Many countries have implemented infection control measures directed at carriers of multidrug-resistant organisms. To explore the ethical implications of these measures, we analyzed 227 consultations about multidrug resistance and compared them with the literature on communicable disease in general. We found that control measures aimed at carriers have a range of negative implications. Although moral dilemmas seem similar to those encountered while implementing control measures for other infectious diseases, 4 distinct features stand out for carriage of multidrug-resistant organisms: carriage presents (...) itself as a state of being; carriage has limited relevance for the health of the carrier; carriage has little relevance outside healthcare settings; and antimicrobial resistance is a slowly evolving threat on which individual carriers have limited effect. These features are of ethical relevance because they influence the way we traditionally think about infectious disease control and urge us to pay more attention to the personal experience of the individual carrier. I discuss the knowledge account of legal proof in Moss (2023) and develop an alternative. The unifying thread throughout this article are reflections on the beyond reasonable doubt (BRD) standard of proof. In Section 1, I will introduce the details of Moss’s account and how she motivates it via the BRD standard. In Section 2, I will argue that there are important disanalogies between BRD and knowledge that undermine Moss’s argument. There is however another motivation for the knowledge account: combined (...) with auxiliary claims, that is probabilistic knowledge and moral encroachment, it can provide a general solution to the puzzle of statistical evidence. Section 3 spells out the details. In Section 4, I suggest to combine the knowledge account with pragmatic encroachment, instead of moral encroachment, in order to stay clear of the thorny issues whether corporations have moral rights. In Section 5, I argue that the verdicts of Moss’s account in cases of false justified beliefs and non-luminous knowledge conflict with the BRD standard and thus call for abandoning the account. Based on the social function of the BRD standard, I suggest a replacement for the knowledge account that is also just as potent as a general solution for the puzzle of statistical evidence. While I will grant that knowledge is neither always necessary nor always sufficient for convictions, I will argue that the concept of knowledge nonetheless plays a significant and ineliminable role in legal decision-making. For both continental and analytic styles of philosophy, the thought of Martin Heidegger must be counted as one of the most important influences in contemporary philosophy. ArgumentIn 1877, a young mathematician named Joseph Boussinesq presented amémoireto theAcadémiedes sciences which demonstrated that some differential equations may have more than one solution. Boussinesq linked this fact to indeterminism and to a possible solution to the free will versus determinism debate. Boussinesq's main interest was to reconcile his philosophical and religious views with science by showing that matter and motion do not suffice to explain all there is in the world. His argument received mixed criticism that addressed both his (...) philosophical views and the scientific content of his work, pointing to the physical “realisticness” of multiple solutions. While Boussinesq proved to be able to face the philosophical criticism, the scientific objections became a serious problem, thus slowly moving the focus of the debate from the philosophical plane to the scientific one. This change of perspective implied a wide discussion on topics such as instability, the sensitivity to initial conditions, and the conservation of energy. The Boussinesq debate is an example of a philosophically motivated debate that transforms into a scientific one, an example of the influence of philosophy on the development of science. (shrink)

The act of drawing a line or uttering a word is often seen as integral to the process of making art. This is especially obvious in music and the visual arts, but applies to literature, performance, and other arts as well. The development of artificial intelligence (AI) in medicine raises fundamental ethical issues. As one example, AI systems in the field of mental health successfully detect signs of mental disorders, such as depression, by using data from social media. These AI depression detectors (AIDDs) identify users who are at risk of depression prior to any contact with the healthcare system. The article focuses on the ethical implications of AIDDs regarding affected users’ health-related autonomy. Firstly, it presents the (ethical) discussion of AI (...) in medicine and, specifically, in mental health. Secondly, two models of AIDDs using social media data and different usage scenarios are introduced. Thirdly, the concept of patient autonomy, according to Beauchamp and Childress, is critically discussed. Since this concept does not encompass the specific challenges linked with the digital context of AIDDs in social media sufficiently, the current