This article uses music and the discourse about music to understand the practice of tolerance in Prague during the period immediately preceding the outbreak of the Thirty Years’ War. Drawing on Las ensaladas, a collection of vernacular polyphony compiled by the Spanish composer Mateo Flecha the Younger, and Harmoniae morales, comprising musical settings of Latin texts by the Slovenian composer Jacobus Handl, the article argues that such music offered Prague's diverse citizens a medium for reflecting on how to live morally (...) and peaceably. Ultimately, this article challenges the commonplace that musical harmony offered an effective model for social harmony, arguing that the practice of singing together exposed the limits of tolerance even as it illuminated how difference might be accommodated. Emanuele Severino appartiene ormai a pieno titolo ai classici della filosofia; il presente volume vuole essere una testimonianza di come le sue opere e i suoi insegnamenti continuino a far “partorire” idee nuove, riconoscendo nella filosofia severiniana un punto di partenza imprescindibile. La presente investigación tuvo como objetivo realizar un análisis del procedimiento abreviado contemplado en el Código Orgánico Integral Penal (COIP), partiendo del criterio de que ciertos aspectos de este procedimiento vulneran derechos fundamentales del investigado. Se destaca particularmente el requisito para el procesado de admitir los hechos que se le imputan para acceder a este procedimiento, lo cual, según la opinión mayoritaria de doctrinarios, compromete el principio de no autoincriminación, la presunción de inocencia y el derecho a un juicio con (...) todas sus fases. El objetivo de esta investigación fue analizar el procedimiento abreviado establecido en el Código Orgánico Integral Penal (COIP), con el propósito de identificar posibles vulneraciones de derechos fundamentales del investigado. Se buscó específicamente evaluar cómo el requisito de admitir los hechos imputados para acceder a este procedimiento podría afectar principios como el de no autoincriminación y la presunción de inocencia. A través de un enfoque cualitativo y utilizando diferentes métodos de análisis, se procuró determinar si el procedimiento abreviado, tal como está configurado, garantiza un debido proceso conforme a los estándares de derechos humanos y constitucionales. La metodología aplicada se sustentó en un enfoque cualitativo, utilizando los métodos inductivo, analítico, sintético y exegético. Se llevó a cabo un análisis documental de la bibliografía relacionada con el tema investigado, así como de instrumentos internacionales de Derechos Humanos, la Constitución de la República de Ecuador, el COIP y jurisprudencia vinculada a la materia. Los resultados de la investigación determinaron que el procedimiento abreviado tal como se encuentra regulado en el COIP beneficia al Estado y al sistema de justicia al agilizar ciertos procesos legales. Sin embargo, se evidenció que este procedimiento puede vulnerar derechos esenciales del procesado, como el principio de no autoincriminación y la presunción de inocencia. Por lo tanto, se concluye que el procedimiento abreviado afecta el debido proceso al comprometer garantías fundamentales. La investigación señala que el procedimiento abreviado regulado en el COIP, si bien puede ser beneficioso para la eficiencia del sistema de justicia, también conlleva riesgos significativos de vulnerar derechos fundamentales del procesado. Por lo tanto, se destaca la necesidad de revisar y modificar este procedimiento para garantizar el respeto absoluto al debido proceso y a las garantías individuales del investigado. (shrink)

