In personal relationships, we conceive of the related person as an individual who is more than a combination of qualities, a bearer of claims or a role-occupant. She is envisaged as a distinct and irreplaceable particular. We have immediate concerns for her that are not mediated by consideration of principles such as the promotion of welfare or the fulfillment of duty. The aim of my dissertation is to analyze and defend this particularistic concern and show how it is anchored in (...) what I call an engaged perspective. Recent critics of Kantianism and utilitarianism claim that these theories endorse only an objective or impersonal perspective, which ignores the particularity of individuals. I contrast this with an engaged perspective which I explicate by building on insights embodied in the Confucian account of role-ethics in the period 550 B.C.-290 B.C. I argue that although Confucian ethics has been rightly interpreted to stress the way in which social role mediates between relationships, nonetheless its ideal concerns socially-mediated relations of love between individuals. ;I first examine the cardinal Confucian virtue of jen, or loving, and other role virtues such as filial piety, and show how they help create connectedness and mutuality. People are connected when they share their emotional world and care for each other. And they share an exclusive mutuality when they generate a unique history of reciprocation and participate in the common good of their relationship. In addition, particularity functions as a structural factor to govern the caring, reciprocity, and emotions of love. Consequently, an engaged agent considers her beloved and the relationship she is engaged in as irreplaceable particulars. The engaged perspective is a distinctive "we" perspective arising from the awareness of such connectedness and mutuality. I also contrast the engaged perspective with the personal perspective. ;Finally, I analyze the motivational structure of a Confucian agent by examining the influence of propriety, emotions, thinking and will on Confucian agency. The thesis of this article is that the notion of an ethical food consumer is untenable unless it is coupled with a conception of food citizenship. The main arguments delivered against the notion of ethical food consumption are that consumption does not take the operations of moral psychology into account, nor afford means to tackle structural problems inherent in the relation between consumer and producer. The notion of an ethically aware food citizen is on the other hand capable (...) of handling these problems head on. The most important distinction in value theory is the subjective-objective distinction which determines the epistemological status of value judgments about medical intervention. Ethical decisions in medical intervention presuppose one of three structures of justification — namely, an inductive approach, a deductive approach which can be either consequentialist or non-consequentialist, and a uniquely ethical approach. Inductivism and deductivism have been discussed extensively in the literature and are only briefly described here. The uniquely ethical approach which presupposes value (...) objectivism is analyzed in detail. This method involves a purely ethical inference which moves from facts to values directly with an emphasis on reason which involves a non-logical justification (as opposed to illogical). It involves the use of natural practical arguments which have an imperative conclusion but no imperative premise and exhibit a value-requiredness between two states of affairs. (shrink)

The purpose of this study is to expand our understanding of the factors that influence ethical behavioral intentions of public accountants. Recent scandals have dominated the news and have caused legislators, regulators and the public to question the role of the accounting profession. Legislative changes have brought about major structural changes in the profession and continued scrutiny will surely lead to further changes. Thus, developing an understanding of the personal and contextual factors that influence ethical decisions is critical. (...) An extension of the theory of planned behavior [Ajzen, I.: 1985, Action Control-From Cognition to Behavior ], the model used in this study examined the influence of personal, social and organizational factors on ethical intentions. Specifically, the individual level model tested direct eects of attitudes, subjective norms, perceived behavioral control, moral sensitivity and ethical climate. Professionals from five accounting firms completed a survey that measured responses to ethical dilemmas related to the public accounting domain. To minimize the potential impact of common method bias, the survey instrument was administered in two phases. Hypotheses were evaluated using a structural modeling technique, partial least squares. Results show strong support for a direct relationship between attitudes and ethical intentions. The proposed direct eect of subjective norms was not supported. However, a significant relationship between subjective norms and attitudes was found. Professionals' attitudes towards ethical issues clearly influence intentions. Moreover, this study illustrates the potential influence of social factors in attitude formation. Future research should explore the factors in the public accounting domain that most strongly influence attitude formation. This study suggests that the theory of reasoned action oers a useful framework for exploring these issues. (shrink)

