The equipoise requirement in clinical research demands that, if patients are to be randomly assigned to one of two interventions in a clinical trial, there must be genuine doubt about which is better. This reflects the traditional view that physicians must never knowingly compromise the care of their patients, even for the sake of future patients. Equipoise has proven to be deeply problematic, especially in the Third World. Some recent critics have argued against equipoise on the grounds that clinical research (...) is fundamentally distinct from clinical care, and thus should be governed by different norms. I argue against this "difference position," and instead take issue with the traditional, exclusively patient-centered account of physicians' obligations that equipoise presupposes. In place of this traditional view, I propose a Kantian test for the reasonable partiality that physicians should show their patients, focusing on its application in clinical research and medical education. ABSTRACT The term “deep state” has enjoyed political prominence in recent years, especially in movements around former President Donald Trump. However, the term emerged in the activist milieu after the founding of Students for a Democratic Society, which sought to engender political realignment in the aftermath of the Kennedy assassination. Those on the far right who use the term to level accusations of conspiracy at supposed subversives in the administrative state are unwittingly drawing on a long-running but little-analyzed intellectual tradition. (...) In that tradition, conspiracy theories purport to unmask the real intentions of political actors in order to facilitate cooperation and recruitment across ideological and partisan divides. From the postwar period to the present, conspiracy theories, and the “deep state” vocabulary in particular, circulated freely across the left-right political divide. Authors and activists were attracted to these tropes and texts not merely because they appeared to reveal concrete truths about long-hidden elements of American political life, but also because their very ambiguity enabled them to be flexibly co-opted. Conspiracy theories allowed activists to mobilize around shared gaps in public knowledge about traumatic events like the assassination, activating public dissatisfaction with official explanations of those events. Their ambiguity, coupled with the seeming pervasiveness of conspiracy theorist tropes across political divides, appeared to activists seeking realignment of both the left and the right as a promising tactical opportunity to assert that they and their erstwhile enemies were actually engaged in a shared project. Activists thus came to see conspiracy theory not as the province of an exclusively left or right politics, but as an autonomous and contestable cultural space. ABSTRACT: So far in this book, we have examined algorithmic decision systems from three autonomy-based perspectives: in terms of what we owe autonomous agents (chapters 3 and 4), in terms of the conditions required for people to act autonomously (chapters 5 and 6), and in terms of the responsibilities of agents (chapter 7). -/- In this chapter we turn to the ways in which autonomy underwrites democratic governance. Political authority, which is to say the ability of a government to exercise (...) power, may be justifiable or not. Whether it is justified and how it can come to be justified is a question of political legitimacy. Political legitimacy is another way in which autonomy and responsibility are linked. This relationship is the basis of the current chapter, and it is important in understanding the moral salience of algorithmic systems. We will draw the connection as follows. We begin, in section 8.1, by describing two uses of technology: crime predicting technology used to drive policing practices and social media technology used to influence elections (including by Cambridge Analytica and by the Internet Research Agency). In section 8.2 we consider several views of legitimacy and argue for a hybrid version of normative legitimacy based on one recently offered by Fabienne Peter. In section 8.3 we will explain that the connection between political legitimacy and autonomy is that legitimacy is grounded in legitimating processes, which are in turn based on autonomy. Algorithmic systems—among them PredPol and the Cambridge Analytica-Facebook-Internet Research Agency amalgam—can hinder that legitimation process and conflict with democratic legitimacy, as we argue in section 8.4. A conception of recognitional abilities and perceptual-discriminative abilities is deployed to make sense of how perceptual experiences enable us to make cognitive contact with objects and facts. It is argued that accepting the emerging view does not commit us to thinking that perceptual experiences are essentially relational, as they are conceived to be in disjunctivist theories. The discussion explores some implications for the theory of knowledge in general and, in particular, for the issue of how we can shed light on (...) the nature of knowledge is if we do not aim to provide conceptual analyses of knowledge in terms of true belief plus something else. Algorithmic systems and predictive analytics play an increasingly important role in various aspects of modern life. Scholarship on the moral ramifications of such systems is in its early stages, and much of it focuses on bias and harm. This paper argues that in understanding the moral salience of algorithmic systems it is essential to understand the relation between algorithms, autonomy, and agency. We draw on several recent cases in criminal sentencing and K–12 teacher evaluation to outline four key ways in (...) which issues of agency, autonomy, and respect for persons can conflict with algorithmic decision-making. Three of these involve failures to treat individual agents with the respect they deserve. The fourth involves distancing oneself from a morally suspect action by attributing one’s decision to take that action to an algorithm, thereby laundering one’s agency. (shrink)

