Each of the books that Hannah Arendt published in her lifetime was unique, and to this day each continues to provoke fresh thought and interpretations. This was never more true than for Eichmann in Jerusalem, her account of the trial of Adolf Eichmann, where she first used the phrase “the banality of evil.” Her consternation over how a man who was neither a monster nor a demon could nevertheless be an agent of the most extreme evil evoked derision, outrage, and (...) misunderstanding. The firestorm of controversy prompted Arendt to readdress fundamental questions and concerns about the nature of evil and the making of moral choices. Responsibility and Judgment gathers together unpublished writings from the last decade of Arendt’s life, as she struggled to explicate the meaning of Eichmann in Jerusalem. At the heart of this book is a profound ethical investigation, “Some Questions of Moral Philosophy”; in it Arendt confronts the inadequacy of traditional moral “truths” as standards to judge what we are capable of doing, and she examines anew our ability to distinguish good from evil and right from wrong. We see how Arendt comes to understand that alongside the radical evil she had addressed in earlier analyses of totalitarianism, there exists a more pernicious evil, independent of political ideology, whose execution is limitless when the perpetrator feels no remorse and can forget his acts as soon as they are committed. Responsibility and Judgment is an essential work for understanding Arendt’s conception of morality; it is also an indispensable investigation into some of the most troubling and important issues of our time. Kant's attempt to establish the principles behind the faculty of judgment remains one of the most important works on human reason.

In this paper I present reasons for us to accept the hypothesis that suspended judgment has correctness conditions, just like beliefs do. Roughly put, the idea is that suspended judgment about p is correct when both p and ¬p might be true in view of certain facts that characterize the subject’s situation. The reasons to accept that hypothesis are broadly theoretical ones: it adds unifying power to our epistemological theories, it delivers good and conservative consequences, and it allows us to (...) assess processes of reasoning involving attitudes of suspended judgment. How Doctors Think defines the nature and importance of clinical judgment. Although physicians make use of science, this book argues that medicine is not itself a science but rather an interpretive practice that relies on clinical reasoning. A physician looks at the patient's history along with the presenting physical signs and symptoms and juxtaposes these with clinical experience and empirical studies to construct a tentative account of the illness. How Doctors Think is divided into four parts. Part one introduces the (...) concept of medicine as a practice rather than a science; part two discusses the idea of causation; part three delves into the process of forming clinical judgment; and part four considers clinical judgment within the uncertain nature of medicine itself. The aggregation of individual judgments over interrelated propositions is a newly arising field of social choice theory. I introduce several independence conditions on judgment aggregation rules, each of which protects against a specific type of manipulation by agenda setters or voters. I derive impossibility theorems whereby these independence conditions are incompatible with certain minimal requirements. Unlike earlier impossibility results, the main result here holds for any (non-trivial) agenda. However, independence conditions arguably undermine the logical structure of judgment aggregation. I therefore (...) suggest restricting independence to premises, which leads to a generalised premise-based procedure. The aim of this paper is to revive a tradition of educational thought that identifies good judgment as the highest aim of education. It identifies sharply opposed manifestations of this tradition in the works of Aristotle and Locke, and uses these as points of departure in defending and exploring the tradition. The defense rests on the claims that the basic aim of educational institutions should be to enable people to live well and that good judgment is essential to living well. (...) The relationships between good judgment and other widely discussed educational aims are addressed, including autonomy, fulfillment of potential, and acquisition of knowledge. Consider orthodox motivational judgment internalism: necessarily, A’s sincere moral judgment that he or she ought to φ motivates A to φ. Such principles fail because they cannot accommodate the amoralist, or one who renders moral judgments without any corresponding motivation. The orthodox alternative, externalism, posits only contingent relations between moral judgment and motivation. In response I first revive conceptual internalism by offering some modifications on the amoralist case to show that certain community-wide motivational failures are not conceptually possible. Second, I (...) introduce a theory of moral motivation that supplements the intuitive responses to different amoralist cases. According to moral judgment purposivism (MJP), in rough approximation, a purpose of moral judgments is to motivate corresponding behaviors such that a mental state without this purpose is not a moral judgment. Several recent results on the aggregation of judgments over logically connected propositions show that, under certain conditions, dictatorships are the only propositionwise aggregation functions generating fully rational (i.e., complete and consistent) collective judgments. A frequently mentioned route to avoid dictatorships is to allow incomplete collective judgments. We show that this route does not lead very far: we obtain oligarchies rather than dictatorships if instead of full rationality we merely require that collective judgments be deductively closed, arguably a minimal condition of (...) rationality, compatible even with empty judgment sets. We derive several characterizations of oligarchies and provide illustrative applications to Arrowian preference aggregation and Kasher and Rubinsteinís group identification problem. (shrink)

