This paper interrogates the relation between reciprocity and ethics as it concerns participation in the world of work and organizations. Tracing discussions of business and organizational ethics that concern themselves, respectively, with the ethics of self-interest, the ethics of reciprocity, and the ethics of generosity, we explore the possibility of ethical relations with those who are seen as radically different, and who are divested of anything worth exchanging. To address this we provide a reading of Franz Kafka’s famous novella The (...) Metamorphosis and relate to it as a means to extend our understanding of business and organizational ethics. This story, we demonstrate, yields insight into the unbearable demands of ethics as they relate to reciprocity and generosity. On this basis, we draw conclusions concerning the mutually constitutive ethical limitations of reciprocity and generosity as ethical touchstones for organizational life while simultaneously accepting the seemingly insurmountable difficulties of exceeding those limits. In such a condition, we argue, ethics is not best served by adopting idealistic or moralizing positions regarding generosity but rather by working in the indissoluble tensions between self and other. La objeción más común en contra de los derechos sociales constitucionales sostiene que estos son derechos prestacionales y que la constitución está destinada a proteger solo los derechos de no interferencia. En este trabajo muestro que la tesis anterior es disputable y ofrezco argumentos que desde la tradición liberal permiten defender la constitucionalización de los derechos sociales. En términos (...) generales, los argumentos presentados giran en tornos a dos ideas matrices del pensamiento de Rawls vinculadas a su concepción de los ciudadanos como personas que deberían gozar de autonomía, así como a su concepción de sociedad. En términos particulares el trabajo presenta una lectura sistemática de los dos principios de la justicia y un análisis de las nociones de sociedad como sistema de mutua cooperación, así como de las ideas de autorrespeto y poderes morales. Abstract Social rights have been considered positive rights that do not require them to be part of the constitution. The most common objection against constitutional social rights holds that social rights are welfare rights and that, by nature, the Constitution should protect only rights of non-interference. In this paper, I show that the previous thesis is debatable, and I offer a liberal argument to defend the constitutionalisation of social rights. In general terms, the arguments presented rest on two main ideas of Rawls's thought linked to his conception of citizens as autonomous persons, as well as to his conception of society. In particular, the paper proposes a systematic understanding of the two principles of justice and an analysis of the notions of society as a system of mutual cooperation, as well as the ideas of self-respect and moral powers. In this article I examine the importance of self-respect in the justification of Rawls’s theory of justice. First, I present two elements that are part of the contemporary debate on self-respect as a form of self-worth—namely, moral status and merit. Second, I specify the bases that support self-respect within A Theory of Justice. Finally, I discuss at length the function of self-respect in justifying the principles of justice. This inquiry implies an analysis of the relationship between self-respect and the component (...) parts of the two principles of justice: basic liberties, fair equality of opportunity, and the difference principle. I also explore the connection between self-respect and the sense of justice in light of the stability argument, and how the relationship between the two is important for achieving social stability. In this paper, I discuss the relevance of the sense of justice for Rawls’s theory of justice. In the first part, I analyse the interpretation that Rawls offered of moral psychology for evaluating its role in the generation of the sense of justice and the acceptance of the principles of Justice. In the second part, I discuss the difficulties of accepting Rawls's proposal. Finally, I conclude that the research on moral psychology developed by Rawls allows him to recognise a way (...) of supporting his principles of justice that is different from the traditional forms of deductive justification. Theories of discourse bring to realism new ideas about how knowledge develops and how representations of reality are influenced. We gain an understanding of the conceptual aspect of social life and the processes by which meaning is produced. This collection reflects the growing interest realist critics have shown towards forms of discourse theory and deconstruction. The diverse range of contributions address such issues as the work of Derrida and deconstruction, discourse theory, Eurocentrism and poststructuralism. What unites all of the contributions (...) is a sense that it is essential to provide a realist alternative to the hitherto dominance of social constructionism, hermeneutics and postmodernism, over many of the issues discussed. By developing a realist perspective the different authors attempt to embed discourse within the structured nature of the reality of the world. Realism can situate language, discourse and ideology within context specific, or 'causally efficacious' circumstances. Realism can help to uncover issues of power, representation, and subjectivity and how discursive and other social practices produce real effects. This can help us understand the manner in which social structures are reproduced through various forms of ideology and discourse. And by knowing this, we can start to address questions concerning human emancipation and how the world is to be transformed. (shrink)

