In their practice, nurses make daily decisions that are ethically informed. An ethical decision is the result of a complex reasoning process based on knowledge and experience and driven by ethical values. Especially in acute elderly care and more specifically decisions concerning the use of physical restraint require a thoughtful deliberation of the different values at stake. Qualitative evidence concerning nurses’ decision-making in cases of physical restraint provided important insights in the complexity of decision-making as a trajectory. However a nuanced (...) and refined understanding of the reasoning process in terms of ethical values is still lacking. A qualitative interview design, inspired by the Grounded Theory approach, was carried out to explore nurses’ reasoning process in terms of ethical values. We interviewed 21 acute geriatric nurses from 12 hospitals in different regions in Flanders, Belgium in the period October 2009–April 2011. The Qualitative Analysis Guide of Leuven was used to analyse interview data. Nurses’ decision-making is characterized as an ethical deliberation process where different values are identified and where the process of balancing these values forms the essence of ethical deliberation. Ethical decision-making in cases of physical restraint implies that nurses have to choose which values receive priority in the process, which entails that not all values can be respected to the same degree. As a result, decision making can be experienced as difficult, even as a dilemma. Driven by the overwhelming goal of protecting physical integrity, nurses took into account the values of dignity and justice more implicitly and less dominantly. (shrink)

The ideal of value free science states that the justification of scientific findings should not be based on non-epistemic (e.g. moral or political) values. It has been criticized on the grounds that scientists have to employ moral judgements in managing inductive risks. The paper seeks to defuse this methodological critique. Allegedly value-laden decisions can be systematically avoided, it argues, by making uncertainties explicit and articulating findings carefully. When does a human being begin to exist? Barry Smith and Berit Brogaard have argued that it is possible, through a combination of biological fact and philosophical analysis, to provide a definitive answer to this question. In their view, a human individual begins to exist at gastrulation, i. e. at about sixteen days after fertilization. In this paper we argue that even granting Smith and Brogaard's ontological commitments and biological assumptions, the existence of a human being can be shown to (...) begin much earlier, viz., with fertilization. Their interpretative claim that a zygote divides immediately into two substances and therefore ceases to exist is highly implausible by their own standards, and their factual claim that there is no communication between the blastomeres has to be abandoned in light of recent embryological research. We give a construction of the square principle by means of forcing with finite conditions.

The article deals with a seldom exposed but ubiquitous method in the 18th century philosophy, named conjectural history by Dugald Stewart. Its characteristic feature is a peculiar combination of historically verified facts and speculations, which in some authors are even openly fictitious. The hypotheses about prehistory (always set forth in the form of temporal historical narrative) are meant to aid a certain classic philosophical topos of the 18th century: the quest for origins. The article first surveys and compares common points (...) as well as peculiarities of various “treatises on the origins” in the Scottish and French Enlightenment. In the second half it focuses on an implicit but clearly identifiable conjectural history in Diderot's Supplement to the Voyage of Bougainville, and on the application of conjectural history in the domain of the intellect and knowledge in the Encylopédie. It seems that the genealogy of knowledge in d'Alembert's Preliminary Discourse most manifestly confirms the initial designation of conjectural history: that it is in fact another name for philosophy. If this holds true, than it might prove useful to search for its first seeds in Descartes’ Discourse on method, a work which places itself on the cross-section of history and fable. (shrink)

Gregor Moder’s Hegel and Spinoza: Substance and Negativity is a lively entry into current debates concerning Hegel, Spinoza, and their relation. Hegel and Spinoza are two of the most influential philosophers of the modern era, and the traditions of thought they inaugurated have been in continuous dialogue and conflict ever since Hegel first criticized Spinoza. Notably, eighteenth- and nineteenth-century German Idealists aimed to overcome the determinism of Spinoza’s system by securing a place for the freedom of the subject within (...) it, and twentieth-century French materialists such as Althusser and Deleuze rallied behind Spinoza as the ultimate champion of anti-Hegelian materialism. This conflict, or mutual rejection, lives on today in recent discussions about materialism. Contemporary thinkers either make a Hegelian case for the productiveness of concepts of the negative, nothingness, and death, or in a way that is inspired by Spinoza they abolish the concepts of the subject and negation and argue for pure affirmation and the vitalistic production of differences. Hegel and Spinoza traces the historical roots of these alternatives and shows how contemporary discussions between Heideggerians and Althusserians, Lacanians and Deleuzians are a variation of the disagreement between Hegel and Spinoza. Throughout, Moder persuasively demonstrates that the best way to read Hegel and Spinoza is not in opposition or contrast but together: as Hegel and Spinoza. (shrink)

