Genetic testing has familial implications. Counsellors find themselves in (moral) conflict between medical confidentiality (towards the patient) and a potential right or even duty to warn at-risk relatives. Legal regulations vary between countries. English literature about German law is scarce. We reviewed the literature of relevant legal cases, focussing on German law, according to the Preferred Reporting Items for Systematic Reviews and Meta-Analyses guidelines. This article aims to familiarise counsellors with their responsibilities, compare the situation between countries and point out (...) legally unresolved areas.According to the German Genetic Diagnostics Act (Gendiagnostikgesetz) in case of an ‘avoidable or treatable’ genetic disorder, geneticists ought to confine themselves to the obligated advice to the patient. Whether a breach of the duty of confidentiality can be justified in exceptional cases by ‘necessity as justification’ for actively informing relatives at risk remains legally unclear. In case of a ‘neither avoidable nor treatable’ genetic disease, geneticists should also refrain from actively informing relatives as the justifiable state of emergency does not permit to break the duty of confidentiality. The Research Domani Criteria framework (RdoC) encourages research on specific impairments present across traditional nosological categories and suggests a list of biological and behavioral measures for assessing them. After a description of RdoC, in this article we focus on impairments of the ability of understanding others, specifically in Theory of Mind and empathy. We illustrate recent evidence on brain anomalies correlating with these deficits in Schizophrenia, Addiction Disorders and Mood Disorders populations. In the last section, we zoom out and consider (...) this kind of research vis-à-vis the objection of being reductionistic that is, in favoring mechanistic accounts of mental disorders. We argue that metaphysical reductionism and explanatory reductionism are not conceptually entailed by the RdoC framework. (shrink)

The critical examination of current hypotheses is one of the key ways in which scientific fields develop and grow. Therefore, any critique, including Haidle and Schlaudt’s article, “Where Does Cumulative Culture Begin? A Plea for a Sociologically Informed Perspective,” represents a welcome addition to the literature. However, critiques must also be evaluated. In their article, Haidle and Schlaudt review some approaches to culture and cumulative culture in both human and nonhuman primates. H&S discuss the “zone of latent solutions” hypothesis as (...) applied to nonhuman primates and stone-toolmaking premodern hominins. Here, we will evaluate whether H&S’s critique addresses its target. (shrink)

Background Retraction is a mechanism for alerting readers to unreliable material and other problems in the published scientific and scholarly record. Retracted publications generally remain visible and searchable, but the intention of retraction is to mark them as “removed” from the citable record of scholarship. However, in practice, some retracted articles continue to be treated by researchers and the public as valid content as they are often unaware of the retraction. Research over the past decade has identified a number of (...) factors contributing to the unintentional spread of retracted research. The goal of the Reducing the Inadvertent Spread of Retracted Science: Shaping a Research and Implementation Agenda (RISRS) project was to develop an actionable agenda for reducing the inadvertent spread of retracted science. This included identifying how retraction status could be more thoroughly disseminated, and determining what actions are feasible and relevant for particular stakeholders who play a role in the distribution of knowledge. -/- Methods These recommendations were developed as part of a year-long process that included a scoping review of empirical literature and successive rounds of stakeholder consultation, culminating in a three-part online workshop that brought together a diverse body of 65 stakeholders in October–November 2020 to engage in collaborative problem solving and dialogue. Stakeholders held roles such as publishers, editors, researchers, librarians, standards developers, funding program officers, and technologists and worked for institutions such as universities, governmental agencies, funding organizations, publishing houses, libraries, standards organizations, and technology providers. Workshop discussions were seeded by materials derived from stakeholder interviews (N = 47) and short original discussion pieces contributed by stakeholders. The online workshop resulted in a set of recommendations to address the complexities of retracted research throughout the scholarly communications ecosystem. -/- Results The RISRS recommendations are: (1) Develop a systematic cross-industry approach to ensure the public availability of consistent, standardized, interoperable, and timely information about retractions; (2) Recommend a taxonomy of retraction categories/classifications and corresponding retraction metadata that can be adopted by all stakeholders; (3) Develop best practices for coordinating the retraction process to enable timely, fair, unbiased outcomes; and (4) Educate stakeholders about pre- and post-publication stewardship, including retraction and correction of the scholarly record. -/- Conclusions Our stakeholder engagement study led to 4 recommendations to address inadvertent citation of retracted research, and formation of a working group to develop the Communication of Retractions, Removals, and Expressions of Concern (CORREC) Recommended Practice. Further work will be needed to determine how well retractions are currently documented, how retraction of code and datasets impacts related publications, and to identify if retraction metadata (fails to) propagate. Outcomes of all this work should lead to ensuring retracted papers are never cited without awareness of the retraction, and that, in public fora outside of science, retracted papers are not treated as valid scientific outputs. Most moral theorists agree that it is one thing to believe that someone has slighted you and another to resent her for the insult; one thing to believe that someone did you a favor and another to feel gratitude toward her for her kindness. While all of these ways of responding to another's conduct are forms of moral appraisal, the reactive attitudes are said to 'go beyond' beliefs in some way. We think this claim is adequately explained only when we (...) take seriously the fact that reactive attitudes are emotions. In this paper, we appeal to insights of the emotions literature to highlight one key way in which reactive attitudes go beyond beliefs: beliefs about a person and her morally significant conduct merely ascribe to the person the property of having performed a morally significant action, while reactive attitudes are ways of experiencing that person as having performed a morally significant action. We then suggest that appreciating this is a crucial first step toward understanding why reactive emotions play roles in our practices around responsibility that beliefs do not. (shrink)