Ernest Sosa extends his distinctive approach to epistemology, intertwining issues concerning the role of the will in judgment and belief with issues of epistemic evaluation. Questions about skepticism and the nature of knowledge are at the forefront. The answers defended are new in their explicit and sustained focus on judgment and epistemic agency. While noting that human knowledge trades on distinctive psychological capacities, Sosa also emphasizes the role of the social in human knowledge. The aggregation of consistent individual judgments on logically interconnected propositions into a collective judgment on those propositions has recently drawn much attention. Seemingly reasonable aggregation procedures, such as propositionwise majority voting, cannot ensure an equally consistent collective conclusion. The literature on judgment aggregation refers to that problem as the discursive dilemma. In this paper, we motivate that many groups do not only want to reach a factually right conclusion, but also want to correctly evaluate the reasons for that conclusion. In (...) other words, we address the problem of tracking the true situation instead of merely selecting the right outcome. We set up a probabilistic model analogous to Bovens and Rabinowicz (2006) and compare several aggregation procedures by means of theoretical results, numerical simulations and practical considerations. Among them are the premise-based, the situation-based and the distance-based procedure. Our findings confirm the conjecture in Hartmann, Pigozzi and Sprenger (2008) that the premise-based procedure is a crude, but reliable and sometimes even optimal form of judgment aggregation. Abstract In this paper I undertake an in-depth examination of an oft mentioned but rarely expounded upon state: suspended judgment. While traditional epistemology is sometimes characterized as presenting a “yes or no” picture of its central attitudes, in fact many of these epistemologists want to say that there is a third option: subjects can also suspend judgment. In Kant’s logical texts the reference of the form S is P to an “unknown = x” is well known, but its understanding still remains controversial. Due to the universality of all concepts, the subject as much as the predicate is regarded as predicate of the x, which, in turn, is regarded as the subject of the judgment. In the CPR, this Kantian interpretation of the S-P relationship leads to the question about the relations between intuition and concept in judgment. (...) In contrast to intuition, if no concept, due to its universality, refers immediately to an object, how should one understand the relations of S and P to one another, as well as their relations to intuition, which corresponds to the possible individuality of the object in general = x? In this essay I argue that moral judgment is a natural kind by developing an empirically grounded theory of the distinctive conceptual content of moral judgments. Psychological research on the moral/conventional distinction suggests that in moral judgments right and wrong, good and bad, praiseworthiness and blameworthiness, etc. are conceptualized as serious, general, authority-independent, and objective. After laying out the theory and the empirical evidence that supports it, I address recent empirical and conceptual objections. This article described three heuristics that are employed in making judgements under uncertainty: representativeness, which is usually employed when people are asked to judge the probability that an object or event A belongs to class or process B; availability of instances or scenarios, which is often employed when people are asked to assess the frequency of a class or the plausibility of a particular development; and adjustment from an anchor, which is usually employed in numerical prediction when a relevant value (...) is available. These heuristics are highly economical and usually effective, but they lead to systematic and predictable errors. A better understanding of these heuristics and of the biases to which they lead could improve judgements and decisions in situations of uncertainty. (shrink)

