The role of power in healthcare can raise many ethical challenges. Power is ownership, whether given, ceded, or taken of another person’s autonomy. When a person has power over someone else, they can control or strongly influence the decision-making freedom of that person. From the principalist perspective1,2 of healthcare ethics, denying a person their freedom to choose, should only occur when justifying conditions related to beneficence and nonmaleficence are sufficiently satisfied. In healthcare, it is rare to be able to identify (...) situations where paternalism is justified. Guidelines orient best practices in medicine, yet, in health care, many real world constraints limit their optimal realization. Since guideline implementation problems are not systematically anticipated, they will be discovered only post facto, in a learning curve period, while the already implemented guideline is tweaked, debugged and adapted. This learning process comes with costs to human health and quality of life. Despite such predictable hazard, the study and modeling of medical guideline implementation is still seldom pursued. In this article we (...) argue that to systematically identify, predict and prevent medical guideline implementation errors is both an epistemic responsibility and an ethical imperative in health care, in order to properly provide beneficence, minimize or avoid harm, show respect for persons, and administer justice. Furthermore, we suggest that implementation knowledge is best achieved technically by providing simulation modeling studies to anticipate the realization of medical guidelines, in multiple contexts, with system and scenario analysis, in its alignment with the emerging field of implementation science and in recognition of learning health systems. It follows from both claims that it is an ethical imperative and an epistemic responsibility to simulate medical guidelines in context to minimize harm in health care, before guideline implementation. In lieu of an abstract, here is a brief excerpt of the content:120 A WORD ON BEHALF OF DEMEA Little attention has been given to the a priori argument for God's existence espoused by Demea in Hume's Dialogues concerning Natural Religion. This circumstance is neither surprising nor unjustified. Given Hume's well-known theological sympathies, certainly no one would be tempted to regard Demea as Hume's spokesman. Demea's argument plays so small a role in the Dialogues as to suggest that Hume does (...) not take it at all seriously. He may present it only to establish that he is aware of alternative arguments for God's existence, but thinks them even less successful than the design argument and hence undeserving of extensive critique. Yet, if a philosopher criticizes an argument he deems unworthy of respect, he should still provide sound, not spurious, reasons for rejecting it. This is exactly what D. C. Stove has argued that Hume fails to do in Part IX of the Dialogues, assuming, as is generally done, that the speeches of Cleanthes and Philo present reasoning that Hume would personally endorse. Stove argues that most of the criticisms of Demea's argument are "extremely defective, and that they even include an inconsistency" (Stove, p. 300). This contention has been challenged by Donald Stahl, who has published a succinct point by point rebuttal of Stove's contentions.3 The Stove-Stahl controversy only deals with the reasoning presented in paragraphs 5, 6, 7, and 10 of Part IX because those are the contentions Stove attacks. He has "nothing to say against" the criticisms presented in paragraphs 8 and 9, which he assumes will be generally agreed to be 121 less important than the others (Stove, p. 308). He totally ignores the argument of paragraph 11. However, I am not convinced that the criticisms of these paragraphs are less important and I do have something to say against them. Consequently, instead of intervening directly on either side of the dispute between Professors Stove and Stahl, I shall attend principally to the argumentation of paragraphs 8, 9, and 11. I shall (1) summarize Demea's argument, (2) argue for the significance of the criticisms of paragraphs 8-9, (3) examine those criticisms, and (4) assess the role of Philo's concluding remarks in paragraphs 10-11. 