This article offers a reading of Sartre's phenomenological ontology in light of the pre-modern understanding of ‘transcendentals’ as universal properties and predicates of all determinate beings. Drawing on Sartre's transcendental account of nothingness in his early critique of Husserl as well as his discussion of ‘determination as negation’ in Being and Nothingness, this article argues that Sartre's universal predicate of ‘the not’ (le non) could be understood in a similar light to the medieval scholastic conception of transcendentals. But whereas the (...) scholastics saw the transcendental properties of oneness, truth, and goodness as reflections of God's divine perfections, Sartre's predicate of the ‘not’ operates as an atheistic transcendental which signifies the non-being of God – that God is not. By comparing Sartre's phenomenological ontology to medieval theological metaphysics, this article not only highlights the atheist underpinnings of Sartre's entire ontological schema in Being and Nothingness but also offers a new way of interpreting Sartre as a systematic transcendental metaphysician. This article offers a reading of the “transcendental” character of Alain Badiou’s and Giorgio Agamben’s ontologies. While neither Badiou nor Agamben are “transcendental” philosophers in the Kantian sense, this article argues that their respective projects of ontology both recover aspects of the “classical” conception of the transcendentals. Not unlike how pre-modern philosophers conceived of oneness, truth and goodness as transcendental properties of all things, both Badiou’s and Agamben’s ontologies present various structures which can be universally predicated of all being. However, (...) as opposed to the essentialist or even theological tendencies of traditional metaphysics, Badiou’s and Agamben’s ontologies are committedly “inessential” and atheistic at their very core. By replacing the divine names of the one, the true and the good in traditional metaphysics with a new yet quasi-classical transcendental notion of “the void” as a universal predicate of all beings, Badiou’s and Agamben’s works may be regarded as projects that go beyond both the pre-Kantian “theological” and the post-Kantian “subjective” conceptions of transcendental philosophy, thereby marking a new development in the history of western metaphysics. This article offers a comparative reading of the ontologies of David Bentley Hart and Jean-Paul Sartre as well as their respective appeals to phenomenology as a philosophical method. While it may seem odd to compare one of the twentieth century’s most celebrated atheists with one of contemporary Christianity’s most highly-acclaimed critics of atheism, this article shows that there are many surprising parallels between the ontological outlooks of Hart and Sartre, namely their conceptions of God as the unity of being and (...) consciousness and their accounts of human consciousness as a desire to ‘become God’. By examining the similarities and differences between Sartre’s and Hart’s philosophical and theological works, this article seeks to highlight the phenomenological aspects of Hart’s theological outlook and consider how Hart’s appeal to the phenomenological analysis of intentional consciousness in his theological work can illuminate our understanding of the ongoing engagements between theology and phenomenology. This article seeks to consider the compatibility between the doctrine of the Trinity and the theory of the transcendental properties by offering a consideration of the notion of the ‘gift’ as a transcendental term. In particular, this article presents a re-reading of John Milbank’s influential theology of the gift through Colin Gunton’s project of developing ‘trinitarian transcendentals’. In addition to showing how Milbank’s notion of the gift could be systematically understood in terms of what Gunton calls a ‘trinitarianly developed transcendental’ (...) which nonetheless avoids many of the problems found in Gunton’s original project, this article argues understanding ‘gift’ as a transcendental term can not only provide us with new ways of reconceiving the relationship between the philosophy of transcendental properties and various traditional doctrines, it can moreover show us how the traditional and biblical names of the Holy Spirit as ‘the Gift’ and the Son as ‘the Word’ can offer new ways of developing distinctively trinitarian accounts of metaphysics. In this paper, we defend a traditional approach to semantics, that holds that the outputs of compositional semantics are propositional, i.e. truth conditions. Though traditional, this view has been challenged on a number of fronts over the years. Since classic work of Lewis, arguments have been offered which purport to show that semantic composition requires values that are relativized, e.g. to times, or other parameters that render them no longer propositional. Focusing in recent variants of these arguments involving quantification and (...) binding, we argue that a correct understanding of how composition works gives no reason to relativize semantic values, and that propositional semantic values are in fact the preferred option. We take our argument to be mainly empirical, but along the way, we defend some more general theses. Simple propositional semantic values are viable in composition, we maintain, because composition is itself a complex phenomenon, involving multiple modes of composition. Furthermore, some composition principles make adjustments to the meanings of constituents in the course of composition. These adjustments are by triggered syntactic environments. We argue such small contributions of meaning from syntactic structure are acceptable. (shrink)