Causal and counterfactual thoughts are bound together in Byrne's theory of human imagination. We think there are two issues in her theory that deserve clarification. First, Byrne describes which counterfactual possibilities we think of, but she leaves unexplained the mechanisms by which we generate these possibilities. Second, her exploration of and enablers gives two different predictions of which counterfactuals we think of in causal scenarios. On one account, we think of the counterfactuals which we have control over. On the other, (...) which counterfactuals we think of depends on whether something is a strong cause or an enabler. Although these two accounts sometimes give the same predictions, we present cases in which they differ, and we would like to see Byrne's theory provide a way of reconciling these differences. Confucian scholars express skepticism about rights. This skepticism is relevant to managers who face issues about the recognition of workplace rights in a Confucian culture. My essay examines the foundations of this skepticism, and the cogency of potential leading Western liberal responses to it. I conclude that Confucian skepticism is more formidable than liberals have recognized. I attempt to craft an argument that defuses Confucian skepticism about workplace rights while at the same time respecting the moral depth of Confucianism.

This new volume on the model he created discusses the developments that have occurred within the model in the past twenty years, and places it within a broader context.

The increasing use of transnational standard-setting bodies to address quality uncertainties and coordination issues across the global economy raises questions about how these bodies establish and maintain their legitimacy and accountability outside the sovereignty of democratic states. Based on a discussion of the legitimacy challenge posed by global governance, we provide an overview of mechanisms by which such bodies can defend their legitimacy claims and examine the actual mechanisms used by the International Accounting Standards Board (IASB). While the IASB staked (...) its initial credibility on technical competence and independence, it has increasingly emphasized due process norms in its claim for support. Our analysis evaluates the IASB due process against the cultural benchmarks established by domestic standard-setters in the USA and UK and against a normative model of procedural legitimacy. These comparisons help us to understand the modifications that were made in the hope of due process adding legitimacy to accounting standard-setting beyond the state. They also reveal the broader political context of competing legitimacy criteria that confronts transnational standard-setters. (shrink)

Many explanations in science make use of mathematics. But are there cases where the mathematical component of a scientific explanation is explanatory in its own right? This issue of mathematical explanations in science has been for the most part neglected. I argue that there are genuine mathematical explanations in science, and present in some detail an example of such an explanation, taken from evolutionary biology, involving periodical cicadas. I also indicate how the answer to my title question impacts on broader (...) issues in the philosophy of mathematics; in particular it may help platonists respond to a recent challenge by Joseph Melia concerning the force of the Indispensability Argument. In spite of a powerful tradition, more than two thousand years old, that in a valid argument the premises must be relevant to the conclusion, twentieth-century logicians neglected the concept of relevance until the publication of Volume I of this monumental work. Since that time relevance logic has achieved an important place in the field of philosophy: Volume II of Entailment brings to a conclusion a powerful and authoritative presentation of the subject by most of the top people working in (...) the area. Originally the aim of Volume II was simply to cover certain topics not treated in the first volume--quantification, for example--or to extend the coverage of certain topics, such as semantics. However, because of the technical progress that has occurred since the publication of the first volume, Volume II now includes other material. The book contains the work of Alasdair Urquhart, who has shown that the principal sentential systems of relevance logic are undecidable, and of Kit Fine, who has demonstrated that, although the first-order systems are incomplete with respect to the conjectured constant domain semantics, they are still complete with respect to a semantics based on "arbitrary objects." Also presented is important work by the other contributing authors, who are Daniel Cohen, Steven Giambrone, Dorothy L. Grover, Anil Gupta, Glen Helman, Errol P. Martin, Michael A. McRobbie, and Stuart Shapiro. Robert G. Wolf's bibliography of 3000 items is a valuable addition to the volume. (shrink)
