulating the existence of unobservable causal relations. This article discusses problems with these theories, proposes a causal-power theory that overcomes the problems, and reports empirical evidence favoring the new theory. Unlike earlier models, the new theory derives (a) the conditions under which covariation implies conjunctive causation (...) and (b) functions relating observable events to unobservable conjunctive causal strength. This psychological theory, which concerns simple cases involving 2 binary candidate causes and a binary effect, raises questions about normative statistics for testing causal hypotheses regarding categorical data resulting from discrete variables. The purpose of this paper is to reassess some mathematical examples in Plato’s dialogues which at a first glance may appear to be nothing more than trivial puzzles. In order to provide the necessary background for this analysis, I shall begin by sketching a brief overview of Plato’s mathematical passages and discuss the criteria for aptly selecting them. Second, I shall explain what I mean by ‘mathematical examples,’ and reflect on their function in light of the discussion on παραδείγματα outlined (...) in theSophistand theStatesman. Against this framework, I shall move to a close examination of specific examples drawn from theTheaetetus(154c–55d), theRepublic(523c–24d), and thePhaedo(96d–97b, 100e–101d). By placing these examples in the broader context of pre-Euclidean mathematics, I shall show that their mathematical content is often less elementary than might appear at first sight. Moreover, by placing emphasis on the specific philosophical concerns that motivated their introduction, I shall argue that the examples are not merely nonsensical jokes. Even if their illustrative purpose is not always immediately clear, and even if they can sound playful and bizarre, they in fact fulfil an important function: by virtue of their power to generate wonder or confusion, they serve as exercises and act as a trigger with respect to the difficult philosophical issues they are intended to clarify. ABSTRACT Against empiricist and rationalist prejudices concerning the nature of issues related to “mental health,” this article offers a phenomenological account of identity as developed in a meaningful system with the environment or world. Drawing on the work of Merleau-Ponty and Dewey, I argue that behavioral and emotional health and illness must be understood in terms of the plasticity or rigidity, respectively, of the individual's responses in the face of new and threatening environmental demands. However, individual plasticity and rigidity are (...) not given qualities of the individual but are themselves developed in healthy or unhealthy interpersonal environments. I discuss three cases of emotional and behavioral trouble in order to explore the manner in which unhealthy self-environment systems can undermine individuals' powers of adaptability and growth. Background: Moral decision-making consists of a complex process requiring individuals to evaluate potential consequences of personal and social decisions, including applied organizational contexts.Methods: This research aims to investigate the behavioral (offer responses and reaction times, RTs) and electrophysiological (EEG) correlates underlying moral decision-making during three different choice conditions (professional fit, company fit, and social fit) and offers (fair, unfair, and neutral).Results: An increase of delta and theta frontal activity (related to emotional behavior and processes) and beta frontal and central activity (...) (linked to cognitive and attentional processes) was found. A left beta, delta, and theta frontal activity was observed for fair offers in professional fit conditions, while increased right frontal delta and theta activity was found in response to unfair offers in company fit conditions. Also, an increase of left delta and theta parietal activity for unfair offers in social fit condition was detected. Finally, higher accepted responses were found for fair and neutral offers in professional and social fit conditions, with increased RTs for unfair offers suggesting decisions’ cognitive load and complexity.Conclusions: By revealing a greater involvement of left and right frontal areas in decision-making processes based on choices and offers, personal interest evaluations and emotional values, and of parietal areas in more prosocial and altruistic moral behavior, current findings provide information about the neural and behavioral correlates underlying company moral behavior. This paper begins with the lived accounts of emergency and critical care medical interventions in which an unhoused person is brought to the emergency department in cardiac arrest. The case is a dramatised representation of the extent to which biopolitical forces via reduction to bare life through biopolitical and necropolitical operations are prominent influences in nursing and medical care. This paper draws on the scholarship of Michel Foucault, Giorgio Agamben, and Achille Mbembe to offer a theoretical analysis of the power (...) dynamics that influence the health care and death care of patients who are caught in the auspices of a neoliberal capitalist healthcare apparatus. This paper offers analysis of the overt displays of biopower over those individuals cast aside as generally unworthy of access to healthcare in a