Building on the insights of existing feminist criticism, it identifies two largely unacknowledged features of such performance-oriented studies: first, an implicit recuperation of a pre-discursively real body; and second, a persistent emphasis on the productive character of performances. Exposing themselves to untested interventions was seen as the most ethical way to gauge the human response to those interventions.     What circumstances create the need for an institution that conforms to civil recourse theory? I consider polities that vary in the extent to which they instantiate justice and argue that only a moderately non-ideal polity has a need for such an institution.
