The Common Foreign and Security Policy (CFSP) objectives are an integral part of the overall objectives of the European Union and the policy area has developed from a purely intergovernmental form of cooperation in the days of the European political cooperation to an area in which the member states have increasingly accepted new forms of institutionalization. CFSP decisions are taken by the General Affairs Council, consisting of the ministers for foreign affairs of the member states. In (...) spite of the growing pains in the development of Common Security and Defence Policy (CSDP), the European Union has made significant strides in deploying crisis management operations. However, the issue of defining success of the CSDP is no longer measured in terms of merely launching missions, ensuring mission output, and gathering operational experience. Although the Lisbon Treaty maintained the general exclusion of Common Foreign and Security Policy (CFSP) matters from ECJ jurisdiction, it introduced a number of changes into this area, including an explicit statement that the Court is competent to review the legality of the Council decisions imposing restraining measures on persons. The article analyzes the nature and origin of those changes and considers the legal implications for the level of the protection of fundamental rights in the European Union. (...) For this purpose the author firstly considers the context of the exclusion of CFSP matters from the ECJ jurisdiction, including discussions on the issue at the European Convention, and, secondly, takes a closer look at the separate heads of jurisdiction over which the Court is competent to act after the entry into force of the Lisbon Treaty. A conclusion is made that the Lisbon Treaty did not introduce significant changes to ECJ jurisdiction. Similarly to the pattern of previous amendment treaties, the Lisbon Treaty again gave recognition to the practice of the ECJ on relevant questions. Nonetheless, the amendments made by the Lisbon Treaty should be welcome for introducing more clarity into the legal regulation of the matter, thus boosting the legal certainty and protection of fundamental rights in the European Union. Luck egalitarianism assigns a central role to personal responsibility in egalitarian justice. In the context of healthcare, luck egalitarianism is the view that the distribution of medical and healthcare resources—or common resources in general—should respond to the (im)prudence of individuals. Recently, Joar Björk, Gert Helgesson, and Niklas Juth have argued that it is impractical to use luck egalitarianism as a normative framework in healthcare because it has no reasonable way of dealing with the imprudent. In response to their argument, (...) this paper first suggests that the epistemic problems of applying luck egalitarianism to the healthcare context raised by Björk et al. can be circumvented by using the exemption system as a policy application of luck egalitarian healthcare justice. This paper then shows that an _ex ante_ policy, a tax system with refunds, can reasonably be adopted as a luck egalitarian institutional design of healthcare policy. We argue that the proposed conception of luck egalitarianism can deal with the problem of differential option luck. Finally, we show that the threshold problem for the definition of imprudence does not refute the proposed _ex ante_ policy. (shrink)

If one of the lessons of the ubiquitous and highly problematic ticking bomb scenario is that torture may be justified under certain narrowly specified situations, why would we not want it made available as a weapon in the government’s anti-terrorist activities? This is not a new question. It has been hotly debated, and a number of arguments have been made against the idea of formulating the torture policy on the basis of the ticking-bomb hypothetical. The question that this Essay (...) addresses is related but narrower: if one starts from the proposition that the ticking bomb scenario demonstrates that a government official facing prosecution for torture may have available the necessity defense, what implications, if any, should the government be able to draw from the existence of the defense as it formulates its torture policy? This Essay discusses, and rejects, one common answer to this question—that the nature of the necessity defense is such that it can generate no forward-looking prescriptions. This Essay then advances a new argument on the basis of the nature and function of the necessity defense as not only spelling out morally permissible instances of harm infliction but also effecting a division of power between the state and citizens. There is no more important question in thinking about life-and actually living-in political community than whether it is to be permeated by, and purposefully oriented around, the main truths about human flourishing. It is at least paradoxical that, precisely when the state and its law and political life are shaping people's lives more and more, the professed roots of all this influence are growing thinner, more shallow. Lawmakers who profess and in many cases even think they should be "neutral" about (...) values are more involved with how persons' lives go than, perhaps, ever before. Of course, any community which has lost faith in the truth about human wellbeing is going to be quite befuddled by the question. But the perennial centrality of the question about truth and politics can be obscured for understandable reasons. One is the immediate urgency of so many practical challenges, such as settling the defense or state budget, protecting against terrorist attack, or deciding what to do about a nuclear-armed North Korea. Attention to the fundamental question is attenuated, too, by focus upon diffuse problems which affect nearly everyone daily, such as getting good healthcare coverage or creating jobs. Significant public debates about moral issues affecting policy are still common. But they tend to be episodic, and wary of getting down to foundations. When Americans argue today about immigration policy and capital punishment, for instance, they rely upon profound ethical beliefs. All too often, however, they link these commitments not to the objective moral truth at the heart of the matter, but instead to past practices, or to communal identity as a matter of fact who we are!"). The starting point of my study is Kant’s remark to the effect that Garve in his treatise on the connection between morality and politics presents arguments in defence of unjust principles. Recognition of these principles is, according to Kant, an inadvisable concession to those who are inclined to abuse it. I interpret this judgement by making a detailed comparison of the texts of the two treatises. I demonstrate that Garve’s work is an eclectic attempt to combine in one concept (...) the lessons of historical experience with the ideas drawn from British empiricism and German rationalism. These ideas were criticised by Kant in his “critical” period. There is a consensus among researchers that Garve condoned the expansionist policy of Frederick II of Prussia, totally denied that legality in international relations was possible and in general deserved the reputation of an conservative. From that point of view the key values for Garve were the security and well-being of the state. I offer an alternative interpretation of Garve’s position because I believe that the value of political stability plays an important role in it. Such an interpretation makes it possible to treat Garve’s narrative as it was assessed by Kant, i.e. as a concession to the common principles of political practice as a result of a failure to find the guiding theory. My study has established that the role of Garve’s work in the writing of Kant’s treatise Toward Perpetual Peace was more significant than Kant’s own words suggest. Besides, I show that it was under Garve’s influence that Kant turned to the problem of excessive complexity of the principles involved in the search for concrete political decisions. Garve obviously laments this complexity and yet makes these principles still more complex. Kant offers a simpler solution of the problem on the basis of his theory of morals and right. (shrink)

