The parents of Charlie Gard, who was born August 4, 2016, with an exceedingly rare and incurable disease called mitochondrial DNA depletion syndrome, fought a prolonged and heated legal battle to allow him access to experimental treatment that they hoped would prolong his life and to prevent his doctors from withdrawing life-sustaining care. Charlie's clinicians at the Great Ormond Street Hospital in London believed that the brain damage Charlie had suffered as a result of frequent epileptic seizures, along with many (...) other severe disabilities, would render any innovative therapy futile, and they disagreed with his parents’ wishes to use an experimental therapy. They felt it in Charlie's best interest that he be allowed to die. A battle ensued among Charlie's parents, his doctors, and a guardian who had been appointed to represent him that drew the attention of politicians and prominent persons from all over the world. As more young people feel safe to outwardly identify as transgender or gender expansive (TGE), meaning that their gender identity does not align with the sex they were assigned at birth, an increasing number of youth who identify as TGE seek gender-affirming medical care (GAMC). GAMC raises a number of ethical questions, such as the capacity of a minor to assent or consent, the role of parents or legal guardians in decisions about treatment, and implications for equitable access to care (...) when differing parental or custodial viewpoints are present. These questions are further complicated by the difficulties in explaining the limits of long-term research in GAMC, with regard to the preservation of fertility, for example. We present two de-identified composite case studies to highlight dilemmas that may arise and offer recommendations to better support patient- and family-centered decision making for GAMC. These include employing a multidisciplinUniverary shared decision-making approach, disentangling informed consent and assent from chronological age, developing a consistent approach to the assessment of decisional capacity, and developing age-appropriate informational materials. Recent political turmoil has focused international attention on Egypt, yet there is little awareness of the country’s stateless populations—those who lack legal nationality to any state—or the challenges they face. Individuals in situations of protracted statelessness are denied their right to a nationality, resulting in an array of additional rights violations. Such violations include denied freedom of movement, equality before the law, and access to economic and social rights. Drawing from two years’ of fieldwork data, this study highlights the plight (...) of those who are unable to achieve legal status in a country with harsh punishments for illegal presence, entry, and exit. It also evaluates potential solutions for eliminating statelessness in Egypt and protecting the rights of stateless populations. As Egypt seeks to move beyond revolution, it is vital that the government addresses the pervasive and systemic inequalities that deny individuals their right to a nationality. (shrink)

Evolving practice requires peer review of clinical ethics (CE) consultation for quality assessment and improvement. Many institutions have identified the chart note as the basis for this process, but to our knowledge, electronic health record (EHR) systems are not necessarily designed to easily include CE consultation notes. This article provides a framework for the inclusion of CE consultation notes into the formal EHR, describing a developed system in the Epic EHR that allows for the elaborated electronic notation of the CE (...) chart note. The implementation of the “meaningful use” criteria for EHR, mandated by the Health Information Technology for Economic and Clinical Health (HITECH) Act of 2009, requires that health professionals meet certain standards for quality, efficiency, and safety, all of which overlap with the goals of standardization, peer review, and quality improvement within CE consultation. Hegel introduced the Phenomenology of Mind as a work on the problem of knowledge. In the first chapter, entitled “Sense Certainty, or the This and Meaning,” he concluded that knowledge cannot consist of an immediate awareness of particulars ). The tradition discusses sense certainty in terms of this failure of immediate knowledge without, however, specifically addressing the problem of reference. Yet reference is distinct from knowledge in the sense that while there can be no knowledge of objects without reference, there (...) may be reference without knowledge. If that is the case, then the failure of immediate knowledge does not entitle us to conclude anything about the success or failure of reference. The moral/conventional task has been widely used to study the emergence of moral understanding in children and to explore the deficits in moral understanding in clinical populations. Previous studies have indicated that moral transgressions, particularly those in which a victim is harmed, evoke a signature pattern of responses in the moral/conventional task: they are judged to be serious, generalizable and not authority dependent. Moreover, this signature pattern is held to be pan‐cultural and to emerge early in development. However, almost all (...) the evidence for these claims comes from studies using harmful transgressions of the sort that primary school children might commit in the schoolyard. In a study conducted on the Internet, we used a much wider range of harm transgressions, and found that they do not evoke the signature pattern of responses found in studies using only schoolyard transgressions. Paralleling other recent work, our study provides preliminary grounds for skepticism regarding many conclusions drawn from earlier research using the moral/conventional task. (shrink)

Knowledge closure is the claim that, if an agent S knows P, recognizes that P implies Q, and believes Q because it is implied by P, then S knows Q. Closure is a pivotal epistemological principle that is widely endorsed by contemporary epistemologists. Against Knowledge Closure is the first book-length treatment of the issue and the most sustained argument for closure failure to date. Unlike most prior arguments for closure failure, Marc Alspector-Kelly's critique of closure does not presuppose any (...) particular epistemological theory; his argument is, instead, intuitively compelling and applicable to a wide variety of epistemological views. Epistemic luck has been the focus of much discussion recently. Perhaps the most general knowledge-precluding type is veritic luck, where a belief is true but might easily have been false. Veritic luck has two sources, and so eliminating it requires two distinct conditions for a theory of knowledge. I argue that, when one sets out those conditions properly, a solution to the generality problem for reliabilism emerges.

