This article analyses and assesses the arguments opposing capital punishment put forward by Ján Kollár, a representative of Central European Evangelical/Lutheran Enlightenment rationalism, using the definition of criminal practice in Europe at the turn of the nineteenth century as the basis. Consequently, the author pays attention to the movement for reform in criminal law and practices, initiated in Europe in the second half of the eighteenth century by Cesare Beccaria, including his argumentation against capital punishment. In this context, the author (...) presents and investigates 13 arguments against capital punishment defined by Kollár in his 1815 diary. The author came to the conclusion that Kollár, in his arguments against capital punishment, followed, to a certain extent, the views of Beccaria and eighteenth -century adherents of the French Enlightenment; however, Kollár’s actual argumentation is rationalistically based on ethical values of humanity and justice with significant space also dedicated to utilitarian aspects of rejecting capital punishment adopted from reformists of criminal law. The study focuses on the ethical aspects of decision-making by national elites in the context of the thinking of Ján Kollár (1793–1852) and Ľudovít Štúr (1815–1856) on the issue of Slavism. Attention is paid to the issue of responsibility for preserving the greatness and unity of the nation in the context of the formation of national identity and individuality. The concepts of the mentioned authors had an impact on the cultural-civilizational orientation of Slovak elites with an emphasis on the role (...) of moral obligations in shaping the value orientation of the nation. In this context, the analysis focuses on the works Reciprocity between the various tribes and dialects of the Slavic nation and Slavdom and the world of the future, which, at the same time, represent alternative concepts of the cultural and political orientation of the Slavs. The study simultaneously analyses these concepts as alternative programs of cultural and political development of national identity, as well as concepts aimed at humanist and political goals. This paper addresses theoretical challenges, still relevant today, that arose in the first decades of the twentieth century related to the concept of the organism. During this period, new insights into the plasticity and robustness of organisms as well as their complex interactions fueled calls, especially in the UK and in the German-speaking world, for grounding biological theory on the concept of the organism. This new organism-centered biology understood organisms as the most important explanatory and methodological unit in biological investigations. (...) At least three theoretical strands can be distinguished in this movement: Organicism, dialectical materialism, and holistic biology. This paper shows that a major challenge of OCB was to describe the individual organism as a causally autonomous and discrete unit with consistent boundaries and, at the same time, as inextricably interwoven with its environment. In other words, OCB had to conciliate individualistic with anti-individualistic perspectives. This challenge was addressed by developing a concept of life that included functionalist and metabolic elements, as well as biochemical and physical ones. It allowed for specifying organisms as life forms that actively delimit themselves from the environment. Finally, this paper shows that the recent return to the concept of the organism, especially in the so-called “Extended Evolutionary Synthesis,” is challenged by similar anti-individualistic tendencies. However, in contrast to its early-twentieth-century forerunner, today’s organism-centered approaches have not yet offered a solution to this problem. (shrink)

In recent years, biologists and philosophers of science have argued that evolutionary theory should incorporate more seriously the idea of ‘reciprocal causation.’ This notion refers to feedback loops whereby organisms change their experiences of the environment or alter the physical properties of their surroundings. In these loops, in particular niche constructing activities are central, since they may alter selection pressures acting on organisms, and thus affect their evolutionary trajectories. This paper discusses long-standing problems that emerge when studying such reciprocal causal (...) processes between organisms and environments. By comparing past approaches to reciprocal causation from the early twentieth century with contemporary ones in niche construction theory, we identify two central reoccurring problems: All of these approaches have not been able to provide a conceptual framework that allows maintaining meaningful boundaries between organisms and environments, instead of merging the two, and integrating experiential and physical kinds of reciprocal causation. By building on case studies of niche construction research, we provide a model that is able to solve these two problems. It allows distinguishing between mutually interacting organisms and environments in complex scenarios, as well as integrating various forms of experiential and physical niche construction. (shrink)

