Generative AI programs can produce high-quality written and visual content that may be used for good or ill. We argue that a credit–blame asymmetry arises for assigning responsibility for these outputs and discuss urgent ethical and policy implications focused on large-scale language models.

The present volume, _Smart Technologies and Fundamental Rights_, contains fourteen outstanding and challenging articles concerning fundamental rights and Artificial Intelligence at the intersection of law, ethics and smart technologies.

Genomic sequencing (GS) is increasingly used in paediatric medicine to aid in screening, research and treatment. Some health systems are trialling GS as a first-line test in newborn screening programmes. Questions about what to do with genomic data after it has been generated are becoming more pertinent. While other research has outlined the ethical reasons for storing deidentified genomic data to be used in research, the ethical case for storing data for future clinical use has not been explicated. In this (...) paper, we examine the ethical case for storing genomic data with the intention of using it as a lifetime health resource. In this model, genomic data would be stored with the intention of reanalysis at certain points through one’s life. We argue this could benefit individuals and create an important public resource. However, several ethical challenges must first be met to achieve these benefits. We explore issues related to privacy, consent, justice and equality. We conclude by arguing that health systems should be moving towards futures that allow for the sequential interrogation of genomic data throughout the lifespan. (shrink)

The following study will show that although the origins of these two notions of freedom are widely divergent, they are nevertheless similar in terms of the vision they incorporate of a fully emancipated existence. As both Mill and Marx were system builders in true nineteenth century fashion, I situate their conceptions of freedom within their general social sciences (...) and begin by assessing the content of their respective theories of human nature. This assessment reveals the methodological foundations of their systems and the impact they have on their understanding of the formation of human character. It also exposes certain inconsistencies which are later shown to have detrimental effects on their propositions regarding social progress. The second part of the study concentrates on Mill's and Marx's analysis of unfreedom in their own time and their different approaches to the task of securing liberty. It will be suggested that both thinkers compromised their commitment to freedom as self-determination; Mill became increasingly susceptible to elitist institutional arrangements; Marx dismissed too easily consideration of morality and rights. However, it will be proposed that the stronger elements of both views may in fact complement one another. (shrink)

Abstract:This paper considers novel ethical issues pertaining to near-future artificial intelligence (AI) systems that seek to support, maintain, or enhance the capabilities of older adults as they age and experience cognitive decline. In particular, we focus on smart assistants (SAs) that would seek to provide proactive assistance and mediate social interactions between users and other members of their social or support networks. Such systems would potentially have significant utility for users and their caregivers if they could reduce the cognitive (...) load for tasks that help older adults maintain their autonomy and independence. However, proactively supporting even simple tasks, such as providing the user with a summary of a meeting or a conversation, would require a future SA to engage with ethical aspects of human interactions which computational systems currently have difficulty identifying, tracking, and navigating. If SAs fail to perceive ethically relevant aspects of social interactions, the resulting deficit in moral discernment would threaten important aspects of user autonomy and well-being. After describing the dynamic that generates these ethical challenges, we note how simple strategies for prompting user oversight of such systems might also undermine their utility. We conclude by considering how near-future SAs could exacerbate current worries about privacy, commodification of users, trust calibration and injustice. (shrink)