1. Demea's Argument Early on Hume has Demea speak so obviously inconsistently as to make the reader wonder whether this character is supposed to think at all about the implications of the claims he espouses. At the beginning of Part II, he proclaims that God's existence is surely not at issue, since no one of common sense... ever entertained a serious doubt with regard to a truth so certain and self-evident." The nature of God is the only proper object of theological inquiry, and that is "altogether incomprehensible and unknown to us" (D 141)! Given such a radically apophatic position (Hume calls it "mystical"), it is hardly surprising that the sceptical Philo readily concurs, once he specifies that he takes 'God' to mean just "the original cause of this universe (whatever it be)" (D 142). But Demea immediately buttresses his alleged self-evident truth by appealing to the authority of Father Malebranche and the whole tradition of Christian theology, apparently oblivious to the impropriety of 122 supporting an indubitable truth by citing authorities (D 141-142). Further, scarcely more than a page later, after Cleanthes has sketched out the design argument, this same Demea is horrified that Cleanthes gives no abstract arguments or a priori proofs and calls for a "demonstration of the being of a God" (D 143). When, in Part IX, Demea himself undertakes to provide the "simple and sublime argument a priori" (D 188) he expected from Cleanthes, he characterizes the argument as "the common one," which suggests he is more engaged in paraphrasing authority than in thoughtfully arguing. Traditional arguments for privacy in public suggest that intentionally public activities, such as political speech, do not deserve privacy protection. In this article, I develop a new argument for the view that surveillance of intentionally public activities should be limited to protect the specific good that this context provides, namely democratic legitimacy. Combining insights from Helen Nissenbaum’s contextualism and Jürgen Habermas’s theory of the public sphere, I argue that strategic surveillance of the public sphere can undermine the capacity of citizens (...) to freely deliberate in public and therefore conflicts with democratic self-determination. The hope for a better future can, and frequently does, motivate political action. Political hope is therefore often considered a positive force. However, not all forms of political hope are beneficial. Some scholars and activists claim that some kinds of hope also function as an ideology. I argue that we can give a precise meaning to the notion of ‘ideological hope,’ and I argue that to say of a given instance of hope that it is ‘ideological’ means more than that (...) it is irrational or immoral. I distinguish two forms of ideological hope: forms where the ideological nature of hope derives from underlying ideological beliefs and judgments, and structural forms. The case of structurally ideological hope shows that even the rational hopes of political agents can undermine their purposes by binding them to distorted political self-understandings. (shrink)

The link between the right to privacy and the right to democratic self-determination is often understood to imply that privacy rights have only instrumental value for democratic participation, and that they consist solely in the possibility to retreat from participation in a public. I examine three arguments for an internal link between both sets of rights: The right to privacy protects political public spheres from epistemic inequality, it protects groups in public from a loss of their deliberative autonomy and it (...) blocks the colonisation of deliberative publics by strategic action orientations. The problem of the social foundations of normativity can be illuminated by discussing the narrower question whether rule-following is necessarily a social matter. The problems with individualistic theories of rule-following seem to make such a conclusion unavoidable. Social theories of rule-following, however, seem to only push back one level the dilemma of having to choose either an infinite regress of interpretations or a collapse into non-normative descriptions. The most plausible of these models, Haugeland's conformism, can avoid these objections if it (...) is supplemented with an ontologically reasonable concept of the collective attitude of a group. Groups of individuals who are bound to shared norms by recognizing each other as equipped with a standard authority of criticism have the necessary properties for ascribing to those groups such collective attitudes. Given such a weak notion of a collective attitude, there is hope for a plausible collectivist theory of rule-following. (shrink)

This paper discusses recent evidence that violations of core knowledge offer special learning opportunities for infants and young children. Children make predictions about the world from the youngest ages. When their fail to match observed data, they show an enhanced drive to seek and retain new information about entities that violated their expectations. Finally, the authors draw comparisons between children and adults, and with other species, to explore how surprise shapes thought more broadly.