postcolonial capitalist system, in addition to the ways in which humans are reduced to ‘bare life’ in their dying days. We analyse this case study through Agamben's description of thanatopolitics, a ‘regime of death’, and the technologies that accompany the dying process, particularly in that of the homo sacer. Additionally, this paper illustrates the ways in which necropolitics and biopower are integral to understanding how the most advanced and expensive medical interventions make visible the political values of the healthcare system and how nurses and healthcare functions in these deathworlds. The purpose of this paper is to develop a greater understanding of biopolitical and necropolitical operations in acute and critical care environments, and to offer guidance to nurses in these spaces as they work to uphold ethical duties in a system that increasingly dehumanises. The challenge that confronts corporate decision-makers in connection with global labor conditions is often in identifying the standardsby which they should govern themselves. In an effort to provide greater direction in the face of possible global cultural conflicts, ethicistsThomas Donaldson and Thomas Dunfee draw on social contract theory to develop a method for identifying basic human rights: Integrated Social Contract Theory (ISCT). In this paper, we apply ISCT to the challenge of global labor standards, attempting to identify labor rights that (...) could serve as guides for corporations producing or outsourcing outside of their home country. In addition to identifying areas of universal agreement, we also examine whether ISCT is, in fact, a sufficient basis for determining worker rights; we seek to define the parameters of the “sweatshop” problem; we include the application and results of our ISCT analysis as applied to labor standards: the global labor rights hypernorms; and conclude that ISCT is sufficient only for rights that are universal. We also discuss whether market-driven decisions can identify the boundaries of labor rights, or at least assure that market outcomes are compatible with maintaining labor rights, in order to respond to the shortcomings of ISCT. We conclude with some comments on directions of analysis for labor rights determination. (shrink)

We often think of normal childhood as a progressive development towards a fixed—and often tacitly individualistic and masculine—model of what it is to be an adult. By contrast, phenomenologists, psychoanalysts, sociology of childhood, and feminist thinkers have set out to offer richer accounts both of childhood development and of mature existence. This paper draws on accounts of childhood development from phenomenologist Maurice Merleau-Ponty and object relations theorist D. W. Winnicott in order to argue that childhood development takes place in “transitional (...) spaces”; explores typical gendered patterns in the formation of selfhood that “split” relationality and separateness into the “feminine” and the “masculine”; and offers a phenomenology of perception, love, and objectivity in order to show the manner in which, contra individualistic and masculine visions of adulthood, maturity requires an embrace rather than eschewal of ambiguity, and the capacity to continue to dwell in the transitional space between relatedness and separateness. There has been an ongoing debate about the best approach in environmental ethics. Bryan Norton believes that “weak anthropocentrism” will yield the best results for public policy, and that it is the most defensible position. In contrast, I have argued that an ecocentric, holistic position is required to deal with the urgent environmental problems that face us, and that position is complemented by the ecosystem approach and complex systems theory. I have called this approach “the ethics of integrity,” and in (...) this paper I show why this perspective suggests better solutions to difficult cases, for which “weak anthropocentrism” fails to provide an answer. We investigated family members’ lived experience of Parkinson’s disease aiming to investigate opportunities for well-being. A lifeworld-led approach to healthcare was adopted. Interpretative phenomenological analysis was used to explore in-depth interviews with people living with PD and their partners. The analysis generated four themes: It’s more than just an illness revealed the existential challenge of diagnosis; Like a bird with a broken wing emphasizing the need to adapt to increasing immobility through embodied agency; Being together with PD exploring the kinship (...) within couples and belonging experienced through support groups; and Carpe diem! illuminated the significance of time and fractured future orientation created by diagnosis. Findings were interpreted using an existential-phenomenological theory of well-being. We highlighted how partners shared the impact of PD in their own ontological challenges. Further research with different types of families and in different situations is required to identify services required to facilitate the process of learning to live with PD. Care and support for the family unit needs to provide emotional support to manage threats to identity and agency alongside problem-solving for bodily changes. Adopting a lifeworld-led healthcare approach would increase opportunities for well-being within the PD illness journey. (shrink)