La tesis aborda uno de los temas centrales en la filosofía de la mente y las ciencias cognitivas: los conceptos como unidades básicas de la cognición humana. La tesis central que se defiende es que el contenido de los conceptos es determinado parcialmente por las comunidades a las que pertenecen los sujetos cognitivos, en la medida en la que dichas comunidades guían y constriñen las interacciones entre el sistema cognitivo conceptual y el entorno del que forma conceptos. La novedad de (...) la tesis es doble. Por una parte, cuestiona las teorías dominantes sobre el contenido de los conceptos —las teorías descriptivistas y las teorías naturalistas—, no solamente a partir de desafíos filosóficos que muestran sus limitaciones, sino también a partir de evidencia empírica sobre el efecto de las interacciones sociales en el contenido de los conceptos y, por tanto, en la cognición. Por otra parte, proporciona evidencia empírica sobre infantes ferales (i.e. niños salvajes), cuyo sistema cognitivo conceptual no ha recibido la guía de ninguna comunidad humana en sus interacciones con el entorno. Dicha evidencia permite sugerir que una explicación puramente naturalizada del contenido, sin la presencia de las comunidades, no puede explicar el desarrollo cognitivo conceptual de dichos infantes. Background This paper describes the design, implementation, and process outcomes from three public deliberations held in three tribal communities. Although increasingly used around the globe to address collective challenges, our study is among the first to adapt public deliberation for use with exclusively Indigenous populations. In question was how to design deliberations for tribal communities and whether this adapted model would achieve key deliberative goals and be well received.Methods We adapted democratic deliberation, an approach to stakeholder engagement, for use with (...) three tribal communities to respect tribal values and customs. Public deliberation convenes people from diverse backgrounds in reasoned reflection and dialogue in search of collective solutions. The deliberation planning process and design were informed by frameworks of enclave deliberation and community-based participatory research, which share key egalitarian values. The deliberations were collaboratively designed with tribal leadership and extensive partner input and involvement in the deliberations. Each deliberation posed different, locally relevant questions about genomic research, but used the same deliberation structure and measures to gauge the quality and experience of deliberation.Results A total of 52 individuals participated in the deliberations across all three sites. Deliberants were balanced in gender, spanned decades in age, and were diverse in educational attainment and exposure to health research. Overall, the deliberations were positively evaluated. Participant perceptions and external observer datasets depict three deliberations that offered intensive conversation experiences in which participants learned from one another, reported feeling respected and connected to one another, and endorsed this intensive form of engagement.Conclusion The adapted deliberations achieved key deliberative goals and were generally well received. Despite apparent political concern and action—often fuelled by high-profile cases and campaigns—legislative and institutional responses to image-based sexual abuse in the UK have been ad hoc, piecemeal and inconsistent. In practice, victim-survivors are being consistently failed: by the law, by the police and criminal justice system, by traditional and social media, website operators, and by their employers, universities and schools. Drawing on data from the first multi-jurisdictional study of the nature and harms of, and legal/policy responses to, image-based sexual abuse, (...) this article argues for a new joined-up approach that supports victim-survivors of image-based sexual abuse to ‘reclaim control’. It argues for a comprehensive, multi-layered, multi-institutional and multi-agency response, led by a government- and industry-funded online or e-safety organisation, which not only recognises the diversity of victim-survivor experiences and the intersection of image-based sexual abuse with other forms of sexual and gender-based violence and discrimination, but which also enables victim-survivors to reclaim control within and beyond the criminal justice system. Este ensayo propone una lectura de la VIII de las Tesis sobre la historia, de Benjamin que la “emplea”, en el sentido en que el propio Benjamin sostenía que una exposición materialista de la historia debía emplear los fragmentos del pasado para interrogar radicalmente el presente y resistir a las opresiones. Se pone en relación esta tesis con las palabras de las mujeres zapatistas, pronunciadas con motivo de la inauguración del Segundo encuentro internacional de mujeres que luchan, para argumentar que (...) el “estado de excepción” que Benjamin había advertido era en verdad la regla, lo sigue siendo hoy específicamente (aunque no únicamente) para las mujeres y otros cuerpos, individuales y colectivos, feminizados. Se argumenta también que la tradición de lucha de las mujeres indígenas producida por una colonialidad capitalista que sigue en curso es la que hoy nos muestra la normalidad del “estado de excepción” contemporáneo. Finalmente se propone que las luchas de las mujeres son, también, ejercicios críticos y prácticas de resistencia e invención, para una justicia por-venir. (shrink)

Our aim was to identify the ethical issues faced by students in the behavioral and natural sciences during their doctoral programmes. The participants were 28 PhD students who were interviewed about their doctoral study and supervision experiences. We identified a total of 102 ethical issues compromising the principles of nonmaleficence, beneficence, autonomy, justice, or fidelity. There were some differences in emphases, with the students in the behavioral sciences displaying a broader range of ethical compromises than the students in the natural (...) sciences. Ethical problems emerged in the individual supervisor–student relationships, but often problems involving the scholarly community appeared in the background. (shrink)

Through qualitative surveys, a team of law students, law professors, physicians, and residents explored the perceptions of neurology residents towards referral to appropriate legal resources in an academic training program. Respondents reported feeling uncomfortable screening their patients for health-harming legal needs, which many attributed to a lack of training in this area. These findings indicate that neurology residents would benefit from training on screening for social factors that may be impacting their patients’ health.

