The sphere of disability can be treated nowadays from different perspectives that answer to multidimensional of this embodied reality. In this context, a privileged area of reflection is constituted by ethics and, inside of this, as this text propose, the prism of the reciprocal recognition. To achieve this, this present article is structured in two parts. The first, regarding to the understanding of disability from different models. The second, according to the recognition perspective approach of Honneth, and its link with (...) the disability, presents the three stages of recognition with their corresponding ways of disdain. Finally, a series of reflections are exposed regarding the necessity to accomplish a group of demands that transcend civil and political prerogatives, as well as public ones. (shrink)

Many people who perform paradigmatic examples of acts of supererogation claim that they could not have done otherwise. In this paper I will argue that these self-reports from moral exemplars present a challenge to the traditional view of supererogation as involving agential sacrifice. I will argue that the claims made by moral exemplars are plausibly understood as what Bernard Williams calls a ‘practical necessity’. I will then argue that this makes it implausible to view these acts as (...) involving agential sacrifice. (shrink)

I claim that the dominant moral-realist understanding of action and moral responsibility cannot provide a comprehensive account of morality since it neglects the irreducibly personal component of the individual’s moral experience. This is not to embrace non-cognitivism, however; indeed, I challenge the whole realist framework of most contemporary moral philosophy. To this end I explore the phenomenon of moral necessity, exemplified by Luther’s declaration that he “has to” continue his protests against the church. I (...) am careful to distinguish this kind of necessity from physical or psychological necessity, from means-end necessity and from the Categorical Imperative, and I suggest that it is far more widespread and far more complex than the realist or non-cognitivist would allow. Thesedeclarations are personal in that they do not entail any necessary universalisability of the judgement; however, their personal nature does not mean that they must collapse into the merely personal realm of whim and preference. Instead, Luther can be said to experience a legitimately objective demand that he behave thus and so, even though others would not experience such a demand in a relevantly similar situation. This irreducible heterogeneity of the moral, I suggest, lies at the heart of the intractability of many moral arguments. My argument can be derived as broadly Wittgensteinian (without being exegetical), and draws on the work of Peter Winch and Bernard Williams. (shrink)

Moral philosophers have defended anger as an important part of our moral lives. In spite of these defenses, skeptics have nonetheless argued that it would be better all things considered to get over anger to the extent that we can. They will often point to moral exemplars like Martin Luther King, Jr. or Gandhi to show both (a) that we can successfully overcome our feelings of anger and (b) that we would be morally better off doing so. (...) In this chapter, I argue against this aspiration. Those who advocate for such an aspiration fail to recognize that getting over anger would require us to radically reshape our moral psychology. I argue that feelings of anger are more central to our moral emotional lives than skeptics realize and that they cannot be removed without altering other valuable moral commitments. (shrink)

While not an explicit claim of Hegel’s, this paper aims to use his analysis of ‘Conscience’ in the Phenomenology of Spirit to demonstrate that the conflict betweendifferent moral judgments is morally necessary. That is, rather than being the unfortunate result of ‘hard’ cases, I argue that moral conflict is a necessary condition for the possibility of duty. Grasping the moral ground of moral conflict, I contend, allows us to understand why such conflicts arise, how and why (...) they become entrenched into ‘moral issues’ and what our duties are in such cases. Thus, I aim to articulate both the moral necessity and dutiful resolution of seemingly intractable moral conflicts. (shrink)

In numerous texts Leibniz claimed that while metaphysical necessity is inconsistent with free choice, moral necessity is not. A question naturally arises concerning what Leibniz took moral necessity to be. In a series of recent articles Michael Murray has argued that the concept of moral necessity Leibniz utilized is one developed and deployed by a group of 17th century Spanish Jesuits. This chapter argues that Leibniz's commitment to certain deep metaphysical principles suggests otherwise.