While no one seems to believe that business schools or their faculties bear entire responsibility for the ethical decision-making processes of their students, these same institutions do have some burden of accountability for educating students surrounding these skills. To that end, the standards promulgated by the Association to Advance Collegiate School of Business, their global accrediting body, require that students learn ethics as part of a business degree. However, since the AACSB does not require the inclusion of a specific course (...) to achieve this objective, it may be satisfied by establishing a stand-alone course in ethical decision-making, by integrating ethical decision-making into the existing curricula, by some combination of the two strategies, or through some alternative mechanism. Notwithstanding the choice of delivery process, though, the institution must ensure that it is able to demonstrate the students' achievement of learning with regard to ethics, a bar that was raised, or arguably simply modified, in 2003. With learning objectives designed precisely to measure the student delta based on content, process and engagement in a particular class, those programs that have opted for stand-alone ethics courses may be more prepared to respond to assessment-related inquiries regarding their programs or satisfaction of the standards. The relevance of the AACSB standards modification to the current efforts at ethics integration in business programs is instead a re-examination of how to create a program of integration that is designed to ensure the most effective learning results possible, while responding to the challenges presented by the integrated approach. The purpose of this article is to explore some of those challenges that may be somewhat universal to business school programs implementing the integrated approach, and to share one large university's response to those challenges, along with lessons learned. Background Intensivists must provide enough analgesia and sedation to ensure dying patients receive good palliative care. However, if it is perceived that too much is given, they risk prosecution for committing euthanasia. The goal of this study is to develop consensus guidelines on analgesia and sedation in dying intensive care unit patients that help distinguish palliative care from euthanasia. Methods Using the Delphi technique, panelists rated levels of agreement with statements describing how analgesics and sedatives should be given to dying (...) ICU patients and how palliative care should be distinguished from euthanasia. Participants were drawn from 3 panels: 1) Canadian Academic Adult Intensive Care Fellowship program directors and Intensive Care division chiefs (N = 9); 2) Deputy chief provincial coroners (N = 5); 3) Validation panel of Intensivists attending the Canadian Critical Care Trials Group meeting (N = 12). Results After three Delphi rounds, consensus was achieved on 16 statements encompassing the role of palliative care in the intensive care unit, the management of pain and suffering, current areas of controversy, and ways of improving palliative care in the ICU. Conclusion Consensus guidelines were developed to guide the administration of analgesics and sedatives to dying ICU patients and to help distinguish palliative care from euthanasia. (shrink)

Zusammenfassung Hintergrund Stigmatisierung hat einen erheblichen Einfluss auf die Gesundheit verschiedener gesellschaftlicher Gruppen und trägt zu Ungleichheiten im Gesundheitswesen bei. Sexarbeit ist mit erheblichem sozialem Stigma verbunden, das sich nachteilig auf den Zugang von Sexarbeiter*innen zur Gesundheitsversorgung auswirkt. Die vorliegende explorative Studie gibt erste Einblicke in die Sichtweisen von Sexarbeiter*innen und Berater*innen in Deutschland auf den Zugang, die Bedürfnisse und die Barrieren von Sexarbeiter*innen in Bezug auf die Gesundheitsversorgung. Dabei lag der Fokus auf einem etablierten Netzwerk von Gesundheitsangeboten für Sexarbeiter*innen (...) in Bochum. Methoden Leitfadengestützte Interviews wurden mit 4 Berater*innen durchgeführt, die soziale und medizinische Beratung für Sexarbeiter*innen anbieten, sowie mit 3 Sexarbeiter*innen, die diese Angebote nutzen. Die Interviews wurden mittels qualitativer Inhaltsanalyse nach Kuckartz ausgewertet. Ergebnisse Es zeigten sich verschiedene Hürden bei der Inanspruchnahme von Gesundheitsversorgung, insbesondere aufgrund unzureichender Krankenversicherung oder fehlendem Wissen über den eigenen Krankenversicherungsstatus, Sprachbarrieren, Bürokratie, Mobilität und Diskriminierung in der Gesundheitsversorgung. Diskriminierung aufgrund von Sexarbeit überschnitt sich mit anderen Diskriminierungsformen, wie beispielsweise antislawischem Rassismus oder der Stigmatisierung von Schwangerschaftsabbrüchen. Spezifische Bedürfnisse und Barrieren wurden hinsichtlich psychischer Gesundheit angegeben, die sich als wichtiges Thema für Sexarbeiter*innen erwies. Die bestehenden kostenlosen, anonymen und zugänglichen Angebote für Sexarbeiter*innen, insbesondere aufsuchende Angebote, wurden als hilfreich beschrieben. Sexarbeiter*innen und Berater*innen wiesen auf einen Mangel an Angeboten für unterschiedliche Bedürfnisse von Sexarbeiter*innen hin, die über Tests auf sexuell übertragbare Infektionen und deren Behandlung hinausgehen, z. B. im Bereich der psychischen Gesundheit. Schlussfolgerung Nach wie vor bestehen Barrieren für den Zugang zur Gesundheitsversorgung, von denen viele besonders Sexarbeiter*innen mit Migrationsgeschichten aus osteuropäischen Ländern betreffen. Die Studie zeigt, dass die Etablierung antidiskriminierender Gesundheitsangebote für Sexarbeiter*innen notwendig ist. Bei der Entwicklung solcher Angebote sollten die Perspektiven von Sexarbeiter*innen eine zentrale Rolle einnehmen. (shrink)