European integration has increased to encompass security-related policies. One such policy is defense industry policy, which traditionally has been a national concern rooted in defense and security policy. Efforts have been made since the 1990s to create a European defense industry market. However, there have been different ideas of how this goal should be achieved or which model for state—industry relations the market should rest on. Using Sweden to illustrate the development, this article argues that (...) for the Europeanization of defense industry policy, marketization has played a vital role. Building on official documents and interviews, the article analyzes the efforts to create a European defense industry market, marketization of Swedish defense industry policy, and the increased interaction between Swedish and European defense industry policy processes. It is now generally recognized that Earth is at risk of a devastating collision with an asteroid or a comet. Impressive strides in our understanding of this threat have been made in recent decades, and various efforts to deal with it have been undertaken. However, the pace of government action hasn’t kept up with the advance of our knowledge. Despite the daunting dimensions of planetary defense, one intrepid NGO has stepped up to the plate: The B612 Foundation has embarked on (...) a half-billion-dollar project, called Sentinel, to map the estimated one million near-Earth objects that could wipe out a city or even end civilization. This article offers an explanation of how it came to be that private citizens have assumed what is arguably government’s primary mandate to "provide for the common defence." It then examines some of the practical – or, if you will, ethical – risks that may be attendant on such a shift of responsibility. Finally, a new policy emphasis is proposed. (shrink)

This essay seeks to characterise the essential features of an equitable health care system in terms of the classical Aristotelian concepts of horizontal and vertical equity, the common language of “need” and the economic notion of cost-effectiveness as a prelude to identifying some of the more important issues of value that policy-makers will have to decide for themselves; the characteristics of health that can cause policy to be ineffective ; the information base that is required to support (...) a policy directed at securing greater equity, and the kinds of research that are needed to underpin such a policy. Food security policy, programs, and infrastructure have been incorporated into Public Health and other areas of the Provincial Government in British Columbia, including the adoption of food security as a Public Health Core Program. A policy analysis of the integration into Public Health is completed by merging findings from 48 key informant interviews conducted with government, civil society, and food supply chain representatives involved in the initiatives along with relevant documents and participant/direct observations. The paper then (...) examines the results within the context of historic and international trends and theoretical models of food policy, community food security, and applied policy research. Public Health re-emerged as a driver of food security in BC—both as a key player and in positing the public’s health as a driver in food security and food systems. While Public Health’s lead role supported an increase in legitimacy for food security in BC, interviewees described a clash of cultures between Public Health and civil society. The clash of cultures occurred partly as a result of Public Health’s limited food security mandate and top down approach. Consequently civil society voice at the provincial level was marginalized. A social policy movement toward a new political paradigm—regulatory pluralism—calls for greater engagement of civil society, and for all sectors to work together toward common goals. A new, emerging policy map is proposed for analyzing the dynamics of food security and health promotion initiatives in BC. (shrink)

In “Ethics and the Underpinnings of Policy in Biodefense and Emergency Preparedness,” Lisa Eckenwiler advances discussion about emergency preparedness by exploring ethical commitments that shape healthcare and defense policy in an age of terrorism. Eckenwiler rightly discerns that policymakers' assumptions about controlling and containing hostile malefactors and the need for public consent regarding security measures are part of an epistemic framework that orders the current response to terrorism. Again rightly, she suggests that citizens ought to have a (...) say in shaping and interpreting such fundamental assumptions, a reductive medical model that focuses on mitigation and the management of casualties is insufficient for understanding and responding to the complex social, political, and economic factors that precipitate terrorist attacks, and there is in emergency preparedness an ethically problematic disproportion between the demands society places on public health/medical professionals and the resources society provides for them to meet these demands. She is also probably correct in claiming that, properly understood, the ethical underpinnings of public health policy are teleological in nature. (shrink)