New York: Routledge, 1996.“The eye can confer the active gift of love upon bodies which have long been accustomed to neglect and disdain,” writes Kaja Silverman in her most recent book, The Threshold of the Visible World. The sentence neatly summarizes her project. “The active gift of love” is the central concept of (...) this book and indicative of the utopian dimension of the theory of love she develops.With Lacan as her primary interlocutor, she sets out to answer a question of one of her students: “does psychoanalysis have a theory of love?” Strange as it might seem, psychoanalysis, so often associated with an excessive interest in sexuality, has not seemed to believe in love. Within the rigorous framework of a discipline that has no use for love and theorizes a bleak view of human nature, Silverman sets out to think through the questions that every parent is at a loss, yet needs, to address: what is love, how can choices in love be culturally encouraged, reoriented, or discouraged? Lacan’s texts on the imaginary order and the visual field, and the imaginary’s stubborn presence within the symbolic order, remain a key resource for those who, like Silverman, wish to understand and analyze, critique and refocus contemporary culture with an eye open to contradictions and complexities. 1The ground for love, the ability to love, is idealization, Silverman claims. Without idealization life would be unbearable, but idealizing is influenced by cultural norms and values that we internalize from early childhood on. Silverman’s project—”to articulate the psychic and aesthetic conditions under which we might be carried away from both ideality and the self, and situated in an identificatory relation to [culturally] despised bodies” [2]—is an attempt to put pressure on two elements of this interaction, “idealization” and “self,” but as she does so she acknowledges the force of the transhistorical, heavy, thick structure of the psyche that is hard, if not impossible, to change.This project, the development of an “ethics of vision,” forms a key part within the larger framework of Silverman’s work. In her first book, The Subject of Semiotics, she argues for and explains the semiotic status of psychoanalysis and the indispensable contribution of psychoanalysis to semiotics. The book remains a valuable handbook for an understanding of the importance of such divergent theorists as De Saussure and Benveniste, Kristeva and Peirce, Freud and Lacan, and the theorists of suture for a coherent and comprehensive theory of culture. Ethics designates a structured process by which important human values and meanings of life are understood and tackled. Therein, the ability to discuss openly and reflect on (aka deliberation) understandings of moral problems, on solutions to these problems, and to explore what a meaningful resolution could amount to is highly valued. However, the indicators of what constitutes a high-quality ethical deliberation remain vague and unclear. This article proposes and develops a pragmatist approach to evaluate the quality of deliberation. Deliberation (...) features three important moments: (1) broadening and deepening the understanding of the situation, (2) envisioning action scenarios, (3) coming to a judgment based on the comparative evaluation of scenarios. In this paper, we propose seven criteria to evaluate ethical deliberations: (1) collaborative diversity, (2) experiential literacy, (3) organization of experiences, (4) reflective capacity to instrumentalize the experiences of others, (5) interactional creativity, (6) openness of agents, (7) quality of the reformulation of scenarios. These criteria are explained and applied to the three moments of deliberation. Based on these criteria, three kinds of outcomes for deliberations are identified and discussed: good ethical deliberations, partial ethical deliberations, bad ethical deliberations. Our proposal will guide researchers and practitioners interested in the evaluation of the quality of ethical deliberations. It provides a reference tool that allows them to identify the possible limitations of a deliberation and to implement actions aimed at correcting these limitations in order to achieve the desired qualitative objectives. This collection of papers (including three completely new ones) by one of the foremost philosophers in epistemology transcends two of the most widely misunderstood positions in philosophy--foundationalism and coherentism. Audi proposes a distinctively moderate, internalist foundationalism that incorporates some of the virtues of both coherentism and reliabilism. He develops important distinctions between positive and negative epistemic dependence, substantively and conceptually naturalistic theories, dispositional beliefs and dispositions to believe, episodically and structurally inferential beliefs, first and second order internalism, and rebutting as (...) opposed to refuting skepticism. These contrasts are applied not only to rational belief, but to rational action and the rationality of desires and intentions. The overall position is a pluralist, moderately rationalistic, internalist theory of justification and a partly externalist conception of knowledge. However, by virtue of offering a theory of rationality as well as an account of knowledge and justified belief, it will interest philosophers of ethics, science, and the social sciences and teachers and students of epistemology. Background Decision-making competence is a complex concept in the care for transgender and gender diverse adolescents, since this type of care concerns one’s developing gender identity and involves treatment options that often lack international consensus. Even despite competence assessments, moral challenges arise in the decision-making process. Here, traditional forms of clinical ethics support such as moral case deliberation might not fit as these do not provide thematic guidance. This study therefore aimed to develop a practice-oriented ethics support tool to assist (...) care providers when dealing with moral challenges around decision-making competence in transgender adolescent care. Methods The study followed a participatory design to develop a tool in close collaboration with care providers; they had a say in all phases of development and dissemination. Firstly, nine care providers were interviewed about experienced moral challenges and needs for ethics support. Based on this, the structure and content of the tool was constructed and discussed in two focus group meetings, after which four care providers tested the tool and additional feedback was collected from the team and an advisory board. The final tool was presented to all Dutch care providers in transgender adolescent care. Results Care providers expressed a need for guidance in defining and assessing decision-making competence. Main moral challenges concerned discussing fertility options with young clients, dealing with co-occurring mental health difficulties and the decision-making role of parents. The final tool, named the Competence Consultant, is an interactive pdf containing four parts: (1) Clarify information; (2) Identify doubts and moral questions; (3) Guidance for conversations and (4) Overview and Conclusions. Discussion Developing an ethics support tool in a controversial care setting is highly relevant as it aims to help individual care providers in defining, discussing and dealing with their moral challenges in actual practice. The ‘Competence Consultant’ for transgender care providers contributes to their moral sensitivity and moral competence. It is an example of the development of innovative and integrative forms of thematic ethics support. (shrink)