On the standard interpretation, Samuel Clarke and Gottfried Wilhelm Leibniz endorse fundamentally different theories of free will. Clarke is typically interpreted as a libertarian who holds that freedom requires indeterminism. Leibniz, in contrast, is typically interpreted as a compatibilist who holds that free actions can be determined. This chapter challenges the standard interpretation and argues that Clarke and Leibniz agree almost completely about free will. Both require free actions to be instances of agent causation, and both view freedom as compatible (...) with moral necessity or the determination by motives, reasons, or final causes. Hence, both Leibniz and Clarke should be interpreted as proponents of compatibilism. (shrink)

This is a review of Soran Reader's monograph 'Needs and Moral Necessity'. Although my response to her book is largely positive, I have reservations about her views of the scope of the ethical, and the coherence of her views with the McIntyrean concept of practice which she espouses.

This paper explores the theory of freedom that Emilie du Châtelet advances in her essay “On Freedom.” Using contemporary terminology, we can characterize this theory as a version of agent-causal compatibilism. More specifically, the theory has the following elements: (a) freedom consists in the power to act in accordance with one’s choices, (b) freedom requires the ability to suspend desires and master passions, (c) freedom requires a power of self-motion in the agent, and (d) freedom is compatible with moral (...) necessity but not with physical necessity. While these elements may at first appear disparate, the paper shows that they fit together quite well. The resulting theory is a surprising combination of doctrines that appear to be based on Samuel Clarke’s libertarian account of free will and doctrines that are reminiscent of the compatibilist accounts of John Locke, Anthony Collins, Gottfried Leibniz, and Thomas Hobbes. Undertaking engagement in public health research is ethically essential. There is a growing emphasis on practicing engagement as the co‐construction of knowledge, which goes beyond other common forms of engagement in health research practice: consulting and informing. Taking such an approach means researchers jointly construct knowledge with research users and beneficiaries; all parties design and conduct research together and share decision‐making power. This article makes the normative argument that such engagement is necessary to achieve the foundational moral aims of (...) public health research—building relations of equality and addressing the health needs of those considered disadvantaged—which reflect the field's underlying commitment to social justice. It next identifies and discusses three ways in which co‐constructing knowledge advances those moral aims: by facilitating self‐determination, supporting individuals’ right to research, and maximizing social knowledge to address cognitive and epistemic injustice. Objections to the arguments presented in the article are then articulated and defended against. (shrink)

Kant and Sidgwick agree that genuine ethical principles must be sourced in reason rather than divine commands. Yet, despite sharing this secular starting point, both philosophers ultimately conclude that the assumption of God’s existence is necessary for the complete viability of practical reason (including principles of morality) within human beings. This mutual reintroduction of God is especially surprising given that Kant and Sidgwick advocate divergent moral theories. The central claim of this chapter is that, despite their philosophical differences, Kant’s (...) and Sidgwick’s respective appeals to the moral necessity of God have a common cause. Both philosophers perceive a deep human need to believe in cosmic justice (i.e., universal harmony between duty and happiness), and their shared hedonic account of well-being colors their conception of what such justice must involve. After explaining how these ideas give rise to the ostensible moral need for faith, I provide a brief defense of an alternative view based on the Stoic belief that the universe is ultimately just, despite the lack of a reliable connection between moral virtue and hedonic well-being. There is no denying that international human rights norms are enforced selectively. Some oppressive governments become the targets of military intervention, while the political sovereignty of other, equally oppressive regimes is left intact. My aim in this paper is to determine whether a military operation to defend human rights can possibly be made morally illegitimate by the fact that the state prosecuting it has failed, is failing or will fail to defend human rights under relevantly similar circumstances elsewhere.

The first chapter of Judith Jarvis Thomson's "The Realm of Rights" includes a defense of moral realism, in which much weight is rested on the idea that some moral judgments are necessarily true. This paper argues that the uncontroversial premise to which Thomson in entitled is that some moral judgments are necessary, which can be understood in a manner that does not bring in truth and does not support realism.