Personal AI assistants are now nearly ubiquitous. Every leading smartphone operating system comes with a personal AI assistant that promises to help you with basic cognitive tasks: searching, planning, messaging, scheduling and so on. Usage of such devices is effectively a form of algorithmic outsourcing: getting a smart algorithm to do something on your behalf. Many have expressed concerns about this algorithmic outsourcing. They claim that it is dehumanising, leads to cognitive degeneration, and robs us of our freedom and (...) autonomy. Some people have a more subtle view, arguing that it is problematic in those cases where its use may degrade important interpersonal virtues. In this article, I assess these objections to the use of AI assistants. I will argue that the ethics of their use is complex. There are no quick fixes or knockdown objections to the practice, but there are some legitimate concerns. By carefully analysing and evaluating the objections that have been lodged to date, we can begin to articulate an ethics of personal AI use that navigates those concerns. In the process, we can locate some paradoxes in our thinking about outsourcing and technological dependence, and we can think more clearly about what it means to live a good life in the age of smart machines. In his defence of the identity theory, Professor Smart has attempted to show that reports of mental states are strictly topic-neutral. If this were the case then it would follow that there is nothing logically wrong with the claim that the mind is the brain or that mental states are really nothing but brain states. Some phillosophers have argued that a fundamental objection to any form of materialism is that the latter makes an obvious logical blunder in identifying the (...) mental with the physical. This is the view that dualism is enshrined in our language. If this is true then of course statements such as ‘the mind is actually nothing but the brain’ and ‘mental states are really nothing but physical processes’ would be quite unacceptable on strictly logical grounds. Smart's claim that talk about mental states is topic-neutral, however, appears to exempt materialism from such objections. The question is, does it? That is to say, are sensation reports and the like topic-neutral in the required sense? Are they analogous in principle to statements of the form ‘someone is in the room’? Smart's point is that expressions such as ‘someone phoned: it was the doctor’ are logically similar to those of the form ‘I am having a red after-image: it is a brain process.’ ‘Someone’ is not logically equivalent to ‘the doctor’ , but it may, of course, be true that the doctor is the someone who phoned. Does this analogy hold and is it correct to say that sensation reports and mentalistic expressions in general are topic-neutral, that they refer only to experienced ‘somethings’? Smart's claim runs as follows: When a person says, ‘I see a yellowish-orange after-image’, he is saying something like this: ‘ There is something going on which is like what is going on when I have my eyes open, am awake, and there is an orange illuminated in good light in front of me, that is, when I really see an orange’. Notice that the italicised words, namely ‘there is something going on which is like what is going on when’, are all quasi logical or topic neutral words. This explains why the ancient Greek peasant's reports about his sensations can be neutral between dualistic metaphysics and my materialistic metaphysics. It explains how sensations can be brain processes and yet how a man who reports them need know nothing about brain processes. For he reports them only very abstractly as ‘something going on which is like what is going on when…’ Similarly, a person may say ‘someone is in the room’, thus reporting truly that the doctor is in the room, even though he has never heard of doctors. We live in a world in which ‘smart’ algorithmic tools are regularly used to structure and control our choice environments. They do so by affecting the options with which we are presented and the choices that we are encouraged or able to make. Many of us make use of these tools in our daily lives, using them to solve personal problems and fulfill goals and ambitions. What consequences does this have for individual autonomy and how should our legal and (...) regulatory systems respond? This chapter defends three claims by way of response. First, it argues that autonomy is indeed under threat in some new and interesting ways. Second, it evaluates and disputes the claim that we shouldn’t overestimate these new threats because the technology is just an old wolf in a new sheep’s clothing. Third, and finally, it looks at responses to these threats at both the individual and societal level and argues that although we shouldn’t encourage an attitude of ‘helplessness’ among the users of algorithmic tools there is an important role for legal and regulatory responses to these threats that go beyond what are currently on offer. A short, smart guide to living the good life through the teachings of Epicurus. As long as there has been human life, we’ve searched for what it means to be happy. As John Sellars shows in this concise, approachable guide, the ideal life envisioned by Epicurus and his followers was a life much more concerned with mental pleasures and the avoidance of pain. Their goal, in short, was a life of tranquility or contentment. In The Pocket Epicurean Sellars walks us through the history of Epicureanism, starting with the private garden on the edge of ancient Athens where Epicurus and his students lived in the fourth century BC, and where women were as welcome as men. Sellars then moves on to ancient Rome, where Epicurean influence flourished thanks to the poet Lucretius and his cohort. Sadler (bio)This issue marks the 30th anniversary of Philosophy, Psychiatry, and Psychology (PPP). All of us at the journal are grateful to our authors, readers, editors, and publishers for enabling this landmark. To commemorate this event, I invited our Founding Editor and Chair of the Advisory Board, K.W.M. "Bill" Fulford to write a brief essay, along with (...) our panel of smart and industrious senior editors. Their instructions were simple: 500 words on PPP past, present, and/or future. These essays appear in the pages to follow. As Editor-in-Chief, I write about PPP's early commitments as a scholarly journal, situate these in the history of academic publishing, and muse over our current moment.Bill Fulford briefly discusses the early years of the journal in his essay. My perspective emerges from an editor's perspective. As co-editors in the early years, Bill and I were committed to an international authorship with comparable editorial oversight. We wanted to build a journal that would equally recognize clinical science and practice and philosophy, maintaining the rigor of each field. We saw philosophers and mental health practitioners as equal partners, collaborators, innovators, and educators. More important, PPP was intended to offer up the best criticism of the mental health and related fields.The scattershot history of scholarly editing has identified several functions of the editor over the centuries following Gutenberg's invention of the printing press in the mid-1440s. The earliest editors took liberties with the language of the Bible, trying to make it more accessible to the public; the printing press permitted fast and inexpensive reproduction. Not surprisingly, this popularizing of the Bible led to praise as well as outrage. The printing of other scholarly works followed quickly. In 1470, only about 25 years after the invention of the printing press, Niccolo Perroni called for Pope Paul II to censor Andrea Bussi's edition of Pliny the Elder's Natural History, an anthology of then-ancient writings about the natural world. This marked the first recorded instance of censorship of a more-or-less secular scholarly work (Monfasani, 1988). In the ensuing centuries, "editors" initially were the popularizers, and later the gatekeepers of texts worth (and not worth) reading. In the [End Page 1] ensuing centuries into the present, editors have been venerated both as defenders of good reading and reviled as censors or intellectual selfaggrandizers.The current moment, in my view, represents a crisis in the history of editing and editorship. Digital communications have liberated communications worldwide. However, this liberty has come at the cost of colossal amounts of material not worth reading and an explosion of divisive, destructive discourse. Even worse, internet "trolls" on social media have moved bullying out of the schoolyard and into international cyberspace. Determining what is worth reading has moved away from a cluster of (hopefully) responsible editors to anyone who wants to go to the small effort of silencing others through online harassment and even violent threats. Such cyberbullying does not eliminate elitism, but instead substitutes a toxic online "elite" without principle other than self-promotion and the alienation of others. Our contemporary online culture has yet to figure out how to shape what is, and is not, worth reading.My wish and intent for the future of PPP is to maintain and grow our place of rational, deliberative, and open discourse, even in the face of such disruptive cultural change.John Z. Most people are aware of the health benefits of being physically active. The question arises then why people so easily fall into sedentary habits. The idea developed here is that sedentary behavior is part of a suite of behaviors to reduce levels of physical activity that were strongly selected in the evolutionary past, likely because high levels of physical activity had direct negative consequences for survival. However, hunter‐gatherer populations could not reduce activity indefinitely because of the need to be active (...) to hunt for, and gather food. Hence they never experienced low levels of activity that are damaging to health, and no corresponding mechanism avoiding low activity evolved. Consequently, gene variants promoting efficiency of activity and increased sedentariness were never selected against. Modern society facilitates reduced activity by providing many options to become less active and divorcing food intake from the need to be active. Choosing the less active option is hard wired in the genes; this explains why being sedentary is so common, and why reversing it is so difficult. Incentivizing activity may be enabled using modern technology, but ultimately may only end up replacing one set of health issues with others. English critics were brilliant initiators and exploiters of biblical criticism. This momentous exercise, whereby the 'Holy Scriptures' became the object of human critique independent of church control, is illustrated by John Drury in the present volume with excerpts from such famous critics as Coleridge, Blake and Matthew Arnold, and lesser names such as Collins and Deist and Bishop Sherlock. Robert Lowth's famous lectures on the Psalms, which had an important influence on Blake and Christopher Smart, are well represented (...) here, as is the famous contribution to Essays and Reviews by Benjamin Jowett. This book provides the only available collection of biblical criticism from this important period of critical enquiry, the eighteenth and nineteenth centuries. The extracts are accompanied by a full editorial introduction, notes and a bibliography. They should be read by all students of literature and theology interested in the period. (shrink)