Watsuji Tetsurô’s Ethics is one of the most important works in Japanese ethical thought. But scholarly research in English has largely focused on the first of three volumes of Ethics, leaving the latter two oft-neglected. In order to balance out the views of Watsuji’s ethics, this paper focuses on the contributions of the second and third volumes of Ethics. These volumes are essential for any concrete understanding of Watsuji’s ‘ethics of emptiness’. The second volume develops the ideas of the (...) first, particularly how the dual-structure is concretely realized through the various stages of ethical organization. The third volume develops the notions of space and time from the first volume into a theory of climate and history. By analyzing these, we can understand Watsuji’s system as a whole and clarify Watsuji’s unique contribution to ethical theory. (shrink)

Neurosurgeons have an especially high rate of exposure to serious ethical challenges in their line of work. The aim of this study was to assess the type and frequency of ethical theories used by neurosurgery residents to make extra- ethical decisions in challenging situations and their relation with the level of residency, and curricular training about medical ethics. A total of 12 neurosurgery residents in Mashhad University of Medical Sciences were interviewed; all the participants were male and (...) aged 29–40 years old. Of all, six were senior and six were junior. Using a systematic review of neurosurgery and medical ethics textbooks, five common cases were selected and a semi-structured, open-ended interview was developed. The interviews were digitally recorded and analyzed in two separate stages. Comparison of the results of the two stages led us to the final judgment about the dominant ethical theory used in each case. In all 60 cases, the decision-making process was compatible with either Deontology or Consequentialism. Only in two cases, beside Deontology, the Virtue ethics was used as an alternative in special situations. The ethical theories were not consistent for all the 12 subjects and all the five questions. No statistically significant difference was found between senior and junior residents, neither for each question nor for the aggregate. Only one of the subjects had extracurricular training in medical ethics, consequently precluding further analysis. Although not intended to be evaluated by this study, similar heterogeneity was observed in final decisions. When faced with medical ethics challenges, neurosurgery residents did not follow a consistent ethical theory for making decisions. The type and frequency of theories did not seem to be changed during the residency period. (shrink)