Before military action, and even before mobilization, the decision on whether to go to war is debated by politicians, pundits, and the public. As they address the right or wrong of such action, it is also a time when, in the language of the just war tradition, the wise would deeply investigate their true claim to jus ad bellum (“the right of war”). Wars have negative consequences, not the least impinging on human life, and offer infrequent and uncertain benefits, yet (...) war is part of the human condition. James G. Murphy’s insightful analysis of the jus ad bellum criteria—competent authority, just cause, right intention, probability of success, last resort, and proportionality—is grounded in a variety of contemporary examples from World War I through Vietnam, the "soccer war" between Honduras and El Salvador, Afghanistan, and the Middle East conflict. Murphy argues persuasively that understanding jus ad bellum requires a primary focus on the international common good and the good of peace. Only secondarily should the argument about going to war hinge on the right of self-defense; in fact, pursuing the common good requires political action, given that peace is not simply the absence of violence. He moves on to demonstrate the interconnectedness of the jus ad bellum criteria, contending that some criteria depend logically on others—and that competent authority, not just cause, is ultimately the most significant criterion in an analysis of going to war. It also tests the outer limits of the ethical deployment of power. I. Types of Wars The Jewish ethics of war focuses on two issues: its legitimation and its conduct. The Talmud classifies wars according to their source oflegitimation. Biblically mandated wars are (...) termed mandatory (milhemet mitzvah or milhemet hovah). Wars undertaken at the discretion of the Sanhédrin are termed discretionary (milhemet reshut). There are three types of mandatory wars: Joshua's war of conquest againstthe seven Canaanite nations, the war againstAmaleq, anddefensive wars against an already launched attack. Discretionary wars are usually expansionary efforts undertaken to enhance the political prestige of the government or to secure economic gain. The first type of mandatory war is only of historical interest as the Canaanite nations lost their national identity already in ancient times. This ruling, which appears repeatedly in rabbinic literature, is part ofa tendency to blunt the impact of the seven-nations policy. The Bible points out that these policies were not implemented even during the zenith of ancient Israel's power (Kings 9:20; 2 Chr 8:7-9; see also Judges 1:21-33, Ps 106:34). Indeed, an ancient Midrash explicitly excludes the possibility of transferring the seven-nations ruling to other non-Jewish residents of the Land ofIsrael. Maimonides is just as explicit in emphasizing that all trace 44Reuven Kimmelman of them has vanished. By limiting the jurisdiction of the seven-nations ruling to the conditions ofancient Canaan it was effectively removed from the postbiblical ethical agendaand vitiated as aprecedent forcontemporary practice. The second category ofmandatory war, against Amaleq, has also been rendered operationally defunct by comparing them with the Canaanites, or by postponing the battle to the immediate premessianic struggle, or by viewing them as a metaphor for genocidal evil. The two remaining categories, reactive defensive wars (which are classified as mandatory) and expansionary wars (which are classified as discretionary) remain intact. So, for example, King David's response to the Philistine attackaredesignated mandatory, whereashis wars "to expandthe border of Israel" are designated discretionary. Intermediate wars such as preventive, anticipatory, or preemptive defy so neat a classification. Not only are the classifications debated in the Talmud, but commentators disagree on the categorization of the differing positions in the Talmud. The major clash occurs between the eleventh century Franco-German scholar Rashi and the thirteenth century Franco-Provencal scholar Meiri. According to Rashi, the majority position considers preemptive action to be discretionary whereas the minority position expounded by Rabbi Judah considers it to be mandatory. According to Meiri, a preemptive strike, against an enemy who it is feared might attack or who is already known to be preparing for war is deemed mandatory by the majority ofthe rabbis, but discretionaryby Rabbi Judah. Accordingly, Rabbi Judah defines a counterattack as mandatory only in response to an already launched attack. A similar reading of Maimonides also limits the mandatory classification to a defensive war launched in response to an attack. With these distinctions between mandatory and discretionary wars in mind, we should be able to investigate the Jewish concerns with the problematics ofwarby focusing on preemptive strikes, declarations ofwar, ethics of warfare, and draftability. II. Preemptive Strikes as Self-Defense Not only Machiavellians view the security and survival ofthe state as nonnegotiable. National self-defense is as much amoral right as is personal self-preservation. Whereas it is clear that offensive war cannot be subsumed under the inalienable right of self-defense, the moral status of pre-emptive attacks is not as clear. Is the moral category of self-defense Working Warfare and Its Restrictions in the Jewish Tradition 45 limited to an already launched attack? The majority talmudic position, according to Rashi, and that of Rabbi Judah, according to Meiri, would answer in the affirmative. Their position is seconded by Article 51 of the United Nations Charter, which states: "Nothing in the present Charter shall impair the inherentright ofindividual ofcollective self-defense ifan armed attack occurs against a member." There is a common misconception across the lntelligence Community (IC) to the effect that information trapped within multiple heterogeneous data silos can be semantically integrated by the sorts of meaning-blind statistical methods employed in much of artificial intelligence (Al) and natural language processlng (NLP). This leads to the misconception that incoming data can be analysed coherently by relying exclusively on the use of statistical algorithms and thus without any shared framework for classifying what the data are about. Unfortunately, such (...) approaches do not yield sustainable results where we are dealing with widely distributed, highly heterogeneous and often changing bodies of data. We argue here that the needed integration requires the use of what we call an lntegrating Semantic Framework (ISF), which provldes a consistent set of categories and relationships that can be reused over and over again to tag successive bodies of data in ways which foster more coherent representation and reasoning. The article examines the key conclusions and recommendations to candidate countries and potential candidates for accession, set out by the European Commission in the annual Communication on the EU enlargement policy in 2022. For better understanding of the essence of the Commission’s Communication, this article the author analyses the realities faced by the EU with the beginning of the Russian Federation’s full-scale war against Ukraine. According to scholars and experts, the war changed Europe more profoundly than any event since (...) the end of the Cold War. It is found that the war clearly emphasized the attractiveness of EU membership and strengthened its transformative power, which was formed thanks to the values, diversity of the societies of the Member States, fundamental freedoms and way of life of the Union. In this context, one can agree with the statement of scholars that the real challenges that the EU cannot avoid if it wants to become more authoritative and strategically autonomous are the strengthening, not the weakening of the European level (institutional and legal systems, common EU policies) under a strict democratic control. The analysis of the conclusions and recommendations in the Commission’s Communication allowed us to conclude that after the Russian invasion of Ukraine, the policy of EU enlargement was returned to the forefront of the EU’s agenda. Evidence of this was, firstly, granting the status of a candidate for accession to Ukraine and Moldova and a potential candidate – to Georgia, and, secondly, a joint search by the EU and its Member States for ways to activate and speed up the process of European integration of the countries of the Western Balkans region. In addition, it should be noted that the cross-cutting themes of the Commission’s conclusions and recommendations are EU security and energy policy, key areas of the Green Course, in particular decarbonization of the economy, as well as the issue of recovery after the COVID-19 pandemic. A separate emphasis in the Commission’s Communication is placed on the reforms continued by the countries of the Western Balkans, which are necessary to fulfill the accession criteria. (shrink)