The study focused on university students' understanding and conceptions of ethical issues in research. Domain-specific and domain-transcending measures were developed to gauge the students' awareness of ethical issues. Responses were obtained from 269 undergraduate and graduate students at a U.S. regional university. Participant withdrawal, the debriefing of research participants, the dissemination of findings, and giving credit to co-contributors were the most challenging ethical issues for the students. Ethical awareness was predicted by professional and organizational socialization, and perspective taking. Contextualization greatly (...) improved the students' ability to recognize ethical issues. Simulations and role-taking are suggested as the means with which to teach students about the ethical issues perceived as challenging. (shrink)

The focus of this article is university teachers’ and students’ views of plagiarism, plagiarism detection, and the use of plagiarism detection software as learning support. The data were collected from teachers and students who participated in a pilot project to test plagiarism detection software at a major university in Finland. The data were analysed through factor analysis, T-tests and inductive content analysis. Three distinct reasons for plagiarism were identified: intentional, unintentional and contextual. The teachers did not utilise plagiarism detection to (...) support student learning to any great extent. We discuss the pedagogical implications and suggest that the contextual reasons for plagiarism require focus primarily on study strategies, whereas the intentional reasons require profound discussion about attitudes and conceptions of good learning and university-level study habits. Although there have been a growing number of studies focusing on dog welfare, the research field concerning dog positive emotion assessment remains mostly unexplored. This paper aims to provide a state-of-the-art review and summary of the scattered and disperse research on dog positive emotion assessment. The review notably details the current advancement in the dog positive emotion research, what approaches, measures, methods, and techniques have been implemented so far in emotion perception, processing, and response assessment. Moreover, we propose possible future (...) research directions for short-term emotion as well as longer-term emotional states assessment in dogs. The review ends by identifying and addressing some methodological limitations and by pointing out further methodological research needs. (shrink)

This study focuses on the intersection of research ethics and academic writing, i.e. the use of sources, assignment of credit to the contributors in the research, and the dissemination of research findings. The study utilized a set of semi-structured and open-ended questions. The sample consisted of 269 undergraduate (BA) and graduate (MA) students at a U.S. university department of psychology including major and non-major students. The data showed that although an overwhelming number of the students’ examples related to ethical issues (...) in citation dealt with plagiarism, a broad range of examples of other types of issues were also provided. Understandably, students tended to view the questions about both the assignment of credit to those involved in conducting the research and the dissemination of research findings from the research participant’s perspective, which is more familiar to them than the researcher perspective. In order to help the students to expand their notions beyond the immediate own experience to a broader understanding for the ethical principles that ought to guide a researcher in his or her work, it is desirable that students be provided with opportunities to participate in authentic research projects. With a deeper understanding of the students’ conceptions of ethics in research and academic writing, we can become more attuned to the common limitations and misconceptions that students harbor, and thus better equipped to support students in their learning process. : The main contribution of this paper to current philosophical and sociological studies on modeling is to analyze modeling as an object-oriented interdisciplinary activity and thus to bring new insights into the wide, heterogeneous discourse on tools, forms and organization of interdisciplinary research. A detailed analysis of interdisciplinarity in the making of models is presented, focusing on long-standing interdisciplinary collaboration between specialists in infectious diseases, mathematicians and computer scientists. The analysis introduces a novel way of studying the elements of the (...) models as carriers of interdisciplinarity. These elements, being functionally interdependent building blocks, evolve during the modeling work and carry the disciplinary tensions in the process. This shows how the long and challenging process of defining and reformulating the object of research is crucial for understanding the dynamics of interdisciplinarity in the making. (shrink)

This paper focuses on Confucian formulations of personhood and the implications they may have for bioethics and medical practice. We discuss how an appreciation of the Confucian concept of personhood can provide insights into the practice of informed consent and, in particular, the role of family members and physicians in medical decision-making in societies influenced by Confucian culture. We suggest that Western notions of informed consent appear ethically misguided when viewed from a Confucian perspective.