Since digital piracy has posed a significant threat to the development of the software industry and the growth of the digital media industry, it has, for the last decade, held considerable interest for researchers and practitioners. This article will propose an integrated model that combines the theory of planned behavior (TPB) and ethics theory, the two theories that are most often used in digital piracy studies. Data were obtained from university students in China, and the model was examined (...) using the structural equation model (SEM). The results show that moral obligation and justice, derived from ethics theories and TPB variables, such as attitude, subjective norms, and perceived behavioral control, influence the behavioral intentions of individuals to commit digital piracy. The attitude of individuals toward digital piracy is also found to be influenced by perceived benefits, perceived risk, and habit. (shrink)

Martin Heidegger’s existential account of care in _Being and Time_ (2010) provides us with an opportunity to reimagine what the proper theoretical grounding of an ethic of care might be. Heidegger’s account of care serves to deconstruct the two primary foundations that an ethic of care is often based upon. Namely, that we are inevitably interdependent upon one another and/or possess an innate disposition to care for fellow humans in need. Heidegger’s account reveals that both positions are founded upon an (...) ontic (meaning factual existence), as opposed to an ontological (which refers to the nature of being), understanding of care. The distinctions between an ontic and ontological understanding of care are significant. Yet, I maintain that they are not completely incompatible. Both Heidegger and care ethicists contend that our existence with others is understood through a relational ontology. Furthermore, there are certain ontological structures from Heidegger which resonate with an ethic of care. Two key existential structures are leaping-ahead and being-guilty. These existential structures are latent in care ethics, and by explicitly revealing them I reinforce the connection between Heidegger’s account and care theory. Lastly, I develop the theoretical foundations of care ethics by proposing an existential ethic of care. (shrink)

BackgroundThe emergence of artificial intelligence (AI) in medicine has prompted the development of numerous ethical guidelines, while the involvement of patients in the creation of these documents lags behind. As part of the European PROFID project we explore patient perspectives on the ethical implications of AI in care for patients at increased risk of sudden cardiac death (SCD).AimExplore perspectives of patients on the ethical use of AI, particularly in clinical decision-making regarding the implantation of an implantable cardioverter-defibrillator (...) (ICD).MethodsSemi-structured, future scenario-based interviews were conducted among patients who had either an ICD and/or a heart condition with increased risk of SCD in Germany (n = 9) and the Netherlands (n = 15). We used the principles of the European Commission’s Ethics Guidelines for Trustworthy AI to structure the interviews.ResultsSix themes arose from the interviews: the ability of AI to rectify human doctors’ limitations; the objectivity of data; whether AI can serve as second opinion; AI explainability and patient trust; the importance of the ‘human touch’; and the personalization of care. Overall, our results reveal a strong desire among patients for more personalized and patient-centered care in the context of ICD implantation. Participants in our study express significant concerns about the further loss of the ‘human touch’ in healthcare when AI is introduced in clinical settings. They believe that this aspect of care is currently inadequately recognized in clinical practice. Participants attribute to doctors the responsibility of evaluating AI recommendations for clinical relevance and aligning them with patients’ individual contexts and values, in consultation with the patient.ConclusionThe ‘human touch’ patients exclusively ascribe to human medical practitioners extends beyond sympathy and kindness, and has clinical relevance in medical decision-making. Because this cannot be replaced by AI, we suggest that normative research into the ‘right to a human doctor’ is needed. Furthermore, policies on patient-centered AI integration in clinical practice should encompass the ethics of everyday practice rather than only principle-based ethics. We suggest that an empirical ethics approach grounded in ethnographic research is exceptionally well-suited to pave the way forward. (shrink)

Business ethics are the moral principles that apply to all aspects of the business environment at an individual and organizational level. This study addresses the basic perceptions regarding the teaching of business ethics and examines university lecturers’ intentions to teach an ethics course. For the present research, the authors conducted a cross study to evaluate whether three variations of the theory of planned behavior, namely, TPB, decomposed TPB (DTPB), and the revised theory of planned behavior (RTPB), could adequately (...) predict teaching of ethics course (TEC) behaviors. The participants were from southern, middle, and northern Taiwan. A structural equation model applied to a final sample of 200 usable questionnaires demonstrated that individual attitudes, subjective norms, perceived behavioral control, and teacher self-efficacy (TSE) influence intentions, but do not influence report behavior of those involved in teaching an ethics course. Among the three variations of TPB-based models, RTPB provided better explanation of variance in intentions to TEC. The present research highlights the importance of TSE, especially because TSE plays a key role in RTPB. The theoretical implications of this study relate to the application of TPB to TEC. (shrink)