A person who is liable to defensive harm has forfeited his rights against the imposition of the harm, and so is not wronged if that harm is imposed. A number of philosophers, most notably Jeff McMahan, argue for an instrumental account of liability, whereby a person is liable to defensive harm when he is either morally or culpably responsible for an unjust threat of harm to others, and when the imposition of defensive harm is necessary to avert the threatened unjust (...) harm. Others may favour a purely noninstrumental account of liability: one that looks only to the past behaviour of the potentially liable person. We argue that both views are vulnerable to serious objections. Instead we develop and defend a new view of liability to defensive harm: the pluralist account. The pluralist account states that liability to defensive harm has at least two bases. First, if an attacker is morally or culpably responsible for an unjust attack then he has forfeited what we call his agency right, and in doing so he has made himself partially liable to defensive harm. Whether the attacker is fully liable to defensive harm depends, however, on whether the imposition of defensive harm would infringe a different right held by the attacker: his humanitarian right. Humanitarian rights are rights to be provided with urgently needed resources or to be protected from serious harms when others can do so at reasonably low cost. We argue the pluralist account avoids the objections to which the instrumental and noninstrumental views are vulnerable, coheres with our intuitive reactions in a wide range of cases, and sheds new light on the way different rights combine to determine a person's liability to suffer harm. The utterance of morals or morality within a communist space is one that may, in the best of cases, raise a few eyebrows or, in the worst of cases, summon calls for condemnation or accusations of being unscientific. The subject of communist morality is one that is often ignored within the broader revolutionary left, while at the same time—especially within our current insurrectionary moment—beckons to be engaged with. As the hydra of neoliberalism begins its inevitable collapse, throwing capitalism once more (...) into a global crisis—and thusly its imperialist head begins to twist fascistically from the periphery back inward toward the United States and Europe—these categories that before seemed abstract and idealistic suddenly become vivid and tangible. Evil is how these injustices are described—in a non-hyperbolic fashion—by those engaged in the frontlines of revolutionary activity. So why is morality eschewed and denounced in left academic discourse? Are morals solely the provenance of the reactionary right or the dreamy idealist? (shrink)

Alan Gewirth's Reason and Morality , in which he set forth the Principle of Generic Consistency, is a major work of modern ethical theory that, though much debated and highly respected, has yet to gain full acceptance. Deryck Beyleveld contends that this resistance stems from misunderstanding of the method and logical operations of Gewirth's central argument. In this book Beyleveld seeks to remedy this deficiency. His rigorous reconstruction of Gewirth's argument gives its various parts their most compelling formulation and clarifies (...) its essential logical structure. Beyleveld then classifies all the criticisms that Gewirth's argument has received and measures them against his reconstruction of the argument. The overall result is an immensely rich picture of the argument, in which all of its complex issues and key moves are clearly displayed and its validity can finally be discerned. The comprehensiveness of Beyleveld's treatment provides ready access to the entire debate surrounding the foundational argument of Reason and Morality . It will be required reading for all who are interested in Gewirth's theory and deontological ethics and will be of central importance to moral and legal theorists. (shrink)

A new variety of empirical skeptical moral arguments have been put forward in recent years, drawing on data from neuroscience, social and behavioral psychology, and economics, which strongly suggest that emotions play a central causal role in moral judgment, and that reasoning has at most a limited supplementary causal role in small portion of moral judgments. It follows from these empirical finding, it is argued, that moral judgments and morality more generally cannot be grounded in reason (...) in the right sort of way to be rational. I argue that there are at least three distinct ways of understanding what it means to claim that moral reasoning is necessary to moral judgment. First, that moral reasoning is directly causally necessary to every moral judgment; second that moral reasoning is causally necessary to the ordinary development of the capacity for moral judgment, but is not directly causally implicated in every particular instance of moral judgment; and third that moral reasoning is necessary to a well-ordered capacity for moral judgment. I argue that the empirical data does support the claim that reasoning is not necessary to moral judgment in at least the first sense, perhaps in the second, but not in third, and that this is sufficient to provide for the rationality of moral judgments and morality more generally. The justification debate has always been a major issue within philosophy of education. In this study Wittgensteinian interpretation of this matter is offered. It is argued that in using his framework justification itself has to be thought of differently, i.e. as making explicit the bedrock of the form of life the educator finds him or herself in. But Wittgenstein's insights highlight too the particularity of the ethical and therefore also of the educational situation. The paper argues that educators cannot but (...) take a stance, cannot but act in accordance with what appeals to them in the midst of the irreconcilable desires of others. It is therefore considered that the demand for particularity reveals itself here as a demand for authenticity. (shrink)

This paper examines Flix Ravaisson's account of habit, as presented in his 1838 essay _Of Habit_, and considers its significance in the context of moral practice. This discussion is set in an historical context by drawing attention to the different evaluations of habit in Aristotelian and Kantian philosophies, and it is argued that Kant's hostility to habit is based on the dichotomy between mind and body, and freedom and necessity, that pervades his (...) thought. Ravaisson argues that the phenomenon of habit challenges these dualisms, and at least in this respect anticipates the discussions of habit in the work of twentieth-century phenomenologists such as Merleau-Ponty and Ricoeur.