Computer-based design environments for skilled domain workers have recently graduated from research prototypes to commercial products, supporting the learning of individual designers. Such systems do not, however, adequately support the collaborative nature of work or the evolution of knowledge within communities of practice. If innovation is to be supported within collaborative efforts, thesedomain-oriented design environments (DODEs) must be extended to becomecollaborative information environments (CIEs), capable of providing effective community memories for managing information and learning within constantly evolving collaborative contexts. Hubert Dreyfus has argued that cases of absorbed bodily coping show that there is no room for self-awareness in flow experiences of experts. In this paper, I argue against Dreyfus’ maxim of vanishing self-awareness by suggesting that awareness of agency is present in expert bodily action. First, I discuss the phenomenon of absorbed bodily coping by discussing flow experiences involved in expert bodily action: merging into the flow; immersion in the flow; emergence out of flow. I argue against the claim (...) that flow experience does not involve an awareness of agency for each of these features, while conceding that fluent agency does not involve self-awareness in the thetic sense. I challenge the assumption that the awareness of fluent agency must be understood in terms of a thetic awareness of agency. Instead, I develop an Anscombean account of the awareness of fluent agency in terms of the phenomenal character of knowing one’s aims. I respond to the challenge that if an Anscombean account of the awareness of agency is to succeed, then agents must be able to answer Anscombean questions. I consider the objection that awareness of agency is not a form of self-awareness by outlining an account of self-awareness as self-synthesis that is distinct from self-perception and self-ascription, but which makes room for self-awareness in expert bodily action. Purpose: Explore public attitudes towards the trade-offs between justice and medical outcome inherent in organ allocation decisions.Background: The US Task Force on Organ Transplantation recommended that considerations of justice, autonomy and medical outcome be part of all organ allocation decisions. Justice in this context may be modeled as a function of three types of need, related to age, clinical urgency, and quality of life.Methods: A web-based survey was conducted in which respondents were asked to choose between two hypothetical patients who (...) differed in clinical urgency , age, pretransplant and post-transplant quality of life, and life expectancy.Results: A pool of 1600 people were notified via email about the survey; 623 responded. Respondents preferred giving organs to younger people up to an age difference of <15.4 years and more clinically urgent people up to a difference in urgency of <2.54 months . Priority varied with the quality of life of the worst-off patient and the relative status of the patients. If both had worse than average quality of life, respondents preferred the better-off patient. When both had better than average quality of life, they preferred the worse-off patient. In analysis according to age versus clinical urgency, the older the patient, the more urgency needed to receive priority. In quality of life versus clinical urgency, the better the control’s quality of life, the more urgency the competing patient required. The worse the patient’s post-transplant outcome, the more urgency needed to receive priority.Conclusions: It appears that clinical urgency is only one of many factors influencing attitudes about allocation decisions and that respondents may invoke different principles of fairness depending the relative clinical status of patients. Do Quine and Carnap distort the social nature of inquiry by privileging individual epistemic subjects? This objection is at the heart of Donald Davidson’s claim that Quine fails to grasp the significance of the concept of truth. In Carnap’s case, the objection may be detected in Charles Morris’s call to ground scientific philosophy in semiotics, the science of signs, rather than syntax, the formal investigation of languages. Drawing out the challenge from Morris’s proposal requires examining a neglected influence on this (...) neglected philosopher: his advisor George Herbert Mead’s social theory of mind. I argue that Morris and Davidson can both be understood as demanding that scientific philosophers socialize their conception of objectivity. (shrink)

For this 1897 publication, the American philosopher William James brought together ten essays, some of which were originally talks given to Ivy League societies. Accessible to a broader audience, these non-technical essays illustrate the author's pragmatic approach to belief and morality, arguing for faith and action in spite of uncertainty. James thought his audiences suffered 'paralysis of their native capacity for faith' while awaiting scientific grounds for belief. His response consisted in an attitude of 'radical empiricism', which deals (...) practically rather than ideologically with real-world phenomena. When facing a 'momentous' decision about belief, he says, we both can and must choose the best hypothesis. The first four essays apply this principle to religious faith, and the rest explore the pragmatic approach to such topics as determinism, ethics and individual achievement. Ableist attitudes and structures regarding disability are increasingly recognized across all sectors of healthcare delivery. After Dobbs, novel questions arose in the USA concerning how to protect reproductive autonomy while avoiding discrimination against and devaluation of disabled persons. As a case study, we examine the Louisiana’s Department of Public Health August 1st Emergency Declaration, “List of Conditions that shall deem an Unborn Child ‘Medically Futile.’” We raise a number of medical, ethical, and public health concerns that lead us to argue (...) the declaration should be rescinded. The ethically objectionable declaration provides valuable lessons concerning how to uphold both reproductive and disability justice in a post-Dobbs landscape. (shrink)