One part of ethics is concerned with good. This chapter talks generally about the idea of the structure of good. According to some ethical theories, the concern for good amounts to the whole of ethics, not just a part. Most nonteleological theories give some role to good. Since side‐constraint theory is an important example of nonteleological ethics, the popular belief that it is necessarily agent relative helps to sustain the popular association between nonteleological ethics and agent‐relative ethics. (...) But what makes side‐constraint theory nonteleological is not agent relativity. It is the way it takes ethical considerations to work: side constraints determine what ought or ought not to be done directly, and not by determining goodness. The chapter describes some ways of making the distinction between teleological and nonteleological ethics, and explains why they are unsatisfactory. In this book Daly attempts to forge a new ethical approach to issues of social structures, an area of thought deficient in traditional Catholic ethics. Daly argues that the concept of the structures of virtue and vice provide the best ethical lens with which to scrutinize the effects of social structures on personal character and the well-being of the community. His argument relies on two premises: First, he considers the nexus between structures and individual moral agency - arguing (...) that Catholic ethics has failed to account for these realities adequately. The second premise concerns virtue theory, once again emphasizing the importance of accounting for the individual when approaching societal ethics. With the establishment of these premises, Daly furthers the book's ultimate goal: the development of ethical concepts capable of scrutinizing social structures regarding how they shape personal moral character, as well as how they causally impact the well-being of people and groups. Drawing on the works of Thomas Aquinas as well as social theories such as critical realism, Daly fills a lacuna in Catholic ethics that addresses the structure-agency problem that has plagued this field of study. This article proposes a model for conceptualizing advertising ethics theory based on a distinction between philosophical and occupational ethical systems and the assumption that the fundamental goal of occupational ethics is to address the imbalance of power between the practitioner group and the community or communities they serve through practices that cultivate a relationship of trust. An analytical model is proposed as the basis for future empirical research to test and clarify the suggested relationships. In this paper, I develop an account of appreciation. I argue that appreciation is an epistemic emotion in which the subject grasps the object in an affective way. The “grasping” and “feeling” components implies that in appreciation, we make sense of the object by having cognitive control over it, are motivated to maintain the valuable epistemic state of understanding, and experience the “aha” or “eureka” moment. This account offers a unified account of the many types of appreciation, including the aesthetic, (...) the moral, and the epistemic. Current organizations are underpinned by utilitarian ethics of Modernity. Pure economic motive driven organizations detach themselves from larger societal interest. Rising number of corporate scandals and intraorganizational income inequalities are breeding similar trends in society at large. Current organizations base their competitive advantage on resources and capabilities which boils down to economic supremacy at all cost whether it is named I/o or RBV of the firm. This theoretical article posits Ethics-based Trust as the main competency and capability for attaining sustained (...) competitive advantage. It in no way condemns utility view of the firms but treats it as a natural yet secondary outcome of genuine ethicality of the firm. Cultivating an ethical culture in the firm through identifying antecedents, organizational practices, and the outcomes where profitability is an automatic but secondary outcome under the supremacy of ethics is detailed in the multilevel model presented in this article. The main call of this article is to posit ethics and morality over and above short-term profits so that organizations fulfill their trustee role for society through enacting socio-humanistic theories within organizations. A brief analysis of the proposed ethical theory of firm is undertaken in light of the “schooling” notion in the contemporary organization theory literature. (shrink)