Wicked problems’ are tricky to solve because of their many interconnected components and a lack of any single optimal solution. At the science–policy interface, all problems can look wicked: research exposes the complexity that is relevant to designing, executing and implementing policy fit for ambitious human needs. Expertise in philosophical research can help to navigate that complexity.

Empathy is a term used increasingly both in moral theory and animal ethics. Yet, its precise meaning is often left unexplored. The book aims to tackle this by clarifying the different and even contradictory ways in which “empathy” can be defined.

Empathy has become a common point of debate in moral psychology. Recent developments in psychiatry, neurosciences and social psychology have led to the revival of sentimentalism, and the ‘empathy thesis’ has suggested that affective empathy, in particular, is a necessary criterion of moral agency. The case of psychopaths – individuals incapable of affective empathy and moral agency, yet capable of rationality – has been utilised in support of this case. Critics, however, have been vocal. They have asserted that the case (...) of autism proves the empathy thesis wrong; that psychopathy centres on rational rather than empathic limitations; that empathy is not relevant to many common normative behaviours; and that rationality is required when empathy fails. The present paper analyses these four criticisms. It will be claimed that they each face severe difficulties, and that moral agency ought to be approached via a multi-tier model, with affective empathy as a baseline. (shrink)

John R. Schneider explores the problem that animal suffering, caused by the inherent nature of Darwinian evolution, poses to belief in theism. Examining the aesthetic aspects of this moral problem, Schneider focuses on the three prevailing approaches to it: that the Fall caused animal suffering in nature (Lapsarian Theodicy), that Darwinian evolution was the only way for God to create an acceptably good and valuable world (Only-Way Theodicy), and that evolution is the source of major, God-justifying beauty (Aesthetic (...) Theodicy). He also uses canonical texts and doctrines from Judaism and Christianity - notably the book of Job, and the doctrines of the incarnation, atonement, and resurrection - to build on insights taken from the non-lapsarian alternative approaches. Schneider thus constructs an original, God-justifying account of God and the evolutionary suffering of animals. His book enables readers to see that the Darwinian configuration of animal suffering unveiled by scientists is not as implausible on Christian theism as commonly supposed. (shrink)

This article discusses madness and saintliness in Dostoevsky’s novels and investigates how the madman and the saint discern between good and evil. I first explore the metaphysical, spiritual, and moral universe of Dostoevsky’s characters by drawing on William Desmond’s philosophy of the between. Second, I argue that the madman’s misconstrual of reality can be grasped as an idolatrous, divisive, and parodic imitation of the good. Third, I reflect on disembodied discernment. In some cases, due to the weakness of the moral (...) agent, the good cannot be properly embodied in space and time, even if a person exhibits ethically sound discernment. Fourth, I look at examples of holy discernment and examine how, through love, the genuinely good person is able to transform idolatry into a universal and cosmic sacramentalism. (shrink)