ABSTRACT One of the most ambitious and sophisticated recent approaches to provide a theory of global health justice is Sridhar Venkatapuram's recent work. In this commentary, we first outline the core idea of Venkatapuram's approach to global health justice. We then argue that one of the most important elements of the account, Venkatapuram's basis of global health duties, is either too weak or assumed implicitly without a robust justification. The more explicit grounding of the duty to protect and promote health (...) capabilities is based on Martha Nussbaum's version of the capability approach. We argue that this foundation gives rise to humanitarian duties rather than duties of justice proper. Venkatapuram's second argument from the social determinants of health thesis is instead a stronger candidate for grounding duties of justice. However, as a justificatory argument, it is only alluded to and has not yet been spelled out sufficiently. We offer plausible justificatory steps to fill this gap and draw some implications for global health action. We believe this both strengthens Venkatapuram's approach and serves to broaden the basis for future action in the area of global health. (shrink)

International institutions such as UNESCO are deliberating on a new standard setting instrument for neurotechnologies. This will likely lead to the adoption of a soft law document which will be the first global document specifically tailored to neurotechnologies, setting the tone for further international or domestic regulations. While some stakeholders have been consulted, these developments have so far evaded the broader attention of the neuroscience, neurotech, and neuroethics communities. To initiate a broader debate, this target article puts to discussion twenty-five (...) considerations and desiderata for recognition by a future instrument. They are formulated at different levels of abstraction, from the big picture to technical details, seek to widen the perspective of preparatory reports and transcend the narrow debate about “neurorights” which overshadows many richer and more relevant aspects. These desiderata are not an exhaustive enumeration but a starting point for discussions about what deserves and what requires protection by an international instrument. (shrink)

Health-worker migration, commonly called "medical brain drain", refers to the mass migration of trained and skilled health professionals from low-income to high-income countries. This is currently leaving a significant number of poor countries, particularly in sub-Saharan Africa, with critical staff shortages in the healthcare sector. A broad consensus exists that, where medical brain drain exacerbates such shortages, it is unethical, and this review presents the main arguments underpinning this view. Notwithstanding the general agreement, which policies are justifiable on ethical grounds (...) to tackle brain drain and how best to go about implementing them remains controversial. The review offers a discussion of the specific ethical issues that have to be taken into account when deciding which policy measures to prioritise and suggests a strategy of policy implementation to address medical brain drain as a matter of urgency. In this article, we defend a normative theory of prenatal equality of opportunity, based on a critical revision of Rawls's principle of fair equality of opportunity . We argue that if natural endowments are defined as biological properties possessed at birth and the distribution of natural endowments is seen as beyond the scope of justice, Rawls's FEO allows for inequalities that undermine the social conditions of a property-owning democracy. We show this by considering the foetal programming of disease and the (...) possibility of germ-line modifications. If children of lower socioeconomic background are more likely to develop in a poor foetal environment and germ-line enhancements are available only to the rich, initial inequalities between the rich and the poor would grow, and yet FEO would be satisfied. In order to avoid the problem, we propose a revised FEO principle omitting any reference to the comparison of natural endowments. Our revised FEO requires that institutions mitigate social class effect from reproduction and gestation to the greatest extent compatible with parental freedoms and the value of the family. (shrink)

There is concern that the use of neuroenhancements to alter character traits undermines consumer's authenticity. But the meaning, scope and value of authenticity remain vague. However, the majority of contemporary autonomy accounts ground individual autonomy on a notion of authenticity. So if neuroenhancements diminish an agent's authenticity, they may undermine his autonomy. This paper clarifies the relation between autonomy, authenticity and possible threats by neuroenhancements. We present six neuroenhancement scenarios and analyse how autonomy accounts evaluate them. Some cases are considered (...) differently by criminal courts; we demonstrate where academic autonomy theories and legal reasoning diverge and ascertain whether courts should reconsider their concept of autonomy. We argue that authenticity is not an appropriate condition for autonomy and that new enhancement technologies pose no unique threats to personal autonomy. (shrink)

