The papers in the 2010 “Clinical Ethics” number of the Journal of Medicine and Philosophy explore issues along La Frontera, the borders and boundaries of clinical ethics. The first three papers in this “Clinical Ethics” number of the Journal explore borders and boundaries drawn within clinical ethics, concerning the moral standing of complementary and alternative medicine, palliative sedation, and induced abortion and feticide. The fourth and fifth papers explore the borders and boundaries between research ethics and clinical ethics.

In the creep literature, time has often been elevated from its role as a means of ordering events to that of a fully fledged state variable. It is hoped that this paper will highlight the dangers of this approach and will illustrate the proper role of time in mathematical physics, emphasizing the important distinction between coordinate and state variables.

In a seminal 1977 article, Rumelhart argued that perception required the simultaneous use of multiple sources of information, allowing perceivers to optimally interpret sensory information at many levels of representation in real time as information arrives. Building on Rumelhart's arguments, we present the Interactive Activation hypothesis—the idea that the mechanism used in perception and comprehension to achieve these feats exploits an interactive activation process implemented through the bidirectional propagation of activation among simple processing units. We then examine the interactive activation (...) model of letter and word perception and the TRACE model of speech perception, as early attempts to explore this hypothesis, and review the experimental evidence relevant to their assumptions and predictions. We consider how well these models address the computational challenge posed by the problem of perception, and we consider how consistent they are with evidence from behavioral experiments. We examine empirical and theoretical controversies surrounding the idea of interactive processing, including a controversy that swirls around the relationship between interactive computation and optimal Bayesian inference. Some of the implementation details of early versions of interactive activation models caused deviation from optimality and from aspects of human performance data. More recent versions of these models, however, overcome these deficiencies. Among these is a model called the multinomial interactive activation model, which explicitly links interactive activation and Bayesian computations. We also review evidence from neurophysiological and neuroimaging studies supporting the view that interactive processing is a characteristic of the perceptual processing machinery in the brain. In sum, we argue that a computational analysis, as well as behavioral and neuroscience evidence, all support the Interactive Activation hypothesis. The evidence suggests that contemporary versions of models based on the idea of interactive activation continue to provide a basis for efforts to achieve a fuller understanding of the process of perception. The study of human intelligence was once dominated by symbolic approaches, but over the last 30 years an alternative approach has arisen. Symbols and processes that operate on them are often seen today as approximate characterizations of the emergent consequences of sub- or nonsymbolic processes, and a wide range of constructs in cognitive science can be understood as emergents. These include representational constructs (units, structures, rules), architectural constructs (central executive, declarative memory), and developmental processes and outcomes (stages, sensitive periods, neurocognitive (...) modules, developmental disorders). The greatest achievements of human cognition may be largely emergent phenomena. It remains a challenge for the future to learn more about how these greatest achievements arise and to emulate them in artificial systems. (shrink)

This article is an exercise in computational jurisprudence. It seems clear thatthe field of AI and Law should draw upon the insights of legal philosophers,whenever possible. But can the computational perspective offer anything inreturn? I will explore this question by focusing on the concept of OWNERSHIP,which has been debated in the jurisprudential literature for centuries. Althoughthe intellectual currents here flow mostly in one direction – from legal philosophy to AI – I will show that there are also some insights to (...) be gained from a computational analysis of the OWNERSHIP relation. In particular, the article suggests a computational explanation for the emergence of abstract property rights, divorced from concrete material objects. (shrink)

We share with Anderson & Lebiere (A&L) (and with Newell before them) the goal of developing a domain-general framework for modeling cognition, and we take seriously the issue of evaluation criteria. We advocate a more focused approach than the one reflected in Newell's criteria, based on analysis of failures as well as successes of models brought into close contact with experimental data. A&L attribute the shortcomings of our parallel-distributed processing framework to a failure to acknowledge a symbolic level of thought. (...) Our framework does acknowledge a symbolic level, contrary to their claim. What we deny is that the symbolic level is the level at which the principles of cognitive processing should be formulated. Models cast at a symbolic level are sometimes useful as high-level approximations of the underlying mechanisms of thought. The adequacy of this approximation will continue to increase as symbolic modelers continue to incorporate principles of parallel distributed processing. (shrink)