In the theory of judgment aggregation, it is known for which agendas of propositions it is possible to aggregate individual judgments into collective ones in accordance with the Arrow-inspired requirements of universal domain, collective rationality, unanimity preservation, non-dictatorship and propositionwise independence. But it is only partially known (e.g., only in the monotonic case) for which agendas it is possible to respect additional requirements, notably non-oligarchy, anonymity, no individual veto power, or implication preservation. We fully characterize the agendas for which there (...) are such possibilities, thereby answering the most salient open questions about propositionwise judgment aggregation. Philosophy long sought to set knowledge on a firm foundation, through derivation of indubitable truths by infallible rules. For want of such truths and rules, the enterprise foundered. Nevertheless, foundationalism's heirs continue their forbears' quest, seeking security against epistemic misfortune, while their detractors typically espouse unbridled coherentism or facile relativism. Maintaining that neither stance is tenable, Catherine Elgin devises a via media between the absolute and the arbitrary, reconceiving the nature, goals, and methods of epistemology. In Considered Judgment, she argues (...) for a reconception that takes reflective equilibrium as the standard of rational acceptability. A system of thought is in reflective equilibrium when its components are reasonable in light of one another, and the account they comprise is reasonable in light of our antecedent convictions about the subject it concerns. Many epistemologists now concede that certainty is a chimerical goal. But they continue to accept the traditional conception of epistemology's problematic. Elgin suggests that in abandoning the quest for certainty we gain opportunities for a broader epistemological purview--one that comprehends the arts and does justice to the sciences. She contends that metaphor, fiction, emotion, and exemplification often advance understanding in science as well as in art. The range of epistemology is broader and more variegated than is usually recognized. Tenable systems of thought are neither absolute nor arbitrary. We propose a revised set of moral dilemmas for studies on moral judgment. We selected a total of 46 moral dilemmas available in the literature and fine-tuned them in terms of four conceptual factors (Personal Force, Benefit Recipient, Evitability and Intention) and methodological aspects of the dilemma formulation (word count, expression style, question formats) that have been shown to influence moral judgment. Second, we obtained normative codings of arousal and valence for each dilemma showing that emotional arousal in response to (...) moral dilemmas depends crucially on the factors Personal Force, Benefit Recipient, and Intentionality. Third, we validated the dilemma set confirming that people's moral judgment is sensitive to all four conceptual factors, and to their interactions. Results are discussed in the context of this field of research, outlining also the relevance of our RT effects for the Dual Process account of moral judgment. Finally, we suggest tentative theoretical avenues for future testing, particularly stressing the importance of the factor Intentionality in moral judgment. Additionally, due to the importance of cross-cultural studies in the quest for universals in human moral cognition, we provide the new set dilemmas in six languages (English, French, German, Spanish, Catalan and Danish). We only regard a system or a process as being “scientific” if it displays the three predominant characteristics of the natural sciences: predictability, repeatability and quantifiability. This by definition precludes intuition, subjective judgement, tacit knowledge, heuristics, dreams, etc. in other words, those attributes which are peculiarly human. Furthermore, this is resulting in a shift from judgment to calculation giving rise, in some cases, to an abject dependency on the machine and an inability to disagree with the outcome or even question (...) it. To tolerate such a situation could be seen as an abdication of professional responsibility. In complex technological and scientific environments, it is sometimes said that those who make best use of computers already know what the answer is (in ball park terms) before the calculation. Since several landmark legal decisions in the 1970s and 1980s, substituted judgment has become widely accepted as an approach to decision‐making for incapacitated patients that incorporates their autonomy and interests. Two notable exceptions have been cases involving minors and those involving cognitively or psychiatrically impaired individuals who never previously possessed the ability to contemplate the medical decisions involved in their care. While a best interest standard may have universal merit in pediatric cases, this paper argues that substituted judgement has been (...) rejected too broadly for “never‐capacitated” patients. It then lays out a three‐condition test for using substituted judgment in these cases. For a subset of “never‐capacitated” patients who belong to distinctive religious or cultural communities with clear medical values and have an appropriate surrogate, these values may prove helpful in vindicating the interests of the never‐capacitated and should not be blanketly dismissed. What is it to suspend judgment about whether p? Much of the recent work on the nature and normative profile of suspending judgment aims to analyze it as a kind of doxastic attitude. On some of these accounts, suspending judgment about whether p partly consists in taking up a certain higher-order belief about one's deficient epistemic position with respect to whether p. On others, suspending judgment about whether p consists in taking up a sui generis attitude, one that takes the (...) question of whether p? as its content. In this paper, I defend an account on which suspending judgment about whether p is not a matter of taking up a doxastic attitude, but rather a way of intentionally omitting to judge whether p. I then close with a discussion of how an account like mine, which sees suspending judgment as fundamentally practical, rather than doxastic, can accommodate what appear to be distinctively epistemic reasons to suspend judgment. When the side effect of an action involves moral considerations (e.g. when a chairman’s pursuit of profits harms the environment) it tends to influence theory-of-mind judgments. On average, bad side effects are judged intentional whereas good side effects are judged unintentional. In a series of two experiments, we examined the largely uninvestigated roles of individual differences in this judgment asymmetry. Experiment 1 indicated that extraversion accounted for variations in intentionality judgments, controlling for a range of other general individual differences (e.g. (...) working memory, self-control). Experiment 2 indicated that extraversion’s influence was partially mediated by more specific variations in intentional action concepts. A priming manipulation also provided causal evidence of judgment instability and bias. Results suggest that the intentional action judgment asymmetry is multiply determined, reflecting the interplay of individual differences and judgment biases. Implications and the roles of individual differences in judgment and decision-making research are discussed. (shrink)