Despite the importance of the Moist-Confucian debate to students of both Chinese thought and comparative religious ethics, it remains in need of a careful analysis using contemporary ethical theory. In presenting such an analysis, this essay aims to accomplish three things: (1) to show how Confucius and Mo-tzu were divided over the priority-of-the-right issue, the latter being a utilitarian in his working ethics despite his oft-noted interest in divine command theory; (2) to describe how their followers worked (...) out a meta-ethical basis for their respective positions on this issue (Mencius, in particular, opposing the psychological and "definist" approach of the Moists with an "intuitionist" one that would have a deep influence upon later Confucian orthodoxy); (3) to demonstrate the tendency, perhaps grounded in the structure of human thought, toward conflict between two basic ways of doing normative ethics: the deontological and the teleological. The paper further realises Foucault’s genealogy of ethics to grasp genealogy as the totality of three axes – power, truth, and ethics – driven by the ethical axis. The paper demonstrates that Foucault’s discussion of antiquity is genealogical. The main focus is Foucault’s late work and, in particular, his final lectures on The Courage of Truth. The paper highlights the genealogical function of the distinction between ‘Laches’ and ‘Alcibiades’. ‘Laches’ provides a heuristic source for self-care in the present in (...) the form of practices of living tied to the ‘Laches’ parrhesia. But, it is also a critique of the present applied to democratic theories that have used the neo-platonic line of the ‘Alcibiades’ parrhesia – of which Foucault disapproves – as their source in creating traceable technologies of the self tied to structures of domination. Such technologies freeze games of power and governmentalise the problematisation of how to govern the self. Hence, the genealogical discussion of antiquity in connection with an understanding of genealogy as problematisation should be perceived as a heuristic source of self-creation with critical implications for evaluating power regimes in the present. The paper introduces the link between the ancient past and the present with respect to Foucault vis-à-vis certain democratic theories. The central aim is to consider on what grounds placing the problematisation of the self at the centre of a new politics can be also linked to governmentality. In this context, the paper also clarifies the wider implication of its core premise for Foucauldian studies and the emerging discussion of parrhesia. (shrink)

Empirical-ethical research constitutes a relatively new field which integrates socio-empirical research and normative analysis. As direct inferences from descriptive data to normative conclusions are problematic, an ethical framework is needed to determine the relevance of the empirical data for normative argument. While issues of normative-empirical collaboration and questions of empirical methodology have been widely discussed in the literature, the normative methodology of empirical-ethical research has seldom been addressed. Although most natural law ethical theories recognize moral absolutes, there is not much agreement even among natural law theorists about how to identify them. The author argues that in order to understand and determine the morality (or immorality) of a human action, it must be considered in relation to the organized system of human practices within which it is performed. Such an approach, he argues, is to be found in the natural law theory of Thomas Aquinas, especially once (...) it is recognized that the logical structure of Aquinas's ethical theory is basically that of an Aristotelian science. This paper argues that the future of capabilities approach lies on the theoretical development of the democratic political structure. For this purpose, we take into account Martha Nussbaum’s late theoretical works. Firstly, we argue that the capability approach can be divided into two main models: the top down and the bottom up. Nussbaum, for example, endorses a top-down model, which it begins from an abstractive theory of partial justice and then draws the issue of institutional implementation. On the (...) other hand, Amartya Sem advocates the bottom-up model, which starts from the immanent demands of justice from public sphere and then up to normative and abstract questions (like his “idea of justice”). In the second part of this paper, we present Nussbaum’s partial theory of justice, arguing that it is mainly composed by four issues: (a) the elaboration of the list of capabilities, (b) the process of normative evaluation, (c) arguments for stability, (d) the implementation of the model. About this last topic, we argue in the third part that the current theoretical advance of the capabilities approach lies on the issue of the democratic political structure. In other words, the future of capabilities approach depends on the interaction between its own theory and a theory of democracy. Finally, in the last section we provide a re-elaboration of Nussbaum’s threshold level of capabilities (the list) in order to make it more adherent with the democratic political structure. (shrink)

Mental disorders in university students are very frequent, therefore higher education institutions have established in-campus mental healthcare centres. These clinics have particular characteristics that differ from other mental health centres, as they report to and represent an educational institution, while at the same time looking after the interests and well-being of patients requesting assistance, thus generating unique bioethical conflicts. Ethics Committees are useful tools to offer support to mental health professionals in making ethical decisions. In order to respond to (...) these issues, it was decided that an Ethics Committee would be created in the mental health clinic of a private university in Mexico City. This article describes the implementation process for this Committee, its duties and scope, as well as the case work and review methodology. A list of the most frequent ethical conflicts is attached, jointly with the ethical analysis of the cases treated throughout the year and a half or work by the Committee. (shrink)