An increasing number of learning goals refer to the acquisition of cognitive skills that can be described as ‘resource-based,’ as they require the availability, coordination, and integration of multiple underlying resources such as skills and knowledge facets. However, research on the support of cognitive skills rarely takes this resource-based nature explicitly into account. This is mirrored in prior research on mathematical argumentation and proof skills: Although repeatedly highlighted as resource-based, for example relying on mathematical topic knowledge, methodological knowledge, mathematical strategic (...) knowledge, and problem-solving skills, little evidence exists on how to support mathematical argumentation and proof skills based on its resources. To address this gap, a quasi-experimental intervention study with undergraduate mathematics students examined the effectiveness of different approaches to support both mathematical argumentation and proof skills and four of its resources. Based on the part-/whole-task debate from instructional design, two approaches were implemented during students’ work on proof construction tasks: (i) asequential approachfocusing and supporting each resource of mathematical argumentation and proof skills sequentially after each other and (ii) aconcurrent approachfocusing and supporting multiple resources concurrently. Empirical analyses show pronounced effects of both approaches regarding the resources underlying mathematical argumentation and proof skills. However, the effects of both approaches are mostly comparable, and only mathematical strategic knowledge benefits significantly more from the concurrent approach. Regarding mathematical argumentation and proof skills, short-term effects of both approaches are at best mixed and show differing effects based on prior attainment, possibly indicating an expertise reversal effect of the relatively short intervention. Data suggests that students with low prior attainment benefited most from the intervention, specifically from the concurrent approach. A supplementary qualitative analysis showcases how supporting multiple resources concurrently alongside mathematical argumentation and proof skills can lead to a synergistic integration of these during proof construction and can be beneficial yet demanding for students. Although results require further empirical underpinning, both approaches appear promising to support the resources underlying mathematical argumentation and proof skills and likely also show positive long-term effects on mathematical argumentation and proof skills, especially for initially weaker students. This paper is my commentary on Raymond Tallis’ book Freedom: An Impossible Reality (2021). Tallis argues that the laws described by science are dependent on human agency which extracts them from nature. Consequently, human agency cannot be explained as an effect of natural laws. I agree with Tallis’ main argument and I appreciate that he helps us understand the systematic importance of a human-scale breadth of view regarding any theoretical investigation. In the main part of the paper, I critically comment (...) on Tallis’ interpretation of several more loosely associated topics from a phenomenological perspective. Firstly, I reconsider Tallis’ account of intentionality as a factor that opens a distance between the cognizer and the world. Whereas Tallis emphasizes that agency requisitions aspects of the world to achieve its goals, I point out that agency does not determine the meaning of things unidirectionally and independently of all context. A self-controlled agency is provisionally reached through a process of ‘deindexicalization’ of our passive intentional capacities, that is, by creating and maintaining new, different worldly contexts. Subsequently, I analyze Tallis’ description of our intentional relation to spatiotemporally distant possibilities. In my view, Tallis underestimates the extent to which our intentional relation to possibilities is pre-reflexive and pre-predicative and hence independent of propositional attitudes. Finally, I consider Tallis’ interpretation of nature and show that it is deeply influenced by the sciences of nature. In contrast, I argue that agency can be properly described only if we understand it as an intervention in a lifeworld already imbued with sense, not merely a physical or material nature. (shrink)

This volume fills this lacuna, showing the fundamental character of the notions of being, one, true and good for his thought. The book inquires into the beginnings of the doctrine in the thirteenth century and explains the relation of the transcendental way of thought to Aquinas's conception of metaphysics. The first strategy is to defeat the principled case for open borders, such as the global equality of opportunity argument for more lax immigration control. The second strategy is to establish the democratic community’s prima facie right to determine the shape of its future, including membership and the right to exclude. First, I argue (...) that Miller’s conception of global equality of opportunity is overly narrow and that his objections to the principle, to the metric and to what counts as feasible political action misfire against other, more plausible, accounts. Second, I argue that his democratic interpretation of collective self-determination does not solve the pressing question concerning the morally justified scope and content of self-determination and the moral limits of the right to exclude. I conclude by questioning Miller’s general strategy: whether theories of immigration should be engaged in an exercise of shifting the burden of proof between open and closed borders. By contrast, I argue that a more desirable task for the political philosophy of immigration is to find ways in which the joint requirement of global equality of opportunity and collective self-determination can be coherently upheld. The sensorimotor theory of perceptual consciousness offers a form of enactivism in that it stresses patterns of interaction instead of any alleged internal representations of the environment. But how does it relate to forms of enactivism stressing the continuity between life and mind? We shall distinguish sensorimotor enactivism, which stresses perceptual capacities themselves, from autopoietic enactivism, which claims an essential connection between experience and autopoietic processes or associated background capacities. We show how autopoiesis, autonomous agency, and affective dimensions of experience (...) may fit into sensorimotor enactivism, and we identify differences between this interpretation and autopoietic enactivism. By taking artificial consciousness as a case in point, we further sharpen the distinction between sensorimotor enactivism and autopoietic enactivism. We argue that sensorimotor enactivism forms a strong default position for an enactive account of perceptual consciousness. (shrink)