analysis suggests, finally, an extended concept of health-related digital autonomy. This article argues that the limited influence of Ludwik Fleck's ideas on philosophy of science is due not only to their indirect dissemination by way of Thomas Kuhn, but also to an incommensurability between the standard conceptual framework of history and philosophy of science and Fleck's own more integratedly historico-social and praxis-oriented approach to understanding the evolution of scientific discovery. What Kuhn named "paradigm" offers a periphrastic rendering or oblique translation of Fleck's Denkstil/Denkkollektiv , a derivation that may also account (...) for the lability of the term "paradigm". This was due not to Kuhn's unwillingness to credit Fleck but rather to the cold war political circumstances surrounding the writing of The Structure of Scientific Revolutions . Following a discussion of Fleck's anatomical allusions, I include a brief discussion of Aristotle (on menstruation and darkened mirrors) and conclude with a reference to the productivity of error in Mach and Nietzsche. Beginning with a reflection on ‘conceptual schemes’ and ‘very’ ideas and proceeding to examine different approaches to thinking philosophy of science not only with Kant but also between traditional analytic and hermeneutico-phenomenological approaches, this essay features a review of Kant’s 1755 solar nebular hypothesis and a reading of Nietzsche and Kant on cosmology along with a reflection on chemistry and the properties of cinnabar. Overall it is argued that a philosophy of science must be critical rather than normative/prescriptive. What is the cash value of Richard Rorty’s philosophy and politics of religion? This paper analyzes the political promise of Rorty’s shift from atheism to anticlericalism in the last decade of his life. It seeks to deliver primarily a concise summary of this shift, and of its transformative motivation. Then a critique of this shift is followed by the suggestion of a friendly amendment: its extension towards a pragmatic pluralism. The outlined Rortyan conception of a serene, and, at the same (...) time robust, politics of religion is proposed as a promising answer to the question of how secular liberal citizens should react to the “return of the gods.”. State governments provide preprinted advance directive forms to the general public. However, many adults in the United States (US) lack the skills necessary to read and comprehend health care-related materials. In this study, we sought to determine the readability of state government-sponsored advance directive forms.

Despite its enduring insights, Durkheim’s theory of suicide fails to account for a significant set of cases because of its overreliance on structural forces to the detriment of other possible factors. In this paper, we develop a new theoretical framework for thinking about the role of culture in vulnerability to suicide. We argue that by focusing on the cultural dynamics of excessive regulation, particularly at the meso level, a more robust sociological model for suicide could be offered that supplements structure-heavy (...) Durkheimian theory. In essence, we argue that the relevance of cultural regulation to suicide rests on the (1) degree to which culture is coherent in sociocultural places, (2) existence of directives related to prescribing or proscribing suicide, (3) degree to which these directives translate into internalized meanings affecting social psychological processes, and (4) degree to which the social space is bounded. We then illustrate how our new theory provides useful insights into three cases of suicide largely neglected within sociology: specifically, suicide clusters in high schools, suicide in the military, and suicides of “despair” among middle-aged white men. We conclude with implications for future sociological research on suicide and suicide prevention. (shrink)

This paper contributes to the (re-)conceptualisation of responsible innovation by proposing an evolutionary economic approach that focuses on the role of consumers in the innovation process. After a discussion of the philosophical foundations and ethical implications of this approach, which bears an explanatory potential that has not been adequately considered in previous discussions of responsible innovation, we present a first step towards capturing the important but often neglected role of consumers in innovation processes (including responsible innovation): We propose an agent-based (...) model that incorporates a multidimensional space of characteristics in which new products or services are represented by more than the mere aspect of price and quality. Instead, innovations are denoted by a large set of characteristics, including also negative or harmful ones. The model is used to illustrate that consumers’ heterogeneity and bounded rationality – even if considered in a simple manner – indeed play a crucial role in the creation and diffusion of responsible innovation which can and should be used for further work in this field and for possible extensions of the model. The coronavirus disease 2019 has been causing major disruptions