This article offers an integrated account of two strands of global health justice: health-related human rights and health-related common goods. After sketching a general understanding of the nature of human rights, it proceeds to explain both how individual human rights are to be individuated and the content of their associated obligations specified. With respect to both issues, the human right to health is taken as the primary illustration. It is argued that the individuation of the right to health is (...) fixed by reference to the subject matter of its corresponding obligations, and not by the interests it serves, and the specification of the content of that right must be properly responsive to thresholds of possibility and burden. The article concludes by insisting that human rights cannot constitute the whole of global health justice and that, in addition, other considerations—including the promotion of health-related global public goods—should also shape such policy. Moreover, the relationship between human rights and common goods should not be conceived as mutually exclusive. On the contrary, there sometimes exists an individual right to some aspect of a common good, including a right to benefit from health-related common goods such as programmes for securing herd immunity from diphtheria. A medical information commons is a networked data environment utilized for research and clinical applications. At three deliberations across the U.S., we engaged 75 adults in two-day facilitated discussions on the ethical and social issues inherent to sharing data with an MIC. Deliberants made recommendations regarding opt-in consent, transparent data policies, public representation on MIC governing boards, and strict data security and privacy protection. Community engagement is critical to earning the public's trust.

How do we know when we are investing wisely in security? Answering this question requires investigating what things are worth securing (and why); what threatens them; how best to protect them; and how to think about it. Is it possible to protect them? How best go about protecting them? What trade-offs are involved in allocating resources to security problems? This book responds to these questions by stripping down our preconceptions and rebuilding an understanding of security from the (...) ground up on the basis of a common-sense ontology and an explicit theory of value. It argues for a clear distinction between objective and subjective security threats, a non-anthropocentric understanding of security, and a particular hierarchy of security referents, looking closely at four in particular-the ecosphere, the state, culture, and individual human beings. The analysis will be of interest not only to students and scholars of International Relations, but also to practitioners. David A. A broad range of intellectual perspectives may be brought to bear on any important social institution. To this general rule, the institution of private property is no exception. The desirability of private property has been endlessly debated across the disciplines: philosophical, historical, economic, and legal. Yet there is very little consensus over its proper social role and limitations. Is it possible to find a unique solution to questions of property and private ownership, good for all resources and for all times? (...) The famous defense of private property that is found in chapter 5 of John Locke'sSecond Treatise of Governmentanswers this question in the affirmative, for Locke writes as though all property was given to mankind in common, and then seeks to find the quickest and most expeditious way to convert all common property into private property. His implicit, but undefended, assumption is that common forms of property are both undesirable and unstable, while private forms of ownership are always just the opposite. Yet his preferred method for moving from a commons to a regime of private property—the unilateral decision to appropriate by each actor—is one that has been frequently condemned as a sop to unbridled egotism, even though it is subject to two constraints: the first against waste, and the second requiring the appropria-tor to leave “enough, and as good” for others. The post 9/11 environment has been characterized by domestic policy actors being incorporated into a globalizing defense industrial sector through the concept of civil-military integration. From administration to administration, the push for increased civil-military integration has spread beyond its original boundaries and has reached the frontlines of the American military. This begs the question, can the market-driven logic of the commercial sector be integrated into the objectives and values of the noncivilian, military sector? More precisely, is civil-military integration the (...) appropriate solution to the post 9/11 strategic shift? The purpose of this study is not to address the detailed merits or limitations of the increased reliance on private contractors. Rather, this study’s primary focus is to examine the policies that set into motion and continue to promote the cornerstone of civil-military integration: strategic outsourcing. This study argues that in today’s threat environment, the extent of civil-military integration poses unique challenges for U.S. strategic policy. With contactors on the battlefield, basic doctrinal issues emerge. The most basic of these is the notion that in a war zone military members are asked to risk their lives for their country. But, while people are willing to risk their lives for their country, they may not be willing to risk their lives for their company. (shrink)

This thesis examines the key moral principles that should govern decision-making by police and military when using lethal force. To this end, it provides an ethical analysis of the following question: Under what circumstances, if any, is it morally justified for the agents of state-sanctioned security institutions to use lethal force, in particular the police and the military? Recent literature in this area suggests that modern conflicts involve new and unique features that render conventional ways of thinking about the (...) ethics of armed conflict, and the use of lethal force, as inadequate or redundant. In particular, there is an increased concern with the moral difficulties created by “non-standard” cases. This is where the police or military are obliged to operate outside their conventional contexts. In such non-standard cases, on what moral basis can (or should) state actors – especially the police and military – use lethal force? One approach argues that there is nothing morally exceptional about the use of lethal force by police or military. This says the only available moral justification for using lethal force is killing in self-defence or defence of others. In contrast, I use an institutional approach to develop a moral framework for the state’s morally exceptional use of lethal force. The institutional approach is concerned with the ends (telos) or purpose of a social institution. It says that the moral purpose of a social institution alters the moral responsibilities of its agents; what is referred to as role morality. My analysis demonstrates that there is an important moral distinction between justified killing in self-defence and state-sanctioned uses of lethal force. My claim is that police and military uses of lethal force are not morally justified in the same way as the average person’s use of lethal force (i.e. self-defence or defence of others). Instead, I argue that the state-sanctioned institutional role of police and military give these state actors special moral duties, and therefore exceptional moral justification, for using lethal force. I argue that the institutional end of the police is the preservation of public safety. This includes using lethal force where it is necessary to protect life and prevent serious injury to jurisdictional inhabitants. In contrast, a morally responsible state uses military force to defend the “common good.” That is, when it is necessary to defend the peaceful functioning of a state from armed threats or other forms of political violence. I then conclude that non-standard cases require the addition of jus ad vim (or the just use of military force short-of-war) as a hybrid element to the moral framework for the state-sanctioned use of lethal force. This provides a better way of applying ethics to the use of military force when defending the common good against serious threats in non-standard cases. This is because jus ad vim complements the conventional military paradigm by permitting the use of military capabilities to defend the common good. But, at the same time, it inhibits the move towards the more destructive levels of violence characteristic of conventional warfighting. (shrink)