Jan-Olav Henriksen reconstructs and analyzes Christianity as a cluster of practices that manifest a distinct historically and contextually shaped mode of being in the world. Henriksen suggests that these practices imply a complicated relationship between the tradition in which they originate, the community that emerges from and is constituted by that tradition, and the individuals who appropriate the tradition that these communities mediate through their practices. Thus, to think of Christianity simply in terms of belief is misleading and represents an (...) underdetermination of its distinct character. Henriksen further argues this relationship needs to be described primarily as practices aimed at orientation and transformation. His analysis points to Christianity's similarity to other religions in regard to the functional or pragmatic dimensions it displays. Examining facets such as prayer, the use of scripture, preaching and doctrine, Henriksen emphasizes that the element that makes a practice distinctively Christian is how it relates to and is informed by the Jesus story. Michael Blake holds that liberal states are precluded from introducing compulsory medical service to improve access to health care under conditions of critical health worker shortage. "Emergency circumstances" are the only exception when the suspension of liberty may be justified. I argue that there are three problems with Blake's emergency justification of compulsory service. First, his concept of emergency is vague. Second, his account does not really rely on emergency as much as liberty. Third, his conception of permissible restrictions of (...) liberty is too narrow. I argue that liberties may be limited to some degree, temporarily, for the sake of attaining the capacities necessary for the exercise of liberties and for safeguarding the social conditions of the right to health. I conclude that in poor societies, temporarily delaying emigration through a highly qualified compulsory medical service can sometimes be justified. (shrink)

In recent years, postgenomic research, and the fields of epigenetics and microbiome science in particular, have described novel ways in which social processes of racialization can become embodied and result in physiological and health-related racial difference. This new conception of biosocial race has important implications for philosophical debates on the ontology of race. We argue that postgenomic research on race exhibits two key biases in the way that racial schemas are deployed. Firstly, although the ‘new biosocial race’ has been characterized (...) as social race entering into biological processes, it is only particular aspects of social race that are taken to cross the biosocial boundary, resulting in a distorted view of the social component of biosocial race. Secondly, racial categories are assumed to be stable across time and space. This assumption is epistemically limiting, as well as indicating a reliance on a fixed racial ontology. However, the causal pathways for the embodiment of social race, and the different possible modes of embodiment, that postgenomic science is uncovering themselves present a challenge for fixed or static racial ontologies. Given these tensions, we argue that the emerging picture of a shifting landscape of entanglement between the social and the biological requires us to increase the complexity of our ontologies of race, or even embrace a deflationary metaphysics of race. Research on the relation between sound and meaning in language has reported substantial evidence for implicit associations between articulatory–acoustic characteristics of phonemes and emotions. In the present study, we specifically tested the relation between the acoustic properties of a text and its emotional tone as perceived by readers. To this end, we asked participants to assess the emotional tone of single stanzas extracted from a large variety of poems. The selected stanzas had either an extremely high, a neutral, or an (...) extremely low average formant dispersion. To assess the average formant dispersion per stanza, all words were phonetically transcribed and the distance between the first and second formant per vowel was calculated. Building on a long tradition of research on associations between sound frequency on the one hand and non‐acoustic concepts such as size, strength, or happiness on the other hand, we hypothesized that stanzas with an extremely high average formant dispersion would be rated lower on items referring to Potency (dominance) and higher on items referring to Activity (arousal) and Evaluation (emotional valence). The results confirmed our hypotheses for the dimensions of Potency and Evaluation, but not for the dimension of Activity. We conclude that, at least in poetic language, extreme values of acoustic features of vowels are a significant predictor for the emotional tone of a text. (shrink)

In recent years the idea that perceptual content is tensed in the sense that we can perceive objects as present or as past has come under attack. In this paper the notion of tensed content is to the contrary defended. The paper argues that assuming that something like an intentionalistic theory of perception is correct, it is very reasonable to suppose that perceptual content is tensed, and that a denial of this notion requires a denial of some intuitively very plausible (...) principles. The paper discusses some common objections against the notion of tensed content and concludes that none of them succeeds in showing that perceptual content cannot be tensed. (shrink)