All existing impossibility theorems on judgment aggregation require individual and collective judgment sets to be consistent and complete, arguably a demanding rationality requirement. They do not carry over to aggregation functions mapping profiles of consistent individual judgment sets to consistent collective ones. We prove that, whenever the agenda of propositions under consideration exhibits mild interconnections, any such aggregation function that is "neutral" between the acceptance and rejection of each proposition is dictatorial. We relate this theorem to the literature.

Moral particularists and generalists alike have struggled over how to incorporate the role of moral salience in ethical reasoning. In this paper, I point to neglected resources in Kant to account for the role of moral salience in maxim formation: Kant's theory of reflective judgment. Kant tasks reflective judgment with picking out salient empirical particulars for formation into maxims, associating it with purposiveness, or intentional activity (action on ends). The unexpected resources in Kantian reflective judgment suggest the possibility of a (...) particularist universalism, where recalcitrant particulars directly inform, and in some cases revise, moral principles. Such an account improves on particularist accounts of moral salience and moral perception: rather than deriving moral sensitivity solely from an agent's upbringing or cultural resources, the reflective dimension is situated alongside the universalist dimension of moral principles typically identified with Kantian ethics, allowing for a critical approach both to moral universals and to the reception of moral particulars. Hannah Arendt's essay "Reflections on Little Rock" sparked massive criticisms, accusing Arendt of holding racist views. In it, Arendt constructs the motivation of black parents whose children integrated into white schools as a desire for social climbing, and not as a political struggle for the right to equal education.1 Kathryn Sophia Belle, in Hannah Arendt and the Negro Question, argues that Arendt's judgment in "Reflections on Little Rock" was not accidental to her writing, but expressive of an underlying current of (...) antiblackness informing her work from The Origins of Totalitarianism onward.2 Belle's criticism leads her to reject Arendt's theory of judgment as inherently flawed.3 I want to hold on to Arendt's... It has long been known that people’s causal judgments can have an impact on their moral judgments. To take a simple example, if people conclude that a behavior caused the death of ten innocent children, they will therefore be inclined to regard the behavior itself as morally wrong. So far, none of this should come as any surprise. But recent experimental work points to the existence of a second, and more surprising, aspect of the relationship between causal judgment and moral (...) judgment. It appears that the relationship can sometimes go in the opposite direction. That is, it appears that our moral judgments can sometimes impact our causal judgments. (Hence, we might first determine that a behavior is morally wrong and then, on that basis, arrive at the conclusion that it was the cause of various outcomes.). (shrink)

Moral and legal judgments sometimes depend on personal traits in this sense: the subject offers good reasons for her judgment, but if she had a different social or ideological background, her judgment would be different. If you would judge the constitutionality of restrictions on abortion differently if you were not a secular liberal, is your judgment really based on the arguments you find convincing, or do you find them so only because you are a secular liberal? The widely discussed "discursive dilemma" shows that majority voting in a group of individuals on logically connected propositions may produce irrational collective judgments. We generalize majority voting by considering quota rules, which accept each proposition if and only if the number of individuals accepting it exceeds a given threshold, where different thresholds may be used for different propositions. After characterizing quota rules, we prove necessary and sufficient conditions on the required thresholds for various collective rationality requirements. We also consider sequential (...) quota rules, which ensure collective rationality by adjudicating propositions sequentially and letting earlier judgments constrain later ones. Sequential rules may be path-dependent and strategically manipulable. We characterize path-independence and prove its essential equivalence to strategy-proofness. Our results shed light on the rationality of simple-, super-, and sub-majoritarian decision-making. (shrink)

Our aim in this survey article is to provide an accessible overview of some key results and questions in the theory of judgment aggregation. We omit proofs and technical details, focusing instead on concepts and underlying ideas.