Purpose– The purpose of this paper is to present a novel mnemonic, ACTIVE, inspired by Mason's 1985 PAPA mnemonic, which will help researchers and IT professionals develop an understanding of the major issues in information ethics.Design/methodology/approach– Theoretical foundations are developed for each element of the mnemonic by reference to philosophical definitions of the terms used and to virtue ethics, particularly MacIntyrean virtue ethics. The paper starts with a critique of the elements of the PAPA mnemonic and then proceeds to develop (...) an understanding of each of the elements of ACTIVE ethics, via a discussion of the underpinning virtue ethics.Findings– This paper identifies six issues, described by the mnemonic, ACTIVE. ACTIVE stands for: autonomy, the ability of the individual to manage their own information and make choice; community, the ethical effect of an information systems on the community which it supports; transparency, the extent to which the derivation of content and process in an information system is made clear; identity, the social and ethical effect of an information system on the definition and maintenance of the distinctive characteristics of a person; value, the value or moral worth placed on information associated with an individual and hence on the relationship with the individual; and empathy, the ability of the information systems professional to emotionally connect with the user and the extent to which the information system distances or connects.Originality/value– The paper applies virtue ethics to developing a tool to help information professionals reflect on their ethical practice in developing and supporting information systems. Four experiments were conducted to evaluate explanations of picture superiority effects previously found for several tasks. In a process dissociation procedure with word stem completion, picture fragment completion, and category production tasks, conscious and automatic memory processes were compared for studied pictures and words with an independent retrieval model and a generate-source model. The predictions of a transfer appropriate processing account of picture superiority were tested and validated in “process pure” latent measures of conscious and unconscious, or automatic and source, (...) memory processes. Results from both model fits verified that pictures had a conceptual processing advantage over words for all tasks. The effects of perceptual compatibility depended on task type, with pictorial tasks favoring pictures and linguistic tasks favoring words. Results show support for an explanation of the picture superiority effect that involves an interaction of encoding and retrieval processes. (shrink)

Clinical ethics consultants (CECs) are not moral authorities. Standardization of CECs’ professional role does not confer upon them moral authority. Certification of particular CECs does not confer upon them moral authority (nor does it reflect such authority). Or, so we will argue. This article offers a distinctly Orthodox Christian response to those who claim that CECs—or any other academically trained bioethicist—retain moral authority (i.e., an authority to know and recommend the right course of action). This article proceeds in three parts. (...) First, we discuss recent movements toward the certification of CECs in the United States, focusing primarily on proposals and programs put forth by the American Society for Humanities and Bioethics (ASBH). Second, we outline two secular reasons to be concerned about the relevant trends toward certification. For one thing, certification is currently being advanced via political dominance, rather than gaining authority by reliance on rigorous philosophical argument or reason. For another, the trends operate on the assumption that there exists a secular, content-full, canonical, morality. There is no such morality. Next, we argue that Orthodox Christians should resist the current trends toward certification of CECs. Specifically, we unpack ways in which the ASBH’s certification program (and those like it) conflict with Orthodox claims about moral authority and the moral life more generally. This collection of thirteen new essays constitutes a state-of-the-art discussion of this important principle. The author, a philosopher, is sometimes in worried denial that Stevens is an "anti-realist" (...) or a "transcendental realist," and one occasionally senses that in the ancient tension between philosophy and poetry, herding the poets into the philosopher's pen is a bullying way to resolve the conflict. But the book isn't a catastrophe at all; it's a lucid, ruminative, and personable reading of Stevens (and Malick) that even offers a good general guide to the reading of poetry in what Critchley calls "the wake of romanticism" (motto: "God is dead; therefore I am").Critchley's major idea is twofold: that poetry is a therapeutic art form because it slows us down and encourages, about countless subjects, "the whole voluptuousness of looking"; and that Stevens's poetry is informed by a contest between a poetry of "supreme fictions" (in which phenomena come under the [End Page 503] dominion of a potent imagination) and a poetry of "antipodes" (in which phenomena resist the imagination—they "merely are"—and thus reduce the imagination to impotence). Here Critchley affirms a usual view of Stevens as a poet of the weather—another way of saying that he is a modernist with strong roots in the Romantic movement—and he notes that the supreme fiction poems often tend to be set in summer, when the imagination seems especially yeasty, while the antipodean poems tend to be set in winter, when the miserly realness of things seems to rule the earth. In his sensitive and astute reading, however, Critchley remarks upon something else: that in his late poems Stevens seems more overtly metaphysical (Critchely says Stevens is the most philosophically interesting poet of the twentieth century) and that his later poems are set more and more in the seasons of transition (late autumn/early spring). Late in Stevens's career the battle between supreme fictions and antipodes is therefore played out in the same, often overtly philosophical poems. Here Critchley's commentary is at its most astute. Occasional lovers of Wallace Stevens's poetry will remember why they adore his work, and have a better idea why.However, lest readers get the wrong idea, some careful qualifications about the dialectic between Stevens's summer and winter poems are in order. For one thing, the poems of supreme fictions always leave phenomena with their particularity, their ordinariness, their concreteness. To cite one such poem, "Anecdote of the Jar," although the poet imaginatively places "a jar in Tennessee" that makes "the lovely wilderness / Surround that hill," the wilderness' birds and bushes, even the jar itself, remain birds and bushes and jars ("gray and bare"). Here Critchley reinterprets Samuel Taylor Coleridge's distinction between "fancy" and "imagination." Fancy dreams of what does not exist, while imagination transfigures what does. Stevens's poems of supreme fiction are always imaginative, never fanciful.A second qualification: Critchley argues that for Stevens (as well as for a number of philosophers) human ways of knowing are always informed, sooner or later, by the conceptual imagination. In that sense a rose is never just a rose, although we need not become overly fanciful about what a cigar might be. And this leads us to a third one: When readers get to the wintry, antipodean poems—the poems of "anti-poetry"—they will find Stevens suggesting that the only way to view objects without imagination is to imagine what that would be like. In “Race, Multiculturalism, and Democracy,” Robert Gooding-Williams offers an insight. I argue that potential modes of bold and assertive comportment are conjured when new insurrectionist descriptions are articulated within oppressed populations. Ever since Eve tempted Adam with her apple, women have been regarded as a corrupting and destructive force. The very idea that women can be used as interrogation tools, as evidenced in the infamous Abu Ghraib torture photos, plays on age-old fears of women as sexually threatening weapons, and therefore the literal explosion of women onto the war scene should come as no surprise. From the female soldiers involved in Abu Ghraib to Palestinian women suicide bombers, women and their bodies (...) have become powerful weapons in the Afghanistan and Iraq wars. In _Women as Weapons of War_, Kelly Oliver reveals how the media and the administration frequently use metaphors of weaponry to describe women and female sexuality and forge a deliberate link between notions of vulnerability and images of violence. Focusing specifically on the U.S. campaigns in Afghanistan and Iraq, Oliver analyzes contemporary discourse surrounding women, sex, and gender and the use of women to justify America's decision to go to war. For example, the administration's call to liberate "women of cover," suggesting a woman's right to _bare_ arms is a sign of freedom and progress. Oliver also considers what forms of cultural meaning, or lack of meaning, could cause both the guiltlessness demonstrated by female soldiers at Abu Ghraib and the profound commitment to death made by suicide bombers. She examines the pleasure taken in violence and the passion for death exhibited by these women and what kind of contexts created them. In conclusion, Oliver diagnoses our cultural fascination with sex, violence, and death and its relationship with live news coverage and embedded reporting, which naturalizes horrific events and stymies critical reflection. This book makes a case for the permissibility of reactive blame – the angry, harmful variety. Blame is a thorny philosophical problem, as it is notoriously difficult to specify the conditions under which an agent is deserving of blame, is deserving of blame in the basic sense, and furthermore why this is so. Kelly McCormick argues that sharpening the focus to reactive, angry blame can both show us how best to characterize the problem itself, and suggest a possible solution (...) to it, because even reactive blame is both valuable and deserved in the basic sense. There is strong disagreement about whether indicative conditionals have truth values. In this paper, I present a new argument for the conclusion that indicative conditionals have truth values based on the claim that some true statements entail indicative conditionals. I then address four arguments that conclude that indicative conditionals lack truth values, showing them to be inadequate. Finally, I present further benefits to having a worldly view of conditionals, which supports the assignment of truth values to indicative conditionals. I conclude (...) that certain types of account of indicative conditionals, which have been ignored in the literature partly on the basis of assigning truth values to indicative conditionals, deserve consideration. Jonathan Vogel has recently argued that counterfactual reliabilism cannot account for higher‐level knowledge that one's belief is true, or not false. His particular argument for this claim is straightforward and valid. Interestingly, there is a parallel argument, based on an alternative but plausible reinterpretation of the main premise in Vogel's argument, which squares CR with higher‐level knowledge both that one's belief is true and that one's belief is not false. I argue that, while Vogel's argument reveals the incompatibility of CR (...) and knowledge of certain higher‐level propositions, it does not establish the general claim that CR is incompatible with knowledge that any of one's beliefs is true, or not false.