Medical practice should evolve alongside medical ethics. As our understanding of the ethical implications of physician-patient interactions becomes more nuanced, physicians should integrate those lessons into practice. As early as the 1930s, epidemiological studies began to identify that the rates of medical procedures varied significantly along geographic and socioeconomic lines. Dr. J. Alison Glover recognized that tonsillectomy rates in school children in certain school districts in England and Wales were in some cases eight times the rates of children in other (...) districts, with the only significant predictive factors being the current chief medical officer in the area and the socioeconomic well-being of the child's parents. Unfortunately, Dr. Glover's work revealed that the increase in tonsillectomies did not improve the health of adolescent patients and appeared to be performed “as a routine prophylactic ritual for no particular reason and with no particular result.”. Clinical evidence suggests that many patients undergo surgery that they would decline if fully informed. Failure to communicate the relevant risks, benefits, and alternatives of a procedure violates medical ethics and wastes medical resources. Integrating shared decision-making, a method of communication between provider and patient, into medical decisions can satisfy physicians' ethical obligations and reduce unwanted procedures. This article proposes a three-step process for implementing a nationwide practice of shared decision-making: create model integration programs; provide legal incentives to ease the (...) transition; and incorporate shared decision-making into medical necessity determinations. Contemporary critical theory and black studies have witnessed a surge in theoretical accounts of “blackness” as “nothingness”. Drawing on the work of the poet and cultural theorist Fred Moten, this article offers a reading of this recent postulation of blackness as “nothingness” in light of some of the similar theoretical endeavors in post-Kantian European philosophy. By comparing Moten’s “paraontological” conception of nothingness to Heidegger’s self-nihilating nothing, Sartre’s relative nothingness, as well as Schelling’s notion of absolute nothingness, this article argues that (...) Moten’s paraontology presents a more robust and systematic conception of nothingness than those of Heidegger, Sartre, and Schelling. By way of this comparison with these “canonical” accounts from European philosophy, this article highlights not only the unique features of Moten’s sophisticated formulation of nothingness, but also some of unacknowledged presumptions and prejudices of traditional metaphysics which Moten’s work calls into question. We propose a two-step guessing game to measure the depth of thinking. We apply this method to the P beauty contest game. Using our method, we find that 81% of subjects do not make choice following best response reasoning while the classical method would suggest only 12%. The result suggests that the classical method has the fundamental problem that it cannot distinguish if a submitted number is due to best response reasoning or not. It also suggests that traditional level k (...) analysis falsely attributes some sophistication to random players, and that the degree of false attribution is large. Our procedure provides an alternative way to identify whether the individual has best response reasoning which is essential for any positive level of depth of thinking and differentiates between the depth of thinking and random choice, and hence provides a very different conclusion, which is suggestive of limitations of the classical method. The Covid‐19 pandemic has concentrated bioethics attention on the “lifeboat ethics” of rationing and fair allocation of scarce medical resources, such as testing, intensive care unit beds, and ventilators. This focus drives ethics resources away from persistent and systemic problems—in particular, the structural injustices that give rise to health disparities affecting disadvantaged communities of color. Bioethics, long allied with academic medicine and highly attentive to individual decision‐making, has largely neglected its responsibility to address these difficult “upstream” issues. This article offers a reading of Jean-Paul Sartre’s phenomenology in light of Jean-Luc Marion’s more recent phenomenology. It may seem odd to compare Sartre to Marion, given that Sartre is well-known for his avowed atheism and his account of intentionality while Marion is primarily known for his work on religious phenomena and counter-intentionality. However, this article shows that there are many ways in which Sartre anticipates Marion’s work on phenomenological reduction and excessive phenomenality. By reading Sartre’s phenomenology in light of (...) Marion’s, and particularly Sartre’s analysis of the viscous slime in Being and Nothingness in relation to Marion’s account of ‘saturated phenomena’, this article presents a fresh interpretation of Sartre as a phenomenologist who has invaluable insights not only on the structures of consciousness and phenomenality, but also for the contemporary theoretical interest in the relationship between human and nonhuman entities. This article offers a reading of Jacques Derrida’s account of “religion” and “life” in his seminal essay “Faith and Knowledge.” Applying Derrida’s aporetic structure of “X without X” to his remarks on religion and life in “Faith and Knowledge,” this article suggests that underlying Derrida’s endeavor to “think religion