This article proposes a novel mapping of the complex relationship between business ethics and regulation, by suggesting five distinct ways in which business ethics and regulation may intersect. The framework is applied to a comparative case study of business responses to climate change regulation in Canada and Germany, both signatories to the Kyoto Protocol. Both countries represent distinctly different approaches which yield significant lessons for emerging economies. We also analyze the specific role of large multinational corporations in this process.

The increasing use of transnational standard-setting bodies to address quality uncertainties and coordination issues across the global economy raises questions about how these bodies establish and maintain their legitimacy and accountability outside the sovereignty of democratic states. Based on a discussion of the legitimacy challenge posed by global governance, we provide an overview of mechanisms by which such bodies can defend their legitimacy claims and examine the actual mechanisms used by the International Accounting Standards Board (IASB). While the IASB staked (...) its initial credibility on technical competence and independence, it has increasingly emphasized due process norms in its claim for support. Our analysis evaluates the IASB due process against the cultural benchmarks established by domestic standard-setters in the USA and UK and against a normative model of procedural legitimacy. These comparisons help us to understand the modifications that were made in the hope of due process adding legitimacy to accounting standard-setting beyond the state. They also reveal the broader political context of competing legitimacy criteria that confronts transnational standard-setters. (shrink)

Wie aber kann das gelingen? In vielen verfügbaren Unterrichtsmaterialien werden argumentative Fähigkeiten eher vorausgesetzt als systematisch gefördert. Auch curriculare Vorgaben bleiben zumeist sehr unspezifisch. Lehrpersonen werden so weitgehend allein gelassen mit der Aufgabe, Lernende beim (...) Erwerb argumentativer Fähigkeiten zu fördern. Die vorliegende Aufgabensammlung soll dazu beitragen, diese Lücke zu schließen. Sie bietet Lehrpersonen reichhaltige Materialien für die spiralcurricular angelegte, systematische Förderung argumentativer Fähigkeit anhand exemplarischer Inhalte. In this paper, we propose a framework for fostering argumentative skills in a systematic way in Philosophy and Ethics classes. We start with a review of curricula and teaching materials from the German-speaking world to show that there is an urgent need for standards for the teaching and learning of argumentation. Against this backdrop, we present a framework for such standards that is intended to tackle these difficulties. The spiral-curricular model of argumentative competences we sketch helps teachers introduce the relevant (...) concepts and skills to students early on in their school career. The following article has its basis in the respective chapter of my book entitled Work, Death, and Life Itself . In the present article I intend to elaborate the working hypothesis that the attempt to increase and extend participation in contemporary work enterprises can be understood more than ever before as a collusive quarrel between managers and workers about immortality. The quarrel has its roots in the widespread experience of the discrepancy between the vigour with which participation in organisations is (...) demanded and offered on the one hand and the inadequacy and limitations of its actual realisation on the other. Attempts to increase participation in a work enterprise are often confronted at an early stage with insoluble difficulties which too often lead to termination of the participation project.Although participation in general, and in work enterprises in particular, is generally seen as a paradigm for integration, co operation and democratisation among more or less equal partners, I propose the hypothesis that any attempt to practice participation will most probably lead to a situation in which management and workers get entangled in a collusive quarrel concerning the preconditions, content and range of said participation. Sustained by the predominant myth that management means the management of people, workers tend to become infantilised. The deep contempt and mistrust that so often characterise relations between managers and workers and/or their respective representatives thus poisons any simultaneous desire for trust and cooperation.In an analogy with ancient Greek mythology and its inherent quarrel between the immortal gods and the mortal ephemerals, the collusion between management and workers in contemporary work enterprises can be understood as a quarrel about participating in immortality. Since immortality is a limited resource, it is only available to the happy few. The collusive quarrel and the underlying split between managers and workers can only be overcome if both parties recognise that as human beings they can neither escape mortality nor relieve the other of it. In specifying the phenomenon, I point out features which often characterise introductory philosophy courses both in secondary schools and at the university level. I argue that these features make student scepticism particularly challenging. Secondly, I describe a central objective of doing philosophy, and highlight three basic pedagogical principles. I argue (...) that this objective and these principles should function as criteria for assessing strategies which teachers might adopt in reaction to metaphilosophical scepticism. Thirdly, I discuss several such strategies with reference to the proposed principles and the features which are characteristic of introductory courses. I argue that especially strategies which encourage students to philosophise themselves are recommendable. Virtual Reality has often been referred to as an “empathy machine.” This is mostly because it can induce empathy through embodiment experiences in outgroup membership. However, the potential of intergroup contact with an outgroup avatar in VR to increase empathy is less studied. Even though intergroup contact literature suggests that less threatening and more prosocial emotions are the key to understanding why intergroup contact is a powerful mean to decrease prejudice, few studies have investigated the effect of intergroup contact on (...) empathy in VR. In this study, we developed a between-participants design to investigate how VR can be used to create a positive intergroup contact with a member of a stigmatized outgroup and present the results of the effect of intergroup contact in VR on empathy. Sixty four participants experienced either positive contact with a black avatar or no intergroup contact, with situational empathy being measured through a self-report questionnaire up to a week before and right after the VR contact experience. The experiment showed that satisfying degrees of body ownership of participants’ own avatar and co-presence with the contacted avatar can be achieved in simple and universally accessible virtual environments such as AltspaceVR. The results indicated that while VR intergroup contact had no significant direct effect on empathy, exploratory analyses indicated that post-intervention empathic interest increased with stronger feelings of co-presence in the intergroup contact condition. It can be seen, that there was no agreement within the Vatican on how to deal with National Socialism. Recent publications have constructed an antagonism between Cardinal Secretary Eugenio Pacelli and Alois Hudal, the politically active principal of the Collegio Santa Maria dell'Anima and supposedly a representative of,appeasement'. However, it can be shown that both (...) men initially agreed in principle with their assessment of National Socialism, even though they pursued different strategies. Hudal insisted on the public denunciation of National Socialism, on a clear positioning of the school, yet without success. Pacelli, a diplomat by training, was the one who thwarted nearly all of the Vatican's public proclamations against National Socialism. (shrink)

