Despite apparent political concern and action—often fuelled by high-profile cases and campaigns—legislative and institutional responses to image-based sexual abuse in the UK have been ad hoc, piecemeal and inconsistent. In practice, victim-survivors are being consistently failed: by the law, by the police and criminal justice system, by traditional and social media, website operators, and by their employers, universities and schools. Drawing on data from the first multi-jurisdictional study of the nature and harms of, and legal/policy responses to, image-based sexual abuse, (...) this article argues for a new joined-up approach that supports victim-survivors of image-based sexual abuse to ‘reclaim control’. It argues for a comprehensive, multi-layered, multi-institutional and multi-agency response, led by a government- and industry-funded online or e-safety organisation, which not only recognises the diversity of victim-survivor experiences and the intersection of image-based sexual abuse with other forms of sexual and gender-based violence and discrimination, but which also enables victim-survivors to reclaim control within and beyond the criminal justice system. Animal welfare science and ecology are both generally concerned with the lives of animals, however they differ in their objectives and scope; the former studies the welfare of animals considered ‘domestic’ and under the domain of humans, while the latter studies wild animals with respect to ecological processes. Each of these approaches addresses certain aspects of the lives of animals living in the world though neither, we argue, tells us important information about the welfare of wild animals. This paper argues (...) for the development of a new scientific discipline ‘welfare biology’ to address these issues and more, given the deficiencies of pre-existing life science disciplines to research the subject. Welfare biology is the study of the welfare of all living beings who have a welfare, with a value orientation toward promoting that welfare, regardless of the beings’ situation or relationship to humans and our activities. In this paper, we address several puzzles concerning speech acts,particularly indirect speech acts. We show how a formal semantictheory of discourse interpretation can be used to define speech actsand to avoid murky issues concerning the metaphysics of action. Weprovide a formally precise definition of indirect speech acts, includingthe subclass of so-called conventionalized indirect speech acts. Thisanalysis draws heavily on parallels between phenomena at the speechact level and the lexical level. First, we argue that, just as co-predicationshows that some words can (...) behave linguistically as if they're `simultaneously'of incompatible semantic types, certain speech acts behave this way too.Secondly, as Horn and Bayer (1984) and others have suggested, both thelexicon and speech acts are subject to a principle of blocking or ``preemptionby synonymy'': Conventionalized indirect speech acts can block their`paraphrases' from being interpreted as indirect speech acts, even ifthis interpretation is calculable from Gricean-style principles. The paper offers a new reading of the argument against poetry in Plato’s Republic 10. I argue that Socrates’ corruption charges rely on the tripartite theory of the soul, and that metaphysical doctrines play a role only in the first charge, which demonstrates that the poets are not qualified to teach by reducing tragic poetry to mimetic skill. This accusation clears the way for two corruption charges: the strengthening of appetite, and the softening of spirit (i.e., ‘the greatest charge’). Philosophy Lab: An Experiential Approach to Conceptual Analysis gives students the skills and strategies needed to do philosophical work in the Analytic tradition. They are presented with a step-by-step method for performing a preliminary conceptual analysis and practice examples to apply the method to standard philosophical problems. Students are introduced to the work of great thinkers including Descartes, Hobbes, Locke, Wittgenstein, and Ryle. These works are complemented by contemporary empirical findings concerning perception, desire, emotion, moral intuition, and other basic elements (...) of explicit intentional cognition. Each chapter features primary source material, commentary, and activity instructions. The activities are designed to allow students to experience each mode of cognition in relative isolation, and then to see how they combine and interrelate in more complex contexts. Finally, students use the template model of conceptual analysis to explore the material. They identify and isolate the concept to be analyzed, determine whether it is simple or complex, and if complex, identify the constituent parts of the concept. Specific topics covered include causal power, sex and marriage, compassion, ambition, justice, and death. Through presentation and modeling the book not only enables student to do conceptual analysis with precision, it helps them understand and interpret philosophical issues. Philosophy Lab is a comprehensive, carefully designed text for first courses in philosophy. It may be used with first-year undergraduate students, advanced high-school students, or adult learners. Deliberative democracy entails a commitment to deciding political questions on their merits. To that end, people engage in an exchange of reasons in a shared endeavour to arrive at the right answer or the best judgement they can make in the circumstances. Of course, in practice a shared judgement may be impossible to reach. Yet while compromise may seem a natural way of dealing with the disagreement that deliberation leaves unresolved – for example, some deliberative theorists argue that a willingness (...) to compromise manifests respect for the considered views of others, even as we continue to disagree with them – the relationship between deliberation and compromise is not as straightforward as one might think. To explain why, this paper contrasts conflicts of judgement with conflicts of preference, interest and value to show why greater attention needs to be paid to the character of the decision to be made. Comparisons have been made between the tobacco industry’s historic tactics in defending their products with the responses of some key actors in the sports world to head injuries. Both, it is said, have deployed deceptive marketing and advertising techniques to entice youth to engage with a subjective pleasure-producing product that has undeniable short- and long-term health detriments. Unlike what is called euphemistically, ‘Big Tobacco’, however, the National Football League (NFL) has evaded legal restrictions on the promotion of an inherently dangerous (...) product that targets youth. By contrast, in 1997, the Federal Trade Commission charged tobacco company R.J. Reynolds with violating federal law by using a cartoon character, Joe Camel, to allure children under age 18. The NFL has partnered with Nickelodeon to produce programs such as NFL Rush Zone and NFL Slimetime that targets youth by using cartoon mascots, bright colors, 3D iconography, and other child-friendly symbols. In addition to fostering positive associations between tackle football and cartoons, these broadcasts have explicitly minimized the risks of tackling. For example, one NFL Playoffs on Nickelodeon announcer equated a forceful head collision with a scrape of the knee that a child might experience during school recess. The NFL’s marketing strategies deflect public attention away from the risks of repetitive head collisions, concussions, traumatic brain injury (TBI), and chronic traumatic encephalopathy (CTE), portraying football as an appealing activity. The ongoing connections between the NFL and youth-oriented television programming raise crucial questions about how risk is communicated in a sport with inherent dangers of long-term cognitive damage. As long as tackle football is portrayed alongside beloved cartoon characters such as Spongebob Squarepants, impressionable children are likely to form undilutedly positive perceptions of the NFL and ignore the substantial risks of repeated, full-body collisions when enchanted by brightly-colored slime, animated bubbles, and goofy dance moves. This volume is about abstract objects and the ways we refer to them in natural language. Asher develops a semantical and metaphysical analysis of these entities in two stages. The first reflects the rich ontology of abstract objects necessitated by the forms of language in which we think and speak. A second level of analysis maps the ontology of natural language metaphysics onto a sparser domain--a more systematic realm of abstract objects that are fully analyzed. Popper conceived an experiment whose analysis led to a result that he deemed absurd. Popper wrote that his reasoning was based on the Copenhagen interpretation and therefore invalidated it. Many authors who have examined Popper's analysis have found in it various technical flaws which are briefly summarized here. However, the aim of the present article is not technical. My concern is to redress logical flaws in Popper's argument: the terminology he uses is ambiguous, his analysis involves counterfactual hypotheses, and it (...) violates Bohr's complementarity principle. Therefore, the absurdity of Popper's result only confirms Bohr's approach. (shrink)