This paper defends the claim that mere temporal proximity always and without exception strengthens certain moral duties, including the duty to save – call this view Robust Temporalism. Although almost all other moral philosophers dismiss Robust Temporalism out of hand, I argue that it is prima facie intuitively plausible, and that it is analogous to a view about special obligations that many philosophers already accept. I also defend Robust Temporalism against several common objections, and I highlight its relevance to (...) a number of practical policy debates, including longtermism. My conclusion is that Robust Temporalism is a moral live option, that deserves to be taken much more seriously in the future. (shrink)

When physicist Alan Sokal recently submitted an article to the postmodernist journal Social Text, the periodical's editors were happy to publish it--for here was a respected scientist offering support for the journal's view that science is a subjective, socially constructed discipline. But as Sokal himself soon revealed in Lingua Franca magazine, the essay was a spectacular hoax--filled with scientific gibberish anyone with a basic knowledge of physics should have caught--and the academic world suddenly awoke to the vast gap that has (...) opened between the scientific community and their mould-be critics. But the truth is that not only postmodern critics but Americans in general have a weak grasp on scientific principles and facts. In Connected Knowledge, physicist Alan Cromer offers a way to bridge the chasm, with a lively, lucid account of scientific thinking and a provocative new agenda for American education. Science, Cromer argues, is anything but common sense: It requires a particular habit of mind that does not come naturally. For example, something as simple as buoyancy can only be explained through Archimedes' principle--that a body in a fluid is subject to an upward force equal to the weight of fluid it displaces--yet few scientists could arrive at this ancient concept by trial and error. School children, however, are often given a ball and a tank of water, and asked to explain buoyancy any way they can. Today's de emphasis on teaching pupils necessary facts and principles, he argues, "far from empowering them, makes them slaves of their own subjective opinions." This movement in education, known as Constructivism, has close ties to postmodern critics (such as the editors of Social Text) who question the objectivity of science, and with it the existence of an objective reality. Cromer offers a ringing defense of the knowability of the world, both as an objective reality and as a finite landscape of discovery. The advance of scientific knowledge, he argues, is not unlike the mapping of the continents; at this point, we have found them all. He shows how the advent of quantum mechanics, rather than making knowledge less certain, actually offers a more precise understanding of the behavior of atoms and electrons. Turning from philosophy to education, he argues that instead of allowing students to flounder, however creatively, schools should follow a progressive curriculum that returns theoretical knowledge to the classroom. Connected Knowledge, however, goes much farther. As a discipline that insists upon connecting theory with measurable reality, physical science offers a new direction for reforming the social sciences. Cromer also shows how some of the hottest issues in public policy--including the debates over special education and group variations in I.Q., can be resolved through clear, hard headed thinking. For example, he argues for use of the G.E.D. as a national educational standard, with a new "politics of intelligence" to guide the distribution of school resources. Steven Landsburg argues that from a legal perspective, “most abortions should be unrestricted.” This conclusion, he claims, follows from combining insights from Judith Jarvis Thomson (1971) with a “careful Rawlsian analysis,” where “Rawlsianism is the industry-standard approach” for settling conflicts like those that arise in debates over abortion policy. If correct, then “the right approach to policy questions” implies that abortion access should remain relatively open. Here, I argue that Landsburg has drawn from Rawlsian tools the wrong conclusion (...) about abortion. I defend what he terms “naive Rawlsian”: the view that as a matter of justice, “many abortions . . . should be prohibited.” If correct, then “the industry-standard approach” for settling conflicts (as Landsburg calls it) should lead society to prohibit abortion in most cases. Proponents of abortion who wish to avoid this outcome, therefore, should abandon the “industry standard” approach to conflict resolution. (shrink)

The Schuman Plan was enthusiastically endorsed by the Benelux countries, France, Germany, and Italy, but the United Kingdom declined to participate, refusing to accept the supranational role of the projected High Authority. The treaty Establishing the European Coal and Steel Community (ECSC) was signed in Paris on 18 April 1951. The European Economic Community (EEC) has provided the core framework for the process of European integration. The Single European Act (SEA) also inserted into the EEC Treaty a number of specific (...) new legal bases for Community action. The treaty provisions were superseded by the Treaty on European Union (TEU), which provides the legal basis for the common foreign and security policy (CFSP). The Reform Treaty was to shed the form, language, and symbols of a European Constitution in favor of having another amending treaty, similar in nature to the SEA, Treaty of Amsterdam (TA), or Treaty of Nice (TN). We develop an anti-commodification defense of ethical veganism which holds that common defenses of ethical veganism can benefit from treating the commodification of non-human animals as a serious, distinct moral wrong. Drawing inspiration from Elizabeth Anderson’s account of commodification, we develop an account of commodification that identifies most uses of animals in developed countries as forms of problematic commodification. We then show that this position can make significant contributions to both welfarist defenses of ethical veganism and animal rights theories.