The paper outlines Ravaisson's account of habit in general, showing how his analysis of the “double law” of habit develops from the work of Maine de Biran, and highlighting the way in which Ravaisson offers a new and original philosophical interpretation of the phenomena of habit. Whereas Maine de Biran remains within a dualistic framework, and finds that habit is problematic within this framework, Ravaisson uses habit to demonstrate continuity between mind and body, will and nature. Then the focus is narrowed to consider how this analysis of habit is applied to a specifically moral context, and how it illuminates traditional Aristotelian theories of virtue. The paper ends by considering several practical consequences of the foregoing discussion of habit and the moral life. (shrink)

I argue that the progression of moral stages in Nietzsche’s study is ordered in such a way that the failure of each stage is logically and structurally necessary, that each failure structures the resultant system or paradigm, but that the historical manifestation of moral paradigms coinciding with predicted or projected theoretical structures is contingent upon a (...) multitude of other historical factors. Harry Frankfurt has famously criticized the principle of alternate possibilities—the principle that an agent is morally responsible for performing some action only if able to have done otherwise than to perform it—on the grounds that it is possible for an agent to be morally responsible for performing an action that is inevitable for the agent when the reasons for which the agent lacks alternate possibilities are not the reasons for which the agent has acted. I argue that an incompatibilist about (...) determinism and moral responsibility can safely ignore so-called “Frakfurt-style cases ” and continue to argue for incompatibilism on the grounds that determinism rules out the ability to do otherwise. My argument relies on a simple—indeed, simplistic—weakening of the principle of alternate possibilities that is explicitly designed to be immune to Frankfurt -style criticism. This alternative to the principle of alternate possibilities is so simplistic that it will no doubt strike many readers as philosophically fallow. I argue that it is not. I argue that the addition of one highly plausible premise allows for the modified principle to be employed in an argument for incompatibilism that begins with the observation that determinism rules out the ability to do otherwise. On the merits of this argument I conclude that deterministic moral responsibility is impossible and that Frankfurt ’s criticism of the principle of alternate possibilities—even if successful to that end—may be safely ignored. Robert Alexy has built his original theory of law upon pervasive claims for “necessary” features of law. In this article, I show that Alexy's claims suffer from two difficulties. First, Alexy is never clear about what he means by “necessity.” Second, Alexy writes as if there have been no challenges to claims of conceptual necessity. There have been such challenges and Alexy needs to answer them if his project is to succeed.

In this collection of essays, Franklin I. Gamwell offers a defense of transcendental metaphysics, especially in its neoclassical form, and builds a case for its importance as a tool for addressing abiding problems in morality and philosophical theology-including talk about God, human fault, moral decision, and the relationship of politics and religious freedom. In Part I, Gamwell argues against Kant and a wide range of contemporary philosophers, for the validity of transcendental metaphysics designated in the strict sense, i.e., as (...) an explication of the possible as such or existence as such, as the most general features or conditions all possible things have in common. He engages with Aquinas, Schleiermacher, Augustine, and Niebuhr to argue that neoclassical metaphysics, for which the divine whole is itself temporal or forever self-surpassing, provides a more coherent account of God than does classical metaphysics, for which the divine whole is completely eternal. In Part II, Gamwell looks at transcendental metaphysics designated in the broad sense, i.e., as an explication of possible subjectivity as such, as the most general features or conditions all possible subjects have in common. In particular, he takes up the moral opportunity that humans are presented with, and argues that the moral law depends on a comprehensive good, that is, a good defined metaphysically in the strict sense. He then offers an extended discussion of the relation between transcendental metaphysics (in the broad sense) and the meaning of religious freedom and explores Ronald Dworkin's view of the relationship between democracy and religion, the question of whether religious activities are properly exempted from generally applicable laws, and the constitutional debate about national and states' rights.