in the sporting world. Negative physiological and psychological effects on athletes have been reported, such as respiratory issues and increased stress. Therefore, it is timely to support this population by presenting cost-effective and accessible intervention techniques to reduce this impact. Slow-paced breathing has the potential to counteract many of the detrimental effects of COVID-19 that can directly affect sports performance. In this article, we present and justify the use of SPB in (...) athletes by focusing on three key outcomes, namely aerobic endurance performance, emotional well-being, and sleep quality. We examine the physiological mechanisms that underpin these three outcomes and review literature showing that SPB can activate anti-inflammatory pathways, increase lung capacity and, in turn, improve aerobic endurance, emotional well-being, and sleep quality. We conclude that interventions using SPB can have preventive and rehabilitative properties for athletes. Future studies should empirically test the potential of SPB to help this specific population. Le volume "Images de Platon et lectures de ses oeuvres" rassemble vingt et une contributions consacrees a diverses relectures qui ont ete faites de l'oeuvre ecrite de Platon entre le IIIe siecle (Diogene Laerce, Plotin) et le XXe sievle (K. Popper). Dans l'introduction, Ada Neschke met en lumiere le cheminement de ces relectures et souligne le fait que les lectures de Platon sont constamment alimentees par des preoccupations propres a ses lecteurs. Dans un premier temps, l'oeuvre de Platon est integree (...) dans une optique essentiellement theologique; apres l'avenement du kantisme, elle s'inscrit dans un cadre de pensee qui se veut critique et philosophique, c'est-a-dire emancipe de l'ancienne metaphysique. Ainsi, l'oeuvre de Platon represente, d'une part, pour les penseurs chretiens une source d'inspiration concernant les sujets les plus divers: la theologie chretienne (Clement d'Alexandrie, Ficin, les Platoniciens de Cambridge), la mytho-theologie neo-platonicienne (Plethon), l'iconographie de la trinite (Francisco di Hollanda), la politique catholique et le calviniste (Jean Bodin, Jean de Serres), le scepticisme face aux debats theologiques (Montaigne). D'autre part, Platon a la valeur d'une autorite pour les penseurs postkantiens, que ce soit pour construire une philosophie de la nature (Schelling), une ethique (Hegel), une epistemologie (les neo-kantiens Cohen et Natorp) ou encore une ontologie (Heidegger). Enfin, Platon sert de reference dans les debats politiques modernes et contemporains, en particulier dans les discussions sur le liberalisme (J. St. Mill) et le totalitarisme (Popper et ses successeurs). De l'antiquite jusqu'a nos jours, Platon reste donc un auteur qui interpelle son lecteur et lui lance meme souvent un defi. (shrink)

Betegh) mettent en relief des moments importants de la reception du "Timee", les contributions de W. Rod, K. Gloy et L. Brisson permettent de comparer globalement la vision antique et (...) moderne de la cosmologie et en particulier des mathematiques. Le volume s'ouvre par un essai d'A. Neschke presentant une comprehension actuelle du Timee comme contribution a la physique grecque. Neschke-Hentschke, nee a Berlin en 1942, enseigne actuellement la philosophie antique et l'histoire de la philosophie a l'Universite de Lausanne. Ses recherches portent en particulier sur Platon et sa reception. En temoignent, a part de nombreux articles, les deux volumes parus dans la meme collection: Images de Platon et lectures de ses oeuvres et Platonisme politique et theorie du droit naturel, vol. 1. La justice est-elle une illusion? Si tel etait le cas, que penser de l'Etat de droit contemporain, lui qui resulte d'une longue et continuelle recherche de la justice par les penseurs occidentaux? Avec Platon, la philosophie occidentale a en effet debute sa longue quete d'un modele pour batir la cite. Le modele de Platon, la justice transcendante ou naturelle (to; fuvsei divkaion), fut accueilli a Rome par Ciceron. Cette phase inaugurale de l'histoire de la philosophie politique occidentale est etudiee dans (...) le premier volume de cette etude: Platonisme politique et theorie du droit naturel. Contributions a une archeologie de la culture politique europeenne. Le platonisme dans l'antiquite, Louvain-Paris, Ed. Peeters, 1995. Le present volume etudie la reception chretienne de la doctrine de Platon, du Veme au XVIIeme siecle. Le lecteur rencontrera d'abord Augustin d'Hippone: l'eveque accueille, puis rejette la theorie platonicienne. Durant le Moyen Age latin, les juristes et le theologien Thomas d'Aquin assoient solidement cette doctrine dans la pensee chretienne en s'opposant a l'augustinisme religieux. De la Renaissance au XVIIeme siecle, Marsile Ficin, Jean Bodin, Jean de Serres, Francisco Suarez, Hugo Grotius, Samuel Pufendorf et John Locke retravaillent encore la notion platonico-chretienne de justice: contre le volontarisme, la pensee theocratique, puis la doctrine de Thomas Hobbes au XVIIeme siecle, cette tradition philosophique met la justice naturelle au fondement de la republique. Au bout de