This is an essay on G. E. Moore’s argument in defense of common sense against David Hume’s theory. However, the burden of essay is to show that, though Moore derived has argument from Thomas Reid, it was the latter who noted that the defense of common sense required more than showing that Hume’s theory conflicted with common sense. It required supplying a better theory than that of Hume’s of the operations of the human mind, and especially, a (...) better theory of the evidence and justification of common sense beliefs. We all live in the age of constitutional balancing.ing away differences of nuance and doctrinal detail, balancing is a common feature of the structure of rights analysis across contemporary constitutional systems. Indeed, abstracting just a little further still, balancing is an inherent part of the near-universal general conception of a constitutional right as an important prima facie claim that nonetheless can in principle be limited or overridden by certain non-constitutional rights premised on conflicting public policy objectives. It is (...) not surprising, then, that a significant literature about balancing has developed at both domestic and comparative levels. What is surprising is that so little of this literature has attempted to present the normative case for constitutional balancing or the general structure of rights analysis of which it is an inherent part. Rather, the existing scholarship has mostly focused on five other tasks: describing and comparing first-order practices of balancing; providing second-order conceptual analyses; explaining balancing's rise to dominance; advancing critiques of balancing; and rebutting these critiques. In this article, I attempt to present one particular normative justification of constitutional balancing; namely a democratic justification. I argue that balancing appropriately bolsters the role of majoritarian decision-making about rights within a system of constitutional democracy. It thereby renders entrenched rights enforced by the power of constitutional or judicial review more consistent with certain enduring democratic concerns. I also explain the implications of this justification for how courts should exercise their powers of review. (shrink)

The article describes the representation of St. Augustine's spirit and theological-historical implications of the law, its positive impact on the legitimization of European identity. Theologian distinguishes three types of law: a temporary, natural and eternal law. The latter is an all-encompassing force that controls all the processes of creation. It is implemented through the story and disclosed in the cognitive capabilities of a person to understand its course. Person of the eternal law is also the Holy Letter. It directs the (...) faithful to the divine essence and enables the implementation of the covenants of Christ - to search for individual mutual society. Realization of the Divine precepts creates two social practices: the legalization of individual and corporate rights of the defense of honor and collective property, as well as claims libertalny principle of law. Natural law comes from the eternal law, and there is a perfect synthesis of normal human relationships and the general laws of nature. Its key provisions are security and the continuation of life of the human race. Precept of natural law is the pursuit of a free implementation of the transcendent and the immanent levels of human existence. And at the same time the desire of people to be a single entity - to reach a general agreement (concordia), the order of love with all the elements of social life. Klyuchnym for achieving concordia is understanding people in the language that gives everyone in the communication process with the "neighbors" to reveal their natural essence and develop common criteria for the fair. Temporary law is a combination of the laws of the state and social control in the form of folk traditions and customs. It forms a unique socio-politic about individual people and determines its development. For Augustine, the temporary law is conscious norm overseas social elements of individual and corporate desires that can destroy people reached concordia. However, Augustine's interpretation of the law did not eliminate the temporary rule of the eternal law in the soul of man - his conscience and the right of free solutions. The human soul is a divine archetype, and therefore the individual acquires the status of an autonomous artist eternal and natural law. Thus, the Augustinian doctrine of the law legitimizes the human right to self-affirmation, the autonomic harmonization of all three levels of law. This aspect of the teaching of St. Augustine become the basis for the approval of the European individualism. (shrink)

Contemporary commentators on the history of ethics have devoted little attention to the ethical theory of Thomas Reid. The main reason for this neglect concerns the perspective from which they are very likely to view his theory. Roughly, this perspective is as follows. Eighteenth century ethics tends to be viewed as consisting mainly in the prolonged dispute concerning the nature of the moral faculty. In identifying Reid’s part in this dispute it should be noted that his Essays on the Active (...) Powers of the Human Mind, his major work on ethics, was published in 1788. It was therefore preceded by the works of such early rational intuitionists as Cudworth, Clarke, Balguy, and Wollaston and by the criticisms directed against them by such defenders of the moral sense position as Shaftesbury, Hutcheson, and Hume. Moreover, it was preceded by the intuitionistic counterattack directed against the latter by Richard Price, a near contemporary of Reid, who has often been described as the greatest of the intuitionists and whose prominence is such that his ethical theory has tended to eclipse that of Reid. The result is that there are in Reid a large number of pages devoted to restatements of an intuitionistic position which a contemporary reader has already encountered in earlier writers and which he is therefore likely to find rather boring. Even those who have maintained correctly that Reid is the founder of the Scottish school of common sense and that his ethical theory is to be seen in the context of his defense of common sense have added little to this perspective, since, generally speaking, they have found no significant differences between his ethical theory as seen in this context and intuitionism. Viewed from this perspective, Reid’s ethics might well be deserving of neglect and of the comment made by Alasdair MacIntyre that “the successors of Hume and Adam Smith in Scottish philosophy have little to say to us. Thomas Reid was a rationalist in the spirit of Price.”. (shrink)