Im 17./18. Jahrhundert war Konstruktion verbunden mit dem Maschinenbegriff und vom Anspruch getragen, das geschlossene Ganze der Maschine als Objekt zu erfassen. Im (...) Unterschied dazu wurde namentlich in der klassischen deutschen Philosophie der Konstruktionsgedanke in ganz anderer Weise ausgebildet. Insbesondere Fichte vollzog einen Paradigmawechsel, indem er die Konstruktion zur universellen Fähigkeit der Begriffsbildung erhob. Wissen galt ihm als ideale "Nachkonstruktion" des Seins unter der Form des Wissens. Es verbindet sich damit der Wechsel vom ordnenden zu einem entwerfenden Weltverhältnis. The concept of construction underwent significant changes under the influence of technical advances and socio-cultural changes, especially in the 19th century. With its seemingly obvious use, the question of its field of meaning arises: Is construction a process that focuses on design, the presentation of the external shape of the object to be produced, or are significantly more aspects implied in it? In the 17th/18th In the 19th century, construction was associated with the concept of machine and supported by the claim to grasp the closed whole of the machine as an object. In contrast to this, the idea of ​​construction was developed in a completely different way, especially in classical German philosophy. Fichte in particular carried out a paradigm shift by elevating construction to the universal ability of concept formation. Knowledge was for him the ideal "reconstruction" of being under the form of knowledge. This is linked to the change from an ordering to a designing world relationship. Knowledge now appears as something in the making. The drafting, active character of the subject manifests itself in the working out of the theoretical-conceptual version of the essence of an object. In the development of his analytical-synthetic method Fichte sought recourse to diaeresis, which reflects back methodically to Plato. While Plato indisputably provides the historical origin of diaeresis, very little is given as a direct reference for Fichte’s decision of terms. Therefore, the essay examines which contemporary scientific and philosophical problems led to the reference point for the resumption and reformation of diaeresis. It also shows how Fichte developed the diaeresis into a special transcendental philosophical method as well as tracking how it marks a turning point in philosophy. The multifaceted methodological and epistemological considerations for formulating the unity and diversity of appearances in nature and history form the contemporary background for Fichte’s development of a new type of analytical-synthetic method. By laying down a basic form which in itself contains the possibility of a differentiated formation, the philosophical development of the concept becomes traceable in its genesis. This marks the point where Fichte's conception transcends the contemporary taxonomic approaches and their spatially-static stratification of concepts. The same applies to the approaches that shape hybridization with their latent temporalization of the conceptual chain. It forms a rupture in thinking related to the linking of species, in that the idea of the mediation of the species (of concepts) among themselves becomes the idea guiding the knowledge. Genetic reconstruction follows the path of the transformation of the absolute I and thus the subject involved in these changes in the process of cognition as a kind of ›unwrapping‹ into other modes of appearance up to ›reality‹ as a representational existence. The essay deals with the question whether Fichte’s socio-economic model which based both on the experiences and ideas of his time. Additionally, it explores how his socio-economic theorems stood out against cameralistic and feudal-conservative discussions and to what extent they can be described as an early critique of capitalism. Is the essence of Fichte’s socio-economic ideas to be seen in his model of state regulation or rather in his methodological claim of genetically developing the phenomena by showing their mediating links? (...) What is however still relevant today is Fichte’s idea that human beings are not the objects or means of social relations but their subjects and aims. For this purpose, Fichte developed a concept of justice that is constitutive for his notion of society. Democracy aiming at an active use of reason and social justice are the two moments which depend on each other. (shrink)

It is known that in connection with proposed educational reforms in the German states around 1800, Johann Gottliebe Fichte, following the Enlightenment concepts, developed a program, which considered education as an indispensable human right. In this program, the idea of providing all the citizens with the opportunity to get an education has been formulated as a social task and a condition of social and political modernization. In accordance with Fichte’s thought, over the cultivation of individuals, a new morality, and then, (...) on that basis, a new civic subject had to shape itself. The science thenceforth should have obtained a function of organizing a new society, in Fichte’s vision of it, instead of theology having previously played that role, while the public education system should have mediated the application of the scientific principles of organizing the society and thus to become a driving force in this development process. The generally accessible education