As climate policy decisions are decisions under uncertainty, being based on a range of future climate change scenarios, it becomes a crucial question how to set up this scenario range. Failing to comply with the precautionary principle, the scenario methodology widely used in the Third Assessment Report of the International Panel on Climate Change (IPCC) seems to violate international environmental law, in particular a provision of the United Nations Framework Convention on Climate Change. To place climate policy advice on a (...) sound methodological basis would imply that climate simulations which are based on complex climate models had, in stark contrast to their current hegemony, hardly an epistemic role to play in climate scenario analysis at all. Their main function might actually consist in ‘foreseeing future ozone-holes’. In order to argue for these theses, I explain first of all the plurality of climate models used in climate science by the failure to avoid the problem of underdetermination. As a consequence, climate simulation results have to be interpreted as modal sentences, stating what is possibly true of our climate system. This indicates that climate policy decisions are decisions under uncertainty. Two general methodological principles which may guide the construction of the scenario range are formulated and contrasted with each other: modal inductivism and modal falsificationism. I argue that modal inductivism, being the methodology implicitly underlying the third IPCC report, is severely flawed. Modal falsificationism, representing the sound alternative, would in turn require an overhaul of the IPCC practice. (shrink)

This paper develops concepts and procedures for the evaluation of complex debates. They provide means for answering such questions as whether a thesis has to be considered as proven or disproven in a debate or who carries a burden of proof. While being based on classical logic, this framework represents an (argument-based) approach to non-monotonic, or defeasible reasoning. Debates are analysed as dialectical structures, i.e. argumentation systems with an attack- as well as a support-relationship. The recursive status assignment over the (...) arguments is conditionalised on proponents in a debate. The problem of multiple status assignments arising on circular structures is solved by showing that uniqueness can be guaranteed qua reconstruction of a debate. The notion of burden of proof as well as other discursive aims rational proponents pursue in a debate is defined within the framework. (shrink)

In the debate about the moral status of human embryos, it is not always clear which arguments are actually disputed. This book offers students and researchers, but also laypersons interested in the current debate, the opportunity to inform themselves about the current state of discussion and to learn about the most important arguments in a clear and concise form. These arguments are as follows: Since embryos as members of the species homo sapiens sapiens are human beings, they possess dignity (species (...) argument); embryos develop continuously, i.e. without morally relevant incisions, into adult human beings possessing dignity (continuum argument); embryos are identical with adult human beings possessing dignity (identity argument); embryos have the potential to become human beings, and this potential is without restriction worth protecting (potentiality argument). These arguments are each represented by a pro position and a contra position and defended or criticized. The time is near where ‘therapeutic’ bodily assistive devices, developed to mimic species-typical body structures in order to enable normative body functioning, will allow the wearer to outperform the species-typical body in various functions. Although such devices are developed for people that are seen to exhibit sub species-typical abilities, many ‘therapeutic enhancements’ might also be desired and used by people that exhibit species-typical body abilities. This paper presents the views of members of the World Federation of the Deaf on potential (...) beyond species-typical abilities enabling therapeutic assistive devices (i.e. related to hearing). Survey respondents showed support for the development and uptake of beyond normal hearing enabling devices. The views of survey respondents as clients affect hearing-enabling professions (such as audiologist and speech pathologists). The paper analyzes what guidance code of ethics of hearing enabling professions give in regards to beyond normal hearing enabling devices. This paper suggests that people labeled impaired and the professions that serve them should more involved in the enhancement discourse. (shrink)

Gregor Paul, Philosoph an der Universität Karlsruhe, will zeigen, “dass ein Krieg gegen den Terrorismus unmöglich wäre, wenn man gültiger Argumentation folgte”. Die Frage ist, ob es einen „gerechten Krieg“ überhaupt gibt – eine alte Frage, auf die nicht nur in der abendländischen Philosophie unterschiedliche Antworten gegeben worden sind. Paul lässt hier die alte chinesische Philosophie zu Wort kommen. An den Beispielen der Kriege in Afghanistan und Irak wie dem sogenannten Krieg gegen den Terrorismus zeigt Paul, wie für deren (...) “Gerechtigkeit” nicht nur nicht offen argumentiert, sondern eine notwendige allseitige Diskussion verhindert wurde. Erst eine solche offene Diskussion würde das Gewicht der Argumente zeigen und Paul ist überzeugt, dass die Argumente für Kriege jeglicher Art vor dem Forum der Vernunft als zu leicht befunden würden. "The objective of this book is to review the complex of issues in Soren Kierkegaard's concept of existence. It is evident that for Kierkegaard existence is always composed of three elements: namely, the subject, freedom, and the ethical. In the process of clarifying the relation between these three elements in the different stages of existence, the course of the development the individual must go through in order to become the single individual is described. "The study falls into four parts. The (...) first section describes the levels in existence on which as person attempts by his own powers to actualize the ethical ideals; in this stage the center of gravity for a person's effort still lies within the bounds of immanence. The second section describes a person's ethical and religious growth as it develops in relation to a transcendent power, whose highest expression is Christ as the revelation of God. The third section discusses the issues in existence that Kierkegaard himself designated as the most difficult of all for human thought. The last section points to the highest existential position to which philosophy in the broader sense and Christianity respectively can take a person. Kierkegaard utilizes these positions as a standard for evaluating existence within immanence and for Christian existence. (shrink)