In the first post World War II identity theories (e.g., Place 1956, Smart 1962), mind brain identities were held to be contingent. However, in work beginning in the late 1960's, Saul Kripke (1971, 1980) convinced the philosophical community that true identity statements involving names and natural kind terms are necessarily true and furthermore, that many such necessary identities can only be known a posteriori. Kripke also offered an explanation of the a posteriori nature of ordinary theoretical identities such as (...) that water = H2O. We identify the kinds and substances involved in theoretical identities by certain of their contingent properties. What we discover when we discover a theoretical identity is the underlying nature of the kind that we identify by those contingent properties. Now, of course, it was being a posteriori, not being contingent, that mattered to the identity theorists anyway, so the necessity of identity is not, in itself, damaging to mind brain identity theories. However, Kripke also argued persuasively that the alleged mind brain identities could not be treated in the same way as ordinary theoretical identities. We "identify" pain by feeling it, and surely how it feels is an essential property of pain, not a contingent property. Thus, a mind body identity theory must provide a different explanation of why its identities are a posteriori. A new wave of materialists has appeared on the scene with a new strategy for explaining [1] the a posteriori nature of its alleged identities. The strategy is to locate the explanation for the a posteriori nature of mind body identities, not on the side of the world, but on the side of the mind -in different ways of thinking about or imagining, or in different concepts. Thus, on this new view, there is only one property—this brain process type, which is identical with this pain.. (shrink)