cette histoire se profilent les premieres declarations des Droits de l'homme, que cet etude envisage dans le sillage du platonisme politique et de l'un de ses heritiers majeurs, John Locke. Cette etude retrace pour la premiere fois la reception de Platon considere comme un penseur politique. Elle ouvre de fait une nouvelle perspective dans l'histoire de la philosophie politique. Elle corrige enfin les histoires anterieures du jusnaturalisme chretien, dans la mesure ou celles-ci ignoraient l'impact de la pensee platonicienne. Günther Anders offers one of the first phenomenological analyses of broadcast radio and its transformation of the contemporary experience of music. Anders also develops a reflection on its political consequences as he continues his reflection in a discussion of radio and newsreel, film and television in his 1956 ‘The World as Phantom and Matrix’. A reflection on the consequences of this transformation brings in Friedrich Kittler’s reflection on radio and precision bombing. A further reflection on Jean Baudrillard’s notion of ‘speech (...) without response’ permits a review of digital culture and the self-creation of the digital consumer absorbed in what Anders named a schizo-topia, that is, today, an autistic culture of distraction, displacement, and self-driven surveillance. Resumen: En La actualidad de lo bello, Gadamer hace una referencia reveladora a la improvisación musical y a la importancia de la escucha musical, además de poner en primer plano la necesidad de justificación del arte. Situando este debate a través de Goethe y Platón, junto con las Lecciones de Estética de Adorno de finales de la década de 1950 y una discusión sobre Nietzsche y la Antigüedad, es posible establecer que lo que está en juego es la afinación, así (...) como una tensión que invita a un debate ulterior tanto sobre la detención del amante en Carson como el demorarse en Heidegger. Al revisar la hermenéutica gadameriana de la programación y la interpretación musical, incluida la improvisación y el desafío de la nueva música, las reflexiones de Gadamer sobre la cultura musical en el contexto de la cultura social y su reflexión no solo pueden ser leídas a través de Platón y Goethe, sino también a partir de las concepciones de "lo bello" en Hölderlin y Rilke. Se trata de una "conversación" cultural en la que la contribución del público puede estar en tensión con la programación musical progresiva, además de la dinámica de respuesta que surge en la energeia de la improvisación tanto para el intérprete como para el oyente.// Abstract: Gadamer’s On the Relevance of the Beautiful makes telling reference to musi-cal improvisation and the importance of musical listening in addition to fore-grounding the need for justification. Situating this discussion via Goethe and Plato along with Adorno’s late 1950s lectures on Aesthetics together with a discussion of Nietzsche and antiquity, what is at stake is attunement and a tension which invites a discussion of Carson on the lover’s arrest and Heidegger on tarrying. By reviewing Gadamer’s hermeneutic of musical pro-gramming and performance, including improvisation and the challenge of new music, Gadamer may be read on music culture in the context of social culture and his reflection not only via Plato and Goethe but Hölderlin and Rilke on ‘the beautiful.’ At work is a cultural ‘conversation’ where audience input can be in tension with progressive musical programing along with the dynamic of response emergent in the energeia of improvisation for performer and listener. What Ivan Illich regarded in his Medical Nemesis as the ‘expropriation of health’ takes place on the surfaces and in the spaces of the screens all around us, including our cell phones but also the patient monitors and (increasingly) the iPads that intervene between nurse and patient. To explore what Illich called the ‘age of the show’, this essay uses film examples, like Creed and the controversial documentary Vaxxed, and the television series Nurse Jackie. Rocky’s cancer in his last film (...) (submitting to chemo to ‘fight’ cancer) highlights what Illich along with Petr Skrabanek called the ‘expropriation of death’. In contrast to what Illich denotes as ‘Umsonstigkeit’ – i.e., a free gift, given undeservedly, i.e., gratuitously – medical science tends to be tempted by what Illich terms scientistic ‘black magic’, taking over (expropriating) the life and the death of the patient in increasingly technological ways, a point underscored in the concluding section on the commercial prospects of xenotransplants using factory farm or mass-produced (and already for some time) human-pig mosaics or chimeras. Gunter Anders' Philosophy of Technology is the first comprehensive exploration of the ground-breaking work of German thinker Gunter Anders. Anders' philosophy has become increasingly prescient in our digitised, technological age as his work predicts the prevalence of social media, ubiquitous surveillance and the turn to big data. Anders' ouevre also explored the technologies of nuclear power and the biotech concerns for the human and transhuman condition which have become so central to current theory.