An explores decoloniality’s conception of the sacred in relation to revolutionary violence, gender, creolization, and racial phenomenology, demonstrating its potential for reshaping religious paradigms. Pointing out that the secular has been pivotal to regulating racial hierarchies under colonialism, he advocates for a broader understanding of religion that captures the fundamental ideas that drive decolonial thinking. This neglect, indeed, is a general characteristic of the reception of Kant's aesthetics in the Anglo-American, and German traditions of philosophy in the twentieth century. The reasons behind it have been usefully summarised by Paul Guyer. ;My approach will be as follows. In Part One of this study , I shall first outline the sublime as it is understood (...) in sources available to Kant--notably the theories of Addison, and Burke. I will then trace how Kant adapts these approaches in his pre-Critical aesthetics, and how he goes beyond them by, in effect, stipulatively defining the sublime as a moral concept in his Critical ethics. In Part Two I will first set the scene for a consideration of Kant's mature theory of the sublime, by discussing how moral factors shape the overall strategy in The Critique of Judgement, and also figure in his account of the judgement of taste. I shall then go on to elaborate and critically review Kant's structures and sources of argument in those sections of the third Critique that deal with judgements of sublimity. In particular, I will argue that whilst his theory of sublimity does fit in well with the overall strategy of the third Critique, the pressures exerted upon it by the Critical ethics are such that he does not succeed in establishing the credentials of sublimity as an aesthetic concept. In Part Three , however, by using some of Kant's basic insights, I will hope to establish these credentials and to apply the theory so derived, to the work of art. I will then proceed to some more general conclusions. ;Considering the wide ground to be covered by this study, and the necessary limitations on its length, it will not be possible to give Kant's concepts and arguments the kind of extensive and finely detailed analysis which has been provided by Paul Guyer. Hegel’s practical philosophy has important insights for understanding the ethical role of the firm in modern society. From a broadly Hegelian perspective, the firm’s role in society is to facilitate freedom, that is, the concrete realization of rational agency. It does this by providing the institutional structures, norms, practices, and modes of discourse necessary for individuals to link their subjective aims with objectively valid societal aims, embodied in the firm’s purpose. Accordingly, I first present a Hegelian account of the (...) link between action and social structure, before arguing that the firm, when it functions properly, enables individuals to express their capacity for rational agency within concrete social contexts. I then draw upon Paul Adler’s Marxist analysis of the development of organizational structures and processes to support the viability of a broadly Hegelian account of the firm within a contemporary economic context. I conclude by outlining a number of practical implications of this account, before explaining its implications for two prominent theories of business ethics, the MacIntyrean perspective, and the Market Failures Approach. Departing from most studies of property, this book focuses directly on the concept of ownership, on the complex structure of property rights, and the relation between that structure and distributive justice. The traditional view that ownership must amount to full sovereignty over what is owned is abandoned. Each section includes two or three of the most important and interesting contributions to the field, together with brief introductions by the editors. The second edition contains an improved approach to applied ethics. (...) Whereas in the first edition the authors included a chapter at the end of the book that contained selections that dealt with moral problems, in the second edition they have dropped that chapter in favour of an approach that ties moral issues more closely to the moral theories. Each chapter on moral theories now includes a selection that deals with a moral problem, such as human cloning, abortion, and global warming. The selection illustrates how the relevant theoretical approach is put to use. There is therefore a much tighter integration between theory and practice than before. The new structural approach should make the book significantly more effective in the classroom. The new edition also contains an improved section on feminist ethical theory. (shrink)