The ability of a group of adults with high functioning autism (HFA) or Asperger Syndrome (AS) to distinguish moral, conventional and disgust transgressions was investigated using a set of six transgression scenarios, each of which was followed by questions about permissibility, seriousness, authority contingency and justification. The results showed that although individuals with HFA or AS (HFA/AS) were able to distinguish affect-backed norms from conventional affect-neutral norms along the dimensions of permissibility, seriousness and authority-dependence, they failed to distinguish moral and (...) disgust transgressions along the seriousness dimension and were unable to provide appropriate welfare-based moral justifications. Moreover, they judged conventional and disgust transgressions to be more serious than did the comparison group, and the correlation analysis revealed that the seriousness rating was related to their ToM impairment. We concluded that difficulties providing appropriate moral justifications and evaluating the seriousness of transgressions in individuals with HFA/AS may be explained by an impaired cognitive appraisal system that, while responsive to rule violations, fails to use relevant information about the agent’s intentions and the affective impact of the action outcome in conscious moral reasoning. Some propositional attitude verbs require that the complement contain some “subjective predicate”. In terms of the theory proposed by Lasersohn, these verbs would seem to identify the “judge” of the embedded proposition with the matrix subject, and there have been suggestions in this direction. I show that it is possible to analyze these verbs as setting the judge and doing nothing more; then according to whether a judge index or a judge argument is assumed, unless the complement contains a subjective (...) predicate, the whole matrix is redundant or there is a type conflict. I further show that certain clear facts argue for assuming a judge argument which can be filled by a contextually salient entity–or by the subject of a subjective attitude verb. (shrink)

Ernest Sosa has recently presented three challenges for evidentialism. The challenges concern what is required for epistemically justified judging and suspending of judgment. The aim of this article is to respond to these challenges on behalf of the evidentialist. Importantly, responding to Sosa's challenges requires giving substance to the idea of appreciating what one's evidence supports. This idea has been mentioned by prominent evidentialists but not given adequate development. Hence, this article marks a significant move forward in the understanding of (...) evidentialism as well as a defense of the theory from Sosa's prima facie serious objections. (shrink)

Judgment internalism about evaluative judgments is the view that there is a necessary internal connection between evaluative judgments and motivation understood as desires. The debate about judgment internalism has reached a standoff some time ago. In this paper, I outline a new argument for judgment internalism. This argument does not rely on intuitions about cases, but rather it has the form of an inference to the best explanation. I argue that the best philosophical explanations of how we know what we (...) desire require that judgment internalism is true, which gives us a good reason to believe that judgment internalism is true. Since the 18th century, one of the key features of diagnosed psychopaths has been “moral colorblindness” or an inability to form moral judgments. However, attempts at experimentally verifying this moral incapacity have been largely unsuccessful. After reviewing the centrality of “moral colorblindness” to the study and diagnosis of psychopathy, I argue that the reason that researchers have been unable to verify that diagnosed psychopaths have an inability to make moral judgments is because their research is premised on the assumption that (...) there is a specific moral faculty of the brain, or specific “moral” emotions, and that this faculty or set of emotions can become “impaired”. I review recent research and argue that we have good reason to think that there is no such distinct capacity for moral judgment, and that, as a result, it is impossible for someone’s “moral judgment faculty” to become selectively disabled. I then discuss the implications of such a position on psychopathy research, the coherence of the disorder, and the moral responsibility of psychopaths. (shrink)

The identity theory of truth takes on different forms depending on whether it is combined with a dual relation or a multiple relation theory of judgment. This paper argues that there are two significant problems for the dual relation identity theorist regarding thought’s answerability to reality, neither of which takes a grip on the multiple relation identity theory.