The late Gregor Sebba was fond of describing his monumental Bibliographia Cartesiana: A Critical Guide to the Descartes Literature, 1800–1960 as a by-product of his research begun in 1949 for an article he had in mind titled The Dream of Descartes. The bibliography has been indispensable to Descartes scholars since its appearance in 1964. When Sebba died in 1985, his manuscript for The Dream of Descartes was still unfinished. Here, with materials provided by Aníbal A. Bueño, Richard H. Popkin, (...) and Helen Sebba, Richard A. Watson presents the completed work based on a 1973 draft, letters, outlines, and other manuscript material. Mit der Philosophie der Verkörperung gewinnt die Theologie einen Gesprächspartner, der ihr hilft, ihre eigene Körpervergessenheit zu überwinden und Anschluss (...) an die biblischen Anthropologien zu gewinnen. Denn diese verstehen die menschliche Existenz grundsätzlich als leiblich verfasst. Aktuelle Forschungen an der Schnittstelle von Neurobiologie und Philosophie einerseits und Exegese und Systematik andererseits lassen sich so in einen spannenden Diskurs bringen, an dessen Ende eine neue interdisziplinäre Anthropologie stehen könnte. This article discusses how inference to the best explanation can be justified as a practical meta - argument. It is, firstly, justified as a practical argument insofar as accepting the best explanation as true can be shown to further a specific aim. And because this aim is a discursive one which proponents can rationally pursue in — and relative to — a complex controversy, namely maximising the robustness of one’s position, IBE can be conceived, secondly, as a meta - argument. (...) My analysis thus bears a certain analogy to Sellars ’ well - known justification of inductive reasoning ; it is based on recently developed theories of complex argumentation. (shrink)

The aim of this paper is to develop and defend an Attentional View of bodily awareness, on which attention is necessary for bodily awareness. The original formulation of the Attentional View is due to Marcel Kinsbourne. First, I will show that the Attentional View of bodily awareness as formulated by Kinsbourne is superior to other accounts in the literature for characterizing the relationship between attention and bodily awareness. Kinsbourne’s account is the only account in the literature so far which can (...) accommodate key neurological diseases such as personal neglect. Second, when I consider Kinsbourne’s view in more detail, I will argue that Kinsbourne’s Attentional View faces problems because it is too reductive. Kinsbourne deviates from the standard taxonomy on which there is a body schema and a body image. Instead he reduces the body image to the neural representation of the body in the somatosensory cortex, the body schema and attentional shifts. I will present two challenges to Kinsbourne’s view which demonstrate that Kinsbourne’s reduction of the body image is unsuccessful. Finally, I will present a revised version of the Attentional View that is both empirically adequate and philosophically satisfactory. (shrink)

In this paper we address the issue of how to think about immunity. Many immunological writings suggest a straightforward option: the view that the immune system is primarily a system of defense, which naturally invites the talk of strong immunity and strong immune response. Despite their undisputable positive role in immunology, such metaphors can also pose a risk of establishing a narrow perspective, omitting from consideration phenomena that do not neatly fit those powerful metaphors. Building on this analysis, we argue (...) two things. First, we argue that the immune system is involved not only in defense. Second, by disentangling various possible meanings of ‘strength’ and ‘weakness’ in immunology, we also argue that such a construal of immunity generally contributes to the distortion of the overall picture of what the immune system is, what it does, and why it sometimes fails. Instead, we propose to understand the nature of the immune system in terms of contextuality, regulation, and trade-offs. We suggest that our approach provides lessons for a general understanding of the organizing principles of the immune system in health and disease. For all this to work, we discuss a wide range of immunological phenomena. (shrink)