BackgroundMachine learning-based clinical decision support systems (ML_CDSS) are increasingly employed in various sectors of health care aiming at supporting clinicians’ practice by matching the characteristics of individual patients with a computerised clinical knowledge base. Some studies even indicate that ML_CDSS may surpass physicians’ competencies regarding specific isolated tasks. From an ethical perspective, however, the usage of ML_CDSS in medical practice touches on a range of fundamental normative issues. This article aims to add to the ethical discussion by using (...) professionalisation theory as an analytical lens for investigating how medical action at the micro level and the physician–patient relationship might be affected by the employment of ML_CDSS.Main textProfessionalisation theory, as a distinct sociological framework, provides an elaborated account of what constitutes client-related professional action, such as medical action, at its core and why it is more than pure expertise-based action. Professionalisation theory is introduced by presenting five general structural features of professionalised medical practice: (i) the patient has a concern; (ii) the physician deals with the patient’s concern; (iii) s/he gives assistance without patronising; (iv) s/he regards the patient in a holistic manner without building up a private relationship; and (v) s/he applies her/his general expertise to the particularities of the individual case. Each of these five key aspects are then analysed regarding the usage of ML_CDSS, thereby integrating the perspectives of professionalisation theory and medical ethics.ConclusionsUsing ML_CDSS in medical practice requires the physician to pay special attention to those facts of the individual case that cannot be comprehensively considered by ML_CDSS, for example, the patient’s personality, life situation or cultural background. Moreover, the more routinized the use of ML_CDSS becomes in clinical practice, the more that physicians need to focus on the patient’s concern and strengthen patient autonomy, for instance, by adequately integrating digital decision support in shared decision-making. Ethics has recently gained importance in the debate over social capital creation. The goal of this study is to empirically examine the ethical work context of the firm as an antecedent of the firm’s internal social capital. We build on person–situation interactionist theory to argue that individuals can learn standards of appropriate behavior induced by the ethical work context in which they are embedded. By creating an ethical work context, managers can facilitate the process through which (...) employees learn to feel empathy toward others and establish profound affective relationships with them. Data were collected from 1,817 individuals in 36 business units of 7 Spanish, French, and Portuguese corporations. Using structural equation and hierarchical linear modeling techniques, our results reveal three phenomena. First, we show that a business unit’s ethical work context exerts significant influence on the structural, relational, and cognitive dimensions of internal social capital. Second, the managerial practices that constitute the ethical work context are not equally important across the seven corporations; in particular, managerial practices are more influential in those corporations that belong to knowledge-intensive industries. Third, a business unit’s internal social capital is influenced not only by the business unit’s ethical work context, but also by the ethical work context of the corporation to which it belongs. Act-utilitarianism and other theories in normative ethics confront the implementability problem: normal human agents, with normal human epistemic abilities, lack the information needed to use those theories directly for the selection of actions. Two Level Theories have been offered in reply. The theoretical level component states alleged necessary and sufficient conditions for moral rightness. That component is supposed to be true, but is not intended for practical use. It gives an account of objective obligation. The practical level component is offered (...) as an implementable system for the choice of actions by agents lacking some relevant information. It gives an account of subjective obligation. Several different ways of developing Two Levelism are explained and criticized. Five conditions that must be satisfied if the practical level principle is to be a good match for a given theoretical level principle are stated. A better form of Two Levelism is presented. (shrink)

This study draws on interviews with forty-nine members of a biomedical research community in the UK that is involved in negotiating data sharing and access. During an interview, an interviewee used the words “ethical moment” to describe a confrontation between collaborators in relation to data sharing. In this article, I use this as a lens for thinking about relations between “the conceptual and the empirical” in a way that allows both analyst and actor to challenge the status quo and (...) consider other ethical possibilities. Drawing on actor network theory, I approach “the empirical” using the concepts of controversy and ontological uncertainty as methodological tools to tackle the problem of ethics. I suggest that these concepts also provide a bridge for understanding the ontological structure of the virtual and the actual, as described in Deleuze’s Difference and Repetition. While other science and technology studies scholars have sought to draw on Deleuze, this article addresses the integration of ethics and empirical research. It arises as a critical reaction to existing treatments of this problem as found in empirical ethics, especially in the sociology of bioethics, and indirectly in ANT texts. (shrink)