In Institutio oratoria 1,7,23 and 9,4,39 Quintilian quotes a somewhat idiosyncratic Catonian spelling for dicam and faciam. The manuscripts offer for the first passage both dicae / faciae and dice / facie as variants, whereas the second passage is corrupt, but in all probability has to be emended according to 1,7,23. Recently James Bradford Churchill and Wolfram Ax have advocated the spellings with -e. In contrast, this paper first argues on the basis of a thorough analysis of the two passages (...) for the readings dicae and faciae, which Quintilian believed Cato the elder to have written; secondly it is likely that Cato indeed had used these forms to render the weakened pronunciation of m, which sounded (as we may presume) like a weak e (something like a schwa) to him. His naturalistic epistemology, "state", "general/universal laws", "social statics/dynamics" are discussed, as well as his four methods. His nomological-behavioral position is analysed, along with his theoretical approach.

This paper is intended to outline both a special field of somatic inquiry concerning bodily communication and resonance and a theoretical approach combining concepts from the philosophical discourse of “Leibphänomenologie” with empirical participant research on bodily practices in somatics and modern dance. Since both the field of inquiry and the theoretical approach are not yet well established, but rather a work in progress, the paper will focus on the delineation of some theoretical conjectures and conceptual propositions, a few empirical observations, (...) and open questions. In den moralphilosophischen Debatten der Gegenwart besteht eine Tendenz, bei der Entwicklung neuer Ansätze auf Elemente antiker Theorien zurückzugreifen, wobei v. a. die Ethik des Aristoteles eine wichtige Rolle spielt. Am Anfang dieses Rückgriffs auf die Antike steht eine grundlegende Kritik an modernen Ethik-Konzeptionen. Um die Wiederbelebung der aristotelischen Ethik zu verstehen, ist es sinnvoll, sich zunächst diese Kritik vor Augen zu führen.

Operation Ill Wind has brought public attention to the criminal and unethical conduct of large defense contractors in their dealings with the government. This article will review how the defense contract bidding process operates and why illegal activity has been able to compromise the process. This article contains some further clarifications of the postitions held by the 'Starnberg Group', i.e. the constitution theory and the finalization theory with particular respect to the case of Classical Hydrodynamics. It is an answer to G. Eberlein und N. Dietrich who recently published a full monography dedicated to criticism of these positions.