Previous research has established that the success of strikes, and social movements more broadly, depends on their ability to garner support from the public. However, there is scant published research investigating the response of the public to strike action by healthcare workers. In this study, we address this gap through a study of public responses to UK nursing strikes in 2022–2023, using a data set drawn from Twitter of more than 2300 publicly available tweets. We focus on negative tweets, investigating (...) which societal discourses social media users draw on to oppose strike action by nurses. Using a combination of corpus‐based approaches and discourse analysis, we identified five categories of opposition: (i) discourse discrediting nurses; (ii) discourse discrediting strikes by nurses; (iii) discourse on the National Health System; (iv) discourse about the fairness of strikers' demands and (v) discourse about potential harmful impact. Our findings show how social media users operationalise wider societal discourses about the nursing profession (e.g., associations with care, gender, vocation and sacrifice) as well as recent crises such as the Covid‐19 pandemic to justify their opposition. The results also provide valuable insights into misconceptions about nursing, strike action and patient harm, which can inform strategies for public communication. (shrink)

La primera ve en el populismo un peligro para la democracia y define su retórica como un recurso para engañar a las masas. La segunda considera el populismo como aquello que funda la democracia y a su retórica como el mecanismo que permite la articulación del pueblo. La discusión que se teje entre estas dos visiones del populismo (...) permitirá demostrar que el papel que en cada una de ellas juega el elemento retórico, determina la noción de democracia que sirve de supuesto a sus afirmaciones. Can one explain both the resilience of the status quo and the possibility for resistance from a subordinate position? This paper aims to resolve these seemingly incompatible perspectives. By extending Randall Collins's interaction ritual theory, and synthesizing it with Norbert Wiley's model of the self, this paper suggests how the emotional dynamics between people and within the self can explain social inertia as well as the possibility for resistance and change. Diverging from literature on the sociology of emotions that has (...) been concerned with individual emotional processes, this paper considers the collective level in order to explore how movement action is motivated. The emotional dynamics of subordinate positioning that limit women's options in face-to-face interactions are examined, as are the social processes of developing feminist consciousness and a willingness to participate in resistance work. Pointing toward empirical applications, I conclude by suggesting conditions where resistance is likely. (shrink)

The increasing concern about ethics and integrity in research communities has brought attention to how students and junior academics can be trained on this regard. Moreover, it is known that ethical behaviour and integrity not only involve individual but also group norms and considerations. Thus, through action research and participant observation, this research investigates the learning processes through which 64 students collaboratively develop research ethics and integrity competencies. The aim was to understand how bachelor, master and PhD students approach ethical (...) dilemma cases through a collaborative process. The data consisted of recorded group work on ethics cases, student group reports, and post-training questionnaires. Later, the analyses considered groups as the unit of analysis. These data were analysed through content analysis utilizing the SOLO taxonomy to identify levels of understanding and assess evolvement of ethical sensitivity during a case-based training session. The results show that all groups reached the level of understanding where the groups demonstrated that concepts had been understood appropriately, but occasionally struggled to make connections between them. Students perceived working collaboratively as beneficial. The results help teachers of research ethics and integrity to make pedagogically justified choices in their teaching. Drawing on the results of this study, we propose a tool for the formative assessment of student learning of research ethics and integrity. (shrink)

This reflection piece considers how expertise has been generated within the history of madness, disability, eugenics, psychiatry and anti-psychiatry. As numerous scholars and critics have pointed out, the power of rational argumentation can be persuasive, while its absence can be pathologized. Yet, in the fields of madness studies and critical disability studies we can see many examples of how the dividing line between normal and pathological states have been contested, especially where those categories correspond with notions of expertise, experience, and (...) insight. This short paper reflects on these themes and draws from a selection of research case studies, in the hopes of encouraging other scholars to take up these questions in their own work to destabilize concepts of expertise as fixed categories of ability and skill. Instead, I use these examples to promote a more complex and diverse way of interpreting expressions of dissent as potential forms of expertise. (shrink)