Este capítulo presenta dos versiones de la teoría según la cual deberíamos centrarnos en ciertas acciones realizadas por los artistas para comprender qué tipo de objetos son las obras de arte: la propuesta de Gregory Currie (An Ontology of Art, 1989) y la de David Davies (Art as Performance, 2004). Si bien estas teorías no están exentas de problemas, es cierto que estas proporcionan una guía completa de algunos de los temas en los que uno debería meditar al evaluar y (...) desarrollar teorías sobre qué son las obras de arte. Además, Currie y Davies presentan algunos de los argumentos más refinados contra los puntos de vista contextualistas y estructuralistas sobre la metafísica de las obras de arte, así como contra el empirismo estético. La relación entre maternidad y trabajo ha sido materia de políticas públicas desde comienzos del siglo XX, pero en las últimas décadas ha adquirido nuevas connotaciones por el aumento de la participación laboral femenina. Ello no ha conducido a una eliminación de las discriminaciones que enfrentan las trabajadoras por su condición (real o potencial) de madres, ni a una organización del mercado de trabajo que permita articular demandas laborales y familiares, ni una redistribución del trabajo reproductivo. Para analizar cómo actores (...) involucrados en la formulación de políticas relacionadas con esta temática concebían la relación entre trabajo y maternidad y las tensiones que derivaban de ella, se entrevistó a un grupo de actores sociales provenientes de tres ámbitos. Dos ideas caracterizan sus concepciones: las normas de protección a la maternidad en el trabajo afectan negativamente la empleabilidad femenina y la relación maternidad trabajo es difícil porque la organización del mercado de trabajo dificulta la articulación de responsabilidades laborales y familiares. Respecto de las tensiones, se constataron en diferentes dimensiones: económica, demográfica, ejercicio de derechos y sociocultural. (shrink)

This chapter explores the concept of sedimentation in Hegel’s account of absolute knowledge in the Phenomenology of Spirit drawing on Merleau-Ponty’s 1954–55 course notes on institution and passivity. The chapter first identifies the notion of sedimentation that informs Merleau-Ponty’s reflections on institution. Such a sedimentation involves a non-egoic modality of retention that activates critical thinking. The chapter then explains why absolute knowledge in the Phenomenology of Spirit rests on a process of sedimentation that is very much in line with Merleau-Ponty’s (...) analysis. My argument revolves on the aspects of self-appropriation and ownership that characterize Hegel’s account of absolute spirit, which are integral to a Hegelian-inspired view of ethical memory. The climate crisis is an enormous challenge for contemporary societies. Yet, public discussions on it often lead to anger, mocking, denial and other defensive behaviours, one prominent example of which is the reception met by the climate advocate Greta Thunberg. The paper approaches this curious phenomenon via shame. It argues that the very idea of anthropogenic climate change invites feelings of human failure and thereby may also entice shame. The notion of “climate shame” is introduced and distinguished from “climate guilt”. (...) Whereas climate guilt prioritises the flourishing of the environment and is focused on actions and morality, climate shame is concerned with human identity and selfhood. The paper then explores whether shame is a morally destructive or constructive emotion. Making use of both psychological and philosophical literature on shame, it argues that although shame faces many challenges that question its usefulness in moral pedagogy, these challenges can be met with “moral maturity”—moreover, following a utilitarian approach, the overall benefits of climate shame can justify its costs to individuals. My argument is that climate shame holds the potential of being a highly effective moral psychological method of persuasion, capable of inviting wholesale critical reflection on current, environmentally damaging practices and cultivation of more virtuous ways of co-existing with the rest of the natural world and other species. La metafora del panottico viene oggi spesso invocata per descrivere gli effetti della sorveglianza contemporanea, effettuata con il supporto di tecnologie digitali. L’ubiquità di sistemi di videosorveglianza, di sensori di ogni tipo incorporati nei dispositivi portatili che ci accompagnano nella quotidianità, la continua esposizione telematica necessaria per espletare funzioni essenziali (lavoro, relazioni con le pubbliche amministrazioni, mantenimento di rapporti interpersonali …) creano una costante possibilità di osservazione simile a quella offerta dalla struttura panottica. Questa nuova situazione sembra riprodurre, negli effetti (...) più che nella struttura architettonica, il sistema disciplinare nel panottico. Stiamo quindi scivolando verso una situazione di “panottismo digitale”, in cui ogni nostro comportamento può essere potenzialmente osservato, senza che ci sia data la possibilità di verificare quando e chi ci osservi?