We discuss the existence of universal spaces (either in the sense of embeddings or continuous images) for some classes of scattered Eberlein compacta. Given a cardinal κ, we consider the class Sκ of all scattered Eberlein compact spaces K of weight ≤ κ and such that the second Cantor-Bendixson derivative of K is a singleton. We prove that if κ is an uncountable cardinal such that κ = 2<κ, then there exists a space X in Sκ such that (...) every member of Sκ is homeomorphic to a retract of X. We show that it is consistent that there does not exist a universal space (either by embeddings or by mappings onto) in Sω₁. Assuming that ∂ = ω₁, we prove that there exists a space X ∈ Sω₁, which is universal in the sense of embeddings. "Der Aufsatz zielt darauf, der Prozess der historischen Überlagerung, Substitution und Verbreitung des theoretischen Paradigmas der Depression gegenüber jenem der Melancholie darzustellen. Im ersten Teil wird versucht, einige der einschneidenden Eigenschaften der Thematisierungen der Melancholie in der Frühen Neuzeit anzugeben, auch im Verhältnis zum Geist des Kapitalismus. Nachdem eine Skizze der Entstehung der moderne Kategorie der Depression, geht es darum, den Verlauf nachzuzeichnen, der im 20. Jahrhundert zu ihrer Transformation in ein weitläufiges theoretisches Paradigma geführt hat, das schließlich jenes der (...) Melancholie ersetzt hat. Der zweite Teil stellt den Versuch dar, eine Zeitdiagnose umzureißen: An dieser Stelle ist die psychosoziale Bedeutung bestimmter sozioökonomischer und kultureller Mechanismen zu untersuchen, unter besonderem Hinweis auf das, was als »der neue Geist des Kapitalismus« bezeichnet worden ist, sowie auf neue Formen des Individualismus und ihre paradoxen Dynamiken. Abschließend wird eine Brücke geschlagen, zwischen der Geschichte der beiden bezeichneten Paradigmen und der zeitgenössischen psychosozialen Dynamiken, die mit dem als »depressive Epidemie« interpretierten Phänomen verbunden sind. -/- The essay aims to analyse the gradual historical process of the partial overlap, replacement and expansion of the theoretical paradigm of depression with respect to that of melancholy. The first part is devoted to analysing some of the central features of the multivalent thematizations of melancholy drawn up during modernity, also with relation to the spirit of capitalism (in its Weberian acceptation). This is followed by an overview of the birth of the modern category of depression, and the process that during the twentieth century led to its transformation into a theoretical and nosological paradigm which in the end replaced that of melancholy. The second part is the attempt to draw up a Zeitdiagnose: the aim is to assess the ‘depressive’ psychosocial impact exercised by particular socio-economic mechanisms and cultural trends, with particular reference to what has been defined as the ‘new spirit of capitalism’, as well as the new forms of individualism and their paradoxical dynamics. In conclusion, I will form a bridge between the history of the two aforesaid paradigms and the contemporary psychosocial dynamics correlated to the phenomenon today interpreted as a ‘depression epidemic’.". After studying philosophy in Frankfurt and sociology in Münster he worked for a number of years in the United States at the University of Michigan, Columbia University in New York and in Washington. At present he is full professor of organisation development' at the Bergische Universität, Wuppertal, Germany.He has published a number of articles in the area of 'organisational sociology’ in which he approaches management problems in organisations from a (...) variety of unusual perspectives. His most important book was published by Walter de Gruyter in 1994 under the title Work, Death and Life Itself — Essays on Management and Organisation and was awarded the HBK prize for employee participation in an organisation in 1995. We study and characterize stability, the negation of the independence property (NIP) and the negation of the strict order property (NSOP) in terms of topological and measure theoretical properties of classes of functions. We study a measure theoretic property, Talagrand's stability, and explain the relationship between this property and the NIP in continuous logic. Using a result of Bourgain, Fremlin, and Talagrand, we prove almost definability and Baire 1 definability of coheirs assuming the NIP. We show that a formula has (...) the strict order property if and only if there is a convergent sequence of continuous functions on the space of φ‐types such that its limit is not continuous. We deduce from this a theorem of Shelah and point out the correspondence between this theorem and the Eberlein‐Šmulian theorem. (shrink)

Spatestens seit dem emotional turn in den Kulturwissenschaften zu Anfang dieses Jahrhunderts ist die Leibphanomenologie von Hermann Schmitz kein Geheimtipp mehr. Die Zahl der Studien, die sich mit ihr auseinandersetzen, ist heute kaum uberschaubar. Der Band versucht nach knapp einem halben Jahrhundert Wirkungsgeschichte eine Art Zwischenbilanz zu ziehen. Er fragt, inwiefern und in welchen Kontexten sich die von Schmitz erarbeiteten Kategorien des eigenleiblichen Spurens bewahrt haben. Die Beitrage erortern die gespurte Leiblichkeit in ihrer Verflechtung mit Sachverhalten wie Geschichte, Kultur, Person, (...) Geschlecht sowie als Aktionsfeld leiblicher Kommunikation und zeugen davon, dass das von Schmitz begonnene Projekt uber die Philosophie hinaus auch von anderen Wissenschaften stetig erganzt und weiterentwickelt wird. Vor dem Hintergrund eines sich am Leitmodell des sicht- und tastbaren Korpers orientierenden Denkens konnten sprachliche Ausdrucke fur leibliches Erleben nur als Skandal der Metapher (Strub) begriffen werden. Die Leibphanomenologie bietet dagegen einen alternativen Zugang, dem aber der Korper, wie Schmitz sagt, zum Skandal wird. Diesem schwierigen Verhaltnis von Leib und Korper geht der Band nach, um das Skandalose theoretisch einzuholen.