In the article the author analyzes the phenomenon of ideological work from the socio-philosophical point of view and conducts general conceptualization of ideological work process in the Armed Forces of Ukraine. The author proposes his own variant of definition of object, functions, the main tasks of ideological work in the Ukrainian army. The main goal of ideological work in the Armed Forces of Ukraine is to achieve and maintain high morale of the Armed Forces personnel, to train in military servicemen (...) the sense of personal responsibility for protection of Motherland, to understand the principles of state policy and measures taken in the interest of ensuring national and international security. The above goal is achieved through realization of the objective function, which lies in the ideological motivation of military servicemen towards conscientious performance of military duty and defense of the homeland, implemented under the formula "knowledge - attitude - motivation." After decomposition of the objective function of ideological work in the Armed Forces of Ukraine, the author has singled out a number of working functions - genetic, epistemological, logical, methodological, methodical, informational, propagandistic, agitational, worldview, regulatory, mobilizational, educational, counter propagandistic, protective, cultural educational, spiritually educational, evaluative ones. The author has defined situations in which genetic function of ideological work in the Armed Forces can be noticeably manifested: the formation of a qualitatively new principles of state construction in the context of social transformation; formation of a qualitatively new principles of military construction and military-political course of the state in the context of military and political changes in the international arena, as well as in the middle of military- political alliances; in the period of preparation for the war, during the direct military operations, in the postwar period with the aim of establishing of "victory image" and "victorious war image " in the media and in the public consciousness. Understanding the clinical significance of variants associated with hereditary cancer risk requires access to a pooled data resource or network of resources—a “cancer gene variant commons”—incorporating representative, well-characterized genetic data, metadata, and, for some purposes, pathways to case-level data. Several initiatives have invested significant resources into collecting and sharing cancer gene variant data, but further progress hinges on identifying and addressing unresolved policy issues. This commentary provides insights from a modified policy Delphi process involving experts from a range (...) of stakeholder groups involved in the data-sharing ecosystem. In particular, we describe policy issues and options generated by Delphi participants in five domains critical to the development of an effective cancer gene variant commons: incentives, financial sustainability, privacy and security, equity, and data quality. Our intention is to stimulate wider discussion and lay a foundation for further work evaluating policy options more in-depth and mapping them to those who have the power to bring about change. Addressing issues in these five domains will contribute to a cancer gene variant commons that supports better care for at-risk and affected patients, empowers patient communities, and advances research on hereditary cancers. This article asks whether a country that suffers from serious environmental problems caused by another country could have a just cause for a defensive war? Danish philosopher Kasper Lippert-Rasmussen has argued that under certain conditions extreme poverty may give a just cause for a country to defensive war, if that poverty is caused by other countries. This raises the question whether the victims of environmental damages could also have a similar right to self-defense. Although the article concerns justice of war, (...) we will concentrate only on the issue of what can be just causes of war, instead of evaluating the entire justification of war. This is to say that we will limit our discussion to the question concerning just cause and leave aside more general questions concerning justness and moral permissibility of war. Our aim is to list the questions that must be made and settled if defensive war in the case of serious environmental problems is said to have (or not to have) a just cause. We will argue that there are three questions that are most important in this context. They are the question concerning liability, the question of collective responsibility, and the question whether environmental harms may create a “sufficient reason” for raising a war. (shrink)

What role does ‘ordinary language philosophy’ play in the defense of common sense beliefs? J.L. Austin and Ludwig Wittgenstein each give central place to ordinary language in their responses to skeptical challenges to common sense beliefs. But Austin and Wittgenstein do not always respond to such challenges in the same way, and their working methods are different. In this paper, I compare Austin’s and Wittgenstein’s metaphilosophical positions, and show that they share many metaphilosophical commitments. I then examine Austin (...) and Wittgenstein’s respective takes on the problem of other minds and the problem of our knowledge of the external world. Interestingly, we find Wittgenstein employing methods more frequently associated Austin and vice versa. Moreover, we find that a variety of defenses of common sense beliefs are compatible with ‘ordinary language philosophy.’. (shrink)

President Barack Obama should strive to realize the ideal goals expressed in the UN Charter. Accordingly, the concept of U.S. foreign policy should be replaced by a concept of UN global policy. Relatedly, the traditional concept of national security should be replaced by a cosmopolitan concept of global state and human security. Topics discussed include the role of the Security Council, the responsibility to protect (R2P), just war principles, UN peacekeeping operations, genocide in Darfur, treaties (...) and other sources of international law, nuclear abolition, climate change, the role of diplomacy, and the common good. Freezing is a common sign of panic, a response to accidents or events that overflow our capacity to react. Just as all civil airspace was cleared after the 9/11 attacks, the US-Canada border was also frozen, causing economic slowdowns. Border policies are caught between these two panics: security failures and economic crisis. To escape this paradox, American and Canadian authorities have implemented a series of security measures to make the border ‘smarter’, notably the implementation of biometric identity (...) documents and surveillance by UAV Predator drones. Psychoanalytic theory can help us explain why the Canadian and American governments have invested so much money for so little evident or measurable increase in either security or economic flows. The article uses the notion of phantastic objects to explain these (over-)reactions to risk management at the US-Canada border. (shrink)