abstractly” is a radical re-conception not only of religion as “religion without religion” but moreover a re-imagination of life as “life without life” that breaks away from the traditional metaphysical understandings of (...) life and religion. This article offers a reading of Colin Gunton’s trinitarian theology in light of recent theological attempts to develop accounts of ‘new trinitarian ontologies’ in a strongly Christian Neo-Platonic vein. In particular, this article seeks to situate Gunton’s work within the broader context of late twentieth-century European thought by comparing his ‘trinitarian ontology’ to the anti-Platonic ontologies of Martin Heidegger and Gilles Deleuze. By way of considering the ‘anti-Platonic’ aspects of Gunton’s trinitarian theology, this article presents his theological project as a (...) testcase which highlights the stakes in constructing ‘new’ trinitarian ontologies as well as possible objections to the affirmative attitude towards Christian Neo-Platonism in contemporary theological metaphysics. This article offers a reading of Plato in light of the recent debates concerning the unique ‘ontology’ of International Relations (IR) as an academic discipline. In particular, this article suggests that Plato’s metaphysical account of the integral connection between human individual, the domestic state, and world order can offer IR an alternative outlook to the ‘political scientific’ schema of ‘levels of analysis’. This article argues that Plato’s metaphysical conception of world order can not only provide IR theory with a way (...) to re-imagine the relation between the human, the state, and world order. Moreover, Plato’s outlook can highlight or even call into question the post-metaphysical presuppositions of contemporary IR theory in its ‘borrowed ontology’ from modern social science, which can in turn facilitate IR’s re-interpretation of its own ‘ontology’ as well as its distinct contributions to the understanding of the various aspects of the social world and human life. The principle of informed consent is so firmly established in bioethics and biomedicine that the term was soon bowdlerized in common practice, such that engaging in the informed decision-making process with patients or research subjects is now often called “consenting” them. This evolution, from the original concept to the rather questionable coinage that makes consent a verb, reveals not only a loss of rhetorical precision but also a fundamental shift in the potential meaning, value, and implementation of the informed consent (...) process. Too often, the sharing of information has been replaced by the mere acquisition of agreement with the authority ostensibly offering a choice.Scholars of informed consent agree that its salience and its legitimacy derive from a fiduciary duty to inform, in order to respect, protect, and promote autonomous decision making by those to whom the duty is owed. Advance directives (ADs) are assumed to reflect the patients’ preferences, even if these are not clearly expressed. Research into whether this assumption is correct has been lacking. This study explores to what extent ADs reflect the true wishes of the signatories.

Background Payment of research participants helps to increase recruitment for research studies, but can pose ethical dilemmas. Research ethics committees (RECs) have a centrally important role in guiding this practice, but standardisation of the ethical approval process in Ireland is lacking. Aim Our aim was to examine REC policies, experiences and concerns with respect to the payment of participants in research projects in Ireland. Method Postal survey of all RECs in Ireland. Results Response rate was 62.5% (n=50). 80% of RECs (...) reported not to have any established policy on the payment of research subjects while 20% had refused ethics approval to studies because the investigators proposed to pay research participants. The most commonly cited concerns were the potential for inducement and undermining of voluntary consent. Conclusions There is considerable variability among RECs on the payment of research participants and a lack of clear consensus guidelines on the subject. The development of standardised guidelines on the payment of research subjects may enhance recruitment of research participants. (shrink)

In his commentary on Aristotle’s Peri hermeneias,1 Abelard distinguishes the form of an expression2 (oratio) from what it says, that is, its content. The content of an expression is its understanding (intellectus). This distinction is surely the most well-known and central idea in Abelard’s commentary. It provides him with the opportunity to distinguish statements (enuntiationes) from other kinds of expressions without implying a diference in their content, since the ability of a statement to signify something true or false (verum vel (...) falsum)3 cannot be found in its content. More precisely, Abelard distinguishes statements both from complete expressions (orationes perfectae) that are not statements but rather questions, requests, commands, etc. and from incomplete expressions, that is, mere word strings (orationes imperfectae), such as homo albus. These kinds of expressions, according to Abelard, do not differ in the understanding they present but in the way they present it. (shrink)