In a working note to The Visible and the Invisible, Maurice Merleau-Ponty makes an enigmatic call for “a psychoanalysis of Nature.” This paper argues that there are two interrelated ways in which this call might be taken up. First, it might be taken as the demand to give voice to the deep sense of a nature, conceived in terms of unconscious desire rather than scientific rationality, that precedes and exceeds human life. Second, we might do a psychoanalysis of our relationship (...) to nature, of the ways in which modern thought tends to deny and repress the unconscious, organic desire at its heart. This paper addresses the psychoanalysis of nature in both these senses. The first part of this paper takes up Merleau-Ponty’s well-known discussion of the phantom limb in Phenomenology of Perception in order to give a critique the mind-body dualism implicit in traditional attempts to account for this and related phenomena, and in order to present Merleau-Ponty’s own account of the phantom limb in terms of being in the world. Second, I argue that being in the world requires that we repress not only aspects of our personal pasts, but also our organic nature itself. Third, I argue that much of modern scientific thinking tends to deny the bodily and unconscious dimensions of conscious life—it is this denial that calls for a psychoanalysis in the second sense of studying our troubled and repressive relationship to nature. This denial of our own naturalness is accompanied by a denial of the unconscious and irrational nature of nature itself; finally, I will speak to the ways in which psychoanalysis might go further back than we might expect—beyond our childhoods and to the organic heartbeat of life itself. ABSTRACT Through an exploration of a home invasion scene in Ingmar Bergman's Shame, this article explores the ways in which it is not only our own bodies that are vulnerable to assault but also the meaningful objects through which we expressively engage with the world, as well as the worldly context of these embodied engagements. First, I draw primarily on the work of Martin Heidegger and Maurice Merleau-Ponty in order to explore the ways in which things come to be incorporated (...) into our bodily experience and how our vulnerability as embodied individuals is thus extended into the life of these things. Second, I engage with phenomenological accounts of home and psychoanalytic accounts of childhood development in order to argue that our extended bodily vulnerability is coextensive with our creative openness to the world. Finally, I offer some reflections on the role played by breakdown in phenomenological experience, at the level of the things through which we are “at home” to expressively extend ourselves out into the world and at the level of the sense of “homelessness” alive in the experience of anxiety. For more than 100,000 years, H. sapiens lived as foragers, in small family groups with low reproductive variance. A minority of men were able to father children by two or three women; and a majority of men and women were able to breed. But after the origin of farming around 10,000 years ago, reproductive variance increased. In civilizations which began in Mesopotamia, Egypt, India, and China, and then moved on to Greece and Rome, kings collected thousands of women, whose children (...) were supported and guarded by thousands of eunuchs. Just a few hundred years ago, that trend reversed. Obligate sterility ended, and reproductive variance declined. The graphical presentation of experimental data in the physical sciences has several advantages which today are too familiar to require very detailed enumeration. Its greatest strength lies in the clarity and succinctness with which it displays the information contained in tabulated results: for the experimenter a graph provides a rough and immediate check on the accuracy and suitability of the methods he is using, and for the reader of a scientific report it may convey in a few seconds information that (...) could only be gleaned from a table of measurements by hours of close study. There are occasions whereonlythe analysis of experimental graphs will provide the information we require, but usually the actual analysis of results is carried out nowadays by computational methods. The use of graphs is therefore not so much a necessary part of scientific procedure as an extremely useful one, and one that is often taken very much for granted. (shrink)