Purpose. Based on the study of philosophical anthropological concepts, to highlight the project of personality in different historical periods, to reveal the meaning of humanistic issues in the postmodern epoch, to identify the essential features of the image of human of the second half of the XX the beginning of the XXI century. Theoretical basis. The methodological basis of the article is the principles of historicism, integrity, objectivity regarding the mastery of the issue of person’s image in postmodernism. The research (...) applied comparative-historical, culturological, analytical, axiological approaches to reveal the problem of individuality in the second half of the XX the beginning of the XXI century. The theoretical basis of the article consists of scientific works in the field of philosophical anthropology, history, cultural studies, and aesthetics. Originality. The author revealed the peculiarities of transformation of the personality model from antiquity to postmodernism, specified the image of man of the second half of the XX the beginning of the XXI century. Conclusions. The analysis of anthropological ideas of Western philosophy of different ages shows the variety of views about understanding the nature of the person, its complexity and ambiguity. In the epoch of postmodernism humanistic issues are of particular relevance, which is connected with social and political uncertainty, domination of mass consciousness, loss of national and cultural identity. The image of a person of this period is deprived of a solid foundation, it is blurred and relative. The destruction of faith in the absolute in the context of the second half of the twentieth century contributed to the formation of confidence in the interdependence of all things, raised the problem of the personality image to a new ontological level. Orientation in the achievements of European civilization, perception of its anthropological experience, intercultural dialogue contribute to the productive use of the achievements of mankind in order to understand the modern person and to form its adequate image. In its essence, postmodernism does not set the goal to realize a retrospection of subject type. However, separating from the cultural memory the excerpts of ideas about a person, by certain styles and directions, it builds on their formations its own eclectic image of the individual. (shrink)

I argue that Peirces conception of Firsts, Seconds and Thirds entails a fundamental ontological realism. I further argue that Peirce does have a theory of truth, that it is a particular non‐traditional ‘correspondence’ theory, consistent with, and implicit in, an over‐arching position of pragmatic realism. Peirce's epistemological position is subject to misinterpretation when the ontological realism on which it rests is overlooked. This article explains and assesses a particular method of loving others that is espoused by Søren Kierkegaard. In his later works, Kierkegaard advocates a kind of deceptive love whereby one mystifies or deceives another person for that other person's own good. The theological underpinning of this mode of love is found in the imitation of Christ. In other words, just as Jesus adopted an incognito, so also Christians should, at times, appear different or lowlier in order to help others by (...) meeting them where they are. After explaining this form of love, I argue that there are considerable reasons not to follow Kierkegaard in his support of outright deception within personal relationships. I conclude with some brief reflections on whether the deceptive structure of Kierkegaard's own authorship is thereby condemned or whether it can be exonerated. (shrink)

In any society influenced by a plurality of cultures, there will be widespread, systematic differences about at least some important values, including moral values. Many of these differences look like deep disagreements, difficult to resolve objectively if that is possible at all. One common response to the suspicion that these disagreements are unsettleable has always been moral relativism. In the flurry of sympathetic treatments of this doctrine in the last two decades, attention has understandably focused on the simpler case in (...) which one fairly self-contained and culturally homogeneous society confronts, at least in thought, the values of another; but most have taken relativism to have implications within a single pluralistic society as well. I am not among the sympathizers. That is partly because I am more optimistic than many about how many moral disagreements can be settled, but I shall say little about that here. For, even on the assumption that many disputes are unsettleable, I continue to find relativism a theoretically puzzling reaction to the problem of moral disagreement, and a troubling one in practice, especially when the practice involves regular interaction among those who disagree. We present game-theoretic characterizations of the complexity/expressibility measures “dimension” and “the number of variables” as Least Fixed Point queries. As an example, we use these characterizations to compute the dimension and number of variables of Connectivity and Connectivity.

Different developmental anomalies produce contrasting deficits in a single, integrated system. In a network that inflects regular and exception verbs correctly, a disproportionate deficit with exceptions occurs if connections are deleted, whereas a disproportionate deficit with regulars occurs when an auditory deficit impairs perception of the regular inflection. In general, contrasting deficits do not license the inference of underlying modularity.

In Book 10 of the Aeneid, Virgil presents an epic catalogue of Etruscan allies who return under Aeneas' command to the beleaguered Trojan camp, including the forces from Liguria. The account of the Ligurians initially conforms to the general pattern of the catalogue, as Virgil briefly introduces and describes the two leaders. But the description of Cupauo's swan-feather crest leads to a digression about the paternal origins of the avian symbol. Cupauo's father Cycnus, stricken with grief for his beloved Phaethon, (...) was transformed from a mournful singer into the swan that bears his name : non ego te, Ligurum ductor fortissime bello,transierim, Cinyre, et paucis comitate Cupauo,cuius olorinae surgunt de uertice pennae formaeque insigne paternae.namque ferunt luctu Cycnum Phaethontis amati,populeas inter frondes umbramque sororum 190dum canit et maestum Musa solatur amorem,canentem molli pluma duxisse senectamlinquentem terras et sidera uoce sequentem. Virgil not only places the Ligurians in a central position within the catalogue, but also devotes more verses to them than to any other contingent, including his own Mantuans. At the very heart of this prominent passage lies the embedded tale of Cycnus, the erotic and sorrowful centrepiece of Virgil's Etruscan catalogue. (shrink)