The concept of voluntariness permeates the ethics and politics of migration and is commonly used to distinguish refugees from migrants. Yet, neither the precise nature and conditions of voluntariness nor its ethical significance for migrant rights and state obligations has received enough attention. The articles in this collection move the debate forward by demonstrating the complex ethical judgments involved in delineating voluntary from forced migration and in drawing out its political and institutional implications. In addition to highlighting the interplay between (...) the voluntary and nonvoluntary elements of migration over time and across different sites of the migration journey, they provide a nuanced account of the various conditions of voluntariness and they challenge common ideas about its normative political consequences. In this paper, I present a solution to the problem that the need to accommodate the phenomenon of epistemic defeat poses for reliabilism. Defeaters are supposed to remove justification for previously justified beliefs. According to standard process reliabilism, the justification of a belief depends on the reliability of a process that is already completed when a defeater for that belief is obtained. It is hard to see, then, how a defeater can affect reliabilist justification, if that justification, from the perspective (...) of the defeater, lies wholly in the past. What is more, undercutting defeaters plausibly defeat by generating incompatibilities with higher-order propositions :105–118, 2014; Melis in Philos Stud 170:433–442, 2014). This is hard to integrate with reliabilism which explicitly denies higher-order conditions for justification. I argue that both of these phenomena can be accommodated by it via what I call the “Replacement Principle”: when a defeater is obtained, it generates either a logical incompatibility or a doxastic incompatibility. The resulting tension is registered and initiates a reasoning process that compares the epistemic support for the defeater with that for the defeated belief. This process may replace the original reliable formation process as a doxastic base for the defeated belief. If the defeater is not given its due weight in the reasoning process, that process was unreliable and if the defeated belief is retained as a result, it will be unjustified. This is intuitively the right result. Since reasoning is reliable, only if it is rational, the account manages to capture the intuition that disregarding a defeater would be irrational without having to make rationality a condition for justification. Replacement is not only plausible on causal pictures of doxastic basing, but also required in order to allow for the possibility of belief reevaluation in general and is therefore not an ad hoc addition to reliabilism, but rather part of its inherent explanatory resources. The immigration debate in political theory has produced a series of accounts that justify the state’s right to exclude potential immigrants, where the right of self-determination figures prominently. We challenge two prominent accounts of the self-determination-based right to exclude and defend a circumscribed right to exclude and a corollary duty to admit immigrants, based on our ‘people relationship goods’ account of self-determination. Our conception reconciles the moral claims of global opportunity migrants with the well-being and non-alienation interests of the locals. (...) It therefore provides a principled answer to the philosophical question underlying pressing political conflicts today, namely what is the permissible scope of exclusion by self-determining political communities, in light of weighty global moral demands of inclusion. This paper is a defense of an internalist view of the perception of shapes. A basic assumption of the paper is that perceptual experiences have certain parts which account both for the phenomenal character associated with perceiving shapes—phenomenal shapes—and for the intentional content presenting shapes—intentional shapes. Internalism about perceptions of shapes is defined as the claim that phenomenal shapes determine the intentional shapes. Externalism is defined as the claim that perceptual experiences represent whatever shape the phenomenal shape reliably tracks. The (...) argument against externalism proceeds in three steps. First, it is argued that phenomenal shapes are modality specific, such that a phenomenal shape that features in a visual perceptual experience cannot feature in a haptic perceptual experience, and vice versa. Second, it is argued that intentional shapes are amodal. Third, it is argued that externalism is incompatible with the fact that phenomenal shapes are modality specific and intentional shapes amodal. Inequality causes a variety of social ills, which give egalitarians reasons for concerns of justice. In particular, inequality is deemed to undermine people’s fundamental moral capacity of self-respect. In this paper, we explore the complex relationship between inequality and self-respect from a philosophical and an empirical angle, arguing that a theory of justice should take both into account. To this purpose, we first clarify the normative objection to inequality from the alleged erosion of self-respect. Then, we elaborate on empirical findings (...) showing the crucial role that ‘relative deprivation’ plays in the causal mechanism that connects inequalities to the erosion of self-respect. This paper studies intentional action in stit logic. The formal logic study of intentional action appears to be new, since most logical studies of intention concern intention as a static mental state. In the formalization we distinguish three modes of acting: the objective level concerning the choices an agent objectively exercises, the subjective level concerning the choices an agent knows or believes to be exercising, and finally, the intentional level concerning the choices an agent intentionally exercises. Several axioms constraining the (...) relations between these different modes of acting will be considered and discussed. The side effect problem will be analyzed as an interaction between knowingly doing and intentionally doing. Non-successful action will be analyzed as a weakening of the epistemic attitude towards action. Finally, the notion of ‘attempt’ will be briefly considered as a further weakening in this direction. Modern societies are characterized by a division of epistemic labor between laypeople and epistemic authorities. Authorities are often far more competent than laypeople and can thus, ideally, inform their beliefs. But how should laypeople rationally respond to an authority’s beliefs if they already have beliefs and reasons of their own concerning some subject matter? According to the standard view, the beliefs of epistemic authorities are just further, albeit weighty, pieces of evidence. In contrast, the Preemption View claims that, when one (...) discovers what an authority believes, it is not permissible to rely on any of one’s own reasons concerning the subject matter. The original version of this view, as proposed by Linda Zagzebski, has recently been severely criticized for recommending blind trust and for abandoning even minimal standards for critical thinking. In our paper, we defend a new version of the Preemption View—Defeatist Preemptionism—in a way that differs radically from Zagzebski’s. We argue that our view can be derived from certain widely accepted general epistemic principles. In particular, we claim that preemption can be identified as a special case of source sensitive defeat. Moreover, we argue that Defeatist Preemptionism does not lead to the undesirable consequences that critics ascribe to the Preemption View. The paper thus articulates the foundations and refinements of the Preemption View, such that it adequately captures the phenomenon of epistemic authority and the rational requirements related to it. Biologists and philosophers of science have recently called for an extension of evolutionary theory. This so-called ‘extended evolutionary synthesis’ seeks to integrate developmental processes, extra-genetic forms of inheritance, and niche construction into evolutionary theory in a central way. While there is often agreement in evolutionary biology over the existence of these phenomena, their explanatory relevance is questioned. Advocates of EES posit that their perspective offers better explanations than those provided by ‘standard evolutionary theory’. Still, why this would be the case (...) is unclear. Usually, such claims assume that EES’s superior explanatory status arises from the pluralist structure of EES, its different problem agenda, and a growing body of evidence for the evolutionary relevance of developmental phenomena. However, what is usually neglected in this debate is a discussion of what the explanatory standards of EES actually are, and how they differ from prevailing standards in SET. In other words, what is considered to be a good explanation in EES versus SET? To answer this question, we present a theoretical framework that evaluates the explanatory power of different evolutionary explanations of the same phenomena. This account is able to identify criteria for why and when evolutionary explanations of EES are better than those of SET. Such evaluations will enable evolutionary biology to find potential grounds for theoretical integration. (shrink)