The unfinished nature of Beauchamp and Childress’s account of the common morality after 34 years and seven editions raises questions about what is lacking, specifically in the way they carry out their project, more generally in the presuppositions of the classical liberal tradition on which they rely. Their wide-ranging review of ethical theories has not provided a method by which to move beyond a hypothetical approach to justification or, on a practical level regarding values conflict, beyond a questionable appeal (...) to consensus. My major purpose in this paper is to introduce the thought of Bernard Lonergan as offering a way toward such a methodological breakthrough. In the first section, I consider Beauchamp and Childress’s defense of their theory of the common morality. In the second, I relate a persisting vacillation in their argument regarding the relative importance of reason and experience to a similar tension in classical liberal theory. In the third, I consider aspects of Lonergan’s generalized empirical method as a way to address problems that surface in the first two sections of the paper: (1) the structural relation of reason and experience in human action; and (2) the importance of theory for practice in terms of what Lonergan calls “common sense” and “general bias.”. Artificial Intelligence (AI) seems to be impacting all industry sectors, while becoming a motor for innovation. The diffusion of AI from the civilian sector to the defense sector, and AI’s dual-use potential has drawn attention from security and ethics scholars. With the publication of the ethical guideline Trustworthy AI by the European Union (EU), normative questions on the application of AI have been further evaluated. In order to draw conclusions on Trustworthy AI as a point of reference for responsible (...) research and development (R&D), we approach the diffusion of AI across both civilian and military spheres in the EU. We capture the extent of technological diffusion and derive European and German patent citation networks. Both networks indicate a low degree of diffusion of AI between civilian and defense sectors. A qualitative investigation of project descriptions of a research institute’s work in both civilian and military fields shows that military AI applications stress accuracy or robustness, while civilian AI reflects a focus on human-centric values. Our work represents a first approach by linking processes of technology diffusion with normative evaluations of R&D. (shrink)

Food security brings a number of benefits to humanity from which nobody can be excluded and which can be simultaneously enjoyed by all. An economic understanding of the concept sees food security qualify as a global public good. However, there are four other ways of understanding a public good which are worthy of attention. A normative public good is a good from which nobody ought to be excluded. Alternatively, one might acknowledge the benevolent character of a public good. (...) Others have argued that public goods demand being public in the sense of being visible to all. Finally, it has also been argued that public goods are those goods which need joint action to be produced and maintained. This chapter discusses these five understandings of the public good in relation to food security and highlights the advantage of assessing policies from each of these perspectives. (shrink)

What kind of role, if any, can immigration policies play in moving us towards global justice? On one view, the removal of restrictions on immigration might seem to constitute great progress in realizing the desired goal. After all, people want to emigrate mainly because they perceive that their prospects for better lives are more likely to be secured elsewhere. If we remove restrictions on their ability to travel, would this not constitute an advance over the status quo in which people (...) are significantly prevented, through tough immigration restrictions, from seeking a better life for themselves and their dependants? In particular, it might seem that a cosmopolitan must be committed to reducing restrictions on immigration. On one common account of what cosmopolitanism is, the central idea is that every person has global stature as the ultimate unit of moral concern and is therefore entitled to equal respect and consideration no matter what her citizenship status or other affiliations happen to be. It is frequently supposed that a cosmopolitan must be committed to more open borders, and that developed countries restricting entry to people from developing countries is unjust and inconsistent with a commitment to our equal moral worth. However, as I argue, removing restrictions on immigration could constitute a considerable step backward for global justice. In order to appreciate why this is the case, we need to review some relevant empirical evidence that our policy recommendations must take into account. As we see, considerable benefits accrue to the immigrant and host nation, but significant costs must often be born in states of origin. As one example, we consider the effects of remittances often believed to be highly beneficial to the global poor. I discuss evidence indicating that patterns associated with remittances are not always at all desirable. Migration policies need to be better managed so that they do benefit the relevant stakeholders. In section 4 I give examples of how this might work. In section 5 we investigate what kinds of policy recommendations would be best given our findings. (shrink)

In many countries and resource sectors, the state is devolving responsibility for natural resource management responsibility to ``communities'' or local user groups. However, both policymakers and researchers in this area have tended to ignore the implications of gender and other forms of intra-community power differences for the effectiveness and equity of natural resource management. In the irrigation sector, despite the rhetoric on women's participation, a review of evidence from South Asia shows that organizations often exclude women through formal or informal (...) membership rules and practices. Women may have other ways to obtain irrigation services, but even if they are effective, these other informal ways of obtaining irrigation services are typically less secure. As resource management – and rights to resources – are transferred from the state to local organizations, ensuring women's participation is essential for gender equity in control over resources. Greater involvement of women can also strengthen the effectiveness of local organizations by improving women's compliance with rules and maintenance contributions. Further detailed and comparative research is required to identify the major factors that affect women's participation and control over resources, if devolution policies are to be both equitable and sustainable. In the aftermath of the 1930s Great Depression, and as the Second World War was drawing to a close, Karl Polanyi concluded a critical analysis of market capitalism on an optimistic — and with the benefit of hindsight we can add premature — note, remarking that the ‘primacy of society’ over the economic system had been ‘secured’. Eighty years later, amidst the unresolved turmoil of another comparable global capitalist economic crisis and accumulating signs of a growing environmental crisis, both a (...) direct legacy of the operation of the ‘market economy’, the remedy advocated by governments and policy-makers is effectively a return to ‘business as usual’. Notwithstanding various manifestations of public expression of dissatisfaction with the consequences of global ‘free-market’ capitalism, which include increasing inequality, poverty, unemployment, depletion of scarce natural resources, environmental destruction, pollution and waste, the default policy setting remains to restore global economic growth, to generate further increases in production and cultivate ever-rising rates of consumption, even if the risk is ‘common ruin’. However, there are a number of realistic, progressive and radical alternatives proposed by critical analysts, including a political program for ‘de-growth’, a reinvention of communism and detailed policy proposals outlining the measures necessary to promote a transition to a ‘post-capitalist’ society with a sustainable economy.