“Metapolitics” is an ambiguous term. Recent philosophers have claimed the concept for neo-conservative, even right-wing agendas, while others have employed it to signal radical discontent with politics altogether. Beginning with Peter Viereck’s characterization of Nazi ideology as “Meta-Politics,” this essay works its way back from an “irrational,” “volkish,” and supposedly “conservative” concept to another use of “Metapolitics” as found in Martin Buber and Hermann Cohen that was rooted in a liberal tradition of the Enlightenment—especially in August Schlözer and Saul Ascher. (...) Both, Buber and Cohen, linked “metapolitical politics” to prophetic and theopolitical sensibilities. As such, the prophetic motif of turning loomed large at the center of their respective philosophies of nationalism. But it was a theme that also connected a wide range of thinkers, including Hans Kohn and Leo Baeck, and which emerged as a Leitmotiv of cultural and spiritual Zionism as well as of the modern Renaissance of Jewish culture. Drawing on Moritz Lazarus, the essay argues that the recurring trope of turning helped establish a paradoxical nationalism founded not upon self-empowerment and political othering but on self-criticism. Concluding with a brief excursion on Abraham Joshua Heschel’s prophetic politics in the Civil Rights Movement, the essay gestures towards the possibility of nationalism as collective introspection and self-reformation. The study of the feeling of knowing may have implications for some of the metatheoretical issues concerning consciousness and control. Assuming a distinction between information-based and experience-based metacognitive judgments, it is argued that the sheer phenomenological experience of knowing (''noetic feeling'') occupies a unique role in mediating between implicit-automatic processes, on the one hand, and explicit-controlled processes, on the other. Rather than reflecting direct access to memory traces, noetic feelings are based on inferential heuristics that operate implicitly and unintentionally. Once (...) such heuristics give rise to a conscious feeling that feeling can then affect controlled action. Examination of the cues that affect noetic feelings suggest that not only do these feelings inform controlled action, but they are also informed by feedback from the outcome of that action. (shrink)