and science were conceived by Fichte as autonomous moments of social organization, being the area intact by any immediate influence of authorities and based on the principles of individuals’ free communication. Fichte’s theorem of intersubjectivity has introduced an understanding of teaching as a social and communicative process into the ethical and political, as well as into the educational thought. It was not limited to reproduction of predetermined skills by the subject, but took into account the subject’s formation in the course of actively perception of educational contents and the change of the subject himself taking place by that. Empirical research into the ethics of emerging technologies, often involving foresight studies, technology assessment or application of the precautionary principle, raises significant epistemological challenges by failing to explain the relative epistemic status of contentious normative claims about future states. This weakness means that it is unclear why the conclusions reached by these approaches should be considered valid, for example in anticipatory ethical assessment or governance of emerging technologies. This paper explains and responds to this problem by proposing an account of (...) how the epistemic status of uncertain normative claims can be established in ethical and political discourses based on Jürgen Habermas’ discourse ethics. To better understand the nature of the problem, the relationship between norms, facts and the future is explored in light of potential meta-ethical fallacies faced in the field of empirical ethics. Weaknesses of current approaches to anticipatory ethical assessment and governance are then explored, including the Precautionary Principle and Technology Assessment. We argue that the epistemic status of uncertain normative claims can be understood within Habermas’ approach to political discourse, which requires ‘translation’ of uncertain claims to be comprehensible to other stakeholders in discourse. Translation thus provides a way to allow for uncertain normative claims to be considered alongside other types of validity claims in discourse. The paper contributes a conceptual account of the epistemic status of uncertain normative claims in discourse and begins to develop a ‘methodology of translation’ which can be further developed for approaches to research and ethical assessment supporting anticipatory evidence-based policy, governance and system design. Purpose The purpose of this paper is clearly illustrate this convergence and the prescriptive recommendations that such documents entail. There is a significant amount of research into the ethical consequences of artificial intelligence. This is reflected by many outputs across academia, policy and the media. Many of these outputs aim to provide guidance to particular stakeholder groups. It has recently been shown that there is a large degree of convergence in terms of the principles upon which these guidance documents are (...) based. Despite this convergence, it is not always clear how these principles are to be translated into practice. Design/methodology/approach In this paper, the authors move beyond the high-level ethical principles that are common across the AI ethics guidance literature and provide a description of the normative content that is covered by these principles. The outcome is a comprehensive compilation of normative requirements arising from existing guidance documents. This is not only required for a deeper theoretical understanding of AI ethics discussions but also for the creation of practical and implementable guidance for developers and users of AI. Findings In this paper, the authors therefore provide a detailed explanation of the normative implications of existing AI ethics guidelines but directed towards developers and organisational users of AI. The authors believe that the paper provides the most comprehensive account of ethical requirements in AI currently available, which is of interest not only to the research and policy communities engaged in the topic but also to the user communities that require guidance when developing or deploying AI systems. Originality/value The authors believe that they have managed to compile the most comprehensive document collecting existing guidance which can guide practical action but will hopefully also support the consolidation of the guidelines landscape. The authors’ findings should also be of academic interest and inspire philosophical research on the consistency and justification of the various normative statements that can be found in the literature. Der Artikel verfolgt, in welcher Weise Johann Gottlieb Fichte mit seiner Wissenschaftslehre die Diskussion um das Wesen der Natur in ihrem Verhältnis zum Subjekt beeinflusst. Dabei wird besonders sein Ansatz zur Fassung der Subjektivität und der Dialektisierung der Erkenntnisbeziehung zwischen Subjekt und Objekt herausgearbeitet. In this unique work, James P. Sterba argues that traditional ethics has yet to confront the three significant challenges posed by environmentalism, feminism, and multiculturalism. He maintains that while traditional ethics has been quite successful at dealing with the problems it faces, it has not addressed the possibility that its solutions to these problems are biased in favor of humans, men, and Western culture. In Three Challenges to Ethics: Environmentalism, Feminism, and Multiculturalism, Sterba examines each of these challenges. In terms of feminism, he maintains that traditional ethics should rule out gendered family structures and implement an ideal of androgyny. In regard to multiculturalism, he contends that traditional ethics must endorse an ethics that is secular in character and that can survive an extensive comparative evaluation of both Western and non-Western moral ideals and cultures.