One sees in this period the improvement of the bureaucratic system, the flourishing of a new poetic genre, the tz'u, a fresh approach to the study of Confucian cla~ics, the advancement of historiography and the rise of Neo-Confucianism. Ou-yang Hsiu (1907-1072) pioneered in all these magnificent political, cultural, and literary achievements. (...) Inevitably, he became a controversial figure to his contemporaries, and to later generations as well. There has not been a complete and balanced study, however, of this well-known and well-remembered man. Perhaps he was too broad and diverse a historical figure to be approached and studied easily. Professor Liu's book deserves our congratulations not merely for its well organized and scholarly presentation, but also for its successful approach to the subject from various angles. Ou-yang Hsiu was an official, a classicist, a political theorist, a historian, an essayist, and a poet. Accordingly this book gives separate chapters on Ou-yang Hsiu the classicist, the his= torian, the political theorist, the master of Sung literature, etc. With profound knowledge and sure control, the author organizes his materials so that the reader will not lose sight of the main points of the study. The best feature of this book (this reviewer feels) is that the author gives equal recognition to Ou-yang Hsiu the man and to the period in which he lived. Professor Liu ably and thoughtfully presents the historical characteristics of the Sung dynasty through Ou-yang Hsiu, and evaluates the merits and shortcomings, accomplishments and hmitations of Ouyang Hsiu against the peculiarity of his time. The subtitle of this book, An Eleventh=Century Neo=Con]ucianist, is most suitable. NeoConfucianism has always been studied abstractly as a philosophy, but Professor Liu's book shows us how this philosophy has been embodied in, substantialized, and practiced by "a key historical figure" who "gives us a finer perspective of his whole era." Volume II continues the rigorously chronological arrangement which singularly suits the philosophical writings of Descartes' "metaphysical period." Like no other edition, this one illuminates the often forgotten character of Descartes' philosophizing as an interaction between an ongoing dialogue (correspondence and replies to critics) and rigorously systematic thought. Imbedded in the stream of letters we find the Meditations not as a monolithic block, but as a sequence of three publications: the Latin text inserted at the time-point of its completion, April 1640; the French text with the first six Objections and Responses, August 1641; and at the end of the volume, the Seventh Objections and Responses and the letter to Diner. Only the Objections of Gassendi and Bourdin have been slightly cut. The volume concludes with the Recherche de la v~rit~ of unascertainable date (Aliqui~ thinks that it fits best into the 1641-42 context, without insisting on his conjecture). We thus have an edition that allows us to read the Meditations as Descartes' contemporaries---friends and adversaries --did. Once again the editor's notes are admirable, and there are brief but important critiques of the revised AT volume containing the Meditations, based on source studies by the editor, Henri Gouhier, and by Leslie J. Beck. This article critically examines the structure and content of the ‘New American Cultural Sociology’, through an engagement with the recent writings of its main representative, Jeffrey Alexander. Alexander’s project to retool sociology and cultural studies alike is coherent and ambitious, and his transition from theory scholar to public intellectual makes an assessment of that project additionally necessary. I argue, however, that while it gives a necessary jolt to conventional thinking around culture and meaning, major weaknesses and problems can be identified (...) in each of the three main levels of analysis: the articulation of the theoretical programme of cultural sociology, its application in substantive cultural exploration, and its emerging political ideology of civil society multiculturalism. Overall, the key theme of the critique is that Alexander’s long-standing concern, and talent, for ‘multidimensional’ social theory is heavily compromised by his equally strong inclination towards excessive culturalism and idealism. We propose that heroes and hero narratives fulfill important cognitive and emotional needs, including the need for wisdom, meaning, hope, inspiration, and growth. We propose a framework called the heroic leadership dynamic to explain how need-based heroism shifts over time, from our initial attraction to heroes to later retention or repudiation of heroes. Central to the HLD is idea that hero narratives fulfill both epistemic and energizing functions. (...) Hero stories provide epistemic benefits by providing scripts for prosocial action, by revealing fundamental truths about human existence, by unpacking life paradoxes, and by cultivating emotional intelligence. To energize us, heroes promote moral elevation, heal psychic wounds, inspire psychological growth, and exude charisma. Examining developments in two of the central traditions of social and political theory - Marxism and pluralism, this work investigates whether the relation between them is one of progressive convergence.

Aristotle's notion of experience plays an important role in his epistemology as the link between perception and memory on the one side, and higher cognitive capacities on the other side. However, Aristotle does not say much about it, and what he does say seems inconsistent. Notably, some passages suggest that it is a non-rational capacity, others that it is a rational capacity and that it provides the principles of science.