The topic of this paper is the perception of properties. It is argued that the perception of properties allows for a distinction between the sense of the identity and the sense of the qualitative nature of a property. So, for example, we might perceive a property as being identical over time even though it is presented as more and more determinate. Thus, you might see an object first as red and then as crimson red. In this case, the property is (...) perceived as identical over time, even though the sense of the qualitative nature (the redness, the crimson redness) of the property is changing. The distinction between the sense of identity and the sense of quality is explicated in terms of perceiving a particular property, a trope, and perceiving it as an instance of a universal. It is subsequently argued that the perceived tropes cannot constitute the phenomenal character of the perceptual experience. (shrink)

Bayesian model selection has frequently been the focus of philosophical inquiry (e.g., Forster, Br J Philos Sci 46:399–424, 1995; Bandyopadhyay and Boik, Philos Sci 66:S390–S402, 1999; Dowe et al., Br J Philos Sci 58:709–754, 2007). This paper argues that Bayesian model selection procedures are very diverse in their inferential target and their justification, and substantiates this claim by means of case studies on three selected procedures: MML, BIC and DIC. Hence, there is no tight link between Bayesian model selection and (...) Bayesian philosophy. Consequently, arguments for or against Bayesian reasoning based on properties of Bayesian model selection procedures should be treated with great caution. (shrink)