Franz Rosenzweig’s Star of Redemption culminates in an aesthetic configuration of simultaneous presences: world, man, God, creation, revelation, and redemption are viewed in a metahistorical side-by-side, connected by the “factualizing power of the And.” But the idea of simultaneity, which is central to Rosenzweig’s configurative thinking, belongs to the historical imagination as much as it belongs to the theological “breaking through the shackles of time.” Rosenzweig’s “and” belongs to both a tradition of cosmic-aesthetic historicism and the philosophical reconstitution of time (...) as a simultaneous perception. In the co-presence of all historical moments, history’s hidden Gestalt, which only a people that is at once old and young can envision, connects the “and” of history with what Hegel considered history’s end—its ultimate self-recognition. Eternity, then, means neither flight from, nor resistance to, history’s naked fact, but the recognition of history’s Gestalt as an image that “does not tolerate epochs.”. (shrink)

In this essay I contrast Kant and Hegel on the so-called right of necessity, or distress. The contrast is significant because it summarizes succinctly the difference between their respective philosophies of right. Furthermore, I take the difference to indicate what in Hegel’s philosophy of right makes it preferable to Kant’s. In sum, the issue between the two is whether or not the concept of justice is determined in part by what I term in the paper the vicissitudes of making a (...) worthwhile living. (shrink)

This article briefly reviews concerns related to the “cultural colonialism” of applying Western biomedical models of research ethics to non-Western groups. The feasibility of alternate ethical models is discussed and found wanting. In practical terms, many academic researchers in the United States are funded by federal agencies and are required to adhere to Title 45, Part 46 of the Code of Federal Regulations , legislation that is clearly grounded in the Western biomedical research tradition. Consequently, the question is not whether (...) this system of ethics should be applied but rather how it can be applied most sensitively, appropriately, and wisely. This book explores the problem of moral metaphysics through investigations of four pivotal philosophers. It uses the contemporary idea of moral sentimentalism as a comparative category to explore the problems and challenges inherent in the project of moral metaphysics.

Martin Buber’s political thought has enjoyed renewed attention lately, particularly his concept of “theopolitics,” a type of political practice that recognizes God as the ultimate political authority. In Buber’s biblical exegesis, theopolitics is a condition of everyday life in premonarchical Israel, but following the installation of the monarchy, it becomes a specialized activity of prophets, consisting chiefly in divinely commanded intercession against state actions. Buber suggests that a version of this prophetic activity is manifest in present-day socialist cooperatives, especially the (...) kibbutzim. Indeed, for Buber, these cooperatives can be seen as laying the groundwork for messianic redemption. This essay probes some potentially troubling implications of Buber’s theopolitical framework, taking objections raised in Walter Benjamin’s correspondence as an entry point. A central concern for Benjamin is Buber’s nationalist articulation of Jewish identity, which appears all the more problematic when considered in tandem with the teleological view of history evident in Buber’s framework. The physicist not only observes phenomena, but he also has an active role in the formulation of some laws. For instance, laws involving irreversibility refer explicitly to what can or cannot be done by physicists. As the abilities of the latter may vary, we obtain sequences of laws, the convergence of which is discussed.

Sartre and Foucault were two of the most prominent and at times mutually antagonistic philosophical figures of the twentieth century. And nowhere are the antithetical natures of their existentialist and poststructuralist philosophies more apparent than in their disparate approaches to historical understanding. A history, thought Foucault, should be a kind of map, a comparative charting of structural transformations and displacements. But for Sartre, authentic historical understanding demanded a much more personal and committed narrative, a kind of interpretive diary of moral (...) choices and risks compelled by critical necessity and an exacting reality. Sartre's history, a rational history of individual lives and their intrinsic social worlds, was in essence immersed in biography. In Volume One of this authoritative two-volume work, Thomas R. Flynn conducts a pivotal and comprehensive reconstruction of Sartrean historical theory, and provocatively anticipates the Foucauldian counterpoint to come in Volume Two. (shrink)

This article is intended to emphasize several ethical issues relating to the activities of the internal auditor. The points of view expressed relate mainly to the public sector of Israel. Beyond the discussion of the specific issues against its unique Israeli background (Internal Audit Law), the discussion throws light on general problems that have not yet been solved.