This open access book explores the gendered reality of learning philosophy at the university level, investigating the ways in which women and minority students become alienated from the social practices of a male-dominated field, and examining pedagogical solutions to this problem. It covers the roles and the interactions of the professor and student in the following ways: (1) the historical situation, (2) the affective, social and bodily situation, and (3) the moral situation. This text analyzes women’s passion for philosophy as (...) a quest for truth, as well as their partial alienation from the social practices of philosophy. It demonstrates that recognition, generosity, and care are central ingredients of good learning and teaching experiences. Providing case studies of experimental courses in philosophy, the book discusses a variety of pedagogical approaches that might increase the inclusiveness of a philosophical education: novel and more gender-balanced ways of interpreting the history of philosophy, problem-based learning as a means of emancipating the student from the traditional master–disciple relationship, body awareness practices as a way of challenging the “disembodying” tendencies of philosophy, and a pluralism of methods to address the needs of different kinds of learners. Thanks to these features, the book is particularly useful for philosophy professors at the university level, but it also provides insights for all readers who feel puzzled about the persistent underrepresentation of women in philosophy. This book deals with the impact of the Reformation debate in Germany on the most prominent intellectual movement of the time: humanism Although it is true that humanism influenced the course of the Reformation, says Erika Rummel, the dynamics of the relationship are better described by saying that humanism was co-opted, perhaps even exploited, in the religious debate.

An absolute decline in US life expectancy in low education whites has alarmed policy makers and attracted media attention. Depending on which studies are correct, low education white women have lost between 3 and 5 years of lifespan; men, between 6 months and 3 years. Although absolute declines in life expectancy are relatively rare, some commentators see the public alarm as reflecting a racist concern for white lives over black ones. How ought we ethically to evaluate this lifespan contraction in (...) low education whites? Should we care, or is it racist to care? Does it constitute an injustice or reflect justice being done? I argue that the lifespan contraction in low education whites violates key normative criteria used to make determinations of health justice, and that these judgments do not vitiate concerns about racism. I conclude with reflections on US population health policy and building an inclusive health equity movement. (shrink)

Toward the beginning of De magistro, Augustine and his son undertake a brief philosophical exercise using a line from Virgil’s Aeneid. That exercise seems to end in failure when father and son jokingly give up on their task. In this essay, I show that neither the selection of the particular line nor the failure of the exercise are accidental. I unpack the context of the Virgilian line, showing its resonance with Augustine’s own life, and I explain how the content of (...) the line stands as a challenge to the very argument Augustine seems to want to use it to make. On the basis of this analysis, I argue the dialogue is best read as a dramatization of a false idealization of words—an idealization Augustine hopes his son might be freed from. I conclude with the suggestion that interiority functions in the dialogue as a way of describing an intimate, shared space of meaning. (shrink)