At the time of this writing, a widely publicized, waived-consent trial is underway. Sponsored by Northfield Laboratories, Inc. (Evanston, IL) the trial is intended to evaluate the emergency use of PolyHeme®, an oxygen-carrying resuscitative fluid that might prevent deaths from uncontrolled bleeding. The protocol allows patients in hemorrhagic shock to be randomized between PolyHeme® and saline in the field and, still without consent, randomized between PolyHeme® and blood after arrival at an emergency department. The Federal regulations that govern the waiver (...) of consent restrict its applicability to circumstances where proven, satisfactory treatments are unavailable. Blood—the standard treatment for hemorrhagic shock—is not available in ambulances but is available in hospitals. In the last decade, advances in technology have significantly disrupted the way firms provide goods and services. At the forefront of this technological disruption is the sharing economy, where individuals earn income by providing services or sharing assets through peer-to-peer platforms. With global revenues in the sharing economy projected to increase substantially in the next decade, income from this economy will continue to be an important source of tax revenues for governments around the world. However, sceptics argue that the sharing (...) economy inherently lends itself to dishonest reporting of taxable income. We employ an online experiment, using 746 taxpayers, to observe whether the prosocial benefits often promoted by P2P platforms reduce honest reporting of taxable sharing economy income. Consistent with moral licensing theory, we find that earning income from a prosocial-oriented P2P platform liberates taxpayers to dishonestly report their sharing economy income, and this result is fully driven by taxpayers whose personal values are incongruent with values promoted by the P2P platform. Our paper contributes to the limited but growing research on the sharing economy and its implications for ethical decisions. It also adds to the moral licensing literature by identifying value congruency as an important moderator for moral licensing effect. (shrink)

We shall argue that there is adequate moral justification for capital punishment with linkage, that is, with linkage to keeping non-murderers from dying. We present the argument with two aims in mind. The first is to question the conventional wisdom, seldom challenged even by proponents of capital punishment, that being an abolitionist is closely connected to having a civilized respect for human life. This conventional wisdom, we hope to show, is somewhat off the mark. To this end we exhibit structural (...) similarities between so-called lifeboat dilemmas and the public's relationship to a murderer. In a lifeboat dilemma one must choose between saving this life or that, since the lifeboat will not hold both persons. Now if this life were an innocent's and that one a murderer's, a choice to save the latter would not be met with accusations of callousness towards human life. We hope to project everyone's intuitions about this case onto the more baffling case of a society's relationship to the murderers and dying innocents in its midst. (shrink)

Currently, all 50 states and the District of Columbia have youth concussion laws based on the core principals of the 2009 Lystedt Law of Washington State. On April 23, 2013, the state of Georgia signed into law House Bill 284, “The Return to Play Act of 2013” and became one of the last states to pass youth concussion legislation. This Act became effective on January 1, 2014. The purpose of this report is to highlight the legislative process of enacting Georgia (...) Concussion is a form of mild traumatic brain injury that can occur as a result of contact to the head or other parts of the body that causes a rapid acceleration-deceleration force to the brain that may cause a functional disturbance in an individual’s ability to concentrate or learn new information. Contrary to popular belief, it is not a bruise to the brain, and there is usually nothing detectable on standard imaging such as a computed tomography or magnetic resonance imaging. (...) Symptoms and signs are therefore important to detect and include decreased levels of consciousness, headache, nausea, difficulty concentrating, memory loss, and poor coordination. This paper reviews the experience of an integrated approach to CSR in the U.S. electric utility sector. The authors report on the results of Southern Company’s historical definition of CSR as a dynamic model, balancing stakeholder needs through shifting pressures to assure long-term shareholder value, superior customer, price performance, and sustainable economic development. Using financial and utility sector measures, the paper assesses the company’s “balancing” approach to addressing CSR, which weights corporate, environmental, community, and economic factors in driving successful and (...) sustained financial, social, and environmental performance. The paper concludes by suggesting that CSR success in this sector requires, first, that the global warming issue be governed by the same balancing considerations to which all stakeholders and their legitimate interests are subject, and second, an energy policy that embraces both atechnology policy and appropriate regulatory incentives. According to many believers there is no end to the enlightening things that may be truly said about God. Perhaps there is no end for them either to the useful ways of dividing these things up into illuminating classes. But as fairly traditional theists we suggest a need to stress two basic classes as two indispensable sides to a traditional theist’s coin. We suggest that neglect or rejection of either side can debase the currency under philosophical investigation, can lead a (...) philosopher—or at least his puzzled readers—into costly muddles about the analysis or evaluation of religious discourse and claims.