In his thought-provoking book, Why Law Matters, Alon Harel defends two key claims: one ontological, the other axiological. First, he argues that constitutions and judicial review are necessary constituents of a just society. Second, he suggests that these institutions are not only means to the realization of worthy ends, but also non-instrumentally valuable. I agree with Harel that constitutions and judicial review have more than instrumental value, but I am not persuaded by his arguments in support of this conclusion. I (...) argue that Harel’s ontological claim is unsustainable, and that his axiological claim needs revision. Regarding the former, I show that constitutions and judicial review are only contingent constituents of a just society. Regarding the latter, I contest Harel’s specific account of the value of constitutions and judicial review. Harel grounds the non-instrumental value of constitutions in freedom as non-domination but, upon scrutiny, it emerges that their non-instrumental value lies elsewhere. Further, Harel holds that the non-instrumental value of judicial review stems from its embodying a right to a fair hearing. I argue that this right has non-instrumental value only under a particular set of circumstances. I thus conclude, contrary to Harel, that the non-instrumental value of judicial review is contingent on those circumstances obtaining. (shrink)

Background While the theoretical benefits and harms of Artificial Intelligence (AI) have been widely discussed in academic literature, empirical evidence remains elusive regarding the practical ethical challenges of developing AI for healthcare. Bridging the gap between theory and practice is an essential step in understanding how to ethically align AI for healthcare. Therefore, this research examines the concerns and challenges perceived by experts in developing ethical AI that addresses the healthcare context and needs. Methods We conducted semi-structured interviews with 41 (...) AI experts and analyzed the data using reflective thematic analysis. Results We developed three themes that expressed the considerations perceived by experts as essential for ensuring AI aligns with ethical practices within healthcare. The first theme explores the ethical significance of introducing AI with a clear and purposeful objective. The second theme focuses on how experts are concerned about the tension that exists between economic incentives and the importance of prioritizing the interests of doctors and patients. The third theme illustrates the need to develop context-sensitive AI for healthcare that is informed by its underlying theoretical foundations. Conclusions The three themes collectively emphasized that beyond being innovative, AI must genuinely benefit healthcare and its stakeholders, meaning AI also aligns with intricate and context-specific healthcare practices. Our findings signal that instead of narrow product-specific AI guidance, ethical AI development may need a systemic, proactive perspective that includes the ethical considerations (objectives, actors, and context) and focuses on healthcare applications. The passage of the Servicemen’s Readjustment Act of 1944 — or GI Bill — opened up a dialogue about men’s physical and mental health, for it addressed very directly what ordinary men would need to recover from extraordinary violence. Political leaders identified veterans’ “welfare,” by which they meant general well-being, as a top priority of World War II’s recovery, and the GI Bill was the centerpiece of their agenda. The bill’s passage was an impressive legislative triumph, the collective product of (...) massive medical, legal, and social science research, bipartisan politicking, and veterans’ activism. It provided education, housing, and small business assistance, along with mental and physical rehabilitation in government-funded hospitals. All of these programs, whether they served mind, body, or wallet, amounted to welfare — a set of government-sponsored policies and services designed to aid a soldier’s transition from enlisted man to healthy, productive citizen. Thus we have to think about the broad reach of the GI Bill’s welfare provision as one of the health legacies of World War II. (shrink)

One major assumption in the climate change debate is that because respondents report positive attitudes to the environment and to low carbon lifestyles they will subsequently engage in environmentally friendly/low carbon behaviors when given the right guidance or information. Many governmental agencies have based their climate change strategy on this basic assumption, despite some anxiety about the value-action gap in psychology more generally. Here we test this assumption. We investigated the relationship between explicit and implicit attitudes to carbon footprint, and (...) both self-reports of environmental behavior and low carbon behavioral choices. We found that self-reported attitudes to carbon footprint were significantly associated only with self-reported environmental and self-reported low-carbon behaviors. They were not significantly associated with the choice of low carbon alternatives in a simulated shopping task. Given that the vast majority of studies on attitudes and behavior in the environmental domain use self-report measures of behavior, this may mean that we are generating research findings that could be making policy makers overly complacent about our readiness for actual behavior change. Implicit attitudes were not significantly associated with either measure in terms of group comparisons, but those with a strong positive implicit attitude towards low carbon did choose more low carbon items, but only under time pressure. The opposite trend was found for explicit attitudes – this increased only when participants were not under time pressure. These results suggest that Kahneman’s hypothesis about contrasting systems of human cognition might be highly relevant to the domain of climate change and behavioral adaptation. (shrink)