En Infancia e historia Giorgio Agamben afirma que en la contemporaneidad asistimos a la “destrucción” de la capacidad para transmitir la experiencia. Ante esto, propone la idea de “infancia” entendida como una “experiencia originaria” en la que residiría la pura potencia del lenguaje. Esta idea presenta una serie de dificultades en tanto posibilidad concreta de volver a transmitir la experiencia ante su destrucción. Por lo tanto, el presente escrito indaga en otros conceptos de Agamben tales como el “montaje de temporalidades”, (...) el “paradigma” y el “testimonio”, conjeturando que allí se encuentran posibles claves para efectivamente volver a transmitir la experiencia. While philosophers generally agree that there can be no direct experience of the foreign consciousness, Simone de Beauvoir argues that literature makes it possible for us to enter the Other’s world. I will investigate the ways in which the position of the other and the position of the self-become one in the literary experience. Using phenomenology of the body as my point of departure, and analyzing the differences and convergences between verbal and literary communication acts, I will argue that the (...) text takes the place of the “inner speech” in the reading act. Consequently, the literary text acquires a kind of ownness, while it also appears as spoken by the other and having a reader-independent existence as a physical or electronic object. Literature does not provide us with the same possibilities of reciprocity, spatial perception and role-reversals as face-to-face encounters do; yet the very absence of the embodied other facilitates the adaption of his or her position and world as “one’s own”. We identify two processes by which humans increase genetic exchange among groups of individuals: by affecting the distribution of groups and dispersal patterns across a landscape, and by affecting interbreeding among sympatric or parapatric groups. Each of these processes might then have two different effects on biodiversity: changes in the number of taxa through merging or splitting of groups, and the extinction/extirpation of taxa through effects on fitness. We review the various ways in which humans are affecting genetic exchange, and (...) highlight the difficulties in predicting the impacts on biodiversity. Gene flow and hybridization are crucially important evolutionary forces influencing biodiversity. Humans alter natural patterns of genetic exchange in myriad ways, and these anthropogenic effects are likely to influence the genetic integrity of populations and species. Critics from a variety of camps have argued that bioethics has suffered an indifference to Cases have been described as thin and the selves inhabiting them hollow. This criticism has been driven at least in part by a reworked conception of the self. The rational and autonomous self that once dominated bioethics discourse has been replaced with a more self, a self embedded in stories, relationships, families, communities, cultures, and other particularitythese differences—matter. They matter because they figure importantly into our (...) ethical analyses of cases, affecting, for example, how we interact with and treat patients. And with this shift has come increasing attention to the processes of moral inquiry that enable inquirers to gather all of this moral information and find their way from complex cases to context-sensitive responses. This article describes research-based role-play on academic integrity. In the role-play, doctoral students negotiated the revision of an institutional integrity policy representing different groups of academics and students. On the one hand, role-play as a teaching method and learning activity demonstrated the difficulty of accommodating different perspectives; on the other, it showed the power and necessity of negotiation in matters that involve value judgments. The role-play is described in detail along with its underlying pedagogical foundations and its contextualisation in a (...) doctoral summer school where it took place. The purpose of the article is to describe how academic integrity was approached through role-play and to discuss theoretical and pedagogical foundations of role-play in teaching academic integrity. Although the article does not describe empirical research on role-play as a teaching method, it demonstrates how role-play in teaching academic integrity was developed based on prior research on the topic. It examines the power dynamics in the Italian publishing world from the perspective of a fiction writer. Writing and publishing are two completely different worlds that can be differently approached. What’s the point of writing? Should writers write about what they know, or about what they do not know? Can publishing be put off? What’s the role of literary agents (...) in the publishing process? Building energy models result from interdisciplinary expertise and collaboration. In order to understand this, models are best seen as narrative devices, capable of integrating various ingredients and to address both research questions and policy initiatives. Shipworth's account of models as sausage machines that can potentially mix ingredients challenges us to reevaluate the epistemological consequences of the use of models as interdisciplinary tools. Models tell stories to different audiences, and through stories, they integrate available expertise to highlight the key findings or (...) outcomes.Model building in applied fields functions both as a mode of knowledge production and as a tool to inform policy. Sex is probably the best example of stable biological variation within the human species. Scientists have tried to account for the origin of sex differences in biological terms using evolutionary theory. Although Charles Darwin derived his theories of natural and sexual selection with no consideration for sex, he assumed that the differences he observed in male and female human and animal behavior were variations related to biology. This chapter examines the link between sex and evolution by reflecting on the various (...) resonances between cultural and social norms one the one hand, and biological theory on the other. It first considers scientific explanations of women's nature, or womanhood as a subject of science, before turning to research on female choice and the animal/woman divide in the early twentieth century. The chapter also discusses the use of human and animal models of “natural” sexual behavior after World War II, sexual selection and biological determinism in the 1970s, and efforts to bridge the gap between feminism and evolutionary theory. The aim of this study was to investigate the consequences of the use of text-matching software on teachers’ and students’ conceptions of plagiarism and problems in academic writing. An electronic questionnaire included scale items, structured questions, and open-ended questions. The respondents were 85 teachers and 506 students in a large Finnish university. Methods of analysis included exploratory factor analysis, t-test, and inductive content analysis. Both teachers and students reported increased awareness of plagiarism and improvements in writing habits, as well as (...) concerns and limitations related to the system. The results suggest that teachers are inclined to think of plagiarism as part of a learning process rather an issue of morality, which may have consequences for how they understand the role of text matching. The introduction of text-matching software has supported teachers’ work, but at the same time teachers emphasized their own responsibility in detecting problems in student writing. The survey provides a limited sample of “Case Finland,” where implementation of text-matching software nationwide has been remarkably rapid; it offers a glimpse into one institution’s implementation of a newly introduced policy for mandatory plagiarism detection.