I hope to demonstrate that the papers which Feyerabend wrote between 1955 and the mid-1960's can most profitably be understood as a contribution to this project. The first three chapters lay the groundwork of Feyerabend's (...) earlier epistemology. They pick out the themes in his model for the acquisition of 'knowledge'. Chapter One sets out Feyerabend's rather unorthodox conception of scientific or theoretical realism, which has not received the attention which I believe it deserves. I detail Feyerabend's objections to some anti-realist positions and outline the formidable structure of his central argument for realism. Over the last fifteen years, communication has become pictorial in a manner that it never was before. Billions of people have smart phones that enable them to take, edit, and share pictures easily whenever they choose to do so. This has created expressive niches within which new activities, with their own norms, continue to develop. Ready availability of these pictorial modes of communication, we claim, not only constitutes a change in the range of our communicative practices, but also changes (...) the world about which we communicate. Increasingly, we are making a world that’s worth depicting, using the tools we now possess. This paper will unpack one example of this phenomenon, trompe l’oeil street art. More and more of this seems to be produced with the intention that it is seen primarily in pictures. It makes sense that anything someone makes, and wants to be seen, would be made with decent photography potential in mind. You want photos to be able to, as they say, do justice to your work no matter what kind of visual work you make. In these cases, however, the pictures of the work are reliably more interesting than the pieces seen in the flesh. (shrink)

In this paper I examine the ethics of street photography. I firstly discuss the close-up ‘in-your-face’ style street photography made famous by American photographer, Bruce Gilden. In close-up street photography, the proximity of the camera to the subject and the element of surprise work in tandem to produce a striking and evocative picture. Close-up street photography is shown to be ethically contentious on wellbeing-related and autonomy-related grounds. I next examine the more orthodox ‘respectable distance’ kind of street photography. In orthodox (...) street photography, the photographer positions the camera some distance away from a nonconsenting subject that may or may not be aware a picture is to be taken. The main ethical problem with this form of street photography relates to the subject’s vanity and sense of self. When street photographers produce and publish images without the consent of subjects, they express their own creative freedom at the expense of the subject’s right to editorial control. I discuss the scope and potentially demanding practical implications of a right to editorial control. To conclude, I offer a workable solution to the ethical dilemma facing street photographers and discuss the implications of smart phones and photo-sharing social media platforms. (shrink)

The principle unifying this valuable collection of essays, all previously published, is that properly to understand Descartes’s philosophical project we must place his work in its historical context. The collection opens, accordingly, with the essay, “Does History Have a Future?”, in which Garber contrasts his context-sensitive approach to the history of philosophy with another that looks to history as a storehouse of possible truth. Though he does not deny the interest of this latter, comparatively ahistorical approach, he argues that a (...) precipitate focus on truth tends not only to distort understanding, but to deprive us of what is perhaps more useful and important, namely, new questions. For, Garber reminds us, it is not so much the truth of a past philosopher’s views, much less their falsity that causes us to reflect on our own beliefs, it is the fact that smart people took seriously views often very different from ours. If Australasian philosophers constitute the kind of group to which a collective identity or broadly shared self-image can plausibly be ascribed, the celebrated history of Australian materialism rightly lies close to its heart. Jack Smart’s chapter in this volume, along with an outstanding series of briefer essays in A Companion to Philosophy in Australia and New Zealand (Forrest 2010; Gold 2010; Koksvik 2010; Lycan 2010; Matthews 2010; Nagasawa 2010; Opie 2010; Stoljar 2010a), effectively describe the naturalistic realism of Australian (...) philosophy of mind. In occasional semi-serious psychogeographic speculation, this long-standing and strongly-felt intellectual attitude has been traced back to the influences of our light, land, or lifestyle (Devitt 1996, x; compare comments by Chalmers and O’Brien in Mitchell, 2006). Australasian work in philosophy of mind and cognition has become more diverse in the last 40 years, but is almost all still marked, in one way or another, by the history of these debates on materialism.