Este artículo aborda la crítica que Rawls presentó al utilitarismo en el marco de la discusión sobre el fundamento moral de los principios de justicia que deben organizar una sociedad democrática. Se muestra que el principio de utilidad carece de las constricciones morales necesarias para garantizar tanto un efectivo reconocimiento entre las personas, así como una equitativa distribución de las bases sociales del autorrespeto. Se presentan los argumentos de Rawls en contra del utilitarismo clásico en dos grupos: primero aquellos que (...) son independientes de la dimensión contractual de su teoría, luego aquellos que son fruto de la posición original y el velo de la ignorancia. Se concluye que dada la relevancia que tiene el reconocimiento recíproco y el autorrespeto para el establecimiento de una sociedad justa dentro del proyecto rawlsiano, el principio de utilidad no puede ofrecerse como una alternativa aceptable para la organización de las principales instituciones sociales. This article addresses Rawls´s critique of utilitarianism in the framework of the discussion on the moral foundation of the principles of justice. It is shown the principle of utility lacks the necessary moral constraints that ensure both effective recognition among people and a fair distribution of the social bases of self-respect. Rawls's arguments against classical utilitarianism fall into two groups: first those who are independent of the contractual dimension of his theory, then those that are the result of the original position and the veil of ignorance. It is concluded that, given the relevance of the mutual recognition and self-respect for the establishment of a just society, the principle of utility cannot be a moral alternative for the organisation of the main social institutions. Permissivism says that for some propositions and bodies of evidence, there is more than one rationally permissible doxastic attitude that can be taken towards that proposition given the evidence. Some critics of this view argue that it condones, as rationally acceptable, sets of attitudes that manifest an untenable kind of arbitrariness. I begin by providing a new and more detailed explication of what this alleged arbitrariness consists in. I then explain why Miriam Schoenfield’s prima facie promising attempt to answer the (...) Arbitrariness Objection, by appealing to the role of epistemic standards in rational belief formation, fails to resolve the problem. Schoenfield’s strategy is, however, a useful one, and I go on to explain how an alternative form of the standards-based approach to Permissivism – one that emphasizes the significance of the relationship between people’s cognitive abilities and the epistemic standards that they employ – can respond to the arbitrariness objection. In his influential article ‘Essence and Modality’, Fine proposes a definition of necessity in terms of the primitive essentialist notion ‘true in virtue of the nature of’. Fine’s proposal is suggestive, but it admits of different interpretations, leaving it unsettled what the precise formulation of an Essentialist definition of necessity should be. In this paper, four different versions of the definition are discussed: a singular, a plural reading, and an existential variant of Fine’s original suggestion and an alternative version proposed (...) by Correia which is not based on Fine’s primitive essentialist notion. The first main point of the paper is that the singular reading is untenable. The second that given plausible background assumptions, the remaining three definitions are extensionally equivalent. The third is that, this equivalence notwithstanding, Essentialists should adopt Correia’s version of the definition, since both the existential variant, which has de facto been adopted as the standard version of the definition in the literature, and the plural reading suffer from problems connected to Fine’s primitive essentialist notion. Epistemic Sentimentalism is the view that emotional experiences such as fear and guilt are a source of immediate justification for evaluative beliefs. For example, guilt can sometimes immediately justify a subject’s belief that they have done something wrong. In this paper I focus on a family of objections to Epistemic Sentimentalism that all take as a premise the claim that emotions possess a normative property that is apparently antithetical to it: epistemic reason-responsiveness, i.e., emotions have evidential bases and justifications can (...) be demanded of them. I respond to these objections whilst granting that emotions are reason-responsive. This is not only dialectically significant vis-à-vis the prospects for Epistemic Sentimentalism, but also supports a broader claim about the compatibility of a mental item’s being reason-responsive and its being a generative source of epistemic justification. This paper concerns the applications of two-dimensional modal semantics to the explanation of the contents of speech and thought. Different interpretations and applications of the apparatus are contrasted. First, it is argued that David Kaplan's two-dimensional semantics for indexical expressions is different from the use that I made of a formally similar framework to represent the role of contingent information in the determination of what is said. But the two applications are complementary rather than conflicting. Second, my interpretation of the (...) apparatus is contrasted with that of David Chalmers, Frank Jackson, and David Lewis. Curiously, while the efficacy of the arts for the development of multicultural understandings has long been theorized, empirical studies of this effect have been lacking. This essay recounts our combined empirical and philosophical study of this issue. We explicate the philosophical considerations that shaped the development of the arts course we studied, which was grounded in rather traditional humanist educational thought, informed by Deweyan considerations for pedagogy and multiculturalism. We also provide an overview of the course and of the study (...) design: the ways in which the course worked to teach aesthetic theory through a combination of popular and canonical works, and the ways in which it sought to instill a sense of cross-cultural appreciation and solidarity