Any attempt to assess the validity of Kant’s basic philosophical approach to the problems of physics must begin, not with a comprehensive metaphysical foundation of natural science but, rather, with the metaphysical foundation of the science directed to the primordial basis of nature, viz., the science of ponderomotive nature. The concrete aggregate of its constructive concerns is the aggregate of momenta. The synthesis of this aggregate is subject to a dynamic reciprocity of nature under the two radical aspects of reality (...) and unreality – factors or “aspects” reflected in cognition as subjective activity and its immediate objective correlate. The synthetic enterprise culminates in the recognition of a schematic event-unity, which is at the same time the basis of the possibility of emergence from the preceding sphere of ponderomotive nature into a higher-synthetic sphere of concrete, materio-formal nature. I claim that Mill has a theory of poetry which he uses to reconcile nineteenth century associationist psychology, the tendency of the intellect to dissolve associations, and the need for educated members of society to desire utilitarian ends. The heart of the argument is that Mill thinks reading poetry encourages us to feel the feelings of others, and thus to develop pleasurable associations with the pleasurable feelings of others and painful associations with the painful feelings of others. Once the associations (...) are developed, they are supported and maintained by our natural capacity for sympathy and by external elements in society, and provide motivation for the pursuit of utilitarian ends. Further, the additional support causes the associations to be strengthened to the extent that they come to be seen as ‘natural and necessary’, and as such are immune from the dissolving force of the intellect. Much has been written about the ethics and values of today's business student, but this research has generally been characterized by a variety of methodological shortcomings — the use of convenience samples, a failure to establish the relevance of comparison groups employed, attempts to understand behavior in terms of unidimensional values preselected by the researcher, and the lack of well-designed longitudinal studies. The research reported here addresses many of these concerns by comparing the values and ethical decision making behavior of (...) a large cohort of students entering an M. B. A. program to students entering law school. Using the Rokeach value survey and several ethical decision making vignettes, significant differences were found between the two groups which have important implications for both the business and legal professions and the education of their future leaders. A weak form of intuitionistic set theory WST lacking the axiom of extensionality is introduced. While WST is too weak to support the derivation of the law of excluded middle from the axiom of choice, we show that beefing up WST with moderate extensionality principles or quotient sets enables the derivation to go through.

Hans Kelsen est, sans conteste, le juriste le plus important de ce siècle. Il n'y a pas une seule question de théorie juridique qu'on puisse traiter aujourd'hui sans examiner d'abord l'analyse qu'il en fait, mais son œuvre ne concerne pas seulement le droit et la philosophie du droit ; elle touche aussi la philosophie politique, l'épistémologie, l'éthique ou la logique. Sa théorie du droit représente, à côté du réalisme, l'une des deux branches du juspositivisme moderne, connue sous le nom de (...) normativisme et que lui-même appelait " Théorie pure du droit ". Elle se donne comme une théorie scientifique qui se borne à décrire son objet, le droit positif, et qui donc est " pure " de tout jugement de valeur. La pureté ne concerne toutefois que la méthodologie. Le droit, lui, n'est nullement pur, car il exprime des choix moraux et politiques. La doctrine kelsenienne pure apparaît ainsi doublement politique : d'une part, elle se donne pour tâche de mettre en évidence la fonction idéologique du droit ; d'autre part, dans la mesure où elle analyse les dispositifs juridiques comme des moyens au service de certaines fins, elle peut servir de fondement à une véritable technologie juridique. C'est cette technologie que Kelsen prétendait appliquer à la politique et qui fonde aussi bien son travail de constituant - il est le père de la Constitution autrichienne et de la première Cour constitutionnelle - que ses écrits sur la démocratie. La Théorie générale du droit et de l'Etat présente à cet égard un intérêt exceptionnel. Elle a été écrite aux Etats-Unis, où Kelsen s'était réfugié au début de la Seconde Guerre mondiale. Comme le souligne Stanley L. Paulson dans son introduction, elle constitue une étape marquante dans l'évolution de sa pensée entre le néokantisme des origines et l'empirisme des derniers écrits. C'est aussi une présentation claire, systématique et concentrée de l'ensemble de sa doctrine et c'est le seul ouvrage de Kelsen qui porte à la fois sur les conditions de possibilité d'une science empirique du droit, sur la théorie générale du droit au sens strict - l'analyse structurale de tous les ordres juridiques possibles - et sur la théorie générale de l'Etat - l'analyse des concepts constitutifs de tout Etat possible. The soul has played many different roles in philosophy and religion. Two of the primary functions of the soul are the bearer of personal identity and the foundation of immortality. In this paper I shall consider different interpretations of what the soul has been taken to be and argue that however we interpret the soul we cannot consistently maintain the soul is both what we are and what continues after our bodily death.