among students through the inclusion of art from different cultures and generations. We then share our research findings and our return to the realm of philosophy to interpret them. Our postcolonial analysis incorporates emerging discussions of the arts as a tool for resistance and dialogue within the system of public education, and revisit and reconsider the very concept of education for pluralistic democracy. This approach problematizes traditional conceptions of pluralism, in which an attempt is made to dissolve difference in a common understanding, and instead advocates that works from among the contemporary popular arts and works drawn from the artistic “canon” alike must be considered and employed for their instrumental value to the educational process—especially for their ability to prompt an intersubjectivity that is accompanied by a heightened awareness of difference. This paper examines two recent contributions to the hate speech literature – by Steven Heyman and Jeremy Waldron – which seek a justification for the legal restriction of hate speech in an account of the way that hate speech infringes against people’s dignity. These analyses look beyond the first-order hurts and disadvantages suffered by the immediate targets of hate speech, and consider the prospect of hate speech sustaining complex social structures whose wide-scale operations lower the social status of members of (...) targeted groups. In Heyman’s and Waldron’s accounts we find plausible insights into the nature of identity-based social hierarchies, and the harms that redound to subordinated people under the operations of such hierarchies. I argue, however, that both analyses are unsuccessful as justifications for the restriction of hate speech, because they do not ultimately provide reason to think that hate speech is responsible for creating or sustaining identity-based social hierarchies. What, if anything, do we epistemically owe to each other? Various “traditional” views of epistemology might hold either that we don’t epistemically owe anything to each other, because “what we owe to each other” is the realm of the moral, or that what we epistemically owe to each other is just to be epistemically responsible agents. Basu (2019) has recently argued, against such views, that morality makes extra-epistemic demands upon what we should believe about one another. And in fact, Basu argues, sometimes those moral demands require us to believe in ways that cut against orthodox epistemic norms. This paper has three aims. First, to offer two strategies for accommodating the kinds of cases Basu discusses while nonetheless holding that only epistemic normativity makes demands on belief. Second, to offer an alternative account of what we owe to each other that does not hold that morality demands that we sometimes believe against our evidence or in violation of epistemic norms. And third, to give a brief diagnosis of why it seems intuitive that morality makes extra-epistemic doxastic demands on us. Ultimately, I argue that what we epistemically owe to each other does not require us to violate orthodox, invariantist epistemic norms. Morality demands that we have a proper regard for others, not that we sometimes believe against our evidence. (shrink)

A framework for pragmatic analysis is proposed which treats discourse as a game, with context as a scoreboard organized around the questions under discussion by the interlocutors. The framework is intended to be coordinated with a dynamic compositional semantics. Accordingly, the context of utterance is modeled as a tuple of different types of information, and the questions therein — modeled, as is usual in formal semantics, as alternative sets of propositions — constrain the felicitous flow of discourse. A requirement of (...) Relevance is satisfied by an utterance (whether an assertion, a question or a suggestion) iff it addresses the question under discussion. Finally, it is argued that the prosodic focus of an utterance canonically serves to reflect the question under discussion (at least in English), placing additional constraints on felicity in context. We make the case that the Prisoner’s Dilemma, notwithstanding its fame and the quantity of intellectual resources devoted to it, has largely failed to explain any phenomena of social scientific or biological interest. In the heart of the paper we examine in detail a famous purported example of Prisoner’s Dilemma empirical success, namely Axelrod’s analysis of WWI trench warfare, and argue that this success is greatly overstated. Further, we explain why this negative verdict is likely true generally and not just (...) in our case study. We also address some possible defenses of the Prisoner’s Dilemma. (shrink)

Exponents and critics of semantic presupposition have almost invariably based their discussion on the ('Standard') definition of presupposition implied by Frege and Strawson. In this study Noel Burton-Roberts argues convincingly against this definition, that leads it to a three-valued semantics. He presents a very simple semantic definition which is weaker, more general and leads to a semantics more easily interpreted as two-valued with gaps. The author shows that a wide range of intuitive facts that eluded the Standard definition follow directly (...) from this ('Revised') definition itself: facts about the presuppositions of compound sentences and modal sentences, about presuppositional conflict and about differences in the logical status of simple sentences suffering from presupposition failure. The book includes a detailed argument that an ambiguity of natural language negation, generally assumed to be necessary to the defence of semantic presupposition, is neither possible nor necessary in a presuppositional semantics. Noel Burton-Roberts has made an authoritative contribution to a debate which has involved philosophers and linguists for many years. His command of the issues, his clarity of exposition and his theoretical insight may well serve to change the boundaries of that debate. (shrink)
